A62675 An essay concerning the power of the magistrate, and the rights of mankind in matters of religion with some reasons in particular for the dissenters not being obliged to take the Sacramental Test but in their own churches, and for a general naturalization : together with a postscript in answer to the Letter to a convocation-man. his_o subject_n when_o by_o it_o he_o who_o be_v as_o fallible_a as_o those_o he_o persecute_v be_v as_o likely_a to_o promote_v error_n as_o truth_n because_o if_o the_o error_n ballance_v the_o truth_n it_o be_v do_v mischief_n for_o mischief_n sake_n now_o since_o truth_n be_v but_o one_o and_o falsehood_n almost_o infinite_a there_o be_v a_o prodigious_a odds_o he_o persecute_v his_o subject_n to_o establish_v error_n 2_o i_o answer_v that_o opinion_n mere_o as_o such_o be_v not_o destructive_a of_o man_n soul_n for_o god_n who_o have_v make_v man_n liable_a to_o mistake_v do_v not_o require_v a_o impossibility_n of_o he_o never_o to_o be_v mistake_v but_o that_o he_o impartial_o search_v after_o religious_a truth_n and_o sincere_o endeavour_v to_o discover_v it_o by_o those_o help_n and_o ability_n he_o have_v bestow_v on_o he_o to_o that_o purpose_n he_o therefore_o that_o do_v this_o have_v the_o satisfaction_n of_o do_v his_o duty_n as_o a_o rational_a creature_n and_o may_v be_v sure_a though_o he_o miss_v truth_n he_o shall_v not_o miss_v the_o reward_n of_o it_o since_o he_o have_v follow_v as_o well_o as_o he_o can_v and_o no_o more_o can_v be_v his_o duty_n the_o only_a guide_n god_n have_v give_v he_o to_o judge_n of_o truth_n and_o falsehood_n and_o if_o it_o be_v no_o fault_n in_o a_o judge_n that_o condemn_v a_o innocent_a person_n if_o upon_o sufficient_a evidence_n he_o appear_v guilty_a the_o same_o reason_n will_v hold_v as_o strong_a for_o the_o innocence_n of_o a_o opinion_n that_o a_o man_n after_o he_o have_v impartial_o consider_v embrace_v for_o truth_n and_o by_o which_o he_o prejudice_v no_o person_n and_o if_o he_o that_o have_v lose_v his_o sense_n if_o it_o be_v not_o by_o his_o own_o fault_n be_v not_o accountable_a for_o what_o he_o do_v there_o be_v as_o little_a reason_n that_o he_o shall_v who_o act_n according_a to_o the_o best_a of_o his_o understanding_n for_o it_o be_v the_o sincerity_n of_o the_o heart_n and_o the_o goodness_n of_o the_o intention_n that_o god_n whole_o regard_v and_o the_o ignorant_a and_o mistake_v if_o it_o be_v not_o their_o own_o fault_n be_v as_o acceptable_a to_o he_o as_o the_o know_n and_o not_o mistake_v since_o it_o be_v he_o that_o cause_v the_o difference_n of_o man_n understanding_n as_o well_o as_o circumstance_n which_o last_o make_v the_o widow_n mite_n though_o very_o inconsiderable_a in_o itself_o as_o acceptable_a as_o the_o great_a present_n of_o the_o rich._n so_o that_o two_o man_n that_o be_v of_o different_a religion_n may_v be_v both_o in_o the_o right_a way_n to_o heaven_n provide_v they_o do_v their_o endeavour_n to_o find_v out_o the_o truth_n for_o it_o be_v inconsistent_a with_o justice_n to_o give_v a_o be_v to_o any_o creature_n that_o must_v necessary_o make_v it_o more_o miserable_a than_o not_o to_o be_v which_o must_v be_v if_o man_n be_v to_o be_v punish_v