great_a or_o the_o privy_a seal_n or_o the_o king_n coin_n to_o kill_v the_o chancellor_n treasurer_n judge_n etc._n etc._n in_o the_o execution_n of_o their_o office_n the_o sense_n therefore_o of_o my_o lord_n coke_n assertion_n be_v that_o these_o act_n be_v treason_n when_o they_o be_v commit_v against_o a_o king_n in_o possession_n whether_o he_o be_v king_n de_fw-fr jure_fw-la or_o no_o and_o not_o treason_n when_o they_o be_v commit_v against_o a_o king_n out_o of_o possession_n though_o he_o be_v king_n de_fw-fr jure_fw-la before_o i_o examine_v the_o ground_n of_o his_o assertion_n i_o shall_v first_o state_n the_o point_n of_o controversy_n the_o question_n therefore_o be_v not_o whether_o some_o of_o these_o act_n may_v not_o be_v punish_v as_o treason_n under_o a_o usurper_n if_o they_o be_v commit_v against_o the_o necessary_a order_n of_o government_n and_o not_o do_v for_o the_o restore_n of_o the_o king_n de_fw-fr jure_fw-la to_o his_o crown_n or_o promote_a his_o inrest_n for_o the_o subject_n be_v oblige_v to_o pay_v a_o submission_n and_o obedience_n to_o the_o usurper_n as_o to_o all_o act_n of_o government_n that_o be_v not_o destructive_a of_o the_o king_n de_fw-fr jure_n right_n and_o interest_n and_o therefore_o if_o herein_o they_o oppose_v or_o disturb_v the_o government_n they_o may_v by_o the_o law_n be_v adjudge_v traitor_n and_o punish_v as_o such_o thus_o therefore_o it_o may_v be_v treason_n under_o a_o usurper_n first_o to_o counterfeit_n or_o clip_v his_o coin_n or_o to_o counterfeit_n his_o broad_a seal_n or_o privy_a seal_n or_o to_o kill_v a_o judge_n sit_v upon_o the_o bench_n some_o these_o offence_n touch_v not_o the_o person_n or_o interest_n of_o the_o usurper_n but_o the_o order_n of_o government_n and_o as_o it_o be_v just_a that_o the_o order_n of_o government_n shall_v proceed_v under_o a_o usurper_n so_o it_o be_v just_a that_o these_o act_n against_o the_o government_n shall_v be_v punish_v as_o well_o as_o robbery_n murder_n and_o the_o like_a as_o offence_n not_o against_o the_o usurper_n but_o the_o lawful_a king_n second_o to_o levy_v war_n against_o he_o or_o to_o be_v adherent_a to_o his_o enemy_n or_o to_o compass_v his_o death_n out_o of_o a_o private_a seditious_a principle_n and_o not_o out_o of_o any_o regard_n to_o the_o right_n and_o interest_n of_o the_o lawful_a king_n as_o suppose_v any_o man_n shall_v practise_v with_o a_o foreign_a prince_n to_o invade_v the_o nation_n not_o in_o the_o lawful_a king_n behalf_n or_o shall_v betray_v any_o fort_n or_o castle_n or_o any_o part_n of_o the_o country_n to_o he_o or_o the_o like_a for_o these_o also_o be_v offence_n not_o so_o much_o against_o the_o person_n and_o interest_n of_o the_o usurper_n as_o against_o the_o course_n of_o the_o government_n and_o strike_v through_o the_o person_n of_o the_o usurper_n at_o the_o person_n and_o authority_n of_o the_o lawful_a king_n and_o in_o that_o regard_n may_v be_v just_o look_v upon_o and_o punish_v as_o treason_n so_o the_o swear_v false_o though_o by_o a_o idol_n may_v be_v look_v upon_o and_o punish_v as_o perjury_n because_o it_o terminate_v upon_o the_o majesty_n of_o