punishment_n upon_o they_o as_o shall_v be_v due_a to_o such_o as_o neglect_v their_o own_o duty_n and_o our_o royal_a command_n publish_v upon_o so_o important_a a_o occasion_n and_o we_o do_v hereby_o will_v require_v and_o command_v all_o and_o every_o our_o judge_n of_o assize_n major_n sheriff_n justice_n of_o peace_n constable_n headborough_n and_o other_o our_o officer_n minister_n and_o subject_n who_o it_o may_v concern_v that_o they_o careful_o and_o effectual_o observe_v and_o perform_v all_o and_o every_o the_o premise_n as_o they_o will_v answer_v the_o neglect_n thereof_o at_o their_o uttermost_a peril_n and_o whereas_o we_o have_v late_o command_v a_o book_n to_o be_v print_v and_o publish_v contain_v certain_a statute_n make_v and_o enact_v heretofore_o for_o the_o relief_n of_o the_o poor_a and_o of_o soldier_n and_o mariner_n and_o for_o punishment_n of_o rogue_n and_o vagabond_n and_o for_o the_o relief_n and_o order_n of_o person_n infect_v with_o the_o plague_n and_o also_o contain_v certain_a order_n heretofore_o and_o now_o late_o conceive_v and_o make_v concern_v health_n all_o which_o be_v necessary_a to_o be_v know_v and_o observe_v by_o our_o love_a subject_n that_o thereby_o they_o may_v the_o better_o avoid_v those_o danger_n which_o otherwise_o may_v fall_v upon_o their_o person_n or_o estate_n by_o their_o neglect_n thereof_o we_o have_v think_v it_o fit_v hereby_o to_o give_v notice_n thereof_o to_o all_o our_o love_a subject_n to_o the_o end_n that_o none_o may_v pretend_v ignorance_n for_o a_o excuse_n in_o matter_n of_o so_o great_a importance_n and_o we_o do_v hereby_o declare_v that_o whosoever_o shall_v be_v find_v remiss_a or_o negligent_a in_o the_o execution_n of_o any_o part_n of_o the_o premise_n shall_v greatness_n of_o the_o same_o parish_n and_o parish_n to_o be_v nominate_v yearly_o in_o easter_n week_n or_o within_o one_o month_n after_o easter_n under_o the_o hand_n and_o seal_v of_o two_o or_o more_o justice_n of_o the_o peace_n in_o the_o same_o county_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la dwell_v in_o or_o near_o the_o same_o parish_n or_o division_n where_o the_o same_o parish_n do_v lie_v shall_v be_v call_v overseer_n of_o the_o poor_a of_o the_o same_o parish_n and_o they_o or_o the_o great_a part_n of_o they_o shall_v take_v order_n from_o time_n to_o time_n by_o and_o with_o the_o consent_n of_o two_o or_o more_o such_o justice_n of_o peace_n as_o be_v aforesaid_a work_v for_o set_v to_o work_v of_o the_o child_n of_o all_o such_o who_o parent_n shall_v not_o by_o the_o say_a churchwarden_n and_o overseer_n or_o the_o great_a part_n of_o they_o be_v think_v able_a to_o keep_v and_o maintain_v their_o child_n and_o also_o for_o set_v to_o work_v all_o such_o person_n marry_v or_o unmarried_a have_v no_o mean_n to_o maintain_v they_o use_v no_o ordinary_a &_o daily_a trade_n of_o life_n to_o get_v their_o live_n by_o and_o also_o to_o raise_v weekly_a or_o otherwise_o by_o taxation_n of_o every_o inhabitant_n parson_n vicar_n and_o other_o &_o of_o every_o occupier_n of_o land_n house_n tithe_n impropriate_a or_o propriation_n of_o tithe_n colemines_n or_o saleable_a underwoods_n in_o the_o say_a parish_n in_o such_o competent_a sum_n and_o sum_n of_o money_n as_o they_o shall_v think_v fit_a a_o convenient_a stock_n of_o flax_n raise_v hemp_n wool_n thread_n iron_n &_o other_o necessary_a ware_n &_o stuff_n to_o set_v the_o poor_a on_o work_n and_o also_o competent_a sum_n of_o money_n for_o and_o towards_o the_o necessary_a relief_n of_o the_o lame_a impotent_a old_a blind_a and_o such_o other_o among_o they_o be_v poor_a and_o not_o able_a to_o work_v &_o also_o for_o the_o put_v out_o of_o such_o child_n to_o be_v apprentice_n to_o be_v gather_v out_o of_o the_o same_o parish_n according_a to_o the_o ability_n of_o the_o same_o parish_n and_o to_o do_v and_o execute_v all_o other_o thing_n aswell_o for_o the_o dispose_n of_o the_o say_a stock_n as_o otherwise_o concern_v the_o premise_n as_o to_o they_o shall_v seem_v convenient_a which_o say_v church_n warden_n &_o overseer_n so_o to_o be_v nominate_v month_n or_o such_o of_o they_o as_o shall_v not_o be_v let_v by_o sickness_n or_o other_o just_a excuse_n to_o be_v allow_v by_o two_o such_o justice_n of_o peace_n or_o more_o as_o be_v aforesaid_a shall_v meet_v together_o at_o the_o least_o once_o every_o month_n in_o the_o church_n of_o the_o say_a parish_n upon_o the_o sunday_n in_o the_o afternoon_n after_o divine_a service_n there_o to_o consider_v of_o some_o good_a course_n to_o be_v take_v and_o of_o some_o meet_a order_n to_o be_v set_v down_o in_o the_o premise_n &_o shall_v within_o four_o day_n after_o the_o end_n of_o their_o year_n &_o after_o other_o overseer_n nominate_v as_o aforesaid_a make_v &_o yield_v up_o to_o such_o two_o justice_n of_o peace_n as_o be_v aforesaid_a peace_n a_o true_a and_o perfect_a account_n of_o all_o sum_n of_o money_n by_o they_o receive_v or_o rate_v and_o sess_v and_o not_o receive_v and_o also_o of_o such_o stock_n as_o shall_v be_v in_o their_o hand_n or_o in_o the_o hand_n of_o any_o of_o the_o poor_a to_o work_v and_o of_o all_o other_o thing_n concern_v their_o say_a office_n and_o such_o sum_n or_o sum_n of_o money_n as_o shall_v be_v in_o their_o hand_n shall_v pay_v and_o deliver_v over_o to_o the_o say_a churchwarden_n and_o overseer_n new_o nominate_v and_o appoint_v as_o be_v aforesaid_a upon_o pain_n that_o every_o one_o of_o they_o absent_v themselves_o without_o lawful_a cause_n as_o aforesaid_a from_o such_o monthly_a meeting_n for_o the_o purpose_n aforesaid_a or_o be_v negligent_a in_o their_o office_n or_o in_o the_o execution_n of_o the_o order_n aforesaid_a be_v make_v by_o and_o with_o the_o assent_n of_o the_o say_a justice_n of_o peace_n or_o any_o two_o of_o they_o before_o mention_v to_o forfeit_v for_o every_o such_o default_n of_o absence_n or_o negligence_n twenty_o shilling_n and_o be_v it_o also_o enact_v parish_n that_o if_o the_o say_a justice_n of_o peace_n do_v perceive_v that_o the_o inhabitant_n of_o any_o parish_n be_v not_o able_a to_o levy_v among_o themselves_o sufficient_a sum_n of_o money_n for_o the_o purpose_n aforesaid_a that_o then_o the_o say_v two_o justice_n shall_v and_o may_v tax_v rate_n and_o assess_v as_o aforesaid_a any_o other_o of_o other_o parish_n or_o out_o of_o any_o parish_n within_o the_o hundred_o where_o the_o say_a parish_n be_v to_o pay_v such_o sum_n and_o sum_n of_o money_n to_o the_o churchwarden_n &_o overseer_n of_o the_o say_v poor_a parish_n for_o the_o say_a purpose_n as_o the_o say_a justice_n shall_v think_v fit_a according_a to_o the_o intent_n of_o this_o law_n and_o if_o the_o say_v hundred_o shall_v not_o be_v think_v to_o the_o say_a justice_n able_a and_o fit_a to_o relieve_v the_o say_a several_a parish_n not_o able_a to_o provide_v for_o themselves_o as_o aforesaid_a then_o the_o justice_n of_o peace_n at_o their_o general_a quarter_n session_n or_o the_o great_a number_n of_o they_o shall_v rate_v and_o assess_v as_o aforesaid_a any_o other_o of_o other_o parish_n or_o out_o of_o any_o parish_n within_o the_o say_a county_n for_o the_o purpose_n aforesaid_a as_o in_o their_o discretion_n shall_v seem_v fit_a and_o that_o it_o shall_v be_v lawful_a aswell_o for_o the_o present_a as_o subsequent_a churchwarden_n and_o overseer_n or_o any_o of_o they_o by_o warrant_n from_o any_o two_o such_o justice_n of_o peace_n as_o be_v aforesaid_a to_o levy_v aswell_o the_o say_a sum_n of_o money_n and_o all_o arrearage_n of_o every_o one_o that_o shall_v refuse_v to_o contribute_v according_a as_o they_o shall_v be_v assess_v pay_v by_o distress_n and_o sale_n of_o the_o offender_n good_n as_o the_o sum_n of_o money_n or_o stock_n which_o shall_v be_v behind_n upon_o any_o account_n to_o be_v make_v as_o aforesaid_a render_v to_o the_o party_n the_o overplus_n and_o in_o defect_n of_o such_o distress_n it_o shall_v be_v lawful_a for_o any_o