eternal_o for_o unavoidable_a mistake_v but_o god_n who_o can_v have_v no_o other_o design_n in_o create_v our_o immortal_a mind_n than_o that_o they_o shall_v be_v happy_a consequent_o have_v give_v they_o all_o since_o they_o be_v all_o equal_o from_o he_o sufficient_a mean_n to_o make_v themselves_o so_o so_o that_o it_o be_v strange_o absurd_a as_o well_o as_o injurious_a to_o a_o infinite_o perfect_a be_v to_o suppose_v he_o be_v a_o respecter_n of_o person_n or_o that_o he_o have_v make_v man_n eternal_a happiness_n or_o misery_n to_o depend_v on_o such_o accident_n as_o be_v bear_v in_o england_n rome_n turkey_n china_n etc._n etc._n promulgation_n be_v certain_o essential_a to_o a_o law_n and_o therefore_o those_o that_o have_v no_o opportunity_n of_o be_v convince_v of_o the_o truth_n of_o the_o gospel_n shall_v not_o be_v accountable_a for_o not_o believe_v it_o but_o shall_v be_v judge_v by_o the_o law_n they_o know_v and_o not_o by_o that_o they_o do_v not_o know_v nor_o shall_v those_o that_o do_v believe_v the_o gospel_n if_o after_o a_o diligent_a search_n they_o be_v mistake_v in_o some_o point_n of_o it_o be_v condemn_v for_o it_o because_o those_o point_n can_v be_v say_v to_o be_v sufficient_o promulgate_v to_o they_o to_o doubt_v of_o this_o be_v to_o question_v the_o justice_n of_o god_n therefore_o i_o may_v safe_o conclude_v that_o whoever_o do_v what_o god_n require_v from_o he_o shall_v be_v reward_v and_o that_o god_n require_v no_o more_o from_o every_o one_o but_o that_o he_o shall_v use_v his_o honest_a endeavour_n by_o all_o mean_n to_o know_v and_o understand_v his_o will_n as_o perfect_o as_o he_o can_v provide_v when_o know_v he_o do_v his_o best_a endeavour_n to_o live_v up_o to_o it_o and_o consequent_o the_o great_a charity_n the_o magistrate_n be_v capable_a of_o do_v be_v not_o to_o prejudice_v man_n in_o their_o grand_a choice_n by_o punishment_n or_o reward_n but_o to_o leave_v they_o entire_o at_o liberty_n as_o the_o most_o likely_a way_n to_o find_v out_o the_o truth_n or_o if_o they_o miss_v it_o to_o make_v their_o mistake_v whole_o innocent_a but_o of_o that_o more_o hereafter_o 3._o all_o the_o uncharitableness_n animosity_n envy_n and_o hatred_n that_o reign_v among_o dissent_v party_n be_v owe_v to_o persecution_n and_o not_o to_o the_o bare_a difference_n of_o opinion_n which_o of_o themselves_o be_v no_o more_o apt_a to_o produce_v these_o effect_n than_o different_a complexion_n or_o palate_n for_o to_o see_v a_o man_n in_o a_o error_n be_v apt_a to_o create_v pity_n in_o we_o a_o passion_n very_o opposite_a to_o or_o outward_a way_n of_o worship_n but_o to_o use_v one_o ill_a upon_o that_o account_n set_v he_o at_o perfect_a enmity_n and_o create_v a_o quarrel_n the_o heathen_n who_o have_v more_o and_o wide_a difference_n about_o matter_n of_o religion_n than_o the_o christian_n yet_o because_o they_o tolerate_v one_o another_o have_v not_o those_o irreconcilable_a animosity_n fierce_a contention_n and_o unnatural_a war_n which_o have_v frequent_o happen_v since_o the_o propagation_n of_o the_o christian_a religion_n which_o yet_o without_o impiety_n can_v be_v impute_v to_o its_o genius_n which_o be_v pure_a peaceable_a and_o inoffensive_a