aforesaid_a by_o the_o space_n of_o one_o whole_a year_n that_o in_o every_o such_o case_n the_o person_n so_o offend_v shall_v for_o every_o such_o offence_n lose_v and_o forfeit_v threescore_o recusant_n whatsoever_o which_o be_v contrary_a to_o the_o express_a word_n of_o the_o statute_n certain_a conviction_n must_v be_v show_v in_o certain_a in_o a_o information_n upon_o this_o statute_n for_o not_o receive_v the_o sacrament_n the_o conviction_n of_o the_o party_n for_o recusancy_n ought_v to_o be_v show_v in_o certain_a before_o who_o in_o what_o court_n etc._n etc._n for_o before_o he_o be_v convict_v of_o recusancy_n he_o be_v not_o liable_a to_o the_o penalty_n inflict_v by_o this_o act_n for_o not_o receive_v and_o yet_o if_o it_o be_v only_o general_o show_v in_o the_o information_n that_o the_o defendant_n be_v convict_v in_o due_a form_n of_o law_n and_o the_o defendant_n do_v not_o demur_v thereto_o but_o plead_v not_o guilty_a and_o it_o be_v find_v against_o he_o there_o judgement_n shall_v not_o be_v stay_v for_o this_o defect_n for_o he_o have_v lose_v his_o advantage_n and_o by_o his_o plea_n have_v admit_v the_o point_n of_o conviction_n and_o at_o the_o trial_n the_o only_a thing_n in_o issue_n be_v whether_o he_o have_v receive_v the_o sacrament_n and_o not_o whether_o he_o be_v convict_v tanfeild_n chief_a baron_n compare_v this_o case_n to_o that_o of_o debt_n upon_o a_o obligation_n and_o in_o the_o declaration_n no_o place_n be_v show_v that_o be_v not_o good_a but_o if_o the_o defendant_n plead_v a_o release_n he_o shall_v never_o afterward_o take_v advantage_n of_o the_o defect_n in_o the_o declaration_n cro._n hill_n 12._o jac._n 365.366_o sivedale_n versus_fw-la sir_n edward_n lenthall_n which_o shall_v hereafter_o conform_v inflict_v by_o this_o act_n although_o he_o never_o go_v before_o the_o ordinary_a ordinary_a ordinary_a cro._n hill_n 12._o jac._n 366._o and_o for_o every_o year_n after_o for_o such_o not_o receive_v threescore_o pound_n note_v the_o statute_n say_v not_o that_o the_o offender_n shall_v forfeit_v for_o the_o first_o second_o and_o three_o offence_n but_o for_o the_o first_o and_o second_o year_n and_o for_o every_o year_n after_o for_o if_o it_o have_v be_v say_v he_o shall_v have_v forfeit_v twenty_o pound_n for_o the_o first_o offence_n forty_o pound_n for_o the_o second_o and_o threescore_o pound_n for_o the_o three_o he_o must_v have_v be_v convict_v and_o have_v have_v judgement_n of_o the_o first_o offence_n before_o he_o can_v have_v incur_v the_o penalty_n for_o what_o he_o do_v the_o first_o or_o second_o year_n after_o his_o conformity_n and_o so_o be_v the_o information_n in_o
be_v a_o popish_a recusant_n convict_v at_o any_o time_n after_o he_o or_o her_o conviction_n shall_v exercise_v any_o public_a office_n or_o charge_n in_o the_o commonwealth_n but_o shall_v be_v utter_o disable_v to_o exercise_v the_o same_o by_o himself_o or_o by_o his_o deputy_n except_o such_o husband_n himself_o and_o his_o child_n which_o shall_v be_v above_o the_o age_n of_o nine_o year_n abide_v with_o he_o and_o his_o servant_n in_o household_n shall_v once_o every_o month_n at_o the_o least_o not_o have_v any_o reasonable_a excuse_n to_o the_o contrary_a repair_v to_o some_o