three_o shilling_n and_o nine_o penny_n arise_v by_o virtue_n of_o this_o act_n and_o not_o hereby_o apply_v towards_o the_o defray_a the_o charge_n of_o the_o sloop_n and_o party_n aforesaid_a other_o misfortune_n to_o pay_v their_o debt_n to_o avoid_v the_o suit_n and_o prosecution_n of_o their_o creditor_n have_v be_v likewise_o oblige_v to_o go_v off_o this_o island_n and_o by_o reason_n of_o the_o offence_n and_o debt_n aforesaid_a can_v safe_o return_v again_o and_o forasmuch_o as_o nothing_o can_v more_o conduce_v to_o the_o strength_n security_n and_o flourish_a condition_n of_o this_o country_n than_o multitude_n of_o people_n and_o that_o it_o be_v become_v absolute_o necessary_a in_o order_n thereunto_o for_o put_v the_o island_n in_o this_o time_n of_o war_n into_o a_o posture_n of_o defence_n against_o the_o enemy_n to_o invite_v and_o encourage_v as_o much_o as_o possible_a their_o majesty_n subject_n to_o come_v to_o this_o island_n by_o deliver_v they_o from_o but_o five_o pound_n or_o under_o no_o bond_n shall_v be_v take_v or_o credit_v give_v after_o the_o entry_n thereof_o but_o the_o custom_n for_o the_o same_o shall_v be_v immediate_o pay_v to_o the_o receiver-general_n or_o his_o lawful_a deputy_n and_o by_o he_o pay_v over_o into_o the_o hand_n of_o the_o treasurer_n or_o treasurer_n as_o be_v before_o direct_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o negro_n to_o be_v export_v shall_v be_v enter_v in_o the_o receiver-general_n office_n export_v negro_n export_v and_o immediate_o bond_n give_v by_o the_o owner_n or_o exporter_n to_o their_o majesty_n for_o the_o payment_n of_o the_o money_n into_o the_o hand_n of_o the_o receiver-general_n or_o his_o lawful_a deputy_n within_o one_o month_n after_o the_o entry_n so_o make_v as_o aforesaid_a and_o whosoever_o shall_v presume_v after_o the_o say_v seventeen_o day_n of_o november_n in_o this_o present_a year_n one_o thousand_o six_o hundred_o ninety_o three_o to_o export_v any_o slave_n or_o slave_n and_o not_o make_v such_o entry_n and_o give_v bond_n and_o pay_v as_o before_o in_o this_o act_n be_v direct_v shall_v forfeit_v banister_n esquire_n be_v and_o be_v hereby_o require_v and_o impower_v to_o nominate_v and_o appoint_v from_o time_n to_o time_n appoint_v manager_n appoint_v such_o fit_a person_n or_o person_n in_o england_n scotland_n ireland_n new_a england_n new_a york_n or_o any_o other_o part_n of_o america_n or_o elsewhere_o as_o they_o or_o the_o major_a part_n of_o they_o shall_v think_v fit_a to_o to_o choose_v one_o or_o more_o of_o themselves_o to_o receive_v choose_v receiver_n how_v choose_v and_o pay_v the_o money_n arise_v by_o virtue_n of_o this_o act_n for_o the_o use_v and_o purpose_v herein_o mention_v of_o the_o receipt_n of_o all_o which_o the_o treasurer_n or_o treasurer_n for_o the_o time_n be_v shall_v keep_v a_o exact_a and_o distinct_a account_n as_o also_o of_o all_o payment_n make_v for_o the_o use_v and_o purpose_v by_o this_o act_n require_v and_o render_v a_o just_a and_o true_a account_n thereof_o when_o thereunto_o demand_v unto_o the_o rest_n of_o the_o person_n in_o this_o act_n nominate_v and_o appoint_v or_o the_o major_a part_n of_o they_o or_o unto_o the_o assembly_n of_o this_o island_n when_o sit_v and_o assemble_v and_o if_o the_o say_a treasurer_n or_o treasurer_n for_o the_o time_n be_v after_o the_o receipt_n of_o any_o of_o the_o say_a money_n shall_v divert_v or_o misapply_v the_o same_o or_o any_o part_n thereof_o by_o any_o pretence_n whatsoever_o otherwise_o than_o before_o intend_v and_o direct_v contrary_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n the_o person_n or_o person_n so_o offend_a shall_v forfeit_v to_o their_o majesty_n misapplication_n forfeiture_n for_o misapplication_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o double_v the_o sum_n so_o divert_v and_o misapply_v and_o the_o say_a treasurer_n or_o treasurer_n for_o the_o time_n be_v shall_v be_v allow_v two_o and_o a_o half_a per_fw-la or_o their_o charge_n in_o or_o about_o the_o discharge_n of_o the_o trust_v hereby_o in_o he_o or_o they_o repose_v and_o whereas_o after_o the_o expiration_n of_o this_o act_n some_o of_o the_o money_n arise_v by_o virtue_n hereof_o may_v remain_v in_o the_o hand_n of_o the_o treasurer_n or_o treasurer_n for_o the_o time_n be_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o such_o sum_n or_o sum_n of_o money_n if_o any_o be_v money_n surplus_n of_o money_n in_o the_o hand_n of_o the_o say_a treasurer_n or_o treasurer_n shall_v notwithstanding_o the_o expiration_n of_o this_o act_n be_v there_o and_o still_o in_o his_o or_o their_o hand_n remain_v and_o be_v employ_v to_o the_o use_v and_o intent_n in_o this_o act_n appoint_v be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o secretary_n of_o this_o island_n shall_v from_o time_n to_o time_n upon_o demand_n deliver_v copy_n of_o this_o act_n to_o be_v deliver_v give_v copy_n or_o copy_n of_o this_o act_n to_o any_o person_n without_o delay_n or_o excuse_v for_o every_o of_o which_o he_o shall_v receive_v the_o fee_n or_o sum_n of_o ten_o shilling_n and_o in_o case_n he_o shall_v delay_v or_o refuse_v to_o give_v such_o copy_n or_o copy_n as_o aforesaid_a to_o any_o person_n or_o person_n demand_v the_o same_o he_o shall_v for_o every_o copy_n so_o demand_v and_o not_o branch_n thereof_o be_v enjoin_v he_o entry_n forfeiture_n of_o the_o receiver-general_n on_o refusal_n of_o entry_n he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o the_o authority_n aforesaid_a that_o in_o case_n any_o of_o the_o officer_n or_o seaman_n on_o board_n the_o say_a sloop_n or_o vessel_n or_o in_o the_o say_a party_n shall_v in_o actual_a service_n disable_v seaman_n or_o soldier_n disable_v lose_v either_o leg_n or_o arm_n