and_o require_v a_o universal_a love_n and_o charity_n for_o all_o man_n of_o what_o profession_n soever_o no_o it_o be_v the_o antichristian_a doctrine_n of_o persecution_n that_o have_v transform_v the_o mild_a and_o sociable_a nature_n of_o man_n into_o great_a ferocity_n than_o that_o of_o wolf_n and_o tiger_n for_o nothing_o its_o certain_a can_v more_o exasperate_v the_o mind_n of_o man_n than_o to_o be_v ill_o use_v for_o follow_v the_o dictate_v of_o their_o conscience_n for_o then_o every_o one_o of_o they_o since_o they_o all_o suffer_v upon_o the_o same_o account_n will_v be_v apt_a to_o resent_v not_o only_o what_o be_v do_v to_o himself_o but_o to_o the_o rest_n of_o his_o sect_n who_o can_v but_o think_v their_o persecutor_n their_o mortal_a enemy_n since_o they_o not_o only_o use_v they_o ill_o without_o any_o manner_n of_o provocation_n but_o as_o they_o can_v but_o suppose_v endeavour_v to_o force_v they_o to_o ruin_v themselves_o eternal_o and_o they_o if_o ever_o they_o get_v their_o persecutor_n in_o their_o power_n will_v in_o all_o likelihood_n double_a or_o treble_a on_o they_o what_o themselves_o suffer_v so_o by_o degree_n man_n arrive_v to_o the_o height_n of_o fury_n rage_n and_o madness_n and_o break_v through_o not_o only_o all_o the_o tie_v of_o christianity_n but_o even_o humanity_n though_o whilst_o they_o thus_o furnish_v such_o powerful_a provocation_n to_o endless_a discord_n hatred_n faction_n war_n massacre_n etc._n etc._n they_o have_v nothing_o in_o their_o mouth_n but_o the_o good_a of_o the_o church_n and_o salvation_n of_o soul_n not_o consider_v that_o without_o love_n they_o can_v be_v christ_n disciple_n john_n 13._o and_o that_o all_o other_o duty_n without_o charity_n profit_n nothing_o but_o what_o be_v more_o opposite_a to_o these_o than_o to_o tempt_v man_n to_o make_v themselves_o miserable_a hereafter_o to_o avoid_v be_v so_o here_o for_o either_o they_o must_v continue_v all_o their_o life_n under_o persecution_n which_o who_o can_v support_v or_o else_o they_o must_v buy_v their_o temporal_a quiet_n with_o the_o loss_n of_o their_o eternal_a happiness_n but_o 4._o this_o doctrine_n of_o compulsion_n be_v not_o only_o inconsistent_a with_o love_n meekness_n and_o suchlike_a but_o direct_o contrary_a to_o the_o very_a foundation_n of_o natural_a equity_n and_o justice_n in_o cause_v man_n to_o do_v as_o they_o will_v not_o be_v do_v unto_o for_o they_o that_o be_v when_o they_o have_v the_o civil_a power_n on_o their_o side_n
doubt_n will_v instruct_v they_o in_o their_o own_o religion_n whether_o paganism_n judaisme_n or_o mahometism_n yet_o no_o man_n will_v suppose_v that_o they_o can_v just_o use_v force_n on_o they_o when_o they_o come_v to_o year_n of_o discretion_n to_o make_v they_o embrace_v those_o religion_n or_o any_o other_o and_o yet_o the_o case_n between_o the_o magistrate_n and_o his_o subject_n be_v very_o different_a from_o that_o of_o parent_n and_o child_n in_o their_o nonage_n because_o the_o magistrate_n be_v not_o in_o those_o matter_n to_o supply_v the_o defect_n of_o his_o subject_n understanding_n for_o a_o time_n but_o his_o power_n reach_v to_o man_n of_o all_o age_n and_o capacity_n so_o that_o it_o