perfect_a conviction_n of_o every_o such_o offender_n for_o such_o offence_n and_o thereupon_o the_o say_a justice_n justice_n and_o chief_a magistrate_n respective_o shall_v impose_v on_o every_o such_o offender_n so_o convict_v as_o aforesaid_a a_o fine_a of_o five_o shilling_n for_o such_o first_o offence_n which_o record_n and_o conviction_n shall_v be_v certify_v by_o the_o say_a justice_n justice_n or_o chief_a magistrate_n at_o the_o next_o quarter_n session_n of_o the_o peace_n for_o the_o county_n or_o place_n where_o the_o offence_n be_v commit_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n or_o offence_n contrary_a to_o this_o act_n and_o be_v thereof_o in_o manner_n aforesaid_a convict_v then_o such_o offender_n so_o convict_v of_o such_o like_a offence_n or_o offence_n shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o ten_o shilling_n which_o fine_a and_o fine_n for_o the_o first_o and_o every_o other_o offence_n shall_v be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n and_o chattel_n or_o in_o case_n of_o the_o poverty_n of_o such_o offender_n upon_o the_o good_n and_o chattel_n of_o any_o other_o person_n or_o person_n who_o shall_v be_v then_o convict_v in_o manner_n aforesaid_a of_o the_o like_a offence_n at_o the_o same_o conventicle_n at_o the_o discretion_n of_o the_o say_a justice_n justice_n or_o chief_a magistrate_n respective_o so_o as_o the_o sum_n to_o be_v levy_v on_o any_o one_o person_n in_o case_n of_o the_o poverty_n of_o other_o offender_n amount_v not_o in_o the_o whole_a to_o above_o the_o sum_n of_o ten_o pound_n upon_o occasion_n of_o any_o one_o meet_v as_o aforesaid_a and_o every_o constable_n head-borough_n tythingman_n churchwarden_n and_o overseer_n of_o the_o poor_a respective_o be_v hereby_o authorize_v and_o reavire_v to_o levy_v the_o same_o according_o have_v first_o receive_v a_o warrant_n under_o the_o hand_n of_o the_o sald_a justice_n justice_n or_o thief_n magistrate_n respective_o so_o to_o do_v the_o say_v money_n so_o to_o be_v levy_v to_o be_v forthwith_o deliver_v to_o the_o same_o justice_n justice_n or_o chief_a magistrate_n and_o by_o he_o or_o they_o to_o be_v distribute_v the_o one_o three_o part_n thereof_o to_o the_o use_n of_o the_o king_n majesty_n his_o heir_n and_o successor_n to_o be_v pay_v to_o the_o high_a sherift_n of_o the_o county_n for_o the_o time_n be_v in_o manner_n follow_v that_o be_v to_o say_v the_o justice_n or_o justice_n of_o peace_n shall_v pay_v the_o same_o into_o the_o court_n of_o the_o respective_a quarter_n session_n which_o say_v court_n shall_v deliver_v the_o same_o to_o the_o sheriff_n and_o make_v a_o memorial_n on_o record_n of_o the_o payment_n and_o delivery_n thereof_o which_o say_v memorial_n shall_v be_v a_o sufficient_a and_o final_a discharge_n to_o the_o say_a justice_n and_o justice_n and_o a_o charge_n to_o the_o sheriff_n which_o say_v discharge_v and_o charge_n shall_v be_v certify_v into_o the_o exchequer_n together_o and_o not_o one_o without_o the_o other_o and_o no_o justice_n shall_v or_o may_v be_v question_v or_o accountable_a for_o the_o same_o in_o the_o exchequer_n or_o elsewhere_o than_o in_o quarter_n session_n another_o three_o part_n thereof_o to_o and_o for_o the_o use_n of_o the_o poor_a of_o the_o parish_n where_o such_o offence_n shall_v be_v commit_v and_o the_o other_o three_o part_n thereof_o to_o the_o informer_n and_o informer_n and_o to_o such_o person_n and_o person_n as_o the_o say_a justice_n justice_n or_o chief_a magistrate_n respective_o shall_v appoint_v have_v regard_n to_o their_o diligence_n and_o industry_n in_o the_o discovery_n disperse_v and_o punish_v of_o the_o say_a conventicle_n and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v take_v upon_o he_o to_o preach_v or_o teach_v in_o any_o such_o meeting_n assembly_n or_o conventicle_n and_o shall_v thereof_o be_v convict_v as_o aforesaid_a shall_v forfeit_v for_o every_o such_o first_o offence_n the_o sum_n of_o twenty_o pound_n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o good_n and_o chattel_n and_o if_o the_o say_a preacher_n or_o teacher_n so_o convict_v be_v a_o stranger_n and_o his_o name_n and_o habitation_n not_o know_v or_o be_v flee_v add_v can_v be_v find_v or_o in_o the_o judgement_n of_o the_o justice_n justice_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v shall_v be_v think_v unable_a to_o pay_v the_o same_o the_o say_a justice_n justice_n or_o chief_a magistrate_n respective_o be_v hereby_o impower_v and_o require_v to_o levy_v the_o same_o by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o any_o such_o person_n who_o shall_v be_v present_a at_o the_o same_o conventicle_n any_o thing_n in_o this_o or_o any_o other_o act_n law_n or_o statute_n to_o the_o contrary_a notwithstanding_o and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a and_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n or_o offence_n contrary_a to_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a than_o such_o offender_n so_o convict_v of_o such_o like_a offence_n or_o offence_n shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o forty_o pound_n to_o be_v levy_v and_o dispose_v as_o aforesaid_a and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n meet_v or_o unlawful_a assembly_n aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n yard_n or_o backside_n and_o be_v convict_v thereof_o in_o manner_n aforesaid_a shall_v forfeit_v the_o sum_n of_o twenty_o pound_n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o or_o her_o good_n and_o chattel_n or_o in_o case_n of_o he_o or_o her_o poverty_n or_o inability_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o such_o person_n who_o shall_v be_v convict_v in_o manner_n aforesaid_a of_o be_v present_a at_o the_o same_o conventicle_n and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n shall_v by_o any_o clause_n of_o this_o act_n be_v liable_a to_o pay_v above_o ten_o pound_n for_o any_o one_o meeting_n in_o regard_n of_o the_o poverty_n of_o any_o other_o person_n or_o person_n