any_o master_n of_o a_o ship_n or_o other_o vessel_n or_o any_o officer_n or_o mariner_n belong_v thereto_o shall_v receive_v such_o provision_n not_o mark_v and_o seal_v as_o aforesaid_a aboard_o any_o of_o their_o ship_n or_o vessel_n he_o or_o they_o who_o shall_v offend_v therein_o shall_v forfeit_v double_a the_o value_n of_o all_o such_o provision_n and_o he_o that_o own_v the_o provision_n shall_v forfeit_v the_o same_o and_o if_o any_o cooper_n seal_v penalty_n for_o shift_a of_o provision_n after_o seal_v or_o other_o person_n shall_v shift_v any_o fish_n or_o flesh_n either_o on_o board_n or_o on_o shore_n after_o the_o same_o have_v be_v so_o seal_v and_o mark_v by_o the_o packer_n and_o ship_n and_o export_v the_o same_o the_o packer_n have_v not_o allow_v may_v probable_o discover_v the_o condition_n of_o the_o whole_a and_o if_o any_o be_v decay_v or_o deceitful_o deal_v with_o the_o packer_n shall_v cull_v and_o repack_v the_o same_o so_o as_o to_o distinguish_v and_o mark_v they_o for_o merchantable_a or_o refuse_v according_a to_o their_o condition_n and_o if_o those_o who_o ship_n or_o export_v any_o such_o provision_n shall_v neglect_v or_o refuse_v such_o second_o search_n or_o survey_v the_o packer_n be_v hereby_o order_v and_o empower_v to_o deface_v his_o former_a mark_n and_o for_o so_o do_v shall_v be_v pay_v as_o if_o he_o have_v repackt_v the_o same_o and_o if_o the_o owner_n refuse_v to_o satisfy_v the_o packer_n such_o packer_n shall_v have_v redress_n on_o complaint_n to_o any_o justice_n of_o the_o peace_n who_o be_v hereby_o empower_v to_o compel_v the_o payment_n thereof_o by_o distress_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o tarr_n that_o shall_v be_v expose_v to_o sale_n within_o this_o province_n tarr_n assize_n of_o cask_n for_o tarr_n shall_v be_v in_o barrel_n half_a barrel_n and_o three_o of_o a_o barrel_n of_o the_o measure_n and_o assize_n follow_v that_o be_v to_o say_v the_o barrel_n to_o contain_v thirty_o gallon_n the_o half_a barrel_n and_o three_o of_o a_o barrel_n of_o the_o same_o cage_n proportionable_o and_o in_o no_o other_o cask_n whatsoever_o and_o all_o cask_n to_o be_v make_v of_o the_o same_o assize_n and_o brand_v by_o the_o cooper_n as_o aforesaid_a on_o pain_n of_o forfeiture_n of_o all_o such_o cask_n as_o be_v not_o of_o due_a assize_n and_o if_o any_o tarr_n shall_v be_v expose_v to_o sale_n in_o any_o cask_n not_o brand_v as_o aforesaid_a the_o same_o shall_v be_v likewise_o forfeit_v and_o further_o it_o be_v enact_v by_o the_o authority_n aforesaid_a informer_n one_o half_n of_o the_o fine_n &_o forfeiture_n to_o be_v unto_o their_o majesty_n and_o the_o other_o half_a to_o the_o informer_n that_o all_o fine_n penalty_n and_o forfeiture_n arise_v by_o force_n and_o virtue_n of_o this_o act_n shall_v be_v the_o one_o half_a to_o their_o majesty_n towards_o the_o support_n of_o the_o government_n of_o this_o province_n and_o the_o other_o half_a to_o he_o or_o they_o that_o shall_v inform_v and_o sue_v for_o the_o same_o in_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a fish_n measurer_n of_o salt_n and_o culler_n of_o fish_n that_o there_o be_v a_o measurer_n of_o salt_n and_o grill_a of_o fish_n in_o every_o seaport_n town_n within_o this_o province_n to_o be_v appoint_v as_o aforesaid_a who_o be_v likewise_o swear_v for_o the_o faithful_a discharge_n of_o that_o office_n shall_v cull_v all_o merchantable_a fish_n and_o measure_v all_o salt_n that_o shall_v be_v import_v and_o sell_v out_o of_o any_o ship_n or_o other_o vessel_n and_o shall_v have_v three-halfe-pence_n