to_o the_o pope_n and_o if_o he_o be_v unjust_o refuse_v the_o bishop_n be_v bind_v to_o provide_v for_o he_o but_o during_o the_o appeal_n the_o patron_n may_v present_v another_o who_o if_o the_o bishop_n approve_v the_o appeal_n do_v fall_v rebuffus_n 10._o a_o note_a lawyer_n say_v that_o it_o be_v a_o damn_v sin_n in_o a_o bishop_n not_o to_o examine_v the_o fitness_n of_o those_o who_o be_v present_v by_o patron_n and_o a_o late_a learned_a french_a canonist_n say_v those_o be_v to_o blame_v who_o lie_v the_o fault_n of_o so_o many_o unworthy_a man_n be_v in_o place_n on_o the_o lay_v patron_n 25._o for_o say_v he_o the_o bishop_n be_v to_o blame_v who_o be_v bind_v to_o examine_v and_o if_o they_o see_v cause_n to_o reject_v they_o so_o that_o we_o have_v not_o only_o our_o own_o law_n but_o the_o general_n consent_v of_o the_o christian_a world_n where_o the_o right_a of_o patronage_n be_v allow_v as_o to_o the_o bishop_n right_o of_o examine_v and_o judge_v the_o fitness_n of_o person_n present_v to_o benefice_n 2._o the_o right_n of_o collation_n upon_o lapse_n belong_v to_o the_o bishop_n notwithstanding_o the_o right_n of_o patronage_n it_o be_v say_v by_o lord_n hobart_n 154._o that_o a_o lapse_n be_v not_o a_o interest_n natural_o but_o a_o mere_a trust_n in_o law_n and_o afterward_o that_o the_o ordinary_a or_o he_o that_o be_v to_o present_v by_o lapse_n be_v as_o a_o kind_n of_o attorney_n make_v by_o law_n to_o do_v that_o for_o the_o patron_n which_o it_o be_v suppose_v he_o will_v do_v himself_o if_o there_o be_v not_o some_o let_v and_o therefore_o the_o collation_n by_o lapse_n be_v in_o the_o right_n of_o the_o patron_n and_o for_o his_o turn_n this_o seem_v to_o i_o to_o be_v a_o mistake_a notion_n of_o a_o lapse_n for_o the_o true_a question_n be_v whether_o upon_o a_o lapse_n the_o ordinary_a do_v collate_n jure_fw-la pleno_fw-la or_o jure_fw-la devoluto_fw-la some_o french_a lawyer_n hold_v the_o latter_a 145._o but_o car._n molinaeus_n and_o other_o utter_o reject_v that_o opinion_n for_o this_o reason_n because_o church_n and_o dioceses_n be_v jure_fw-la communi_fw-la under_o the_o care_n of_o the_o bishop_n but_o it_o be_v by_o particular_a indulgence_n that_o the_o patron_n have_v the_o right_n of_o presentation_n which_o be_v neglect_v thing_n do_v return_v to_o common_a right_n and_o therefore_o the_o bishop_n have_v a_o true_a interest_n and_o act_v not_o in_o the_o right_n of_o the_o patron_n but_o his_o own_o it_o be_v true_a there_o be_v a_o devolution_n afterward_o by_o our_o law_n for_o as_o the_o author_n of_o the_o doctor_n and_o student_n say_v 125._o the_o law_n of_o the_o realm_n be_v that_o if_o a_o benefice_n fall_v void_a than_o the_o patron_n shall_v present_v within_o six_o month_n and_o if_o he_o do_v not_o that_o then_o the_o ordinary_n shall_v present_v but_o yet_o the_o law_n be_v far_a in_o this_o case_n that_o if_o the_o patron_n present_a before_o the_o ordinary_a put-in_a his_o clerk_n that_o then_o the_o patron_n shall_v enjoy_v his_o presentment_n and_o so_o it_o be_v though_o the_o time_n shall_v fall_v to_o the_o metropolitan_a for_o as_o he_o say_v by_o our_o law_n if_o the_o bishop_n do_v not_o collate_n within_o six_o month_n than_o the_o metropolitan_a present_n but_o this_o