constitute_v and_o establish_v a_o judicature_n and_o they_o or_o any_o two_o of_o they_o be_v hereby_o authorize_v to_o hear_v adjudge_v and_o determine_v such_o controversy_n and_o difference_n county_n of_o wilts_n and_o southampton_n from_o the_o town_n of_o christ-church_n in_o the_o say_a county_n of_o southampton_n to_o the_o city_n of_o new-sarum_n in_o the_o say_a county_n of_o wilt_n and_o if_o need_v require_v the_o make_n of_o a_o new_a haven_n may_v with_o god_n blessing_n be_v of_o great_a advantage_n and_o benefit_n not_o only_o to_o the_o say_a county_n but_o also_o to_o the_o public_a by_o import_n and_o export_n of_o commodity_n and_o increase_v of_o commerce_n and_o trade_n and_o of_o able_a seaman_n and_o waterman_n and_o most_o profitable_a and_o necessary_a for_o the_o say_a city_n of_o new-sarum_n for_o the_o conveyance_n thereby_o of_o fuel_n and_o other_o necessary_n to_o the_o say_a city_n whereof_o there_o be_v now_o great_a scarcity_n and_o far_o great_a be_v like_a to_o grow_v if_o some_o help_n therefore_o be_v not_o provide_v beside_o the_o extraordinary_a preservation_n of_o the_o highway_n in_o and_o near_o the_o say_a city_n and_o county_n navigable_a commissioner_n how_o to_o be_v appoint_v for_o make_v the_o river_n avon_n navigable_a be_v it_o therefore_o enact_v by_o the_o king_n majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o lord_n chancellor_n or_o lord_n keeper_n of_o the_o great_a seal_n of_o england_n for_o the_o time_n be_v at_o any_o time_n after_o the_o end_n of_o this_o present_a session_n of_o parliament_n shall_v and_o may_v nominate_v appoint_v and_o authorise_v by_o commission_n under_o the_o great_a seal_n of_o england_n such_o person_n or_o person_n body_n politic_a and_o corporate_a as_o to_o he_o shall_v seem_v fit_a and_o be_v willing_a to_o undertake_v the_o make_n navigable_a the_o say_a river_n of_o avon_n from_o the_o say_a town_n of_o christ-church_n to_o the_o say_a city_n of_o new-sarum_n and_o to_o make_v a_o new_a haven_n if_o need_v require_v for_o ship_n and_o vessel_n near_o the_o say_a town_n of_o christ-church_n which_o say_v undertaker_n so_o nominate_v and_o appoint_v as_o aforesaid_a be_v hereby_o authorize_v and_o shall_v have_v full_a power_n and_o authority_n by_o this_o present_a act_n to_o make_v navigable_a or_o passable_a by_o barge_n boat_n lighter_n or_o other_o vessel_n the_o say_a river_n of_o avon_n from_o the_o say_a town_n of_o christ-church_n to_o the_o city_n of_o new-sarum_n aforesaid_a and_o for_o that_o purpose_n to_o cleanse_v scour_v and_o open_v the_o same_o and_o to_o cut_v or_o dig_v the_o bank_n of_o the_o same_o and_o to_o take_v away_o or_o remove_v all_o wear_v or_o other_o impediment_n that_o may_v hinder_v navigation_n either_o in_o sail_v or_o hale_v of_o boat_n with_o horse_n man_n or_o otherwise_o to_o amend_v or_o alter_v such_o bridge_n and_o highway_n as_o may_v hinder_v the_o say_v passage_n and_o navigation_n and_o to_o open_v prepare_v and_o make_v all_o wear_v sass_n lock_n and_o turn-pike_n fit_a for_o the_o say_a passage_n and_o likewise_o to_o cleanse_v scour_v open_a or_o cut_v and_o dig_v the_o bank_n of_o any_o other_o stream_n brook_n ditch_n or_o watercourse_n that_o shall_v to_o they_o seem_v convenient_a for_o the_o better_a make_v the_o say_a river_n navigable_a and_o passable_a for_o boat_n barge_n lighter_n and_o other_o vessel_n and_o likewise_o to_o make_v and_o erect_v any_o wharf_n sass_n lock_n turnpike_n or_o pen_n for_o water_n in_o or_o near_o the_o say_a river_n or_o passage_n that_o shall_v be_v fit_a or_o necessary_a for_o the_o same_o and_o to_o bring_v lay_v and_o work_v all_o material_n requisite_a for_o the_o make_n erect_v and_o repair_v of_o