provide_v also_o and_o be_v it_o far_o enact_v that_o in_o all_o case_n of_o this_o act_n where_o the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o ten_o shilling_n and_o such_o offender_n shall_v find_v himself_o aggrieve_v it_o shall_v and_o may_v be_v lawful_a for_o he_o within_o one_o week_n after_o the_o say_a penalty_n or_o maney_n charge_v shall_v be_v pay_v or_o levy_v to_o appeal_v in_o write_v from_o the_o person_n or_o person_n convict_v to_o the_o judgement_n of_o the_o justice_n of_o the_o peace_n in_o their_o next_o quarter_n session_n to_o who_o the_o justice_n or_o justice_n of_o peace_n chief_a magistrate_n or_o alderman_n that_o first_o convict_v such_o offender_n shall_v return_v the_o money_n levy_v upon_o the_o appellant_n and_o shall_v certify_v under_o his_o and_o their_o hand_n and_o seal_n the_o evidence_n upon_o which_o the_o conviction_n pass_v with_o the_o whole_a record_n thereof_o and_o the_o say_a appeal_n whereupon_o such_o offender_n may_v plead_v and_o make_v defence_n and_o have_v his_o trial_n by_o a_o jury_n thereupon_o and_o in_o case_n such_o appellant_n shall_v not_o prosecute_v with_o effect_n or_o if_o upon_o such_o trial_n he_o shall_v not_o be_v acquit_v or_o judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n the_o say_a justice_n at_o the_o session_n shall_v give_v treble_a cost_n against_o such_o offender_n for_o his_o unjust_a appeal_n and_o no_o other_o court_n whatsoever_o shall_v intermeddle_v with_o any_o cause_n or_o cause_n of_o appeal_n upon_o this_o act_n but_o they_o shall_v be_v final_o determine_v in_o the_o quarter_n session_n only_o provide_v always_o and_o be_v it_o far_o enact_v that_o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a the_o person_n or_o person_n appellant_n shall_v enter_v before_o the_o person_n or_o person_n convict_v into_o a_o recognizance_n to_o prosecute_v the_o say_a appeal_n with_o effect_n which_o say_v recognizance_n the_o person_n or_o person_n convict_v be_v hereby_o impower_v to_o take_v and_o require_v to_o certify_v the_o same_o to_o the_o next_o quarter_n session_n and_o in_o case_n no_o such_o recognizance_n be_v enter_v into_o the_o
neglect_n come_v to_o church_n or_o have_v declare_v or_o any_o way_n make_v their_o dislike_n of_o or_o aversion_n from_o the_o liturgy_n or_o doctrine_n of_o the_o church_n of_o england_n this_o be_v in_o any_o opinion_n such_o a_o notorious_a evidence_n and_o circumstance_n of_o the_o fact_n as_o be_v sufficient_a to_o ground_v a_o conviction_n within_o the_o intent_n of_o the_o law_n and_o in_o such_o and_o the_o like_a case_n the_o record_n of_o conviction_n need_v not_o make_v mention_n of_o any_o thing_n more_o but_o that_o the_o offender_n be_v convict_v by_o the_o notorious_a evidence_n and_o circumstance_n of_o the_o fact_n without_o particularise_v the_o fact_n for_o that_o where_o no_o appeal_n lie_v the_o justice_n be_v the_o sole_a judge_n of_o the_o notoriety_n of_o the_o evidence_n and_o circumstance_n and_o where_o a_o appeal_n be_v give_v there_o the_o fact_n must_v be_v try_v over_o again_o and_o so_o the_o offender_n can_v be_v injure_v 14._o to_o make_v a_o record_n of_o every_o such_o offence_n under_o he_o or_o their_o hand_n and_o seal_n respective_o &c_n &c_n for_o the_o form_n of_o such_o record_n see_v hereunder_o and_o note_v that_o the_o subscribe_v the_o justice_n hand_n to_o the_o record_n be_v absolute_o essential_a for_o though_o the_o justice_n set_v to_o his_o seal_n and_o it_o be_v so_o mention_v in_o the_o record_n which_o be_v as_o much_o as_o the_o law_n require_v in_o most_o case_n yet_o this_o act_n require_v the_o record_n to_o be_v as_o well_o under_o his_o hand_n as_o seal_v if_o it_o be_v not_o under_o both_o the_o record_n and_o all_o that_o be_v do_v in_o pursuance_n of_o it_o will_v be_v altogether_o void_a though_o it_o be_v not_o of_o absolute_a necessity_n that_o the_o record_n shall_v mention_v that_o the_o justice_n have_v put_v his_o hand_n and_o seal_n so_o that_o it_o be_v actual_o do_v but_o the_o better_a and_o safe_a way_n be_v to_o mention_v it_o in_o the_o record_n according_a to_o the_o precedent_n 15._o which_o record_n so_o make_v as_o aforesaid_a shall_v to_o all_o intent_n and_o purpose_n be_v in_o law_n take_v and_o adjudge_v to_o be_v a_o full_a and_o perfect_a conviction_n etc._n etc._n so_o as_o the_o party_n convict_v shall_v be_v conclude_v to_o say_v that_o he_o be_v not_o guilty_a of_o the_o offence_n contain_v in_o such_o record_n he_o be_v so_o convict_a 16._o and_o thereupon_o the_o say_a justice_n etc._n etc._n shall_v impose_v on_o every_o such_o offender_n so_o convict_v as_o aforesaid_a a_o fine_a of_o five_o shilling_n for_o every_o such_o first_o offence_n etc._n etc._n this_o impose_v the_o fine_a must_v be_v in_o the_o same_o record_n of_o conviction_n and_o not_o in_o any_o other_o record_n by_o itself_o and_o it_o be_v not_o safe_a nor_o justifiable_a to_o make_v a_o warrant_n to_o levy_v any_o fine_a but_o what_o be_v contain_v in_o the_o record_n of_o conviction_n 17._o which_o record_n and_o conviction_n shall_v be_v certify_v by_o the_o say_a justice_n at_o the_o next_o quarter_n session_n etc._n etc._n the_o next_o quarter_n sessions_n be_v intend_v next_o after_o the_o conviction_n not_o next_o after_o the_o offence_n commit_v for_o perhaps_o the_o quarter_n session_n next_o after_o the_o offence_n commit_v may_v be_v pass_v before_o the_o offender_n be_v convict_v next_o quarter_n session_n i._n e._n for_o the_o place_n where_o the_o offence_n be_v commit_v and_o the_o conviction_n make_v if_o by_o a_o justice_n of_o the_o peace_n for_o the_o county_n at_o large_a then_o to_o the_o next_o quarter_n session_n hold_v for_o such_o county_n if_o in_o a_o corporation_n or_o other_o liberty_n by_o the_o chief_a magistrate_n or_o justice_n of_o such_o place_n then_o to_o the_o next_o quarter_n session_n for_o such_o place_n if_o the_o conviction_n be_v make_v by_o a_o justice_n of_o the_o peace_n of_o the_o county_n for_o a_o offence_n commit_v in_o a_o liberty_n or_o