the_o true_a god_n but_o all_o this_o may_v be_v grant_v and_o yet_o it_o do_v not_o follow_v that_o the_o allegiance_n of_o the_o subject_n ought_v or_o may_v be_v pay_v to_o the_o king_n in_o possession_n if_o he_o be_v a_o usurper_n for_o still_o their_o submission_n and_o obedience_n to_o he_o be_v limit_v with_o a_o reserve_n to_o the_o right_n and_o interest_n of_o the_o lawful_a king_n the_o question_n therefore_o must_v be_v whether_o it_o be_v treason_n to_o act_v against_o the_o usurper_n in_o possession_n for_o the_o right_n and_o interest_n of_o the_o king_n de_fw-fr jure_fw-la out_o of_o possession_n to_o be_v adherent_a to_o the_o king_n de_fw-fr jure_fw-la to_o give_v he_o and_o his_o party_n aid_n and_o comfort_n and_o to_o levy_v assert_v that_o treason_n lie_v only_o against_o the_o king_n in_o possession_n i_o shall_v proceed_v therefore_o to_o consider_v the_o ground_n of_o his_o assertion_n it_o be_v indeed_o true_a in_o fact_n that_o the_o act_n declare_v to_o be_v treason_n in_o the_o statute_n 25_o edw._n 3._o will_v be_v adjuge_v and_o punish_v as_o treason_n under_o every_o king_n in_o possession_n whether_o he_o be_v king_n de_fw-fr jure_fw-la or_o no_o for_o though_o he_o be_v a_o usurper_n yet_o while_o he_o be_v in_o the_o throne_n the_o law_n court_n of_o judicature_n and_o every_o thing_n else_o be_v make_v to_o favour_v his_o side_n as_o much_o as_o if_o he_o be_v the_o most_o lawful_a and_o rightful_a king_n his_o party_n be_v hold_v to_o be_v the_o loyal_a subject_n in_o the_o eye_n of_o the_o law_n and_o the_o adverse_a party_n rebel_n and_o traitor_n so_o the_o law_n may_v be_v fit_o compare_v to_o the_o bank_n cast_v up_o against_o the_o sea_n which_o be_v make_v to_o keep_v out_o a_o inundation_n but_o when_o once_o the_o water_n be_v get_v over_o they_o they_o keep_v it_o in_o in_o like_a manner_n the_o law_n be_v make_v to_o prevent_v a_o usurpation_n but_o when_o once_o a_o usurper_n be_v get_v into_o the_o throne_n than_o they_o be_v make_v to_o become_v a_o fence_n to_o he_o to_o keep_v in_o possession_n of_o it_o now_o there_o be_v hardly_o any_o monarchy_n wherein_o there_o have_v be_v more_o usurpation_n than_o there_o have_v be_v in_o we_o and_o it_o ought_v not_o to_o be_v strange_a if_o in_o all_o these_o the_o usurper_n take_v upon_o they_o to_o act_v as_o lawful_a king_n and_o obedience_n be_v pay_v to_o they_o as_o such_o by_o the_o major_a part_n of_o the_o nation_n at_o least_o while_o they_o continue_v in_o the_o throne_n and_o those_o that_o stand_v by_o they_o against_o the_o king_n de_fw-fr jure_v who_o right_n they_o have_v usurp_v be_v look_v upon_o as_o faithful_a and_o loyal_a subject_n and_o reward_v according_o and_o those_o that_o rise_v up_o against_o they_o in_o behalf_n of_o their_o rightful_a king_n be_v declare_v traitor_n and_o rebel_n and_o punish_v as_o such_o and_o so_o the_o whole_a course_n of_o the_o government_n run_v on_o their_o side_n they_o call_v parliament_n and_o then_o the_o law_n be_v make_v in_o favour_n of_o their_o title_n they_o make_v the_o judge_n and_o no_o wonder_n then_o if_o all_o the_o law_n as_o well_o as_o the_o sat._n 25._o