the_o say_a lock_n or_o turnpike_n upon_o the_o say_a river_n or_o passage_n and_o to_o cut_v such_o and_o so_o many_o new_a channel_n and_o trench_n as_o to_o they_o shall_v seem_v convenient_a for_o alter_v the_o course_n of_o the_o say_a river_n of_o avon_n in_o bring_v the_o same_o to_o the_o city_n of_o new-sarum_n as_o aforesaid_a as_o also_o for_o the_o bring_n in_o any_o other_o river_n or_o watercourse_n into_o the_o say_a river_n and_o to_o do_v all_o other_o thing_n necessary_a and_o convenient_a for_o the_o say_a river_n and_o passage_n new_a channel_n wharf_n sass_n lock_n wear_v turnpike_n penn_n for_o water_n and_o the_o say_a bridge_n way_n and_o passage_n and_o for_o the_o alter_n repair_a keep_v use_v and_o amend_v of_o the_o same_o or_o any_o of_o they_o or_o any_o part_n of_o they_o from_o time_n to_o time_n hereafter_o as_o oft_o as_o need_v shall_v require_v and_o also_o if_o need_v require_v to_o make_v a_o commodious_a haven_n and_o port_n near_o the_o say_a town_n of_o christ-church_n for_o the_o entry_n
the_o trust_n their_o heir_n and_o assign_v in_o such_o manner_n and_o wise_a as_o be_v herein_o after_o more_o particular_o and_o especial_o limit_v and_o provide_v and_o according_a to_o such_o part_n and_o proportion_n as_o they_o respective_o now_o hold_v and_o enjoy_v or_o by_o virtue_n and_o provision_n of_o this_o act_n ought_v to_o hold_v and_o enjoy_v subject_n and_o liable_a likewise_o to_o the_o payment_n of_o all_o tax_n and_o charge_n as_o aforesaid_a to_o be_v hold_v of_o the_o king_n majesty_n his_o heir_n and_o successor_n of_o the_o manor_n of_o east_n greenwich_n by_o fealty_n only_o in_o free_a and_o common_a soccage_n and_o not_o otherwise_o and_o the_o say_v ten_o thousand_o acre_n residue_n of_o the_o say_v twelve_o thousand_o acre_n whereof_o his_o say_a enforce_v the_o say_a earl_n his_o participant_n and_o adventurer_n commissioner_n and_o country_n to_o very_o great_a trouble_n loss_n and_o expense_n both_o of_o money_n and_o time_n for_o avoid_v say_a governor_n bailiff_n and_o conservator_n of_o the_o say_a corporation_n for_o the_o time_n be_v or_o any_o five_o or_o more_o of_o they_o whereof_o the_o say_a governor_n or_o bailiff_n for_o the_o time_n be_v or_o their_o successor_n or_o any_o of_o they_o to_o be_v two_o for_o maintenance_n and_o preservation_n of_o the_o say_v great_a level_n by_o convenient_a outfall_n to_o the_o sea_n shall_v for_o ever_o hereafter_o be_v and_o be_v hereby_o make_v and_o constitute_v commissioner_n of_o sewer_n for_o and_o of_o the_o say_v great_a level_n of_o the_o fen_n and_o the_o say_a hereby_o enable_v and_o empower_v from_o henceforth_o to_o use_v and_o exercise_v the_o power_n and_o authority_n of_o commissioner_n of_o sewer_n within_o the_o say_v great_a level_n of_o the_o fen_n and_o of_o the_o work_v make_v or_o to_o be_v make_v without_o the_o say_v great_a level_n for_o convey_v of_o the_o water_n of_o the_o say_v great_a level_n by_o convenient_a outfall_n to_o the_o sea_n touch_v all_o matter_n and_o thing_n whatsoever_o happen_v to_o be_v execute_v or_o do_v within_o the_o say_v great_a level_n or_o the_o say_a work_n without_o the_o say_v great_a level_n itself_o and_o the_o say_a governor_n bailiff_n and_o conservator_n or_o any_o five_o or_o more_o of_o they_o whereof_o the_o say_a governor_n or_o bailiff_n or_o any_o of_o they_o to_o be_v two_o shall_v have_v further_a power_n as_o well_o for_o the_o maintenance_n of_o the_o say_v great_a level_n as_o for_o lay_v and_o levy_v of_o tax_n upon_o the_o say_v ninety_o five_o thousand_o acre_n to_o use_v and_o exercise_v within_o the_o say_v great_a level_n such_o and_o the_o like_a law_n and_o custom_n and_o constitute_v and_o appoint_v such_o and_o