general_a court_n or_o assembly_n and_o it_o be_v enact_v by_o the_o authority_n of_o the_o same_o that_o henceforth_o no_o dwelling_n house_n slate_n building_n in_o boston_n to_o be_v of_o brick_n or_o stone_n and_o cover_v with_o slate_n shop_n warehouse_n barn_n stable_a or_o any_o other_o house_n of_o more_o than_o eight_o foot_n in_o length_n or_o breadth_n and_o seven_o foot_n in_o height_n shall_v be_v erect_v and_o set_v up_o in_o boston_n but_o of_o stone_n or_o brick_n and_o cover_v with_o slate_n or_o tyle_n unless_o in_o particular_a case_n where_o necessity_n require_v be_v so_o judge_v and_o signify_v in_o write_v under_o the_o hand_n of_o the_o justice_n and_o select-man_n of_o the_o say_a town_n or_o major_a part_n of_o both_o the_o governor_n with_o the_o come_v to_o the_o age_n of_o twenty_o one_o year_n and_o a_o woman_n child_n to_o the_o age_n of_o eighteen_o year_n or_o time_n of_o marriage_n which_o shall_v be_v as_o effectual_a to_o all_o authority_n aforesaid_a that_o every_o person_n and_o person_n except_o as_o in_o this_o act_n be_v before_o except_v be_v due_o choose_v as_o aforesaid_a to_o serve_v in_o the_o office_n of_o constable_n constable_n penalty_n for_o not_o serve_v in_o the_o office_n of_o constable_n who_o shall_v refuse_v to_o take_v the_o oath_n to_o that_o office_n belong_v and_o to_o serve_v therein_o if_o any_o officer_n or_o officer_n his_o or_o their_z under_o officer_n or_o under_o officer_n underkeeper_n or_o under-keeper_n or_o deputy_n fuse_v to_o make_v the_o return_v aforesaid_a or_o to_o bring_v the_o body_n or_o body_n of_o the_o prisoner_n or_o prisoner_n according_a to_o the_o command_n of_o the_o say_v write_v within_o the_o respective_a time_n aforesaid_a or_o upon_o demand_v make_v by_o the_o prisoner_n or_o person_n in_o his_o behalf_n shall_v refuse_v to_o deliver_v or_o within_o the_o space_n of_o six_o hour_n after_o demand_n shall_v not_o deliver_v to_o the_o person_n so_o demand_v a_o true_a copy_n of_o the_o warrant_n or_o warrant_n of_o commitment_n and_o detainer_n of_o such_o prisoner_n which_o he_o &_o they_o be_v hereby_o require_v to_o deliver_v according_o all_z &_o every_o the_o head_n gaoler_n &_o keeper_n of_o such_o prison_n &_o such_o other_o person_n in_o who_o custody_n the_o prisoner_n shall_v be_v detain_v shall_v for_o the_o first_o offence_n forfeit_v to_o the_o prisoner_n or_o party_n grieve_v the_o sum_n of_o fifty_o pound_n &_o for_o the_o second_o offence_n the_o sum_n of_o one_o hundred_o pound_n and_o shall_v and_o be_v hereby_o make_v incapable_a to_o hold_v or_o execute_v his_o say_a office_n the_o say_v penalty_n to_o be_v recover_v by_o the_o prisoner_n or_o party_n grieve_v his_o executor_n or_o administrator_n against_o such_o offender_n his_o executor_n or_o administrator_n by_o any_o action_n of_o debt_n suit_n bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n wherein_o no_o essoign_n protection_n privilege_n injunction_n wager_n of_o law_n or_o stay_v of_o prosecution_n by_o non_fw-la vult_fw-la ulterius_fw-la prosequi_fw-la or_o otherwise_o shall_v be_v admit_v or_o allow_v and_o any_o
