subtle_o and_o false_o forge_n or_o make_v or_o subtle_o cause_n or_o witting_o assent_v to_o be_v forge_v or_o make_v any_o false_a deed_n conveyance_n or_o write_v seal_v or_o the_o will_n of_o any_o person_n or_o person_n in_o write_v to_o the_o intent_n that_o the_o state_n of_o freehold_n or_o inheritance_n right_o title_n or_o interest_n of_o any_o person_n or_o person_n of_o in_o or_o to_o any_o land_n tenement_n or_o
pain_n of_o forfeit_v the_o sum_n of_o forty_o shilling_n for_o every_o such_o offence_n upon_o due_a conviction_n thereof_o gamester_n penalty_n on_o gamester_n the_o say_v fine_a to_o be_v dispose_v the_o party_n himself_o his_o child_n or_o servant_n that_o shall_v refuse_v to_o give_v in_o upon_o his_o oath_n when_o so_o require_v what_o he_o know_v relate_v to_o the_o premise_n shall_v among_o the_o creditor_n save_v the_o widow_n dower_n save_v that_o shall_v have_v make_v out_o their_o claim_n in_o due_a proportion_n to_o the_o sum_n to_o they_o respective_o owe_v according_a as_o time_n when_o pack_v and_o all_o such_o other_o provision_n as_o the_o packer_n shall_v find_v wholesome_a and_o useful_a though_o for_o its_o quality_n it_o be_v not_o merchantable_a he_o shall_v cause_v to_o be_v well_o pack_v salt_v fill_v and_o seal_v with_o the_o letter_n r._n and_o such_o other_o letter_n as_o may_v signify_v the_o town_n specie_fw-la and_o time_n of_o pack_v and_o if_o any_o master_n of_o a_o ship_n or_o other_o vessel_n or_o any_o officer_n or_o mariner_n belong_v thereto_o shall_v receive_v such_o provision_n not_o mark_v and_o seal_v as_o aforesaid_a aboard_o cull_v all_o merchantable_a fish_n and_o measure_v all_o salt_n that_o shall_v be_v import_v and_o sell_v out_o of_o any_o ship_n or_o other_o vessel_n and_o shall_v have_v three-halfe-pence_n for_o every_o hogshead_n of_o salt_n by_o he_o so_o measure_v to_o be_v pay_v the_o one_o half_a by_o the_o buyer_n the_o other_o half_o by_o the_o seller_n and_o one_o penny_n per_fw-la quintal_n for_o every_o quintal_n of_o merchantable_a fish_n by_o he_o cull_v to_o be_v pay_v one_o half_a by_o the_o buyer_n and_o the_o other_o half_a by_o the_o seller_n a_o act_n for_o the_o punish_n of_o criminal_a offender_n be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o swear_v curse_v and_o swear_v that_o if_o any_o person_n or_o person_n shall_v profane_o swear_v or_o curse_n in_o the_o hear_n of_o any_o justice_n of_o the_o peace_n or_o shall_v be_v thereof_o convict_v by_o the_o oath_n of_o two_o witness_n or_o confession_n of_o the_o party_n before_o any_o justice_n or_o justice_n of_o the_o peace_n every_o such_o offender_n shall_v forfeit_v and_o pay_v unto_o the_o use_n of_o the_o poor_a of_o the_o town_n where_o the_o offence_n shall_v be_v commit_v the_o sum_n of_o five_o shilling_n and_o if_o the_o offender_n be_v not_o able_a to_o pay_v the_o say_a sum_n then_o to_o be_v set_v in_o the_o stock_n not_o exceed_v two_o hour_n and_o if_o any_o person_n shall_v utter_v more_o profane_a oath_n or_o curse_n at_o the_o same_o time_n and_o in_o hear_v by_o the_o authority_n aforesaid_a that_o all_o controversy_n concern_v marriage_n and_o divorce_n divorce_n divorce_n shall_v be_v hear_v and_o determine_v by_o the_o governor_n and_o council_n a_o act_n for_o the_o setlement_n and_o support_v of_o minister_n and_o schoolmaster_n be_v it_o ordain_v and_o enact_v by_o the_o governor_n council_n and_o representative_n convene_v in_o general_a court_n or_o assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o the_o inhabitant_n of_o each_o town_n within_o this_o province_n shall_v take_v due_a care_n from_o time_n to_o time_n to_o be_v constant_o provide_v of_o a_o able_a learned_a orthodox_n minister_n or_o minister_n of_o good_a conversation_n to_o dispense_v the_o word_n of_o god_n to_o they_o which_o minister_n or_o minister_n shall_v he_o suitable_o encourage_v and_o sufficient_o support_v and_o maintain_v by_o the_o inhabitant_n of_o such_o town_n good_a contract_n &_o agreement_n to_o be_v make_v good_a and_o all_o contract_n agreement_n and_o order_n heretofore_o make_v or_o that_o shall_v hereafter_o be_v make_v by_o the_o inhabitant_n of_o any_o town_n within_o this_o province_n respect_v their_o minister_n or_o schoolmaster_n as_o to_o their_o settlement_n or_o maintenance_n shall_v remain_v good_a and_o valid_a according_a to_o the_o true_a intent_n thereof_o the_o whole_a time_n for_o which_o they_o be_v or_o shall_v be_v make_v in_o all_o the_o particular_n thereof_o and_o shall_v according_o be_v pursue_v put_v in_o execution_n and_o fulfil_v and_o where_o there_o be_v no_o contract_n and_o agreement_n make_v in_o any_o town_n respect_v the_o support_n and_o maintenance_n of_o the_o ministry_n or_o when_o the_o same_o happen_v to_o be_v expire_v and_o the_o inhabitant_n of_o such_o town_n shall_v neglect_v to_o make_v suitable_a provision_n therein_o upon_o complaint_n thereof_o make_v unto_o the_o quarter_n session_n of_o the_o peace_n for_o the_o county_n where_o such_o town_n lie_v minister_n neglect_v of_o make_v suitable_a provision_n for_o minister_n to_o be_v redress_v by_o the_o quarter_n session_n the_o court_n of_o quarter_n session_n to_o take_v care_n that_o no_o town_n be_v destitute_a of_o a_o minister_n the_o say_a court_n of_o quarter_n session_n shall_v and_o hereby_o be_v empower_v to_o order_n a_o competent_a allowance_n unto_o such_o minister_n according_a to_o the_o estate_n &_o ability_n of_o the_o town_n the_o same_o to_o be_v assess_v upon_o the_o inhabitant_n by_o warrant_n from_o the_o court_n direct_v to_o the_o select-man_n who_o be_v thereupon_o to_o proceed_v to_o make_v and_o proportion_v such_o assessment_n in_o manner_n as_o be_v direct_v for_o other_o public_a charge_n and_o to_o cause_v the_o same_o to_o be_v levy_v by_o the_o constable_n of_o such_o town_n by_o warrant_n under_o the_o hand_n of_o the_o select-man_n or_o of_o the_o town_n clerk_n by_o their_o order_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o where_o any_o town_n shall_v be_v destitute_a of_o a_o minister_n qualify_v as_o aforesaid_a and_o shall_v so_o continue_v by_o the_o space_n of_o six_o month_n not_o have_v take_v due_a care_n for_o the_o procure_n settle_v and_o encouragement_n of_o such_o