that_o if_o any_o assessor_n collector_n receiver_n or_o any_o other_o person_n appoint_v by_o the_o commissioner_n shall_v wilful_o neglect_v or_o refuse_v to_o perform_v his_o duty_n in_o the_o due_a and_o speédy_a execution_n of_o this_o present_a act_n the_o say_v respective_a commissioner_n or_o any_o two_o or_o more_o of_o they_o may_v and_o shall_v by_o virtue_n of_o this_o act_n have_v power_n and_o authority_n to_o commit_v such_o assessor_n collector_n or_o receiver_n to_o goal_n till_o he_o or_o they_o have_v do_v he_o or_o their_o duty_n according_a to_o this_o act_n or_o to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v their_o duty_n any_o fine_a not_o exceed_v twenty_o pound_n for_o any_o one_o offence_n at_o their_o discretion_n the_o same_o to_o be_v levy_v and_o certify_v as_o aforesaid_a into_o his_o majesty_n court_n of_o exchequer_n and_o charge_v upon_o the_o respective_a receiver_n among_o the_o rest_n of_o the_o rate_v aforesaid_a and_o the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o may_v or_o shall_v from_o time_n to_o time_n call_v for_o and_o require_v a_o account_n from_o the_o respective_a receiver_n of_o all_o the_o money_n receive_v by_o they_o of_o the_o say_a collector_n and_o of_o the_o payment_n thereof_o according_a to_o the_o direction_n of_o this_o act_n and_o in_o case_n of_o any_o failure_n in_o the_o premise_n the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o be_v hereby_o require_v to_o cause_v the_o same_o to_o be_v forthwith_o levy_v and_o pay_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n and_o in_o case_n of_o any_o controversy_n arise_v between_o the_o say_a commissioner_n concern_v the_o say_a rate_n or_o assessment_n the_o commissioner_n that_o shall_v be_v concern_v therein_o shall_v have_v no_o voice_n but_o shall_v withdraw_v during_o the_o debate_n of_o such_o controversy_n until_o it_o be_v determine_v by_o the_o rest_n of_o the_o commissioner_n and_o in_o default_n thereof_o that_o the_o commissioner_n then_o present_a shall_v have_v power_n and_o be_v hereby_o require_v to_o impose_v such_o fine_a or_o fine_n as_o to_o they_o shall_v be_v think_v fit_a upon_o such_o commissioner_n so_o refuse_v to_o withdraw_v not_o exceed_v twenty_o pound_n and_o to_o cause_v the_o same_o to_o be_v levy_v and_o pay_v as_o other_o fine_n to_o be_v impose_v by_o virtue_n of_o this_o act_n be_v to_o be_v levy_v and_o pay_v and_o all_o question_n and_o difference_n that_o shall_v arise_v touch_v any_o of_o the_o say_a rate_n tax_n assessment_n or_o levy_n and_o the_o collect_v thereof_o shall_v be_v hear_v and_o final_o determine_v by_o threé_o or_o more_o of_o the_o commissioner_n upon_o complaint_n thereof_o to_o they_o make_v by_o any_o person_n or_o person_n thereby_o grieve_v without_o further_a trouble_n or_o suit_n in_o law_n and_o the_o say_a receiver-general_n his_o deputy_n or_o deputy_n shall_v give_v acquittance_n gratis_o to_o the_o say_a barony-receiver_n who_o shall_v likewise_o give_v acquittance_n gratis_o to_o the_o say_a parish-collector_n for_o all_o money_n of_o they_o respective_o receive_v in_o pursuance_n of_o this_o act_n which_o acquittance_n shall_v be_v a_o full_a discharge_v to_o say_v collector_n respective_o and_o the_o say_a collector_n shall_v make_v and_o deliver_v to_o the_o say_a receivers-general_n their_o deputy_n or_o deputy_n a_o perfect_a schedule_n fair_o write_v in_o parchment_n under_o their_o hand_n and_o seal_n signed_n and_o allow_v by_o any_o two_o