do_v arise_v by_o such_o dangerous_a tenet_n and_o unlawful_a assembly_n be_v it_o enact_v by_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o that_o if_o any_o person_n or_o person_n common_o call_v quaker_n or_o any_o other_o separatist_n whatsoever_o in_o this_o colony_n shall_v at_o any_o time_n after_o the_o publish_v this_o act_n in_o the_o several_a respective_a county_n depart_v from_o the_o place_n of_o their_o several_a habitation_n and_o assemble_v themselves_o to_o the_o number_n of_o five_o or_o more_o punish_v quaker_n â—y_a other_o separatist_n and_o case_n the_o party_n so_o offend_a be_v thereof_o lawful_o convict_v by_o the_o verdict_n of_o twelve_o man_n or_o by_o his_o own_o confession_n or_o by_o notorious_a evidence_n of_o the_o fact_n shall_v for_o the_o first_o offence_n each_o person_n forfeit_a and_o pay_v two_o hundred_o pound_n of_o tobacco_n and_o if_o any_o such_o person_n or_o person_n be_v once_o convict_v shall_v again_o offend_v therein_o and_o shall_v in_o form_n aforesaid_a be_v thereof_o lawful_o convict_v shall_v for_o the_o second_o offence_n forfeit_v and_o pay_v five_o hundred_o pound_n of_o tobacco_n to_o be_v levy_v by_o distress_n or_o sale_n of_o the_o good_n of_o the_o party_n so_o convict_v by_o warrant_n from_o any_o one_o justice_n of_o the_o peace_n before_o who_o they_o shall_v be_v so_o convict_v render_v the_o overplus_n to_o the_o owner_n if_o any_o be_v and_o for_o want_v of_o such_o distress_n or_o for_o want_n of_o ability_n of_o any_o person_n among_o they_o to_o pay_v the_o say_v fine_a or_o fine_n than_o it_o shall_v be_v lawful_a to_o levy_v and_o recover_v the_o same_o from_o the_o rest_n of_o the_o separatist_n or_o quaker_n or_o any_o one_o of_o they_o then_o present_a that_o be_v of_o great_a ability_n to_o pay_v the_o say_v fine_a or_o fine_n and_o if_o any_o person_n after_o he_o or_o she_o in_o form_n aforesaid_a colony_n such_o person_n be_v convict_v person_n shall_v arrive_v the_o same_o be_v prove_v by_o sufficient_a evidence_n and_o the_o say_a master_n shall_v be_v further_o enjoin_v to_o carry_v he_o or_o they_o out_o of_o the_o country_n again_o when_o his_o ship_n return_v and_o to_o take_v especial_a care_n to_o secure_v he_o her_z or_o they_o so_o bring_v in_o as_o aforesaid_a from_o spread_v any_o seditious_a tenet_n whilst_o he_o she_o or_o they_o remain_z in_o the_o country_n and_o be_v it_o further_o enact_v fine_v inhabitant_n that_o shall_v entertain_v preach_v quaker_n to_o be_v fine_v that_o any_o person_n or_o person_n inhabitant_n of_o this_o country_n that_o shall_v entertain_v any_o quaker_n in_o or_o near_o their_o house_n to_o teach_v or_o preach_v shall_v likewise_o be_v fine_v five_o thousand_o pound_n of_o tobacco_n for_o each_o time_n they_o do_v so_o entertain_v they_o to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o person_n good_n by_o order_n from_o the_o justice_n of_o the_o peace_n in_o the_o next_o county_n court_n hold_v for_o that_o county_n where_o the_o fact_n be_v commit_v before_o who_o the_o say_a fact_n shall_v be_v by_o evidence_n prove_v and_o be_v it_o further_o enact_v for_o prevention_n of_o neglect_v in_o the_o due_a execution_n of_o this_o act_n by_o any_o magistrate_n or_o magistrate_n officer_n or_o officer_n of_o this_o colony_n that_o in_o case_n any_o justice_n of_o the_o peace_n or_o any_o other_o officer_n shall_v neglect_v the_o performance_n of_o their_o duty_n in_o prosecute_a this_o act_n or_o shall_v direct_o or_o indirect_o connive_v at_o any_o