minister_n the_o same_o be_v make_v to_o appear_v upon_o complaint_n unto_o their_o majesty_n justice_n at_o the_o general_a session_n of_o the_o peace_n for_o the_o county_n the_o say_a court_n of_o quarter_n session_n shall_v and_o hereby_o be_v empower_v to_o make_v a_o order_n upon_o every_o such_o defective_a town_n speedy_o to_o provide_v themselves_o of_o such_o minister_n as_o aforesaid_a by_o the_o next_o session_n at_o the_o further_a and_o in_o case_n such_o order_n be_v not_o comply_v with_o than_o the_o say_a court_n shall_v take_v effectual_a care_n to_o procure_v and_o settle_v a_o minister_n qualify_v as_o aforesaid_a and_o order_n the_o charge_n thereof_o and_o of_o such_o minister_n maintenance_n to_o be_v levy_v on_o the_o inhabitant_n of_o such_o town_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a church_n in_o the_o several_a town_n within_o this_o province_n shall_v at_o all_o time_n hereafter_o use_v exercise_n and_o enjoy_v all_o their_o privilege_n and_o freedom_n respect_v divine_a worship_n freedom_n church_n to_o enjoy_v their_o privilege_n &_o freedom_n church-order_n and_o discipline_n and_o shall_v be_v encourage_v in_o the_o peaceable_a and_o regular_a profession_n and_o practice_n thereof_o and_o further_o it_o be_v enact_v that_o every_o minister_n be_v a_o person_n of_o good_a conversation_n able_a town_n minister_n choose_v by_o the_o major_a part_n of_o the_o inhabitant_n to_o be_v the_o minister_n of_o such_o town_n learned_a and_o orthodox_n that_o shall_v be_v choose_v by_o the_o major_a part_n of_o the_o inhabitant_n in_o any_o town_n at_o a_o town-meeting_a due_o warn_v for_o that_o purpose_n notice_n thereof_o be_v give_v to_o the_o inhabitant_n fifteen_o day_n before_o the_o time_n for_o such_o meeting_n shall_v be_v the_o minister_n of_o such_o town_n and_o the_o whole_a town_n shall_v be_v oblige_v to_o pay_v towards_o his_o settlement_n and_o maintenance_n each_o man_n his_o several_a proportion_n thereof_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o town_n within_o this_o province_n school_n school_n for_o reading_n and_o write_v grammar_n school_n have_v the_o number_n of_o fifty_o householder_n or_o upward_o shall_v be_v constant_o provide_v of_o a_o schoolmaster_n to_o teach_v child_n and_o youth_n to_o read_v and_o write_v and_o where_o any_o town_n or_o town_n have_v the_o number_n of_o one_o hundred_o family_n or_o householder_n there_o shall_v also_o be_v a_o grammar_n school_n set_v up_o in_o every_o such_o town_n and_o some_o discreet_a person_n of_o good_a conversation_n well_o instruct_v in_o the_o tongue_n procure_v to_o keep_v such_o school_n every_o such_o schoolmaster_n to_o be_v suitable_o encourage_v and_o pay_v by_o the_o inhabitant_n and_o the_o select-man_n and_o inhabitant_n of_o such_o town_n respective_o shall_v take_v effectual_a care_n and_o make_v due_a provision_n for_o the_o settlement_n and_o maintenance_n of_o such_o schoolmaster_n and_o master_n support_v schoolmaster_n to_o be_v support_v and_o if_o any_o town_n qualify_v as_o before_o express_v shall_v neglect_v the_o due_a observance_n of_o this_o act_n for_o the_o procure_n &_o settle_v of_o any_o such_o schoolmaster_n as_o aforesaid_a by_o the_o space_n of_o one_o year_n every_o such_o defective_a town_n shall_v incur_v the_o penalty_n of_o ten_o pound_n for_o every_o conviction_n of_o such_o neglect_n neglect_v penalty_n for_o neglect_v upon_o complaint_n make_v unto_o their_o majesty_n justice_n in_o quarter_n session_n for_o the_o same_o county_n in_o which_o such_o defective_a town_n lie_v which_o penalty_n shall_v be_v towards_o the_o support_n of_o such_o school_n or_o school_n within_o the_o same_o county_n where_o there_o may_v be_v most_o need_n at_o the_o discretion_n of_o the_o justice_n in_o quarter_n session_n to_o be_v levy_v by_o warrant_n from_o the_o say_a court_n of_o session_n in_o proportion_n upon_o the_o
use_n of_o the_o poor_a of_o such_o town_n and_o to_o be_v levy_v by_o distress_n upon_o such_o delinquent_n constable_n good_n by_o warrant_n from_o one_o justice_n of_o the_o peace_n be_v convent_v and_o convict_v of_o such_o neglect_n before_o he_o who_o be_v hereby_o thereto_o empower_v provide_v nevertheless_o that_o every_o constable_n at_o the_o end_n of_o every_o three_o month_n shall_v overseer_n of_o the_o poor_a in_o each_o town_n where_o there_o be_v such_o choose_a and_o special_o appoint_v for_o that_o service_n be_v hereby_o empower_v and_o order_v to_o take_v effectual_a care_n that_o all_o child_n youth_n correction_n idle_n person_n and_o loiterer_n to_o be_v employ_v upon_o refusal_n to_o labour_n to_o be_v send_v to_o the_o house_n of_o correction_n and_o other_o person_n of_o able_a body_n live_v within_o the_o same_o town_n or_o precinct_n thereof_o not_o have_v estate_n otherwise_o to_o maintain_v themselves_o do_v not_o live_v idle_o or_o misspend_v their_o time_n in_o loiter_v but_o that_o they_o be_v bring_v up_o or_o employ_v in_o some_o honest_a call_v which_o may_v be_v profitable_a unto_o themselves_o and_o the_o public_a and_o if_o any_o person_n or_o person_n fit_a and_o able_a to_o work_v shall_v refuse_v so_o to_o do_v but_o loiter_v &_o misspend_v his_o or_o her_o time_n wander_v from_o place_n to_o place_n or_o otherwise_o misorder_n themselves_o and_o thereof_o be_v convict_v before_o one_o or_o more_o justice_n of_o the_o peace_n such_o person_n or_o person_n shall_v by_o such_o justice_n or_o justice_n be_v send_v to_o the_o house_n of_o correction_n and_o at_o their_o entrance_n be_v whip_v on_o the_o naked_a back_n by_o the_o master_n of_o such_o house_n or_o such_o other_o as_o he_o shall_v procure_v not_o exceed_v ten_o lash_n and_o be_v there_o keep_v to_o hard_a labour_n until_o he_o or_o she_o be_v discharge_v by_o such_o justice_n or_o justice_n or_o the_o quarter_n session_n of_o the_o peace_n for_o the_o same_o county_n and_o it_o shall_v and_o may_v be_v lawful_a for_o the_o overseer_n of_o the_o poor_a or_o select-man_n in_o each_o town_n where_o there_o be_v no_o other_o person_n special_o choose_v and_o appoint_v to_o be_v overseer_n of_o the_o poor_a apprentice_n poor_a child_n to_o be_v bind_v out_o apprentice_n and_o they_o be_v hereby_o order_v with_o the_o assent_n of_o two_o