power_n of_o impeachment_n or_o render_v they_o ineffectual_a the_o commons_o think_v fit_a to_o propose_v to_o your_o lordship_n that_o a_o committee_n of_o both_o house_n may_v be_v appoint_v for_o this_o purpose_n at_o which_o committee_n when_o agree_v to_o by_o your_o lordship_n it_o be_v first_o propose_v that_o the_o time_n of_o the_o trial_n of_o the_o lord_n in_o the_o tower_n shall_v be_v put_v off_o till_o the_o other_o matter_n be_v adjust_v and_o it_o be_v then_o agree_v that_o the_o proposition_n as_o to_o the_o time_n of_o trial_n shall_v be_v the_o last_o thing_n consider_v and_o the_o effect_n of_o this_o agreement_n stand_v report_v upon_o your_o lordship_n book_n after_o which_o the_o commons_o communicate_v to_o your_o lordship_n by_o your_o committee_n a_o vote_n of_o they_o viz._n that_o the_o committee_n of_o commons_o shall_v insist_v upon_o the_o former_a vote_n of_o their_o house_n that_o the_o lord_n spiritual_a ought_v not_o to_o have_v any_o vote_n in_o any_o proceed_n against_o the_o lord_n in_o the_o tower_n and_o that_o when_o that_o matter_n shall_v be_v settle_v and_o the_o method_n of_o proceed_n adjust_v the_o commons_o will_v then_o be_v ready_a to_o proceed_v upon_o the_o trial_n of_o the_o pardon_n of_o the_o earl_n of_o danby_n against_o who_o they_o have_v before_o demand_v judgement_n and_o afterward_o to_o the_o trial_n of_o the_o other_o five_o lord_n in_o the_o tower_n which_o vote_n extend_v as_o well_o to_o the_o earl_n of_o danby_n as_o the_o other_o five_o lord_n but_o the_o commons_o have_v as_o yet_o receive_v nothing_o from_o your_o lordship_n towards_o a_o answer_n to_o that_o vote_n save_v that_o your_o lordship_n have_v acquaint_v they_o that_o the_o bishop_n have_v ask_v leave_n of_o the_o house_n of_o peer_n that_o they_o may_v withdraw_v themselves_o from_o the_o trial_n of_o the_o say_v five_o lord_n with_o liberty_n of_o enter_v their_o usual_a protestation_n and_o though_o the_o commons_o committee_n have_v almost_o daily_o declare_v to_o your_o lordship_n committee_n that_o that_o be_v a_o necessary_a point_n of_o right_a to_o be_v settle_v before_o the_o trial_n and_o offer_v to_o debate_n the_o same_o your_o committee_n always_o answer_v that_o they_o have_v not_o any_o power_n from_o your_o lordship_n either_o to_o confer_v upon_o or_o to_o give_v any_o answer_n concern_v that_o matter_n and_o yet_o your_o lordship_n without_o have_v give_v the_o commons_o any_o satisfactory_a answer_n to_o the_o say_a vote_n or_o permit_v any_o conference_n or_o debate_n there-upon_a and_o contrary_a to_o the_o say_a agreement_n do_v on_o thursday_n the_o twenty-fourth_a of_o may_n send_v a_o message_n to_o the_o commons_o declare_v that_o the_o lord_n spiritual_a as_o well_o as_o temporal_a have_v order_v that_o the_o twentyseventh_a of_o this_o instant_a may_v be_v appoint_v for_o the_o trial_n of_o the_o five_o lord_n so_o that_o the_o commons_o can_v but_o apprehend_v your_o lordship_n have_v not_o only_o depart_v from_o what_o be_v agree_v on_o and_o in_o effect_n lay_v aside_o that_o committee_n constitute_v for_o preserve_v a_o good_a understanding_n betwixt_o the_o two_o house_n and_o better_a dispatch_n of_o the_o weighty_a affair_n now_o depend_v in_o parliament_n but_o must_v also_o needs_o conclude_v from_o the_o say_a message_n and_o from_o the_o vote_n of_o your_o lordship_n of_o the_o 14_o of_o may_n that_o the_o lord_n spiritual_a have_v a_o right_a to_o stay_v and_o sit_v in_o court_n till_o the_o court_n proceed_v to_o guilty_a or_o not_o guilty_a and_o from_o the_o bishop_n ask_v leave_n as_o appear_v by_o the_o lord_n book_n two_o day_n after_o the_o say_a vote_n that_o they_o may_v withdraw_v themselves_o from_o the_o trial_n of_o the_o five_o lord_n with_o liberty_n of_o enter_v their_o usual_a protestation_n and_o from_o their_o persist_v