or_o more_o of_o the_o respective_a commissioner_n contain_v the_o name_n and_o surname_n and_o place_n of_o abode_n of_o every_o person_n within_o their_o respective_a collection_n that_o shall_v make_v default_n of_o payment_n of_o any_o the_o sum_n that_o shall_v be_v rate_v or_o assess_v on_o such_o person_n by_o virtue_n of_o this_o act_n and_o the_o sum_n and_o sum_v charge_v on_o every_o such_o person_n the_o same_o to_o be_v return_v by_o he_o into_o his_o majesty_n exchequer_n whereupon_o every_o such_o person_n make_v default_n of_o payment_n may_v be_v charge_v by_o process_n of_o the_o say_a court_n according_a to_o the_o course_n thereof_o in_o that_o behalf_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o letter_n patent_n grant_v by_o the_o king_n or_o late_a queén_n majesty_n or_o any_o of_o their_o royal_a predecessor_n or_o to_o be_v grant_v by_o his_o majesty_n to_o any_o person_n or_o person_n city_n burough_n or_o town_n corporate_a within_o this_o realm_n or_o any_o manner_n of_o liberty_n privilege_n or_o exemption_n from_o subsidy_n toll_n tax_n assessment_n or_o aid_n shall_v be_v construe_v or_o take_v to_o exempt_v any_o person_n or_o person_n city_n burough_n or_o town_n corporate_a or_o any_o of_o the_o inhabitant_n of_o the_o same_o from_o the_o burden_n or_o charge_n of_o any_o sum_n or_o sum_n of_o money_n grant_v by_o this_o act_n and_o all_o non-obstantes_a in_o such_o letter_n patent_n for_o any_o such_o purpose_n or_o intent_n be_v declare_v to_o be_v void_a and_o of_o none_o effect_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o constable_n head-buroughs_a and_o other_o his_o majesty_n officer_n shall_v and_o be_v hereby_o require_v and_o enjoin_v to_o be_v respective_o aid_v and_o assist_v in_o the_o execution_n of_o this_o act_n and_o to_o obey_v and_o execute_v such_o precept_n or_o warrant_v as_o shall_v be_v to_o they_o direct_v in_o that_o behalf_n by_o the_o respective_a commissioner_n hereby_o appoint_v or_o to_o any_o two_o or_o more_o of_o they_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n plaint_n suit_n or_o information_n shall_v be_v commence_v or_o prosecute_v against_o any_o person_n or_o person_n for_o what_o he_o or_o they_o shall_v do_v in_o pursuance_n or_o in_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v in_o any_o court_n whatsoever_o shall_v or_o may_v plead_v the_o general_n issue_n not_o guilty_a and_o upon_o any_o issue_n join_v may_v give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v become_v non-sute_n or_o forbear_v further_a prosecution_n or_o suffer_v discontinuance_n or_o if_o a_o verdict_n pass_v against_o he_o the_o defendant_n and_o defendant_n shall_v recover_v treble_a cost_v for_o which_o they_o shall_v have_v the_o like_a remedy_n as_o in_o case_n where_o cost_v by_o law_n be_v give_v to_o the_o defendant_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a parent_n guardian_n and_o tutor_n of_o every_o person_n under_o the_o age_n of_o one_o and_o twenty_o year_n shall_v upon_o default_n of_o payment_n of_o such_o person_n and_o upon_o demand_n pay_v what_o be_v due_a and_o payable_a by_o this_o act_n for_o every_o such_o person_n reside_v in_o their_o family_n or_o under_o their_o tuition_n as_o before_o herein_o be_v mention_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o money_n due_a and_o payable_a by_o this_o act_n shall_v be_v pay_v by_o the_o particular_a collector_n of_o the_o respective_a county_n city_n burough_n town_n parish_n and_o