thereupon_o in_o any_o court_n of_o record_n within_o this_o island_n and_o if_o such_o mortgagee_n shall_v not_o within_o three_o month_n after_o request_n and_o tender_v make_v for_o his_o reasonable_a charge_n repair_v to_o the_o office_n of_o enrolment_n and_o there_o make_v such_o acknowledgement_n as_o aforesaid_a he_o she_o or_o they_o so_o refuse_v shall_v for_o every_o such_o offence_n forfeit_a and_o pay_v unto_o the_o party_n or_o party_n aggrieve_v the_o sum_n of_o fifty_o pound_n currant_n money_n of_o this_o island_n to_o be_v recover_v in_o any_o of_o his_o majesty_n court_n of_o record_n within_o this_o island_n by_o bill_n plaint_n or_o information_n wherein_o no_o essoign_n wager_n of_o law_n or_o protection_n shall_v be_v allow_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o judge_n before_o who_o such_o acknowledgement_n of_o deed_n or_o other_o write_n and_o copy_v a_o ordinary_a deed_n grant_v or_o patent_n for_o one_o or_o more_o parcel_n of_o land_n or_o any_o deed_n or_o conveyance_n not_o exceed_v the_o length_n of_o such_o patent_n five_o shilling_n for_o every_o deed_n exceed_v the_o length_n aforesaid_a eight_o penny_n per_fw-la sheet_n account_v twenty_o line_n to_o a_o sheet_n and_o eight_o word_n to_o a_o line_n for_o every_o short_a write_v not_o exceed_v the_o length_n aforesaid_a twelve_o penny_n for_o record_v every_o plot_n one_o shilling_n and_o three_o penny_n for_o search_v the_o record_n twelve_o penny_n and_o for_o acknowledge_v satisfaction_n in_o the_o margin_n of_o a_o mortgage_n record_v one_o shilling_n and_o three_o penny_n and_o no_o more_o under_o the_o penalty_n of_o ten_o pound_n to_o the_o use_v and_o to_o be_v recover_v as_o aforesaid_a and_o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o all_o patent_n already_o grant_v and_o not_o enrol_v shall_v be_v enrol_v in_o the_o office_n of_o enrolment_n within_o six_o month_n and_o all_o patent_n hereafter_o to_o be_v grant_v shall_v be_v enrol_v within_o six_o month_n after_o the_o seal_v such_o patent_n which_o enrolment_n as_o likewise_o all_o such_o as_o be_v already_o there_o enrol_v shall_v be_v good_a and_o valid_a in_o the_o law_n notwithstanding_o any_o clause_n insert_v in_o the_o say_a patent_n direct_v the_o contrary_a and_o whereas_o it_o be_v most_o manifest_a that_o the_o estate_n of_o several_a orphan_n have_v be_v preserve_v and_o vast_o improve_v by_o be_v during_o their_o minority_n lease_v out_o by_o their_o guardian_n and_o whereas_o it_o may_v be_v disputable_a whether_o such_o lease_n be_v warrant_v by_o the_o law_n of_o england_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o lease_n heretofore_o make_v or_o grant_v or_o that_o hereafter_o shall_v be_v make_v or_o grant_v of_o the_o estate_n of_o any_o orphan_n by_o the_o respective_a guardian_n for_o any_o term_n of_o year_n not_o exceed_v the_o minority_n of_o such_o respective_a orphan_n shall_v be_v good_a and_o valid_a in_o the_o law_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o provide_v always_o that_o this_o act_n or_o any_o thing_n therein_o contain_v shall_v not_o extend_v to_o contradict_v or_o alter_v any_o power_n give_v or_o to_o be_v give_v by_o the_o parent_n to_o any_o guardian_n or_o to_o give_v liberty_n for_o the_o future_a to_o any_o guardian_n to_o lease_n out_o the_o estate_n of_o any_o heiress_n for_o any_o long_a term_n or_o time_n than_o till_o she_o shall_v complete_a the_o age_n of_o fourteen_o year_n be_v it_o likewise_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o the_o enrolment_n or_o whosoever_o