or_o be_v otherwise_o disable_v that_o then_o and_o in_o all_o such_o case_n all_o and_o every_o of_o the_o disable_v man_n shall_v receive_v ten_o pound_n per_fw-la annum_fw-la without_o charge_n during_o his_o or_o their_o natural_a life_n and_o also_o their_o cure_n to_o be_v pay_v for_o out_o of_o the_o public_a revenue_n of_o this_o island_n by_o order_n of_o the_o lieutenant-governour_n and_o council_n or_o of_o the_o government_n of_o this_o island_n out_o of_o the_o first_o payment_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o when_o there_o shall_v be_v no_o necessity_n for_o the_o say_a sloop_n or_o vessel_n of_o war_n that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o commissioner_n or_o the_o major_a part_n of_o they_o to_o sell_v the_o same_o with_o all_o the_o apparel_n and_o furniture_n and_o of_o the_o money_n arise_v therefrom_o with_o all_o other_o sum_n of_o money_n which_o shall_v remain_v over_o and_o above_o apply_v remainder_n how_o apply_v or_o be_v not_o expend_v of_o the_o money_n arise_v and_o appropriate_v by_o virtue_n of_o this_o act_n and_o not_o hereby_o apply_v shall_v be_v and_o remain_v in_o the_o hand_n of_o the_o say_a treasurer_n or_o either_o of_o they_o by_o this_o act_n appoint_v to_o be_v apply_v and_o dispose_v of_o for_o and_o towards_o such_o other_o use_v or_o uses_n as_o the_o assembly_n of_o this_o island_n shall_v appoint_v by_o a_o law_n and_o that_o the_o say_a receiver_n or_o receiver_n towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o the_o other_o half_n to_o the_o informer_n who_o shall_v sue_v for_o the_o same_o thereof_o as_o shall_v be_v necessary_a for_o the_o victual_v and_o manning_n of_o a_o sloop_n to_o transport_v colonel_n peter_n beckford_n who_o be_v now_o go_v for_o england_n for_o the_o service_n of_o this_o island_n shall_v be_v pay_v as_o the_o governor_n shall_v direct_v and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o such_o money_n as_o shall_v arise_v from_o the_o freight_n of_o good_n ship_v on_o board_n the_o say_a sloop_n either_o to_o or_o from_o england_n be_v by_o colonel_n peter_n beckford_n apply_v to_o the_o defray_v the_o charge_n of_o the_o say_a vessel_n and_o that_o the_o commander_n of_o the_o say_v sloop_n do_v from_o time_n to_o time_n observe_v all_o such_o order_n and_o instruction_n as_o he_o shall_v receive_v from_o the_o say_a colonel_n beckford_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o of_o the_o money_n arise_v by_o virtue_n of_o the_o act_n aforesaid_a the_o sum_n of_o one_o thousand_o pound_n shall_v be_v pay_v into_o the_o hand_n of_o the_o treasurer_n or_o treasurer_n appoint_v by_o a_o act_n entitle_v a_o act_n to_o reimburse_v their_o majesty_n treasury_n and_o encourage_v their_o subject_n to_o come_v and_o settle_v in_o this_o island_n to_o be_v by_o they_o employ_v and_o use_v for_o the_o pay_v the_o passage_n of_o such_o person_n as_o shall_v transport_v windward_n to_o cruise_n there_o to_o give_v notice_n to_o the_o english_a fleet_n daily_o expect_v here_o of_o the_o additional_a force_v the_o french_a have_v or_o may_v sudden_o receive_v and_o be_v it_o further_o enact_v that_o of_o the_o money_n arise_v by_o virtue_n of_o the_o act_n aforesaid_a and_o not_o hitherto_o apply_v or_o make_v use_n of_o the_o sum_n of_o one_o hundred_o sixty_o two_o pound_n be_v pay_v into_o the_o hand_n of_o colonel_n edward_n stanton_n for_o defray_v the_o charge_n of_o twelve_o man_n for_o six_o month_n to_o be_v constant_o keep_v at_o fort-william_n at_o port-morant_a for_o their_o defence_n thereof_o and_o the_o security_n of_o the_o adjacent_a part_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o remainder_n of_o the_o say_a money_n arise_v by_o virtue_n of_o the_o beforementioned_a act_n and_o not_o by_o this_o present_a act_n apply_v shall_v be_v by_o the_o governor_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o council_n apply_v and_o make_v use_v of_o for_o the_o immediate_a defence_n of_o this_o island_n and_o to_o no_o other_o use_v intent_n or_o purpose_n whatsoever_o and_o the_o receiver_n or_o receiver_n treasurer_n or_o treasurer_n in_o the_o say_a act_n appoint_v be_v hereby_o require_v and_o impower_v to_o pay_v the_o same_o according_o under_o the_o penalty_n in_o this_o act_n hereaftermention_v any_o thing_n in_o this_o or_o any_o other_o act_n seem_v to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v that_o the_o several_a sum_n of_o money_n order_v to_o be_v assess_v and_o levy_v by_o the_o abovementioned_a act_n either_o not_o have_v be_v assess_v nor_o levy_v within_o the_o time_n in_o the_o say_a act_n limit_v and_o appoint_v in_o some_o of_o the_o parish_n within_o this_o island_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o where_o any_o tax_n mention_v to_o be_v raise_v by_o either_o of_o the_o above-recited_n act_n make_v re-assessment_a to_o be_v make_v and_o omit_v to_o be_v either_o assess_v or_o levy_v by_o the_o justice_n and_o vestry_n or_o the_o justice_n where_o the_o vestry_n neglect_v their_o duty_n or_o where_o no_o vestry_n be_v be_v impower_v at_o any_o other_o day_n or_o place_n within_o three_o month_n after_o the_o pass_v this_o act_n as_o to_o the_o say_a justice_n shall_v seem_v meet_a to_o appoint_v to_o assess_v and_o levy_v as_o well_o during_o martial_a law_n as_o while_o the_o common-law_n be_v in_o force_n upon_o the_o several_a inhabitant_n of_o the_o say_a parish_n the_o say_a tax_n and_o issue_n out_o their_o warrant_n according_o to_o the_o respective_a constable_n for_o the_o collect_v levy_v and_o distrain_v for_o the_o deputy_n to_o levy_v or_o cause_n to_o be_v levy_v on_o all_o and_o every_o person_n or_o person_n so_o offend_a forfeit_a 100_o l._n forfeit_a one_o hundred_o pound_v currant_n money_n of_o this_o