the_o like_a officer_n from_o time_n to_o time_n as_o be_v or_o lawful_o may_v be_v use_v in_o rumney_n marsh_n in_o the_o county_n of_o kent_n they_o who_o exercise_v the_o say_a power_n of_o commissioner_n of_o sewer_n first_o take_v administer_v from_o time_n to_o time_n without_o any_o further_a commission_n and_o because_o the_o metes_n and_o boundary_n of_o the_o say_a ground_n within_o the_o say_v great_a level_n as_o to_o the_o county_n and_o parish_n be_v very_o uncertain_a and_o hard_a to_o be_v distinguish_v ground_n the_o mete_n &_o boundary_n of_o ground_n be_v it_o therefore_o further_o enact_v that_o every_o writ_n bill_n plaint_n count_n declaration_n information_n presentment_n and_o indictment_n of_o for_o or_o concern_v the_o say_a ground_n within_o the_o say_v great_a level_n of_o the_o fen_n or_o any_o part_n or_o parcel_n of_o the_o same_o or_o any_o trespass_n offence_n or_o wrong_n do_v act_v or_o commit_v within_o the_o say_v great_a level_n and_o proceed_n thereupon_o shall_v be_v good_a and_o sufficient_a in_o law_n though_o the_o county_n parish_n town_n or_o place_n or_o any_o of_o they_o in_o such_o writ_n bill_n plaint_n count_n declaration_n information_n presentment_n or_o indictment_n be_v not_o right_o name_v so_o as_o there_o be_v such_o other_o certainty_n or_o description_n of_o the_o place_n whereby_o the_o same_o be_v or_o may_v be_v common_o know_v level_n no_o great_a level_n or_o with_o any_o the_o work_v make_v or_o to_o be_v make_v for_o support_n maintenance_n or_o preservation_n of_o the_o say_v great_a level_n within_o or_o without_o the_o say_v great_a level_n as_o aforesaid_a otherwise_o then_o hereafter_o in_o this_o act_n shall_v be_v provide_v and_o be_v it_o further_o enact_v register_n conveyance_n by_o indenture_n enter_v with_o the_o register_n that_o all_o conveyance_n by_o indenture_n of_o the_o say_v ninety_o five_o thousand_o acre_n or_o any_o part_n thereof_o enter_v with_o the_o say_a register_n in_o a_o book_n to_o be_v keep_v for_o that_o purpose_n shall_v be_v of_o equal_a force_n to_o convey_v the_o fréehold_n and_o inheritance_n of_o the_o say_v ninety_o five_o thousand_o acre_n or_o any_o part_n thereof_o as_o if_o the_o same_o conveyance_n by_o indenture_n be_v for_o valuable_a consideration_n of_o money_n enroll_v within_o six_o month_n in_o one_o of_o the_o king_n court_n of_o
record_n at_o westminster_n and_o no_o lease_n grant_v or_o conveyance_n of_o or_o charge_v out_o of_o or_o upon_o the_o say_v ninety_o five_o thousand_o acre_n or_o any_o part_n thereof_o except_o lease_n for_o seven_o year_n or_o under_o in_o possession_n shall_v be_v of_o force_n but_o from_o the_o time_n it_o shall_v be_v enter_v with_o the_o say_a register_n as_o aforesaid_a the_o entry_n of_o this_o act_n to_o be_v levy_v by_o sale_n of_o the_o land_n and_o be_v it_o further_o enact_v penalty_n levy_v of_o tax_n and_o penalty_n that_o for_o the_o levy_v such_o tax_n and_o penalty_n as_o be_v now_o in_o arrear_n or_o at_o any_o time_n since_o the_o thirty_o day_n of_o september_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o fifty_o and_o eight_o other_o than_o such_o as_o be_v hereby_o otherwise_o direct_v to_o be_v levy_v or_o which_o shall_v be_v set_v and_o impose_v upon_o the_o say_v ninety_o five_o thousand_o acre_n by_o virtue_n of_o this_o act_n and_o shall_v be_v in_o arrear_n upon_o the_o respective_a part_n and_o proportion_n of_o the_o say_v ninety_o five_o thousand_o acre_n the_o say_a governor_n bailiff_n and_o conservator_n of_o nor_o shall_v the_o say_a corporation_n be_v enforce_v to_o give_v to_o any_o other_o person_n any_o recompense_n for_o any_o loss_n or_o damage_n which_o have_v or_o shall_v happen_v by_o reason_n