still_o to_o go_v on_o &_o give_v their_o vote_n in_o proceed_v upon_o the_o impeachment_n that_o their_o desire_n of_o leave_n to_o withdraw_v at_o the_o say_a trial_n be_v only_o a_o evasive_a answer_n to_o the_o forementioned_a vote_n of_o the_o commons_o and_o chief_o intend_v as_o a_o argument_n for_o a_o right_a of_o judicature_n upon_o proceed_n upon_o impeachment_n and_o as_o a_o reserve_v to_o judge_n upon_o the_o earl_n of_o danby_n plea_n of_o pardon_n and_o upon_o these_o and_o other_o like_a impeachment_n although_o no_o such_o power_n be_v ever_o claim_v by_o their_o predecessor_n but_o be_v utter_o deny_v by_o the_o commons_o and_o the_o commons_o be_v the_o rather_o induce_v to_o believe_v it_o so_o intend_a because_o the_o very_a ask_n to_o withdraw_v seem_v to_o imply_v aright_o to_o be_v there_o and_o that_o they_o can_v be_v absent_a without_o it_o because_o by_o this_o way_n they_o will_v have_v it_o in_o their_o power_n whether_o or_o no_o for_o the_o future_a either_o in_o the_o earl_n of_o danby_n case_n or_o any_o other_o they_o will_v ever_o ask_v leave_n to_o be_v absent_a and_o the_o temporal_a lord_n have_v like_a power_n of_o deny_v leave_v if_o that_o shall_v be_v admit_v once_o necessary_a the_o commons_o be_v therefore_o oblige_v not_o to_o proceed_v to_o the_o trial_n of_o the_o five_o lord_n the_o twenty_o seven_o of_o this_o instant_n may_v but_o to_o adhere_v to_o their_o aforesaid_a vote_n and_o for_o their_o so_o do_v beside_o what_o have_v be_v now_o and_o former_o by_o they_o say_v to_o your_o lordship_n do_v offer_v you_o these_o reason_n follow_v the_o reason_n 1._o because_o your_o lordship_n have_v receive_v the_o earl_n of_o danby_n plea_n of_o pardon_n with_o a_o very_a long_a and_o unusual_a protestation_n wherein_o he_o have_v asperse_v his_o majesty_n with_o false_a suggestion_n as_o if_o his_o majesty_n have_v command_v or_o countenance_v the_o crime_n he_o stand_v charge_v with_o and_o particular_o suppress_v and_o discourage_v the_o discovery_n of_o the_o plot_n and_o endeavour_v to_o introduce_v a_o arbitrary_a and_o tyrannical_a way_n of_o government_n which_o remain_v as_o a_o scandal_n upon_o record_n against_o his_o majesty_n tend_v to_o render_v his_o person_n and_o government_n odious_a to_o his_o people_n against_o which_o it_o ought_v to_o be_v the_o first_o and_o principal_a care_n of_o both_o house_n to_o vindicate_v his_o majesty_n by_o do_v justice_n against_o the_o say_v earl_n 2._o the_o set_n up_o a_o pardon_n to_o be_v a_o bar_n of_o a_o impeachment_n defeat_v the_o whole_a use_n and_o effect_n of_o impeachment_n and_o shall_v this_o point_n be_v admit_v or_o stand_v doubt_v it_o will_v total_o discourage_v the_o exhibit_v any_o for_o the_o future_a whereby_o the_o chief_a institution_n for_o the_o preservation_n of_o the_o government_n and_o consequent_o the_o government_n itself_o will_v be_v destroy_v and_o therefore_o the_o case_n of_o the_o say_a earl_n which_o in_o consequence_n concern_v all_o impeachment_n whatever_o aught_o to_o be_v determine_v before_o that_o of_o the_o five_o lord_n which_o be_v but_o their_o particular_a case_n and_o without_o resort_v to_o many_o authority_n of_o great_a antiquity_n the_o commons_o desire_v your_o your_o lordship_n to_o take_v notice_n with_o the_o same_o regard_v they_o do_v of_o the_o declaration_n which_o that_o excellent_a prince_n king_n charles_n the_o first_o of_o bless_a memory_n make_v in_o this_o behalf_n in_o his_o answer_n to_o the_o nineteenth_o proposition_n of_o both_o house_n of_o parliament_n wherein_o state_v the_o several_a part_n of_o this_o regulate_v monarchy_n he_o say_v the_o king_n the_o house_n of_o lord_n and_o the_o house_n of_o commons_o have_v each_o particular_a privilege_n and_o among_o those_o which_o belong_v to_o the_o king_n he_o reckon_v power_n of_o