justice_n of_o the_o peace_n to_o bound_v any_o poor_a child_n belong_v to_o such_o town_n to_o be_v apprentice_n where_o they_o shall_v see_v convenient_a a_o man_n child_n until_o he_o shall_v come_v to_o the_o age_n of_o twenty_o one_o year_n and_o a_o woman_n child_n to_o the_o age_n of_o eighteen_o year_n or_o time_n of_o marriage_n which_o shall_v be_v as_o effectual_a to_o all_o intent_n and_o purpose_n as_o if_o any_o such_o child_n be_v of_o full_a age_n and_o by_o indenture_n of_o covenant_n have_v bind_v he_o or_o herself_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n and_o person_n except_o as_o in_o this_o act_n be_v before_o except_v be_v due_o choose_v as_o aforesaid_a to_o serve_v in_o the_o office_n of_o constable_n constable_n penalty_n for_o not_o serve_v in_o the_o office_n of_o constable_n who_o shall_v refuse_v to_o take_v the_o oath_n to_o that_o office_n belong_v and_o to_o serve_v therein_o if_o he_o be_v able_a in_o person_n to_o execute_v the_o same_o shall_v pay_v the_o sum_n of_o five_o pound_n to_o the_o use_n of_o the_o poor_a of_o such_o town_n and_o if_o in_o the_o town_n of_o boston_n or_o salem_n the_o sum_n of_o ten_o pound_n and_o shall_v forthwith_o declare_v his_o acceptance_n or_o refusal_n and_o the_o town_n shall_v proceed_v to_o a_o new_a choice_n and_o if_o such_o person_n refuse_v to_o pay_v down_o his_o fine_a he_o shall_v be_v convent_v before_o the_o next_o session_n of_o the_o peace_n to_o be_v hold_v for_o that_o county_n in_o which_o such_o town_n lie_v who_o upon_o certificate_n under_o the_o hand_n of_o the_o town_n clerk_n or_o two_o or_o more_o of_o the_o select-man_n that_o such_o person_n be_v legal_o choose_v to_o the_o office_n of_o constable_n and_o show_v no_o just_a cause_n to_o the_o session_n for_o his_o excuse_n the_o justice_n shall_v order_n a_o warrant_n to_o be_v sign_v by_o the_o clerk_n of_o the_o peace_n direct_v to_o any_o of_o the_o constable_n then_o in_o be_v within_o such_o town_n to_o levy_v the_o say_v fine_a by_o distress_n and_o sale_n of_o such_o offender_n good_n return_v the_o overplus_a if_o any_o be_v say_v fine_a to_o be_v deliver_v unto_o the_o overseer_n of_o the_o poor_a or_o select-man_n to_o the_o use_v of_o the_o poor_a of_o such_o town_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n come_v to_o inhabitant_n person_n entertain_v in_o any_o town_n by_o the_o space_n of_o 3_o month_n and_o not_o warn_v out_o to_o be_v repute_v inhabitant_n sojourn_v or_o dwell_v in_o any_o town_n within_o this_o province_n or_o precinct_n thereof_o and_o he_o there_o receive_v and_o entertain_v by_o the_o space_n of_o three_o month_n not_o have_v be_v warn_v by_o the_o constable_n or_o other_o person_n who_o the_o select-man_n shall_v appoint_v for_o that_o service_n to_o leave_v the_o place_n and_o the_o name_n of_o such_o person_n with_o the_o time_n of_o their_o abide_v there_o and_o when_o such_o warning_n be_v give_v they_o return_v unto_o the_o court_n of_o quarter_n session_n every_o such_o person_n shall_v be_v repute_a a_o inhabitant_n of_o such_o town_n or_o precinct_n of_o the_o same_o and_o the_o proper_a charge_n of_o the_o same_o in_o case_n through_o sickness_n lameness_n or_o otherwise_o they_o come_v to_o stand_v in_o need_n of_o relief_n to_o be_v bear_v by_o such_o town_n unless_o the_o relation_n of_o such_o poor_a impotent_a person_n in_o the_o line_n or_o degree_n of_o father_n or_o grandfather_n relation_n person_n of_o ability_n to_o relieve_v their_o poor_a relation_n mother_n or_o grandmother_n child_n or_o grandchild_n be_v of_o sufficient_a ability_n then_o such_o relation_n respective_o shall_v relieve_v such_o poor_a person_n in_o such_o manner_n as_o the_o justice_n of_o the_o peace_n in_o that_o county_n where_o such_o sufficient_a person_n dwell_v shall_v assess_v on_o pain_n that_o every_o one_o fail_v therein_o shall_v forfeit_v twenty_o shilling_n for_o every_o month_n neglect_v to_o be_v levy_v by_o distress_n and_o sale_n of_o such_o offender_n good_n by_o warrant_n from_o any_o two_o such_o justice_n of_o the_o peace_n quorum_fw-la unus_n within_o their_o limit_n which_o shall_v be_v employ_v to_o the_o use_n and_o relief_n of_o such_o impotent_a poor_a person_n provide_v nevertheless_o this_o act_n shall_v not_o be_v understand_v of_o any_o person_n commit_v to_o prison_n or_o lawful_o restrain_v in_o any_o town_n or_o of_o such_o as_o shall_v come_v or_o be_v send_v for_o nurse_n or_o education_n or_o to_o any_o physician_n or_o chirurgeon_n to_o be_v heal_v or_o cure_a but_o the_o particular_a person_n who_o receive_v and_o entertain_v any_o such_o shall_v be_v the_o town_n security_n in_o their_o behalf_n and_o be_v oblige_v to_o relieve_v and_o support_v they_o in_o case_n of_o need_n upon_o complaint_n make_v to_o the_o quarter_n session_n who_o shall_v according_o order_v the_o same_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o any_o person_n orderly_o warn_v as_o aforesaid_a to_o depart_v any_o town_n whereof_o he_o be_v not_o a_o inhabitant_n and_o neglect_v so_o to_o do_v by_o the_o space_n of_o fourteen_o day_n next_o after_o such_o warning_n give_v constable_n person_n warn_v out_o of_o any_o town_n to_o depart_v in_o 14_o day_n or_o else_o to_o be_v send_v by_o the_o constable_n may_v by_o warrant_n from_o the_o next_o justice_n of_o the_o peace_n be_v send_v and_o convey_v from_o constable_n to_o constable_n unto_o the_o town_n where_o he_o proper_o belong_v or_o have_v his_o last_o residence_n at_o his_o own_o charge_n if_o able_a to_o pay_v the_o same_o or_o otherwise_o at_o the_o charge_n of_o the_o town_n so_o send_v he_o and_o further_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o when_o and_o so_o often_o as_o there_o shall_v be_v occasion_n of_o a_o town-meeting_a for_o any_o business_n of_o public_a concernment_n to_o the_o town_n there_o to_o be_v do_v town-meeting_n constable_n to_o warn_v town-meeting_n the_o constable_n or_o constable_n of_o such_o town_n by_o order_n from_o the_o select-man_n or_o major_a part_n of_o they_o or_o of_o the_o town_n clerk_n by_o their_o