edw._n 3._o be_v interpret_v in_o their_o favour_n and_o treason_n lie_v in_o their_o own_o court_n against_o they_o only_o but_o it_o be_v be_v always_o thus_o in_o fact_n be_v no_o just_a ground_n for_o any_o man_n to_o declare_v it_o to_o be_v so_o in_o point_n of_o right_n and_o to_o give_v it_o for_o law_n that_o treason_n be_v only_o against_o the_o king_n in_o possession_n whether_o he_o be_v the_o king_n de_fw-fr jure_fw-la or_o a_o usurper_n we_o may_v therefore_o take_v leave_n to_o examine_v whether_o there_o be_v any_o better_a ground_n for_o this_o assertion_n it_o will_v seem_v a_o very_a odd_a question_n for_o any_o to_o ask_v touch_v the_o law_n which_o be_v make_v in_o any_o settle_a monarchy_n for_o the_o desence_n of_o the_o king_n person_n crown_n and_o dignity_n who_o be_v mean_v by_o the_o king_n in_o those_o law_n the_o lawful_a and_o rightful_a king_n of_o that_o realm_n or_o any_o one_o that_o get_v into_o the_o possession_n of_o the_o throne_n though_o he_o be_v not_o the_o rightful_a king_n but_o a_o usurper_n common_a sense_n will_v hardly_o allow_v such_o a_o question_n to_o be_v put_v for_o the_o king_n de_fw-fr jure_fw-la and_o not_o a_o usurper_n be_v true_o and_o proper_o king_n and_o therefore_o if_o the_o word_n of_o a_o law_n be_v to_o be_v understand_v in_o their_o natural_a and_o proper_a sense_n the_o word_n king_n can_v be_v understand_v to_o
be_v just_o punishable_a by_o himself_o because_o they_o terminate_v upon_o his_o authority_n and_o upon_o the_o interest_n which_o he_o have_v in_o the_o regular_a and_o orderly_o prccee_v of_o the_o government_n though_o he_o be_v exclude_v from_o the_o administration_n of_o it_o they_o be_v punishable_a also_o by_o the_o inferior_a magistrate_n by_o virtue_n of_o his_o presume_a will_n authorise_v they_o to_o act_v for_o he_o and_o the_o nation_n be_v interest_n though_o under_o a_o usurper_n and_o upon_o this_o ground_n we_o find_v that_o judge_n etc._n judge_n dr._n burnet_n life_n of_o judge_n hale_n p_o 36_o etc._n etc._n hale_n do_v not_o scruple_n to_o try_v felon_n under_o oliver_n cromwell_n though_o he_o scruple_v to_o try_v any_o offender_n against_o the_o state_n second_o there_o may_v be_v some_o act_n against_o the_o very_a person_n and_o crown_n of_o the_o usurper_n which_o may_v be_v do_v out_o of_o a_o private_a seditious_a principle_n or_o for_o the_o interest_n not_o of_o the_o king_n de_fw-fr jure_fw-la but_o some_o other_o person_n mere_o to_o disturb_v the_o government_n or_o to_o set_v up_o a_o second_o usurper_n in_o the_o place_n of_o the_o first_o now_o these_o act_n may_v be_v just_o pnnish_v as_o treason_n either_o by_o the_o inferior_a magistrate_n under_o the_o usurper_n or_o by_o the_o king_n de_fw-fr jure_fw-la when_o he_o come_v to_o the_o crown_n for_o first_o these_o act_n strike_v indirect_o at_o the_o king_n de_fw-fr jure_fw-la '_o we_o person_n and_o crown_n through_o the_o usurper_n and_o therefore_o either_o himself_n may_v punish_v they_o as_o do_v against_o himself_o or_o the_o inferior_a magistrate_n may_v punish_v they_o by_o virtue_n of_o his_o presume_a will_n and_o consent_n second_o the_o necessity_n