more_o assemble_v together_o over_o and_o beside_o those_o of_o the_o same_o household_n if_o it_o be_v in_o a_o house_n where_o there_o be_v a_o family_n inhabit_v or_o if_o it_o be_v in_o a_o house_n field_n or_o place_n where_o there_o be_v no_o family_n inhabit_v then_o where_o any_o five_o person_n or_o more_o be_v so_o assemble_v as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o one_o or_o more_o justice_n of_o the_o peace_n of_o the_o county_n limit_v division_n corporation_n or_o liberty_n wherein_o the_o offence_n aforesaid_a shall_v be_v commit_v the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o ten_o shilling_n and_o such_o offendor_n shall_v find_v himself_o aggrieve_v it_o shall_v and_o may_v be_v lawful_a for_o he_o within_o one_o week_n after_o the_o say_a penalty_n or_o money_n charge_v shall_v be_v pay_v or_o levy_v to_o appeal_v in_o write_v from_o the_o person_n or_o person_n convict_v judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n the_o say_a justice_n at_o the_o session_n shall_v give_v treble_a cost_n against_o such_o offender_n for_o his_o unjust_a appeal_n 5._o and_o no_o other_o court_n whatsoever_o shall_v intermeddle_v with_o any_o cause_n or_o cause_n of_o appeal_n upon_o this_o act_n but_o they_o shall_v be_v final_o determine_v in_o the_o quarter-session_n only_o 7._o provide_v always_o and_o be_v it_o further_o enact_v that_o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a the_o person_n or_o person_n appellant_n shall_v enter_v before_o the_o person_n or_o person_n convict_v into_o a_o recognizance_n to_o prosecute_v the_o say_a appeal_n with_o effect_n 2._o which_o say_v recognizance_n the_o person_n or_o person_n convict_v be_v hereby_o impower_v to_o take_v and_o require_v to_o certify_v the_o same_o to_o the_o next_o quarter_n session_n 3._o and_o in_o case_n no_o such_o recognizance_n be_v enter_v into_o the_o say_a appeal_n to_o be_v null_n and_o void_a 8._o provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o 9_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justices_z of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tythingman_n by_o warrant_n from_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o shall_v and_o may_v with_o what_o aid_n force_v and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v of_o any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberty_n as_o without_o 2._o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act_n 3._o and_o that_o the_o lieutenant_n or_o deputy_n lieutenant_n or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o of_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n 10._o provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v then_o be_v resident_n shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy_n lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v 11._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n headborough_z tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n headborough_z tything-man_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o aid_n of_o the_o constable_n headborough_z or_o tything-man_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v lie_v 12._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n 2._o and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n every_o such_o defendant_n construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o 2._o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n 3._o and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o peace_n or_o chief_a magistrate_n before_o who_o he_o and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o the_o husband_n of_o each_o feme-covert_n 17._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o virtue_n or_o force_n of_o this_o act_n any_o thing_n matter_n or_o clause_n therein_o to_o the_o contrary_a notwithstanding_o 18._o provide_v also_o religious_a worship_n that_o be_v where_o the_o conventicler_n meet_v together_o under_o a_o pretence_n of_o worship_n not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o indeed_o to_o carry_v on_o ill_a design_n against_o the_o state_n 2._o if_o any_o such_o conventicle_n be_v the_o justices_z know_v it_o by_o the_o oath_n of_o two_o witness_n may_v make_v a_o record_n thereof_o and_o then_o the_o person_n so_o offend_v shall_v forfeit_v so_o as_o in_o the_o act_n you_o have_v hear_v 3._o it_o must_v appear_v upon_o oath_n before_o the_o justice_n or_o confession_n of_o the_o party_n 1._o that_o it_o be_v a_o seditious_a conventicle_n meet_v together_o to_o disturb_v the_o peace_n under_o pretence_n of_o religion_n 2._o that_o the_o worship_n there_o practise_v be_v not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n so_o that_o the_o informer_n must_v be_v present_a the_o whole_a time_n chancellor_n or_o lord_n keeper_n or_o such_o justice_n or_o baron_n before_o who_o the_o prisoner_n shall_v be_v bring_v as_o aforesaid_a shall_v discharge_v the_o say_a prisoner_n from_o his_o imprisonment_n take_v his_o or_o their_o recognizance_n with_o one_o or_o more_o surety_n or_o surety_n in_o any_o sum_n according_a to_o their_o discretion_n have_v regard_n to_o the_o quality_n of_o the_o prisoner_n and_o nature_n of_o the_o offence_n for_o his_o