be_v by_o a_o right_n of_o devolution_n and_o then_o why_o not_o the_o other_o the_o answer_n be_v that_o the_o bishop_n be_v ordinary_a of_o the_o diocese_n and_o therefore_o it_o come_v to_o he_o of_o common_a right_n but_o it_o fall_v to_o the_o archbishop_n not_o as_o ordinary_a but_o as_o superior_a to_o who_o the_o right_a of_o devolution_n fall_v upon_o the_o inferiour_n neglect_n for_o although_o in_o some_o respect_n and_o in_o the_o except_v case_n the_o archbishop_n may_v be_v say_v to_o be_v ordinary_a of_o the_o whole_a province_n yet_o that_o be_v not_o so_o much_o in_o respect_n of_o immediate_a jurisdiction_n 27._o which_o hobart_n and_o other_o say_v be_v by_o virtue_n of_o the_o legatine_n power_n which_o be_v annex_v to_o his_o see_n but_o the_o archbishop_n have_v a_o power_n as_o metropolitan_a to_o supply_v the_o defect_n of_o the_o suffragans_fw-la of_o his_o province_n and_o so_o this_o right_n of_o collate_v upon_o defect_n of_o the_o ordinary_a come_v to_o he_o by_o right_a of_o devolution_n but_o how_o then_o come_v the_o king_n to_o his_o right_n after_o the_o metropolitan_n neglect_n that_o be_v 124._o say_v our_o lawyer_n because_o the_o king_n be_v patron_n paramount_n of_o all_o the_o benefice_n within_o the_o realm_n b._n the_o meaning_n be_v that_o the_o king_n by_o right_n of_o his_o crown_n be_v to_o see_v that_o all_o place_n be_v due_o supply_v with_o person_n fit_a for_o they_o and_o if_o all_o other_o who_o the_o law_n have_v entrust_v do_v neglect_v their_o duty_n then_o by_o the_o natural_a order_n and_o course_n of_o government_n it_o fall_v to_o the_o supreme_a power_n which_o be_v to_o supply_v defect_n and_o to_o reform_v abuse_n 3._o the_o bishop_n have_v the_o right_a of_o make_v a_o avoidance_n by_o deprivation_n or_o resignation_n for_o as_o he_o have_v the_o power_n of_o putting-in_a so_o the_o law_n have_v lodge_v in_o he_o the_o judicial_a power_n of_o proceed_v against_o offender_n and_o have_v not_o leave_v that_o to_o the_o judgement_n of_o the_o patron_n if_o we_o inquire_v who_o by_o our_o law_n be_v make_v the_o proper_a judge_n of_o a_o benefice_a person_n whether_o he_o behave_v himself_o so_o as_o to_o deserve_v to_o lose_v his_o benefice_n will_v any_o one_o say_v that_o the_o law_n have_v put_v this_o into_o the_o patron_n be_v hand_n yet_o all_o those_o who_o justify_v these_o bond_n of_o resignation_n must_v in_o effect_n say_v that_o the_o patron_n be_v the_o proper_a judge_n for_o they_o have_v the_o real_a power_n of_o deprivation_n in_o their_o hand_n and_o may_v execute_v it_o when_o they_o please_v which_o be_v such_o a_o arbitrary_a jurisdiction_n as_o will_v be_v think_v intolerable_a in_o other_o hand_n in_o all_o cause_n of_o deprivation_n of_o a_o person_n actual_o possess_v of_o a_o benefice_n these_o thing_n must_v concur_v 1._o a_o monition_n or_o citation_n of_o the_o party_n to_o appear_v 2._o a_o charge_n give_v he_o to_o which_o he_o be_v to_o answer_v call_v the_o libel_n 3._o a_o competent_a time_n assign_v for_o the_o proof_n and_o answer_n 4._o a_o liberty_n for_o counsel_n to_o defend_v his_o cause_n and_o to_o except_v against_o the_o proof_n and_o witness_n 5._o a_o solemn_a sentence_n after_o hear_v all_o the_o proof_n and_o answer_n these_o be_v