very_a matter_n of_o it_o as_o have_v full_o appear_v before_o 6._o it_o be_v true_a oath_n be_v give_v by_o college_n and_o corporation_n but_o be_v they_o not_o warrantable_a by_o the_o law_n and_o untouched_a 7._o indeed_o these_o particular_a oath_n be_v not_o in_o so_o many_o word_n find_v in_o the_o statute_n yet_o who_o doubt_n but_o that_o the_o king_n have_v power_n by_o the_o law_n of_o the_o land_n to_o grant_v such_o charter_n and_o to_o give_v authority_n to_o college_n and_o corporation_n to_o administer_v such_o oath_n 8._o again_o who_o can_v or_o dare_v lay_v claim_n to_o such_o a_o power_n but_o the_o king_n or_o administer_v such_o oath_n without_o power_n from_o the_o king_n much_o less_o against_o his_o express_a will_n and_o proclamation_n case_n xvii_o whether_o the_o covenant_n be_v not_o against_o former_a obligation_n 1._o i_o conclude_v it_o be_v so_o and_o therefore_o void_a the_o force_n of_o the_o consequence_n can_v be_v resist_v in_o those_o obey_v authority_n to_o keep_v our_o oath_n and_o promise_n to_o serve_v the_o church_n in_o our_o generation_n which_o we_o shall_v now_o review_v in_o their_o order_n sect_n 1._o whether_o the_o covenant_n be_v not_o against_o the_o law_n of_o obedience_n to_o authority_n 1._o you_o will_v persuade_v we_o that_o i_o affirm_v this_o only_a upon_o my_o former_a principle_n because_o the_o covenant_n be_v against_o the_o right_n of_o the_o king_n the_o law_n of_o the_o land_n the_o privilege_n of_o parliament_n and_o the_o liberty_n of_o the_o subject_n which_o you_o conceive_v be_v all_o lay_v in_o the_o dust_n 2._o perhaps_o you_o may_v find_v these_o principle_n more_o potent_a and_o vigorous_a in_o their_o resurrection_n however_o though_o i_o have_v a_o general_n reflection_n upon_o these_o former_a argument_n yet_o i_o add_v a_o particular_a force_n to_o the_o present_a argument_n which_o have_v raise_v a_o dust_n it_o seem_v you_o do_v not_o see_v in_o these_o word_n 3._o more_o particular_o god_n first_o oblige_v we_o to_o be_v subject_a and_o to_o obey_v our_o governor_n and_o the_o covenant_n will_v engage_v we_o to_o disobey_v disown_n and_o destroy_v they_o i_o mean_v our_o governor_n in_o the_o church_n the_o covenant_n will_v discharge_v we_o of_o our_o obedience_n and_o oblige_v we_o to_o resistance_n contrary_a to_o god_n express_a obligation_n upon_o we_o which_o can_v be_v 4._o god_n do_v immediate_o by_o his_o word_n and_o likewise_o by_o the_o mediation_n and_o interposition_n of_o civil_a authority_n command_v we_o to_o obey_v to_o be_v subject_n and_o not_o to_o resist_v our_o spiritual_a governor_n the_o covenant_n will_v engage_v to_o break_v all_o at_o once_o and_o at_o once_o to_o violate_v the_o law_n of_o god_n the_o king_n and_o the_o church_n and_o all_o authority_n 5._o our_o duty_n be_v positive_a to_o be_v subject_n 2._o negative_a not_o to_o resist_v whosoever_o resist_v the_o power_n resist_v the_o ordinance_n of_o god_n wherefore_o we_o must_v needs_o be_v subject_a for_o conscience_n sake_n rom._n 13._o now_o both_o these_o be_v break_v by_o the_o covenant_n the_o one_o by_o omission_n the_o other_o by_o commission_n 6._o first_o our_o positive_a duty_n of_o obedience_n and_o subjection_n carry_v in_o it_o by_o universal_a consent_n to_o defend_v preserve_v