such_o two_o justice_n of_o the_o peace_n to_o commit_v he_o or_o they_o to_o the_o common_a gaol_n of_o the_o county_n there_o to_o remain_v without_o bail_n or_o maineprise_n until_o payment_n of_o the_o say_a sum_n arrearage_n &_o stock_n and_o the_o say_a justice_n of_o peace_n work_v or_o any_o of_o they_o to_o send_v to_o the_o house_n of_o correction_n or_o common_a gaol_n such_o as_o shall_v not_o employ_v themselves_o to_o work_v be_v appoint_v thereunto_o as_o aforesaid_a and_o also_o any_o two_o such_o justice_n of_o peace_n to_o commit_v to_o the_o say_a prison_n every_o one_o of_o the_o say_a churchwarden_n and_o overseer_n which_o shall_v refuse_v to_o account_v there_o to_o remain_v without_o bail_n or_o maineprise_n until_o he_o have_v make_v a_o true_a account_n and_o satisfy_v and_o pay_v so_o much_o as_o upon_o the_o say_a account_n shall_v be_v remain_v in_o his_o hand_n and_o be_v it_o further_o enact_v that_o it_o shall_v be_v lawful_a for_o the_o say_a churchwarden_n and_o overseer_n or_o the_o great_a part_n of_o they_o by_o the_o assent_n of_o any_o two_o justice_n of_o the_o peace_n aforesaid_a to_o bind_v any_o such_o child_n as_o aforesaid_a overseer_n to_o be_v apprentice_n where_o they_o shall_v see_v convenient_a till_o such_o man_n child_n shall_v come_v to_o the_o age_n of_o four_o and_o twenty_o year_n and_o such_o woman_n child_n to_o the_o age_n of_o one_o and_o twenty_o year_n or_o the_o time_n of_o her_o marriage_n the_o same_o to_o be_v as_o effectual_a to_o all_o purpose_n as_o if_o such_o child_n be_v of_o full_a age_n and_o by_o indenture_n of_o covenant_n bind_v he_o or_o herself_o and_o to_o the_o intent_n that_o necessary_a place_n of_o habitation_n may_v more_o convenient_o be_v provide_v for_o such_o poor_a impotent_a people_n be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a churchwarden_n and_o overseer_n or_o the_o great_a part_n of_o they_o by_o the_o leave_n of_o the_o lord_n or_o lord_n of_o the_o manor_n whereof_o any_o waste_n or_o common_a within_o their_o parish_n be_v or_o shall_v be_v parcel_n and_o upon_o agreement_n before_o with_o he_o or_o they_o make_v in_o write_v under_o the_o hand_n and_o seal_n of_o the_o say_a lord_n and_o lord_n or_o otherwise_o according_a to_o any_o order_n to_o be_v set_v down_o by_o the_o justice_n of_o peace_n of_o the_o say_a county_n at_o their_o general_n quarter_n session_n or_o the_o great_a part_n of_o they_o by_o like_a leave_n and_o agreement_n of_o the_o say_a lord_n or_o lord_n in_o write_v under_o he_o or_o their_o hand_n and_o seal_n to_o erect_v build_v build_v and_o set_v up_o in_o fit_a and_o convenient_a place_n of_o habitation_n in_o such_o waste_n or_o common_a at_o the_o general_a charge_n of_o the_o parish_n or_o otherwise_o of_o the_o hundred_o or_o county_n as_o aforesaid_a to_o be_v tax_v rate_v and_o gather_v in_o manner_n before_o express_v convenient_a house_n of_o dwell_v for_o the_o say_v impotent_a poor_a and_o also_o to_o place_v inmate_n or_o more_o family_n than_o one_o in_o one_o cottage_n or_o house_n one_o act_n make_v in_o the_o one_o &_o thirty_o year_n of_o her_o majesty_n reign_n entitle_v a_o act_n against_o the_o erect_n and_o maintain_v of_o cottage_n or_o any_o thing_n therein_o contain_v to_o the_o contrary_a notwithstanding_o which_o cottage_n and_o place_n for_o inmate_n shall_v not_o at_o any_o time_n after_o be_v use_v or_o employ_v to_o or_o for_o any_o other_o habitation_n but_o only_o for_o impotent_a and_o poor_a of_o the_o same_o parish_n that_o shall_v be_v there_o place_v from_o time_n to_o time_n by_o the_o churchwarden_n and_o overseer_n of_o the_o poor_a of_o the_o same_o parish_n or_o the_o most_o part_n of_o they_o upon_o the_o pain_n and_o forfeiture_n contain_v in_o the_o say_v former_a act_n make_v in_o the_o say_v one_o and_o thirty_o year_n of_o her_o majesty_n reign_n provide_v always_o tax_n that_o if_o any_o person_n or_o person_n shall_v find_v themselves_o grieve_v with_o any_o sesse_n or_o tax_n or_o other_o act_n do_v by_o the_o say_a churchwarden_n and_o other_o person_n or_o by_o the_o say_a justice_n of_o peace_n that_o then_o it_o shall_v be_v lawful_a for_o the_o justice_n of_o peace_n at_o their_o general_a quarter_n session_n or_o the_o great_a number_n of_o they_o to_o take_v such_o order_n therein_o as_o to_o they_o shall_v be_v think_v convenient_a and_o the_o same_o to_o conclude_v and_o bind_v all_o the_o say_a party_n and_o be_v it_o further_o enact_v that_o the_o father_n and_o grandfather_n and_o the_o mother_n poor_a and_o grandmother_n and_o the_o child_n of_o every_o poor_a old_a blind_a lame_a and_o impotent_a person_n or_o other_o poor_a person_n not_o able_a to_o work_v be_v of_o a_o sufficient_a ability_n shall_v at_o their_o own_o charge_n relieve_v and_o maintain_v every_o such_o poor_a person_n in_o that_o manner_n and_o according_a to_o that_o raâ—e_n as_o by_o the_o justice_n of_o peace_n of_o that_o county_n where_o such_o sufficient_a person_n dwell_v or_o the_o great_a number_n of_o they_o at_o their_o general_a quarter_n session_n shall_v be_v assess_v upon_o pain_n that_o every_o one_o of_o they_o shall_v forfeit_v twenty_o shilling_n for_o every_o month_n which_o they_o shall_v fail_v therein_o and_o be_v it_o further_o hereby_o enact_v that_o the_o major_n peace_n bailiff_n or_o other_o head_n officer_n of_o every_o town_n and_o place_n corporate_a and_o city_n within_o this_o realm_n be_v justice_n or_o justice_n of_o peace_n shall_v have_v the_o same_o authority_n by_o virtue_n of_o this_o act_n within_o the_o limit_n and_o precint_n of_o their_o jurisdiction_n aswell_o out_o of_o session_n as_o at_o their_o session_n if_o they_o hold_v any_o as_o be_v herein_o limit_v prescribe_v and_o appoint_v to_o justice_n of_o peace_n of_o the_o county_n or_o any_o two_o or_o more_o of_o execute_v in_o every_o respect_n so_o much_o as_o be_v appoint_v and_o allow_v by_o this_o act_n to_o be_v do_v and_o execute_v by_o one_o or_o two_o