the_o offender_n good_n and_o in_o case_n of_o the_o poverty_n of_o the_o say_a offender_n upon_o the_o good_n and_o chattel_n of_o any_o other_o offender_n who_o shall_v be_v then_o convict_v in_o and_o industry_n in_o discover_v and_o disperse_v and_o punish_v such_o conventicle_n from_o hence_o observe_v these_o thing_n observe_v 1._o that_o though_o person_n be_v convict_v yet_o constable_n have_v no_o power_n to_o make_v distress_n upon_o any_o man_n good_n without_o a_o warrant_n under_o the_o hand_n and_o seal_n of_o some_o justice_n of_o the_o peace_n or_o chief_a magistrate_n observe_v 2._o that_o when_o constable_n have_v a_o warrant_n to_o make_v distress_n this_o act_n do_v not_o empower_v they_o to_o break_v open_a any_o man_n door_n that_o so_o they_o may_v take_v away_o his_o good_n neither_o do_v it_o require_v they_o to_o lurk_v about_o man_n house_n to_o find_v opportunity_n that_o they_o may_v surprise_v man_n house_n and_o therefore_o they_o be_v officer_n of_o the_o peace_n aught_o to_o depart_v in_o peace_n observe_v 3._o that_o such_o officer_n must_v be_v sure_a that_o when_o they_o make_v distress_n it_o be_v upon_o the_o offender_n own_o good_n and_o not_o the_o good_n of_o other_o man_n which_o may_v be_v in_o the_o offender_n hand_n lest_o they_o meet_v with_o such_o trouble_n as_o they_o may_v not_o easy_o defend_v by_o law_n observe_v 4._o that_o the_o three_o part_n of_o such_o fine_n may_v be_v give_v to_o the_o diligent_a assister_n as_o well_o as_o to_o the_o informer_n so_o that_o the_o informer_n may_v have_v but_o poor_a wage_n if_o the_o justice_n shall_v appoint_v any_o other_o person_n to_o be_v helpful_a in_o the_o same_o work_n and_o the_o three_o part_n of_o fine_n distribute_v as_o aforesaid_a seven_o particular_a to_o be_v consider_v in_o the_o aforesaid_a act_n be_v the_o penalty_n of_o every_o person_n who_o shall_v take_v upon_o he_o to_o preach_v or_o teach_v in_o any_o such_o meeting_n most_o legal_a way_n to_o determine_v offencest_n against_o the_o law_n in_o matter_n between_o the_o king_n and_o the_o subject_a and_o between_o man_n and_o man_n be_v by_o juries_n of_o wise_a and_o honest_a man_n and_o therefore_o the_o king_n and_o parliament_n by_o this_o act_n have_v not_o give_v the_o whole_a and_o sole_a determine_v of_o the_o case_n therein_o contain_v to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n ten_o particular_a to_o be_v consider_v it_o be_v further_a provide_v by_o the_o authority_n aforesaid_a that_o justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o constable_n head-borough_n and_o tything-man_n by_o warrant_n from_o the_o say_a justice_n or_o chief_a magistrate_n respective_o shall_v and_o may_v take_v with_o they_o such_o aid_n and_o force_n as_o they_o shall_v think_v fit_a to_o break_v open_a and_o enter_v any_o house_n or_o other_o place_n after_o refusal_n or_o denial_n and_o that_o forcible_n entry_n into_o any_o house_n or_o place_n without_o first_o a_o denial_n or_o refusal_n of_o entrance_n which_o therefore_o ought_v first_o to_o be_v fair_o demand_v observe_v 4._o that_o the_o officer_n must_v first_o be_v sure_a that_o it_o be_v such_o a_o meeting_n or_o conventicle_n as_o be_v aforesaid_a viz._n seditious_a and_o that_o contrive_v insurrection_n observe_v 5._o that_o whereas_o lieutenant_n deputy-lieutenant_n sheriff_n commissionated_a officer_n of_o the_o militia_n and_o other_o his_o majesty_n force_n of_o horse_n and_o foot_n and_o other_o magistrate_n joint_o or_o several_o be_v mention_v to_o assist_v in_o this_o work_n of_o prevent_v and_o suppress_v such_o meeting_n they_o be_v not_o to_o run_v in_o this_o work_n of_o their_o own_o accord_n be_v put_v to_o trouble_v and_o his_o majesty_n subject_n amaze_v without_o just_a cause_n observe_v 7._o magistrate_n and_o other_o officer_n have_v need_n remember_v and_o consider_v that_o there_o be_v a_o act_n of_o parliament_n since_o this_o against_o conventicle_n which_o forbid_v the_o