popish_a recusant_n and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o every_o marry_a woman_n be_v or_o that_o shall_v be_v a_o popish_a recusant_n convict_v her_o husband_n not_o stand_v convict_v of_o popish_a recusancy_n which_o shall_v not_o conform_v herself_o and_o remain_v conform_v but_o shall_v forbear_v to_o repair_v to_o some_o church_n or_o usual_a place_n of_o common_a prayer_n and_o there_o to_o hear_v divine_a service_n and_o sermon_n if_o any_o than_o be_v and_o within_o the_o say_a year_n receive_v the_o sacrament_n of_o the_o lord_n supper_n according_a to_o the_o law_n of_o this_o realm_n by_o the_o space_n of_o one_o whole_a year_n next_o before_o the_o death_n of_o her_o say_a husband_n shall_v forfeit_v and_o loose_a to_o the_o king_n majesty_n his_o heir_n and_o successor_n the_o issue_n and_o profit_n of_o two_o part_n of_o her_o jointure_n and_o two_o part_n of_o her_o dower_n in_o three_o part_n to_o be_v divide_v during_o her_o life_n of_o or_o out_o of_o any_o the_o land_n tenement_n or_o hereditament_n which_o be_v or_o be_v she_o say_v husband_n and_o also_o be_v disable_v to_o be_v executrix_n or_o the_o statute_n of_o 27_o h._n 8._o her_o acceptance_n thereof_o shall_v not_o bar_v her_o dower_n but_o she_o shall_v have_v such_o jointure_n and_o her_o dower_n also_o and_o the_o reason_n why_o in_o the_o two_o last_o case_n the_o wife_n shall_v not_o be_v bar_v of_o her_o dower_n although_o there_o be_v a_o estate_n limit_v to_o she_o for_o her_o life_n be_v because_o the_o estate_n be_v not_o in_o its_o first_o creation_n appoint_v to_o take_v immediate_o after_o the_o death_n of_o the_o husband_n and_o no_o matter_n which_o arise_v ex_fw-la post_fw-la facto_fw-la can_v salve_v of_o two_o part_n of_o both_o profit_n of_o what_o land_n she_o shall_v not_o forfeit_v the_o profit_n but_o otherwise_o it_o be_v where_o a_o estate_n be_v give_v or_o limit_v by_o the_o husband_n be_v for_o her_o jointure_n for_o in_o this_o case_n a_o averment_n that_o it_o be_v so_o intend_v will_v not_o serve_v unless_o there_o be_v express_a word_n in_o the_o will_n to_o that_o purpose_n these_o estate_n so_o gain_v by_o the_o wife_n as_o they_o do_v not_o bar_v her_o dower_n out_o of_o the_o residue_n of_o her_o husband_n estate_n but_o that_o she_o shall_v enjoy_v both_o the_o one_o and_o the_o other_o co._n 4._o 4._o so_o they_o be_v not_o within_o the_o meaning_n of_o this_o act_n because_o not_o make_v for_o her_o jointure_n and_o she_o shall_v not_o forfeit_v the_o profit_n her_o husband_n estate_n for_o that_o the_o land_n first_o settle_v on_o she_o be_v not_o for_o her_o whole_a jointure_n co._n 1._o inst_z 35._o co._n 4._o 3._o jointure_n forfeiture_n of_o the_o profit_n of_o part_n of_o her_o jointure_n and_o if_o she_o be_v a_o popish_a recusant_n convict_v and_o her_o husband_n none_o and_o she_o conform_v not_o within_o the_o year_n next_o before_o his_o statute_n of_o 27_o h._n 8._o so_o in_o some_o case_n likewise_o where_o she_o have_v a_o jointure_n pursuant_n to_o that_o statute_n as_o where_o she_o have_v such_o a_o jointure_n make_v to_o she_o by_o the_o husband_n before_o marriage_n and_o he_o afterward_o endow_v her_o ad_fw-la ostium_fw-la ecclesiae_fw-la or_o if_o she_o have_v