breach_n thereof_o he_o or_o they_o for_o every_o such_o offence_n shall_v be_v fine_v two_o thousand_o pound_n of_o tobacco_n to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o goood_n of_o the_o person_n so_o offend_v he_o or_o they_o be_v thereof_o lawful_o convict_v by_o the_o virdict_n of_o twelve_o man_n by_o his_o own_o confession_n or_o evidence_n of_o fact_n fines_n justice_n of_o peace_n within_o the_o limit_n of_o their_o commission_n to_o hear_v &_o determine_v offence_n of_o this_o kind_n and_o to_o grant_v their_o warrant_n for_o levy_v of_o fines_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o the_o justice_n the_o peace_n in_o their_o several_a county_n shall_v be_v hereafter_o empower_v to_o inquire_v hear_v and_o determine_v all_o and_o every_o the_o offence_n aforesaid_a within_o the_o limit_n of_o their_o commission_n and_o to_o give_v warrant_n for_o the_o levy_n and_o distress_v the_o fine_n upon_o the_o good_n of_o the_o person_n offend_v all_o which_o say_v fines_n mention_v in_o this_o act_n shall_v be_v dispose_v of_o to_o the_o use_n and_o use_n purpose_n and_o purpose_n follow_v viz_o the_o two_o hundred_o and_o five_o hundred_o pound_n of_o tobacco_n impose_v on_o the_o quaker_n and_o other_o separatist_n for_o unlawful_a assemble_v shall_v be_v pay_v half_a to_o the_o informer_n half_a to_o the_o use_n of_o the_o parish_n where_o the_o fact_n be_v commit_v that_o the_o five_o thousand_o pound_n of_o tobacco_n impose_v on_o each_o master_n that_o shall_v bring_v in_o any_o quaker_n of_o levy_n and_o fine_n for_o unlawful_a assembly_n how_o to_o be_v dispose_v of_o shall_v be_v pay_v half_a to_o the_o informer_n half_a to_o the_o use_n of_o the_o parish_n in_o the_o county_n where_o the_o person_n or_o person_n do_v arrive_v that_o the_o five_o thousand_o pound_n of_o tobacco_n impose_v upon_o every_o inhabitant_n that_o shall_v entertain_v as_o aforesaid_a in_o or_o near_o his_o house_n any_o quaker_n shall_v be_v pay_v half_a to_o the_o informer_n half_a to_o the_o parish_n in_o the_o county_n where_o he_o live_v for_o pious_a use_n provide_v always_o
public_a or_o countie-dues_a or_o other_o fee_n as_o aforesaid_a any_o sheriff_n or_o collector_n shall_v at_o any_o time_n make_v seizure_n or_o distress_n of_o more_o tobacco_n than_o be_v at_o that_o time_n due_a from_o the_o debtor_n that_o in_o all_o such_o case_n public_a a_o regulation_n of_o seizure_n make_v of_o tobacco_n due_a to_o the_o public_a the_o person_n seize_v shall_v make_v immediate_a satisfaction_n to_o the_o party_n from_o who_o they_o shall_v make_v such_o seizure_n or_o otherways_o that_o he_o be_v allow_v to_o take_v his_o overplus_a tobacco_n out_o of_o the_o hogshead_n so_o seize_v and_o that_o no_o sheriff_n or_o other_o public_a collector_n shall_v or_o may_v from_o or_o after_o the_o publication_n of_o this_o act_n presume_v to_o make_v seizure_n of_o any_o hogshead_n of_o tobacco_n before_o that_o time_n pay_v away_o and_o mark_v and_o if_o there_o be_v at_o that_o time_n other_o merchantable_a tobacco_n ready_a in_o such_o plantation_n where_o such_o seizure_n be_v make_v and_o which_o shall_v be_v offer_v and_o tender_v by_o the_o debtor_n and_o be_v it_o further_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o the_o justice_n hold_v court_n be_v by_o virtue_n of_o this_o act_n for_o the_o time_n to_o come_v full_o impower_v to_o commissionate_a and_o appoint_v the_o respective_a collector_n or_o collector_n of_o the_o public_a and_o countie-levy_n and_o whereas_o