to_o his_o enemy_n or_o to_o compass_v his_o death_n out_o of_o a_o private_a seditious_a principle_n and_o not_o out_o of_o any_o regard_n to_o the_o right_n and_o interest_n of_o the_o lawful_a king_n as_o suppose_v any_o man_n shall_v practise_v with_o a_o foreign_a prince_n to_o invade_v the_o nation_n not_o in_o the_o lawful_a king_n behalf_n or_o shall_v betray_v any_o fort_n or_o castle_n or_o any_o part_n of_o the_o country_n to_o he_o or_o the_o like_a for_o these_o also_o be_v offence_n not_o so_o much_o against_o the_o person_n and_o interest_n of_o the_o usurper_n as_o against_o the_o course_n of_o the_o government_n and_o strike_v through_o the_o person_n of_o the_o usurper_n at_o the_o person_n and_o authority_n of_o the_o lawful_a king_n and_o in_o that_o regard_n may_v be_v just_o look_v upon_o and_o punish_v as_o treason_n so_o the_o swear_v false_o though_o by_o a_o idol_n may_v be_v look_v upon_o and_o punish_v as_o perjury_n because_o it_o there_o have_v be_v more_o usurpation_n than_o there_o have_v be_v in_o we_o and_o it_o ought_v not_o to_o be_v strange_a if_o in_o all_o these_o the_o usurper_n take_v upon_o they_o to_o act_v as_o lawful_a king_n and_o obedience_n be_v pay_v to_o they_o as_o such_o by_o the_o major_a part_n of_o the_o nation_n at_o least_o while_o they_o continue_v in_o the_o throne_n and_o those_o that_o get_v into_o the_o possession_n of_o the_o throne_n though_o he_o be_v not_o the_o rightful_a king_n but_o a_o usurper_n common_a sense_n will_v hardly_o allow_v such_o a_o question_n to_o be_v put_v for_o the_o king_n de_fw-fr jure_fw-la and_o not_o a_o usurper_n be_v true_o and_o proper_o king_n and_o therefore_o if_o the_o word_n of_o a_o law_n be_v to_o be_v understand_v in_o their_o natural_a still_o his_o allegiance_n may_v be_v due_a to_o the_o king_n de_fw-fr jure_fw-la out_o of_o possession_n so_o as_o to_o oblige_v he_o not_o to_o act_v any_o thing_n against_o he_o in_o behalf_n of_o the_o usurper_n 2_o lie_n we_o may_v observe_v upon_o the_o view_n of_o the_o statute_n that_o the_o preamble_n of_o it_o do_v not_o direct_o and_o positive_o declare_v that_o the_o allegiance_n of_o the_o subject_n be_v due_a to_o the_o king_n for_o the_o time_n be_v but_o only_o oblique_o suppose_v and_o insinuate_v it_o the_o king_n be_v say_v to_o call_v to_o his_o remembrance_n his_o subject_n duty_n of_o allegiance_n and_o that_o they_o by_o virtue_n of_o it_o be_v bind_v to_o fight_v for_o the_o king_n for_o the_o time_n be_v etc._n etc._n this_o be_v not_o to_o declare_v it_o to_o be_v so_o by_o virtue_n of_o the_o authority_n of_o king_n and_o parliament_n to_o interpret_v the_o former_a law_n about_o the_o subject_n allegiance_n but_o to_o suppose_v it_o as_o a_o thing_n certain_o fix_v and_o determine_v by_o the_o law_n already_o and_o so_o also_o it_o be_v oblique_o insinuate_v in_o the_o body_n of_o the_o act_n that_o their_o fight_n under_o a_o king_n de_fw-fr facto_fw-la be_v do_v their_o true_a duty_n and_o service_n of_o allegiance_n and_o if_o this_o be_v only_o suppose_v and_o that_o supposition_n have_v no_o ground_n neither_o in_o the_o fundamental_a constitution_n of_o the_o realm_n nor_o in_o any_o former_a statute_n or_o custom_n but_o these_o all_o do_v all_o of_o they_o clear_o demonstrate_v the_o contrary_a as_o be_v show_v above_o then_o i_o think_v the_o preamble_n of_o this_o statute_n can_v be_v urge_v upon_o the_o conscience_n of_o the_o subject_n as_o a_o law_n oblige_v they_o to_o transfer_v their_o allegiance_n from_o their_o lawful_a king_n to_o any_o usurper_n get_v into_o the_o possession_n of_o the_o throne_n and_o to_o fight_v under_o the_o usurper_n against_o their_o lawful_a king_n if_o he_o attempt_v to_o recover_v his_o crown_n 3_o we_o may_v observe_v upon_o the_o view_n of_o this_o statute_n that_o one_o thing_n lay_v down_o in_o the_o preamble_n as_o the_o ground_n for_o the_o indemnify_v part_n of_o the_o act_n be_v express_o false_a viz._n that_o it_o be_v not_o