a_o jointure_n make_v by_o the_o husband_n in_o his_o life_n time_n and_o after_o his_o death_n his_o heir_n or_o feoffee_n assign_v other_o land_n to_o she_o in_o dower_n or_o the_o heir_n plead_v to_o she_o in_o a_o writ_n of_o dower_n ne_fw-la unque_fw-la seisi_fw-la que_fw-la dower_n etc._n etc._n or_o nient_a accouple_v in_o loyal_a matrimony_n or_o any_o other_o plea_n save_o jointure_n in_o bar_n of_o dower_n and_o it_o be_v find_v against_o he_o in_o these_o case_n the_o wife_n shall_v hold_v her_o jointure_n and_o yet_o be_v endow_v and_o if_o she_o be_v a_o offender_n within_o this_o branch_n of_o the_o act_n shall_v forfeit_v the_o profit_n of_o two_o part_n of_o her_o jointure_n and_o dower_n both_o but_o if_o a_o widow_n forfeit_v dower_n not_o forfeit_v who_o be_v endow_v of_o the_o land_n of_o her_o decease_a husband_n take_v a_o second_o husband_n who_o be_v no_o popish_a recusant_n convict_v by_o who_o she_o have_v a_o jointure_n and_o she_o become_v a_o popish_a recusant_n convict_v and_o the_o second_o husband_n die_v and_o the_o wife_n be_v a_o offender_n within_o this_o act_n in_o this_o case_n she_o shall_v not_o by_o force_n thereof_o forfeit_v the_o profit_n of_o two_o part_n of_o such_o dower_n and_o jointure_n both_o but_o only_o of_o her_o jointure_n for_o that_o her_o dower_n be_v not_o out_o of_o the_o land_n of_o her_o say_a husband_n that_o be_v of_o the_o husband_n in_o who_o life_n time_n she_o stand_v convict_v and_o after_o such_o conviction_n forbear_v to_o conform_v etc._n etc._n within_o the_o year_n next_o before_o his_o death_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a person_n stat._n sect._n 12._o a_o popish_a recusant_n shall_v be_v disable_v as_o a_o excommunicate_a person_n that_o every_o popish_a recusant_n which_o be_v or_o shall_v this_o act_n disable_v to_o be_v executor_n for_o although_o the_o name_n of_o a_o executor_n be_v in_o law_n a_o grant_n of_o administration_n and_o if_o a_o man_n by_o his_o last_o will_n grant_v much_o less_o shall_v he_o be_v disable_v to_o be_v executor_n who_o be_v not_o convict_v at_o the_o time_n of_o the_o testator_n death_n although_o he_o be_v convict_v at_o the_o time_n of_o the_o say_a oath_n if_o any_o person_n or_o person_n this_o clause_n be_v general_a and_o extend_v to_o all_o before_o so_o that_o if_o any_o of_o the_o nobility_n commit_v the_o nobility_n may_v be_v commit_v refuse_v this_o oath_n they_o may_v be_v commit_v to_o the_o common_a gaol_n etc._n etc._n by_o such_o as_o be_v by_o this_o act_n authorize_v to_o tender_v it_o co._n 12._o 131._o shall_v refuse_v to_o take_v the_o say_a oath_n due_o tender_v to_o he_o or_o she_o if_o the_o person_n authorize_v to_o tender_a this_o oath_n not_o what_o be_v a_o good_a tender_a what_o not_o ask_v the_o afterward_o unless_o she_o conform_v or_o the_o husband_n pay_v ten_o pound_n per_fw-la month_n or_o yield_v the_o three_o part_n of_o his_o land_n to_o the_o king_n and_o yet_o this_o statute_n do_v not_o after_o such_o conviction_n of_o the_o wife_n in_o a_o popular_a suit_n away_o suit_n upon_o former_a statute_n not_o take_v away_o or_o action_n of_o debt_n etc._n etc._n at_o the_o king_n suit_n take_v away_o the_o popular_a action_n or_o information_n from_o