complaint_n have_v be_v make_v that_o sometime_o one_o and_o the_o same_o person_n have_v officiate_v at_o the_o same_o time_n in_o the_o office_n of_o justice_n as_o justice_z of_o the_o peace_n and_o clerk_n of_o the_o countie-court_n which_o have_v be_v find_v inconvenient_a for_o the_o prevention_n whereof_o for_o the_o future_a be_v it_o enact_v by_o this_o present_a grand_a assembly_n time_n no_o person_n shall_v be_v justice_n of_o the_o peace_n or_o high_a sheriff_n and_o clerk_n of_o the_o county-court_n at_o the_o same_o time_n and_o the_o authority_n thereof_o that_o no_o person_n whatsoever_o shall_v be_v capable_a at_o the_o same_o time_n of_o be_v a_o justice_n of_o the_o peace_n and_o clerk_n of_o the_o county-court_n or_o be_v at_o one_o and_o the_o same_o time_n high_a sheriff_n of_o the_o county_n and_o county-court-clerk_n and_o for_o the_o great_a ease_n of_o the_o inhabitant_n of_o this_o country_n be_v it_o enact_v by_o this_o present_a grand_a assembly_n action_n the_o county-clerk_n may_v depute_v the_o high_a sheriff_n or_o vnder-sheriff_n to_o enter_v action_n and_o the_o authority_n thereof_o and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o the_o publication_n of_o this_o act_n it_o shall_v and_o may_v be_v lawful_a for_o the_o county-court_n clerk_n to_o depute_v the_o high_a sheriff_n or_o under-sheriff_n of_o the_o county_n to_o enter_v such_o action_n as_o shall_v be_v bring_v to_o they_o or_o either_o of_o they_o and_o that_o such_o entry_n be_v hold_v good_a in_o law_n and_o for_o the_o better_a guide_n of_o the_o county-court_n and_o more_o sure_a administration_n of_o justice_n be_v it_o enact_v by_o this_o present_a grand_a assembly_n and_o the_o authority_n thereof_o that_o such_o of_o the_o honourable_a council_n of_o state_n as_o will_v please_v at_o any_o time_n to_o fit_v in_o any_o court_n of_o virginia_n shall_v and_o may_v have_v equal_a vote_n with_o every_o justice_n of_o the_o peace_n of_o or_o belong_v to_o the_o say_a court_n and_o that_o such_o counsellor_n so_o sit_v with_o the_o court_n be_v by_o the_o clerk_n enter_v to_o sit_v there_o virginia_n member_n of_o the_o council_n of_o state_n may_v sit_v in_o any_o court_n in_o virginia_n and_o be_v equal_o liable_a and_o responsible_a with_o every_o other_o justice_n of_o peace_n for_o all_o such_o act_n or_o order_n of_o court_n he_o shall_v at_o any_o time_n 64th_o act_n in_o the_o print_a book_n do_v empower_v the_o county-court_n to_o grant_v probates_n and_o administration_n which_o probates_n and_o administration_n be_v usual_o sign_v by_o the_o right_n honourable_a the_o governor_n administration_n any_o two_o justice_n of_o the_o quorum_fw-la may_v sign_v probates_n of_o will_n and_o letter_n of_o administration_n which_o be_v not_o only_o burdensome_a to_o his_o honour_n but_o inconvenient_a to_o the_o inhabitant_n be_v it_o enact_v that_o from_o &_o after_o publication_n hereof_o it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o the_o quorum_fw-la in_o their_o respective_a county_n to_o sign_v such_o probates_n and_o letter_n of_o administration_n and_o the_o same_o so_o sign_v shall_v be_v hold_v and_o deem_v good_a in_o law_n provide_v always_o that_o certificate_n thereof_o be_v send_v to_o mr._n secretataries_n office_n as_o be_v provide_v by_o the_o aforesaid_a act_n of_o assembly_n ix_o a_o act_n repeal_n the_o act_n allow_v free_a tythable_n to_o divers_a person_n whereas_o by_o several_a act_n of_o assembly_n it_o be_v provide_v that_o every_o respective_a