have_v hitherto_o in_o truth_n without_o partiality_n towards_o myself_o or_o passion_n and_o prevarication_n towards_o my_o adversary_n present_v the_o deposition_n and_o evidence_n on_o both_o side_n touch_v the_o first_o charge_n i_o will_v therefore_o request_v that_o these_o follow_v particular_n draw_v together_o by_o way_n of_o recapitulation_n may_v be_v serious_o weigh_v and_o consider_v part._n 1._o that_o to_o most_o of_o these_o nine_o article_n they_o have_v but_o one_o witness_n without_o any_o concurrent_a testimony_n which_o be_v not_o sufficient_a proof_n according_a to_o the_o ordinance_n they_o be_v to_o act_v by_o in_o which_o it_o be_v express_v that_o at_o least_o there_o must_v be_v one_o witness_n with_o concurrent_a evidence_n part._n 2._o that_o wheresoever_o the_o accuser_n have_v two_o i_o have_v also_o two_o to_o balance_v they_o part._n 3._o that_o although_o many_o of_o the_o article_n be_v in_o gross_a swear_v to_o positive_o yet_o in_o the_o cross_a examination_n you_o will_v find_v such_o limitation_n as_o these_o according_a to_o our_o best_a remembrance_n and_o according_a to_o our_o apprehension_n in_o the_o same_o express_a word_n for_o the_o substance_n of_o they_o etc._n etc._n which_o can_v therefore_o amount_v to_o legal_a evidence_n be_v invalid_a in_o point_n of_o law_n because_o as_o the_o judicious_a lawyer_n say_v if_o the_o deponent_n swear_v not_o positive_o and_o syllabical_o they_o may_v by_o change_v add_v to_o or_o take_v from_o the_o express_a word_n usurp_v the_o place_n of_o judge_n and_o so_o prevent_v their_o work_n and_o duty_n which_o be_v to_o judge_v whether_o such_o express_a term_n be_v criminous_a or_o not_o which_o they_o can_v do_v after_o the_o term_n be_v alter_v and_o make_v criminous_a already_o by_o the_o witness_n misrepresent_v they_o part._n 4._o that_o my_o witness_n in_o reference_n to_o the_o most_o substantial_a question_n be_v positive_a in_o their_o answer_n i_o shall_v here_o also_o further_o present_v you_o with_o some_o more_o consideration_n take_v from_o the_o justice_n of_o law_n and_o particular_o of_o those_o law_n and_o ordinance_n by_o which_o the_o present_a commissioner_n be_v oblige_v to_o act_v consid_fw-la 1._o that_o the_o present_a commissioner_n have_v no_o legal_a authority_n to_o question_v i_o again_o for_o this_o charge_n of_o article_n especial_o the_o that_o the_o in_o regard_n i_o public_o in_o a_o sermon_n before_o the_o committee_n renounce_v the_o deny_v the_o godhead_n of_o christ_n and_o aver_v the_o contrary_a as_o my_o cordial_a judgement_n which_o have_v be_v sufficient_a though_o i_o have_v former_o deny_v the_o godhead_n of_o christ_n which_o i_o never_o do_v to_o have_v prevent_v further_o trouble_v about_o that_o eight_o and_o nine_o in_o regard_n i_o be_v clear_v from_o they_o by_o the_o vote_n of_o the_o committee_n of_o berks_n who_o have_v legal_a power_n by_o a_o act_n of_o parliament_n to_o do_v it_o 2._o that_o this_o charge_n of_o article_n be_v not_o within_o their_o cognizance_n to_o traverse_v over_o again_o because_o after_o a_o full_a hear_n and_o examination_n of_o witness_n on_o both_o side_n as_o the_o discharge_n run_v the_o cause_n be_v dismiss_v by_o the_o committee_n of_o plundered_a minister_n two_o and_o thirty_o then_o sit_v who_o have_v a_o absolute_a power_n by_o a_o ordinance_n of_o