corporation_n where_o the_o county_n justice_n have_v a_o concurrent_a authority_n than_o the_o same_o must_v be_v certify_v to_o the_o next_o quarter_n session_n of_o the_o county_n note_v by_o the_o statute_n of_o 2_o h._n 5._o cap._n 4._o the_o quarter_n session_n be_v appoint_v to_o be_v hold_v in_o all_o the_o county_n of_o england_n four_o time_n in_o the_o year_n that_o be_v to_o say_v the_o first_o week_n after_o the_o feast_n of_o st._n michael_n and_o the_o first_o week_n after_o the_o epiphany_n and_o in_o the_o first_o week_n after_o the_o close_a or_o end_n of_o easter_n and_o in_o the_o first_o week_n after_o the_o feast_n of_o translation_n of_o st._n thomas_n the_o martyr_n which_o as_o i_o take_v it_o always_o fall_v upon_o the_o seven_o day_n of_o july_n these_o be_v the_o four_o quarter_n session_n but_o the_o same_o statute_n direct_v that_o the_o session_n shall_v be_v hold_v often_o if_o need_n be_v the_o session_n hold_v at_o other_o time_n be_v call_v general_a session_n but_o not_o quarter_v session_n by_o the_o statute_n of_o 14_o of_o hen._n 6._o c._n 4._o the_o justice_n of_o middlesex_n be_v bind_v to_o hold_v quarter_n session_n but_o twice_o in_o the_o year_n but_o they_o may_v as_o they_o do_v hold_v quarter_n session_n at_o the_o four_o time_n of_o the_o year_n abovesaid_a and_o each_o of_o these_o session_n be_v a_o quarter_n session_n and_o session_n hold_v at_o other_o time_n be_v general_a session_n now_o every_o quarter_n sessions_n be_v a_o general_a session_n yet_o every_o general_n sessions_n be_v not_o a_o quarter_n session_n and_o not_o hold_v at_o the_o time_n appoint_v by_o the_o statute_n of_o 2_o hen._n 5._o above_o mention_v sect_n 2._o 1._o that_o of_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n obs_n obs_n etc._n etc._n by_o this_o clause_n these_o two_o point_n be_v to_o be_v observe_v 1._o he_o that_o be_v to_o be_v convict_v and_o to_o incur_v the_o penalty_n of_o 10_o s._n must_v be_v guilty_a of_o such_o offence_n after_o the_o time_n he_o be_v convict_v of_o the_o former_a offence_n and_o not_o only_o after_o the_o time_n he_o commit_v the_o former_a offence_n for_o if_o one_o commit_v two_o or_o more_o offence_n before_o he_o be_v convict_v he_o may_v be_v afterward_o convict_v for_o each_o of_o these_o offence_n but_o he_o shall_v only_o pay_v a_o fine_a of_o five_o shilling_n for_o each_o offence_n and_o not_o 10_o s._n for_o either_o one_o of_o they_o for_o that_o though_o he_o offend_v twice_o or_o often_o yet_o he_o never_o offend_v after_o he_o be_v once_o convict_v 2._o where_o any_o one_o be_v convict_v for_o the_o second_o offence_n whereby_o the_o penalty_n of_o 10_o s._n be_v impose_v on_o he_o the_o record_n of_o such_o conviction_n ought_v to_o mention_v and_o take_v notice_n of_o the_o record_n of_o the_o former_a conviction_n 2._o which_o fine_a and_o fine_n for_o the_o first_o and_o every_o other_o offence_n shall_v be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n and_o chattel_n etc._n etc._n but_o the_o officer_n may_v seize_v ready_a money_n of_o the_o offender_n if_o he_o can_v find_v it_o in_o his_o house_n but_o he_o may_v not_o take_v it_o from_o the_o person_n of_o the_o offender_n and_o by_o the_o word_n chattel_n must_v be_v understand_v personal_a chattel_n which_o may_v be_v distrain_v or_o levy_v as_o well_o as_o sell_v and_o therefore_o a_o lease_n for_o year_n or_o other_o real_a chattel_n can_v be_v sell_v by_o the_o officer_n for_o levy_v any_o penalty_n impose_v by_o virtue_n of_o this_o act._n good_n and_o chattel_n this_o reach_n to_o the_o utensil_n tool_n and_o instrument_n of_o trade_n as_o well_o as_o any_o other_o good_n and_o chattel_n for_o the_o rule_n of_o the_o common_a law_n that_o exempt_v such_o where_o there_o be_v sufficient_a beside_o from_o distress_n extend_v not_o where_o distress_n be_v give_v as_o a_o execution_n by_o any_o particular_a statute_n as_o for_o poors_z rate_n hearth-money_n and_o so_o the_o like_a on_o this_o law_n and_o govern_v only_o in_o distress_n for_o rent_n amerciament_n and_o the_o like_a 3._o or_o in_o case_n of_o the_o poverty_n of_o such_o offender_n etc._n etc._n what_o shall_v be_v say_v in_o a_o case_n of_o poverty_n and_o how_o shall_v it_o be_v determine_v i_o conceive_v the_o justice_n be_v the_o judge_n of_o it_o and_o may_v determine_v it_o at_o the_o time_n of_o the_o conviction_n and_o thereupon_o impose_v the_o fine_a upon_o any_o other_o convict_v of_o the_o same_o offence_n but_o if_o the_o party_n convict_v be_v take_v to_o be_v responsible_a and_o a_o warrant_n be_v make_v to_o levy_v and_o afterward_o the_o constable_n or_o other_o officer_n to_o who_o the_o warrant_n be_v direct_v shall_v afterward_o certify_v the_o justice_n of_o
may_v be_v impose_v upon_o any_o person_n present_a at_o the_o same_o conventicle_n though_o such_o person_n upon_o who_o it_o be_v impose_v be_v not_o convict_v for_o be_v present_a at_o the_o conventicle_n nor_o can_v be_v convict_v for_o be_v present_a as_o a_o alien_a or_o subject_a under_o 16_o year_n of_o age_n and_o the_o different_a pen_n of_o this_o and_o the_o precedent_n paragraph_n seem_v to_o make_v it_o clear_a for_o in_o the_o precedent_n paragraph_n the_o word_n be_v that_o the_o penalty_n there_o mention_v in_o case_n of_o poverty_n of_o such_o offender_n 12_o he_o be_v convict_v for_o be_v present_a at_o a_o conventicle_n shall_v be_v levy_v on_o the_o good_n and_o chattel_n of_o any_o other_o person_n or_o person_n who_o shall_v be_v then_o convict_v in_o manner_n aforesaid_a of_o the_o like_a offence_n at_o the_o same_o conventicle_n so_o the_o penalty_n there_o can_v be_v lay_v upon_o none_o but_o such_o as_o by_o this_o law_n be_v and_o aught_o to_o be_v convict_v for_o be_v present_a at_o the_o same_o conventicle_n but_o a_o alien_a or_o subject_a under_o 16_o year_n can_v be_v convict_v for_o that_o offence_n but_o here_o the_o word_n of_o this_o paragraph_n say_v that_o the_o penalty_n of_o 20_o l._n here_o mention_v may_v be_v levy_v upon_o any_o such_o person_n who_o