hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v lie_v 12._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n 2._o and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o full_a treble_n cost_v 13._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o this_o act_n and_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o 2._o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n 3._o and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_n to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o 4._o which_o say_v justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o full_o as_o the_o say_v other_o justice_n whatsoever_o 15._o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberty_n thereof_o for_o the_o examine_v convict_v and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberty_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o the_o person_n offend_a and_o convict_a as_o aforesaid_a be_v a_o feme-covert_n cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o aforesaid_a incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o the_o husband_n of_o each_o feme-covert_n 17._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o virtue_n or_o force_n of_o this_o act_n any_o thing_n matter_n or_o clause_n therein_o to_o the_o contrary_a notwithstanding_o 18._o provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o invalidate_v or_o avoid_v his_o majesty_n supremacy_n in_o ecclesiastical_a affair_n 2._o but_o that_o his_o majesty_n and_o his_o heir_n and_o successor_n from_o time_n to_o time_n and_o at_o all_o time_n hereafter_o exercise_n and_o enjoy_v all_o power_n and_o authority_n in_o ecclesiastical_a affair_n as_o full_o and_o as_o ample_o as_o himself_o or_o any_o of_o his_o predecessor_n have_v or_o may_v have_v do_v the_o same_o any_o thing_n in_o this_o act_n notwithstanding_o note_n upon_o the_o forego_n act._n 1._o by_o the_o title_n preamble_n and_o scope_n of_o the_o act_n it_o appear_v that_o the_o same_o be_v intend_v for_o suppress_v seditious_a conventicle_n under_o pretence_n of_o religious_a worship_n that_o be_v where_o the_o conventicler_n meet_v together_o under_o a_o pretence_n of_o worship_n not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o indeed_o to_o carry_v on_o ill_a design_n against_o the_o state_n 2._o if_o any_o such_o conventicle_n be_v the_o justices_z know_v it_o by_o the_o oath_n of_o two_o witness_n may_v make_v a_o record_n thereof_o and_o then_o the_o person_n so_o offend_v shall_v forfeit_v so_o as_o in_o the_o act_n you_o have_v hear_v 3._o it_o must_v appear_v upon_o oath_n before_o the_o justice_n or_o confession_n of_o the_o party_n 1._o that_o it_o be_v a_o seditious_a conventicle_n meet_v together_o to_o disturb_v the_o peace_n under_o pretence_n of_o religion_n 2._o that_o the_o worship_n there_o practise_v be_v not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n so_o that_o the_o informer_n must_v be_v present_a the_o whole_a time_n of_o the_o meeting_n for_o if_o they_o only_o hear_v a_o man_n pray_v or_o preach_v that_o be_v not_o contrary_a to_o the_o practice_n of_o the_o church_n of_o england_n and_o how_o do_v it_o appear_v that_o they_o do_v not_o read_v the_o liturgy_n 3._o it_o must_v be_v prove_v that_o there_o be_v assemble_v five_o person_n or_o more_o beside_o the_o inhabitant_n in_o the_o house_n 4._o if_o a_o party_n be_v fine_v above_o ten_o shilling_n if_o he_o pay_v down_o the_o money_n or_o it_o be_v levy_v within_o one_o week_n after_o such_o payment_n or_o levy_n he_o may_v appeal_v from_o the_o justice_n convict_v to_o the_o next_o quarter-session_n where_o he_o shall_v have_v a_o trial_n by_o jury_n thereupon_o and_o undoubted_o if_o it_o do_v not_o appear_v to_o the_o say_a jury_n that_o conventicle_n be_v hold_v and_o then_o the_o constable_n ought_v forthwith_o to_o go_v and_o if_o he_o find_v it_o so_o to_o suppress_v it_o but_o otherwise_o the_o constable_n may_v be_v put_v to_o endless_a vexation_n in_o hunt_v after_o meeting_n to_o no_o purpose_n whereas_o the_o act_n enjoin_v he_o no_o such_o trouble_n and_o if_o you_o go_v once_o and_o find_v no_o conventicle_n you_o be_v not_o oblige_v to_o go_v a_o second_o time_n on_o the_o same_o warrant_n but_o aught_o to_o have_v a_o new_a one_o nor_o be_v the_o constable_n oblige_v to_o turn_v informer_n 6._o as_o to_o break_v open_a door_n you_o see_v the_o act_n direct_v that_o it_o may_v be_v do_v first_o only_a in_o a_o house_n where_o it_o be_v inform_v there_o be_v actual_o a_o conventicle_n as_o aforesaid_a that_o be_v upon_o the_o oath_n of_o two_o person_n 2._o the_o constable_n &c._n &c._n can_v do_v this_o without_o first_o there_o be_v a_o demand_n and_o denial_n to_o enter_v 3._o nor_o then_o neither_o without_o a_o warrant_n from_o the_o justice_n to_o that_o purpose_n if_o a_o constable_n upon_o a_o light_n vain_a tale_n without_o two_o person_n swear_v it_o that_o there_o be_v at_o such_o a_o house_n a_o meeting_n and_o without_o warrant_n shall_v venture_v to_o break_v open_a the_o door_n and_o there_o be_v find_v no_o conventicle_n he_o make_v himself_o liable_a to_o