the_o whole_a case_n to_o say_a court_n and_o each_o party_n shall_v be_v there_o allow_v the_o benefit_n of_o any_o further_a plea_n or_o evidence_n and_o if_o upon_o any_o such_o new_a plea_n or_o hold_v and_o keep_v in_o each_o relpective_a county_n and_o island_n beforenamed_n within_o this_o province_n a_o inferior_a court_n of_o common_a plea_n by_o four_o of_o the_o justice_n of_o and_o reside_v within_o the_o same_o county_n and_o island_n respective_o to_o be_v appoint_v and_o commissionated_a thereto_o any_o three_o of_o who_o to_o be_v a_o quorum_fw-la for_o the_o hear_n and_o down_o to_o the_o say_a person_n or_o person_n so_o tend_v the_o say_a oath_n or_o either_o of_o they_o such_o sum_n of_o money_n not_o exceed_v forty_o shilling_n as_o the_o say_a person_n or_o person_n so_o tender_v the_o say_a oath_n or_o either_o of_o they_o shall_v require_v such_o offender_n to_o pay_v for_o his_o say_a refusal_n which_o money_n shall_v be_v pay_v to_o the_o hold_v for_o the_o fame_n county_n where_o such_o offender_n do_v inhabit_v or_o reside_v at_o which_o court_n of_o quarter_n session_n the_o say_a oath_n shall_v be_v again_o tender_v to_o every_o such_o offender_n by_o the_o justice_n of_o the_o say_a court_n in_o open_a session_n and_o if_o the_o say_a offender_n shall_v refuse_v to_o take_v the_o say_a oath_n or_o either_o of_o they_o when_o tender_v to_o he_o by_o the_o say_a justice_n in_o open_a session_n as_o be_v aforesaid_a the_o say_v justice_n tender_v the_o say_a oath_n shall_v commit_v the_o say_a person_n and_o person_n so_o refuse_v to_o the_o common_a goal_n or_o house_n of_o correction_n there_o to_o remain_v for_o the_o space_n of_o six_o month_n unless_o every_o such_o offender_n shall_v pay_v down_o to_o the_o justice_n so_o tender_v the_o say_a oath_n such_o sum_n of_o money_n not_o exceed_v ten_o pound_n nor_o under_o five_o pound_n as_o the_o say_a justice_n shall_v require_v such_o offender_n to_o pay_v for_o his_o second_o refusal_n the_o say_a money_n to_o be_v dispose_v of_o in_o manner_n aforesaid_a and_o unless_o every_o such_o offender_n shall_v likewise_o become_v bind_v with_o two_o sufficient_a surety_n with_o condition_n to_o be_v of_o the_o good_a behaviour_n until_o he_o or_o they_o do_v take_v the_o say_a oath_n and_o whereas_o there_o be_v certain_a person_n who_o scruple_n select-man_n of_o the_o town_n where_o they_o dwell_v or_o who_o shall_v be_v otherwise_o think_v fit_a by_o the_o justice_n themselves_o shall_v be_v license_v by_o the_o say_a justice_n in_o quarter_n session_n may_v presume_v to_o be_v a_o common_a victualler_n inn-holder_n taverner_n or_o seller_n of_o wine_n beer_n ale_n cider_n or_o strong_a liquor_n by_o retail_n nor_o shall_v any_o presume_v without_o such_o licence_n to_o sell_v wine_n or_o strong_a liquor_n private_o by_o a_o less_o quantity_n than_o a_o quarter_n cask_n and_o that_o deliver_v and_o carry_v away_o all_o at_o one_o time_n on_o pain_n of_o forfeit_v the_o sum_n of_o forty_o shilling_n for_o every_o such_o offence_n upon_o due_a conviction_n thereof_o give_v one_o half_n to_o the_o informer_n and_o the_o other_o to_o the_o use_n of_o the_o poor_a upon_o second_o conviction_n to_o give_v bond_n for_o the_o good_a behaviour_n licence_n to_o be_v renew_v yearly_a &_o bond_n give_v one_o half_a thereof_o to_o the_o informer_n and_o the_o other_o half_a to_o the_o use_n of_o the_o poor_a of_o the_o town_n where_o such_o offence_n be_v commit_v and_o upon_o a_o second_o conviction_n beside_o the_o forfeiture_n of_o forty_o shilling_n as_o aforesaid_a shall_v enter_v into_o recognizance_n with_o one_o or_o more_o surety_n for_o the_o good_a behaviour_n especial_o not_o to_o transgress_v the_o law_n in_o that_o respect_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o licence_n be_v renew_a yearly_a and_o bond_n give_v for_o the_o due_a observance_n of_o the_o same_o and_o of_o the_o law_n and_o that_o the_o person_n license_v shall_v use_v his_o licence_n in_o such_o house_n as_o shall_v be_v therein_o name_v and_o no_o other_o and_o if_o the_o justice_n in_o quarter_n session_n shall_v think_v fit_a to_o licence_n any_o person_n or_o person_n not_o present_v a_o certificate_n as_o aforesaid_a from_o the_o select-man_n give_v justice_n may_v grant_v licence_n without_o certificate_n of_o the_o select-man_n upon_o notice_n give_v the_o clerk_n of_o the_o session_n before_o grant_v licence_n to_o any_o such_o shall_v signify_v the_o name_n and_o desire_v of_o every_o such_o person_n unto_o the_o select-man_n of_o the_o town_n where_o such_o person_n dwell_v one_o month_n beforehand_o that_o so_o they_o may_v have_v opportunity_n and_o liberty_n to_o offer_v their_o objection_n against_o it_o if_o any_o shall_v be_v and_o forasmuch_o as_o the_o ancient_a and_o principal_a use_n of_o inn_n tavern_n alehouse_n victualling-house_n not_o intend_v for_o entertainment_n and_o harbour_v of_o lewd_a or_o idle_a people_n to_o spend_v or_o consume_v their_o money_n or_o time_n there_o therefore_o to_o prevent_v the_o mischief_n and_o great_a disorder_n happen_v daily_o by_o the_o abuse_n of_o such_o house_n it_o be_v further_a enact_v by_o the_o authority_n aforesaid_a that_o no_o taverner_n innkeeper_n alehousekeeper_n or_o victualler_n shilling_n game_n and_o game_n forbid_v in_o publick-house_n on_o pain_n of_o forty_o shilling_n shall_v have_v or_o keep_v in_o or_o about_o their_o house_n outhouse_n yard_n backsides_n garden_n or_o place_n to_o they_o belong_v any_o dice_n card_n table_n bowl_n shuffleboard_n billiard_n coit_n cales_n logat_n or_o any_o other_o implement_n use_v in_o game_n nor_o shall_v suffer_v any_o person_n or_o person_n refort_v unto_o any_o of_o their_o house_n to_o use_v or_o exercise_v any_o of_o the_o say_a game_n or_o any_o other_o unlawful_a game_n or_o sport_n within_o their_o of_o the_o public_a and_o necessary_a charge_n arise_v within_o each_o respective_a county_n in_o this_o province_n be_v it_o ordain_v and_o enact_v by_o the_o governor_n council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o all_o county_n as_o they_o now_o lie_v former_o county_n to_o continue_v as_o former_o and_o be_v name_v continue_v and_o remain_v distinct_a county_n to_o all_o intent_n and_o purpose_n in_o the_o law_n whatsoever_o and_o that_o there_o be_v a_o county_n treasurer_n annual_o choose_v for_o each_o respective_a county_n be_v a_o freeholder_n within_o the_o