the_o informer_n or_o the_o action_n of_o debt_n etc._n etc._n from_o the_o king_n for_o the_o time_n to_o come_v but_o that_o they_o may_v be_v bring_v against_o the_o husband_n and_o wife_n for_o the_o recusancy_n of_o the_o wife_n for_o any_o month_n or_o month_n wherein_o she_o be_v absent_a from_o church_n after_o such_o conviction_n for_o this_o statute_n and_o 23_o eliz._n 1._o and_o 35_o eliz._n 1._o 1_o stat._n 23_o eliz._n 1_o 35_o eliz._n 1_o be_v all_o affirmative_a law_n and_o may_v well_o stand_v together_o so_o that_o any_o of_o the_o three_o remedy_n give_v by_o these_o statute_n may_v be_v pursue_v this_o statute_n not_o abrogate_a any_o former_a law_n but_o only_o provide_v another_o way_n of_o punishment_n for_o the_o wife_n after_o she_o be_v once_o convict_v howbeit_o she_o shall_v not_o be_v punish_v by_o any_o more_o than_o one_o of_o these_o three_o way_n co._n 11._o 63_o 64._o &_o roll_n 1._o 94._o doctor_n foster_n case_n cro._n pasch_fw-mi 17_o jac._n 529._o parker_n versus_fw-la curson_n and_o therefore_o if_o the_o king_n bring_v a_o action_n of_o debt_n etc._n etc._n upon_o 35_o eliz._n against_o the_o husband_n and_o wife_n imprison_v where_o the_o wife_n shall_v not_o be_v imprison_v or_o the_o informer_n sue_v they_o upon_o 23_o eliz._n for_o any_o absence_n of_o the_o wife_n from_o church_n after_o she_o be_v once_o convict_v by_o either_o of_o those_o way_n and_o recover_v the_o privy_a counsellor_n bishop_n or_o justice_n of_o peace_n here_o mention_v can_v imprison_v she_o by_o force_n of_o this_o act_n for_o the_o nonpayment_n of_o the_o ten_o pound_n per_fw-la month_n by_o the_o husband_n for_o those_o month_n for_o which_o the_o king_n or_o informer_n have_v recover_v or_o for_o his_o not_o yield_v the_o three_o of_o his_o land_n to_o the_o king_n and_o the_o reason_n be_v for_o that_o when_o the_o husband_n stand_v charge_v with_o the_o penalty_n of_o twenty_o pound_n per_fw-la month_n for_o the_o absence_n of_o the_o wife_n the_o intent_n of_o the_o act_n be_v satisfy_v in_o respect_n of_o those_o month_n of_o her_o absence_n for_o which_o he_o stand_v so_o charge_v for_o if_o he_o pay_v not_o the_o twenty_o pound_n per_fw-la month_n so_o recover_v the_o king_n or_o informer_n have_v the_o ordinary_a remedy_n after_o judgement_n by_o process_n of_o capias_fw-la against_o they_o both_o both_o and_o the_o intent_n of_o the_o act_n be_v no_o more_o then_o that_o the_o husband_n shall_v pay_v for_o the_o recusancy_n of_o his_o wife_n or_o the_o wife_n be_v imprison_v and_o if_o in_o this_o case_n the_o privy_a counsellor_n bishop_n or_o justice_n of_o peace_n shall_v have_v power_n to_o imprison_v the_o wife_n unless_o the_o husband_n will_v pay_v ten_o pound_n for_o the_o month_n for_o which_o the_o king_n or_o informer_n have_v recover_v it_o will_v follow_v that_o the_o husband_n have_v his_o election_n whether_o he_o will_v pay_v ten_o pound_n per_fw-la month_n to_o the_o king_n by_o force_n of_o this_o act_n or_o the_o twenty_o pound_n per_fw-la month_n so_o recover_v against_o he_o by_o the_o king_n or_o informer_n for_o he_o shall_v not_o pay_v both_o the_o one_o and_o the_o other_o for_o that_o be_v bis_fw-la puniri_fw-la pro_fw-la uno_fw-la delicto_fw-la and_o if_o he_o