the_o fundamental_o of_o all_o judicial_a proceed_n in_o the_o ecclesiastical_a court_n in_o order_n to_o a_o deprivation_n and_o if_o these_o thing_n be_v not_o observe_v the_o party_n have_v just_a cause_n of_o appeal_n and_o may_v have_v remedy_n by_o a_o superior_a court_n and_o these_o proceed_n be_v agreeable_a to_o the_o common_a justice_n and_o reason_n of_o mankind_n because_o the_o party_n accuse_v have_v the_o liberty_n of_o defence_n and_o the_o right_n of_o appeal_n but_o there_o be_v nothing_o of_o all_o this_o in_o bond_n of_o resignation_n for_o the_o patron_n take_v the_o advantage_n of_o the_o forfeiture_n of_o the_o bond_n and_o so_o without_o any_o trial_n or_o proof_n or_o sentence_n deprive_v he_o of_o his_o benefice_n some_o who_o be_v no_o friend_n to_o the_o ecclesiastical_a court_n will_v have_v no_o deprivation_n of_o a_o benefice_n but_o by_o proceed_n at_o common_a law_n because_o it_o be_v a_o freehold_a suppose_v that_o it_o be_v so_o which_o seem_v contrary_a to_o the_o course_n of_o the_o law_n for_o the_o bishop_n in_o a_o plea_n to_o a_o quare_fw-la impedit_fw-la say_v nihil_fw-la clamat_fw-la praeter_fw-la institutionem_fw-la &_o destitutionem_fw-la clericorum_fw-la and_o ecclesiastical_a deprivation_n have_v be_v still_o allow_v at_o common_a law_n if_o they_o have_v be_v according_a to_o the_o ecclesiastical_a law_n but_o take_v it_o for_o grant_v that_o a_o deprivation_n of_o a_o freehold_a aught_o to_o be_v at_o common_a law_n what_o then_o what_o without_o a_o indictment_n and_o without_o a_o trial_n by_o a_o jury_n no_o hear_v of_o the_o cause_n no_o witness_n examine_v no_o counsel_n to_o be_v hear_v no_o judgement_n by_o his_o peer_n and_o can_v this_o be_v agreeable_a to_o the_o fundamental_a law_n of_o england_n to_o have_v man_n force_v out_o of_o their_o freehold_n in_o such_o a_o arbitrary_a manner_n what_o will_v they_o think_v if_o other_o freehold_a estate_n which_o hold_v of_o a_o superior_a lord_n be_v make_v so_o arbitrary_a as_o to_o depend_v upon_o the_o will_n of_o the_o lord_n so_o as_o to_o be_v turn_v out_o upon_o six_o month_n notice_n let_v we_o see_v bond_n of_o resignation_n practise_v upon_o such_o estate_n and_o then_o
have_v the_o same_o court_n with_o the_o bishop_n 54._o so_o that_o the_o legal_a act_n of_o the_o court_n be_v the_o bishop_n act_n by_o who_o authority_n he_o sit_v there_o so_o that_o no_o appeal_n lie_v from_o the_o bishop_n officer_n to_o himself_o but_o to_o the_o superior_a and_o although_o a_o commissary_n be_v allow_v to_o have_v the_o power_n of_o the_o ordinary_a in_o testamentary_a cause_n which_o be_v not_o original_o of_o spiritual_a jurisdiction_n as_o it_o be_v say_v in_o henslow_n case_n approbat_fw-la with_o which_o lindwood_n agree_v yet_o in_o act_n of_o spiritual_a and_o voluntary_a jurisdiction_n the_o case_n be_v otherwise_o for_o the_o bishop_n by_o appoint_v a_o chancellor_n do_v not_o divest_v himself_o of_o his_o own_o ordinary_a power_n but_o he_o may_v delegate_v some_o part_n of_o it_o by_o commission_n to_o other_o which_o go_v no_o far_a than_o be_v express_v in_o it_o for_o it_o be_v a_o very_a great_a mistake_n in_o any_o to_o think_v that_o such_o who_o act_n by_o a_o delegated_a power_n can_v have_v any_o more_o power_n