island_n or_o the_o value_n thereof_o upon_o his_o or_o their_o money_n slave_n good_n or_o chattel_n and_o sell_v the_o same_o by_o public_a outcry_n return_v the_o overplus_n if_o any_o be_v to_o the_o owner_n and_o in_o case_n no_o money_n slave_n or_o good_n be_v to_o be_v find_v as_o aforesaid_a that_o then_o he_o take_v into_o custody_n the_o body_n of_o the_o person_n or_o person_n so_o offend_v and_o he_o or_o they_o in_o safe_a custody_n keep_v until_o he_o or_o they_o pay_v the_o say_a sum_n of_o one_o hundred_o pound_n for_o the_o say_a offence_n any_o law_n custom_n or_o usage_n and_o know_v by_o the_o name_n of_o the_o town_n and_o parish_n of_o kingston_n and_o have_v use_v exercise_n and_o enjoy_v all_o and_o every_o the_o power_n authority_n benefit_n privilege_n right_n immunity_n and_o custom_n that_o all_o or_o any_o of_o the_o parish_n or_o precinct_n within_o this_o island_n have_v or_o aught_o to_o have_v use_v exercise_n or_o enjoy_v of_o common_a right_n or_o by_o virtue_n of_o any_o general_a act_n or_o act_n of_o this_o country_n as_o full_o ample_o and_o effectual_o as_o if_o the_o same_o have_v then_o be_v a_o distinct_a and_o separate_a parish_n or_o precinct_n and_o therein_o by_o name_n express_o mention_v and_o specify_v and_o particular_o that_o there_o shall_v be_v choose_v three_o representative_n to_o serve_v in_o every_o assembly_n hereafter_o or_o after_o the_o first_o prorogation_n of_o this_o present_a assembly_n for_o the_o say_a town_n and_o parish_n of_o kingston_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o for_o the_o ease_n of_o the_o merchant_n and_o trading_n people_n of_o the_o say_a town_n of_o kingston_n that_o there_o be_v erect_v establish_v and_o hold_v in_o the_o say_a town_n a_o quarter-session_n for_o the_o conservation_n of_o the_o peace_n and_o a_o court_n of_o common-plea_n justice_n court_n of_o justice_n with_o the_o same_o power_n and_o authority_n that_o be_v or_o have_v be_v late_o hold_v or_o exercise_v at_o port-royal_a which_o say_v court_n shall_v be_v hold_v the_o first_o time_n on_o the_o second_o thursday_n in_o october_n in_o this_o present_a year_n one_o thousand_o six_o hundred_o ninety_o three_o and_o afterward_o once_o every_o two_o month_n and_o the_o session_n every_o three_o month_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o receiver-general_n secretary_n of_o this_o island_n and_o naval_a officer_n for_o the_o time_n be_v do_v by_o themselves_o or_o deputy_n within_o one_o month_n after_o the_o pass_v this_o act_n keep_v or_o cause_n to_o be_v keep_v in_o the_o town_n of_o kingston_n aforesaid_a their_o several_a and_o respective_a office_n office_n public_a office_n as_o they_o now_o do_v or_o heretofore_o have_v or_o aught_o to_o have_v do_v on_o port-royal_a on_o penalty_n of_o fifty_o pound_n each_o for_o every_o month_n they_o or_o any_o of_o they_o shall_v neglect_v or_o refuse_v to_o do_v the_o same_o to_o be_v recover_v against_o they_o or_o any_o of_o they_o by_o bill_n plaint_n information_n or_o otherwise_o in_o the_o supreme_a court_n of_o this_o island_n the_o one_o half_n to_o their_o majesty_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_n to_o the_o informer_n or_o he_o that_o shall_v sue_v for_o the_o same_o wherein_o no_o essoyn_n injunction_n protection_n wager_n of_o law_n or_o nonvult_fw-la ulterius_fw-la prosequi_fw-la shall_v be_v allow_v a_o act_n for_o the_o better_a secure_n of_o port_n royal._n preamble_n preamble_n whereas_o the_o town_n of_o port-royal_a be_v a_o town_n of_o a_o very_a considerable_a trade_n and_o of_o great_a strength_n to_o resist_v the_o enemy_n in_o time_n of_o war_n by_o reason_n of_o their_o majesty_n fortification_n and_o a_o great_a number_n of_o house_n through_o the_o mercy_n of_o god_n leave_v stand_v thereon_o and_o whereas_o by_o the_o late_a dreadful_a earthquake_n the_o land_n on_o the_o back-sea-side_n be_v settle_v low_a than_o it_o be_v by_o reason_n whereof_o the_o sea_n have_v more_o power_n to_o gain_v upon_o it_o and_o if_o not_o timely_o prevent_v by_o wharf_n to_o resist_v the_o violence_n thereof_o may_v endanger_v the_o house_n that_o be_v stand_v on_o that_o seaside_n for_o prevention_n whereof_o be_v it_o enact_v and_o ordain_v by_o their_o majesty_n lieutenant-governour_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o it_o shall_v and_o may_v be_v lawful_a from_o and_o after_o the_o twenty_o five_o day_n of_o july_n in_o the_o year_n of_o our_o lord_n 1693._o for_o the_o justice_n and_o vestry_n of_o the_o parish_n of_o port-royal_a or_o the_o major_a part_n of_o they_o to_o assess_v tax_n work_n money_n for_o the_o work_n and_o levy_v such_o sum_n or_o sum_n of_o money_n upon_o all_o and_o every_o the_o freeholder_n of_o the_o say_a parish_n of_o port-royal_a as_o to_o they_o shall_v seem_v meet_a and_o convenient_a for_o and_o towards_o the_o wharf_n or_o otherwise_o secure_v the_o town_n of_o port-royal_a towards_o the_o great-sea-side_n abovemention_v and_o whereas_o after_o the_o wharf_n be_v make_v they_o may_v from_o time_n to_o time_n want_v repair_v be_v it_o therefore_o further_o enact_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o justice_n and_o vestry_n of_o port-royal_a aforesaid_a or_o the_o major_a part_n of_o they_o to_o assess_v tax_n repair_v for_o the_o repair_v and_o levy_v yearly_a and_o every_o year_n such_o sum_n or_o sum_n of_o money_n upon_o the_o freeholder_n of_o the_o say_a parish_n of_o port-royal_a at_o such_o time_n as_o to_o they_o shall_v seem_v requisite_a or_o necessary_a for_o repair_v and_o maintain_v the_o say_a wharf_n and_o that_o the_o constable_n or_o constable_n of_o the_o say_a parish_n of_o port-royal_a shall_v gather_v in_o the_o abovesaid_a money_n so_o to_o be_v levy_v assess_v and_o tax_v