of_o government_n require_v that_o the_o law_n and_o court_n of_o judicature_n stand_v by_o the_o king_n in_o possession_n though_o a_o usurper_n against_o any_o other_o person_n pretend_v to_o the_o to_o the_o crown_n may_v be_v just_o punish_v either_o by_o the_o usurper_n or_o by_o the_o inferior_a magistrate_n under_o he_o or_o much_o less_o by_o the_o king_n de_fw-fr jure_fw-la himself_o when_o he_o come_v to_o the_o crown_n neither_o be_v it_o conceivable_a that_o bagott_n '_o be_v council_n mean_v this_o by_o their_o plea_n that_o those_o who_o act_v against_o hen._n vi_o to_o bring_v ed._n iu._n to_o the_o crown_n may_v be_v attaint_v by_o ed._n iu._n for_o traitor_n and_o rebel_n for_o fight_v against_o hen._n vi_o the_o king_n in_o possession_n in_o king_n edward_n behalf_n this_o will_v have_v be_v a_o beld_v plea_n in_o king_n ed._n iv'_v time_n and_o before_o his_o judge_n and_o yet_o this_o must_v be_v their_o plea_n to_o prove_v from_o it_o that_o treason_n can_v be_v commit_v against_o only_a the_o king_n in_o possession_n it_o may_v be_v object_v that_o the_o attaindor_n of_o peson_n by_o a_o king_n de_fw-fr facto_fw-la for_o fightingagainst_a he_o have_v attaint_v those_o that_o come_v against_o he_o under_o hen._n 7._o and_o his_o parliament_n declare_v richard_n to_o be_v a_o usurper_n yet_o they_o think_v not_o fit_a to_o let_v any_o of_o observe_v 1_o st_o that_o it_o be_v not_o enact_v in_o the_o body_n of_o the_o statute_n that_o the_o subject_n shall_v be_v oblige_v to_o pay_v allegiance_n to_o the_o king_n for_o the_o time_n be_v so_o that_o if_o what_o be_v enact_v in_o the_o body_n of_o a_o statute_n only_o be_v law_n than_o the_o allegiance_n of_o the_o subject_n be_v not_o due_a by_o virtue_n of_o this_o statute_n to_o the_o king_n for_o the_o time_n be_v the_o direct_a intent_n of_o the_o body_n of_o it_o be_v to_o indemnify_v those_o that_o fight_n under_o the_o king_n in_o possession_n and_o their_o be_v indemnify_v for_o fight_v under_o he_o be_v no_o argument_n that_o it_o be_v lawful_a for_o they_o to_o do_v it_o much_o less_o that_o it_o be_v their_o duty_n for_o they_o may_v be_v guilty_a in_o foro_fw-la interno_fw-la of_o treason_n and_o rebellion_n for_o fight_v under_o the_o king_n in_o possession_n against_o the_o king_n de_fw-fr jure_fw-la and_o yet_o it_o may_v not_o be_v unjust_a or_o improper_a to_o indemnify_v they_o in_o foro_fw-la externo_fw-la by_o such_o a_o statute_n 1_o st_o because_o many_o that_o fight_v under_o the_o king_n in_o possession_n do_v it_o in_o the_o simplicity_n of_o their_o heart_n 2_o lie_n because_o this_o will_v prevent_v any_o revengeful_a effusion_n of_o blood_n by_o the_o king_n de_fw-fr jure_fw-la at_o his_o come_n to_o the_o crown_n all_o therefore_o that_o the_o body_n of_o the_o statute_n prove_v be_v that_o though_o by_o the_o stat._n 25_o edw._n 3._o it_o be_v treason_n to_o fight_v for_o a_o usurper_n against_o the_o king_n de_fw-fr jure_fw-la out_o of_o possession_n yet_o he_o that_o fight_v for_o a_o usurper_n against_o the_o king_n de_fw-fr jure_fw-la out_o of_o possession_n be_v indemnify_v by_o this_o statute_n and_o so_o he_o be_v not_o