justice_n of_o peace_n of_o any_o county_n within_o this_o realm_n and_o be_v it_o also_o enact_v that_o if_o it_o shall_v happen_v any_o parish_n to_o extend_v itself_o into_o more_o county_n than_o one_o or_o part_n to_o lie_v within_o the_o liberty_n of_o any_o city_n town_n or_o place_n corporate_a and_o part_n without_o that_o then_o as_o well_o the_o justice_n of_o peace_n of_o every_o county_n as_o also_o the_o head_n officer_n of_o such_o city_n town_n or_o place_n corporate_a liberty_n shall_v deal_v and_o intermeddle_v only_o in_o so_o much_o of_o the_o say_a parish_n as_o lie_v within_o their_o liberty_n and_o not_o any_o further_o and_o every_o of_o they_o respective_o within_o their_o several_a limit_n ward_n and_o jurisdiction_n to_o execute_v the_o ordinance_n before_o mention_v concern_v the_o nomination_n of_o overseer_n the_o consent_n to_o bind_v apprentice_n the_o give_a warrant_n to_o levy_v taxation_n unpayd_a the_o take_a account_n of_o churchwarden_n and_o overseer_n and_o the_o commit_n to_o prison_n such_o as_o refuse_v to_o account_v or_o deny_v to_o pay_v the_o arrearage_n due_a upon_o their_o account_n and_o yet_o nevertheless_o the_o say_a churchwarden_n and_o overseer_n or_o the_o most_o part_n of_o they_o of_o the_o say_a parish_n that_o do_v extend_v into_o such_o several_a limit_n and_o jurisdiction_n shall_v without_o divide_v themselves_o due_o execute_v their_o office_n in_o all_o place_n within_o the_o say_a parish_n in_o all_o thing_n to_o they_o belong_v make_v and_o shall_v due_o exhibit_v and_o make_v one_o account_n before_o the_o say_a head_n officer_n of_o the_o town_n or_o place_n corporate_a and_o one_o other_o before_o the_o say_a justice_n of_o peace_n or_o any_o such_o two_o of_o they_o as_o be_v aforesaid_a and_o further_o be_v it_o enact_v by_o the_o authority_n aforesaid_a overseer_n that_o if_o in_o any_o place_n within_o this_o realm_n there_o happen_v to_o be_v hereafter_o no_o such_o nomination_n of_o overseer_n yearly_o as_o be_v before_o appoint_v that_o then_o every_o justice_n of_o peace_n of_o the_o county_n dwell_v within_o the_o division_n where_o such_o default_n of_o nomination_n shall_v happen_v and_o every_o mayor_n alderman_n and_o head_n officer_n of_o city_n town_n or_o place_n corporate_a where_o such_o default_n shall_v happen_v shall_v lose_v
and_o forfeit_v for_o every_o such_o default_n five_o pound_n to_o be_v employ_v towards_o the_o relief_n of_o the_o poor_a of_o the_o say_a parish_n or_o place_n corporate_a and_o to_o be_v levy_v as_o aforesaid_a of_o their_o good_n by_o warrant_n from_o the_o general_a session_n of_o the_o peace_n of_o the_o say_a county_n or_o of_o the_o same_o city_n town_n or_o place_n corporate_a if_o they_o keep_v session_n use_n and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o all_o penalty_n and_o forfeiture_n before_o mention_v in_o this_o act_n to_o be_v forfeit_v by_o any_o person_n or_o person_n shall_v go_v and_o be_v employ_v to_o the_o use_n of_o the_o poor_a of_o the_o same_o parish_n and_o towards_o a_o stock_n and_o habitation_n for_o they_o and_o other_o necessary_a use_n and_o relief_n as_o before_o in_o this_o act_n be_v mention_v and_o express_v and_o shall_v be_v levy_v by_o the_o say_a churchwarden_n and_o overseer_n or_o one_o of_o they_o by_o warrant_n from_o any_o two_o such_o justice_n of_o peace_n or_o mayor_n alderman_n or_o head_n officer_n of_o city_n town_n or_o place_n corporate_a respective_o within_o their_o several_a limit_n by_o distress_n and_o sale_n thereof_o as_o aforesaid_a or_o in_o defect_n thereof_o it_o shall_v be_v lawful_a for_o any_o two_o such_o justice_n of_o peace_n and_o the_o say_a alderman_n and_o head_n officer_n within_o their_o several_a limit_n to_o commit_v the_o offendor_n to_o the_o say_a prison_n there_o to_o remain_v without_o bail_n or_o maineprise_n till_o the_o say_a forfeiture_n shall_v be_v satisfy_v and_o pay_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a session_n that_o the_o justice_n of_o peace_n of_o every_o county_n or_o place_n corporate_a or_o the_o more_o part_n of_o they_o in_o their_o general_a session_n to_o be_v hold_v next_o after_o the_o feast_n of_o easter_n next_o and_o so_o yearly_o as_o often_o as_o they_o shall_v think_v meet_a shall_v rate_v every_o parish_n to_o such_o a_o weekly_a sum_n of_o money_n as_o they_o shall_v think_v convenient_a so_o as_o no_o parish_n be_v rate_v above_o the_o sum_n of_o six_o penny_n nor_o under_o the_o sum_n of_o a_o halfpenny_n weekly_o to_o be_v pay_v and_o so_o as_o the_o total_a sum_n of_o such_o taxation_n of_o the_o parish_n in_o every_o county_n amount_v not_o above_o the_o rate_n of_o two_o penny_n for_o every_o parish_n within_o the_o say_a county_n which_o sum_v so_o tax_v rate_v shall_v be_v yearly_o assess_v by_o the_o agreement_n of_o the_o parishioner_n within_o themselves_o or_o in_o default_n thereof_o by_o the_o churchwarden_n and_o petty_a constable_n of_o the_o same_o parish_n or_o the_o more_o part_n of_o they_o or_o in_o default_n of_o their_o agreement_n by_o the_o order_n of_o such_o justice_n or_o justice_n of_o peace_n as_o shall_v dwell_v in_o the_o same_o parish_n or_o if_o none_o be_v there_o dwell_v in_o the_o part_n next_o adjoin_v and_o if_o any_o person_n shall_v refuse_v or_o neglect_v to_o pay_v any_o such_o portion_n of_o money_n so_o tax_v it_o shall_v be_v lawful_a for_o the_o say_a churchwarden_n and_o constable_n or_o any_o of_o they_o or_o in_o their_o default_n for_o any_o justice_n of_o peace_n of_o the_o say_a limit_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o the_o good_n of_o the_o party_n so_o refuse_v or_o neglect_v render_v to_o the_o party_n the_o overplus_n and_o in_o default_n of_o such_o distress_n it_o shall_v be_v lawful_a to_o any_o justice_n of_o that_o limit_n to_o commit_v quarterly_o out_o of_o every_o county_n or_o place_n corporate_a for_o the_o relief_n of_o the_o poor_a prisoner_n of_o the_o king_n bench_n and_o marshalsey_n &_o also_o of_o such_o hospital_n and_o alm_n house_n as_o shall_v be_v in_o the_o say_a county_n and_o what_o sum_n of_o money_n shall_v be_v send_v to_o every_o one_o of_o the_o say_v hospital_n &_o alm_n house_n so_o as_o there_o be_v send_v out_o of_o every_o county_n yearly_o xx_o s._n at_o the_o least_o to_o each_o of_o the_o say_a prison_n of_o the_o king_n bench_n and_o marshalsey_n which_o sum_n ratable_o to_o be_v assess_v upon_o every_o parish_n the_o churchwarden_n of_o every_o parish_n shall_v true_o collect_v and_o pay_v over_o to_o the_o high_a constable_n in_o who_o division_n such_o parish_n shall_v be_v situate_a from_o time_n to_o time_n quarterly_a ten_o day_n before_o the_o end_n of_o every_o quarter_n and_o every_o such_o constable_n at_o every_o such_o quarter_n session_n in_o such_o county_n shall_v pay_v over_o the_o same_o to_o such_o two_o treasurer_n or_o to_o one_o of_o they_o as_o shall_v by_o the_o more_o part_n of_o the_o justice_n of_o peace_n of_o