shall_v execute_v the_o say_a office_n for_o the_o time_n be_v do_v find_v two_o sufficient_a surety_n with_o himself_o to_o become_v bind_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n in_o a_o bond_n of_o the_o penalty_n of_o two_o thousand_o pound_n for_o the_o true_a and_o faithful_a execution_n of_o the_o say_a office_n and_o for_o keep_v of_o the_o same_o in_o the_o town_n of_o st._n jago_n de_fw-fr la_fw-fr vega_n as_o be_v herein_o before_o declare_v and_o not_o elsewhere_o which_o say_v bond_n shall_v be_v record_v in_o the_o supreme_a court_n of_o judicature_n within_o this_o island_n and_o be_v keep_v by_o the_o chief_a justice_n of_o the_o same_o for_o the_o time_n be_v to_o be_v make_v use_n of_o according_a as_o be_v direct_v in_o a_o act_n entitle_v a_o act_n impower_v the_o secretary_n to_o take_v security_n and_o whosoever_o after_o publication_n hereof_o shall_v officiate_v in_o the_o say_a office_n before_o he_o have_v give_v such_o security_n as_o aforesaid_a he_o or_o they_o so_o offend_a shall_v forfeit_v the_o sum_n of_o five_o hundred_o pound_n to_o be_v recover_v by_o bill_n plaint_n or_o information_n in_o any_o of_o his_o majesty_n court_n of_o record_n within_o this_o island_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n between_o st._n catharines_n and_o st._n andrews_n whereas_o william_n parker_n of_o the_o parish_n of_o st._n andrews_n esquire_n have_v at_o his_o particular_a charge_n find_v out_o and_o make_v a_o very_a convenient_a way_n between_o the_o salt_n and_o fresh_a river_n in_o the_o parish_n of_o st._n andrews_n and_o st._n catharines_n which_o will_v be_v of_o great_a use_n and_o advantage_n to_o the_o whole_a island_n in_o cause_v a_o more_o near_o and_o easy_a correspondence_n with_o the_o several_a precinct_n and_o whereas_o the_o say_v william_n parker_n have_v likewise_o set_v up_o and_o erect_v a_o ferry_n for_o the_o better_a accommodation_n of_o the_o say_a passage_n and_o whereas_o the_o same_o can_v be_v maintain_v without_o great_a and_o constant_a charge_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v be_v by_o this_o act_n impower_v and_o authorize_v for_o the_o space_n and_o term_v of_o fourteen_o year_n from_o the_o make_n hereof_o to_o ask_v demand_n sue_v for_o recover_v and_o receive_v as_o a_o duty_n and_o toll_n for_o the_o transport_v of_o any_o person_n over_o the_o say_a ferry_n seven_o penny_n half_a penny_n for_o every_o horse_n and_o man_n fifteen_o penny_n for_o every_o grow_v beast_n that_o have_v no_o rider_n seven_o penny_n half_a penny_n for_o every_o sheep_n calf_n or_o hog_n six_o penny_n and_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v may_v and_o shall_v erect_v a_o tavern_n or_o victualling-house_n near_o the_o say_a ferry_n and_o shall_v not_o be_v compel_v to_o renew_v or_o pay_v any_o licence_n money_n for_o the_o same_o provide_v always_o that_o if_o the_o say_v william_n parker_n or_o his_o assign_v shall_v not_o finish_v and_o complete_a the_o say_a way_n and_o passage_n within_o twelve_o month_n from_o and_o after_o the_o make_n of_o this_o act_n and_o that_o in_o all_o place_n it_o be_v not_o less_o than_o eight_o foot_n broad_a and_o that_o the_o same_o be_v always_o keep_v in_o good_a and_o sufficient_a repair_n that_o the_o aforesaid_a limitation_n of_o the_o rate_n which_o shall_v be_v pay_v by_o virtue_n of_o this_o act_n or_o any_o letter_n patent_n grant_v for_o the_o same_o shall_v cease_v determine_v and_o be_v utter_o void_a and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o other_o person_n whatsoever_o presume_v to_o erect_v