shall_v be_v present_a at_o the_o same_o conventicle_n whether_o convict_v or_o not_o and_o a_o alien_n may_v be_v present_a at_o a_o conventicle_n though_o he_o can_v be_v convict_v whereby_o to_o forfeit_n 5_o s._n as_o a_o subject_a may_v but_o the_o penalty_n impose_v on_o the_o preacher_n so_o far_o as_o 10_o l._n may_v be_v levy_v upon_o he_o and_o the_o non_fw-la obstante_fw-la in_o this_o paragraph_n do_v seem_v to_o confirm_v this_o construction_n 5._o and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a etc._n etc._n that_o be_v as_o above_o direct_v by_o the_o next_o precedent_n paragraph_n viz._n one_o three_o to_o the_o king_n one_o other_o three_o to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n be_v commit_v and_o the_o other_o three_o to_o the_o informer_n and_o such_o person_n as_o the_o justice_n shall_v appoint_v 6._o and_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n etc._n etc._n the_o commitment_n of_o the_o say_a offence_n must_v be_v after_o the_o conviction_n for_o the_o first_o see_v above_o §_o 2._o obs_n 1._o 7._o shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o forty_o pound_n to_o be_v levy_v and_o dispose_v as_o aforesaid_a this_o penalty_n of_o 40_o l._n may_v be_v levy_v upon_o the_o preacher_n as_o the_o 20_o l._n penalty_n above_o and_o in_o case_n of_o inability_n of_o the_o preacher_n upon_o the_o good_n of_o other_o present_a at_o the_o same_o conventicle_n in_o like_a manner_n as_o the_o penalty_n of_o 20_o l._n might_n sect_n 4._o obs_n 1._o and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n etc._n etc._n these_o word_n house_n though_o without_o any_o title_n make_v it_o to_o be_v his_o or_o her_o house_n within_o the_o intent_n of_o this_o law_n as_o for_o instance_n if_o a_o man_n enter_v upon_o i_o and_o put_v i_o out_o of_o possession_n of_o my_o house_n by_o wrong_n and_o keep_v i_o out_o of_o possession_n and_o in_o that_o time_n suffer_v a_o conventicle_n to_o be_v hold_v in_o the_o same_o house_n now_o he_o that_o have_v sell_v the_o possession_n of_o my_o house_n be_v to_o be_v punish_v for_o suffer_v a_o conventicle_n in_o his_o house_n though_o in_o truth_n the_o title_n of_o the_o house_n be_v i_o 3._o or_o in_o case_n of_o the_o poverty_n etc._n etc._n this_o be_v in_o the_o judgement_n of_o the_o justice_n of_o peace_n convict_v as_o above_o in_o case_n of_o the_o preacher_n but_o the_o penalty_n in_o this_o case_n of_o poverty_n be_v only_o to_o be_v levy_v upon_o such_o as_o shall_v be_v convict_v for_o be_v present_a at_o the_o same_o conventicle_n and_o not_o upon_o alien_n who_o be_v not_o to_o be_v convict_v for_o be_v present_a at_o the_o conventicle_n the_o pen_n of_o this_o clause_n and_o the_o like_a clause_n in_o the_o second_o paragraph_n do_v exact_o agree_v but_o be_v both_o different_a from_o the_o clause_n in_o the_o three_o paragraph_n where_o the_o penalty_n of_o the_o preacher_n in_o case_n of_o his_o poverty_n or_o inability_n be_v to_o be_v levy_v on_o any_o person_n present_a at_o the_o same_o conventicle_n though_o not_o convict_v sect_n 5._o 1._o this_o be_v clear_a yet_o it_o may_v be_v doubt_v whether_o more_o than_o ten_o pound_n may_v not_o be_v impose_v upon_o one_o person_n for_o the_o penalty_n of_o the_o preacher_n where_o his_o name_n or_o habitation_n be_v not_o know_v for_o that_o penalty_n be_v not_o impose_v in_o regard_n of_o the_o poverty_n or_o inability_n of_o the_o preacher_n but_o because_o he_o be_v not_o know_v so_o as_o the_o justice_n may_v judge_v whether_o he_o be_v able_a to_o pay_v the_o penalty_n or_o not_o the_o husband_n and_o wife_n co-habiting_a be_v both_o present_a at_o a_o conventicle_n and_o convict_a whereby_o the_o penalty_n of_o 5._o s._n impose_v upon_o the_o wife_n be_v to_o be_v levy_v on_o the_o husband_n be_v good_n yet_o the_o husband_n may_v be_v charge_v with_o 10_o l._n beside_o for_o and_o in_o regard_n of_o the_o poverty_n of_o another_o for_o the_o wife_n penalty_n of_o 5_o s._n be_v not_o lay_v upon_o the_o husband_n in_o regard_n of_o her_o poverty_n but_o in_o regard_n of_o the_o relation_n between_o they_o where_o there_o be_v a_o penalty_n of_o twenty_o pound_n or_o more_o to_o be_v impose_v in_o respect_n the_o justice_n may_v assess_v what_o sum_n he_o think_v fit_a upon_o each_o party_n liable_a so_o that_o no_o one_o be_v charge_v with_o more_o than_o 10_o l._n in_o regard_n of_o poverty_n etc._n etc._n act._n sect_n 6._o 1._o provide_v also_o and_o be_v it_o far_o enact_v that_o in_o all_o case_n of_o this_o act_n where_o the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o 10_o s._n this_o paragraph_n give_v a_o appeal_n to_o the_o offender_n in_o certain_a case_n whereupon_o these_o thing_n be_v to_o be_v take_v notice_n of_o 1._o the_o person_n that_o may_v appeal_v must_v be_v a_o offender_n charge_v with_o above_o the_o sum_n or_o penalty_n of_o 10_o s._n for_o if_o he_o be_v charge_v with_o the_o sum_n or_o penalty_n of_o 10_o s._n only_o or_o under_o he_o be_v conclude_v by_o the_o conviction_n and_o can_v appear_v a_o constable_n convict_v upon_o the_o 11_o paragraph_n of_o this_o act_n may_v appeal_v 2._o the_o time_n when_o he_o may_v appeal_v and_o that_o must_v be_v within_o one_o week_n after_o the_o penalty_n above_o 10._o s._n be_v levy_v upon_o his_o good_n etc._n etc._n or_o who_o poverty_n etc._n etc._n be_v either_o a_o teacher_n or_o present_v at_o the_o conventicle_n whereby_o the_o justice_n convict_v have_v a_o jurisdiction_n to_o impose_v the_o penalty_n either_o upon_o the_o party_n himself_o or_o upon_o some_o other_o but_o in_o this_o case_n the_o justice_n have_v no_o authority_n at_o all_o to_o impose_v a_o penalty_n either_o upon_o one_o that_o be_v not_o present_a at_o the_o conventicle_n or_o in_o regard_n of_o the_o poverty_n of_o one_o that_o be_v not_o present_a at_o the_o conventicle_n which_o diversity_n be_v apparent_a what_o if_o the_o penalty_n in_o regard_n of_o the_o poverty_n of_o another_o impose_v upon_o the_o appellant_n have_v be_v impose_v upon_o the_o party_n himself_o