must_v be_v with_o hold_v of_o correspondence_n with_o any_o such_o person_n as_o be_v reside_v in_o scotland_n and_o with_o any_o other_o person_n reside_v there_o then_o as_o to_o the_o other_o part_n l._n pres_n it_o be_v a_o continue_a speech_n not_o with_o the_o scot_n nor_o any_o other_o mr._n hales_n then_o here_o be_v another_o thing_n in_o it_o that_o it_o be_v not_o aver_v that_o such_o correspondence_n and_o intelligence_n be_v hold_v without_o the_o licence_n of_o parliament_n att._n gen._n you_o be_v mistake_v in_o that_o your_o note_n be_v not_o true_a the_o clerk_n and_o he_o the_o say_v christopher_n love_n within_o the_o time_n and_o at_o the_o place_n before_o mention_v do_v traitorous_o assist_v encourage_v without_o the_o special_a licence_n of_o the_o council_n of_o state_n or_o parliament_n or_o captain_n general_n of_o the_o parliament_n force_n m._n hales_n we_o say_v then_o these_o be_v two_o distinct_a charge_n and_o ground_v upon_o two_o distinct_a part_n of_o a_o act_n but_o there_o be_v this_o more_o in_o it_o which_o we_o conceive_v be_v not_o to_o be_v answer_v with_o submission_n under_o favour_n it_o be_v say_v he_o do_v it_o within_o be_v good_a enough_o with_o that_o strike_v out_o before_o the_o first_o of_o june_n 1651._o whether_o it_o be_v not_o good_a enough_o and_o no_o time_n lay_v before_o it_o mr._n hales_n no_o indeed_o it_o be_v not_o good_a enough_o at._n gen._n why_o not_o it_o be_v after_o the_o offence_n commit_v mr._n hales_n because_o it_o may_v as_o well_o be_v before_o the_o act_n as_o after_o the_o act._n at._n gen._n if_o we_o lay_v it_o after_o the_o offence_n commit_v i_o suppose_v it_o be_v well_o enough_o and_o the_o wise_a will_v think_v so_o lay_v it_o to_o be_v the_o first_o of_o june_n 1651_o suppose_v it_o be_v in_o september_n before_o it_o be_v good_a enough_o mr._n hales_n if_o you_o lay_v it_o upon_o the_o first_o of_o june_n it_o be_v a_o year_n before_o it_o be_v not_o good_a enough_o att_n gen._n that_o that_o mr._n hales_n insist_o upon_o he_o may_v say_v it_o be_v before_o the_o first_o of_o june_n 1651_o so_o long_o since_o but_o in_o a_o just_a and_o reasonable_a after_o you_o have_v hear_v the_o proof_n as_o before_o you_o have_v hear_v it_o for_o it_o stand_v now_o as_o upon_o the_o charge_n single_o so_o that_o it_o shall_v not_o be_v supply_v out_o of_o matter_n that_o appear_v in_o the_o proof_n but_o it_o must_v be_v consider_v whether_o the_o charge_n can_v supply_v itself_o or_o not_o for_o that_o that_o be_v alledgable_a against_o the_o charge_n before_o the_o proof_n make_v be_v alledgable_a as_o well_o afterward_o if_o it_o be_v not_o good_a before_o the_o proof_n the_o proof_n shall_v not_o be_v supplementall_a to_o it_o for_o upon_o that_o reason_n if_o a_o indictment_n do_v want_v time_n or_o certainty_n then_o after_o the_o party_n be_v hear_v upon_o his_o defence_n it_o may_v be_v say_v when_o this_o exception_n be_v take_v to_o the_o indictment_n all_o this_o may_v appear_v upon_o the_o evidence_n but_o that_o will_v not_o supply_v the_o defect_n of_o the_o indictment_n at._n gen._n i_o be_o sure_a we_o have_v lay_v it_o late_o enough_o the_o first_o of_o june_n 1651._o before_o that_o time_n and_o mr._n hale_v his_o exception_n be_v still_o upon_o that_o way_n of_o proceed_n upon_o indictment_n he_o must_v