same_o and_o to_o be_v choose_v by_o the_o vote_n of_o the_o freeholder_n and_o other_o inhabitant_n of_o each_o respective_a town_n due_o qualify_v as_o be_v provide_v by_o the_o act_n for_o the_o choice_n of_o select-man_n and_o other_o town_n officer_n and_o at_o the_o same_o time_n such_o vote_n to_o be_v give_v in_o write_v and_o seal_v up_o by_o the_o constable_n by_o he_o to_o be_v keep_v and_o return_v unto_o the_o next_o quarter_n session_n to_o be_v hold_v for_o say_a county_n there_o to_o be_v open_v and_o sort_v by_o such_o as_o the_o court_n shall_v appoint_v in_o presence_n of_o the_o justice_n county-treasurer_n choice_n of_o county-treasurer_n and_o the_o person_n have_v the_o majority_n of_o say_a vote_n shall_v be_v treasurer_n of_o such_o county_n for_o that_o year_n and_o be_v swear_v before_o say_v court_n and_o for_o the_o due_a and_o equal_a raise_v of_o money_n for_o defray_v of_o the_o charge_n arise_v within_o each_o respective_a county_n for_o the_o necessary_a repair_v and_o amendment_n of_o bridge_n prison_n the_o maintenance_n of_o poor_a prisoner_n and_o all_o other_o proper_a county_n charge_n it_o be_v further_a enact_v by_o the_o authority_n aforesaid_a that_o when_o and_o so_o often_o from_o time_n to_o time_n as_o there_o shall_v be_v need_n of_o raise_v money_n for_o the_o end_n aforesaid_a defray_v county_n charges_n how_o to_o be_v defray_v in_o any_o county_n the_o justice_n in_o quarter_n session_n for_o such_o county_n receive_v information_n thereof_o from_o the_o county_n treasurer_n shall_v agree_v and_o determine_v the_o whole_a sum_n to_o be_v raise_v and_o each_o respective_a town_n proportion_n of_o the_o same_o as_o near_o as_o may_v be_v according_a to_o the_o rule_n for_o raise_v of_o money_n for_o the_o province_n charges_n and_o shall_v issue_v forth_o their_o order_n unto_o the_o select-man_n of_o the_o respective_a town_n to_o assess_v the_o same_o upon_o the_o inhabitant_n of_o such_o town_n each_o one_o his_o due_a and_o equal_a proportion_n thereof_o according_a to_o the_o rule_n before_o mention_v as_o near_o as_o may_v be_v to_o be_v pay_v in_o money_n or_o equivalent_a thereto_o and_o to_o make_v a_o distinct_a list_n of_o each_o person_n name_n and_o proportion_n under_o their_o hand_n and_o such_o list_n commit_v unto_o the_o constable_n or_o constable_n of_o such_o town_n with_o a_o warrant_n sign_v by_o the_o town_n clerk_n direct_v unto_o the_o say_a constable_n or_o constable_n to_o levy_v and_o collect_v the_o say_a assessment_n of_o each_o one_o his_o respective_a proportion_n and_o to_o pay_v in_o their_o say_a collection_n unto_o the_o county_n treasurer_n or_o his_o order_n within_o the_o time_n set_v for_o the_o same_o and_o to_o make_v distress_n upon_o every_o person_n neglect_v or_o refuse_v to_o make_v payment_n and_o in_o default_n of_o good_n or_o chattel_n whereon_o to_o make_v distress_n to_o commit_v the_o party_n to_o the_o common_a goal_n of_o the_o county_n until_o he_o make_v payment_n or_o otherwise_o be_v release_v by_o the_o justice_n in_o quarter_n session_n and_o if_o any_o person_n or_o person_n think_v themselves_o overrated_n in_o any_o such_o assessment_n they_o shall_v be_v ease_v by_o the_o assessor_n make_v the_o same_o to_o appear_v or_o in_o default_n thereof_o by_o the_o court_n of_o quarter_n session_n and_o further_o it_o be_v enact_v that_o all_o money_n so_o collect_v be_v improve_v and_o employ_v for_o the_o end_v within_o mention_v as_o the_o court_n of_o quarter_n session_n shall_v from_o time_n to_o time_n hy_o their_o order_n in_o write_v direct_a and_o appoint_v and_o the_o county_n treasurer_n in_o each_o respective_a county_n shall_v account_n unto_o the_o court_n of_o quarter_n session_n or_o who_o they_o shall_v appoint_v for_o all_o his_o receipt_n and_o payment_n a_o act_n for_o regulate_v of_o township_n choice_n of_o town-officer_n and_o set_v forth_o their_o power_n be_v it_o ordain_v and_o enact_v by_o the_o governor_n penalty_n bound_n of_o township_n to_o contive_a as_o heretofore_o grant_v &_o settle_a and_o to_o be_v run_v and_o mark_n renew_v once_o in_o 3_o year_n under_o a_o penalty_n council_n and_o representatives_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o bound_n of_o all_o township_n shall_v be_v and_o continue_v as_o heretofore_o grant_v and_o settle_v respective_o and_o shall_v be_v run_v betwixt_o town_n and_o town_n and_o mark_n renew_v once_o in_o three_o year_n by_o two_o of_o the_o select-man_n of_o each_o town_n or_o any_o other_o two_o person_n who_o the_o select-man_n shall_v appoint_v the_o select-man_n of_o the_o most_o ancient_a town_n to_o give_v notice_n unto_o the_o select-man_n of_o the_o next_o adjacent_a town_n of_o the_o time_n and_o place_n of_o meet_v for_o such_o perambulation_n six_o day_n beforehand_o on_o pain_n of_o forfeit_v five_o pound_n by_o the_o select-man_n of_o any_o town_n that_o shall_v neglect_v their_o duty_n in_o any_o of_o the_o particular_n aforesaid_a two_o three_o thereof_o unto_o the_o use_n of_o the_o poor_a of_o such_o town_n and_o the_o other_o three_o unto_o the_o select-man_n of_o any_o of_o the_o next_o adjacent_a town_n that_o shall_v inform_v and_o sue_v for_o the_o same_o in_o the_o inferior_a court_n of_o plea_n within_o the_o same_o county_n to_o be_v recover_v by_o action_n or_o information_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o each_o proprietor_n of_o land_n lie_v unfenced_a year_n proprietor_n of_o land_n unfenced_a or_o in_o common_a field_n to_o run_v the_o line_n once_o in_o two_o year_n or_o in_o any_o common_a field_n shall_v once_o in_o two_o year_n on_o six_o day_n warn_v before_o give_v he_o by_o the_o next_o proprietor_n or_o proprietor_n adjoin_v run_v the_o line_n make_v and_o keep_v up_o the_o bound_n between_o they_o by_o sufficient_a met-stone_n on_o pain_n that_o every_o party_n so_o neglect_v or_o refuse_v shall_v forfeit_v the_o sum_n of_o ten_o shilling_n one_o half_a to_o the_o party_n move_v &_o the_o other_o half_a to_o the_o use_n of_o the_o poor_a of_o the_o town_n be_v convent_v &_o convict_v of_o such_o neglect_n or_o refusal_n before_o any_o aforesaid_a that_o the_o proprietor_n of_o the_o undivided_a or_o common_a land_n within_o each_o town_n and_o precinct_n