for_o every_o hogshead_n of_o salt_n by_o he_o so_o measure_v to_o be_v pay_v the_o one_o half_a by_o the_o buyer_n the_o other_o half_o by_o the_o seller_n and_o one_o penny_n per_fw-la quintal_n for_o every_o quintal_n of_o merchantable_a fish_n by_o he_o cull_v to_o be_v pay_v one_o half_a by_o the_o buyer_n and_o the_o other_o half_a by_o the_o seller_n a_o act_n for_o the_o punish_n of_o criminal_a offender_n be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o swear_v curse_v and_o swear_v that_o if_o any_o person_n or_o person_n shall_v profane_o swear_v or_o curse_n in_o the_o hear_n of_o any_o justice_n of_o the_o peace_n or_o shall_v be_v thereof_o convict_v by_o the_o oath_n of_o two_o witness_n or_o confession_n of_o the_o party_n before_o any_o justice_n or_o justice_n of_o the_o peace_n every_o such_o offender_n shall_v forfeit_v and_o pay_v unto_o the_o use_n of_o the_o poor_a of_o the_o town_n where_o the_o offence_n shall_v be_v commit_v the_o sum_n of_o five_o shilling_n and_o if_o the_o offender_n be_v not_o able_a to_o pay_v the_o say_a sum_n then_o to_o be_v set_v in_o the_o stock_n not_o exceed_v two_o hour_n and_o if_o any_o person_n shall_v utter_v more_o profane_a oath_n or_o curse_n at_o the_o same_o time_n and_o in_o hear_v of_o the_o same_o person_n or_o person_n he_o shall_v forfeit_v and_o pay_v to_o the_o use_n aforesaid_a the_o sum_n of_o twelve_o penny_n for_o every_o oath_n or_o curse_n after_o the_o first_o or_o be_v set_v in_o the_o stock_n three_o hour_n provide_v that_o every_o offence_n against_o this_o law_n shall_v be_v complain_v of_o and_o prove_v as_o aforesaid_a within_o thirty_o day_n next_o after_o the_o offence_n commit_v presumption_n presumption_n further_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n drunkenness_n drunkenness_n convict_v of_o drunkenness_n by_o view_n of_o any_o justice_n of_o peace_n confession_n of_o the_o party_n or_o oath_n of_o two_o witness_n such_o person_n so_o convict_v shall_v forfeit_v and_o pay_v unto_o the_o use_n of_o the_o poor_a of_o the_o town_n where_o such_o offence_n be_v commit_v the_o sum_n of_o five_o shilling_n for_o every_o such_o offence_n and_o if_o the_o offender_n be_v unable_a to_o pay_v the_o say_a sum_n to_o be_v set_v in_o the_o stock_n not_o exceed_v three_o hour_n at_o the_o discretion_n of_o the_o justice_n or_o justice_n before_o who_o the_o conviction_n shall_v be_v and_o upon_o a_o second_o conviction_n of_o drunkenness_n every_o such_o offender_n over_o and_o above_o the_o penalty_n aforesaid_a shall_v be_v bind_v with_o two_o surety_n in_o the_o sum_n of_o ten_o pound_n with_o condition_n for_o the_o good_a behaviour_n and_o for_o want_v of_o such_o surety_n shall_v be_v send_v to_o the_o common_a goal_n until_o he_o find_v the_o same_o provide_v that_o no_o person_n shall_v be_v impeach_v or_o molest_v for_o any_o offence_n against_o this_o act_n unless_o he_o shall_v be_v thereof_o present_v indict_v or_o convict_v within_o six_o month_n after_o the_o offence_n commit_v and_o the_o justice_n or_o justice_n before_o who_o conviction_n of_o any_o of_o the_o aforesaid_a offence_n shall_v be_v be_v hereby_o empower_v and_o authorize_v to_o restrain_v or_o commit_v the_o offender_n until_o the_o fine_a impose_v for_o such_o offence_n be_v satisfy_v or_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n by_o warrant_n direct_v to_o the_o constable_n return_v the_o overplus_a if_o any_o be_v all_o such_o fine_n to_o be_v levy_v within_o one_o week_n next_o after_o such_o conviction_n and_o deliver_v to_o the_o select_a man_n or_o overseer_n of_o the_o poor_a for_o the_o use_v of_o the_o poor_a as_o aforesaid_a it_o be_v further_a enact_v and_o ordain_v by_o