as_o before_o mention_v and_o appoint_v by_o this_o present_a act_n and_o pay_v the_o same_o into_o the_o hand_n of_o the_o churchwarden_n of_o the_o say_a parish_n of_o port-royal_a for_o the_o time_n be_v deduct_v to_o he_o or_o themselves_o four_o penny_n in_o the_o pound_n for_o collect_v the_o same_o and_o in_o case_n any_o constable_n or_o constable_n shall_v neglect_v he_o or_o their_o duty_n in_o collect_v gather_v or_o pay_v in_o the_o money_n so_o collect_v by_o virtue_n of_o this_o act_n he_o or_o they_o so_o neglect_v his_o or_o their_o duty_n therein_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o twenty_o pound_n and_o in_o case_n any_o person_n or_o person_n shall_v refuse_v or_o delay_v to_o pay_v his_o or_o their_o tax_n so_o to_o be_v assess_v tax_v and_o levy_v refusal_n case_n of_o refusal_n as_o in_o this_o present_a act_n be_v prescribe_v be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o parish_n of_o port-royal_a aforesaid_a to_o issue_v out_o their_o warrant_n of_o distress_n direct_v to_o any_o constable_n of_o the_o say_a parish_n to_o levy_v the_o same_o upon_o the_o good_n or_o chattel_n of_o he_o her_z or_o they_o so_o refuse_v or_o delay_v to_o pay_v the_o same_o and_o sell_v the_o same_o at_o public_a outcry_n return_v the_o overplus_n if_o any_o be_v to_o the_o owner_n and_o to_o the_o intent_n that_o the_o money_n which_o shall_v be_v collect_v and_o raise_v by_o virtue_n of_o this_o act_n may_v be_v apply_v to_o the_o use_n and_o purpose_n by_o this_o act_n mention_v and_o direct_v be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o churchwarden_n or_o churchwarden_n of_o the_o say_a parish_n of_o port-royal_a for_o the_o time_n and_o be_v hereby_o require_v from_o time_n to_o time_n to_o pay_v the_o money_n arise_v by_o virtue_n of_o this_o act_n to_o such_o person_n or_o person_n and_o to_o such_o use_v as_o the_o justice_n and_o vestry_n who_o payment_n to_o who_o or_o major_a part_n of_o they_o shall_v direct_v and_o appoint_v and_o that_o the_o churchwarden_n of_o the_o say_a parish_n for_o the_o time_n be_v shall_v keep_v a_o distinct_a account_n of_o the_o money_n by_o they_o and_o each_o of_o they_o receive_v by_o virtue_n of_o this_o act_n and_o likewise_o render_v a_o true_a and_o just_a account_n thereof_o to_o the_o justice_n and_o vestry_n of_o the_o say_a parish_n of_o port-royal_a when_o thereunto_o require_v and_o also_o pay_v the_o full_a balance_n of_o the_o same_o unto_o the_o succeed_a churchwarden_n or_o to_o whosoever_o the_o say_a justice_n and_o vestry_n or_o major_a part_n of_o they_o shall_v direct_v and_o appoint_v under_o the_o penalty_n of_o fifty_o pound_n for_o every_o offence_n commit_v contrary_a to_o their_o duty_n in_o this_o act_n enjoin_v and_o whereas_o several_a of_o the_o freeholder_n of_o port-royal_a may_v be_v or_o be_v not_o resident_n or_o inhabitant_n on_o the_o say_a place_n for_o the_o better_a recovery_n of_o the_o say_a tax_n to_o be_v assess_v as_o aforesaid_a be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o in_o such_o case_n from_o freeholder_n absent_a freeholder_n and_o after_o the_o twenty_o five_o day_n of_o july_n one_o thousand_o six_o hundred_o ninety_o three_o a_o action_n of_o debt_n shall_v lie_v in_o any_o court_n of_o record_n or_o before_o any_o justice_n of_o the_o peace_n as_o in_o other_o debt_n for_o the_o churchwarden_n of_o the_o respective_a parish_n of_o port-royal_a and_o their_o successor_n to_o recover_v against_o any_o of_o the_o say_a person_n rate_v or_o assess_v by_o virtue_n of_o this_o act_n or_o any_o of_o they_o or_o their_o heir_n executor_n administrator_n assign_v agent_n or_o attorney_n here_o all_o such_o sum_n and_o sum_n of_o money_n as_o be_v or_o shall_v be_v rate_v or_o assess_v upon_o they_o as_o aforesaid_a and_o that_o the_o same_o rate_n or_o assessment_n produce_v in_o such_o court_n of_o record_n or_o before_o such_o justice_n of_o the_o peace_n as_o aforesaid_a shall_v be_v sufficient_a evidence_n and_o proof_n for_o the_o recovery_n of_o all_o such_o sum_n or_o sum_n money_n so_o rate_v or_o assess_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n be_v seize_v possess_v or_o interest_v of_o or_o in_o any_o ground_n which_o be_v former_o build_v upon_o and_o the_o house_n thereupon_o be_v now_o destroy_v rebuilding_n neglect_v of_o rebuilding_n or_o pull_v down_o at_o the_o time_n or_o by_o the_o mean_n of_o the_o late_a dreadful_a earthquake_n shall_v not_o within_o three_o year_n next_o ensue_a build_v on_o the_o same_o that_o then_o the_o judge_n of_o the_o court_n of_o common-plea_n of_o the_o say_a parish_n for_o the_o time_n be_v or_o any_o one_o of_o they_o shall_v forthwith_o cause_v public_a proclamation_n to_o be_v make_v as_o well_o at_o or_o upon_o the_o say_a ground_n as_o also_o in_o the_o court-house_n of_o the_o say_a parish_n thereby_o to_o give_v notice_n to_o all_o person_n that_o shall_v or_o may_v be_v therein_o concern_v to_o cause_v the_o same_o to_o be_v rebuild_v within_o the_o space_n of_o nine_o month_n then_o next_o follow_v and_o in_o case_n the_o owner_n thereof_o or_o other_o person_n or_o person_n have_v interest_n therein_o shall_v refuse_v or_o neglect_v to_o rebuild_v the_o same_o within_o such_o time_n as_o aforesaid_a that_o then_o and_o in_o such_o case_n the_o say_a judge_n of_o the_o say_a court_n or_o any_o one_o of_o they_o be_v hereby_o authorize_v to_o issue_n out_o their_o warrant_n to_o the_o provost_n marshal_n for_o the_o time_n be_v require_v he_o to_o impannel_n and_o return_v before_o they_o or_o any_o one_o of_o they_o a_o jury_n of_o good_a and_o lawful_a man_n of_o the_o say_a parish_n which_o the_o say_v provost_z marshal_z be_v hereby_o authorize_v and_o require_v to_o do_v according_o which_o jury_n so_o