the_o county_n be_v elect_v to_o be_v the_o say_a treasurer_n to_o be_v choose_v by_o the_o justice_n of_o peace_n of_o the_o say_a county_n city_n or_o town_n or_o place_n corporate_a or_o of_o other_o which_o be_v sess_v and_o tax_v at_o five_o pound_n land_n or_o ten_o pound_n good_n at_o the_o least_o at_o the_o tax_n of_o subsidy_n next_o before_o the_o time_n of_o the_o say_a election_n to_o be_v make_v and_o the_o say_a treasurer_n so_o elect_v end_n to_o continue_v for_o the_o space_n of_o one_o whole_a year_n in_o their_o office_n and_o then_o to_o give_v up_o their_o charge_n with_o a_o due_a account_n of_o their_o receipt_n and_o disbursement_n at_o the_o quarter_n session_n to_o be_v hold_v next_o after_o the_o feast_n of_o easter_n in_o every_o year_n to_o such_o other_o as_o shall_v from_o year_n to_o year_n in_o form_n aforesaid_a successive_o be_v elect_v treasurer_n for_o the_o say_a county_n city_n town_n or_o place_n corporate_a which_o say_v treasurer_n or_o one_o of_o they_o shall_v pay_v over_o the_o same_o to_o the_o lord_n chief_a justice_n of_o england_n martial_n and_o knight_n marshal_n for_o the_o time_n be_v equal_o to_o be_v divide_v to_o the_o use_n aforesaid_a take_v their_o acquittance_n for_o the_o same_o or_o in_o default_n of_o the_o say_v chief_a justice_n to_o the_o next_o ancient_a justice_n of_o the_o king_n bench_n as_o aforesaid_a and_o if_o any_o churchwarden_n or_o high_a constable_n or_o his_o executor_n or_o administrator_n payment_n shall_v fail_v to_o make_v payment_n in_o form_n above_o specify_v than_o every_o churchwarden_n his_o executor_n or_o administrator_n so_o offend_v shall_v forfeit_v for_o every_o time_n the_o sum_n of_o ten_o shilling_n and_o every_o high_a constable_n his_o executor_n or_o administrator_n shall_v forfeit_v for_o every_o time_n the_o sum_n of_o xx_o s_o the_o same_o forfeiture_n together_o with_o the_o sum_n behind_o to_o be_v levy_v by_o the_o say_a treasurer_n and_o treasurer_n by_o way_n of_o distress_n and_o sale_n of_o the_o good_n as_o aforesaid_a in_o form_n aforesaid_a and_o by_o they_o to_o be_v employ_v towards_o the_o charitable_a use_n comprise_v in_o this_o act._n bestow_v and_o be_v it_o further_o enact_v that_o all_o the_o surplusage_n of_o money_n which_o shall_v be_v remain_v in_o the_o say_a stock_n of_o any_o county_n shall_v by_o discretion_n of_o the_o more_o part_n of_o the_o justice_n of_o peace_n in_o their_o quarter_n session_n be_v order_v distribute_v and_o bestow_v for_o the_o relief_n of_o the_o poor_a hospital_n of_o that_o county_n and_o of_o those_o that_o shall_v sustain_v loss_n by_o fire_n water_n the_o sea_n or_o other_o casualty_n and_o to_o such_o other_o charitable_a purpose_n for_o the_o relief_n of_o the_o poor_a as_o to_o the_o more_o part_n of_o the_o say_a justice_n of_o peace_n shall_v seem_v convenient_a appoint_v and_o be_v it_o further_o enact_v that_o if_o any_o treasurer_n elect_v shall_v wilful_o refuse_v to_o take_v upon_o he_o the_o say_a office_n of_o treasurership_n or_o refuse_v to_o distribute_v and_o give_v relief_n or_o to_o account_v according_a to_o such_o form_n as_o shall_v be_v appoint_v by_o the_o more_o part_n of_o the_o say_a justice_n of_o peace_n that_o then_o it_o shall_v be_v lawful_a for_o the_o justice_n of_o peace_n in_o their_o quarter_n session_n or_o in_o their_o default_n for_o the_o justice_n of_o assize_n at_o the_o assize_n to_o be_v hold_v in_o the_o same_o county_n to_o five_o the_o same_o treasurer_n by_o their_o discretion_n the_o same_o five_o not_o to_o be_v under_o three_o pound_n and_o to_o be_v levy_v by_o sale_n of_o his_o good_n and_o
to_o be_v prosecute_v by_o any_o two_o of_o the_o say_a justice_n of_o peace_n who_o they_o shall_v authorise_v provide_v always_o that_o this_o act_n shall_v not_o take_v effect_n until_o the_o feast_n of_o easter_n next_o poor_a and_o be_v it_o enact_v that_o the_o statute_n make_v in_o the_o nine_o and_o thirty_o year_n of_o her_o majesty_n reign_n entitle_v a_o act_n for_o the_o relief_n of_o the_o poor_a shall_v continue_v and_o stand_v in_o force_n until_o the_o feast_n of_o easter_n next_o and_o that_o all_o taxation_n heretofore_o impose_v and_o not_o pay_v nor_o that_o shall_v be_v pay_v before_o the_o say_a feast_n of_o easter_n next_o and_o that_o all_o tax_n hereafter_o before_o the_o say_a feast_n to_o be_v tax_v by_o virtue_n of_o the_o say_v former_a act_n which_o shall_v not_o be_v pay_v before_o the_o say_a feast_n of_o easter_n shall_v and_o may_v after_o the_o say_a feast_n of_o easter_n be_v levy_v by_o the_o overseer_n and_o other_o person_n in_o this_o act_n respective_o appoint_v to_o levy_v taxation_n by_o distress_n and_o by_o such_o warrant_n in_o every_o respect_n as_o if_o they_o have_v be_v tax_v &_o impose_v by_o virtue_n of_o this_o act_n &_o be_v not_o pay_v provide_v always_o foulness_n that_o whereas_o the_o island_n of_o foulness_n in_o the_o county_n of_o essex_n be_v environ_v with_o the_o sea_n and_o have_v a_o chapel_n of_o ease_n for_o the_o inhabitant_n thereof_o and_o yet_o the_o say_a island_n be_v no_o parish_n but_o the_o land_n in_o the_o same_o be_v situate_v within_o diverse_a parish_n far_o distant_a from_o the_o same_o island_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_v justice_n of_o peace_n shall_v nominate_v and_o appoint_v inhabitant_n within_o the_o say_a island_n to_o be_v overseer_n for_o the_o poor_a people_n dwell_v within_o the_o say_a island_n and_o that_o both_o they_o the_o say_v justice_n and_o the_o say_a overseer_n shall_v have_v the_o same_o power_n and_o authority_n to_o all_o intent_n consideration_n and_o purpose_n for_o the_o execution_n of_o the_o part_n and_o article_n of_o this_o act_n and_o shall_v be_v subject_a to_o the_o same_o pain_n and_o forfeiture_n and_o likewise_o that_o the_o inhabitant_n and_o occupier_n of_o land_n there_o shall_v be_v liable_a and_o chargeable_a to_o the_o same_o payment_n charge_n expense_n and_o order_n in_o such_o manner_n and_o form_n as_o if_o the_o same_o island_n be_v a_o parish_n in_o consideration_n whereof_o neither_o the_o say_a inhabitant_n or_o occupier_n of_o land_n within_o the_o say_a island_n shall_v not_o be_v compel_v to_o contribute_v towards_o the_o relief_n of_o the_o poor_a of_o those_o parish_n wherein_o their_o house_n or_o land_n which_o they_o occupy_v within_o the_o say_a island_n be_v situate_v for_o or_o by_o reason_n of_o their_o say_a habitation_n or_o occupying_n other_o then_o for_o the_o relief_n of_o the_o poor_a people_n within_o the_o say_a island_n neither_o yet_o shall_v the_o other_o inhabitant_n of_o the_o parish_n wherein_o such_o house_n or_o land_n be_v situate_v be_v compel_v by_o reason_n of_o their_o resiancie_n or_o dwelling_n to_o contribute_v to_o the_o relief_n of_o the_o poor_a inhabitant_n within_o the_o say_a island_n he_o and_o be_v it_o further_o enact_v that_o if_o any_o action_n or_o trespass_n or_o other_o suit_n shall_v happen_v to_o