place_n who_o shall_v collect_v the_o same_o unto_o the_o respective_a barony_n receiver_n who_o shall_v pay_v the_o same_o unto_o such_o receiver_n or_o receiver_n as_o shall_v by_o their_o excellency_n the_o lord_n justice_n or_o other_o chief_a governor_n for_o the_o time_n be_v be_v appoint_v as_o before_o be_v mention_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o particular_a collector_n for_o payment_n of_o any_o sum_n by_o they_o receive_v unto_o such_o barony-receiver_n or_o receiver_n shall_v not_o be_v oblige_v to_o travel_v above_o twenty_o mile_n from_o the_o place_n of_o their_o habitation_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o receiver_n of_o any_o hundred_o barony_n or_o division_n from_o time_n to_o time_n within_o the_o space_n of_o one_o month_n next_o after_o he_o shall_v have_v receive_v the_o full_a sum_n that_o shall_v be_v charge_v upon_o any_o hundred_o barony_n or_o division_n for_o each_o particular_a quarterly_o payment_n that_o be_v to_o be_v make_v to_o such_o receiver_n by_o virtue_n of_o this_o act_n shall_v give_v the_o commissioner_n who_o shall_v act_v in_o such_o hundred_o barony_n or_o division_n a_o receipt_n under_o his_o hand_n and_o seal_n acknowledge_v his_o receipt_n of_o the_o full_a sum_n charge_v upon_o such_o hundred_o barony_n or_o division_n

and_o be_v hereby_o impower_v and_o require_v to_o administer_v a_o oath_n to_o the_o respective_a assessor_n or_o presenter_n of_o the_o several_a parish_n respective_o appoint_v they_o to_o assess_v in_o pursuance_n of_o this_o act_n that_o they_o will_v according_a to_o the_o best_a of_o their_o understanding_n true_o perform_v the_o office_n of_o assessor_n or_o presenter_n to_o they_o respective_o commit_v without_o concealment_n love_n favour_n partiality_n expectation_n of_o reward_n dread_a hatred_n or_o malice_n according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n and_o the_o say_a assessor_n or_o presenter_n be_v hereby_o require_v before_o they_o enter_v into_o or_o upon_o the_o execution_n of_o their_o office_n to_o take_v the_o say_a oath_n according_o and_o for_o the_o careful_a write_n and_o transcribe_v the_o say_a warrant_n estreat_n and_o duplicate_v in_o due_a time_n and_o for_o make_v certificate_n upon_o appeal_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n clerk_n who_o shall_v respective_o perform_v the_o same_o shall_v by_o warrant_n under_o three_o or_o more_o of_o the_o commissioner_n hand_n have_v and_o receive_v from_o the_o respective_a person_n or_o person_n who_o shall_v be_v appoint_v in_o each_o county_n by_o the_o chief_a governor_n or_o governor_n of_o this_o kingdom_n for_o the_o time_n be_v as_o aforesaid_a to_o receive_v the_o several_a sum_n pursuant_n to_o this_o act_n three_o penny_n in_o the_o pound_n of_o all_o such_o money_n as_o they_o shall_v have_v receive_v by_o virtue_n of_o such_o warrant_n and_o estreat_v who_o be_v hereby_o appoint_v to_o pay_v the_o same_o according_o and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o pay_v the_o several_a sum_n and_o sum_n and_o proportion_n appoint_v by_o this_o act_n for_o such_o person_n to_o pay_v within_o the_o space_n of_o ten_o day_n after_o demand_n or_o notice_n leave_v at_o the_o place_n of_o residence_n or_o dwelling_v of_o such_o person_n by_o the_o officer_n or_o collector_n of_o the_o place_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v by_o the_o say_a commissioner_n it_o shall_v be_v lawful_a to_o and_o for_o such_o