impower_v he_o or_o they_o to_o levy_v the_o say_a tax_n and_o upon_o refusal_n to_o distrain_v and_o sell_v by_o public_a outcry_n as_o aforesaid_a any_o thing_n in_o this_o act_n seem_v to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o justice_n and_o vestry-man_n of_o each_o parish_n have_v full_a power_n to_o inquire_v into_o arrear_n of_o former_a subscription_n and_o tax_n and_o to_o levy_v the_o same_o arrear_n by_o warrant_n from_o the_o justice_n to_o the_o constable_n aforesaid_a and_o that_o the_o minister_n demand_v no_o fee_n in_o his_o own_o parish_n for_o christen_n marriage_n church_n or_o buryal_n under_o the_o penalty_n of_o five_o pound_n for_o every_o offence_n unless_o such_o as_o the_o justice_n and_o vestry-man_n shall_v allow_v any_o law_n custom_n or_o usage_n to_o the_o contrary_a notwithstanding_o the_o one_o half_a of_o all_o which_o forfeiture_n shall_v be_v to_o the_o poor_a of_o the_o parish_n and_o the_o other_o moiety_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o in_o any_o court_n of_o record_n within_o this_o island_n and_o forasmuch_o as_o many_o person_n who_o may_v by_o virtue_n of_o this_o act_n and_o the_o act_n for_o mend_v and_o repair_v the_o highway_n be_v tax_v and_o have_v nothing_o in_o the_o parish_n where_o they_o be_v tax_v upon_o which_o any_o distress_n may_v be_v make_v it_o be_v therefore_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o in_o such_o case_n from_o and_o after_o the_o make_n hereof_o a_o action_n of_o debt_n shall_v lie_v in_o any_o court_n of_o record_n or_o before_o any_o justice_n of_o the_o peace_n as_o in_o other_o debt_n for_o the_o several_a churchwarden_n and_o surveyor_n of_o each_o respective_a parish_n and_o their_o successor_n to_o recover_v against_o any_o of_o the_o say_a person_n rate_v or_o assess_v by_o virtue_n of_o this_o act_n or_o any_o of_o they_o or_o their_o agent_n or_o attorney_n here_o all_o such_o sum_n and_o sum_n of_o money_n as_o be_v or_o shall_v be_v rate_v or_o assess_v upon_o they_o as_o aforesaid_a and_o that_o the_o same_o rate_n or_o assessment_n produce_v in_o such_o court_n of_o record_n or_o before_o such_o justice_n of_o the_o peace_n as_o aforesaid_a shall_v be_v sufficient_a evidence_n and_o proof_n for_o the_o recovery_n of_o all_o such_o sum_n or_o sum_n of_o money_n so_o rate_v or_o assess_v as_o aforesaid_a provide_v nevertheless_o and_o it_o be_v the_o true_a intent_n and_o meaning_n hereof_o that_o no_o justice_n of_o the_o peace_n and_o vestry-man_n shall_v have_v power_n to_o assess_v any_o such_o person_n or_o person_n as_o aforesaid_a above_o the_o sum_n of_o one_o shilling_n per_fw-la annum_fw-la and_o for_o every_o hundred_o acre_n of_o land_n and_o so_o proportionable_a for_o a_o great_a or_o lesser_a quantity_n and_o it_o be_v hereby_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o any_o person_n or_o person_n aggrieve_v or_o rate_v in_o any_o such_o assessment_n or_o tax_n have_v hereby_o liberty_n grant_v to_o appeal_v to_o the_o justice_n sit_v in_o the_o quarter_n session_n in_o their_o respective_a precinct_n in_o this_o island_n provide_v that_o such_o appeal_n to_o they_o be_v make_v at_o the_o first_o or_o second_o quarter_n session_n after_o such_o tax_n make_v and_o not_o afterward_o and_o that_o there_o it_o appear_v to_o the_o say_a justice_n that_o he_o she_o or_o they_o be_v overrated_n tax_v or_o assess_v the_o say_a justice_n be_v hereby_o authorize_v and_o impower_v if_o they_o find_v he_o her_z or_o they_o so_o overrated_n or_o assess_v