or_o upon_o any_o other_o and_o have_v be_v actual_o levy_v or_o pay_v in_o this_o case_n i_o think_v the_o appellant_n be_v to_o be_v relieve_v against_o that_o penalty_n and_o though_o he_o be_v not_o total_o acquit_v yet_o he_o ought_v not_o to_o be_v charge_v with_o cost_v or_o judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n etc._n etc._n this_o clause_n seem_v to_o confirm_v the_o opinion_n above_o that_o the_o appellant_n session_n but_o what_o if_o the_o offender_n appeal_v to_o the_o session_n and_o the_o justice_n convict_v certify_v the_o record_n of_o conviction_n the_o evidence_n and_o the_o appeal_n but_o the_o appellant_n do_v not_o appear_v at_o the_o session_n at_o all_o nor_o do_v any_o thing_n in_o prosecution_n of_o his_o appeal_n how_o shall_v the_o prosecutor_n name_v appear_v in_o such_o case_n to_o of_o peace_n convict_v where_o no_o appeal_n lie_v and_o the_o justice_n of_o the_o session_n where_o a_o appeal_n be_v give_v be_v make_v the_o final_a judge_n of_o the_o offence_n of_o be_v present_a at_o a_o conventicle_n and_o of_o any_o person_n be_v take_v upon_o he_o to_o preach_v or_o teach_v in_o a_o conventicle_n or_o wilful_a suffer_v a_o conventicle_n to_o be_v hold_v in_o his_o or_o her_o dwell_a house_n etc._n etc._n and_o of_o a_o constable_n omission_n of_o the_o performance_n of_o his_o duty_n in_o execution_n of_o this_o act_n and_o this_o exclusive_a to_o the_o great_a court_n at_o westminster-hall_n and_o all_o other_o court_n whatsoever_o yet_o if_o a_o certiorari_fw-la or_o write_v of_o error_n issue_n out_o of_o any_o of_o the_o great_a court_n at_o westminster_n hall_n and_o be_v deliver_v either_o to_o the_o justice_n convict_v or_o to_o the_o session_n they_o ought_v not_o to_o proceed_v till_o the_o court_n out_o of_o which_o such_o a_o writ_n issue_v be_v inform_v of_o the_o matter_n and_o shall_v think_v fit_a to_o supersede_n their_o own_o for_o though_o the_o justice_n of_o peace_n and_o the_o session_n be_v make_v the_o final_a judge_n of_o the_o offence_n aforesaid_a yet_o they_o be_v not_o judge_n of_o the_o process_n of_o the_o superior_a court_n but_o only_o the_o superior_a court_n itself_o out_o of_o which_o the_o process_n issue_v sect_n 7._o 1._o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a etc._n etc._n the_o time_n for_o delivery_n of_o the_o appeal_n must_v be_v within_o one_o week_n next_o after_o the_o penalty_n levy_v or_o pay_v and_o at_o the_o time_n of_o the_o delivery_n of_o the_o appeal_n in_o write_v the_o appeal_n be_v make_v now_o the_o act_n appoint_v that_o a_o recognizance_n be_v enter_v into_o for_o the_o prosecute_n of_o the_o appeal_n at_o the_o same_o time_n that_o be_v at_o the_o same_o instant_n of_o time_n the_o appeal_n be_v deliver_v and_o the_o recognizance_n must_v have_v these_o circumstance_n it_o must_v be_v enter_v into_o by_o the_o party_n himself_o appeal_n and_o in_o strictness_n not_o by_o any_o other_o though_o sufficient_a security_n for_o he_o it_o must_v be_v acknowledge_v before_o and_o take_v by_o the_o same_o justice_n that_o make_v the_o record_n of_o the_o conviction_n but_o if_o the_o conviction_n be_v by_o two_o or_o more_o justice_n the_o appeal_v deliver_v to_o and_o the_o recognizance_n acknowledge_v before_o any_o one_o of_o they_o be_v sufficient_a but_o if_o both_o or_o all_o of_o the_o justice_n convict_v be_v together_o the_o recognizance_n must_v be_v acknowledge_v before_o they_o all_o though_o the_o statute_n have_v not_o appoint_v any_o sum_n to_o be_v contain_v in_o the_o recognizance_n yet_o it_o ought_v to_o be_v in_o a_o reasonable_a sum_n which_o be_v common_o and_o usual_o double_v the_o sum_n in_o question_n which_o in_o this_o case_n be_v double_a the_o penalty_n impose_v on_o the_o offender_n that_o appeal_v there_o may_v be_v some_o doubt_n how_o the_o appeal_n be_v to_o be_v make_v or_o the_o recognizance_n enter_v when_o the_o single_a justice_n convict_v shall_v happen_v to_o die_v or_o be_v out_o of_o conviction_n before_o the_o time_n of_o appeal_n but_o that_o be_v a_o matter_n rare_o happen_v i_o shall_v not_o spend_v time_n about_o it_o at_o present_a sect_n 8._o that_o be_v at_o the_o time_n of_o make_v the_o appeal_n and_o the_o appeal_n can_v be_v say_v to_o be_v make_v till_o it_o be_v deliver_v and_o the_o recognizance_n enter_v sect_n 9_o after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v any_o such_o conventicle_n as_o aforesaid_a all_o case_n where_o the_o outward_a door_n of_o a_o house_n may_v be_v break_v the_o law_n as_o this_o act_n do_v require_v that_o first_o a_o demand_v be_v make_v to_o have_v the_o door_n open_v for_o force_n be_v not_o to_o be_v use_v where_o the_o law_n may_v be_v execute_v in_o a_o peaceable_a and_o quiet_a manner_n now_o a_o refusal_n or_o denial_n
as_o they_o call_v it_o a_o silent_a meeting_n yet_o even_o such_o assembly_n of_o they_o seem_v to_o be_v within_o the_o first_o section_n and_o be_v a_o conventicle_n within_o the_o meaning_n of_o this_o act_n for_o it_o be_v a_o meeting_n under_o colour_n of_o the_o exercise_n of_o religion_n though_o none_o be_v exercise_v they_o pretend_v that_o they_o meet_v out_o of_o conscience_n and_o for_o such_o purpose_n and_o it_o be_v plain_o within_o the_o mischief_n viz._n the_o danger_n of_o contrive_v mutiny_n and_o insurrection_n at_o such_o assembly_n and_o there_o be_v as_o much_o danger_n of_o that_o in_o such_o congregation_n as_o any_o other_o and_o by_o the_o design_n of_o this_o clause_n such_o construction_n ought_v to_o be_v make_v as_o may_v most_o suppress_v the_o mischief_n intend_v to_o be_v remedy_v by_o this_o act_n the_o like_a equitable_a construction_n ought_v to_o be_v make_v for_o the_o encouragement_n and_o justification_n of_o the_o officer_n of_o justice_n and_o other_o employ_v in_o the_o execution_n of_o this_o act_n the_o meaning_n of_o which_o be_v that_o by_o no_o strain_a interpretation_n ought_v such_o person_n to_o be_v bring_v to_o damage_n for_o any_o thing_n do_v by_o colour_n of_o this_o statute_n and_o so_o this_o