co._n 5._o 77._o and_o it_o be_v also_o enact_v by_o the_o authority_n aforesaid_a stat._n stat._n that_o as_o well_o justice_n of_o assize_n in_o their_o circuit_n as_o justice_n of_o peace_n etc._n which_o be_v here_o for_o the_o first_o offence_n make_v a_o praemunire_n for_o these_o be_v the_o only_a premise_n in_o the_o act_n and_o this_o clause_n extend_v not_o to_o the_o oath_n of_o supremacy_n or_o any_o offence_n in_o refuse_v of_o it_o much_o less_o to_o all_o offence_n against_o this_o act_n as_o it_o be_v mistake_v in_o the_o late_a addition_n to_o dalton_n cap._n 140._o tit_n high_a treason_n sect._n 11._o nor_o do_v it_o seem_v to_o be_v the_o intent_n of_o the_o statute_n to_o give_v the_o justice_n of_o peace_n any_o power_n to_o inquire_v of_o any_o offence_n make_v high_a treason_n thereby_o herein_o the_o power_n of_o justice_n of_o peace_n herein_o for_o the_o power_n here_o give_v to_o the_o justice_n of_o peace_n be_v only_o to_o inquire_v of_o offence_n contrary_a to_o the_o true_a meaning_n of_o the_o premise_n and_o the_o premise_n extend_v only_o to_o those_o offence_n make_v a_o praemunire_n and_o this_o clear_o appear_v by_o the_o subsequent_a word_n viz._n that_o the_o presentment_n thereof_o shall_v be_v certify_v into_o the_o king_n bench_n who_o shall_v hear_v and_o determine_v every_o such_o offence_n as_o if_o the_o offender_n have_v be_v present_v upon_o any_o matter_n in_o the_o statute_n of_o 16_o r._n 2._o now_o that_o can_v be_v intend_v of_o high_a treason_n assize_n and_o of_o justice_n of_o assize_n the_o like_a may_v be_v say_v of_o justice_n of_o assize_n for_o as_o they_o be_v mere_o justice_n of_o assize_n they_o can_v by_o force_v of_o this_o act_n inquire_v of_o either_o the_o first_o or_o second_o offence_n in_o refuse_v the_o oath_n of_o supremacy_n nor_o of_o the_o second_o offence_n in_o extol_v the_o bishop_n of_o rome_n authority_n only_o for_o the_o first_o offence_n of_o this_o last_o kind_n they_o may_v inquire_v and_o take_v indictment_n thereof_o and_o certify_v they_o into_o the_o king_n bench_n but_o then_o by_o their_o commission_n of_o oyer_n and_o terminer_n they_o may_v not_o only_o inquire_v of_o the_o first_o or_o second_o offence_n in_o extol_v the_o bishop_n of_o rome_n authority_n or_o refuse_v the_o oath_n of_o supremacy_n but_o may_v hear_v and_o determine_v they_o and_o according_o be_v slade_n and_o body_n indict_v arraign_v and_o try_v in_o the_o county_n of_o southampton_n of_o a_o praemunire_n for_o the_o first_o offence_n in_o extol_v the_o bishop_n of_o rome_n authority_n upon_o which_o they_o be_v attaint_v and_o afterward_o of_o treason_n for_o the_o second_o offence_n before_o sir_n roger_n manwood_n and_o justice_n
but_o forbear_v the_o same_o contrary_n to_o the_o tenor_n of_o a_o statute_n make_v in_o the_o first_o year_n of_o the_o reign_n of_o the_o say_v late_a queen_n for_o uniformity_n of_o common_a prayer_n and_o be_v thereof_o lawful_o convict_v shall_v forfeit_v to_o the_o say_a queen_n for_o every_o month_n after_o the_o end_n of_o the_o say_a session_n of_o parliament_n which_o he_o or_o she_o shall_v so_o forbear_v twenty_o pound_n of_o lawful_a english_a money_n as_o in_o and_o by_o the_o say_a act_n of_o parliament_n more_o at_o large_a appear_v and_o whereas_o afterward_o by_o another_o act_n of_o parliament_n of_o the_o say_a queen_n it_o be_v further_o enact_v by_o the_o authority_n of_o the_o say_a parliament_n among_o other_o thing_n how_o and_o when_o the_o say_v payment_n of_o the_o say_v 20_o l._n shall_v be_v make_v and_o that_o if_o default_n shall_v be_v make_v in_o any_o part_n of_o any_o payment_n of_o the_o say_v twenty_o pound_n contrary_a to_o the_o form_n in_o the_o say_v last_o specify_v statute_n limit_v that_o then_o and_o so_o often_o the_o say_a queen_n shall_v and_o may_v by_o process_n out_o of_o her_o highness_n exchequer_n take_v seize_v and_o enjoy_v all_o the_o good_n and_o two_o part_n as_o well_o of_o all_o the_o land_n tenement_n and_o hereditament_n lease_n and_o farm_n of_o such_o offender_n as_o of_o all_o other_o child_n and_o family_n as_o in_o and_o by_o the_o last_o specify_v statute_n more_o at_o large_a also_o may_v appear_v now_o forasmuch_o as_o the_o say_a penalty_n of_o twenty_o pound_n monthly_o be_v a_o great_a burden_n unto_o man_n of_o small_a live_n then_o unto_o such_o as_o be_v of_o better_a ability_n and_o do_v refuse_v to_o come_v unto_o divine_a service_n as_o aforesaid_a who_o rather_o than_o they_o will_v have_v two_o part_n of_o their_o land_n to_o be_v seize_v will_v be_v ready_a always_o to_o pay_v the_o say_v twenty_o pound_n according_a to_o the_o limitation_n of_o the_o say_a statute_n and_o yet_o retain_v the_o residue_n of_o their_o live_n and_o inheritance_n in_o their_o own_o hand_n be_v of_o great_a yearly_a value_n which_o they_o do_v for_o the_o most_o part_n employ_v as_o experience_n have_v teach_v to_o the_o maintenance_n of_o superstition_n and_o popish_a religion_n and_o to_o the_o relief_n of_o jesuit_n seminary_n popish_a priest_n and_o other_o dangerous_a person_n to_o the_o state_n therefore_o to_o the_o intent_n that_o hereafter_o the_o penalty_n for_o not_o repair_v to_o divine_a service_n may_v be_v inflict_v in_o better_a proportion_n upon_o man_n of_o great_a ability_n be_v it_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n land_n the_o king_n may_v refuse_v 20_o l._n a_o month_n and_o take_v two_o part_n of_o a_o recusants_n land_n that_o the_o king_n majesty_n his_o heir_n and_o successor_n shall_v from_o and_o after_o the_o feast_n of_o st._n michael_n the_o archangel_n next_o come_v after_o the_o end_n