than_o be_v give_v to_o they_o where_o a_o special_a commission_n be_v require_v for_o the_o exercise_n of_o it_o 2._o for_o by_o the_o general_n commission_n no_o other_o authority_n pass_v but_o that_o of_o hear_v cause_n but_o all_o act_n of_o voluntary_a jurisdiction_n require_v a_o special_a commission_n which_o the_o bishop_n may_v restrain_v as_o he_o see_v cause_n for_o as_o lyndwood_n say_v nothing_o pass_v virtute_fw-la officii_fw-la but_o the_o hear_n of_o cause_n so_o that_o other_o act_n depend_v upon_o the_o bishop_n particular_a grant_n for_o that_o purpose_n and_o the_o law_n nowhere_o determin_n the_o bound_n of_o a_o chancellor_n power_n as_o to_o such_o act_n nor_o can_v it_o be_v suppose_v so_o to_o do_v since_o it_o be_v but_o a_o delegated_a power_n and_o it_o be_v in_o the_o right_n of_o he_o that_o depute_v to_o circumscribe_v and_o limit_v it_o neither_o can_v use_v or_o custom_n enlarge_v such_o a_o power_n which_o depend_v upon_o another_o will._n and_o however_o by_o modern_a practice_n the_o patent_n for_o such_o place_n have_v pass_v for_o the_o life_n of_o the_o person_n to_o who_o they_o be_v first_o grant_v yet_o it_o be_v not_o so_o by_o the_o ancient_a ecclesiastical_a law_n of_o england_n officiales_fw-la for_o lyndwood_n affirm_v that_o a_o grant_v of_o jurisdiction_n cease_v by_o the_o death_n of_o he_o who_o give_v it_o per_fw-la mortem_fw-la deputantis_fw-la cessat_fw-la potestas_fw-la officialium_fw-la or_o else_o it_o can_v never_o pass_v into_o the_o dean_n and_o chapter_n sede_fw-la vacant_a or_o to_o the_o guardian_n of_o the_o spiritualty_n and_o he_o give_v a_o good_a reason_n for_o it_o nè_fw-la invitus_fw-la habeat_fw-la officialem_fw-la sibi_fw-la fortassis_fw-la odiosum_fw-la it_o be_v true_a that_o by_o the_o statute_n 37_o h._n 8._o c._n 17._o mere_a doctor_n of_o law_n be_v make_v capable_a of_o exercise_v all_o manner_n of_o ecclesiastical_a jurisdiction_n but_o it_o do_v not_o assign_v the_o extent_n of_o their_o jurisdiction_n but_o leave_v it_o to_o the_o bishop_n themselves_o from_o who_o their_o authority_n be_v derive_v and_o the_o law_n still_o distinguish_v between_o potestas_fw-la ordinaria_fw-la and_o delegata_fw-la 2._o for_o the_o former_a suppose_v a_o person_n to_o act_v in_o his_o own_o right_a and_o not_o by_o deputation_n ordin_n which_o i_o suppose_v no_o chancellor_n or_o official_o will_v pretend_v to_o but_o how_o far_o now_o a_o commission_n to_o exercise_v jurisdiction_n do_v hold_v when_o the_o person_n who_o give_v it_o be_v dead_a be_v not_o my_o present_a business_n to_o inquire_v but_o in_o sutton_n case_n it_o seem_v to_o be_v take_v for_o grant_v by_o the_o counsel_n that_o a_o chancellor_n patent_n 65._o confirm_v by_o dean_n and_o chapter_n do_v give_v a_o man_n a_o freehold_a for_o life_n if_o he_o be_v capable_a of_o do_v his_o duty_n otherwise_o he_o may_v be_v deprive_v for_o insufficiency_n as_o doctor_n sutton_n be_v but_o noy_n say_v 91._o that_o the_o court_n be_v in_o doubt_n how_o far_o the_o act_n of_o the_o predecessor_n can_v bind_v the_o successor_n as_o to_o the_o profit_n and_o in_o the_o prebend_n of_o hatcherlies_n case_n 152._o dodderidge_n declare_v that_o ecclesiastical_a jurisdiction_n in_o judicial_a act_n may_v be_v execute_v