officer_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v for_o nonpayment_n say_a money_n and_o the_o overplus_a come_n by_o the_o say_a sale_n if_o any_o be_v over_o and_o above_o the_o charge_n of_o take_v and_o keép_v the_o say_a distress_n to_o be_v immediate_o restore_v to_o the_o owner_n thereof_o and_o if_o any_o person_n or_o person_n assess_v by_o this_o act_n shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o ten_o day_n after_o demand_n as_o aforesaid_a where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o same_o may_v be_v levy_v in_o every_o such_o case_n threé_o of_o the_o commissiones_fw-la by_o this_o act_n appoint_v for_o any_o such_o city_n county_n or_o place_n be_v hereby_o authorize_v by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o person_n or_o person_n to_o the_o common_a goal_n there_o to_o be_v keep_v without_o bail_n or_o mainprize_n until_o payment_n shall_v be_v make_v and_o if_o any_o person_n certify_v assess_v or_o rate_v find_v he_o or_o herself_o aggrieve_v with_o such_o assess_n or_o rate_v and_o do_v within_o five_o day_n after_o demand_v thereof_o make_v complaint_n to_o the_o say_a commissioner_n they_o aforesaid_a and_o to_o that_o end_n the_o say_a commissioner_n be_v hereby_o require_v to_o meét_v together_o for_o the_o determine_v such_o complaint_n and_o appeal_v according_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n to_o be_v rate_v by_o this_o act_n shall_v be_v rate_v at_o such_o place_n where_o he_o or_o she_o with_o his_o or_o her_o family_n shall_v be_v resident_n at_o the_o time_n of_o the_o execution_n of_o this_o act._n and_o that_o every_o person_n not_o be_v a_o housholder_n nor_o have_v a_o certain_a place_n for_o abide_v and_o all_o servant_n shall_v be_v tax_v at_o the_o place_n where_o they_o be_v resident_n at_o the_o time_n of_o the_o execution_n of_o this_o act._n the_o tax_n upon_o such_o servant_n to_o be_v pay_v by_o their_o respective_a master_n or_o mistress_n and_o to_o be_v deduct_v out_o of_o their_o wage_n which_o deduction_n the_o say_a master_n or_o mistress_n be_v hereby_o impower_v to_o make_v provide_v always_o that_o if_o any_o person_n have_v several_a mansion-house_n or_o place_n of_o residence_n shall_v be_v double_o charge_v by_o virtue_n of_o this_o act_n that_o upon_o certificate_n make_v by_o two_o or_o more_o of_o the_o commissioner_n for_o the_o county_n city_n or_o place_n which_o certificate_n the_o say_a commissioner_n be_v hereby_o require_v to_o give_v without_o delay_n feé_v or_o reward_v of_o his_o or_o her_o personal_a residence_n under_o their_o hand_n and_o seal_n of_o the_o sum_n or_o sum_n there_o charge_v upon_o he_o or_o they_o or_o in_o what_o capacity_n or_o respect_n he_o or_o they_o be_v so_o charge_v and_o upon_o oath_n make_v of_o such_o certificate_n before_o any_o justice_n of_o the_o peace_n of_o the_o county_n or_o place_n where_o such_o certificate_n shall_v be_v make_v which_o oath_n the_o say_a justice_n of_o the_o peace_n be_v hereby_o authorize_v to_o administer_v then_o the_o person_n or_o person_n so_o double_o charge_v shall_v for_o so_o much_o as_o shall_v be_v certify_v be_v discharge_v in_o every_o other_o county_n city_n or_o place_n and_o if_o any_o person_n at_o the_o time_n of_o the_o assess_n shall_v be_v out_o of_o the_o realm_n such_o person_n shall_v be_v rate_v where_o such_o person_n be_v last_o abide_v within_o the_o realm_n and_o if_o any_o person_n that_o ought_v to_o be_v tax_v by_o virtue_n of_o this_o act_n