shall_v have_v his_o election_n the_o king_n or_o informer_n may_v by_o this_o device_n be_v elude_v of_o the_o penalty_n of_o twenty_o pound_n per_fw-la month_n so_o recover_v which_o can_v not_o be_v the_o intent_n of_o the_o maker_n of_o this_o law_n imprisonment_n the_o king_n and_o informer_n bar_v by_o her_o imprisonment_n but_o if_o the_o wife_n be_v after_o such_o conviction_n imprison_v by_o force_n of_o this_o act_n neither_o the_o king_n or_o informer_n can_v so_o sue_v the_o husband_n and_o wife_n for_o the_o recusancy_n of_o the_o wife_n for_o she_o be_v already_o punish_v by_o this_o act_n and_o must_v remain_v in_o prison_n until_o the_o husband_n pay_v the_o ten_o pound_n for_o every_o month_n or_o yield_v the_o three_o of_o his_o land_n to_o the_o king_n or_o the_o wife_n conform_v three_o or_o if_o the_o husband_n yield_v the_o three_o so_o if_o the_o husband_n yield_v the_o three_o of_o his_o land_n to_o save_v his_o wife_n imprisonment_n he_o be_v already_o punish_v by_o this_o act_n the_o penalty_n to_o the_o king_n by_o 29_o eliz._n 6._o or_o 3_o jac._n 4._o indictment_n conviction_n upon_o indictment_n if_o the_o wife_n be_v convict_v of_o recusancy_n upon_o a_o indictment_n it_o have_v be_v much_o debate_v whether_o that_o do_v not_o so_o appropriate_a the_o
or_o reside_v when_o he_o or_o they_o be_v or_o be_v so_o admit_v or_o place_v within_o the_o city_n of_o london_n or_o westminster_n or_o within_o thirty_o mile_n of_o the_o same_o shall_v take_v the_o say_a oath_n aforesaid_a in_o the_o say_v respective_a court_n or_o court_n aforesaid_a in_o the_o next_o term_n after_o such_o he_o or_o their_o admittance_n or_o admittance_n into_o the_o office_n or_o office_n employment_n or_o employment_n aforesaid_a between_o the_o hour_n aforesaid_a and_o no_o other_o and_o the_o proceed_n to_o cease_v as_o aforesaid_a and_o that_o all_o and_o every_o such_o person_n or_o person_n to_o be_v admit_v after_o the_o say_v first_o day_n of_o easter_n term_n as_o aforesaid_a not_o have_v take_v the_o say_a oath_n in_o the_o court_v aforesaid_a shall_v at_o the_o quarter_n session_n for_o that_o county_n or_o place_n where_o he_o or_o they_o shall_v reside_v next_o after_o such_o his_o admittance_n or_o admittance_n into_o any_o of_o the_o say_v respective_a office_n or_o employment_n aforesaid_a take_v the_o say_v several_a and_o respective_a oath_n as_o aforesaid_a and_o all_o and_o every_o such_o person_n and_o person_n so_o to_o be_v admit_v as_o aforesaid_a shall_v also_o receive_v the_o sacrament_n of_o the_o lord_n supper_n according_a to_o the_o usage_n of_o the_o church_n of_o england_n within_o three_o month_n after_o adjudge_v void_a and_o be_v it_o further_o enact_v that_o all_o and_o every_o such_o person_n or_o person_n that_o shall_v neglect_v or_o refuse_v to_o take_v the_o say_a oath_n or_o the_o sacrament_n of_o the_o say_a session_n in_o every_o quarter_n session_n for_o every_o one_o to_o resort_v to_o and_o look_v upon_o without_o fee_n or_o reward_n and_o likewise_o none_o of_o the_o person_n or_o person_n aforesaid_a shall_v give_v or_o pay_v as_o any_o fee_n or_o reward_n to_o any_o officer_n or_o officer_n belong_v to_o any_o of_o the_o court_n as_o aforesaid_a above_o the_o sum_n of_o
