all_o civil_a case_n decide_v by_o their_o proper_a judge_n my_o conscience_n ought_v to_o acquiesce_v and_o if_o i_o may_v be_v thereby_o mislead_v into_o any_o error_n it_o will_v be_v without_o gild_n before_o god._n and_o i_o be_o also_o inform_v that_o by_o a_o statute_n make_v 11_o hen._n 7._o we_o be_v legal_o indemnify_v in_o pay_v our_o allegiance_n to_o the_o king_n in_o be_v it_o we_o continue_v faithful_a therein_o however_o infirm_a his_o title_n may_v afterward_o appear_v and_o therefore_o i_o can_v see_v what_o danger_n can_v affright_v we_o from_o our_o allegiance_n or_o with_o what_o safety_n we_o can_v refuse_v it_o three_o i_o have_v now_o give_v you_o my_o resolution_n of_o the_o chief_a difficulty_n in_o the_o case_n propound_v and_o the_o reason_n on_o which_o it_o be_v build_v and_o i_o can_v think_v of_o nothing_o more_o requisite_a to_o your_o satisfaction_n except_o to_o show_v how_o this_o resolution_n do_v consist_v with_o all_o the_o obligation_n which_o may_v affect_v a_o good_a conscience_n in_o the_o present_a case_n which_o be_v i_o suppose_v chief_o these_o three_o viz._n the_o prescription_n of_o that_o holy_a religion_n we_o profess_v the_o solemn_a oath_n we_o have_v take_v or_o the_o declaration_n we_o have_v subscribe_v and_o the_o avow_a principle_n and_o doctrine_n of_o this_o church_n in_o who_o communion_n we_o live_v 1._o as_o to_o the_o first_o the_o rule_n of_o our_o religion_n be_v the_o holy_a scripture_n nothing_o can_v be_v inconsistent_a with_o one_o which_o be_v not_o repugnant_a to_o the_o other_o and_o according_a to_o the_o best_a of_o my_o understanding_n the_o principle_n i_o have_v proceed_v upon_o do_v not_o disagree_v with_o any_o sacred_a text_n right_o interpret_v the_o first_o king_n of_o israel_n we_o meet_v with_o in_o the_o old_a testament_n be_v saul_n who_o be_v advance_v to_o the_o throne_n as_o well_o by_o god_n institution_n as_o the_o people_n election_n and_o who_o be_v according_a to_o the_o people_n desire_n a_o absolute_a monarch_n like_o the_o other_o king_n in_o those_o eastern_a country_n but_o this_o thanks_o be_v to_o god_n be_v not_o our_o case_n who_o live_v under_o a_o mix_a government_n and_o a_o monarchy_n limit_v by_o the_o fundamental_a constitution_n of_o this_o realm_n and_o yet_o i_o can_v but_o observe_v how_o david_n who_o be_v usual_o prescribe_v as_o a_o eminent_a pattern_n of_o loyalty_n think_v it_o lawful_a to_o raise_v a_o band_n of_o soldier_n for_o a_o defensive_a resistance_n against_o the_o unjust_a persecution_n of_o saul_n though_o a_o absolute_a prince_n and_o sure_o we_o may_v conclude_v a_o minori_fw-la ad_fw-la majus_fw-la that_o such_o a_o defensive_a resistance_n can_v be_v less_o lawful_a when_o apparent_o necessary_a to_o preserve_v a_o whole_a people_n from_o imminent_a ruin_n i_o remember_v our_o lord_n determination_n that_o his_o kingdom_n be_v not_o of_o this_o world_n and_o as_o i_o think_v we_o right_o infer_v from_o thence_o that_o there_o be_v no_o secular_a force_n belong_v to_o his_o kingdom_n for_o enlarge_n its_o border_n or_o secure_v its_o intereslt_n so_o i_o can_v see_v nothing_o in_o these_o word_n to_o hinder_v but_o that_o when_o any_o of_o the_o kingdom_n of_o this_o world_n be_v become_v the_o kingdom_n of_o christ_n by_o incorporate_n his_o religion_n among_o its_o civil_a constitution_n than_o we_o may_v use_v any_o expedient_n for_o the_o defence_n of_o our_o religion_n which_o we_o may_v use_v in_o defend_v any_o