execution_n of_o any_o writ_n warrant_v process_n order_n judgement_n or_o decree_n upon_o the_o lordsday_n except_o in_o case_n of_o treason_n felony_n or_o breach_n of_o the_o peace_n if_o any_o shall_v presume_v to_o say_v that_o the_o peaceable_a meeting_n of_o protestant_a dissenter_n who_o spend_v their_o time_n in_o pray_v to_o the_o god_n of_o peace_n for_o the_o peace_n of_o their_o own_o soul_n and_o the_o peace_n of_o the_o realm_n and_o that_o preach_v the_o gospel_n of_o peace_n whereby_o the_o best_a peace_n be_v maintain_v in_o family_n city_n and_o kingdom_n be_v a_o breach_n of_o the_o public_a peace_n of_o this_o kingdom_n it_o may_v be_v safe_o conclude_v that_o such_o man_n do_v not_o well_o understand_v god_n law_n nor_o the_o king_n law_n eleven_o particular_a to_o be_v consider_v be_v the_o prosecution_n of_o the_o aforesaid_a act_n against_o a_o peer_n of_o this_o realm_n who_o be_v a_o offender_n provide_v that_o no_o peer_n of_o this_o realm_n shall_v have_v his_o house_n search_v where_o he_o or_o his_o wife_n shall_v be_v then_o resident_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v observe_v this_o part_n of_o the_o act_n show_v the_o difference_n between_o the_o prosecute_n of_o a_o peer_n and_o a_o twelve_o particular_a to_o be_v consider_v be_v the_o default_n of_o constable_n and_o other_o officer_n that_o if_o any_o constable_n head-borough_n tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v wiehin_n his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n or_o if_o any_o person_n lawful_o call_v in_o aid_n of_o the_o aforesaid_a officer_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o be_v levy_v upon_o his_o good_n and_o chattel_n as_o aforesaid_a from_o this_o part_n of_o the_o act_n observe_v these_o thing_n observe_v 1._o that_o constable_n and_o other_o officer_n be_v to_o have_v certain_a knowledge_n of_o such_o meeting_n before_o they_o proceed_v to_o prosecute_v this_o law_n against_o they_o observe_v 2._o that_o this_o knowledge_n must_v be_v such_o as_o may_v reach_v to_o the_o conviction_n of_o the_o offender_n and_o therefore_o they_o must_v so_o know_v as_o they_o may_v be_v able_a to_o swear_v matter_n of_o fact_n express_v in_o this_o act._n observe_v 3._o that_o they_o can_v so_o know_v of_o the_o aforesaid_a meeting_n with_o out_o they_o be_v present_a there_o and_o take_v notice_n who_o it_o be_v that_o preach_v and_o the_o matter_n that_o be_v preach_v whether_o it_o be_v seditious_a and_o promote_v insurrection_n observe_v 4._o that_o this_o act_n do_v not_o require_v the_o aforesaid_a officer_n to_o make_v it_o their_o business_n to_o seek_v out_o and_o hunt_v after_o such_o meeting_n so_o as_o to_o neglect_v their_o own_o be_v at_o church_n to_o hear_v the_o word_n of_o god_n for_o the_o welfare_n of_o their_o own_o soul_n observe_v 5._o
for_o want_v of_o knowledge_n the_o officer_n be_v require_v to_o proceed_v upon_o credible_a information_n not_o every_o or_o any_o kind_n of_o information_n but_o credible_a information_n and_o that_o be_v such_o as_o this_o act_n require_v viz._n the_o oath_n of_o two_o witness_n before_o a_o justice_n of_o the_o peace_n or_o chief_a magistrate_n observe_v 6._o that_o if_o after_o all_o this_o the_o aforesaid_a officer_n shall_v willing_o and_o witting_o omit_v their_o duty_n and_o be_v convict_v as_o in_o manner_n aforesaid_a than_o they_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o be_v levy_v upon_o their_o good_n and_o chattel_n and_o dispose_v of_o in_o manner_n aforesaid_a observe_v 7._o that_o the_o officer_n must_v be_v convict_v of_o their_o offence_n as_o aforesaid_a and_o that_o be_v by_o the_o oath_n of_o two_o witness_n thirteen_o particular_a to_o be_v consider_v be_v the_o fault_n and_o punishment_n mention_v without_o doubt_n inquire_v whether_o the_o meeting_n inform_v against_o be_v for_o godly_a instruction_n or_o whether_o they_o be_v seditious_a conventicle_n to_o contrive_v insurrection_n or_o such_o