such_o person_n and_o person_n so_o as_o aforesaid_a offend_n shall_v be_v deem_v declare_v and_o adjudge_v to_o be_v traitor_n and_o shall_v suffer_v pain_n of_o death_n and_o also_o lose_v and_o forfeit_v as_o in_o case_n of_o high_a treason_n 2._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n at_o any_o time_n after_o the_o four_o and_o twenty_o day_n of_o june_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o one_o during_o his_o majesty_n life_n shall_v malicious_o and_o advise_o publish_v or_o affirm_v the_o king_n to_o be_v a_o heretic_n or_o papist_n or_o that_o he_o endeavourr_n to_o introduce_v popery_n 2._o or_o shall_v malicious_o and_o advise_o by_o print_n write_v lord_n chief_a baron_n or_o any_o two_o of_o they_o for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n in_o london_n middlesex_n and_o surrey_n and_o by_o the_o judge_n for_o the_o several_a circuit_n and_o justice_n of_o the_o peace_n for_o the_o time_n be_v in_o their_o several_a precinct_n and_o fair_o write_v and_o hang_v up_o in_o a_o table_n in_o every_o gaol_n and_o prison_n before_o the_o first_o day_n of_o november_n 1671._o and_o likewise_o be_v register_v by_o each_o and_o every_o clerk_n of_o the_o peace_n within_o he_o or_o their_o particular_a jurisdiction_n and_o after_o such_o establishment_n no_o other_o or_o great_a fee_n or_o fee_n than_o shall_v be_v so_o establish_v shall_v be_v demand_v or_o receive_v and_o whereas_o it_o be_v become_v the_o common_a practice_n of_o gaoler_n and_o keeper_n of_o newgate_n the_o gatehouse_n at_o westminster_n and_o sundry_a other_o gaol_n and_o prison_n to_o lodge_v together_o in_o one_o room_n or_o chamber_n and_o bed_n prisoner_n for_o debt_n and_o felon_n whereby_o many_o time_n honest_a gentleman_n tradesman_n and_o other_o prisoner_n for_o debt_n be_v disturb_v and_o hinder_v in_o the_o nighttime_n from_o their_o natural_a rest_n by_o reason_n of_o their_o fetter_n and_o iron_n and_o otherwise_o much_o offend_v and_o trouble_v by_o their_o lewd_a and_o profane_a language_n and_o discourse_n with_o most_o horrid_a curse_v and_o swear_v much_o accustom_a to_o such_o person_n 2._o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v not_o be_v lawful_a hereafter_o for_o any_o sheriff_n jailer_n or_o keeper_n of_o any_o gaol_n or_o prison_n to_o put_v keep_v or_o lodge_n prisoner_n for_o debt_n and_o felon_n together_o in_o one_o room_n or_o chamber_n but_o that_o they_o shall_v be_v put_v keep_v and_o lodge_v separate_a and_o apart_o one_o from_o another_o in_o distinct_a room_n 3._o upon_o pain_n that_o he_o she_o or_o they_o which_o shall_v offend_v against_o this_o act_n or_o the_o true_a intent_n and_o meaning_n thereof_o or_o any_o part_n thereof_o shall_v forfeit_v and_o lose_v his_o or_o her_o office_n place_n or_o employment_n and_o shall_v forfeit_v treble_a damage_n to_o the_o party_n grieve_v to_o be_v recover_v by_o virtue_n of_o this_o act_n any_o law_n statute_n usage_n or_o custom_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o to_o the_o end_n that_o englishman_n may_v more_o entire_o enjoy_v their_o due_a freedom_n the_o prudence_n of_o our_o legislator_n have_v think_v fit_a from_o time_n to_o time_n to_o remove_v encroachment_n thereupon_o though_o under_o pretence_n of_o jurisdiction_n and_o court_n of_o justice_n and_o to_o prohibit_v any_o exorbitant_a arbitrary_a power_n for_o the_o future_a but_o that_o all_o thing_n may_v be_v leave_v to_o the_o calm_a and_o equal_a proceed_n of_o law_n and_o that_o most_o excellent_a method_n of_o trial_n by_o juries_n one_o of_o the_o principal_a bulwark_n of_o england_n liberty_n for_o a_o instance_n hereof_o take_v the_o act_n follow_v a_o act_n for_o regulate_v of_o the_o privy_a council_n and_o for_o take_v away_o the_o court_n common_o call_v the_o star-chamber_n whereas_o by_o the_o great_a charter_n many_o time_n confirm_v in_o parliament_n it_o be_v enact_v that_o no_o freeman_n shall_v be_v take_v or_o imprison_v or_o disseize_v of_o his_o freehold_a or_o liberties_n or_o free_a custom_n or_o be_v outlaw_v or_o exile_v or_o otherwise_o destroy_v and_o that_o the_o king_n will_v not_o pass_v upon_o he_o or_o condemn_v he_o but_o by_o lawful_a judgement_n of_o his_o peer_n or_o by_o the_o law_n of_o the_o land_n 2._o and_o by_o another_o statute_n make_v in_o the_o five_o year_n of_o the_o like_a offence_n or_o offence_n