punishable_a as_o a_o traitor_n though_o he_o have_v the_o gild_n of_o treason_n upon_o his_o conscience_n and_o if_o he_o may_v still_o be_v guilty_a of_o treason_n than_o still_o his_o allegiance_n may_v be_v due_a to_o the_o king_n de_fw-fr jure_fw-la out_o of_o possession_n so_o as_o to_o oblige_v he_o not_o to_o act_v any_o thing_n against_o he_o in_o behalf_n of_o the_o usurper_n 2_o lie_n we_o may_v observe_v upon_o the_o view_n of_o the_o statute_n that_o the_o preamble_n of_o it_o do_v not_o direct_o and_o positive_o declare_v that_o the_o allegiance_n of_o the_o subject_n be_v due_a to_o the_o king_n for_o the_o time_n be_v but_o only_o oblique_o suppose_v and_o insinuate_v it_o the_o king_n be_v say_v to_o call_v to_o his_o remembrance_n his_o subject_n duty_n of_o allegiance_n and_o that_o they_o by_o virtue_n of_o it_o be_v bind_v to_o fight_v for_o the_o king_n for_o the_o time_n be_v etc._n etc._n this_o be_v not_o to_o declare_v it_o to_o be_v so_o by_o virtue_n of_o the_o authority_n of_o king_n and_o parliament_n to_o interpret_v the_o former_a law_n about_o the_o subject_n allegiance_n but_o to_o suppose_v it_o as_o a_o thing_n certain_o fix_v and_o determine_v by_o the_o law_n already_o and_o so_o also_o it_o be_v oblique_o insinuate_v in_o the_o body_n of_o the_o act_n that_o their_o fight_n under_o a_o king_n de_fw-fr facto_fw-la be_v do_v their_o true_a duty_n and_o service_n of_o allegiance_n and_o if_o this_o be_v only_o suppose_v and_o that_o supposition_n have_v no_o ground_n neither_o in_o the_o fundamental_a constitution_n of_o the_o realm_n nor_o in_o any_o former_a statute_n or_o custom_n but_o these_o all_o do_v all_o of_o they_o clear_o demonstrate_v the_o contrary_a as_o be_v show_v above_o then_o i_o think_v the_o preamble_n of_o this_o statute_n can_v be_v urge_v upon_o the_o conscience_n of_o the_o subject_n as_o a_o law_n oblige_v they_o to_o transfer_v their_o allegiance_n from_o their_o lawful_a king_n to_o any_o usurper_n get_v into_o the_o possession_n of_o the_o throne_n and_o to_o fight_v under_o the_o usurper_n against_o their_o lawful_a king_n if_o he_o attempt_v to_o recover_v his_o crown_n 3_o we_o may_v observe_v upon_o the_o view_n of_o this_o statute_n that_o one_o thing_n lay_v down_o in_o the_o preamble_n as_o the_o ground_n for_o the_o indemnify_v part_n of_o the_o act_n be_v express_o false_a viz._n that_o it_o be_v not_o
not_o amount_v to_o a_o consent_n for_o their_o cause_n of_o their_o not_o repeal_n it_o may_v be_v first_o because_o the_o subsequent_a king_n since_o henry_n the_o 7_o the_o have_v not_o have_v any_o occasion_n to_o see_v the_o evil_a consequence_n of_o it_o by_o any_o general_a compliance_n of_o the_o nation_n with_o a_o usurper_n against_o their_o lawful_a king_n under_o colour_n of_o be_v oblige_v thereto_o by_o this_o statute_n second_o the_o statute_n have_v be_v general_o understand_v to_o do_v no_o more_o than_o indemnify_v those_o that_o fight_n under_o the_o king_n de_fw-fr facto_fw-la and_o this_o our_o king_n may_v not_o look_v upon_o as_o unjust_a or_o inexpedient_a and_o therefore_o may_v see_v no_o necessity_n of_o repeal_n the_o statute_n