return_v shall_v upon_o their_o oath_n to_o be_v administer_v to_o they_o by_o the_o say_a judge_n or_o one_o of_o they_o who_o be_v likewise_o hereby_o authorize_v to_o administer_v the_o same_o inquire_v estimate_n and_o assess_v the_o true_a and_o just_a value_n of_o such_o void_a ground_n according_a to_o their_o judgement_n and_o that_o from_o and_o after_o such_o enquiry_n and_o valuation_n thereof_o make_v as_o aforesaid_a by_o inquest_n of_o the_o say_a jury_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a judge_n or_o judge_n to_o make_v sale_n of_o the_o fee_n and_o inheritance_n thereof_o by_o conveyance_n under_o he_o or_o their_o hand_n and_o seal_n to_o any_o person_n or_o person_n that_o will_v purchase_v the_o same_o at_o such_o price_n at_o which_o the_o same_o shall_v have_v be_v so_o as_o aforesaid_a estimate_v and_o value_v by_o the_o say_a jury_n and_o the_o money_n thereupon_o to_o be_v receive_v of_o the_o purchaser_n thereof_o shall_v forthwith_o be_v pay_v into_o the_o hand_n of_o the_o churchwarden_n of_o the_o say_a parish_n for_o the_o time_n be_v and_o from_o thence_o to_o be_v issue_v out_o and_o pay_v by_o the_o say_a churchwarden_n for_o the_o time_n be_v unto_o such_o person_n or_o person_n who_o shall_v have_v any_o estate_n or_o interest_n in_o to_z or_o out_o of_o the_o same_o according_a to_o his_o or_o their_o respective_a estate_n or_o estate_n title_n or_o interest_n which_o sale_n so_o make_v and_o enrol_v in_o the_o office_n of_o enrolment_n of_o this_o island_n enrol_v sale_n to_o be_v enrol_v shall_v be_v final_a and_o conclusive_a to_o all_o other_o person_n whatsoever_o and_o shall_v bar_v they_o their_o heir_n and_o assign_v to_o claim_v any_o estate_n right_o title_n or_o interest_n of_o in_o or_o out_o of_o the_o ground_n so_o sell_v precedent_n to_o the_o say_a sale_n and_o the_o purchaser_n or_o purchaser_n thereof_o his_o and_o their_o heir_n and_o assign_v shall_v and_o may_v by_o virtue_n of_o this_o act_n have_v hold_v and_o enjoy_v the_o same_o against_o all_o person_n claim_v any_o estate_n right_o title_n or_o interest_n in_o to_z or_o out_o of_o the_o same_o his_o her_z and_o their_o heir_n executor_n administrator_n and_o assign_v free_v and_o discharge_v of_o and_o from_o encumbrance_n in_o estate_n title_n charge_n or_o otherwise_o precedent_n to_o the_o say_a sale_n their_o majesty_n quitrent_n only_o except_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o receiver_n general_n and_o naval_a officer_n of_o this_o island_n shall_v by_o themselves_o or_o lawful_a deputy_n port-royal_a office_n to_o be_v keep_v on_o port-royal_a keep_v their_o office_n on_o port-royal_a as_o at_o any_o time_n heretofore_o they_o have_v or_o aught_o to_o have_v do_v and_o that_o the_o secretary_n of_o this_o island_n shall_v from_o time_n to_o time_n by_o his_o lawful_a deputy_n keep_v his_o office_n at_o port-royal_a as_o at_o any_o time_n heretofore_o have_v now_o do_v or_o aught_o to_o have_v do_v under_o the_o penalty_n of_o fifty_o pound_n for_o every_o month_n the_o receiver_n general_n naval_a officer_n or_o secretary_n of_o this_o island_n or_o any_o of_o they_o shall_v neglect_v or_o refuse_v to_o do_v the_o same_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o parish_n of_o port-royal_a for_o and_o towards_o the_o wharf_n repair_v and_o maintain_v the_o wharf_n so_o to_o be_v make_v repair_v and_o maintain_v as_o in_o this_o act_n mention_v and_o to_o and_o for_o no_o other_o use_v intent_n or_o purpose_v whatsoever_o to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n by_o action_n of_o debt_n bill_n plaint_n or_o information_n wherein_o the_o market_n shall_v be_v adjudge_v open_a and_o public_a within_o this_o act_n as_o aforesaid_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o from_o and_o after_o the_o ten_o day_n of_o august_n of_o this_o present_a year_n one_o thousand_o six_o hundred_o ninety_o three_o that_o this_o act_n and_o every_o clause_n thereof_o be_v and_o shall_v be_v of_o force_n to_o therefore_o your_o majesty_n most_o dutiful_a and_o loyal_a subject_n the_o assembly_n of_o this_o your_o island_n do_v most_o humble_o beseech_v your_o majesty_n that_o it_o may_v be_v enact_v and_o aforesaid_a and_o no_o long_o the_o exporter_n or_o owner_n shall_v pay_v the_o sum_n of_o twenty_o shilling_n per_fw-la head_n negro_n negro_n as_o a_o impost_n to_o their_o majesty_n all_o which_o negro_n so_o export_v shall_v be_v enter_v in_o the_o receiver-general_n office_n and_o immediate_o bond_n give_v by_o the_o owner_n or_o exporter_n to_o their_o majesty_n for_o the_o payment_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o towards_o the_o repair_v the_o loss_n the_o revenue_n have_v sustain_v by_o the_o wine_n and_o other_o merchandise_n lose_v in_o the_o earthquake_n a_o act_n to_o reimburse_v their_o majesty_n treasury_n and_o encourage_v their_o subject_n to_o come_v and_o settle_v in_o this_o island_n preamble_n preamble_n whereas_o their_o majesty_n revenue_n be_v considerable_o anticipate_v the_o principal_a branch_n of_o which_o be_v the_o custom_n of_o wine_n great_a quantity_n whereof_o be_v lose_v at_o port-royal_a in_o the_o late_a dreadful_a earthquake_n we_o therefore_o your_o majesty_n most_o dutiful_a and_o loyal_a subject_n the_o assembly_n of_o this_o your_o island_n of_o jamaica_n do_v most_o humble_o beseech_v your_o majesty_n that_o it_o may_v be_v enact_v and_o be_v it_o enact_v by_o your_o majesty_n lieutenant-governour_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n of_o the_o same_o that_o from_o and_o after_o the_o seventeen_o day_n of_o november_n in_o this_o present_a year_n one_o thousand_o six_o hundred_o ninety_o three_o shall_v be_v raise_v levy_v and_o additional_a duty_n and_o impost_n on_o the_o