councillor_n and_o ten_o of_o his_o family_n shall_v be_v free_a from_o pay_v any_o public_a or_o county-levy_n and_o also_o that_o every_o minister_n and_o six_o tythable_n for_o their_o attendance_n at_o james_n city_n in_o general_a court-time_n and_o time_n of_o assembly_n be_v free_a from_o pay_v levy_n which_o law_n be_v find_v unequal_a and_o inconvenient_a be_v it_o therefore_o enact_v by_o the_o governor_n attend_v general_a court_n and_o assembly_n over_o and_o beside_o the_o two_o hundred_o and_o fifty_o pound_n sterling_a according_a to_o several_a act_n and_o order_n of_o assembly_n usual_o heretofore_o pay_v they_o one_o hundred_o pound_n sterling_a which_o together_o with_o the_o say_v two_o hundred_o and_o fifty_o pound_n sterling_a make_v in_o the_o whole_a three_o hundred_o and_o fifty_o pound_n sterling_a and_o that_o all_o the_o say_v three_o hundred_o and_o fifty_o pound_n sterling_a to_o be_v annual_o pay_v as_o aforesaid_a court_v allowance_n to_o the_o councillor_n attend_v at_o general_n court_v shall_v be_v distribute_v and_o proportion_v among_o the_o several_a councillor_n attend_v at_o general_n court_n and_o assembly_n according_a to_o their_o attendance_n at_o the_o same_o proportionable_o which_o distribution_n and_o proportion_v shall_v be_v annual_o make_v by_o the_o right_n honourable_a the_o governor_n and_o the_o several_a councillor_n according_a to_o their_o attendance_n more_o or_o less_o at_o general_a court_n or_o assembly_n and_o be_v it_o further_o enact_v by_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o there_o be_v annual_o pay_v out_o of_o the_o say_a impost_n money_n to_o such_o minister_n or_o minister_n as_o by_o the_o right_n honourable_a the_o governor_n shall_v be_v appoint_v and_o shall_v attend_v at_o general_a court_n or_o assembly_n five_o pound_n sterling_a for_o their_o attendance_n court_n minister_n to_o have_v 5_o pound_n allow_v he_o for_o his_o
act_n for_o presentation_n and_o delivery_n of_o grievance_n for_o as_o much_o as_o it_o have_v be_v the_o frequent_a practice_n of_o ill_o dispose_v and_o seditious_a person_n to_o deliver_v to_o their_o burgess_n and_o they_o to_o the_o assembly_n scandalous_a and_o seditious_a paper_n and_o to_o entitle_v or_o call_v they_o the_o grievance_n of_o such_o county_n or_o county_n wherein_o they_o dwell_v neither_o give_v or_o present_v the_o same_o in_o lawful_a manner_n nor_o in_o truth_n be_v know_v to_o any_o other_o of_o his_o majesty_n good_a subject_n of_o such_o county_n who_o title_n they_o bear_v be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n sign_v sberiff_n of_o each_o county_n shall_v general_n assembly_n and_o it_o be_v hereby_o enact_v that_o from_o and_o after_o publication_n of_o this_o act_n it_o shall_v not_o be_v lawful_a for_o any_o person_n or_o person_n whatsoever_o to_o export_v out_o of_o this_o his_o majesty_n colony_n of_o virginia_n any_o untainted-hides_a or_o deer-skin_n upon_o the_o penalty_n of_o pay_v for_o every_o raw-hide_a or_o deer-skin_n one_o hundred_o pound_n of_o tobacco_n and_o cask_n that_o shall_v be_v find_v on_o board_n any_o ship_n boat_n sloop_n or_o other_o vessel_n in_o order_n to_o such_o exportation_n over_o and_o beside_o the_o forfeiture_n of_o all_o such_o raw-hides_a or_o deer-skin_n so_o find_v in_o exportation_n the_o one_o half_a to_o his_o majesty_n his_o heir_n and_o successor_n and_o the_o other_o half_a to_o he_o that_o shall_v make_v information_n thereof_o and_o all_o collector_n of_o the_o two_o shilling_n per_fw-la