be_v attempt_v &_o bring_v against_o any_o person_n or_o person_n for_o take_v of_o any_o distress_n make_v of_o any_o sale_n or_o any_o other_o thing_n do_v by_o authority_n of_o this_o present_a act_n the_o defendant_n or_o defendant_n in_o any_o such_o action_n or_o suit_n shall_v &_o may_v either_o plead_v not_o guilty_a or_o otherwise_o make_v auowry_n cognisance_n or_o justification_n for_o the_o take_n of_o the_o say_a distress_n make_v of_o sale_n or_o other_o thing_n do_v by_o virtue_n of_o this_o act_n allege_v in_o such_o auowry_n cognisance_n or_o justification_n that_o the_o say_a distress_n sale_n trespass_n or_o other_o thing_n whereof_o the_o plaintiff_n or_o plaintiff_n complain_v be_v do_v by_o authority_n of_o this_o act_n and_o according_a to_o the_o tenor_n purport_n and_o effect_n of_o this_o act_n without_o any_o express_v or_o rehearsal_n of_o any_o other_o matter_n of_o circumstance_n contain_v in_o this_o present_a act_n to_o which_o auowrie_n cognisance_n or_o justification_n the_o plaintiff_n shall_v be_v admit_v to_o reply_v that_o the_o defendant_n do_v take_v the_o say_a distress_n make_v the_o say_a sale_n or_o do_v any_o other_o act_n or_o trespass_n suppose_v in_o his_o declaration_n of_o his_o own_o wrong_n without_o any_o such_o cause_n allege_v by_o the_o say_a defendant_n whereupon_o the_o issue_n in_o every_o such_o action_n shall_v be_v join_v to_o be_v try_v by_o verdict_n of_o twelve_o man_n and_o not_o otherwise_o as_o be_v accustom_v in_o other_o personal_a action_n and_o upon_o the_o weekly_a such_o a_o sum_n of_o money_n towards_o the_o relief_n of_o sick_a hurt_n and_o maim_a soldier_n and_o mariner_n that_o so_o have_v be_v as_o afore_o be_v say_v or_o shall_v lose_v their_o limb_n or_o disable_v their_o body_n have_v be_v press_v and_o in_o pay_n for_o her_o majesty_n service_n as_o by_o the_o justice_n of_o peace_n or_o the_o more_o part_n of_o they_o in_o their_o general_a quarter_n session_n to_o be_v hold_v in_o their_o several_a county_n next_o after_o the_o feast_n of_o easter_n next_o &_o so_o from_o time_n to_o time_n at_o the_o like_o quarter_n session_n to_o be_v hold_v next_o after_o the_o feast_n of_o easter_n yearly_o shall_v be_v appoint_v parish_n so_o as_o no_o parish_n be_v rate_v above_o the_o sum_n of_o ten_o penny_n nor_o under_o the_o sum_n of_o two_o penny_n weekly_a to_o be_v pay_v and_o so_o as_o the_o total_a sum_n of_o such_o taxation_n of_o the_o parish_n in_o any_o county_n where_o there_o shall_v be_v above_o fifty_o parish_n do_v not_o exceed_v the_o rate_n of_o six_o penny_n for_o every_o parish_n in_o the_o same_o county_n which_o sum_n so_o tax_v shall_v be_v yearly_o assess_v by_o the_o agreement_n of_o the_o parishioner_n within_o themselves_o or_o in_o default_n thereof_o by_o the_o churchwarden_n and_o the_o petty_a constable_n of_o the_o
same_o parish_n or_o the_o more_o part_n of_o they_o or_o in_o default_n of_o their_o agreement_n by_o the_o order_n of_o such_o justice_n or_o justice_n of_o peace_n as_o shall_v dwell_v in_o the_o same_o parish_n or_o if_o none_o be_v there_o dwell_v in_o the_o part_n next_o adjoin_v tax_v and_o if_o any_o person_n shall_v refuse_v or_o neglect_v to_o pay_v any_o such_o portion_n of_o money_n before_o the_o quarter_n session_n to_o be_v hold_v next_o before_o or_o about_o the_o feast_n of_o the_o nativity_n of_o s._n john_n baptist_n next_o in_o the_o county_n where_o the_o say_a parish_n shall_v be_v situate_a and_o so_o from_o time_n to_o time_n quarterly_a within_o ten_o day_n before_o every_o quarter_n session_n and_o that_o every_o such_o high_a constable_n at_o every_o such_o quarter_n session_n in_o such_o county_n shall_v pay_v over_o the_o same_o to_z two_o such_o justice_n of_o peace_n or_o to_o one_o of_o they_o or_o to_o two_o such_o other_o person_n or_o one_o of_o they_o as_o shall_v be_v by_o the_o more_o part_n of_o the_o justice_n of_o peace_n of_o the_o same_o county_n elect_v to_o be_v treasurer_n of_o the_o say_a collection_n the_o same_o other_o person_n to_o be_v elect_v treasurer_n to_o be_v such_o as_o at_o the_o last_o taxation_n of_o the_o subsidy_n next_o before_o the_o same_o election_n shall_v be_v value_v and_o sess_v at_o ten_o pound_n in_o land_n yearly_a or_o at_o fifteen_o pound_n in_o good_n which_o treasurer_n in_o every_o county_n so_o choose_v shall_v continue_v but_o for_o the_o space_n of_o one_o whole_a year_n and_o then_o give_v up_o their_o charge_n with_o a_o due_a account_n of_o their_o receipt_n and_o disbursement_n at_o their_o meeting_n in_o easter_n quarter_n session_n or_o within_o ten_o day_n after_o to_o such_o other_o as_o shall_v from_o year_n to_o year_n in_o the_o form_n aforesaid_a successive_o be_v elect_v and_o if_o any_o churchwarden_n payment_n petty_a constable_n or_o high_a constable_n or_o his_o executor_n or_o administrator_n shall_v fail_v to_o make_v payment_n in_o form_n above_o specify_v then_o every_o churchwarden_n and_o petty_a constable_n his_o executor_n or_o administrator_n so_o offend_v shall_v forfeit_v the_o sum_n of_o twenty_o shilling_n and_o every_o high_a constable_n his_o executor_n or_o administrator_n the_o sum_n of_o forty_o shilling_n to_o be_v levy_v by_o the_o treasurer_n aforesaid_a by_o distress_n and_o sale_n in_o manner_n before_o express_v and_o to_o be_v take_v by_o the_o say_a treasurer_n in_o augmentation_n of_o their_o stock_n to_o the_o use_v aforesaid_a and_o if_o any_o treasurer_n charge_n his_o executor_n or_o administrator_n shall_v fail_v to_o give_v up_o his_o account_n within_o the_o time_n aforesaid_a or_o shall_v be_v otherwise_o negligent_a in_o the_o execution_n of_o his_o charge_n than_o it_o shall_v be_v lawful_a for_o the_o more_o part_n of_o the_o justice_n of_o peace_n of_o the_o same_o county_n in_o their_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o every_o soldier_n or_o mariner_n have_v have_v his_o or_o their_o limb_n lose_v or_o disable_v in_o their_o body_n by_o service_n be_v in_o her_o majesty_n pay_n as_o above_o be_v mention_v or_o such_o as_o shall_v hereafter_o return_v into_o this_o realm_n hurt_n or_o maim_v or_o grievous_o sick_a shall_v repair_v if_o he_o be_v able_a to_o travel_v and_o make_v his_o complaint_n to_o the_o treasurer_n of_o the_o county_n out_o of_o which_o he_o be_v press_v or_o if_o he_o be_v no_o press_a man_n to_o the_o treasurer_n of_o the_o county_n where_o he_o be_v bear_v or_o last_o inhabit_v by_o the_o space_n of_o three_o year_n at_o his_o election_n and_o if_o he_o be_v not_o able_a to_o travel_v to_o the_o treasurer_n of_o the_o county_n where_o he_o shall_v land_v or_o arrive_v and_o shall_v bring_v a_o certificate_n unto_o any_o of_o the_o treasurer_n aforesaid_a certificate_n under_o the_o hand_n and_o seal_v of_o the_o general_n of_o the_o camp_n or_o governor_n of_o the_o town_n wherein_o he_o serve_v and_o of_o the_o captain_n of_o the_o band_n under_o who_o he_o serve_v or_o his_o lieutenant_n or_o in_o the_o absence_n