several_a liquor_n hereafter_o mention_v over_o and_o above_o what_o be_v already_o payable_a for_o the_o same_o wine_n additional_a duty_n on_o wine_n viz._n for_o every_o tun_n of_o spanish_a and_o madera_n wine_n import_v into_o this_o island_n the_o sum_n of_o forty_o shilling_n all_o wine_n of_o the_o growth_n of_o the_o western_a island_n or_o mixture_n of_o madera_n wines_n with_o those_o of_o the_o western_a island_n the_o sum_n of_o five_o pound_n per_fw-la tun_n for_o every_o tun_n of_o french_a or_o rhenish_a wine_n thirty_o shilling_n for_o every_o tun_n of_o beer_n or_o cider_n four_o shilling_n for_o every_o tun_n of_o mumm_n or_o metheglin_n twenty_o shilling_n for_o every_o gallon_n of_o brandy_n six_o penny_n for_o every_o gallon_n of_o english_a spirit_n three_o penny_n and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n all_o which_o say_v liquor_n shall_v be_v due_o enter_v and_o under_o the_o same_o penalty_n and_o regulation_n as_o in_o a_o former_a act_n of_o this_o country_n entitle_v a_o act_n for_o raise_v a_o public_a revenue_n for_o the_o support_n of_o the_o government_n of_o this_o his_o majesty_n island_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o for_o every_o slave_n export_v from_o this_o island_n by_o way_n of_o merchandise_n the_o exporter_n or_o owner_n shall_v pay_v the_o sum_n of_o twenty_o shilling_n slave_n on_o slave_n as_o a_o impost_n to_o their_o majesty_n for_o and_o during_o the_o term_n and_o time_n of_o five_o year_n aforesaid_a except_v only_o such_o slave_n who_o by_o misdemeanour_n shall_v by_o the_o judgement_n of_o two_o justice_n of_o the_o peace_n and_o three_o freeholder_n be_v order_v to_o be_v transport_v off_o this_o island_n by_o the_o master_n or_o owner_n of_o such_o slave_n or_o slave_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o out_o of_o the_o several_a sum_n or_o sum_n of_o money_n arise_v by_o virtue_n of_o this_o act_n and_o one_o other_o act_n entitle_v a_o act_n to_o reimburse_v their_o majesty_n treasury_n make_v this_o present_a session_n there_o shall_v be_v first_o deduct_v
and_o pay_v unto_o their_o majesty_n majesty_n deduction_n to_o their_o majesty_n to_o and_o for_o the_o use_v of_o their_o majesty_n the_o sum_n of_o one_o thousand_o seven_o hundred_o and_o seventy_o four_o pound_n sixteen_o shilling_n as_o a_o sum_n equivalent_a to_o their_o majesty_n for_o the_o custom_n of_o wine_n lose_v in_o the_o earthquake_n and_o be_v it_o further_o enact_v that_o upon_o due_a proof_n make_v in_o the_o supreme_a court_n of_o judicature_n a_o action_n of_o debt_n shall_v lie_v for_o their_o majesty_n against_o any_o person_n whatsoever_o produce_v bond_n not_o produce_v their_o executor_n administrator_n or_o attorney_n that_o stand_v indebt_v to_o their_o majesty_n for_o custom_n whether_o bond_n be_v give_v or_o not_o without_o be_v oblige_v to_o twenty_o one_o pound_n twelve_o shilling_n joseph_n seargeant_n in_o the_o sum_n of_o one_o hundred_o eighty_o seven_o pound_n four_o shilling_n william_n hutchinson_n in_o the_o sum_n of_o one_o evidence_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a notwithstanding_o settler_n encouragement_n for_o settler_n and_o to_o the_o end_n it_o may_v be_v understand_v what_o sort_n of_o people_n be_v by_o this_o act_n intend_v to_o be_v encourage_v be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o all_o tradesman_n and_o other_o person_n of_o what_o call_v or_o condition_n soever_o not_o able_a to_o pay_v their_o passage_n except_v jew_n cripple_n and_o child_n under_o eleven_o year_n of_o age_n who_o upon_o encouragement_n of_o this_o act_n be_v willing_a to_o transport_v themselves_o to_o this_o island_n shall_v upon_o repair_v to_o any_o master_n or_o commander_n of_o any_o ship_n or_o vessel_n bind_v for_o this_o island_n free_a passage_n pay_v and_o person_n free_a be_v receive_v on_o board_n his_o ship_n or_o vessel_n and_o after_o he_o or_o their_o arrival_n in_o this_o island_n be_v free_a from_o all_o manner_n of_o servitude_n whatsoever_o and_o have_v liberty_n to_o hire_n and_o employ_v he_o her_z or_o themselves_o here_o how_o they_o think_v fit_a in_o any_o honest_a trade_n service_n or_o call_v and_o the_o captain_n master_n or_o commander_n of_o such_o ship_n or_o vessel_n shall_v receive_v of_o the_o treasurer_n name_v and_o appoint_v by_o this_o act_n for_o the_o passage_n of_o every_o person_n so_o transport_v he_o or_o themselves_o from_o england_n or_o scotland_n the_o sum_n of_o seven_o pound_n ten_o shilling_n and_o for_o every_o person_n from_o ireland_n the_o sum_n of_o six_o pound_n currant_n money_n of_o this_o island_n without_o fraud_n or_o delay_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o for_o each_o person_n so_o bring_v hither_o from_o europe_n the_o captain_n encourage_v captain_n etc._n etc._n encourage_v master_n or_o commander_n of_o each_o ship_n or_o vessel_n shall_v for_o his_o encouragement_n and_o to_o his_o own_o use_n receive_v of_o the_o say_a treasurer_n or_o treasurer_n the_o sum_n of_o twenty_o shilling_n per_fw-la head_n over_z and_o above_o the_o say_a sum_n and_o whereas_o several_a of_o their_o majesty_n subject_n under_o the_o qualification_n aforesaid_a reside_v at_o new_a england_n new_a york_n carolina_n or_o other_o part_n of_o america_n the_o windward_n island_n and_o providence_n may_v upon_o the_o encouragement_n of_o this_o act_n be_v willing_a to_o transport_v themselves_o to_o this_o island_n be_v it_o therefore_o enact_v that_o all_o master_n or_o commander_n of_o any_o vessel_n or_o vessel_n that_o shall_v import_n any_o such_o person_n before_o mention_v shall_v for_o every_o person_n so_o bring_v from_o new_a england_n plantation_n person_n from_o other_o plantation_n new_a york_n carolina_n or_o other_o part_n