the_o exercile_a of_o his_o ministry_n and_o that_o the_o presbytrie_n of_o dalkeith_n and_o other_o haver_n of_o the_o lybel_n give_v in_o against_o he_o and_o deposition_n of_o the_o witness_n may_v of_o the_o presbytery_n of_o dalkeith_n their_o procedure_n in_o reference_n to_o the_o sentence_n of_o mr._n alexander_n heriot_n and_o their_o plant_n of_o the_o congregation_n of_o dalkeith_n it_o be_v not_o to_o be_v doubt_v but_o that_o a_o late_a pamphlet_n call_v a_o information_n for_o mr._n alexander_n heriot_n design_v minister_n at_o dalkeith_n have_v spread_v through_o a_o great_a part_n of_o this_o kingdom_n and_o it_o may_v perhaps_o be_v think_v strange_a that_o none_o of_o the_o member_n either_o of_o the_o presbytery_n of_o dalkeith_n or_o synod_n of_o louthian_n and_o tweddale_n have_v appear_v to_o vindicate_v the_o innocency_n of_o these_o judicatories_n and_o to_o wipe_v off_o the_o soul_n aspersion_n cast_v upon_o they_o by_o that_o defamatory_n paper_n but_o the_o truth_n be_v a_o answer_n to_o that_o paper_n be_v prepare_v about_o four_o month_n ago_o and_o the_o reason_n why_o the_o publication_n thereof_o be_v at_o that_o time_n delay_v be_v because_o it_o be_v judge_v convenient_a to_o know_v the_o mind_n of_o the_o synod_n who_o integrity_n be_v also_o question_v and_o reproach_v by_o the_o informer_n before_o any_o answer_n to_o that_o paper_n shall_v be_v emit_v but_o the_o synod_n sit_v in_o may_n last_o and_o judge_v the_o calumny_n of_o that_o paper_n obvious_a enough_o decline_v to_o trouble_v themselves_o with_o any_o review_n thereof_o as_o a_o thing_n not_o worthy_a of_o their_o time_n but_o some_o of_o the_o synod_n put_v it_o in_o the_o hand_n of_o a_o person_n who_o acquaintance_n with_o the_o process_n of_o mr._n heriot_n qualify_v he_o to_o descry_v the_o informer_n lie_v thereanent_a and_o again_o this_o person_n be_v divert_v with_o a_o throng_n of_o business_n till_o the_o plantation_n of_o the_o kirk_n of_o dalkeith_n be_v near_o a_o issue_n it_o be_v think_v expedient_a still_o to_o forebear_v the_o answer_n of_o that_o paper_n till_o the_o answerer_n may_v be_v able_a to_o give_v a_o joint_a view_n of_o the_o process_n of_o mr._n heriot_n and_o of_o the_o method_n take_v for_o the_o settlement_n of_o the_o paroch_n of_o dalkeith_n with_o a_o qualify_v minister_n which_o be_v now_o bring_v to_o a_o happy_a period_n it_o seem_v high_a time_n after_o so_o long_a forbearance_n to_o undeceive_v all_o that_o be_v willing_a to_o know_v the_o truth_n and_o to_o give_v in_o the_o first_o place_n a_o compendious_a but_o distinct_a account_n of_o the_o process_n and_o then_o refel_v the_o informer_n misrepresentation_n of_o the_o same_o only_o let_v this_o be_v premit_v that_o the_o reason_n why_o
court_n arbitrary_a and_o yet_o this_o be_v the_o informer_n only_a argument_n why_o no_o ecclesiastic_a court_n can_v be_v sovereign_a in_o the_o matter_n of_o censure_n because_o than_o it_o will_v be_v arbitrary_a 2_o the_o high_a asserter_n of_o the_o supremacy_n before_o the_o act_n of_o parliament_n 1669_o which_o be_v now_o rescind_v do_v never_o affirm_v that_o the_o king_n or_o council_n may_v by_o themselves_o reverse_v or_o redress_v censure_n pure_o ecclesiastic_a but_o the_o outmost_a by_o they_o acclaim_v be_v and_o be_v that_o all_o remedy_n by_o church_n judicature_n fail_v the_o king_n or_o council_n may_v with_o advice_n of_o the_o sanior_fw-la pars_fw-la put_v a_o stop_n to_o the_o procedure_n for_o some_o competent_a time_n and_o recommend_v a_o review_n till_o better_a order_n may_v be_v reestablish_v but_o 3_o lie_v the_o informer_n may_v have_v find_v the_o act_n of_o parliament_n that_o he_o cite_v thereafter_o plain_o interpret_v and_o restrict_v viz._n by_o the_o informer_n shall_v no_o way_n be_v prejudicial_a to_o nor_o derogate_v any_o thing_n from_o the_o privilege_n that_o god_n have_v give_v to_o the_o spititual_a office-bearer_n in_o the_o church_n concern_v the_o collation_n or_o deprivation_n of_o minister_n etc._n etc._n but_o this_o last_o act_n the_o informer_n do_v not_o or_o will_v not_o think_v on_o and_o certain_o to_o understand_v the_o former_a act_n so_o lax_o as_o he_o do_v and_o to_o apply_v it_o to_o a_o case_n so_o plain_a and_o obvious_a as_o mr._n heriot_n deposition_n be_v no_o less_o than_o to_o overturn_v the_o church_n and_o introduce_v confusion_n 2._o but_o in_o answer_n to_o what_o be_v say_v viz._n that_o the_o council_n can_v put_v in_o minister_n and_o therefore_o can_v meddle_v that_o the_o council_n power_n to_o charge_n in_o the_o case_n he_o suppose_v be_v allow_v to_o fortify_v the_o presentation_n of_o the_o patron_n when_o in_o use_n and_o so_o to_o maintain_v that_o mix_v right_o partly_o civil_a and_o partly_o ecclesiastical_a which_o they_o pretend_v to_o but_o now_o that_o presentation_n be_v abolish_v and_o that_o the_o matter_n of_o call_v and_o of_o enter_v minister_n be_v by_o the_o late_a act_n of_o parliament_n refer_v to_o the_o determination_n of_o the_o presbytery_n of_o the_o bound_n to_o be_v by_o they_o conclude_v the_o remedy_n in_o case_n of_o difference_n upon_o a_o call_v must_v no_o long_o be_v by_o letter_n of_o horning_n but_o by_o appeal_n to_o the_o synod_n and_o from_o the_o synod_n to_o the_o assembly_n to_o be_v there_o ultimate_o determine_v and_o 2_o lie_n there_o be_v beside_o this_o mistake_n in_o the_o case_n suppose_v a_o great_a disparity_n and_o inconsequence_n in_o the_o argument_n thereon_o found_v for_o esto_fw-la that_o the_o lord_n of_o council_n may_v put_v the_o presbytery_n to_o do_v their_o duty_n it_o do_v not_o therefore_o follow_v that_o in_o case_n they_o refuse_v the_o council_n may_v do_v it_o for_o they_o which_o yet_o must_v be_v the_o informer_n inference_n or_o otherwise_o he_o conclude_v nothing_o but_o all_o the_o magistrate_n do_v in_o such_o a_o case_n be_v to_o bring_v the_o matter_n people_n must_v be_v in_o perpetual_a disquiet_n for_o can_v the_o informer_n upon_o the_o small_a reflection_n think_v that_o his_o clamour_n shall_v preponderate_v with_o the_o magistrate_n to_o