order_n in_o each_o respective_a town_n within_o this_o province_n shall_v warn_v a_o meeting_n of_o such_o town_n have_v order_n for_o the_o same_o in_o write_v on_o pain_n that_o every_o constable_n neglect_v his_o duty_n in_o that_o respect_n and_o be_v thereof_o convict_v before_o one_o justice_n of_o the_o peace_n shall_v forfeit_v the_o sum_n of_o twenty_o shilling_n neglect_v penalty_n for_o neglect_v to_o the_o use_v of_o the_o poor_a of_o such_o town_n and_o to_o be_v levy_v by_o distress_n and_o sale_n of_o such_o offender_n good_a by_o warrant_n from_o such_o justice_n of_o the_o of_o the_o next_o justice_n of_o the_o peace_n within_o the_o same_o county_n such_o justice_n by_o his_o warrant_n direct_v to_o the_o constable_n or_o constable_n may_v order_v a_o meeting_n of_o the_o inhabitant_n of_o such_o town_n therein_o signify_v the_o occasion_n thereof_o a_o act_n for_o make_v of_o land_n and_o tenement_n liable_a to_o the_o payment_n of_o debt_n whereas_o the_o estate_n of_o person_n within_o this_o province_n do_v chief_o consist_v of_o house_n and_o land_n which_o give_v they_o credit_n some_o be_v remiss_a in_o pay_v of_o their_o just_a debt_n other_o the_o payment_n of_o all_o just_a debt_n owe_v by_o such_o person_n as_o well_o as_o his_o personal_a estate_n and_o shall_v be_v liable_a to_o be_v take_v in_o execution_n for_o satisfaction_n of_o the_o same_o where_o the_o debtor_n or_o his_o attorney_n shall_v not_o expose_v to_o view_v and_o tender_a to_o the_o officer_n personal_n estate_n sufficient_a to_o answer_v the_o sum_n mention_v in_o the_o execution_n with_o the_o charge_n and_o all_o execution_n due_o serve_v upon_o any_o such_o house_n and_o land_n be_v return_v into_o the_o clerk_n office_n of_o the_o court_n out_o of_o which_o the_o same_o issue_v and_o there_o record_v shall_v make_v a_o good_a title_n to_o the_o party_n for_o who_o they_o be_v so_o take_v his_o heir_n and_o assign_v for_o ever_o debt_n superior_a court_n may_v empower_v executor_n administrator_n to_o sell_v land_n for_o payment_n of_o debt_n also_o where_o the_o good_n and_o movable_n of_o any_o person_n decease_a shall_v not_o be_v sufficient_a to_o answer_v the_o just_a debt_n which_o the_o decease_a owe_v upon_o representation_n thereof_o and_o make_v the_o same_o to_o appear_v unto_o the_o superior_a court_n within_o the_o county_n where_o such_o decease_a person_n last_o dwell_v the_o say_a court_n be_v hereby_o empower_v to_o licence_n and_o authorize_v the_o executor_n or_o administrator_n of_o such_o person_n decease_a to_o make_v sale_n of_o all_o or_o any_o part_n of_o the_o house_n and_o land_n of_o the_o decease_a so_o far_o as_o shall_v be_v necessary_a to_o satisfy_v the_o just_a debt_n which_o the_o purchaser_n and_o further_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o where_o any_o person_n shall_v make_v sale_n or_o other_o alienation_n of_o any_o land_n or_o tenement_n to_o he_o of_o right_n belong_v with_o intent_n to_o defeat_v and_o defraud_v his_o creditor_n of_o their_o just_a debs_n not_o bona_fw-la fide_fw-la for_o good_a and_o valuable_a consideration_n pay_v all_o such_o sales_n and_o alienation_n be_v to_o be_v deem_v covenous_a and_o fraudulent_a and_o shall_v be_v of_o none_o effect_v to_o bar_n any_o creditor_n from_o such_o debt_n as_o be_v to_o he_o owe_v a_o act_n for_o due_a regulation_n of_o weight_n and_o measure_n to_o the_o end_n that_o weight_n and_o measure_n