other_o privilodge_v of_o our_o civil_a establishment_n our_o lord_n have_v teach_v we_o to_o render_v unto_o cesar_n the_o thing_n that_o be_v cesar_n be_v and_o his_o apostle_n that_o we_o must_v render_v to_o all_o man_n their_o due_n tribute_n to_o who_o tribute_n be_v due_a custom_n to_o who_o custom_n fear_v to_o who_o fear_n and_o honour_n to_o who_o honour_n but_o they_o have_v lest_o we_o to_o the_o constitution_n of_o our_o country_n to_o determine_v what_o the_o thing_n of_o cesar_n be_v what_o custom_n and_o tribute_n be_v due_a and_o when_o to_o be_v pay_v i_o have_v already_o have_v occasion_n to_o consider_v the_o doctrine_n of_o st._n paul_n and_o st._n peter_n concern_v our_o duty_n of_o submission_n to_o the_o supreme_a authority_n and_o to_o those_o who_o administer_v it_o and_o upon_o the_o general_a review_n of_o the_o whole_a he_o seem_v to_o i_o to_o do_v the_o part_n of_o a_o good_a christian_a as_o well_o as_o of_o a_o good_a englishman_n who_o have_v on_o his_o mind_n a_o awful_a regard_n for_o the_o supreme_a authority_n which_o be_v open_a divine_a institution_n who_o will_v not_o refuse_v a_o active_a obedience_n to_o the_o law_n of_o our_o legislator_n if_o consistent_a with_o the_o law_n of_o god_n who_o can_v ready_o submit_v to_o the_o king_n and_o to_o those_o that_o be_v commission_v by_o he_o in_o the_o execution_n of_o those_o law_n who_o pay_v the_o high_a civil_a honour_n to_o the_o king_n as_o the_o supreme_a magistrate_n of_o the_o kingdom_n who_o make_v the_o most_o candid_a and_o honourable_a construction_n he_o can_v of_o all_o his_o prince_n action_n who_o can_v quiet_o submit_v to_o any_o act_n of_o government_n though_o they_o seem_v very_o unjust_a and_o grievous_a to_o his_o private_a intereste_n and_o who_o never_o think_v a_o defensive_a resistance_n lawful_a but_o when_o apparent_o necessary_a to_o save_v a_o kingdom_n from_o utter_a ruin._n he_o that_o can_v do_v all_o this_o be_v a_o good_a proficient_a in_o his_o religion_n for_o he_o will_v find_v it_o not_o very_o easy_a to_o flesh_n and_o blood_n to_o go_v so_o far_o but_o they_o who_o be_v not_o content_a with_o any_o notion_n of_o religion_n which_o will_v not_o expose_v to_o ruin_v the_o kingdom_n that_o embrace_v it_o do_v but_o traduce_v our_o holy_a religion_n and_o expose_v it_o to_o the_o contempt_n and_o hatred_n of_o the_o world._n 2._o let_v we_o next_o consider_v how_o the_o resolution_n i_o have_v give_v will_v consist_v with_o the_o oath_n we_o have_v take_v and_o the_o declaration_n we_o have_v subscribe_v you_o will_v here_o give_v i_o leave_v to_o premise_v that_o the_o form_n we_o have_v swear_v or_o subscribe_v be_v not_o to_o be_v take_v careless_o according_a to_o the_o mere_a sound_n of_o word_n but_o be_v to_o be_v understand_v according_a to_o the_o sense_n which_o they_o plain_o express_v and_o which_o appear_v to_o be_v intend_v by_o our_o superior_n in_o impase_v they_o and_o if_o we_o consider_v our_o oath_n and_o declaration_n according_a to_o this_o rule_n we_o shall_v discover_v that_o they_o have_v bring_v upon_o we_o no_o new_a degree_n of_o allegiance_n or_o subjection_n which_o be_v not_o always_o due_a according_a to_o the_o ancient_a fundamental_a constitution_n of_o this_o kingdom_n that_o we_o have_v hereby_o lose_v none_o of_o our_o english_a right_n and_o liberty_n nor_o the_o king_n enlarge_v his_o prerogative_n beyond_o what_o it_o always_o be_v and_o ought_v to_o be_v and_o therefore_o if_o according_a