a_o act_n prohibit_v to_o brew_n for_o sale_n any_o ale_n or_o beer_n above_o ten_o shilling_n the_o barrel_n beside_o the_o excise_n be_v it_o enact_v by_o this_o present_a parliament_n and_o by_o authority_n thereof_o that_o no_o brewer_n or_o other_o person_n that_o brew_v to_o put_v to_o sale_n shall_v after_o the_o first_o day_n of_o october_n one_o thousand_o six_o hundred_o forty_o nine_o brew_v to_o sell_v direct_o or_o indirect_o any_o beer_n or_o ale_n or_o other_o drink_n wherein_o malt_n shall_v be_v use_v any_o barrel_n of_o beer_n ale_n or_o other_o drink_n as_o aforesaid_a or_o great_a or_o lesser_a quantity_n proportionable_o above_o the_o rate_n of_o ten_o shilling_n the_o barrel_n over_o and_o above_o the_o excize_n payable_a account_v thirty_o six_o gallon_n to_o the_o barrel_n for_o beer_n and_o thirty_o two_o gallon_n for_o ale_n upon_o the_o pain_n and_o forfeiture_n for_o every_o barrel_n the_o sum_n of_o five_o pound_n and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n be_v thereof_o convict_v by_o the_o oath_n of_o two_o witness_n before_o any_o one_o justice_n of_o the_o peace_n which_o oath_n the_o say_a justice_n have_v hereby_o power_n to_o administer_v and_o to_o grant_v warrant_n for_o distress_n and_o sale_n of_o good_n as_o aforesaid_a and_o in_o default_n of_o sufficient_a distress_n than_o the_o say_a justice_n shall_v send_v such_o person_n to_o the_o goal_n there_o to_o remain_v for_o the_o space_n of_o three_o month_n without_o bail_n or_o mainprise_v and_o if_o such_o person_n shall_v offend_v the_o second_o time_n and_o be_v thereof_o convict_v as_o aforesaid_a then_o such_o justice_n of_o the_o peace_n shall_v cause_v such_o offender_n to_o be_v send_v to_o the_o house_n of_o correction_n and_o there_o to_o get_v he_o or_o her_o livelihood_n by_o labour_n for_o the_o space_n of_o six_o month_n without_o he_o or_o she_o shall_v pay_v down_o ten_o pound_n for_o every_o barrel_n or_o other_o great_a or_o lesser_a quantity_n so_o brew_v and_o sell_v over_o and_o above_o the_o price_n or_o rate_n of_o ten_o shilling_n as_o aforesaid_a the_o one_o moiety_n of_o which_o several_a fine_n the_o say_a justice_n shall_v give_v to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v and_o the_o other_o moiety_n to_o the_o party_n that_o shall_v make_v discovery_n and_o prosecute_v the_o same_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a justice_n to_o examine_v upon_o oath_n any_o victualler_n seller_n or_o retailer_n of_o beer_n ale_n or_o drink_n as_o aforesaid_a or_o other_o person_n whatsoever_o other_o than_o the_o say_a brewer_n himself_o what_o price_n or_o price_n direct_o or_o indirect_o have_v be_v make_v or_o other_o indirect_a practice_n have_v be_v use_v with_o or_o by_o the_o say_a brewer_n or_o other_o person_n to_o delude_v this_o act_n and_o the_o good_a intend_v thereby_o to_o the_o end_n the_o say_a brewer_n or_o other_o person_n may_v be_v bring_v to_o condign_a punishment_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o brewer_n of_o ale_n or_o beer_n to_o sell_v ale_n or_o beer_n at_o ten_o shilling_n the_o barrel_n over_o and_o above_o the_o excise_n and_o so_o proportionable_o a_o great_a or_o lesser_a quantity_n any_o law_n statute_n or_o usage_n to_o the_o contrary_a in_o any_o wise_a notwithstanding_o provide_v always_o that_o this_o act_n be_v in_o full_a force_n for_o the_o space_n of_o one_o whole_a year_n from_o and_o after_o the_o first_o day_n of_o october_n one_o thousand_o six_o hundred_o forty_o nine_o and_o no_o long_o die_fw-la mercurii_fw-la 12_o septembr_n 1649._o order_a by_o the_o commons_o assemble_v in_o parliament_n that_o this_o act_n be_v forthwith_o print_v and_o publish_v hen_n scobell_n cleric_n parliamenti_fw-la london_n print_v for_o edward_n husband_n printer_n to_o the_o parliament_n of_o england_n 1649._o