may_v be_v one_o and_o the_o same_o throughout_o this_o their_o majesty_n province_n be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o brass_n and_o copper_n weight_n and_o measure_n former_o send_v out_o of_o england_n with_o certificate_n out_o of_o their_o majesty_n exchequer_n to_o be_v approve_v winchester_n measure_n according_a to_o the_o standard_n in_o the_o exchequer_n be_v the_o public_a allow_v standard_n throughout_o this_o their_o majesty_n province_n for_o the_o prove_v and_o seal_v all_o weight_n and_o measure_n thereby_o and_o the_o constable_n of_o every_o town_n throughout_o this_o province_n not_o already_o supply_v shall_v within_o three_o month_n next_o come_n provide_v upon_o the_o town_n charge_v one_o bushel_n one_o half_a bushel_n one_o peck_n one_o half_a peck_n one_o ale_n quart_n one_o wine-pint_n and_o half-pint_n one_o ell_n one_o yard_n one_o sett_n of_o brass_n weight_n to_o four_o pound_n after_o sixteen_o ounce_n to_o the_o pound_n with_o fit_a scale_n and_o steel_n beam_n try_v and_o prove_v by_o the_o aforesaid_a standard_n and_o seal_v by_o the_o treasurer_n or_o his_o deputy_n in_o his_o presence_n which_o shall_v be_v keep_v and_o use_v only_o for_o standard_n in_o the_o several_a town_n who_o be_v hereby_o authorize_v to_o do_v the_o same_o for_o which_o he_o shall_v receive_v from_o the_o constable_n of_o each_o town_n twopence_n for_o every_o weight_n and_o measure_n so_o try_v and_o prove_v and_o seal_v and_o the_o constable_n of_o every_o town_n shall_v commit_v those_o weight_n and_o measure_n unto_o the_o custody_n of_o the_o select-man_n of_o their_o town_n for_o the_o time_n be_v who_o with_o the_o constable_n be_v hereby_o enjoin_v to_o choose_v one_o able_a man_n for_o sealer_n of_o all_o weight_n and_o measure_n for_o their_o town_n from_o time_n to_o time_n and_o till_o another_o be_v choose_v who_o shall_v be_v present_v unto_o weight_n and_o measure_n so_o seal_v one_o penny_n from_o the_o owner_n thereof_o at_o the_o first_o seal_v and_o all_o such_o weight_n and_o measure_n as_o can_v be_v bring_v to_o their_o just_a standard_n he_o shall_v deface_v and_o destroy_v and_o after_o the_o first_o seal_v shall_v have_v nothing_o so_o long_o as_o they_o continue_v just_a with_o the_o standard_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n select_a man_n or_o sealer_n do_v not_o due_o execute_v this_o law_n so_o far_o as_o to_o each_o &_o every_o of_o they_o appertain_v they_o &_o each_o of_o they_o shall_v forfeit_v to_o their_o majesty_n for_o every_o such_o neglect_n by_o the_o space_n of_o one_o month_n the_o sum_n of_o forty_o shilling_n towards_o the_o support_n of_o their_o government_n here_o and_o every_o person_n neglect_v to_o bring_v in_o their_o weight_n &_o measure_n at_o the_o time_n and_o place_n appoint_v be_v due_o warn_v thereto_o shall_v likewise_o forfeit_v three_o shilling_n and_o fourpence_n the_o one_o half_n whereof_o to_o be_v to_o their_o majesty_n as_o aforesaid_a the_o other_o half_o to_o the_o sealer_n aforesaid_a of_o his_o duty_n in_o not_o levy_v and_o pay_v unto_o the_o treasurer_n his_o deputy_n or_o deputy_n such_o sum_n and_o sum_n of_o money_n as_o from_o time_n to_o time_n he_o shall_v have_v receive_v and_o as_o aught_o by_o he_o to_o have_v be_v pay_v within_o the_o respective_a time_n set_v and_o limit_v by_o the_o warrant_n or_o estreat_n to_o he_o commit_v pursuant_n to_o the_o act_n of_o upon_o demand_n make_v by_o the_o constable_n or_o collector_n of_o the_o town_n place_n or_o precinct_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o