to_o the_o ancient_a constitution_n of_o this_o kingdom_n the_o government_n be_v mix_v and_o the_o monarchy_n limit_v so_o it_o continue_v if_o the_o freeman_n of_o england_n be_v before_o these_o oath_n bind_v to_o no_o active_a or_o passive_a obedience_n beyond_o what_o the_o law_n of_o the_o land_n prescribe_v they_o arc_n bind_v to_o no_o more_o since_o and_o if_o it_o be_v former_o lawful_a for_o the_o people_n of_o england_n in_o a_o extreme_a necessity_n to_o remove_v a_o king_n who_o government_n be_v become_v inconsistent_a with_o the_o publick-weal_n and_o to_o set_v up_o another_o by_o who_o the_o public_a interest_n may_v be_v secure_v it_o be_v as_o lawful_a still_o notwithstanding_o these_o oath_n we_o have_v take_v or_o the_o declaration_n we_o have_v subscribe_v and_o to_o evince_v this_o more_o satisfactory_o let_v we_o descend_v to_o particular_n 1._o the_o oath_n of_o supremacy_n prescribe_v 1_o eliz._n do_v plain_o appear_v from_o the_o preamble_n and_o body_n of_o the_o act_n and_o from_o all_o the_o part_n of_o the_o oath_n itself_o to_o be_v intend_v only_o for_o assert_v to_o the_o queen_n a_o supremacy_n over_o ecclesiastical_a person_n and_o in_o ecclesiastical_a cause_n in_o opposition_n to_o the_o pretension_n of_o the_o pope_n and_o court_n of_o rome_n when_o therefore_o it_o speak_v of_o bear_v faith_n and_o true_a allegiance_n to_o the_o queen_n and_o her_o heir_n and_o lawful_a successor_n it_o be_v in_o oppolition_n to_o all_o foreign_a jurisdiction_n power_n superiority_n and_o authority_n and_o when_o it_o speak_v of_o our_o assist_v and_o defend_v her_o jurisdiction_n preeminency_n and_o authority_n it_o be_v only_o of_o such_o as_o have_v be_v grant_v or_o belong_v or_o unite_a and_o annex_v to_o the_o imperial_a crown_n of_o this_o realm_n and_o that_o no_o new_a power_n be_v hereby_o give_v to_o
transgress_v a_o divine_a institution_n this_o be_v a_o matter_n of_o great_a importance_n and_o of_o common_a continual_a concernment_n to_o mankind_n we_o may_v reasonable_o expect_v that_o if_o god_n have_v make_v any_o such_o law_n it_o be_v somewhere_o promulge_v to_o the_o world_n with_o sufficient_a evidence_n and_o certainty_n but_o though_o many_o have_v be_v for_o some_o year_n most_o sollicitous_o seek_v after_o it_o yet_o they_o be_v not_o agree_v among_o themselves_o in_o the_o discovery_n nor_o can_v direct_v we_o where_o we_o may_v certain_o meet_v with_o it_o i_o know_v but_o of_o two_o sort_n of_o law_n which_o god_n have_v give_v to_o mankind_n either_o moral_a impress_v on_o the_o human_a nature_n or_o positive_a reveal_v in_o the_o holy_a scripture_n but_o the_o jus_o divinum_fw-la in_o dispute_n be_v a_o stranger_n to_o both_o god_n have_v indeed_o by_o both_o institute_v government_n or_o civil_a authority_n for_o the_o welfare_n and_o security_n of_o man_n in_o their_o civil_a society_n he_o have_v also_o command_v that_o superior_n govern_v just_o and_o merciful_o and_o that_o inferior_n honour_v they_o with_o duty_n and_o submission_n but_o i_o no_o where_n find_v that_o god_n have_v command_v all_o nation_n or_o we_o in_o particular_a to_o be_v under_o that_o form_n of_o government_n which_o in_o contradistinction_n to_o other_o form_n be_v call_v monarchy_n or_o under_o some_o particular_a person_n or_o family_n in_o contradistinction_n to_o all_o other_o the_o law_n of_o nature_n do_v indeed_o erect_v a_o monarchy_n in_o family_n over_o those_o who_o be_v natural_o descend_v from_o he_o that_o