hogshead_n and_o penny_n per_fw-la pound_n custom_n be_v hereby_o require_v and_o enjoin_v on_o every_o information_n and_o suspicion_n of_o such_o exportation_n to_o make_v diligent_a search_n and_o seizure_n according_o xiii_o a_o act_n prohibit_v unlawful_a disturbance_n of_o divine_a service_n be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o consent_n of_o the_o general_n assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n all_o and_o all_o manner_n of_o log_n tree_n root_n of_o tree_n and_o other_o rubbish_n as_o may_v any_o way_n hurt_v and_o endanger_v any_o sloop_n boat_n or_o other_o vessel_n from_o out_o of_o obtain_v from_o they_o for_o the_o patent_v thereof_o neither_o shall_v the_o first_o petitioner_n for_o any_o deserted_n land_n be_v deny_v of_o have_v the_o first_o grant_v he_o make_v his_o right_n appear_v when_o he_o petition_n for_o the_o land_n and_o whereas_o the_o former_a act_n concern_v deserted_n land_n reserve_v to_o the_o first_o taker_n up_o his_o right_n to_o take_v up_o land_n in_o and_o choose_v as_o also_o their_o horse_n arm_n and_o furniture_n out_o of_o those_o who_o be_v now_o there_o or_o aught_o to_o be_v there_o by_o each_o respective_a commander_n proportional_o out_o enjoin_v upon_o notice_n to_o he_o or_o they_o give_v of_o any_o skin_n iron_n wool_n woolfels_n hides_n tan_v or_o untan_v of_o any_o deer_n ox_n steer_v bull_n cow_n or_o calf_n be_v on_o board_n any_o ship_n sloop_n or_o vessel_n or_o of_o any_o opposition_n resistance_n make_v in_o the_o seizure_n thereof_o to_o issue_v out_o his_o warrant_n to_o the_o high-sheriff_n under-sheriff_n constable_n or_o other_o officer_n require_v they_o to_o go_v on_o board_n such_o ship_n sloop_n or_o vessel_n and_o there_o to_o make_v diligent_a search_n and_o seizure_n of_o the_o say_a hide_n skin_n iron_n wool_n woolfels_n or_o any_o leather_n tan_v or_o untan_v find_v on_o board_n the_o ship_n sloop_n or_o vessel_n or_o if_o any_o justice_n or_o justice_n of_o the_o peace_n upon_o request_n to_o he_o or_o they_o make_v refuse_v or_o neglect_v to_o issue_n out_o warrant_v or_o any_o sheriff_n under-sheriff_n or_o other_o officer_n shall_v refuse_n to_o execute_v such_o warrant_n he_o or_o they_o so_o offend_v shall_v forfeit_v three_o thousand_o pound_n of_o tobacco_n and_o cask_n or_o if_o any_o person_n or_o person_n act._n penalty_n upon_o such_o justice_n sheriff_n and_o other_o as_o shall_v not_o give_v due_a obedience_n to_o this_o act._n shall_v upon_o command_n make_v to_o he_o in_o his_o majesty_n name_n refuse_v to_o be_v aid_v or_o assist_v to_o such_o sheriff_n or_o other_o officer_n in_o the_o execution_n of_o such_o warrant_n every_o such_o person_n so_o offend_v shall_v forfeit_v the_o sum_n of_o one_o thousand_o pound_n of_o tobacco_n with_o cask_n one_o half_a of_o all_o such_o fine_n and_o forfeiture_n to_o be_v pay_v to_o the_o king_n majesty_n and_o the_o other_o half_a to_o he_o or_o they_o that_o will_v inform_v to_o be_v recover_v as_o be_v before_o direct_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o collector_n in_o this_o country_n shall_v at_o the_o entry_n of_o every_o ship_n or_o vessel_n acquaint_v every_o master_n of_o such_o ship_n or_o vessel_n with_o this_o act_n and_o enter_v a_o particular_a clause_n in_o the_o condition_n of_o their_o entry-bond_n for_o the_o performance_n of_o the_o same_o provide_v always_o and_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o if_o any_o person_n or_o person_n shall_v hereafter_o be_v sue_v or_o