of_o the_o say_a general_n or_o governor_n from_o the_o marshal_n or_o deputy_n of_o the_o governor_n or_o from_o any_o admiral_n of_o her_o majesty_n fleet_n or_o in_o his_o absence_n from_o any_o other_o general_n of_o her_o majesty_n ship_n at_o the_o sea_n or_o in_o absence_n of_o such_o general_n from_o the_o captain_n of_o the_o ship_n wherein_o the_o say_v mariner_n or_o soldier_n do_v serve_v the_o queen_n majesty_n contain_v the_o particular_n by_o his_o hurt_n and_o service_n certificate_n which_o certificate_n shall_v be_v also_o allow_v of_o the_o general_a muster_n master_n for_o the_o time_n be_v resident_a here_o within_o this_o realm_n or_o receiver_n general_a of_o the_o muster_n roll_n the_o treasurer_n and_o controller_n of_o her_o majesty_n navy_n under_o his_o hand_n for_o the_o avoid_n of_o all_o fraud_n and_o counterfeit_v then_o upon_o such_o certificate_n soldier_n such_o treasurer_n as_o be_v before_o express_v shall_v according_a say_a war_n exceed_v not_o the_o sum_n in_o gross_a nor_o yearly_a pension_n of_o ten_o pound_n nor_o to_o any_o that_o have_v bear_v office_n under_o the_o degree_n of_o a_o lieutenant_n the_o sum_n or_o town_n corporate_a where_o the_o same_o pension_n shall_v be_v grant_v relief_n and_o whereas_o it_o must_v needs_o fall_v out_o that_o many_o of_o such_o hurt_n and_o maim_a soldier_n and_o mariner_n do_v arrive_v in_o port_n and_o place_n far_o remote_a from_o the_o county_n whence_o they_o be_v by_o virtue_n of_o this_o act_n to_o receive_v their_o yearly_a annuity_n and_o pension_n as_o also_o they_o be_v prescribe_v by_o this_o act_n to_o obtain_v the_o allowance_n of_o their_o certificate_n from_o the_o muster_n master_n
or_o receiver_n general_n of_o the_o muster_n roll_n who_o common_o be_v like_a to_o abide_v about_o the_o court_n or_o london_n so_o as_o they_o shall_v need_v at_o the_o first_o provision_n for_o the_o bear_n of_o their_o charge_n to_o such_o place_n be_v it_o therefore_o enact_v that_o it_o may_v be_v lawful_a for_o the_o treasurer_n of_o the_o county_n where_o they_o shall_v arrive_v in_o their_o discretion_n upon_o their_o certificate_n though_o not_o allow_v to_o give_v they_o any_o convenient_a relief_n for_o their_o journey_n to_o carry_v they_o to_o the_o next_o county_n with_o a_o testimonial_a of_o their_o allowance_n to_o pass_v on_o towards_o such_o a_o place_n and_o in_o like_a manner_n shall_v it_o be_v lawful_a for_o the_o treasurer_n of_o the_o next_o county_n to_o do_v the_o like_a and_o so_o from_o county_n to_o county_n in_o the_o direct_a way_n till_o they_o come_v to_o the_o place_n where_o they_o be_v direct_v to_o find_v their_o maintenance_n according_a to_o the_o tenure_n of_o this_o statute_n and_o for_o the_o better_a execution_n of_o this_o act_n in_o all_o the_o branch_n thereof_o be_v it_o enact_v that_o every_o the_o treasurer_n in_o their_o several_a county_n register_n shall_v keep_v a_o true_a book_n of_o computation_n of_o all_o such_o sum_n as_o they_o levy_v and_o also_o a_o register_n of_o the_o name_n of_o every_o such_o person_n unto_o who_o they_o shall_v have_v disburse_v any_o relief_n and_o shall_v also_o preserve_v or_o enter_v every_o certificate_n by_o warrant_n whereof_o such_o relief_n have_v be_v by_o they_o disburse_v and_o also_o that_o the_o muster_n master_n or_o receiver_n general_a of_o the_o muster_n roll_n shall_v keep_v a_o book_n wherein_o shall_v be_v enter_v the_o name_n of_o all_o such_o every_o soldier_n or_o mariner_n that_o shall_v be_v take_v beg_v in_o any_o place_n within_o this_o realm_n after_o the_o feast_n of_o easter_n next_o or_o any_o that_o shall_v counterfeit_v any_o certificate_n in_o this_o act_n express_v shall_v for_o ever_o lose_v his_o annuity_n or_o pension_n and_o shall_v be_v take_v deem_v and_o adjudge_v as_o a_o common_a rogue_n or_o vagabond_n person_n and_o shall_v have_v and_o sustain_v the_o same_o and_o the_o like_a pain_n imprisonment_n and_o punishment_n as_o be_v appoint_v and_o provide_v for_o common_a rogue_n and_o vagabond_n person_n provide_v always_o and_o be_v it_o enact_v that_o all_o the_o surplusage_n of_o money_n which_o shall_v be_v remain_v in_o the_o stock_n of_o any_o county_n stock_n shall_v by_o â—he_n discretion_n of_o the_o more_o part_n of_o the_o justice_n of_o peace_n in_o their_o quarter_n session_n be_v order_v distribute_v and_o bestow_v upon_o such_o good_a and_o charitable_a use_n and_o in_o such_o that_o the_o justice_n of_o peace_n within_o any_o county_n of_o this_o realm_n or_o wales_n town_n shall_v not_o intromit_v or_o enter_v into_o any_o city_n borough_n place_n or_o town_n corporate_a where_o be_v any_o justice_n of_o peace_n for_o any_o such_o city_n borough_n place_n or_o town_n corporate_a for_o the_o execution_n of_o any_o article_n of_o this_o act_n but_o that_o it_o shall_v be_v lawful_a to_o the_o justice_n and_o justice_n of_o the_o peace_n major_n bailiff_n and_o other_o head_n officer_n of_o those_o city_n borough_n place_n &_o town_n corporate_a where_o there_o be_v any_o justice_n of_o peace_n to_o proceed_v to_o the_o execution_n of_o this_o act_n within_o the_o precinct_n and_o compass_n of_o their_o liberty_n in_o such_o manner_n as_o the_o justice_n of_o peace_n in_o any_o county_n may_v do_v by_o virtue_n of_o this_o act._n and_o that_o every_o justice_n of_o peace_n within_o every_o such_o city_n borough_n place_n or_o town_n corporate_a for_o every_o offence_n by_o he_o commit_v contrary_a to_o the_o meaning_n of_o this_o statute_n shall_v be_v fineable_a as_o other_o justice_n of_o peace_n at_o the_o large_a in_o the_o county_n be_v in_o this_o act_n appoint_v to_o be_v and_o that_o the_o mayor_n and_o justice_n of_o peace_n in_o every_o such_o borough_n place_n and_o town_n corporate_a shall_v have_v authority_n by_o this_o present_a act_n to_o appoint_v any_o person_n for_o the_o receive_n of_o the_o say_a money_n and_o pay_v the_o same_o within_o such_o city_n borough_n place_n or_o town_n corporate_a which_o person_n so_o appoint_v shall_v have_v authority_n to_o do_v all_o such_o thing_n and_o be_v subject_a to_o all_o such_o penalty_n as_o high_a constable_n by_o virtue_n of_o this_o act_n shall_v have_v or_o be_v employ_v and_o be_v it_o enact_v that_o all_o forfeiture_n to_o be_v forfeit_v by_o any_o treasurer_n collector_n constable_n churchwarden_n or_o other_o person_n for_o any_o cause_n mention_v in_o this_o act_n shall_v be_v employ_v to_o the_o relief_n of_o such_o soldier_n and_o mariner_n as_o be_v by_o this_o act_n appoint_v to_o take_v and_o have_v relief_n and_o after_o that_o relief_n satisfy_v than_o the_o overplus_n thereof_o with_o the_o overplus_n of_o the_o stock_n remain_v in_o any_o the_o say_v treasurer_n hand_n shall_v be_v employ_v as_o be_v before_o mention_v to_o the_o charitable_a use_n express_v in_o the_o say_a statute_n concern_v the_o relief_n of_o poor_a and_o for_o punishment_n of_o rogue_n and_o beggar_n except_o the_o say_a justice_n