by_o substitute_n but_o a_o grant_v of_o it_o be_v not_o good_a but_o during_o the_o bishop_n life_n and_o shall_v not_o bind_v the_o successor_n and_o coke_n think_v it_o a_o very_a hard_a thing_n that_o the_o successor_n shall_v not_o remove_v he_o but_o be_v bind_v to_o answer_v for_o the_o act_n and_o offence_n of_o a_o commissary_n which_o he_o never_o put-in_a but_o these_o thing_n belong_v not_o to_o our_o present_a business_n any_o far_a than_o to_o show_v that_o however_o in_o some_o case_n the_o bishop_n may_v substitute_v other_o yet_o as_o to_o resignation_n of_o benefice_n for_o all_o that_o i_o can_v find_v the_o law_n only_o take_v notice_n of_o the_o bishop_n himself_o lyndwood_n observe_v that_o there_o be_v a_o difference_n to_o be_v make_v between_o the_o resignation_n of_o a_o simple_a benefice_n i._n e._n where_o there_o be_v no_o cure_n of_o soul_n and_o of_o such_o a_o one_o that_o have_v such_o a_o cure_n go_v along_o with_o it_o in_o the_o former_a case_n he_o say_v that_o a_o resignation_n may_v be_v to_o the_o prejudice_n of_o the_o party_n without_o the_o bishop_n consent_n but_o in_o the_o latter_a where_o it_o may_v be_v to_o the_o prejudice_n of_o other_o as_o well_o as_o of_o himself_o it_o have_v no_o force_n without_o the_o bishop_n ratification_n in_o hoc_fw-la casu_fw-la necessaria_fw-la est_fw-la ratihabitio_fw-la episcopi_fw-la so_o that_o no_o resignation_n of_o a_o cure_n of_o soul_n can_v be_v of_o any_o validity_n without_o the_o bishop_n acceptance_n in_o the_o case_n of_o smith_n against_o foane_n it_o be_v resolve_v and_o agree_v by_o all_o upon_o evidence_n at_o bar_n 157._o that_o a_o resignation_n to_o a_o proctor_n do_v not_o make_v the_o church_n void_a until_o it_o be_v accept_v by_o the_o bishop_n and_o acknowledge_v before_o he_o 2._o but_o suppose_v the_o resignation_n be_v make_v into_o the_o hand_n of_o the_o bishop_n be_v he_o bind_v to_o accept_v it_o by_o what_o law_n for_o what_o reason_n must_v he_o not_o inquire_v into_o the_o reason_n and_o inducement_n of_o the_o resignation_n whether_o it_o be_v corrupt_a or_o not_o no_o bishop_n can_v be_v bind_v to_o accept_v a_o corrupt_a resignation_n and_o whether_o it_o be_v so_o or_o not_o he_o be_v bind_v to_o inquire_v and_o if_o he_o be_v not_o satisfy_v by_o what_o law_n can_v he_o be_v require_v to_o do_v that_o which_o he_o can_v do_v with_o a_o good_a conscience_n if_o the_o law_n have_v trust_v he_o with_o accept_v a_o resignation_n it_o have_v likewise_o trust_v he_o with_o judge_v whether_o it_o be_v fit_a to_o be_v accept_v or_o not_o in_o gayton_n case_n it_o be_v plain_a that_o the_o bishop_n may_v refuse_v a_o resignation_n before_o a_o public_a notary_n 12._o when_o there_o be_v a_o condition_n annex_v to_o it_o which_o the_o law_n do_v not_o annex_v for_o in_o this_o case_n the_o condition_n be_v that_o if_o such_o or_o such_o a_o person_n be_v not_o present_v within_o six_o month_n the_o resignation_n shall_v be_v null_a which_o coke_n then_o say_v make_v it_o void_a because_o resignation_n ought_v to_o be_v free_a and_o this_o be_v a_o judicial_a act_n to_o which_o a_o condition_n can_v be_v annex_v no_o more_o than_o a_o ordinary_n may_v admit_v upon_o condition_n but_o it_o may_v be_v object_v that_o in_o case_n