pardon_n after_o the_o enumerating_n of_o which_o and_o other_o his_o prerogative_n his_o say_a majesty_n add_v thus_o again_o that_o the_o prince_n may_v not_o make_v use_n of_o this_o high_a and_o perpetual_a power_n to_o the_o hurt_a of_o those_o for_o who_o good_a he_o have_v it_o and_o make_v use_v of_o the_o name_n of_o public_a necessity_n for_o the_o gain_n of_o his_o private_a favourite_n and_o follower_n to_o the_o detriment_n of_o his_o people_n the_o house_n of_o commons_o a_o excellent_a conserver_n of_o liberty_n be_v sole_o entrust_v with_o the_o first_o proposition_n concern_v the_o leavye_n of_o money_n and_o the_o impeach_a of_o those_o who_o for_o their_o own_o end_n though_o countenance_v by_o any_o surreptitiously-gotten_a command_n of_o the_o king_n have_v violate_v that_o law_n which_o he_o be_v bind_v when_o he_o know_v it_o to_o protect_v and_o to_o the_o protection_n of_o which_o they_o be_v bind_v to_o advise_v he_o at_o least_o not_o to_o serve_v he_o in_o the_o contrary_n and_o the_o lord_n be_v trust_v with_o a_o judicatory_a power_n be_v a_o excellent_a screen_n and_o bank_n between_o the_o prince_n and_o people_n to_o assist_v each_o against_o any_o encroachment_n of_o the_o other_o and_o by_o just_a judgement_n to_o preserve_v that_o law_n which_o ought_v to_o be_v the_o rule_n of_o every_o one_o of_o the_o three_o etc._n etc._n therefore_o the_o power_n legal_o place_v in_o both_o house_n be_v more_o than_o sufficient_a to_o prevent_v and_o restrain_v the_o power_n of_o tyranny_n etc._n etc._n 3._o until_o the_o commons_o of_o england_n have_v right_a down_o they_o against_o this_o plea_n of_o pardon_n they_o may_v just_o apprehend_v that_o the_o whole_a justice_n of_o the_o kingdom_n in_o the_o case_n of_o the_o lord_n may_v be_v obstruct_v and_o defeat_v by_o pardon_n of_o like_a nature_n 4._o a_o impeachment_n be_v virtual_o the_o voice_n of_o every_o particular_a subject_n of_o this_o kingdom_n cry_v out_o against_o a_o oppression_n by_o which_o every_o member_n of_o that_o body_n be_v equal_o wound_v and_o it_o will_v prove_v a_o matter_n of_o ill_a consequence_n that_o the_o universality_n of_o the_o people_n shall_v have_v occasion_n minister_v and_o continue_v to_o they_o to_o be_v apprehensive_a of_o utmost_a danger_n from_o the_o crown_n from_o whence_o they_o of_o right_o expect_v protection_n 5._o the_o commons_o exhibit_v article_n of_o impeachment_n against_o the_o say_a earl_n before_o any_o against_o the_o five_o other_o lord_n and_o demand_v judgement_n upon_o those_o article_n whereupon_o your_o lordship_n have_v appoint_v the_o trial_n of_o the_o say_a earl_n to_o be_v before_o that_o of_o the_o other_o five_o lord_n now_o your_o lordship_n have_v since_o invert_v that_o order_n give_v a_o great_a cause_n of_o doubt_n to_o the_o house_n of_o commons_o and_o raise_v a_o jealousy_n in_o the_o heart_n of_o all_o the_o commons_o of_o england_n that_o if_o they_o shall_v proceed_v to_o the_o trial_n of_o the_o five_o lord_n in_o the_o first_o place_n not_o only_a justice_n will_v be_v obstruct_v in_o the_o case_n of_o those_o lord_n but_o that_o they_o shall_v never_o have_v right_o do_v they_o in_o the_o matter_n of_o this_o plea_n of_o pardon_n which_o be_v of_o so_o fatal_a consequence_n to_o the_o whole_a kingdom_n and_o a_o new_a devise_n to_o frustrate_v public_a justice_n in_o parliament_n which_o reason_n and_o matter_n be_v due_o weigh_v by_o your_o lordship_n the_o commons_o doubt_v not_o but_o your_o lordship_n will_v receive_v satisfaction_n concern_v their_o proposition_n and_o proceed_n and_o will_v agree_v that_o the_o commons_o ought_v not_o nor_o can_v without_o desert_v their_o trust_n depart_v from_o their_o former_a vote_n communicate_v to_o your_o lordship_n that_o the_o lord_n spiritual_a ought_v not_o to_o have_v any_o vote_n in_o any_o