in_o this_o province_n where_o the_o same_o have_v be_v heretofore_o state_v each_o one_o proportion_n be_v know_v shall_v and_o hereby_o be_v empower_v to_o order_n improve_v or_o divide_v in_o such_o way_n and_o manner_n as_o shall_v be_v conclude_v and_o agree_v upon_o by_o the_o major_a part_n of_o the_o interest_v the_o voice_n to_o be_v collect_v and_o account_v according_a to_o the_o interest_n improve_v some_o more_o land_n how_o to_o be_v improve_v and_o the_o proprietor_n of_o all_o undivided_a or_o common_a land_n not_o state_v and_o proportion_v as_o aforesaid_a shall_v and_o hereby_o be_v improve_v to_o manage_n improve_v divide_v or_o dispose_v of_o the_o same_o as_o have_v be_v or_o shall_v be_v conclude_v and_o agree_v on_o by_o the_o major_a part_n of_o such_o proprietor_n that_o no_o cottage_n or_o dwelling-place_n in_o any_o town_n shall_v be_v admit_v to_o the_o privilege_n of_o commonage_n for_o wood_n timber_n and_o herbage_n or_o any_o other_o the_o privilege_n which_o lie_v in_o common_a in_o any_o town_n or_o peculiar_a other_o than_o such_o as_o be_v erect_v or_o privilege_v by_o the_o grant_n of_o such_o town_n or_o peculiar_a before_o the_o year_n one_o thousand_o six_o hundred_o sixty_o one_o or_o that_o have_v be_v since_o or_o shall_v hereafter_o be_v grant_v by_o the_o consent_n of_o any_o town_n or_o peculiar_a and_o whereas_o it_o have_v be_v a_o continue_a practice_n and_o custom_n in_o the_o several_a town_n within_o this_o province_n
order_n in_o each_o respective_a town_n within_o this_o province_n shall_v warn_v a_o meeting_n of_o such_o town_n have_v order_n for_o the_o same_o in_o write_v on_o pain_n that_o every_o constable_n neglect_v his_o duty_n in_o that_o respect_n and_o be_v thereof_o convict_v before_o one_o justice_n of_o the_o peace_n shall_v forfeit_v the_o sum_n of_o twenty_o shilling_n neglect_v penalty_n for_o neglect_v to_o the_o use_v of_o the_o poor_a of_o such_o town_n and_o to_o be_v levy_v by_o distress_n and_o sale_n of_o such_o offender_n good_a by_o warrant_n from_o such_o justice_n of_o the_o peace_n upon_o neglect_n or_o refusal_n of_o payment_n and_o in_o case_n the_o select_a man_n in_o any_o town_n shall_v unreasonable_o deny_v to_o call_v a_o meeting_n of_o the_o inhabitant_n of_o such_o town_n case_n justice_z to_o give_v warrant_n for_o town-meeting_a in_o case_n upon_o any_o public_a occasion_n thereof_o the_o same_o be_v complain_v of_o and_o make_v to_o appear_v to_o one_o of_o the_o next_o justice_n of_o the_o peace_n within_o the_o same_o county_n such_o justice_n by_o his_o warrant_n direct_v to_o the_o constable_n or_o constable_n may_v order_v a_o meeting_n of_o the_o inhabitant_n of_o such_o town_n therein_o signify_v the_o occasion_n thereof_o a_o act_n for_o make_v of_o land_n and_o tenement_n liable_a to_o the_o payment_n of_o debt_n whereas_o the_o estate_n of_o person_n within_o this_o province_n do_v chief_o consist_v of_o house_n and_o land_n which_o give_v they_o credit_n some_o be_v remiss_a in_o pay_v of_o their_o just_a debt_n other_o happen_v to_o die_v before_o they_o have_v discharge_v the_o same_o it_o be_v therefore_o ordain_v and_o enact_v by_o the_o governor_n council_n and_o representative_n convene_v in_o general_a court_n and_o by_o the_o authority_n of_o the_o same_o that_o all_o land_n or_o tenement_n belong_v to_o any_o person_n in_o his_o own_o proper_a right_n in_o fee_n simple_n shall_v stand_v charge_v with_o the_o payment_n of_o all_o just_a debt_n owe_v by_o such_o person_n as_o well_o as_o his_o personal_a estate_n and_o shall_v be_v liable_a to_o be_v take_v in_o execution_n for_o satisfaction_n of_o the_o same_o where_o the_o debtor_n or_o his_o attorney_n shall_v not_o expose_v to_o view_v and_o tender_a to_o the_o officer_n personal_n estate_n sufficient_a to_o answer_v the_o sum_n mention_v in_o the_o execution_n with_o the_o charge_n and_o all_o execution_n due_o serve_v upon_o any_o such_o house_n and_o land_n be_v return_v into_o the_o clerk_n office_n of_o the_o court_n out_o of_o which_o the_o same_o issue_v and_o there_o record_v shall_v make_v a_o good_a title_n to_o the_o party_n for_o who_o they_o be_v so_o take_v his_o heir_n and_o assign_v for_o ever_o debt_n superior_a court_n may_v empower_v executor_n administrator_n to_o sell_v land_n for_o payment_n of_o debt_n also_o where_o the_o good_n and_o movable_n of_o any_o person_n decease_a shall_v not_o be_v sufficient_a to_o answer_v the_o just_a debt_n which_o the_o decease_a owe_v upon_o representation_n thereof_o and_o make_v the_o same_o to_o appear_v unto_o the_o superior_a court_n within_o the_o county_n where_o such_o decease_a person_n last_o dwell_v the_o say_a court_n be_v hereby_o empower_v to_o licence_n and_o authorize_v the_o executor_n or_o administrator_n of_o such_o person_n decease_a to_o make_v sale_n of_o all_o or_o any_o part_n of_o the_o house_n and_o land_n of_o the_o decease_a so_o far_o as_o shall_v be_v necessary_a to_o satisfy_v the_o just_a debt_n which_o the_o decease_a owe_v at_o the_o time_n of_o his_o death_n and_o every_o executor_n or_o administrator_n be_v so_o license_v and_o authorize_v shall_v and_o may_v by_o virtue_n of_o such_o authority_n make_v and_o execute_v deed_n or_o conveyance_n in_o due_a form_n for_o such_o house_n and_o land_n as_o they_o shall_v so_o sell_v which_o instrument_n shall_v be_v a_o good_a title_n to_o the_o purchaser_n and_o further_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o where_o any_o person_n shall_v make_v sale_n or_o other_o alienation_n of_o any_o land_n or_o tenement_n to_o he_o of_o right_n belong_v with_o intent_n to_o defeat_v and_o defraud_v his_o creditor_n of_o their_o just_a debs_n not_o bona_fw-la fide_fw-la for_o good_a and_o valuable_a consideration_n pay_v all_o such_o sales_n and_o alienation_n be_v to_o be_v deem_v covenous_a and_o fraudulent_a and_o shall_v be_v of_o none_o effect_v to_o bar_n any_o creditor_n from_o such_o debt_n as_o be_v to_o he_o owe_v a_o act_n for_o due_a regulation_n of_o weight_n and_o measure_n to_o the_o end_n that_o weight_n and_o measure_n may_v be_v one_o and_o the_o same_o throughout_o this_o their_o majesty_n province_n be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o brass_n and_o