be_v to_o govern_v but_o there_o be_v not_o the_o same_o natural_a reason_n in_o our_o civil_a society_n there_o be_v not_o the_o same_o law_n of_o nature_n to_o prescribe_v the_o same_o government_n and_o if_o some_o plead_v a_o likeness_n or_o analogy_n between_o they_o that_o can_v serve_v only_o for_o a_o rhetorical_a illustration_n but_o not_o for_o any_o logical_a proof_n such_o as_o the_o present_a case_n require_v from_o the_o holy_a scripture_n we_o learn_v that_o god_n do_v once_o institute_v a_o monarchy_n for_o the_o people_n of_o israel_n and_o appoint_v particular_o that_o david_n shall_v be_v their_o king_n and_o also_o entail_v the_o crown_n upon_o his_o posterity_n but_o as_o god_n have_v particular_a reason_n for_o that_o institution_n respect_v the_o messiah_n so_o we_o have_v no_o reason_n to_o think_v that_o god_n intend_v by_o that_o institution_n to_o oblige_v any_o other_o nation_n but_o the_o jew_n only_o in_o the_o new_a testament_n we_o find_v civil_a government_n suppose_v and_o the_o moral_a duty_n to_o be_v discharge_v both_o by_o superior_n and_o inferior_n describe_v and_o enforce_v beyond_o what_o they_o be_v in_o any_o other_o institution_n but_o we_o no_o where_n find_v christ_n and_o his_o apostle_n prescribe_v the_o particular_a form_n of_o civil_a government_n or_o prefer_v monarchy_n or_o condemn_v a_o aristocratic_a or_o democratic_n state_n and_o much_o less_o determine_v the_o particular_a person_n or_o family_n on_o who_o the_o regal_a dignity_n shall_v descend_v some_o indeed_o have_v infer_v from_o st._n paul_n assertion_n rom._n 13.1_o that_o the_o particular_a form_n of_o government_n and_o the_o particular_a person_n which_o administer_v it_o be_v by_o a_o divine_a institution_n but_o however_o they_o countenance_v this_o mistake_n from_o our_o english_a translation_n which_o say_v there_o be_v no_o power_n but_o of_o god_n the_o power_n that_o be_v be_v ordain_v of_o god_n yet_o the_o text_n be_v incapable_a of_o such_o a_o sense_n if_o we_o read_v and_o render_v it_o exact_o according_a to_o the_o original_a st._n paul_n word_n be_v 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d which_o in_o a_o exact_a translation_n will_v run_v thus_o there_o be_v no_o authority_n if_o not_o of_o god_n and_o the_o authority_n which_o be_v of_o god_n institution_n be_v order_v under_o god._n the_o plain_a doctrine_n of_o which_o text_n can_v be_v only_o this_o that_o no_o man_n can_v have_v a_o authority_n over_o other_o man_n who_o be_v his_o fellow-creature_n except_o it_o be_v derive_v to_o he_o from_o god_n who_o be_v the_o lord_n of_o all_o and_o that_o whatever_o power_n be_v derive_v to_o any_o superior_n over_o inferior_n it_o must_v be_v subordinate_v to_o god_n from_o who_o it_o be_v derive_v and_o as_o the_o apostle_n do_v infer_v from_o the_o former_a assertion_n that_o every_o soul_n shall_v be_v subject_a to_o and_o not_o resist_v this_o authority_n even_o for_o conscience-sake_n because_o derive_v from_o god_n so_o he_o infer_v from_o the_o latter_a that_o the_o superior_a who_o use_v this_o authority_n must_v administer_v it_o as_o the_o minister_n of_o god_n for_o the_o good_a of_o man_n in_o protect_a virtue_n and_o discourage_a vice_n because_o his_o authority_n be_v subordinate_v to_o god_n the_o supreme_a and_o absolute_a lord_n of_o all_o mankind_n and_o that_o the_o apostle_n do_v speak_v of_o authority_n according_a to_o its_o general_a nature_n and_o institution_n and_o not_o the_o