to_o honour_v observe_v and_o to_o be_v faithful_a to_o our_o governor_n now_o how_o these_o be_v consistent_a with_o endeavour_n to_o extirpate_v i_o can_v see_v 7._o again_o our_o negative_a part_n or_o nonresistance_n be_v transgress_v too_o by_o the_o apostle_n logic_n not_o to_o be_v subject_n be_v to_o resist_v whosoever_o resist_v wherefore_o we_o must_v needs_o be_v subject_a however_o to_o endeavour_v to_o extirpate_v be_v too_o plain_o to_o resist_v 8._o for_o endeavour_n to_o extirpate_v a_o government_n be_v both_o far_o beyond_o the_o compass_n of_o subjection_n they_o be_v no_o part_n either_o of_o active_a or_o passive_a obedience_n and_o deep_a in_o the_o nature_n of_o resistance_n most_o proper_o take_v 9_o endeavour_n to_o extirpate_v have_v action_n in_o they_o and_o be_v therefore_o more_o than_o passive_a obedience_n their_o action_n also_o be_v diametrical_o opposite_a to_o active_a obedience_n 10._o again_o endeavour_n to_o extirpate_v do_v formal_o carry_v resistance_n in_o they_o yea_o they_o be_v the_o formal_a act_n of_o high_a resistance_n not_o of_o the_o law_n only_o but_o of_o the_o government_n itself_o not_o in_o the_o action_n only_o but_o in_o the_o very_o be_v of_o it_o for_o extirpation_n be_v the_o end_n and_o utmost_a of_o resistance_n and_o therefore_o endeavour_v to_o extirpate_v be_v proper_o resistance_n 11._o pray_v resolve_v i_o to_o what_o part_n of_o our_o duty_n to_o our_o parent_n will_v you_o reduce_v endeavour_n to_o extirpate_v their_o government_n over_o we_o or_o how_o can_v such_o endeavour_n square_a and_o conform_v to_o the_o command_v of_o god_n and-the_a law_n of_o the_o land_n not_o to_o resist_v but_o to_o be_v subject_a to_o our_o governor_n ecclesiastical_a and_o civil_a 12._o it_o be_v vain_a to_o say_v we_o be_v bind_v to_o obey_v he_o law_n yet_o we_o may_v endeavour_v to_o have_v they_o change_v it_o be_v not_o safe_a to_o argue_v from_o the_o law_n which_o be_v but_o the_o rule_n to_o our_o governor_n who_o be_v the_o object_n of_o our_o obedience_n 13._o if_o this_o consequence_n be_v good_a upon_o a_o oath_n take_v of_o the_o like_a nature_n against_o the_o civil_a power_n we_o may_v hold_v ourselves_o bind_v to_o endeavour_v to_o extirpate_v both_o king_n and_o parliament_n 14._o for_o government_n by_o monarchy_n and_o the_o constitution_n of_o parliament_n you_o will_v not_o say_v they_o be_v in_o themselves_o necessary_a to_o our_o civil_a state_n and_o if_o because_o episcopacy_n be_v doubt_v to_o be_v jure_fw-la divino_fw-la you_o conclude_v it_o lawful_a to_o swear_v against_o it_o or_o have_v so_o swear_v to_o endeavour_v to_o extirpate_v it_o i_o dare_v not_o undertake_v to_o find_v a_o way_n for_o the_o civil_a government_n to_o escape_v the_o danger_n the_o inference_n be_v easy_a from_o government_n to_o government_n though_o the_o one_o be_v in_o the_o church_n and_o the_o other_o in_o the_o state_n especial_o see_v we_o can_v resist_v the_o one_o and_o not_o disobey_v the_o other_o sect_n 2._o whether_o the_o covenant_n be_v not_o against_o former_a oath_n and_o promise_n 1._o this_o i_o also_o affirm_v and_o consequent_o that_o the_o covenant_n be_v prevent_v by_o the_o whole_a nation_n for_o ever_o 23._o but_o it_o be_v to_o be_v remember_v before_o we_o conclude_v so_o confident_o