not_o amount_v to_o a_o consent_n for_o their_o cause_n of_o their_o not_o repeal_n it_o may_v be_v first_o because_o the_o subsequent_a king_n since_o henry_n the_o 7_o the_o have_v not_o have_v any_o occasion_n to_o see_v the_o evil_a consequence_n of_o it_o by_o any_o general_a compliance_n of_o the_o nation_n with_o a_o usurper_n against_o their_o lawful_a king_n under_o colour_n of_o be_v oblige_v thereto_o by_o this_o statute_n second_o the_o statute_n have_v be_v general_o understand_v to_o do_v no_o more_o than_o indemnify_v those_o that_o fight_n under_o the_o king_n de_fw-fr facto_fw-la and_o this_o our_o king_n may_v not_o look_v upon_o as_o unjust_a or_o inexpedient_a and_o therefore_o may_v see_v no_o necessity_n of_o repeal_n the_o statute_n but_o it_o can_v be_v conceive_v but_o that_o any_o lawful_a king_n who_o have_v be_v exclude_v or_o depose_v by_o a_o usurper_n and_o have_v see_v that_o the_o nation_n have_v look_v upon_o themselves_o as_o oblige_v by_o this_o act_n to_o stand_v by_o the_o usurper_n against_o he_o will_v if_o ever_o he_o have_v come_v to_o the_o crown_n have_v make_v it_o his_o business_n to_o declare_v it_o null_n and_o invalid_a second_o this_o statute_n have_v in_o effect_n be_v declare_v to_o be_v null_n and_o invalid_a by_o the_o subsequent_a lawful_a king_n and_o parliament_n i_o say_v it_o have_v be_v in_o effect_n declare_v null_n and_o invalid_a though_o not_o express_o repeal_v by_o the_o subsequent_a king_n and_o parliament_n and_o that_o in_o two_o way_n first_o by_o their_o proceed_n express_o contrary_a to_o the_o letter_n of_o it_o second_o their_o lay_v a_o contrary_a obligation_n on_o the_o conscience_n of_o the_o subject_n first_o by_o their_o proceed_n express_o contrary_a to_o the_o letter_n of_o this_o statute_n the_o statute_n enact_v that_o those_o that_o serve_v the_o king_n for_o the_o time_n be_v in_o his_o war_n shall_v be_v in_o no_o wise_a convict_v or_o attaint_v of_o high_a treason_n by_o act_n of_o parliament_n or_o otherwise_o by_o any_o process_n of_o law_n and_o that_o if_o any_o act_n or_o act_n or_o other_o process_n of_o law_n hereafter_o thereupon_o for_o the_o attaint_v and_o execute_v and_o his_o attaindor_n confirm_v in_o the_o next_o 16._o next_o 1_o mar._n sess_n 2._o c._n 16._o parliament_n and_o therein_o he_o and_o other_o person_n be_v declare_v to_o have_v be_v lawful_o just_o and_o according_a to_o the_o law_n of_o the_o realm_n convict_v or_o attaint_v and_o to_o have_v suffer_v the_o pain_n of_o death_n according_a to_o their_o demerit_n consider_v that_o the_o very_a plea_n of_o the_o duke_n of_o northumberland_n seem_v to_o be_v ground_v on_o this_o statute_n his_o plea_n consist_v in_o two_o point_n which_o he_o propose_v to_o the_o court_n one_o whereof_o be_v he_o be_v dr._n burnet_n '_o s_o hist_n reform_v p._n 2._o p._n 248._o l_n reflection_n on_o the_o 3_o d._n and_o 4_o the_o tome_n of_o mr._n varillas_n as_o p._n 126._o though_o this_o be_v a_o point_n in_o law_n that_o may_v have_v some_o colour_n in_o it_o yet_o it_o be_v far_o from_o confound_v any_o for_o a_o council_n or_o a_o great_a seal_n flow_v from_o a_o usurper_n be_v nothing_o so_o this_o authorty_n can_v not_o justify_v he_o whether_o a_o man_n act_v by_o the_o authority_n of_o the_o great_a seal_n and_o the_o order_n of_o the_o privy_a