to_o ease_v he_o her_z or_o they_o as_o to_o their_o discretion_n shall_v seem_v meet_a but_o that_o no_o appeal_n shall_v lie_v further_o or_o to_o any_o other_o court_n or_o place_n in_o this_o island_n for_o any_o tax_n or_o rate_v make_v or_o assess_v by_o the_o justice_n and_o vestry-man_n of_o each_o respective_a parish_n in_o this_o island_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o churchwarden_n of_o each_o respective_a parish_n within_o this_o island_n do_v buy_v or_o cause_n to_o be_v buy_v one_o fair_a well_o bind_v book_n wherein_o the_o minister_n and_o in_o case_n there_o be_v no_o minister_n there_o resident_a the_o respective_a churchwarden_n upon_o notice_n thereof_o give_v by_o the_o master_n of_o the_o several_a family_n who_o be_v hereby_o require_v to_o give_v such_o notice_n under_o the_o penalty_n of_o five_o pound_n shall_v register_n or_o cause_n to_o be_v register_v by_o the_o clerk_n of_o the_o vestry_n of_o that_o parish_n the_o time_n of_o the_o birth_n christen_n marriage_n and_o burial_n of_o all_o such_o person_n or_o person_n that_o shall_v from_o time_n to_o time_n be_v bear_v christen_v marry_v or_o bury_v within_o the_o say_a parish_n under_o the_o penalty_n of_o five_o pound_n for_o every_o such_o default_n and_o that_o the_o say_v clark_n or_o person_n that_o shall_v register_n the_o same_o shall_v have_v and_o receive_v as_o a_o fee_n for_o each_o entry_n fifteen_o penny_n and_o no_o more_o and_o it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o entry_n due_o make_v and_o keep_v as_o aforesaid_a shall_v at_o all_o time_n hereafter_o be_v deem_v judge_v and_o take_v as_o a_o authentic_a record_n of_o all_o such_o birth_n christen_n marriage_n and_o burial_n and_o in_o all_o and_o every_o the_o court_n of_o record_n in_o this_o island_n but_o if_o any_o person_n hereby_o authorize_v to_o make_v such_o entry_n or_o any_o other_o whatsoever_o shall_v make_v or_o cause_n to_o be_v make_v any_o false_a entry_n or_o shall_v raze_v our_o or_o imbezel_n any_o entry_n or_o book_n of_o entry_n he_o or_o they_o so_o offend_v shall_v be_v proceed_v against_o and_o punish_v in_o manner_n and_o form_n as_o the_o law_n of_o england_n provide_v against_o such_o as_o steal_v raze_v or_o imbezel_n record_n the_o one_o moiety_n of_o all_o which_o forfeiture_n or_o penalty_n or_o any_o other_o mention_v in_o this_o act_n and_o not_o direct_v how_o to_o be_v dispose_v of_o shall_v be_v to_o the_o poor_a of_o the_o parish_n where_o the_o fault_n be_v commit_v the_o other_o moiety_n or_o half_a part_n to_o the_o informer_n to_o be_v recover_v by_o bill_n plaint_n or_o information_n in_o any_o of_o his_o majesty_n court_n of_o record_n in_o this_o island_n wherein_o no_o wager_n of_o law_n essoin_fw-fr protection_n or_o injunction_n shall_v be_v allow_v any_o thing_n in_o this_o act_n or_o in_o any_o other_o act_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o parish_n of_o port-royal_a do_v allow_v and_o pay_v unto_o the_o minister_n thereof_o two_o hundred_o and_o fifty_o pound_n per_fw-la annum_fw-la of_o currant_n money_n of_o this_o island_n and_o that_o the_o parish_n of_o st._n catharines_n do_v allow_v and_o pay_v unto_o the_o minister_n thereof_o one_o hundred_o and_o forty_o pound_n of_o the_o like_a money_n per_fw-la annum_fw-la and_o not_o less_o and_o that_o the_o parish_n of_o st._n thomas_n st._n andrews_n and_o st._n john_n do_v allow_v and_o pay_v unto_o their_o respective_a minister_n one_o hundred_o pound_n of_o like_a money_n per_fw-la annum_fw-la and_o that_o all_o the_o other_o