copper_n weight_n and_o measure_n former_o send_v out_o of_o england_n with_o certificate_n out_o of_o their_o majesty_n exchequer_n to_o be_v approve_v winchester_n measure_n according_a to_o the_o standard_n in_o the_o exchequer_n be_v the_o public_a allow_v standard_n throughout_o this_o their_o majesty_n province_n for_o the_o prove_v and_o seal_v all_o weight_n and_o measure_n thereby_o and_o the_o constable_n of_o every_o town_n throughout_o this_o province_n not_o already_o supply_v shall_v within_o three_o month_n next_o come_n provide_v upon_o the_o town_n charge_v one_o bushel_n one_o half_a bushel_n one_o peck_n one_o half_a peck_n one_o ale_n quart_n one_o wine-pint_n and_o half-pint_n one_o ell_n one_o yard_n one_o sett_n of_o brass_n weight_n to_o four_o pound_n after_o sixteen_o ounce_n to_o the_o pound_n with_o fit_a scale_n and_o steel_n beam_n try_v and_o prove_v by_o the_o aforesaid_a standard_n and_o seal_v by_o the_o treasurer_n or_o his_o deputy_n in_o his_o presence_n which_o shall_v be_v keep_v and_o use_v only_o for_o standard_n in_o the_o several_a town_n who_o be_v hereby_o authorize_v to_o do_v the_o same_o for_o which_o he_o shall_v receive_v from_o the_o constable_n of_o each_o town_n twopence_n for_o every_o weight_n and_o measure_n so_o try_v and_o prove_v and_o seal_v and_o the_o constable_n of_o every_o town_n shall_v commit_v those_o weight_n and_o measure_n unto_o the_o custody_n of_o the_o select-man_n of_o their_o town_n for_o the_o time_n be_v who_o with_o the_o constable_n be_v hereby_o enjoin_v to_o choose_v one_o able_a man_n for_o sealer_n of_o all_o weight_n and_o measure_n for_o their_o town_n from_o time_n to_o time_n and_o till_o another_o be_v choose_v who_o shall_v be_v present_v unto_o the_o next_o court_n of_o session_n and_o there_o swear_v to_o the_o faithful_a discharge_n of_o his_o duty_n and_o shall_v have_v power_n to_o send_v forth_o his_o warrant_n by_o the_o constable_n to_o all_o the_o inhabitant_n of_o such_o town_n to_o bring_v in_o all_o such_o weight_n and_o measure_n as_o they_o make_v use_v of_o in_o the_o month_n of_o april_n from_o year_n to_o year_n at_o such_o time_n and_o place_n as_o he_o shall_v appoint_v and_o make_v return_n to_o the_o sealer_n in_o write_v of_o all_o person_n so_o summon_v that_o then_o and_o there_o all_o such_o weight_n and_o measure_n may_v be_v prove_v and_o seal_v with_o the_o town_n seal_n which_o be_v likewise_o to_o be_v provide_v by_o the_o constable_n at_o each_o town_n charge_v who_o shall_v have_v for_o every_o weight_n and_o measure_n so_o seal_v one_o penny_n from_o the_o owner_n thereof_o at_o the_o first_o seal_v and_o all_o such_o weight_n and_o measure_n as_o can_v be_v bring_v to_o their_o just_a standard_n he_o shall_v deface_v and_o destroy_v and_o after_o the_o first_o seal_v shall_v have_v nothing_o so_o long_o as_o they_o continue_v just_a with_o the_o standard_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n select_a man_n or_o sealer_n do_v not_o due_o execute_v this_o law_n so_o far_o as_o to_o each_o &_o every_o of_o they_o appertain_v they_o &_o each_o of_o they_o shall_v forfeit_v to_o their_o majesty_n for_o every_o such_o neglect_n by_o the_o space_n of_o one_o month_n the_o sum_n of_o forty_o shilling_n towards_o the_o support_n of_o their_o government_n here_o and_o every_o person_n neglect_v to_o bring_v in_o their_o weight_n &_o measure_n at_o the_o time_n and_o place_n appoint_v be_v due_o warn_v thereto_o shall_v likewise_o forfeit_v three_o shilling_n and_o fourpence_n the_o one_o half_n whereof_o to_o be_v to_o their_o majesty_n as_o aforesaid_a the_o other_o half_o to_o the_o sealer_n aforesaid_a in_o every_o sea-port-town_n within_o this_o province_n the_o constable_n or_o constable_n be_v to_o provide_v upon_o the_o town_n charge_v one_o hundred_o weight_n one_o half_n hundred_o one_o quarter_n of_o a_o hundred_o and_o one_o fourteen_o pound_n weight_n make_v of_o iron_n to_o be_v try_v prove_v and_o seal_v as_o aforesaid_a and_o be_v keep_v as_o standard_n in_o the_o say_v several_a town_n to_o be_v use_v as_o before_o for_o other_o weight_n and_o measure_n be_v direct_v a_o act_n against_o the_o counterfeit_n clip_v round_v file_v or_o impair_v of_o coin_n whereas_o divers_a false_a and_o evil_a dispose_a person_n have_v attempt_v and_o practise_v for_o wicked_a lucre_n and_o gain_n sake_n to_o diminish_v impair_v and_o falsify_v the_o money_n and_o coin_n currant_n within_o this_o province_n by_o counterfeit_v or_o clip_v round_v or_o file_v thereof_o not_o only_o to_o the_o great_a discredit_v of_o the_o province_n and_o the_o government_n thereof_o but_o also_o to_o the_o great_a loss_n and_o damage_n of_o their_o majesty_n subject_n and_o more_o be_v like_a to_o be_v if_o the_o same_o be_v not_o speedy_o meet_v withal_o and_o prevent_v for_o remedy_n whereof_o be_v it_o enact_v and_o declare_v and_o establish_v by_o the_o governor_n council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o coin_n of_o the_o late_a massachusetts_n colony_n currant_n massachusetts_n coin_n &_o piece_n of_o eight_o of_o 17_o penny_n weight_n make_v currant_n shall_v pass_v currant_n at_o the_o rate_n it_o be_v stamp_v for_o and_o piece_n of_o eight_o sevil_n pillar_n and_o mexico_n of_o full_a seventeen_o penny_n weight_n shall_v pass_v currant_n at_o six_o shilling_n per_fw-la otherwise_o diminish_v coin_n penalty_n for_o counterfeit_v clip_v &c._n &c._n of_o coin_n or_o debase_v any_o of_o the_o money_n and_o coin_n currant_n within_o this_o province_n be_v thereof_o lawful_o convict_v before_o the_o justice_n of_o assize_n shall_v forfeit_v double_a the_o value_n of_o the_o money_n so_o counterfeit_v clip_v round_v or_o file_v one_o half_n to_o their_o majesty_n towards_o the_o support_n of_o the_o government_n and_o the_o other_o half_n to_o the_o informer_n and_o shall_v also_o stand_v in_o the_o pillory_n in_o some_o open_a place_n in_o the_o shire_n town_n of_o that_o county_n where_o the_o offence_n be_v commit_v and_o there_o have_v one_o of_o his_o ear_n cut_v off_o a_o act_n for_o the_o regulate_a and_o encouragement_n of_o fishery_n upon_o consideration_n of_o great_a damage_n and_o scandal_n that_o have_v happen_v upon_o the_o account_n of_o pickle_a fish_n