of_o donative_n the_o resignation_n must_v be_v into_o the_o patron_n hand_n as_o in_o gay_n and_o fairchild_n case_n 765._o why_o then_o may_v not_o a_o resignation_n be_v good_a to_o a_o patron_n in_o other_o benefice_n since_o those_o be_v as_o real_o benefice_n as_o the_o other_o the_o difference_n be_v that_o there_o be_v no_o presentation_n to_o the_o bishop_n in_o donative_n for_o it_o be_v agree_v by_o the_o judge_n in_o that_o case_n 63._o that_o if_o there_o be_v a_o presentation_n once_o make_v to_o the_o bishop_n 344_o it_o cease_v to_o be_v a_o donative_n and_o become_v always_o presentable_a so_o that_o the_o case_n of_o donative_n be_v very_o different_a for_o we_o say_v that_o wherever_o the_o bishop_n have_v a_o right_a to_o admit_v it_o be_v his_o right_n to_o accept_v of_o a_o resignation_n but_o in_o this_o case_n the_o bishop_n be_v suppose_v to_o have_v nothing_o to_o do_v in_o the_o admission_n or_o institution_n of_o the_o person_n if_o it_o be_v ask_v how_o the_o bishop_n come_v to_o lose_v their_o right_n of_o receive_v the_o presentation_n to_o these_o benefice_n i_o answer_v that_o they_o seem_v to_o i_o to_o have_v come_v one_o of_o these_o two_o
way_n 1._o by_o royal_a licence_n so_o my_o lord_n coke_n say_v that_o the_o king_n may_v not_o only_o find_v a_o church_n 344._o or_o free_a chapel_n donative_n himself_o but_o may_v licence_n any_o subject_a to_o do_v the_o same_o but_o the_o register_n suppose_v a_o royal_a foundation_n 3._o and_o not_o a_o mere_a royal_a licence_n and_o that_o it_o must_v be_v prove_v to_o be_v ancient_a too_o and_o therefore_o a_o new_a licence_n will_v not_o come_v up_o to_o the_o register_n 2._o by_o peculiar_a privilege_n as_o when_o a_o lord_n of_o a_o manor_n in_o a_o great_a parish_n have_v his_o tenant_n about_o he_o at_o a_o remote_a distance_n from_o the_o parish-church_n offer_v to_o build_v and_o endow_v a_o church_n there_o provide_v that_o it_o shall_v belong_v entire_o to_o he_o and_o his_o family_n to_o put_v in_o such_o person_n as_o they_o shall_v think_v fit_a if_o they_o be_v in_o holy_a order_n it_o be_v very_o possible_a that_o the_o bishop_n at_o that_o time_n to_o encourage_v such_o a_o work_n may_v permit_v they_o to_o enjoy_v this_o liberty_n which_o be_v continue_v time_n out_o of_o mind_n be_v turn_v into_o a_o prescription_n if_o these_o donative_n have_v it_o must_v be_v into_o the_o bishop_n hand_n exempt_a jurisdiction_n be_v not_o so_o call_v because_o under_o no_o ordinary_a but_o because_o they_o be_v not_o under_o the_o ordinary_a of_o the_o either_o by_o ancient_a privilege_n 〈◊〉_d or_o inherent_a right_n but_o how_o far_o resignation_n may_v be_v make_v to_o the_o king_n as_o supreme_a ordinary_n as_o in_o goodman_n case_n it_o be_v not_o here_o a_o place_n to_o examine_v 2._o archbishop_n peculiar_o which_o be_v not_o only_o in_o the_o neighbour_n diocese_n but_o disperse_v up_o and_o down_o in_o remote_a place_n for_o it_o original_a but_o derive_v from_o the_o bishop_n 357._o and_o where_o the_o composition_n be_v lose_v it_o depend_v upon_o prescription_n as_o in_o the_o dean_n and_o chapter_n of_o st._n paul_n and_o either_o from_o the_o bishop_n or_o from_o the_o pope_n which_o prove_v the_o most_o effectual_a but_o more_o chargeable_a