of_o america_n receive_v the_o sum_n of_o three_o pound_n ten_o shilling_n and_o for_o every_o person_n bring_v from_o providence_n and_o the_o windward_n island_n the_o sum_n of_o forty_o shilling_n current_a money_n of_o this_o island_n without_o fraud_n or_o delay_n and_o that_o the_o master_n or_o commander_n of_o every_o vessel_n who_o shall_v import_n any_o person_n by_o encouragement_n of_o this_o act_n from_o new_a england_n new_a york_n carolina_n or_o other_o part_n of_o america_n the_o windward_n island_n and_o providence_n shall_v receive_v the_o sum_n of_o ten_o shilling_n per_fw-la head_n to_z and_o for_o his_o own_o proper_a use_n and_o benefit_n over_o and_o above_o the_o sum_n aforesaid_a for_o the_o passage_n of_o each_o person_n and_o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o master_n or_o master_n of_o any_o vessel_n or_o vessel_n who_o shall_v import_n any_o passenger_n upon_o the_o credit_n of_o this_o act_n shall_v within_o forty_o eight_o hour_n after_o he_o or_o their_o arrival_n deliver_v to_o the_o secretary_n of_o this_o island_n or_o his_o lawful_a deputy_n upon_o oath_n which_o say_v oath_n the_o secretary_n be_v hereby_o impower_v to_o administer_v a_o fair_a write_v list_n of_o all_o such_o person_n as_o he_o give_v a_o list_n to_o be_v give_v or_o they_o shall_v have_v bring_v to_o this_o island_n in_o which_o list_n shall_v be_v contain_v the_o name_n surname_n age_n trade_n and_o country_n of_o all_o and_o every_o the_o say_a person_n and_o person_n as_o also_o if_o single_a or_o marry_a which_o say_v listen_v the_o secretary_n or_o his_o lawful_a deputy_n be_v forthwith_o to_o enter_v in_o a_o book_n to_o be_v keep_v for_o that_o purpose_n and_o then_o to_o transmit_v the_o same_o with_o his_o certificate_n indorsed_n to_o the_o treasurer_n or_o treasurer_n receive_v for_o the_o same_o the_o sum_n of_o two_o shilling_n and_o sixpence_n from_o the_o say_a treasurer_n or_o treasurer_n who_o be_v hereby_o order_v and_o require_v upon_o receipt_n thereof_o to_o pay_v the_o say_a master_n or_o master_n the_o several_a sum_n for_o the_o respective_a passage_n as_o be_v above_o direct_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o for_o the_o well_o and_o true_o assess_v collect_v levy_v and_o pay_v in_o all_o and_o every_o the_o sum_n and_o sum_n of_o money_n arise_v by_o virtue_n of_o this_o
churchwarden_n or_o justice_n who_o do_v by_o virtue_n of_o this_o act_n advance_v and_o pay_v the_o say_a parish-tax_n for_o this_o present_a year_n it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a justice_n and_o vestry_n and_o where_o no_o vestry_n be_v the_o justices_z themselves_o within_o the_o limit_n of_o their_o respective_a commission_n be_v hereby_o require_v and_o impower_v that_o at_o the_o next_o usual_a time_n of_o assess_v their_o parish-tax_n that_o they_o assess_v such_o sum_n or_o sum_n of_o money_n as_o shall_v have_v be_v lend_v and_o advance_v by_o the_o churchwarden_n or_o justice_n as_o be_v above_o require_v which_o money_n so_o assess_v and_o levy_v shall_v be_v by_o the_o churchwarden_n and_o where_o no_o churchwarden_n be_v reimburse_v how_o to_o be_v reimburse_v by_o the_o justice_n within_o the_o limit_n of_o their_o respective_a commission_n pay_v unto_o the_o hand_n of_o the_o person_n so_o lend_v the_o money_n for_o this_o present_a year_n with_o lawful_a interest_n for_o the_o same_o which_o say_v sum_n with_o the_o say_a interest_n shall_v be_v pay_v by_o the_o churchwarden_n or_o justice_n or_o where_o no_o churchwarden_n be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a sum_n yearly_a to_o be_v collect_v as_o aforesaid_a shall_v for_o this_o present_a year_n and_o the_o year_n ensue_v during_o the_o time_n mention_v in_o this_o act_n be_v pay_v by_o the_o churchwarden_n or_o justice_n of_o each_o respective_a parish_n within_o twenty_o one_o day_n after_o their_o receipt_n thereof_o payment_n time_n of_o payment_n into_o the_o hand_n of_o the_o receiver_n or_o receiver_n impower_v to_o receive_v the_o same_o and_o if_o any_o of_o the_o justice_n churchwarden_n vestry-man_n or_o constable_n shall_v neglect_v he_o or_o their_o duty_n in_o assess_v levy_v or_o pay_v the_o say_a sum_n which_o be_v above_o require_v to_o be_v assess_v levy_v and_o pay_v he_o or_o they_o so_o neglect_v or_o fail_v of_o his_o or_o their_o duty_n therein_o shall_v respective_o forfeit_v for_o every_o such_o offence_n the_o sum_n of_o fifty_o pound_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o raise_v and_o pay_v as_o aforesaid_a into_o the_o hand_n of_o the_o say_a receiver_n or_o receiver_n for_o the_o time_n be_v shall_v by_o they_o be_v yearly_o remit_v on_o the_o country_n risque_n in_o such_o manner_n as_o they_o shall_v think_v fit_a into_o the_o hand_n of_o gilbert_n heathcote_n remit_v to_o who_o remit_v bartholomew_n gracedieu_o and_o john_n tutt_n of_o london_n merchant_n or_o any_o one_o of_o they_o or_o such_o other_o person_n or_o person_n as_o shall_v from_o time_n to_o time_n be_v appoint_v to_o solicit_v in_o england_n the_o public_a affair_n of_o this_o island_n as_o occasion_n shall_v require_v and_o as_o to_o they_o shall_v seem_v most_o to_o the_o interest_n and_o advantage_n thereof_o and_o in_o case_n of_o the_o death_n absence_n or_o refusal_n of_o any_o of_o the_o solicitor_n beforementioned_a or_o the_o commissioner_n hereafter_o mention_v in_o this_o act_n that_o then_o the_o person_n remain_v or_o survive_v or_o the_o major_a part_n of_o they_o do_v choose_v to_o themselves_o such_o other_o person_n or_o person_n as_o they_o shall_v think_v fit_a in_o the_o room_n or_o stead_n of_o he_o or_o they_o that_o shall_v remove_v decease_n or_o refuse_v and_o that_o the_o person_n or_o person_n so_o choose_v shall_v here_o and_o in_o england_n