that_o though_o the_o proem_n run_v thus_o we_o nobleman_n baron_n knight_n gentleman_n citizens_z burgess_n and_o minister_n of_o the_o gospel_n as_o well_o as_o commons_o of_o all_o sort_n have_v so_o resolve_v and_o determine_v yet_o most_o nobleman_n baron_n knight_n citizens_z burgess_n minister_n and_o commons_o of_o all_o sort_n have_v not_o thus_o resolve_v and_o determine_v when_o the_o covenant_n be_v pen_v or_o publish_v 24._o for_o it_o be_v bring_v from_o seotland_n and_o by_o a_o few_o man_n at_o first_o a_o little_a alter_v in_o england_n and_o then_o by_o a_o order_n of_o some_o of_o the_o commons_o print_v and_o publish_v 25._o now_o if_o this_o be_v to_o make_v a_o real_a and_o national_a covenant_n three_o or_o four_o private_a person_n may_v as_o easy_o write_v over_o these_o great_a word_n and_o as_o easy_o oblige_v the_o whole_a nation_n and_o posterity_n for_o ever_o but_o this_o be_v ridiculous_a 26._o again_o it_o be_v certain_a that_o many_o individual_a person_n from_o the_o king_n the_o noble_n baron_n knight_n burgess_n citizen_n minister_n and_o commons_o of_o all_o sort_n never_o take_v the_o covenant_n but_o ever_o as_o occasion_n be_v offer_v declare_v their_o abhorrency_n of_o it_o 27._o yea_o the_o popish_a the_o milignant_a and_o the_o prelatical_a party_n which_o certain_o be_v then_o no_o mean_a part_n of_o the_o nation_n if_o not_o the_o great_a be_v suppose_v in_o the_o covenant_n itself_o to_o be_v enemy_n to_o it_o and_o be_v indeed_o swear_v against_o it_o and_o be_v these_o oblige_v by_o the_o same_o covenant_n and_o their_o posterity_n after_o they_o be_v they_o swear_v to_o oppose_v and_o destroy_v themselves_o you_o will_v not_o say_v it_o 28._o again_o if_o these_o word_n can_v create_v a_o real_a covenant_n in_o your_o sense_n not_o only_a scotland_n who_o frame_v it_o and_o england_n who_o know_v not_o of_o it_o for_o the_o most_o part_n till_o it_o be_v take_v but_o ireland_n too_o and_o its_o posterity_n be_v oblige_v by_o it_o and_o all_o the_o rebel_n there_o be_v take_v into_o confederation_n and_o thousand_o of_o people_n there_o that_o never_o see_v it_o or_o perhaps_o never_o hear_v so_o much_o as_o that_o there_o be_v any_o such_o thing_n in_o the_o world_n for_o divers_a year_n after_o this_o their_o pretend_a obligation_n by_o it_o 29._o true_o i_o think_v the_o covenant_a party_n will_v not_o have_v enter_v into_o so_o solemn_a a_o league_n with_o a_o prelatical_a malignant_a party_n much_o less_o with_o papist_n and_o irish_a rebel_n yet_o such_o be_v the_o consequence_n of_o your_o notion_n of_o a_o real_a covenant_n 30._o moreover_o this_o argument_n be_v confute_v in_o the_o very_a proem_n of_o the_o covenant_n itself_o so_o plain_o and_o evident_o that_o i_o must_v needs_o wonder_v that_o so_o many_o quick_a and_o perceive_v eye_n shall_v not_o have_v discover_v it_o wherein_o it_o say_v speak_v of_o the_o form_n and_o manner_n of_o give_v and_o take_v the_o covenant_n wherein_o we_o all_o subscribe_v therefore_o no_o more_o do_v take_v the_o covenant_n then_o do_v subscribe_v it_o and_o beyond_o all_o contradiction_n add_v be_v each_o one_o of_o we_o for_o himself_o then_o no_o one_o for_o another_o much_o less_o for_o so_o many_o thousand_o as_o your_o real_a notion_n will_v infer_v 31._o therefore_o