although_o afterward_o dry_v and_o hardly_o discoverable_a to_o the_o great_a convene_v in_o general_a court_n or_o assembly_n and_o it_o be_v enact_v by_o the_o authority_n of_o the_o same_o that_o no_o person_n or_o person_n whatsoever_o july_n no_o mackerel_n to_o be_v salt_v up_o before_o the_o first_o of_o july_n after_o the_o publication_n hereof_o shall_v save_o or_o salt_n any_o sort_n of_o fish_n that_o it_o intend_v to_o be_v dry_v in_o cask_n or_o fat_n or_o her_o trial_n or_o discharge_v in_o due_a course_n of_o law_n or_o in_o case_n of_o sudden_a fire_n or_o infection_n or_o other_o necessity_n and_o if_o any_o person_n or_o person_n shall_v after_o such_o commitment_n aforesaid_a make_v out_o and_o sign_n or_o countersign_v any_o warrant_n or_o warrant_n for_o such_o removal_n aforesaid_a contrary_n to_o this_o act_n as_o well_o he_o that_o make_v or_o sign_n or_o counter-sign_n such_o warrant_n or_o warrant_n as_o the_o officer_n or_o officer_n that_o obey_v or_o execute_v the_o same_o shall_v suffer_v and_o incur_v the_o pain_n and_o forfeiture_n in_o this_o act_n before_o mention_v both_o for_o the_o first_o and_o second_o offence_n respective_o to_o be_v recover_v in_o manner_n aforesaid_a by_o the_o party_n grieve_v provide_v also_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a corpus_fw-la penalty_n etc._n etc._n for_o deny_v a_o habeas_fw-la corpus_fw-la that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o prisoner_n and_o prisoner_n as_o aforesaid_a to_o move_v and_o obtain_v he_o or_o their_o habeas_fw-la corpus_fw-la and_o if_o the_o say_a justice_n for_o the_o time_n be_v or_o any_o of_o they_o in_o or_o out_o of_o court_n upon_o view_n of_o the_o copy_n or_o copy_n of_o the_o warrant_n or_o warrant_n of_o commitment_n or_o detainer_n or_o upon_o oath_n make_v that_o such_o copy_n or_o copy_n be_v deny_v as_o aforesaid_a shall_v deny_v any_o writ_n of_o habeas_fw-la corpus_fw-la by_o this_o act_n require_v to_o be_v grant_v be_v move_v for_o as_o aforesaid_a they_o shall_v several_o forfeit_v to_o the_o prisoner_n or_o party_n grieve_v the_o sum_n of_o one_o hundred_o pound_n to_o be_v recover_v in_o manner_n aforesaid_a provide_v always_o and_o be_v it_o enact_v that_o no_o person_n or_o person_n shall_v be_v sue_v implead_v make_v prosecution_n for_o offence_n within_o what_o time_n to_o be_v make_v molest_v or_o trouble_v for_o any_o offence_n against_o this_o act_n unless_o the_o party_n offend_a be_n sue_v or_o implead_v for_o the_o same_o within_o two_o year_n at_o the_o most_o after_o such_o time_n wherein_o the_o offence_n shall_v be_v commit_v in_o case_n the_o party_n grieve_v shall_v not_o be_v then_o in_o prison_n and_o if_o he_o shall_v be_v in_o prison_n then_o within_o the_o space_n of_o two_o year_n after_o the_o decease_n of_o the_o person_n imprison_v or_o he_o or_o her_o delivery_n out_o of_o prison_n which_o shall_v first_o happen_v and_o to_o the_o intent_n no_o person_n may_v avoid_v his_o trial_n at_o the_o assize_n or_o general_a goal_n delivery_n by_o procure_v his_o removal_n before_o the_o assize_n at_o such_o time_n as_o he_o can_v be_v bring_v back_o to_o receive_v his_o trial_n there_o be_v it_o enact_v that_o after_o the_o assize_n proclaim_v for_o or_o within_o that_o county_n where_o the_o prisoner_n be_v detain_v no_o person_n shall_v be_v remove_v from_o the_o common_a goal_n upon_o any_o habeas_fw-la corpus_fw-la grant_v in_o pursuance_n of_o this_o act_n but_o upon_o any_o such_o habeas_fw-la corpus_fw-la shall_v be_v bring_v before_o the_o justice_n of_o assize_n in_o open_a court_n who_o be_v thereupon_o to_o do_v what_o to_o justice_n shall_v appertain_v provide_v nevertheless_o that_o after_o the_o assize_n be_v end_v any_o person_n or_o person_n detain_v may_v have_v his_o or_o her_o habeas_fw-la corpus_fw-la according_a to_o the_o direction_n and_o intention_n of_o this_o act._n and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o information_n suit_n or_o action_n shall_v be_v bring_v or_o exhibit_v against_o any_o person_n or_o person_n for_o any_o offence_n commit_v or_o to_o be_v commit_v against_o the_o form_n of_o this_o law_n it_o shall_v be_v lawful_a for_o such_o defendant_n to_o plead_v the_o general_a issue_n that_o they_o be_v not_o guilty_a or_o that_o they_o owe_v nothing_o and_o to_o give_v such_o special_a matter_n in_o evidence_n to_o the_o jury_n that_o shall_v try_v the_o same_o which_o matter_n be_v plead_v have_v be_v good_a and_o sufficient_a matter_n in_o law_n to_o have_v discharge_v the_o say_a defendant_n or_o defendant_n against_o the_o say_a information_n suit_n or_o action_n and_o the_o say_a matter_n shall_v be_v then_o as_o available_a to_o he_o or_o they_o to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o they_o have_v sufficient_o plead_v set_v forth_o or_o allege_v the_o say_a matter_n in_o bar_n or_o discharge_v of_o such_o information_n suit_n or_o action_n a_o act_n for_o the_o revise_v of_o a_o act_n for_o continue_v of_o the_o local_a law_n and_o one_o other_o act_n for_o send_v of_o soldier_n to_o the_o relief_n of_o the_o neighbour_a province_n and_o colony_n whereas_o at_o the_o session_n of_o this_o court_n in_o june_n last_o pass_v a_o act_n be_v make_v entitle_v a_o act_n for_o continue_v the_o local_a law_n to_o stand_v in_o part_n of_o it_o be_v and_o hereby_o be_v revive_v and_o continue_v in_o full_a force_n to_o all_o intent_n and_o purpose_n from_o and_o after_o the_o say_v ten_o day_n of_o november_n and_o shall_v so_o continue_v until_o the_o general_n assembly_n shall_v take_v further_a order_n and_o whereas_o at_o the_o aforesaid_a session_n one_o other_o act_n be_v make_v entitutle_v a_o act_n for_o transport_v of_o part_n of_o the_o militia_n of_o the_o province_n or_o oblige_v they_o to_o march_v to_o the_o relief_n of_o the_o neighbour_a province_n or_o colony_n which_o act_n be_v also_o near_o expire_v and_o forasmuch_o as_o in_o this_o time_n of_o war_n there_o may_v happen_v frequent_a occasion_n for_o relief_n to_o be_v give_v unto_o the_o neighbour_a province_n it_o be_v therefore_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a act_n and_o every_o part_n of_o it_o be_v and_o hereby_o be_v revive_v and_o continue_v in_o full_a force_n to_o