constable_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v distrein_o constable_n or_o collector_n power_n to_o distrein_o and_o require_v for_o he_o within_o the_o say_v four_o day_n than_o the_o say_a distress_n or_o distress_n to_o be_v apprize_v by_o two_o or_o three_o of_o the_o inhabitant_n where_o the_o distress_n be_v take_v and_o to_o be_v sell_v by_o the_o say_a officer_n for_o payment_n of_o the_o say_a money_n and_o the_o overplus_n come_v by_o the_o say_a sale_n if_o any_o be_v over_o and_o above_o the_o charge_n of_o take_v and_o keep_v the_o say_a distress_n or_o distress_n to_o be_v immediate_o restore_v to_o the_o owner_n and_o if_o any_o person_n or_o person_n assess_v as_o aforesaid_a shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o twenty_o day_n after_o demand_v thereof_o where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o same_o may_v be_v levy_v in_o every_o such_o case_n person_n for_o want_v of_o distress_n to_o commit_v the_o person_n two_o or_o more_o of_o the_o select-man_n or_o assessor_n in_o such_o town_n be_v hereby_o authorize_v by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o person_n or_o person_n to_o the_o common_a goal_n there_o to_o be_v keep_v without_o baill_n or_o further_a enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o governor_n and_o council_n 〈◊〉_d and_o hereby_o be_v empower_v to_o borrow_v and_o take_v up_o upon_o loan_n of_o any_o person_n or_o person_n any_o such_o and_o sum_n of_o money_n not_o exceed_v five_o thousand_o pound_n upon_o the_o credit_n of_o this_o act_n and_o to_o make_v over_o and_o give_v for_o security_n unto_o the_o person_n and_o person_n so_o lend_v the_o one_o three_o part_n of_o the_o money_n grant_v and_o to_o be_v collect_v by_o virtue_n of_o the_o same_o for_o the_o repayment_n of_o the_o money_n that_o shall_v be_v lend_v with_o interest_n for_o forbearance_n after_o the_o rate_n of_o seven_o per_n cent_z per_fw-la annum_fw-la the_o say_a interest_n money_n to_o be_v pay_v at_o the_o the_o bill_n of_o credit_n emit_v by_o the_o late_a government_n of_o the_o massachusetts_n coleny_n have_v be_v and_o be_v daily_o bring_v in_o to_o their_o majesty_n treasury_n of_o this_o their_o province_n payment_n bill_n of_o credit_n make_v carrant_v in_o public_a payment_n and_o employ_v in_o payment_n or_o the_o public_a debt_n thereof_o there_o be_v but_o few_o of_o those_o bill_n now_o stand_v out_o except_o what_o be_v borrow_v by_o the_o present_a government_n it_o be_v therefore_o enact_v that_o all_o the_o say_a bill_n as_o well_o those_o not_o endors't_n as_o other_o shall_v be_v receive_v in_o payment_n of_o all_o tax_n or_o assessment_n and_o other_o public_a payment_n whatsoever_o at_o five_o pound_n per_fw-la centum_fw-la advance_v any_o act_n or_o law_n to_o the_o contrary_a notwithstanding_o and_o that_o those_o that_o have_v lend_v their_o bill_n to_o the_o treasury_n shall_v have_v the_o same_o allowance_n of_o five_o pound_n per_fw-la centum_fw-la for_o so_o much_o as_o shall_v be_v repay_v they_o by_o discount_n bona_fw-la fide_fw-la on_o their_o own_o account_n with_o the_o treasurer_n for_o rate_n impost_n or_o excise_n a_o act_n for_o the_o better_a secure_v the_o liberty_n of_o the_o subject_a and_o for_o prevention_n of_o illegal_a imprisonment_n for_o the_o speedy_a relief_n of_o all_o person_n imprison_v for_o criminal_a or_o suppose_a criminal_a matter_n in_o such_o case_n where_o by_o law_n they_o be_v bailable_a be_v it_o enact_v by_o the_o governor_n council_n and_o representative_n in_o general_a assembly_n convene_v