contrary_a to_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a than_o such_o offender_n so_o convict_v of_o such_o like_a offence_n or_o offence_n shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o forty_o pound_n to_o be_v levy_v and_o dispose_v as_o aforesaid_a 4._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n that_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n meeting_n or_o unlawful_a assembly_n aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n yard_n or_o backside_n and_o be_v convict_v thereof_o in_o manner_n aforesaid_a shall_v forfeit_v the_o sum_n of_o 20_o l._n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o or_o her_o good_n and_o chattel_n or_o in_o case_n of_o he_o or_o her_o poverty_n or_o inability_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o such_o person_n who_o shall_v be_v convict_v in_o manner_n abovesaid_a of_o be_v present_a at_o the_o same_o conventicle_n and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a 5._o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n shall_v by_o any_o clause_n of_o this_o act_n be_v liable_a to_o pay_v above_o ten_o pound_n for_o any_o one_o meeting_n in_o regard_n of_o the_o poverty_n of_o any_o other_o person_n or_o person_n provide_v also_o and_o be_v it_o further_o enact_v that_o in_o all_o case_n of_o this_o act_n where_o the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o ten_o shilling_n and_o such_o offendor_n shall_v find_v himself_o aggrieve_v it_o shall_v and_o may_v be_v lawful_a for_o he_o within_o one_o week_n after_o the_o say_a penalty_n or_o money_n charge_v shall_v be_v pay_v or_o levy_v to_o appeal_v in_o write_v from_o the_o person_n or_o person_n convict_v to_o the_o judgement_n of_o the_o justice_n of_o the_o peace_n in_o the_o next_o quarter-session_n 2._o to_o who_o the_o justice_n or_o justice_n of_o peace_n chief_a magistrate_n or_o alderman_n that_o first_o convict_v such_o offendor_n shall_v return_v the_o money_n levy_v upon_o the_o appellant_n and_o shall_v certify_v under_o his_o and_o their_o hand_n and_o seal_n the_o evidence_n upon_o which_o the_o conviction_n past_a with_o the_o whole_a record_n thereof_o and_o the_o say_a appeal_n 3._o whereupon_o such_o offender_n may_v plead_v and_o make_v defence_n and_o have_v his_o trial_n by_o a_o jury_n thereupon_o 4._o and_o in_o case_n such_o appellant_n shall_v not_o prosecute_v with_o effect_n or_o if_o that_o upon_o such_o trial_n he_o shall_v not_o be_v acquit_v or_o judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n the_o say_a justice_n at_o the_o session_n shall_v give_v treble_a cost_n against_o such_o offender_n for_o his_o unjust_a appeal_n 5._o and_o no_o other_o court_n whatsoever_o shall_v intermeddle_v with_o any_o cause_n or_o cause_n of_o appeal_n upon_o this_o act_n but_o they_o shall_v be_v final_o determine_v in_o the_o quarter-session_n only_o 7._o provide_v always_o and_o be_v it_o further_o enact_v that_o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a the_o person_n or_o person_n appellant_n shall_v enter_v before_o the_o person_n or_o person_n convict_v into_o a_o recognizance_n to_o prosecute_v the_o say_a appeal_n with_o effect_n 2._o which_o say_v recognizance_n the_o person_n or_o person_n convict_v be_v hereby_o impower_v to_o take_v and_o require_v to_o certify_v the_o same_o to_o the_o next_o quarter_n session_n 3._o and_o in_o case_n no_o such_o recognizance_n be_v enter_v into_o the_o say_a appeal_n to_o be_v null_n and_o void_a 8._o provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o 9_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justices_z of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tythingman_n by_o warrant_n from_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o shall_v and_o may_v with_o what_o aid_n force_v and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v of_o any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberty_n as_o without_o 2._o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act_n 3._o and_o that_o the_o lieutenant_n or_o deputy_n lieutenant_n or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o of_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n 10._o provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v then_o be_v resident_n shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy_n lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v 11._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n headborough_z tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n headborough_z tything-man_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o aid_n of_o the_o constable_n headborough_z or_o tything-man_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o be_v levy_v upon_o