but_o it_o can_v be_v conceive_v but_o that_o any_o lawful_a king_n who_o have_v be_v exclude_v or_o depose_v by_o a_o usurper_n and_o have_v see_v that_o the_o nation_n have_v look_v upon_o themselves_o as_o oblige_v by_o this_o act_n to_o stand_v by_o the_o usurper_n against_o he_o will_v if_o ever_o he_o have_v come_v to_o the_o crown_n have_v make_v it_o his_o business_n to_o declare_v it_o null_n and_o invalid_a second_o this_o statute_n have_v in_o effect_n be_v declare_v to_o be_v null_n and_o invalid_a by_o the_o subsequent_a lawful_a king_n and_o parliament_n i_o say_v it_o have_v be_v in_o effect_n declare_v null_n and_o invalid_a though_o not_o express_o repeal_v by_o the_o subsequent_a king_n and_o parliament_n and_o that_o in_o two_o way_n first_o by_o their_o proceed_n express_o contrary_a to_o the_o letter_n of_o it_o second_o their_o lay_v a_o contrary_a obligation_n on_o the_o conscience_n of_o the_o subject_n first_o by_o their_o proceed_n express_o contrary_a to_o the_o letter_n of_o this_o statute_n the_o statute_n enact_v that_o those_o that_o serve_v the_o king_n for_o the_o time_n be_v in_o his_o war_n shall_v be_v in_o no_o wise_a convict_v or_o attaint_v of_o high_a treason_n by_o act_n of_o parliament_n or_o otherwise_o by_o any_o process_n of_o law_n and_o that_o if_o any_o act_n or_o act_n or_o other_o process_n of_o law_n hereafter_o thereupon_o for_o the_o attaint_v and_o execute_v and_o his_o attaindor_n confirm_v in_o the_o next_o 16._o next_o 1_o mar._n sess_n 2._o c._n 16._o parliament_n and_o therein_o he_o and_o other_o person_n be_v declare_v to_o have_v be_v lawful_o just_o and_o according_a to_o the_o law_n of_o the_o realm_n convict_v or_o attaint_v and_o to_o have_v suffer_v the_o pain_n of_o death_n according_a to_o their_o demerit_n and_o yet_o this_o can_v not_o be_v look_v upon_o as_o according_a to_o law_n if_o the_o stat._n 11_o hen._n 7._o be_v look_v upon_o as_o valid_a which_o will_v more_o clear_o appear_v if_o we_o consider_v that_o the_o very_a plea_n of_o the_o duke_n of_o northumberland_n seem_v to_o be_v ground_v on_o this_o statute_n his_o plea_n consist_v in_o two_o point_n which_o he_o propose_v to_o the_o court_n one_o whereof_o be_v he_o be_v dr._n burnet_n '_o s_o hist_n reform_v p._n 2._o p._n 248._o l_n reflection_n on_o the_o 3_o d._n and_o 4_o the_o tome_n of_o mr._n varillas_n as_o p._n 126._o though_o this_o be_v a_o point_n in_o law_n that_o may_v have_v some_o colour_n in_o it_o yet_o it_o be_v far_o from_o confound_v any_o for_o a_o council_n or_o a_o great_a seal_n flow_v from_o a_o usurper_n be_v nothing_o so_o this_o authorty_n can_v not_o justify_v he_o whether_o a_o man_n act_v by_o the_o authority_n of_o the_o great_a seal_n and_o the_o order_n of_o the_o privy_a council_n he_o before_o he_o receive_v their_o order_n submit_v and_o 239._o and_o dr._n burnet_n hist_o reform_v p._n 2._o p._n 239._o proclaim_v she_o himself_o at_o cambridge_n second_o if_o this_o be_v sufficient_a to_o take_v off_o the_o argument_n from_o the_o proceed_n against_o the_o duke_n than_o this_o rather_o shall_v be_v the_o ground_n whereupon_o his_o plea_n be_v overrule_v but_o