meeting_n as_o be_v inconsistent_a with_o the_o practice_n of_o the_o church_n of_o england_n observe_v 3._o that_o if_o upon_o proof_n of_o such_o meeting_n the_o one_o hundred_o pound_n be_v recover_v than_o it_o be_v to_o be_v divide_v between_o the_o king_n and_o the_o informer_n observe_v 4._o that_o the_o poor_a of_o the_o parish_n be_v quite_o shut_v out_o from_o have_v any_o benefit_n of_o the_o say_v hundred_o pound_n but_o let_v we_o now_o proceed_v to_o the_o fourtenth_n particular_a to_o be_v consider_v in_o this_o act_n that_o if_o any_o person_n be_v sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o then_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n or_o if_o the_o plaintiff_n discontinue_v his_o action_n the_o particular_a crime_n express_v in_o this_o act_n viz._n seditious_a conventicle_n contrive_v insurrection_n observe_v 3._o if_o the_o plaintiff_n be_v nonsuit_n or_o discontinue_v his_o action_n or_o if_o a_o verdict_n pass_v for_o the_o defendant_n or_o upon_o demurrer_n judgement_n be_v give_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o treble_a cost_n observe_v 4._o that_o such_o as_o will_v venture_v a_o trial_n at_o law_n with_o the_o dissent_v protestant_n as_o the_o transgressor_n of_o this_o act_n in_o hope_n to_o have_v treble_a cost_n may_v meet_v with_o a_o great_a disappointment_n if_o there_o be_v a_o wise_a and_o honest_a jury_n who_o understand_v law_n and_o good_a reason_n fifteen_o particular_a to_o be_v consider_v in_o the_o aforesaid_a act_n that_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o from_o hence_o observe_v these_o thing_n observe_v 1._o that_o these_o large_a expression_n be_v not_o a_o licence_n to_o commit_v violence_n either_o upon_o the_o person_n or_o the_o good_n of_o any_o of_o his_o majesty_n subject_n contrary_a to_o other_o law_n especial_o that_o law_n call_v magna_fw-la charta_fw-la observe_v 2._o that_o if_o any_o person_n under_o pretence_n of_o prosecute_a this_o act_n shall_v commit_v violence_n viz._n shall_v wound_n or_o beat_v any_o of_o his_o majesty_n peaceable_a subject_n may_v be_v indict_v for_o a_o riot_n or_o if_o they_o shall_v kill_v any_o of_o they_o such_o prosecutor_n may_v be_v indict_v for_o murder_n or_o if_o they_o shall_v violent_o break_v open_a man_n house_n to_o force_v away_o their_o good_n such_o may_v be_v indict_v of_o felony_n notwithstanding_o the_o large_a and_o beneficial_a construe_v of_o the_o aforesaid_a act._n observe_v 3._o the_o best_a way_n to_o escape_v harm_n be_v not_o to_o do_v harm_n and_o therefore_o the_o prosecutor_n of_o this_o and_o another_o law_n have_v need_n take_v heed_n that_o they_o do_v not_o run_v upon_o strange_a interpretation_n but_o act_n according_a to_o the_o plain_a expression_n in_o the_o law_n sixteenth_o particular_a to_o be_v consider_v that_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n or_o chief-magistrate_n that_o convict_v the_o aforesaid_a person_n shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_n to_o any_o justice_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n which_o say_v justice_n or_o chief_a magistrate_n be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v from_o her_o husband_n be_v the_o offender_n and_o be_v eonvict_v as_o afore_o say_v the_o penalty_n of_o five_o and_o ten_o shilling_n shall_v be_v levy_v upon_o the_o good_n and_o chattle_n of_o the_o husband_n observe_v that_o no_o high_a than_o ten_o shilling_n fine_a can_v be_v impose_v upon_o a_o wife_n live_v with_o her_o husband_n the_o sum_n of_o ten_o pound_n can_v be_v impose_v and_o follow_a and_o conclude_v word_n of_o this_o act._n two_o and_o twenty_o particular_a but_o that_o his_o majesty_n and_o his_o heir_n and_o successor_n may_v from_o time_n to_o time_n at_o all_o time_n hereafter_o exercise_n and_o enjoy_v all_o power_n and_o authority_n in_o ecclesiastical_a affair_n as_o full_o and_o as_o ample_o as_o himself_o or_o any_o of_o his_o predecessor_n have_v or_o