way_n a_o exemption_n from_o ordinary_a jurisdiction_n those_o church_n which_o the_o monastery_n have_v get_v to_o be_v annex_v to_o themselves_o be_v call_v appropriation_n but_o how_o far_o these_o be_v exempt_a from_o the_o ordinary_n jurisdiction_n be_v not_o full_o understand_v and_o therefore_o i_o shall_v endeavour_v to_o explain_v it_o 1._o appropriation_n do_v not_o at_o first_o imply_v any_o exemption_n from_o the_o ordinary_a for_o it_o be_v express_o provide_v in_o the_o canon_n law_n ●ane_a that_o no_o person_n shall_v be_v put_v into_o such_o church_n without_o institution_n from_o the_o bishop_n to_o who_o the_o incumbent_n be_v to_o be_v answerable_a in_o all_o spiritual_a matter_n as_o in_o all_o temporal_a to_o the_o abbot_n and_o in_o the_o old_a appropriation_n which_o i_o have_v see_v there_o be_v a_o salvo_n per_fw-la omne_fw-la jure_fw-la episcopali_fw-la which_o word_n be_v inconsistent_a with_o a_o exemption_n 2._o the_o form_n of_o appropriation_n be_v different_a afterward_o for_o although_o none_o can_v be_v make_v without_o the_o bishop_n consent_n yet_o that_o consent_n be_v express_v in_o different_a way_n and_o have_v different_a effect_n if_o the_o bishop_n only_o confirm_v the_o lay-patron's_a gift_n than_o nothing_o but_o the_o right_n of_o patronage_n pass_v and_o his_o jurisdiction_n remain_v if_o the_o bishop_n join_v in_o the_o donation_n in_o these_o word_n pastor_n concedimus_fw-la canonist_n say_v he_o pass_v his_o diocesan_n right_o which_o consist_v in_o right_n which_o the_o bishop_n have_v distinct_a from_o his_o episcopal_a jurisdiction_n which_o it_o be_v think_v he_o can_v not_o part_v with_o by_o any_o act_n of_o he_o for_o that_o be_v to_o divest_v himself_o of_o his_o order_n 3._o appropriation_n confirm_v by_o the_o papal_a authority_n be_v allow_v to_o till_o they_o have_v obtain_v bull_n for_o that_o purpose_n and_o then_o they_o take_v themselves_o to_o be_v free_a in_o their_o conventual_a church_n as_o well_o as_o their_o chapel_n or_o oratory_n on_o their_o own_o land_n 4._o all_o papal_a exemption_n be_v take_v away_o by_o act_n of_o parliament_n 31_o h._n 8._o c._n 13._o and_o the_o church_n so_o exempt_v be_v put_v under_o the_o appropriate_v church_n how_o clear_a and_o full_a soever_o the_o charter_n of_o exemption_n be_v this_o be_v a_o thing_n so_o little_o take_v notice_n of_o that_o i_o shall_v set_v down_o the_o word_n plead_v a_o exemption_n by_o virtue_n thereof_o from_o the_o ordinary_n jurisdiction_n nor_o that_o they_o have_v a_o power_n to_o put-in_a and_o putout_a as_o they_o please_v without_o any_o regard_n to_o the_o bishop_n authority_n but_o suppose_v there_o be_v no_o endowment_n and_o that_o the_o church_n be_v build_v on_o the_o site_n of_o the_o monastery_n and_o so_o be_v supply_v by_o their_o own_o body_n then_o such_o person_n be_v whole_o at_o their_o will_n and_o they_o may_v turn_v they_o out_o as_o they_o please_v i_o answer_v i_o confess_v the_o condition_n of_o such_o fraudulent_o pervert_v by_o the_o combination_n of_o the_o monk_n and_o pope_n will_v at_o the_o least_o take_v care_n that_o the_o cure_n of_o soul_n be_v due_o provide_v for_o in_o such_o place_n for_o that_o burden_n go_v along_o with_o the_o church_n revenue_n in_o who_o hand_n