or_o the_o more_o and_o mariner_n out_o of_o the_o county_n or_o place_n where_o they_o be_v press_v so_o far_o forth_o as_o the_o taxation_n limit_v by_o this_o act_n will_v extend_v and_o if_o the_o whole_a taxation_n there_o shall_v be_v before_o employ_v according_a to_o the_o meaning_n of_o this_o act_n or_o that_o they_o shall_v not_o be_v press_v man_n than_o out_o of_o the_o place_n where_o they_o be_v bear_v or_o last_v inhabit_v by_o the_o space_n of_o three_o year_n at_o his_o or_o their_o election_n provide_v always_o and_o be_v it_o enact_v repeal_v that_o every_o pension_n assign_v heretofore_o to_o any_o soldier_n or_o mariner_n or_o that_o shall_v be_v assignen_n before_o the_o say_a feast_n of_o easter_n next_o notwithstanding_o the_o discontinuance_n of_o the_o say_v two_o former_a act_n shall_v stand_v in_o force_n and_o shall_v yearly_o from_o and_o after_o the_o say_a feast_n of_o easter_n next_o be_v satisfy_v and_o pay_v out_o of_o such_o taxation_n and_o forfeiture_n as_o shall_v be_v make_v collect_v and_o levy_v by_o force_n of_o this_o act_n so_o long_o as_o the_o say_a pension_n shall_v remain_v in_o force_n without_o such_o revocation_n or_o diminish_n as_o be_v before_o in_o this_o act_n mention_v which_o clause_n of_o revocation_n or_o diminish_v before_o mention_v shall_v extend_v aswell_o to_o pension_n heretofore_o assign_v as_o to_o such_o as_o at_o any_o time_n hereafter_o before_o or_o after_o the_o say_a feast_n of_o easter_n shall_v be_v assign_v to_o any_o person_n or_o person_n and_o be_v it_o also_o enact_v levy_v that_o all_o arrearage_n of_o taxation_n heretofore_o make_v by_o virtue_n of_o the_o say_v former_a statute_n or_o any_o of_o they_o which_o shall_v be_v or_o remain_v at_o the_o say_a feast_n of_o easter_n use_v express_v in_o this_o act_n and_o no_o otherwise_o london_n provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o say_a rate_n shall_v be_v think_v not_o to_o be_v sufficient_a for_o the_o relief_n of_o such_o soldier_n and_o mariner_n as_o shall_v be_v to_o be_v relieve_v within_o the_o city_n of_o london_n that_o then_o it_o shall_v be_v lawful_a for_o the_o mayor_n recorder_n &_o alderman_n of_o london_n or_o the_o more_o part_n of_o they_o to_o rate_n and_o tax_v such_o reasonable_a tax_n sum_n and_o sum_n of_o money_n for_o the_o say_a relief_n as_o shall_v be_v to_o they_o think_v fit_a and_o convenient_a so_o as_o such_o sum_n and_o sum_n of_o money_n so_o to_o be_v rate_v do_v not_o exceed_v three_o shilling_n weekly_o correction_n and_o stock_n and_o store_n thereof_o or_o relief_n of_o the_o poor_a where_o the_o offence_n shall_v be_v commit_v at_o the_o discretion_n of_o the_o justice_n of_o the_o peace_n of_o the_o same_o limit_n city_n borough_n or_o town_n corporate_a and_o that_o all_o fine_n and_o forfeiture_n appoint_v or_o to_o grow_v by_o conviction_n of_o any_o person_n according_a to_o this_o levy_v such_o money_n and_o thing_n as_o they_o shall_v find_v not_o to_o have_v be_v due_o employ_v upon_o the_o say_a house_n of_o correction_n or_o stock_n or_o upon_o other_o like_a use_n have_v in_o such_o other_o like_o use_n respect_v of_o thing_n pass_v by_o the_o say_a commissioner_n to_o be_v allow_v of_o either_o by_o distress_n &_o sale_n of_o the_o good_n and_o chattel_n of_o such_o person_n as_o they_o shall_v think_v fit_a to_o be_v chargeable_a or_o answerable_a for_o the_o same_o or_o by_o imprisonment_n of_o their_o body_n at_o their_o discretion_n and_o that_o the_o say_v shall_v be_v agree_v and_o appoint_v this_o act_n to_o endure_v to_o the_o end_n of_o the_o first_o session_n of_o the_o next_o parliament_n â§_o certain_a branch_n of_o the_o statute_n make_v in_o the_o first_o year_n of_o the_o reign_n of_o king_n james_n concern_v rogue_n vagabond_n and_o sturdy_a beggar_n forasmuch_o as_o since_o the_o
of_o peace_n of_o the_o county_n of_o or_o near_o to_o the_o say_a city_n borough_n town_n corporate_a or_o privilege_a place_n so_o infect_v or_o any_o two_o of_o they_o to_o be_v make_v the_o say_a justice_n of_o or_o near_o the_o say_a county_n or_o any_o two_o of_o they_o shall_v or_o may_v tax_v and_o assess_v the_o inhabitant_n of_o the_o county_n within_o five_o mile_n of_o the_o say_a place_n infect_v at_o such_o reasonable_a and_o weekly_a tax_n and_o rate_n as_o they_o shall_v think_v fit_a to_o be_v levy_v by_o warrant_n from_o any_o such_o two_o justice_n of_o peace_n of_o or_o near_o the_o county_n by_o sale_n of_o good_n and_o in_o default_n thereof_o by_o imprisonment_n of_o the_o body_n of_o the_o party_n tax_v as_o aforesaid_a and_o if_o any_o such_o infection_n shall_v be_v in_o any_o borough_n town_n corporate_a or_o privilege_v place_n where_o there_o be_v or_o shall_v be_v no_o justice_n of_o peace_n or_o in_o any_o village_n or_o hamlet_n within_o any_o county_n that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o peace_n of_o the_o say_a county_n wherein_o the_o saâ—d_a place_n infect_v be_v or_o shall_v be_v to_o tax_n and_o assess_v the_o inhabitant_n of_o the_o say_a county_n within_o five_o mile_n of_o the_o say_a place_n infect_v at_o such_o reasonable_a weekly_a tax_n and_o rate_n as_o they_o shall_v think_v fit_a for_o the_o reasonable_a relief_n of_o the_o say_a place_n infect_v to_o be_v levy_v by_o warrant_n from_o the_o say_a justice_n of_o peace_n of_o the_o same_o county_n by_o sale_n of_o good_n and_o in_o default_n thereof_o by_o imprisonment_n of_o the_o body_n of_o every_o party_n so_o tax_v as_o aforesaid_a the_o same_o tax_n make_v by_o the_o say_a justice_n of_o peace_n of_o the_o county_n for_o the_o relief_n of_o such_o city_n borough_n town_n corporate_a &_o place_n privilege_v where_o there_o be_v no_o justice_n of_o peace_n to_o be_v dispose_v as_o they_o shall_v think_v fit_a and_o where_o there_o be_v justice_n of_o peace_n then_o in_o such_o sort_n as_o to_o the_o mayor_n bailiff_n head_n officer_n &_o justice_n of_o peace_n there_o or_o any_o two_o of_o they_o shall_v seem_v fit_a and_o convenient_a all_o which_o tax_n and_o rate_v make_v within_o any_o such_o city_n borough_n town_n corporate_a or_o place_n privilege_v shall_v be_v certify_v at_o the_o next_o quarter_n session_n to_o be_v hold_v within_o the_o same_o city_n borough_n town_n corporate_a or_o place_n privilege_v and_o the_o say_a tax_n and_o rate_n make_v within_o any_o part_n of_o the_o say_a county_n shall_v in_o like_a sort_n be_v certify_v at_o the_o next_o quarter_n session_n to_o be_v hold_v in_o and_o for_o the_o say_a county_n and_o that_o if_o the_o justice_n of_o peace_n at_o such_o quarter_n session_n respective_o or_o the_o more_o part_n of_o they_o shall_v think_v it_o fit_v the_o say_a tax_n or_o rate_n shall_v continue_v or_o be_v enlarge_v or_o extend_v to_o any_o other_o part_n of_o the_o county_n or_o otherwise_o determine_v than_o the_o same_o to_o be_v so_o enlarge_v extend_v or_o determine_v increase_v or_o tax_v and_o levy_v in_o manner_n and_o form_n aforesaid_a as_o