the_o presser_n of_o the_o covenant_n dare_v not_o trust_v your_o logic_n but_o will_v have_v not_o only_a parent_n but_o their_o child_n not_o only_o master_n but_o servant_n not_o only_o tutor_n but_o pupil_n and_o such_o as_o be_v under_o the_o tuition_n of_o other_o to_o subscribe_v for_o themselves_o according_a to_o the_o phrase_n every_o one_o for_o himself_o 32._o but_o to_o conclude_v if_o it_o be_v against_o the_o very_a nature_n and_o essence_n of_o a_o oath_n to_o be_v any_o more_o than_o personal_a to_o bind_v succession_n or_o posterity_n or_o to_o be_v national_a and_o real_a as_o you_o pretend_v alas_o what_o can_v word_n do_v more_o then_o to_o make_v a_o noise_n to_o trouble_v man_n mind_n and_o to_o beget_v trouble_n in_o the_o church_n by_o needless_a disputation_n but_o that_o it_o be_v so_o i_o hope_v our_o casuist_n who_o yourselves_o and_o all_o man_n else_o admire_v have_v put_v it_o out_o of_o doubt_n to_o your_o full_a satisfaction_n sect_n 3._o of_o the_o capacity_n of_o all_o covenanter_n 1._o the_o three_o principle_n which_o you_o intimate_v i_o take_v for_o grant_v be_v that_o all_o person_n that_o take_v the_o covenant_n be_v in_o the_o same_o capacity_n with_o ourselves_o you_o say_v you_o can_v yield_v unto_o it_o 2._o i_o have_v labour_v to_o find_v out_o your_o meaning_n and_o can_v discover_v any_o thing_n but_o the_o exception_n of_o the_o single_a person_n that_o you_o can_v stand_v upon_o 3._o but_o if_o you_o please_v to_o review_v what_o i_o say_v from_o pag._n 93._o to_o pag._n 97._o you_o will_v see_v your_o oversight_n and_o grant_v that_o i_o do_v not_o take_v it_o for_o grant_v 4._o and_o until_o you_o give_v answer_n to_o the_o reason_n there_o offer_v as_o also_o in_o some_o other_o place_n of_o my_o book_n i_o think_v i_o be_o not_o at_o all_o concern_v to_o trouble_v you_o further_o about_o it_o but_o shall_v now_o take_v up_o my_o shield_n and_o appear_v in_o defence_n of_o my_o particular_a argument_n case_n viii_o whether_o to_o endeavour_v to_o alter_v the_o government_n of_o the_o church_n be_v against_o to_o prove_v the_o matter_n of_o the_o covenant_n sinful_a my_o major_a proposition_n you_o say_v be_v determine_v in_o the_o second_o of_o these_o case_n this_o you_o grant_v in_o mr._n crofton_n the_o wind_a it_o up_o or_o to_o wind_v it_o up_o 4._o i_o can_v easy_o consent_v that_o conatus_fw-la be_v not_o effectus_fw-la yet_o you_o acknowledge_v it_o be_v a_o motion_n towards_o the_o effect_n which_o you_o call_v a_o natural_a power_n and_o i_o doubt_v not_o we_o agree_v that_o conatus_fw-la have_v essential_o in_o it_o a_o natural_a tendency_n and_o operation_n towards_o the_o effect_n endeavour_v 5._o now_o simple_a and_o bare_a petition_n or_o submiss_a supplication_n have_v not_o so_o it_o have_v indeed_o a_o verbal_a motion_n for_o the_o thing_n desire_v but_o no_o real_a operation_n or_o natural_a motion_n towards_o the_o effect_n of_o it_o 6._o the_o subject_n by_o petition_n do_v desire_v it_o but_o the_o parliament_n in_o all_o those_o legal_a method_n of_o debate_v vete_v commit_v engross_a etc._n etc._n do_v proper_o endeavour_v the_o abolition_n of_o any_o thing_n legal_o establish_v 7._o true_o i_o sober_o discern_v this_o distinction_n of_o petition_n and_o endeavour_n both_o in_o the_o