each_o for_o themselves_o be_v impower_v to_o act_n as_o full_o to_o all_o intent_n and_o purpose_n in_o each_o place_n as_o if_o he_o or_o they_o have_v be_v mention_v and_o appoint_v by_o name_n in_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o honourable_a samuel_n bernard_n and_o nicholas_n law_n esquire_n and_o james_n bradshaw_n william_n hutchinson_n thomas_n clarke_n james_n banister_n and_o modyford_n freeman_n esquire_n receiver_n commissioner_n and_o receiver_n shall_v be_v and_o be_v hereby_o impower_v and_o appoint_v to_o be_v commissioner_n and_o they_o or_o the_o major_a part_n of_o they_o from_o time_n to_o time_n to_o appoint_v one_o or_o more_o of_o themselves_o to_o be_v receiver_n or_o receiver_n of_o the_o money_n by_o this_o act_n to_o be_v raise_v and_o whereas_o at_o this_o present_a session_n there_o be_v general_a instruction_n draw_v up_o by_o the_o council_n and_o assembly_n for_o direction_n to_o the_o solicitor_n in_o england_n the_o commissioner_n name_v in_o this_o act_n observe_v instruction_n to_o be_v observe_v be_v at_o no_o time_n to_o order_n any_o thing_n contrary_a to_o any_o particular_n contain_v therein_o but_o full_o to_o observe_v and_o be_v direct_v thereby_o any_o thing_n in_o this_o act_n seem_v to_o the_o contrary_a notwithstanding_o which_o say_v instruction_n be_v to_o be_v sign_v by_o the_o clerk_n of_o the_o council_n and_o the_o speaker_n of_o the_o assembly_n and_o be_v enter_v in_o the_o minute_n of_o both_o house_n provide_v nevertheless_o that_o the_o commissioner_n beforementioned_a instruction_n farther_o instruction_n may_v from_o time_n to_o time_n upon_o any_o sudden_a or_o emergent_a occasion_n give_v to_o the_o solicitor_n in_o england_n such_o further_a instruction_n as_o they_o shall_v think_v fit_a for_o the_o public_a service_n of_o this_o island_n and_o in_o case_n it_o shall_v be_v think_v fit_a at_o any_o time_n hereafter_o to_o turn_v out_o or_o alter_v any_o of_o the_o solicitor_n in_o england_n that_o then_o the_o say_a commissioner_n or_o major_a part_n of_o they_o be_v hereby_o impower_v from_o time_n to_o time_n to_o turn_v out_o change_v solicitor_n change_v or_o alter_v as_o aforesaid_a all_o or_o any_o of_o the_o solicitor_n in_o this_o act_n mention_v and_o be_v it_o further_o enact_v that_o the_o person_n or_o person_n so_o name_v to_o be_v receiver_n or_o receiver_n shall_v receive_v and_o pay_v all_o such_o sum_n or_o sum_n of_o money_n as_o shall_v come_v to_o his_o or_o their_o hand_n arise_v by_o virtue_n of_o this_o act_n of_o all_o which_o the_o receiver_n or_o receiver_n for_o the_o time_n be_v shall_v keep_v a_o exact_a and_o distinct_a account_n of_o all_o payment_n and_o remittance_n make_v for_o the_o use_v and_o purpose_v by_o this_o act_n require_v give_v account_v to_o be_v give_v and_o render_v a_o just_a and_o true_a account_n thereof_o when_o demand_v unto_o the_o rest_n of_o the_o commissioner_n in_o this_o act_n nominate_v or_o the_o major_a part_n of_o they_o when_o thereunto_o require_v or_o to_o the_o assembly_n of_o this_o island_n when_o sit_v and_o assemble_v of_o all_o the_o sum_n and_o sum_n of_o money_n by_o he_o or_o they_o receive_v by_o virtue_n of_o this_o act_n and_o how_o lay_v out_o or_o remit_v and_o if_o the_o say_a receiver_n or_o receiver_n for_o the_o time_n be_v after_o the_o receipt_n of_o any_o of_o the_o say_a money_n shall_v divert_v or_o misapply_v the_o same_o or_o any_o part_n thereof_o by_o any_o pretence_n whatsoever_o otherwise_o than_o before_o intend_v and_o direct_v contrary_a to_o the_o true_a intent_n and_o mean_v of_o this_o act_n the_o person_n or_o person_n so_o offend_a shall_v forfeit_v to_o according_a to_o their_o discretion_n and_o forasmuch_o as_o the_o present_a necessity_n will_v require_v the_o advancement_n of_o money_n for_o and_o towards_o the_o buy_v or_o hire_v and_o equip_v for_o and_o towards_o the_o furtherance_n of_o this_o present_a occasion_n such_o sum_n or_o sum_n of_o money_n as_o may_v be_v needful_a and_o that_o whosoever_o shall_v advance_v and_o lend_v any_o such_o sum_n or_o sum_n of_o money_n upon_o the_o security_n of_o this_o act_n shall_v receive_v for_o the_o loan_n of_o the_o sum_n they_o shall_v so_o lend_v after_o the_o rate_n of_o twelve_o pound_n and_o a_o half_a per_fw-la cent._n per_fw-la annum_fw-la for_o the_o time_n he_o or_o they_o shall_v be_v indisbur_v of_o the_o say_a money_n on_o the_o credit_n of_o this_o act_n as_o aforesaid_a any_o thing_n beforementioned_a to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o and_o to_o the_o end_n that_o all_o money_n that_o shall_v be_v lend_v unto_o their_o majesty_n upon_o the_o credit_n hereof_o may_v be_v well_o and_o sufficient_o secure_v same_o security_n for_o the_o same_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o person_n and_o person_n who_o shall_v advance_v and_o lend_v any_o sum_n or_o sum_n of_o money_n to_o their_o majesty_n on_o the_o credit_n of_o this_o act_n and_o actual_o pay_v the_o same_o into_o the_o hand_n of_o the_o receiver_n or_o receiver_n herein_o after_o name_v and_o appoint_v shall_v by_o the_o receiver_n or_o receiver_n on_o the_o first_o payment_n of_o money_n that_o shall_v be_v pay_v into_o the_o receiver_n hand_n by_o virtue_n of_o this_o act_n be_v forthwith_o pay_v unto_o the_o person_n or_o person_n their_o executor_n or_o administrator_n so_o lend_v the_o say_a sum_n advance_v with_o the_o interest_n of_o the_o same_o for_o the_o discharge_v of_o the_o money_n so_o lend_v and_o advance_v and_o that_o all_o and_o every_o other_o sum_n and_o sum_n of_o money_n that_o shall_v be_v lay_v out_o or_o pay_v by_o the_o receiver_n or_o receiver_n for_o and_o towards_o the_o buy_v equip_v victual_v and_o fit_v to_o sea_n as_o also_o for_o pay_v the_o