clause_n require_v all_o encouragement_n to_o be_v give_v to_o such_o person_n by_o the_o king_n court_n of_o record_n of_o westminster_n upon_o all_o occasion_n and_o particular_o by_o the_o next_o clause_n which_o be_v that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v for_o any_o default_n in_o form_n i._n e._n no_o record_n of_o conviction_n warrant_v for_o to_o disperse_v a_o conventicle_n or_o to_o levy_v the_o penalty_n by_o distress_n or_o mittimus_fw-la to_o prison_n shall_v etc._n etc._n this_o extend_v to_o all_o court_n as_o to_o the_o session_n so_o to_o the_o kings-bench_n or_o any_o other_o court_n where_o such_o record_n etc._n etc._n may_v be_v remove_v or_o otherwise_o come_v in_o question_n upon_o any_o action_n that_o may_v be_v bring_v against_o any_o person_n for_o any_o thing_n do_v in_o pursuance_n of_o this_o act_n although_o the_o court_n of_o kings-bench_n may_v by_o certiorari_fw-la command_v such_o record_n to_o be_v remove_v thither_o etc._n etc._n yet_o it_o be_v a_o good_a act_n of_o their_o legal_a discretion_n to_o deny_v such_o certiorari_n as_n of_o late_a year_n be_v do_v it_o be_v a_o writ_n discretionary_a and_o not_o ex_fw-la debito_fw-la justitiae_fw-la send_v only_o to_o certify_v his_o majesty_n in_o his_o say_a court_n of_o the_o proceed_n against_o such_o a_o man_n and_o the_o justice_n below_o be_v the_o proper_a judge_n of_o the_o fact_n and_o this_o act_n seem_v to_o order_v the_o final_a determination_n of_o such_o offence_n to_o the_o justice_n particular_o for_o that_o this_o very_a law_n give_v a_o appeal_n to_o the_o session_n where_o the_o party_n have_v his_o advantage_n for_o matter_n of_o law_n as_o well_o as_o fact_n but_o it_o may_v be_v question_v what_o shall_v be_v deem_v a_o default_n in_o form_n i_o confess_v that_o may_v be_v of_o some_o difficulty_n but_o however_o by_o the_o virtue_n of_o this_o clause_n though_o it_o be_v by_o a_o penal_a law_n it_o ought_v to_o be_v help_v by_o intendment_n and_o presumption_n as_o much_o as_o any_o plea_n in_o bar_n or_o any_o other_o plead_v in_o a_o civil_a action_n but_o to_o make_v the_o best_a judgement_n in_o this_o case_n will_v be_v to_o compare_v this_o clause_n with_o the_o statute_n of_o demur_n viz._n the_o 27_o elizabeth_n cap._n 5._o where_o the_o word_n be_v any_o imperfection_n defect_n or_o want_v of_o form_n and_o the_o word_n here_o be_v by_o reason_n of_o any_o default_n in_o form_n which_o be_v plain_o all_o one_o upon_o the_o former_a the_o rule_n be_v whatsoever_o it_o be_v without_o which_o the_o right_a do_v sufficient_o appear_v to_o the_o court_n it_o be_v form_n within_o that_o law_n and_o so_o è_fw-la conuerso_fw-la whatsoever_o be_v want_v or_o imperfect_a whereby_o the_o right_a appear_v not_o be_v not_o remedy_v as_o form_n within_o that_o statute_n so_o here_o whatsoever_o it_o be_v without_o which_o the_o offence_n do_v sufficient_o appear_v to_o the_o court_n that_o be_v form_n within_o our_o law_n so_o if_o it_o appear_v a_o conventicle_n be_v hold_v against_o this_o law_n and_o the_o party_n mean_v to_o be_v convict_v be_v present_a at_o it_o if_o there_o be_v but_o sufficient_a express_v that_o it_o may_v appear_v upon_o the_o whole_a record_n the_o party_n convict_v be_v a_o offender_n against_o this_o law_n it_o will_v be_v well_o enough_o and_o there_o need_v no_o more_o for_o which_o see_v above_o under_o the_o first_o section_n the_o description_n of_o a_o conventicle_n which_o will_v direct_v you_o how_o such_o a_o conviction_n ought_v to_o be_v make_v as_o the_o precedent_n hereafter_o give_v you_o be_v and_o in_o case_n any_o person_n offend_v against_o this_o law_n shall_v fly_v into_o any_o other_o county_n or_o corporation_n etc._n etc._n this_o clause_n make_v provision_n for_o the_o punishment_n of_o such_o person_n convict_v on_o this_o act_n as_o be_v stranger_n inhabit_v or_o fugitive_n fly_v into_o any_o other_o county_n or_o corporation_n that_o must_v be_v mean_v such_o corporation_n where_o the_o justice_n convict_v have_v no_o jurisdiction_n so_o as_o the_o penalty_n can_v be_v levy_v by_o his_o warrant_n and_o therefore_o this_o paragraph_n provide_v that_o there_o may_v be_v a_o certificate_n make_v of_o such_o conviction_n under_o the_o hand_n and_o seal_n of_o such_o justice_n as_o make_v it_o that_o must_v be_v mean_v a_o certificate_n that_o there_o be_v such_o conviction_n make_v or_o a_o transcript_n thereof_o under_o the_o justice_n hand_n and_o seal_n not_o the_o very_a record_n of_o conviction_n itself_o for_o that_o perhaps_o may_v be_v return_v into_o the_o session_n and_o divers_a other_o person_n inhabit_v where_o the_o offence_n be_v commit_v may_v be_v perhaps_o convict_v by_o the_o same_o record_n and_o then_o it_o will_v be_v inconvenient_a to_o transmit_v that_o same_o it_o may_v be_v to_o any_o justice_n of_o the_o peace_n of_o such_o other_o county_n or_o corporation_n and_o if_o such_o offender_n be_v inhabit_v or_o flee_v into_o a_o corporation_n where_o the_o county_n justice_n have_v nothing_o to_o do_v there_o the_o certificate_n may_v be_v to_o any_o justice_n of_o that_o corporation_n as_o well_o as_o to_o the_o chief_a magistrate_n of_o the_o same_o notwithstanding_o the_o wilful_a error_n of_o some_o who_o in_o corporation_n will_v have_v none_o but_o the_o chief_a magistrate_n of_o that_o corporation_n as_o mayor_n etc._n etc._n and_o no_o other_o justice_n of_o such_o place_n impower_v by_o this_o the_o liturgy_n for_o preach_v to_o to_o this_o it_o be_v answer_v that_o by_o the_o 22d_o paragraph_n or_o section_n of_o the_o act_n of_o uniformity_n it_o be_v enact_v that_o at_o all_o and_o every_o time_n and_o time_n when_o any_o sermon_n or_o leaure_n be_v to_o he_o preach_v the_o common_a prayer_n and_o service_n in_o and_o by_o the_o say_a book_n viz._n the_o book_n of_o common-prayer_n appoint_v to_o be_v read_v for_o that_o time_n of_o the_o day_n shall_v be_v open_o public_o and_o solemn_o read_v by_o some_o priest_n or_o deacon_n in_o the_o church_n chapel_n or_o place_n of_o public_a worship_n