covenant_n and_o in_o the_o act_n of_o uniformity_n 8._o the_o covenant_n say_v we_o shall_v endeavour_v the_o extirpation_n of_o prelacy_n not_o desire_n or_o persuade_v but_o endeavour_v it_o neither_o can_v you_o possible_o persuade_v yourselves_o that_o such_o as_o then_o impose_v and_o take_v the_o covenant_n do_v at_o first_o intend_v such_o endeavour_n as_o you_o mean_v who_o take_v other_o course_n you_o well_o know_v to_o effect_v the_o same_o 9_o it_o be_v add_v constant_o and_o zealous_o must_v we_o be_v always_o zealous_a and_o hot_a in_o our_o petition_n must_v we_o perpetual_o solicit_v king_n and_o parliament_n with_o our_o supplication_n this_o will_v hardly_o consist_v with_o submiss_a supplication_n 10._o indeed_o it_o be_v plain_o sedition_n in_o itself_o take_v endeavour_n in_o your_o own_o sense_n public_o to_o engage_v by_o covenant_n zealous_o and_o constant_o to_o petition_v the_o alteration_n of_o government_n this_o be_v to_o declare_v to_o the_o world_n that_o we_o will_v never_o be_v quiet_a under_o it_o 11._o thus_o also_o it_o be_v in_o the_o act_n we_o be_v to_o declare_v there_o lie_v no_o obligation_n to_o endeavour_v a_o change_n it_o be_v not_o say_v that_o we_o shall_v not_o petition_v that_o other_o may_v endeavour_v it_o 12._o rational_a endeavour_n imply_v that_o the_o person_n endeavour_v have_v probable_o a_o power_n to_o effect_v but_o it_o be_v certain_a before_o hand_n that_o without_o the_o supreme_a legislative_a power_n the_o subject_n can_v effect_v the_o extirpation_n of_o episcopacy_n therefore_o they_o can_v rational_o or_o lawful_o endeavour_v it_o therefore_o if_o they_o promise_v or_o covenant_n so_o to_o do_v it_o be_v sinful_a and_o they_o may_v lawful_o declare_v they_o be_v not_o oblige_v unto_o it_o that_o be_v to_o endeavour_v what_o they_o have_v no_o power_n by_o law_n to_o do_v neither_o can_v the_o act_n be_v think_v to_o intend_v any_o more_o stultum_fw-la est_fw-la conari_fw-la quod_fw-la nequeas_fw-la efficere_fw-la 13._o last_o if_o submiss_a supplication_n be_v yet_o think_v to_o have_v any_o spice_n of_o endeavour_n in_o it_o it_o can_v be_v rational_o think_v to_o be_v intend_v in_o the_o word_n endeavour_n in_o the_o act_n you_o observe_v that_o endeavour_n in_o the_o act_n and_o in_o the_o covenant_n be_v of_o one_o measure_n and_o it_o be_v too_o evident_a there_o be_v more_o in_o endeavour_n in_o the_o covenant_n then_o mere_a petition_n and_o submiss_a supplication_n which_o run_v we_o upon_o those_o sad_a consequence_n that_o in_o all_o reason_n the_o intention_n of_o this_o new_a act_n be_v but_o to_o secure_v we_o from_o you_o say_v to_o make_v law_n against_o simple_a endeavor_n be_v certain_o destructive_a to_o the_o liberty_n of_o the_o subject_a and_o privilege_n of_o parliament_n methinks_v then_o you_o shall_v not_o apprehend_v such_o a_o simple_a and_o bare_a endeavour_n be_v to_o be_v disclaim_v as_o be_v essential_a in_o your_o own_o judgement_n to_o the_o liberty_n of_o the_o subject_a and_o privilege_n of_o parliament_n sect_n 6._o whether_o to_o endeavour_v etc._n etc._n be_v at_o all_o time_n svi_fw-la juris_fw-la to_o every_o subject_a etc._n etc._n 1._o i_o can_v yet_o consent_v that_o to_o endeavour_v to_o alter_v the_o overnment_n of_o the_o church_n be_v at_o all_o