by_o change_v his_o place_n of_o residence_n or_o by_o fraud_n or_o covin_z shall_v escape_v from_o the_o taxation_n and_o not_o be_v tax_v and_o the_o same_o be_v prove_v before_o the_o commissioner_n or_o any_o two_o of_o they_o or_o two_o justice_n of_o the_o peace_n of_o the_o county_n where_o such_o person_n dwell_v or_o reside_v at_o any_o time_n within_o twelve_o month_n next_o ensue_v after_o such_o taxation_n make_v every_o person_n that_o shall_v so_o escape_v from_o the_o say_a taxation_n and_o payment_n shall_v be_v charge_v upon_o proof_n thereof_o at_o the_o double_a value_n of_o so_o much_o as_o he_o shall_v or_o aught_o to_o have_v be_v tax_v by_o this_o act_n the_o say_v double_a value_n upon_o certificate_n thereof_o make_v into_o the_o exchequer_n by_o the_o aforesaid_a provide_v always_o that_o the_o commissioner_n within_o any_o county_n or_o place_n within_o their_o respective_a limit_n or_o the_o major_a part_n of_o they_o shall_v tax_n and_o assess_v every_o other_o commissioner_n join_v with_o they_o and_o the_o commissioner_n within_o their_o division_n shall_v assess_v every_o assessor_n within_o their_o division_n and_o as_o well_o all_o sum_n upon_o every_o of_o the_o say_a commissioner_n and_o assessor_n as_o the_o assessment_n make_v and_o present_v by_o the_o presenter_n as_o aforesaid_a shall_v be_v write_v estreat_v levy_v and_o gather_v
for_o such_o particular_a payment_n and_o the_o receipt_n of_o such_o receiver_n or_o receiver_n as_o shall_v be_v appoint_v by_o the_o lord_n justice_n of_o this_o kingdom_n or_o other_o chief_a governor_n or_o governor_n of_o this_o realm_n for_o the_o time_n be_v as_o aforesaid_a to_o every_o collector_n of_o any_o barony_n hundred_o or_o division_n for_o so_o much_o of_o the_o say_a assessment_n as_o shall_v be_v contain_v in_o such_o receipt_n shall_v be_v a_o full_a discharge_v to_o such_o barony_n hundred_o or_o division_n against_o his_o majesty_n his_o heir_n and_o successor_n and_o for_o prevent_v such_o vexation_n as_o may_v be_v occasion_v by_o such_o person_n as_o shall_v be_v appoint_v to_o make_v return_v of_o such_o person_n and_o person_n as_o make_v default_n of_o payment_n of_o the_o sum_n or_o sum_n on_o he_o or_o they_o assess_v by_o this_o act._n and_o to_o the_o intent_n such_o person_n or_o person_n may_v return_v true_a account_n or_o account_n into_o his_o majesty_n court_n of_o exchequer_n of_o such_o sum_n of_o money_n as_o shall_v not_o be_v receive_v by_o they_o and_o every_o of_o they_o their_z and_o every_o of_o their_o deputy_n and_o deputy_n be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o person_n shall_v return_v or_o certify_v into_o the_o say_a court_n any_o sum_n or_o sum_n of_o money_n to_o be_v in_o arrear_n or_o unpaid_a after_o the_o same_o have_v be_v receive_v such_o person_n or_o person_n so_o make_v such_o return_n or_o return_v or_o shall_v cause_v any_o person_n or_o person_n to_o be_v set_v insuper_fw-la in_o the_o say_a court_n for_o any_o sum_n or_o sum_n of_o money_n that_o have_v be_v so_o receive_v that_o then_o every_o such_o person_n or_o person_n cause_n duplicate_v of_o the_o whole_a sum_n charge_v within_o every_o hundred_o barony_n ward_n or_o place_n rate_v and_o assess_v in_o such_o county_n in_o pursuance_n of_o this_o act_n without_o name_v the_o person_n to_o be_v fair_o write_v in_o parchment_n and_o ascertain_v under_o threé_o or_o more_o of_o their_o hand_n respective_o to_o each_o duplicate_v and_o the_o same_o so_o by_o