to_o the_o say_a justice_n at_o the_o quarter_n session_n respective_o shall_v be_v think_v fit_a and_o convenient_a and_o every_o constable_n and_o other_o officer_n that_o shall_v wilful_o make_v default_n in_o levy_v such_o money_n as_o they_o shall_v be_v command_v by_o the_o say_a warrant_n or_o warrant_n shall_v forfeit_v for_o every_o such_o offence_n ten_o shilling_n to_o be_v employ_v on_o the_o charitable_a use_n aforesaid_a and_o be_v it_o further_o enact_v disobey_v that_o if_o any_o person_n or_o person_n infect_v or_o be_v or_o dwell_v in_o any_o house_n inject_v shall_v be_v by_o the_o mayor_n bailiff_n constable_n or_o other_o head_n officer_n of_o any_o city_n borough_n town_n corporate_a privilege_a place_n or_o market_n town_n or_o by_o any_o justice_n of_o peace_n constable_n headborough_z or_o other_o officer_n of_o the_o county_n if_o any_o such_o infection_n be_v out_o of_o any_o city_n borough_n town_n corporate_a privilege_a place_n or_o market_n town_n command_v or_o appoint_v as_o aforesaid_a to_o keep_v his_o or_o their_o house_n for_o avoid_v of_o further_a infection_n and_o shall_v notwithstanding_o wilful_o and_o contemptuous_o disobey_v such_o direction_n and_o appointment_n offer_v &_o attempt_v to_o break_v and_o go_v abroad_o and_o to_o resist_v or_o go_v abroad_o and_o resist_v such_o keeper_n or_o watchman_n as_o shall_v be_v appoint_v as_o aforesaid_a to_o see_v they_o keep_v in_o that_o then_o it_o shall_v be_v lawful_a for_o such_o watchman_n with_o violence_n to_o enforce_v they_o to_o keep_v their_o house_n and_o if_o any_o hurt_n come_v by_o such_o enforcement_n to_o such_o disobedient_a person_n that_o then_o the_o say_a keeper_n watchman_n and_o any_o other_o their_o assistant_n shall_v not_o be_v impeach_v therefore_o felon_n and_o if_o any_o infect_a person_n as_o aforesaid_a so_o command_v to_o keep_v house_n shall_v contrary_v to_o such_o commandment_n wilful_o and_o contemptuous_o go_v abroad_o and_o shall_v converse_v in_o company_n have_v any_o infectious_a sore_a upon_o he_o uncured_a that_o then_o such_o person_n and_o person_n shall_v be_v take_v deem_v and_o adjudge_v as_o a_o felon_n and_o to_o suffer_v pain_n of_o death_n as_o in_o case_n of_o felony_n but_o if_o such_o person_n shall_v not_o have_v any_o such_o sore_o find_v about_o he_o then_o for_o his_o say_a offence_n to_o be_v punish_v as_o a_o vagabond_n in_o all_o respect_n shall_v or_o aught_o to_o be_v by_o the_o statute_n make_v in_o the_o nine_o and_o thirty_o year_n of_o the_o reign_n of_o our_o late_a sovereign_n lady_n queen_n elizabeth_n for_o the_o punishment_n of_o rogue_n and_o vagabond_n and_o further_o to_o be_v bind_v to_o he_o or_o their_o good_a behaviour_n for_o one_o whole_a year_n provide_v that_o no_o attainder_n of_o felony_n by_o virtue_n of_o this_o act_n shall_v extend_v to_o any_o attainder_n or_o corruption_n of_o blood_n or_o forfeiture_n of_o any_o good_n chattel_n land_n tenement_n or_o hereditament_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v be_v lawful_a for_o justice_n of_o peace_n mayor_n bailiff_n and_o other_o head_n officer_n aforesaid_a to_o appoint_v within_o the_o several_a limit_n searcher_n infect_a watchman_n examiner_n keeper_n and_o burier_n for_o the_o person_n and_o place_n respective_o infect_v as_o aforesaid_a and_o to_o minister_v unto_o they_o oath_n for_o the_o performance_n of_o their_o office_n of_o searcher_n examiner_n watchman_n keeper_n and_o buryer_n and_o give_v they_o other_o direction_n as_o unto_o they_o for_o the_o present_a necessity_n shall_v seem_v good_a in_o their_o discretion_n and_o this_o act_n to_o continue_v no_o long_o then_o within_o either_o the_o university_n of_o cambridge_n or_o oxford_n or_o within_o any_o cathedral_n church_n winchester_n or_o the_o liberty_n or_o precinct_n thereof_o in_o this_o realm_n of_o england_n or_o within_o the_o college_n of_o eton_n or_o winchester_n but_o that_o the_o vicechancellor_n of_o either_o of_o the_o university_n for_o the_o time_n be_v within_z either_o of_o the_o same_o respective_o and_o the_o bishop_n and_o deane_n of_o every_o such_o cathedral_n church_n or_o one_o of_o they_o within_o such_o cathedral_n church_n and_o the_o provost_n or_o warden_n of_o either_o of_o the_o say_a college_n within_o the_o same_o shall_v have_v all_o such_o power_n and_o authority_n and_o shall_v do_v and_o execute_v all_o &_o every_o such_o act_n and_o act_n thing_n and_o thing_n in_o this_o act_n before_o mention_v within_o their_o several_a precinct_n and_o jurisdiction_n abovesayd_a as_o whole_o absolute_o and_o full_o to_o all_o intent_n and_o purpose_n as_o any_o mayor_n bailiff_n head_n officer_n or_o justice_n of_o peace_n within_o their_o several_a precinct_n and_o jurisdiction_n may_v elsewhere_o by_o force_n of_o this_o act_n do_v and_o execute_v ¶_o order_v thought_n meet_v by_o his_o majesty_n and_o his_o privy_a counsel_n to_o be_v execute_v throughout_o the_o county_n of_o this_o realm_n in_o such_o town_n village_n and_o other_o place_n as_o be_v or_o may_v be_v hereafter_o infect_v with_o the_o plague_n for_o the_o stay_n of_o further_a increase_n of_o the_o same_o also_o a_o advise_v set_v down_o by_o the_o best_a learned_a
say_a village_n stand_v or_o to_o the_o common_a gaol_n of_o that_o county_n or_o place_n there_o to_o remain_v and_o be_v employ_v in_o work_n until_o he_o or_o she_o shall_v be_v place_v in_o some_o service_n and_o so_o to_o continue_v by_o the_o space_n of_o one_o year_n or_o not_o be_v able_a of_o body_n until_o he_o or_o she_o shall_v be_v place_v to_o remain_v in_o some_o almeshouse_n in_o or_o from_o the_o isle_n of_o man_n into_o this_o realm_n of_o england_n do_v witting_o or_o willing_o bring_v or_o convey_v or_o suffer_v to_o be_v bring_v or_o convey_v in_o any_o vessel_n or_o boat_n from_o and_o out_o of_o the_o say_a realm_n of_o ireland_n scotland_n or_o isle_n of_o man_n into_o the_o realm_n of_o england_n or_o wales_n or_o any_o part_n thereof_o any_o vagabond_n rogue_n or_o beggar_n or_o any_o such_o as_o shall_v be_v force_v or_o very_o like_a to_o live_v by_o beg_v within_o the_o realm_n of_o england_n or_o wales_n be_v bear_v in_o the_o same_o realm_n how_o many_o of_o the_o same_o place_n so_o infect_v be_v corporate_a town_n market_n town_n and_o village_n and_o shall_v consider_v of_o what_o wealth_n the_o inhabitant_n of_o the_o same_o town_n and_o parish_n be_v to_o be_v able_a to_o relieve_v the_o poor_a that_o be_v or_o shall_v be_v infect_v and_o to_o be_v restrain_v in_o their_o house_n 3_o item_n thereupon_o after_o conference_n use_v according_a to_o the_o necessity_n of_o the_o cause_n they_o shall_v devise_v and_o make_v a_o general_a taxation_n either_o by_o charge_v the_o town_n infect_v with_o one_o sum_n in_o gross_a or_o by_o charge_v the_o special_a person_n of_o wealth_n within_o the_o same_o to_o be_v forthwith_o collect_v for_o the_o rate_n of_o one_o month_n at_o the_o first_o and_o so_o if_o the_o
