upon_o he_o nor_o condemn_v he_o but_o by_o a_o lawful_a judgement_n of_o his_o peer_n and_o by_o the_o law_n of_o the_o land_n 2._o we_o shall_v sell_v to_o no_o man_n nor_o defer_v to_o any_o man_n justice_n or_o right_n second_o that_o by_o the_o statute_n of_o 42_o of_o edward_n 3d._n cha._n 1._o 1._o the_o great_a charter_n be_v command_v to_o be_v keep_v in_o all_o the_o point_n and_o 2._o it_o be_v enact_v that_o if_o any_o statute_n be_v make_v to_o the_o contrary_a that_o shall_v be_v hold_v for_o none_o which_o statute_n be_v unrepealed_a the_o respondent_fw-la observe_v that_o by_o a_o act_n of_o the_o 26_o of_o march_n 1650._o entitle_v a_o act_n for_o establish_v a_o high_a court_n of_o justice_n power_n be_v give_v to_o this_o court_n to_o try_v condemn_v and_o cause_n execution_n of_o death_n to_o be_v do_v upon_o the_o freeman_n of_o england_n according_a as_o the_o major_a number_n of_o any_o 12_o of_o the_o member_n thereof_o shall_v judge_n to_o appertain_v to_o justice_n and_o thereupon_o the_o respondent_fw-la do_v humble_o infer_v and_o offer_v for_o law_n that_o the_o say_a act_n be_v diametrical_o contrary_a unto_o and_o utter_o inconsistent_a with_o the_o say_v great_a charter_n and_o be_v therefore_o by_o the_o say_v recite_v statute_n to_o be_v hold_v for_o none_o that_o it_o can_v with_o no_o more_o reason_n equity_n or_o justice_n hold_v the_o value_n and_o reputation_n of_o a_o law_n the_o say_a statute_n before_o recite_v be_v in_o force_n then_o if_o contrary_a to_o the_o second_o clause_n in_o that_o 29_o chap._n of_o magna_fw-la charta_fw-la it_o have_v be_v also_o enact_v that_o justice_n and_o right_o shall_v be_v defer_v to_o all_o freeman_n and_o sell_v to_o all_o that_o will_v buy_v it_o three_o that_o upon_o premise_v by_o the_o petition_n of_o right_o 3d_o car._n that_o contrary_a to_o the_o great_a charter_n trial_n and_o execution_n have_v be_v have_v and_o do_v against_o the_o subject_n by_o commission_n martial_a etc._n etc._n it_o be_v therefore_o pray_v and_o by_o the_o commission_n enact_v that_o 1._o no_o commission_n of_o the_o like_a nature_n may_v be_v thenceforth_o issue_v etc._n etc._n and_o that_o do_v 2._o to_o prevent_v lest_o any_o of_o the_o subject_n shall_v be_v put_v to_o death_n contrary_a to_o the_o law_n and_o franchise_n of_o the_o land_n the_o respondent_fw-la humble_o observe_v and_o affirm_v that_o this_o court_n be_v though_o under_o a_o different_a stile_n in_o nature_n and_o in_o the_o proceed_n thereby_o direct_o the_o same_o with_o a_o commission_n martial_a the_o freeman_n thereby_o be_v to_o be_v try_v for_o life_n and_o adjudge_v by_o the_o major_a number_n of_o the_o commissioner_n sit_v as_o in_o court_n of_o commissioner_n martial_n be_v practise_v and_o be_v agreeable_a to_o their_o constitution_n and_o consequent_o against_o the_o petition_n of_o right_n in_o which_o he_o and_o all_o the_o freeman_n of_o england_n if_o it_o be_v grant_v there_o