particular_a person_n by_o who_o or_o form_n in_o which_o it_o be_v then_o exercise_v be_v evident_a from_o the_o excellent_a property_n and_o end_n of_o this_o authority_n which_o he_o enumerate_v which_o do_v belong_v indeed_o to_o that_o authority_n which_o god_n have_v institute_v but_o can_v certain_o be_v ascribe_v to_o the_o government_n of_o nero_n the_o present_a and_o the_o worst_a of_o emperor_n and_o to_o make_v this_o more_o plain_a and_o unquestionable_a it_o may_v be_v observe_v that_o as_o saint_n paul_n speak_v of_o authority_n in_o the_o general_n call_v it_o 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d the_o ordinance_n of_o god_n so_o saint_n peter_n speak_v of_o the_o person_n by_o who_o this_o authority_n be_v administer_v call_v they_o 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d 〈◊〉_d the_o ornance_n of_o man_n 14._o 1_o pet._n 2.13_o 14._o whether_o it_o be_v the_o king_n as_o supreme_a or_o inferior_a magistrate_n commission_v by_o he_o after_o all_o i_o be_o ready_a to_o acknowledge_v that_o the_o law_n of_o god_n do_v secure_a prince_n yea_o and_o the_o mean_a of_o their_o subject_n in_o the_o quiet_a possession_n of_o those_o right_n which_o they_o have_v just_o which_o assert_n the_o english_a monarchy_n to_o be_v absolute_a and_o unlimited_a at_o least_o that_o in_o its_o original_a and_o essential_a constitution_n it_o be_v so_o and_o can_v be_v otherwise_o we_o can_v but_o reflect_v on_o the_o ill_a design_n or_o ill_a conduct_n of_o some_o who_o in_o their_o discourse_n on_o this_o subject_a have_v transcribe_v out_o of_o their_o common_a to_o be_v ascribe_v to_o any_o king_n or_o emperor_n in_o any_o part_n or_o age_n of_o the_o world._n upon_o this_o principle_n they_o have_v exalt_v the_o english_a monarch_n into_o as_o absolute_a and_o arbitrary_a a_o sovereign_n as_o any_o emperor_n of_o rome_n or_o constantineple_n they_o make_v his_o will_n the_o sole_a spring_n of_o our_o government_n from_o which_o it_o be_v original_o derive_v and_o into_o which_o it_o must_v be_v
only_o to_o the_o good_a and_o gentle_a but_o also_o to_o the_o froward_a so_o that_o if_o a_o king_n in_o the_o administration_n of_o his_o government_n shall_v be_v too_o sparnig_v in_o his_o his_o maladministration_n yet_o if_o it_o be_v such_o as_o will_v consist_v with_o the_o be_v of_o the_o government_n and_o the_o safety_n of_o the_o people_n it_o shall_v rather_o be_v bear_v patient_o than_o redress_v by_o a_o violent_a opposition_n i_o acknowledge_v also_o that_o in_o all_o case_n not_o certain_a and_o notorious_a the_o subject_a aught_o to_o presume_v the_o right_a to_o be_v rather_o on_o his_o prince_n side_n than_o on_o his_o own_o and_o never_o to_o think_v any_o oppression_n intolerable_a till_o they_o be_v evident_o such_o or_o to_o call_v for_o a_o violent_a redress_n till_o they_o appear_v otherwise_o irremediable_a i_o must_v acknowledge_v also_o that_o i_o can_v see_v no_o right_a the_o subject_n have_v from_o the_o law_n of_o god_n or_o man_n to_o use_v any_o other_o resistance_n against_o a_o king_n than_o what_o be_v defensive_a or_o to_o proceed_v judicial_o against_o he_o or_o to_o inflict_v any_o punishment_n on_o his_o person_n for_o any_o default_n of_o government_n because_o there_o can_v be_v no_o authority_n in_o our_o kingdom_n superior_a to_o that_o with_o which_o the_o king_n be_v invest_v yet_o after_o all_o these_o concession_n it_o must_v be_v confess_v that_o the_o regal_a power_n be_v in_o