parish_n within_o this_o his_o majesty_n island_n that_o either_o have_v or_o shall_v have_v a_o minister_n do_v allow_v and_o pay_v eighty_o pound_n currant_n money_n and_o not_o less_o as_o a_o constant_a yearly_o salary_n for_o the_o support_n and_o maintenance_n of_o every_o of_o their_o minister_n to_o be_v pay_v at_o their_o respective_a dwell_v house_n every_o six_o month_n without_o any_o charge_n or_o defalcation_n by_o equal_a portion_n and_o none_o to_o be_v capable_a of_o be_v present_v to_o the_o say_a benefice_n or_o receive_v the_o profit_n of_o the_o same_o unless_o they_o produce_v due_a testimonial_n that_o they_o be_v qualify_v according_a to_o the_o canon_n of_o the_o church_n of_o england_n by_o have_v take_v deacon_n and_o priest_n order_n and_o the_o say_a testimonial_n to_o be_v record_v in_o the_o secretary_n office_n and_o be_v it_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o no_o minister_n not_o due_o qualify_v as_o aforesaid_a presume_v to_o marry_v any_o person_n or_o person_n whatsoever_o under_o the_o penalty_n of_o one_o hundred_o pound_n currant_n money_n of_o this_o island_n one_o third_n thereof_o to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o
his_o majesty_n dominion_n and_o territory_n and_o whereas_o not_o only_o against_o such_o treaty_n of_o peace_n make_v by_o his_o majesty_n with_o his_o ally_n but_o also_o contrary_a to_o his_o majesty_n royal_a proclamation_n several_a of_o his_o subject_n have_v and_o do_v continual_o go_v off_o from_o this_o his_o majesty_n island_n of_o jamaica_n into_o foreign_a prince_n service_n and_o jurisdiction_n shall_v be_v inquire_v try_v hear_v determine_a and_o judge_v within_o this_o island_n in_o such_o like_a form_n as_o if_o such_o offence_n have_v be_v commit_v in_o and_o upon_o the_o land_n and_o to_o that_o end_n and_o purpose_n commission_n shall_v be_v have_v under_o the_o king_n great_a seal_n of_o this_o island_n direct_v to_o the_o judge_n or_o judge_n of_o the_o admiralty_n his_o or_o their_o knowledge_n or_o notice_n give_v that_o any_o privateer_n pirate_n or_o other_o person_n suspect_v to_o be_v upon_o any_o unlawful_a design_n be_v in_o any_o place_n within_o their_o respective_a precinct_n to_o raise_v and_o levy_v such_o a_o number_n of_o well_o arm_a man_n as_o he_o or_o they_o shall_v think_v needful_a for_o the_o seize_v apprehend_v and_o carry_v to_o to_o the_o particular_a account_n of_o the_o fortification_n and_o shall_v keep_v a_o distinct_a book_n of_o account_n for_o the_o same_o which_o book_n of_o account_n shall_v be_v free_a and_o open_a at_o all_o office-hour_n for_o any_o person_n to_o view_v the_o same_o without_o pay_v any_o manner_n of_o fee_n therefore_o and_o that_o the_o say_a receiver-general_n or_o his_o deputy_n shall_v when_z and_o as_o often_o as_o thereunto_o require_v by_o the_o governor_n council_n or_o assembly_n when_o sit_v or_o to_o any_o committee_n by_o they_o or_o either_o of_o they_o to_o be_v appoint_v give_v in_o upon_o oath_n which_o oath_n they_o be_v hereby_o empower_v to_o administer_v a_o just_a and_o true_a account_n of_o the_o particular_a disbursement_n out_o of_o the_o thousand_o pound_n the_o governor_n and_o a_o quorum_fw-la of_o the_o council_n enter_v into_o bond_n in_o the_o penalty_n of_o five_o thousand_o pound_n which_o bond_n shall_v lie_v in_o the_o secretary_n office_n to_o be_v sue_v in_o manner_n and_o form_n as_o be_v direct_v in_o a_o act_n require_v all_o master_n of_o ship_n and_o vessel_n to_o give_v security_n in_o the_o secretary_n office_n under_o the_o