where_o the_o say_a sermon_n or_o lecture_n be_v to_o be_v preach_v before_o such_o sermon_n or_o lecture_n be_v preach_v and_o that_o the_o lecturer_n then_o to_o preach_v shall_v be_v present_a at_o the_o read_n thereof_o so_o that_o preach_v in_o a_o conventicle_n where_o the_o common_a prayer_n appoint_v to_o be_v read_v for_o the_o time_n of_o the_o day_n be_v not_o first_o solemn_o read_v be_v a_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n and_o a_o offence_n against_o this_o statute_n 8._o in_o any_o place_n within_o the_o kingdom_n of_o england_n etc._n etc._n these_o word_n be_v plain_a and_o therefore_o if_o there_o be_v a_o assembly_n or_o meeting_n in_o a_o church_n by_o five_o person_n or_o more_o under_o pretence_n of_o any_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n the_o same_o be_v a_o conventicle_n within_o this_o act_n where_o any_o one_o or_o more_o present_a who_o be_v of_o the_o age_n of_o 16_o or_o upward_o and_o a_o subject_a of_o this_o realm_n aught_o to_o be_v convict_v but_o this_o be_v not_o to_o be_v understand_v of_o foreigner_n and_o alien_n of_o the_o foreign_a reform_a church_n allow_v or_o to_o be_v allow_v by_o his_o majesty_n his_o heir_n or_o successor_n in_o england_n for_o the_o act_n of_o uniformity_n which_o this_o be_v make_v to_o strengthen_v do_v not_o extend_v to_o they_o as_o by_o the_o proviso_n in_o the_o 15_o paragraph_n of_o that_o act_n appear_v and_o which_o prerogative_n of_o allowance_n to_o such_o foreigner_n or_o alien_n church_n be_v save_v to_o his_o majesty_n by_o this_o act_n which_o be_v where_o five_o or_o more_o where_o there_o be_v no_o household_n be_v meet_v together_o under_o colour_n or_o pretence_n of_o any_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n wherein_o these_o thing_n be_v to_o be_v observe_v 1._o that_o the_o person_n or_o person_n that_o be_v to_o be_v punish_v by_o this_o law_n for_o be_v present_a at_o a_o conventicle_n must_v be_v of_o the_o age_n of_o 16_o or_o upward_o and_o a_o subject_a of_o this_o realm_n 2._o that_o though_o the_o person_n to_o be_v punish_v must_v have_v these_o qualification_n yet_o alien_n or_o minor_n if_o they_o be_v of_o discretion_n may_v make_v up_o the_o number_n of_o five_o to_o make_v it_o a_o conventicle_n within_o this_o law_n as_o for_o example_n suppose_v five_o be_v meet_v together_o in_o a_o house_n beside_o the_o household_n under_o colour_n and_o pretence_n of_o exercise_n of_o religion_n in_o other_o manner_n than_o according_a to_o the_o liturgy_n etc._n etc._n and_o four_o of_o those_o be_v alien_n and_o the_o five_o a_o subject_a of_o the_o age_n of_o 16_o this_o be_v nevertheless_o a_o conventicle_n though_o four_o of_o the_o five_o can_v be_v punish_v as_o be_v alien_n yet_o the_o five_o be_v a_o subject_a shall_v be_v convict_v and_o punish_v by_o this_o law_n for_o be_v present_a at_o such_o conventicle_n for_o the_o law_n describe_v he_o that_o be_v to_o be_v convict_v to_o be_v of_o the_o age_n of_o 16_o or_o upward_o and_o a_o subject_a of_o this_o realm_n but_o the_o conventicle_n at_o which_o he_o be_v present_a and_o for_o which_o he_o be_v convict_v be_v only_o to_o be_v a_o meeting_n together_o or_o a_o assembly_n of_o five_o or_o more_o and_o so_o a_o conventicle_n there_o those_o of_o the_o same_o household_n if_o present_a at_o the_o conventicle_n be_v of_o the_o age_n of_o 16_o and_o subject_n of_o this_o realm_n may_v and_o aught_o to_o be_v convict_v for_o be_v at_o the_o conventicle_n as_o well_o as_o any_o other_o i_o think_v by_o the_o word_n household_n both_o lodger_n and_o inmate_n be_v include_v so_o that_o there_o must_v be_v five_o over_o and_o above_o the_o household_n and_o the_o lodger_n and_o inmate_n as_o part_v of_o the_o household_n 4._o the_o preacher_n or_o teacher_n in_o such_o conventicle_n though_o a_o alien_n or_o not_o of_o the_o age_n of_o 16_o aught_o to_o be_v convict_v see_v the_o three_o paragraph_n of_o this_o act._n 5._o if_o a_o subject_a of_o the_o age_n of_o 16_o or_o upward_o be_v present_a at_o the_o church_n or_o assembly_n of_o foreigner_n or_o alien_n of_o the_o foreign_a reform_a church_n allow_v by_o his_o majesty_n he_o be_v not_o to_o be_v convict_v for_o be_v at_o a_o conventicle_n for_o see_v the_o assembly_n itself_o be_v lawful_a he_o that_o be_v present_a at_o it_o can_v be_v say_v to_o have_v commit_v a_o offence_n within_o this_o act._n 10._o then_o where_o any_o five_o person_n or_o more_o be_v so_o assemble_v as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o one_o or_o more_o justice_n of_o the_o peace_n of_o of_o those_o three_o division_n corporation_n as_o london_n york_n bristol_n and_o other_o that_o be_v county_n of_o themselves_o and_o wherein_o the_o justice_n of_o peace_n for_o the_o county_n at_o large_a have_v nothing_o to_o do_v or_o else_o such_o corporation_n that_o continue_v parcel_n of_o the_o county_n at_o large_a yet_o have_v justice_n of_o their_o own_o exclusive_a to_o the_o justice_n of_o the_o peace_n of_o the_o county_n where_o the_o corporation_n be_v so_o that_o the_o justice_n of_o the_o county_n may_v not_o intermeddle_v and_o last_o liberty_n which_o have_v justice_n of_o peace_n within_o the_o liberty_n and_o yet_o the_o justice_n of_o the_o county_n or_o ride_v where_o such_o liberty_n have_v a_o concurrent_a jurisdiction_n now_o if_o where_o the_o offence_n happen_v be_v such_o a_o liberty_n that_o the_o justice_n of_o the_o county_n at_o large_a may_v not_o intermeddle_v then_o the_o justice_n or_o justice_n of_o peace_n of_o such_o liberty_n of_o the_o party_n etc._n etc._n this_o confession_n must_v be_v judicial_a before_o the_o justice_n himself_o at_o the_o time_n of_o the_o conviction_n and_o not_o a_o confession_n at_o another_o time_n or_o before_o other_o person_n for_o such_o confession_n though_o swear_v before_o the_o justice_n by_o sufficient_a witness_n be_v only_o a_o evidence_n or_o circumstance_n of_o the_o fact_n but_o not_o a_o ground_n to_o convict_v the_o offender_n ipso_fw-la facto_fw-la as_o a_o confession_n