its_o constitution_n limit_v and_o in_o its_o exercise_n liable_a to_o be_v abuse_v there_o may_v such_o case_n happen_v wherein_o a_o defensive_a resistance_n may_v be_v not_o only_o lawful_a but_o a_o necessary_a duty_n and_o if_o we_o may_v not_o lie_v for_o god_n much_o less_o may_v we_o do_v it_o in_o flattery_n to_o any_o man_n and_o if_o subject_n may_v not_o be_v defraud_v of_o their_o estate_n no_o more_o shall_v they_o be_v of_o their_o liberty_n to_o prevent_v their_o abuse_n of_o they_o wherefore_o to_o speak_v out_o plain_o and_o honest_o in_o a_o case_n wherein_o conscience_n be_v so_o much_o concern_v i_o must_v add_v that_o we_o be_v not_o bind_v in_o conscience_n to_o yield_v passive_a obedience_n to_o the_o king_n any_o far_a than_o that_o regal_a authority_n extend_v which_o the_o constitution_n of_o this_o kingdom_n have_v invest_v he_o with_o and_o that_o those_o constitution_n do_v not_o empower_v he_o to_o treat_v his_o subject_n according_a to_o his_o own_o private_a will_n but_o according_a to_o the_o public_a rule_n of_o the_o law_n and_o by_o consequence_n whatever_o grievance_n be_v without_o or_o contrary_n to_o law_n the_o subject_n be_v not_o bind_v in_o conscience_n to_o bear_v it_o with_o respect_n to_o the_o king_n who_o have_v no_o authority_n to_o impose_v it_o though_o he_o may_v be_v sometime_o with_o respect_n to_o the_o public_a peace_n and_o if_o officer_n be_v appoint_v by_o the_o king_n to_o oppress_v his_o subject_n contrary_a to_o law_n their_o commission_n be_v illegal_a must_v be_v without_o authority_n and_o therefore_o the_o subject_n be_v not_o bind_v in_o conscience_n to_o submit_v to_o they_o but_o may_v resist_v their_o injust_a assault_n if_o he_o can_v otherwise_o evade_v they_o and_o do_v not_o disturb_v the_o public_a peace_n by_o the_o defence_n of_o his_o private_a interest_n and_o if_o we_o may_v suppose_v a_o case_n so_o sad_a as_o that_o a_o king_n through_o ill_a counsel_n or_o some_o strong_a temptation_n shall_v be_v change_v from_o a_o father_n into_o the_o enemy_n of_o his_o country_n and_o shall_v with_o a_o immovable_a obstinacy_n engage_v himself_o in_o such_o illegal_a design_n as_o plain_o and_o inevitable_o tend_v to_o the_o subversion_n of_o the_o government_n and_o the_o destruction_n of_o the_o people_n his_o subject_n in_o such_o unhappy_a circumstance_n will_v be_v excusable_a before_o god_n if_o they_o use_v so_o much_o defensive_a resistance_n as_o he_o have_v make_v necessary_a for_o preserve_v the_o government_n and_o themselves_o for_o if_o in_o nature_n a_o people_n be_v presuppose_v to_o government_n and_o ruler_n be_v intend_v by_o god_n for_o the_o welfare_n of_o a_o people_n and_o not_o a_o people_n for_o the_o pleasure_n of_o their_o ruler_n it_o will_v be_v most_o reasonable_a to_o infer_v that_o when_o the_o end_n and_o the_o mean_n become_v inconsistent_a the_o end_n shall_v be_v prefer_v and_o those_o mean_v prevent_v or_o reject_v which_o will_v destroy_v the_o end_n they_o shall_v promote_v but_o these_o thing_n be_v so_o easy_o anticipate_v by_o the_o common_a sense_n and_o reason_n of_o mankind_n that_o there_o need_v no_o long_a discourse_n about_o they_o and_o they_o be_v indeed_o too_o irksome_a to_o a_o ingenuous_a mind_n to_o dwell_v long_o upon_o they_o and_o though_o our_o extraordinary_a case_n at_o present_a have_v make_v it_o necessary_a to_o say_v so_o much_o yet_o i_o hope_v a_o like_a case_n will_v never_o happen_v again_o to_o give_v occasion_n