be_v evident_a that_o the_o reason_n that_o subject_n child_n in_o their_o nonage_n to_o the_o use_n of_o force_n do_v not_o all_o concern_v man_n at_o year_n of_o discretion_n 10._o it_o be_v grant_v by_o all_o that_o a_o heathen_a magistrate_n have_v no_o right_a to_o judge_n in_o matter_n simple_o religious_a how_o then_o come_v a_o christian_a by_o the_o law_n of_o nature_n to_o obtain_v this_o charter_n since_o that_o law_n allow_v one_o magistrate_n no_o more_o power_n than_o another_o and_o what_o be_v do_v by_o a_o competent_a authority_n though_o not_o right_a yet_o be_v valid_a ratum_fw-la si_fw-la non_fw-la rectum_fw-la and_o as_o civil_a power_n be_v every_o where_o the_o same_o so_o let_v i_o add_v church-power_n be_v so_o too_o so_o that_o the_o church_n can_v give_v any_o new_a power_n to_o the_o magistrate_n by_o his_o become_v a_o member_n of_o it_o nor_o the_o magistrate_n any_o new_a power_n to_o the_o church_n by_o his_o come_n into_o it_o 11._o it_o be_v say_v the_o law_n of_o nature_n oblige_v every_o one_o in_o his_o station_n to_o promote_v the_o true_a religion_n and_o for_o that_o reason_n the_o magistrate_n be_v oblige_v to_o exercise_v a_o coercive_a power_n in_o matter_n mere_o religious_a the_o magistrate_n no_o doubt_n be_v to_o make_v use_n of_o his_o power_n in_o thing_n that_o belong_v to_o his_o station_n but_o mere_o religious_a one_o as_o it_o have_v be_v already_o prove_v do_v not_o as_o to_o those_o he_o be_v no_o more_o than_o a_o private_a person_n nay_o the_o clergy_n can_v own_v he_o for_o more_o without_o destroy_v their_o own_o supremacy_n in_o matter_n spiritual_a which_o include_v mere_o religious_a one_o except_o there_o can_v be_v more_o than_o one_o supreme_a in_o the_o same_o thing_n chap._n iii_o that_o a_o power_n in_o the_o magistrate_n to_o use_v force_n in_o matter_n of_o mere_a religion_n tend_v to_o man_n eternal_a ruin_n 1._o but_o if_o the_o magistrate_n have_v any_o such_o power_n from_o the_o law_n of_o nature_n it_o must_v be_v because_o it_o tend_v to_o promote_v either_o the_o eternal_a or_o temporal_a good_a of_o mankind_n or_o the_o honour_n of_o god_n but_o to_o take_v away_o the_o least_o colour_n of_o any_o right_n upon_o these_o pretence_n i_o shall_v show_v first_o the_o exercise_n of_o such_o a_o power_n be_v destructive_a of_o man_n eternal_a happiness_n 2_o of_o his_o temporal_a and_o contrary_a to_o all_o those_o law_n that_o for_o consequence_n to_o the_o eternal_a happiness_n of_o mankind_n in_o have_v a_o direct_a tendency_n to_o make_v they_o act_v contrary_a to_o their_o conscience_n for_o since_o force_n can_v no_o more_o to_o convince_v the_o conscience_n as_o violence_n be_v and_o yet_o it_o oblige_v a_o man_n to_o act_v it_o oblige_v he_o to_o act_v contrary_a to_o his_o conscience_n which_o be_v direct_o contrary_a and_o base_o lie_v both_o to_o god_n and_o man._n 3._o the_o true_a religion_n itself_o can_v neither_o judge_v nor_o punish_v but_o the_o magistrate_n by_o the_o true_a religion_n mean_v his_o own_o and_o since_o all_o magistrate_n think_v themselves_o in_o the_o right_n they_o if_o force_n be_v to_o be_v use_v must_v think_v themselves_o oblige_v to_o use_v it_o and_o consequent_o if_o one_o