before_o the_o justice_n himself_o be_v 12._o or_o do_v of_o two_o witness_n etc._n etc._n a_o present_a at_o the_o same_o conventicle_n a_o man_n that_o be_v only_o indict_v of_o perjury_n or_o any_o other_o infamous_a crime_n but_o not_o convict_v be_v a_o witness_n for_o no_o man_n be_v disable_v to_o give_v testimony_n upon_o oath_n upon_o a_o bare_a indictment_n only_o note_v in_o this_o case_n the_o oath_n of_o the_o witness_n and_o all_o other_o evidence_n give_v upon_o oath_n before_o the_o justice_n or_o justice_n convict_v shall_v be_v put_v in_o write_v and_o subscribe_v by_o the_o party_n swear_v or_o give_v such_o evidence_n at_o the_o time_n of_o his_o deposition_n or_o examination_n especial_o where_o a_o appeal_n be_v give_v by_o this_o act_n for_o that_o by_o the_o 6_o paragraph_n it_o be_v require_v that_o upon_o a_o appeal_n the_o justice_n certify_v to_o conventicle_n far_o than_o that_o they_o be_v assemble_v together_o if_o the_o person_n convent_v can_n or_o will_v not_o give_v a_o account_n for_o what_o other_o cause_n they_o be_v so_o assemble_v or_o meet_v together_o or_o if_o they_o or_o some_o other_o at_o such_o assembly_n be_v common_o know_v and_o repute_v to_o be_v frequenter_n of_o conventicle_n or_o that_o they_o common_o though_o not_o always_o do_v

believe_v that_o he_o shall_v not_o be_v able_a to_o suppress_v the_o conventicle_n whereof_o he_o have_v notice_n he_o may_v make_v his_o certificate_n that_o the_o military_a power_n may_v be_v ready_a for_o if_o a_o certificate_n shall_v not_o be_v make_v till_o the_o very_a time_n of_o the_o conventicle_n hold_v it_o will_v perhaps_o be_v too_o late_o for_o the_o suppress_n of_o they_o assistance_n of_o any_o officer_n for_o the_o execute_v any_o power_n give_v by_o this_o law_n have_v the_o same_o privilege_n and_o benefit_n every_o such_o defendant_n shall_v have_v his_o full_a act_n be_v declare_v viz._n for_o provide_v far_o and_o more_o speedy_a remedy_n against_o the_o grow_a and_o dangerous_a practire_n of_o seditious_a sectary_n and_o other_o disloyal_a person_n who_o under_o the_o pretence_n of_o tender_a conscience_n have_v or_o may_v at_o their_o meeting_n contrive_v insurrection_n as_o experience_n have_v show_v and_o that_o experience_n have_v be_v much_o more_o abundant_a of_o late_a day_n and_o therefore_o the_o act_n continue_v as_o necessary_a as_o ever_o it_o be_v too_o well_o know_v that_o the_o person_n so_o pretend_v to_o a_o great_a church_n of_o england_n and_o it_o seem_v to_o be_v a_o base_a reflection_n on_o the_o wisdom_n and_o prudence_n of_o our_o lawmaker_n that_o the_o prosecution_n of_o this_o law_n shall_v be_v think_v unnecessary_a in_o the_o same_o age_n wherein_o it_o be_v make_v and_o the_o reason_n continue_v for_o which_o it_o be_v at_o first_o provide_v viz._n the_o danger_n of_o mutiny_n and_o sedition_n for_o the_o prevention_n and_o suppress_v whereof_o there_o be_v no_o better_a mean_n than_o the_o execution_n of_o this_o act_n which_o as_o this_o clause_n be_v ought_v to_o have_v the_o large_a and_o most_o beneficial_a construction_n imaginable_a i._n e._n such_o a_o equitable_a construction_n although_o it_o be_v a_o penal_a law_n as_o may_v best_o conduce_v to_o the_o suppression_n of_o such_o conventicle_n though_o perhaps_o the_o thing_n be_v not_o express_o within_o the_o letter_n of_o the_o law_n yet_o it_o ought_v to_o be_v construe_v within_o the_o intent_n as_o for_o instance_n suppose_v a_o certain_a number_n of_o man_n shall_v meet_v and_o assemble_v themselves_o together_o under_o the_o colour_n and_o pretence_n of_o exercise_v religion_n and_o there_o shall_v be_v no_o formal_a preach_v and_o teach_v but_o only_o a_o extempore_o enthusiastical_a prayer_n yet_o the_o prolocutor_n or_o speaker_n in_o such_o assembly_n ought_v to_o be_v construe_v with_o the_o intent_n of_o the_o three_o section_n of_o this_o act_n and_o incur_v the_o penalty_n of_o 20_o l._n be_v certain_o within_o the_o intent_n though_o not_o within_o the_o precise_a letter_n of_o seditious_a or_o treasonable_a word_n resist_v the_o magistrate_n come_v to_o disperse_v they_o or_o give_v opprobrious_a language_n to_o the_o justice_n or_o other_o officer_n in_o the_o execution_n of_o this_o act_n he_o may_v be_v indict_v and_o punish_v for_o any_o such_o offence_n and_o by_o this_o act_n too_o sect_n 15._o provide_v also_o that_o every_o alderman_n of_o london_n etc._n etc._n the_o second_o time_n and_o in_o case_n such_o appellant_n shall_v not_o prosecute_v with_o effect_n etc._n etc._n if_o at_o the_o next_o quarter_n session_n the_o appellant_n shall_v not_o appear_v and_o plead_v matter_n of_o fact_n or_o demur_n in_o law_n to_o the_o record_n of_o the_o first_o conviction_n this_o will_v be_v a_o non-prosecution_n whereby_o treble_a cost_v be_v to_o be_v give_v the_o payment_n of_o any_o cost_v and_o in_o all_o case_n of_o non-prosecution_n there_o must_v be_v a_o record_n of_o it_o make_v by_o the_o session_n or_o if_o upon_o such_o trial_n he_o shall_v not_o be_v acquit_v etc._n etc._n it_o be_v not_o say_v if_o upon_o trial_n the_o first_o conviction_n shall_v be_v affirm_v or_o find_v true_a but_o if_o the_o appellant_n shall_v not_o be_v acquit_v suppose_v the_o appellant_n be_v convict_v of_o be_v present_a at_o a_o conventicle_n and_o 5_o s._n penalty_n impose_v upon_o he_o and_o in_o regard_n of_o the_o poverty_n of_o the_o teacher_n 10_o l._n more_o be_v impose_v upon_o he_o which_o be_v levy_v he_o appeal_v and_o plead_v that_o the_o teacher_n be_v able_a to_o pay_v himself_o and_o therefore_o the_o appellant_n ought_v not_o to_o have_v be_v charge_v with_o the_o 10_o l._n in_o this_o case_n i_o conceive_v such_o plea_n be_v insufficient_a and_o though_o it_o be_v find_v so_o by_o verdict_n at_o the_o session_n yet_o the_o appellant_n be_v not_o acquit_v of_o the_o offence_n which_o 〈◊〉_d of_o be_v present_a at_o the_o conventicle_n nor_o be_v the_o teacher_n find_v innocent_a and_o therefore_o the_o appellant_n can_v be_v relieve_v but_o aught_o to_o pay_v treble_a