time_n or_o at_o this_o time_n svi_fw-la juris_fw-la to_o every_o or_o to_o any_o subject_a or_o indeed_o to_o any_o person_n in_o the_o nation_n to_o speak_v home_o 2._o the_o king_n be_v the_o proper_a judge_n of_o what_o government_n be_v fit_a for_o the_o church_n both_o as_o he_o be_v supreme_a governor_n over_o it_o and_o as_o he_o be_v the_o head_n of_o the_o parliament_n 3._o as_o he_o be_v supreme_a governor_n over_o the_o church_n of_o england_n he_o be_v supreme_a judge_n in_o all_o cause_n into_o who_o the_o last_o appeal_n resolve_v and_o consequent_o he_o be_v supreme_a judge_n in_o this_o of_o the_o fitness_n of_o the_o government_n of_o the_o church_n unto_o who_o the_o last_o appeal_n for_o a_o final_a &_o definitive_a sentence_n and_o determination_n be_v only_o to_o be_v make_v 4._o again_o as_o he_o be_v head_n of_o the_o parliament_n he_o be_v no_o less_o for_o though_o the_o 2_o house_n be_v also_o judge_n of_o the_o fitness_n of_o the_o government_n yet_o still_o with_o submission_n and_o reservation_n to_o the_o high_a judge_n thereof_o their_o sovereign_a lord_n the_o king_n who_o have_v a_o negative_a upon_o both_o house_n and_o give_v life_n or_o death_n with_o his_o own_o word_n to_o any_o bill_n tender_v to_o he_o 5._o so_o that_o in_o matter_n legal_o exist_v the_o king_n have_v this_o great_a advantage_n above_o his_o 2_o house_n the_o king_n have_v power_n of_o himself_o to_o continue_v the_o existence_n of_o any_o such_o thing_n without_o his_o two_o house_n that_o be_v whether_o they_o may_v petition_v &_o both_o house_n may_v proceed_v so_o far_o as_o to_o frame_v a_o bill_n against_o a_o government_n absolute_o consider_v and_o without_o respect_n to_o any_o prior_n obligation_n by_o oath_n or_o otherwise_o upon_o the_o king_n and_o tender_v this_o unto_o the_o king_n in_o order_n to_o the_o extirpation_n of_o the_o same_o yet_o if_o the_o king_n refuse_v to_o pass_v the_o bill_n that_o bill_n so_o once_o reject_v can_v be_v revive_v during_o that_o parliament_n neither_o may_v any_o person_n in_o either_o house_n so_o much_o as_o move_v it_o any_o more_o by_o the_o law_n of_o parliament_n which_o nothing_o can_v warrant_v against_o but_o the_o necessity_n of_o the_o thing_n so_o to_o be_v revive_v upon_o the_o word_n of_o god_n 7._o the_o same_o reason_n persuade_v i_o that_o when_o both_o king_n and_o parliament_n have_v by_o fresh_a law_n declare_v their_o dissent_n to_o alter_v the_o government_n against_o all_o endeavour_n use_v to_o that_o end_n and_o so_o they_o have_v do_v by_o the_o late_a statute_n for_o its_o restauration_n then_o we_o the_o subject_n can_v be_v bind_v any_o long_a to_o endeavour_v it_o if_o we_o be_v bind_v before_o 8._o to_o be_v bind_v still_o to_o vex_v the_o king_n and_o parliament_n with_o perpetual_a repetition_n of_o petition_n to_o remove_v a_o government_n which_o they_o have_v &_o still_o do_v signify_v they_o will_v not_o remove_v yea_o which_o they_o do_v signal_o own_v and_o ratify_v so_o much_o the_o more_o be_v to_o be_v bind_v to_o go_v contrary_a to_o authority_n as_o well_o as_o law_n to_o trouble_v the_o peace_n of_o church_n and_o state_n and_o the_o government_n over_o we_o and_o indeed_o to_o endeavour_v or_o labour_n in_o vain_a all_o hope_n of_o prevail_a be_v take_v away_o at_o