to_o subject_n to_o consider_v so_o minutely_o the_o limit_n of_o the_o regal_a power_n and_o of_o their_o own_o submission_n 2._o have_v now_o rescue_v our_o conscience_n from_o the_o prejudices_fw-la of_o the_o forego_n error_n we_o may_v be_v capable_a of_o make_v a_o impartial_a judgement_n of_o the_o case_n propound_v whether_o we_o can_v with_o a_o good_a conscience_n transfer_v our_o allegiance_n from_o the_o late_a to_o the_o present_a king_n allegiance_n in_o its_o primary_n general_a sense_n signify_v be_v oblige_v or_o bind_v in_o its_o political_a sense_n it_o import_v that_o kind_n of_o relation_n which_o refer_v a_o subject_a to_o his_o prince_n and_o by_o consequence_n it_o connote_v the_o duty_n which_o result_n from_o that_o relation_n and_o take_v the_o word_n in_o its_o full_a latitude_n there_o will_v arise_v these_o two_o difficulty_n to_o be_v distinct_o resolve_v 1._o whether_o our_o conscience_n be_v discharge_v from_o allegiance_n to_o the_o late_a king_n 2._o whether_o we_o can_v with_o a_o good_a conscience_n transfer_v our_o allegiance_n to_o the_o present_a king_n though_o not_o the_o immediate_a heir_n of_o the_o crown_n 1._o in_o resolve_v the_o former_a enquiry_n it_o will_v be_v necessary_a to_o premise_v that_o our_o allegiance_n to_o james_n the_o second_o be_v not_o to_o his_o person_n absolute_o but_o respectlive_o as_o he_o sustain_v the_o character_n of_o king_n and_o therefore_o as_o we_o owe_v no_o allegiance_n to_o he_o before_o he_o be_v king_n so_o neither_o can_v we_o owe_v he_o any_o now_o if_o he_o cease_v to_o be_v so_o and_o i_o think_v it_o too_o plain_a to_o need_v any_o proof_n that_o it_o be_v possible_a that_o a_o person_n may_v cease_v to_o be_v king_n though_o he_o still_o survive_v and_o that_o a_o relation_n cease_v when_o one_o of_o its_o term_n be_v lose_v if_o therefore_o it_o appear_v that_o james_n the_o second_o do_v cease_v to_o be_v our_o king_n though_o he_o be_v still_o alive_a our_o allegiance_n to_o he_o will_v be_v sufficient_o discharge_v and_o that_o he_o do_v cease_v to_o be_v our_o king_n may_v i_o suppose_v be_v evince_v from_o the_o follow_a consideration_n 1._o if_o james_n the_o second_o do_v with_o a_o immovable_a obstinacy_n engage_v himself_o in_o such_o illegal_a and_o pernicious_a design_n as_o be_v notorious_o subversive_a of_o the_o government_n and_o destructive_a of_o the_o people_n he_o do_v thereby_o cease_v the_o jure_v to_o be_v our_o king_n and_o our_o allegiance_n to_o he_o be_v by_o consequence_n discharge_v the_o title_n of_o king_n include_v both_o a_o office_n to_o be_v discharge_v and_o a_o estate_n to_o be_v enjoy_v but_o the_o latter_a be_v a_o appendant_a to_o the_o former_a when_o therefore_o he_o cease_v to_o govern_v and_o protect_v his_o people_n according_a to_o the_o law_n of_o this_o kingdom_n his_o right_n must_v so_o far_o cease_v to_o that_o power_n dignity_n or_o revenue_n which_o be_v assign_v to_o he_o for_o that_o end_n except_o we_o can_v imagine_v some_o thing_n to_o have_v a_o moral_a power_n of_o subsist_v when_o the_o reason_n of_o they_o be_v go_v and_o as_o the_o office_n of_o the_o king_n be_v direct_v by_o the_o public_a rule_n of_o the_o law_n so_o the_o right_n which_o any_o person_n can_v have_v to_o the_o regal_a estate_n must_v be_v found_v on_o the_o constitution_n of_o the_o realm_n and_o these_o constitution_n must_v either_o invest_v he_o with_o a_o absolute_a right_a irrespective_n to_o his_o office_n and_o then_o