or_o their_o appearance_n in_o the_o court_n of_o king_n bench_n the_o term_n follow_v or_o at_o the_o next_o assize_n session_n or_o general_a goal-delivery_n of_o and_o for_o such_o county_n city_n or_o place_n where_o the_o commitment_n be_v or_o where_o the_o offence_n be_v commit_v or_o in_o such_o other_o court_n where_o the_o say_a offence_n be_v proper_o recognizable_a as_o the_o case_n shall_v require_v and_o then_o shall_v certify_v the_o say_a writ_n with_o the_o return_v thereof_o and_o the_o say_a recognizance_n or_o recognizance_n into_o the_o say_a court_n where_o such_o appearance_n be_v to_o be_v make_v 6_o unless_o it_o shall_v appear_v unto_o the_o say_a lord_n chancellor_n or_o lord_n keeper_n or_o justice_n or_o justice_n baron_n or_o baron_n that_o the_o party_n so_o commit_v be_v detain_v upon_o a_o legal_a process_n order_n or_o warrant_v out_o of_o some_o court_n that_o have_v jurisdiction_n of_o criminal_a matter_n or_o by_o some_o warrant_n sign_v and_o seal_v with_o the_o hand_n and_o seal_n of_o any_o of_o the_o say_a justice_n or_o baron_n or_o some_o justice_n or_o justice_n of_o the_o peace_n for_o such_o matter_n or_o offence_n for_o the_o which_o by_o the_o law_n the_o prisoner_n be_v not_o bailable_a iv._o provide_v always_o and_o be_v it_o enact_v that_o if_o any_o person_n shall_v have_v wilful_o neglect_v by_o the_o space_n of_o two_o whole_a term_n after_o his_o imprisonment_n to_o pray_v a_o habeas_fw-la corpus_fw-la for_o his_o enlargement_n neglect_v or_o refuse_v to_o make_v the_o return_v aforesaid_a or_o to_o bring_v the_o body_n or_o body_n of_o the_o prisoner_n or_o prisoner_n according_a to_o the_o command_n of_o the_o say_v write_v within_o the_o respective_a time_n aforesaid_a or_o upon_o demand_n make_v by_o the_o prisoner_n or_o person_n in_o his_o behalf_n shall_v resuse_v to_o deliver_v or_o within_o the_o space_n of_o six_o hour_n after_o demand_n shall_v not_o deliver_v to_o the_o person_n so_o demand_v a_o true_a copy_n of_o the_o warrant_n or_o warrant_n of_o commitment_n and_o detainer_n of_o such_o prisoner_n which_o he_o or_o they_o be_v hereby_o require_v to_o deliver_v according_o all_z and_o every_o the_o head_n gaoler_n and_o keeper_n of_o such_o prison_n and_o such_o other_o person_n in_o to_o be_v recover_v by_o the_o prisoner_n or_o party_n grieve_v his_o executor_n or_o administrator_n against_o such_o offender_n his_o executor_n or_o administrator_n by_o any_o action_n of_o debt_n suit_n bill_n plaint_n or_o information_n in_o any_o of_o the_o king_n court_n at_o westmin_n wherein_o no_o essoign_n protection_n privilege_n injunction_n wager_n of_o law_n or_o stay_v of_o prosecution_n by_o non_fw-la vult_fw-la ulterius_fw-la prosequi_fw-la or_o otherwise_o shall_v be_v admit_v or_o allow_v or_o any_o more_o than_o one_o imparlance_n 4._o and_o any_o recovery_n or_o judgement_n at_o the_o suit_n of_o any_o party_n grieve_v shall_v be_v a_o sufficient_a conviction_n for_o the_o first_o offence_n and_o any_o after_o recovery_n or_o judgement_n at_o the_o suit_n of_o a_o party_n grieve_v for_o
any_o offence_n after_o the_o first_o judgement_n shall_v be_v a_o sufficient_a conviction_n to_o bring_v the_o officer_n or_o person_n within_o the_o say_a penalty_n for_o the_o second_o offence_n 6._o and_o for_o the_o prevention_n of_o unjust_a vexation_n by_o reiterated_a commitment_n for_o the_o same_o 2._o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n which_o shall_v be_v deliver_v or_o set_v at_o large_a upon_o any_o habeas_fw-la corpus_fw-la shall_v at_o any_o time_n hereafter_o be_v again_o imprison_v or_o commit_v for_o the_o same_o offence_n by_o any_o person_n or_o person_n whatsoever_o other_o than_o by_o the_o legal_a order_n and_o process_n of_o such_o court_n wherein_o he_o or_o they_o shall_v be_v bind_v by_o any_o colourable_a pretence_n or_o variation_n in_o the_o warrant_n or_o warrant_n of_o commitment_n notwithstandin_fw-mi to_o be_v recover_v as_o aforesaid_a 7._o provide_v always_o and_o be_v it_o further_o enact_v that_o if_o any_o person_n or_o person_n shall_v be_v commit_v for_o high_a treason_n or_o felony_n plain_o and_o special_o express_v in_o the_o warrant_n of_o commitment_n upon_o his_o prayer_n or_o petition_n in_o open_a court_n the_o first_o week_n of_o the_o term_n or_o first_o day_n of_o the_o session_n of_o oyer_n and_o terminer_n or_o general_a gaol_n delivery_n to_o be_v bring_v to_o his_o trial_n shall_v not_o be_v indict_v sometime_o in_o the_o next_o term_n session_n of_o oyer_n and_o terminer_n or_o general_a gaol_n delivery_n after_o such_o commitment_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o judge_n of_o the_o court_n of_o king_n bench_n and_o justice_n of_o oyer_n and_o terminer_n or_o general_a gaol_n delivery_n and_o they_o be_v hereby_o require_v upon_o motion_n to_o they_o make_v in_o open_a court_n the_o last_o day_n of_o the_o term_n session_n or_o gaol_n delivery_n either_o by_o the_o prisoner_n or_o any_o one_o in_o his_o behalf_n to_o set_v at_o liberty_n the_o prisoner_n upon_o bail_n unless_o it_o appear_v to_o the_o judge_n and_o justice_n upon_o oath_n make_v that_o the_o witness_n for_o the_o king_n can_v offence_n he_o shall_v be_v keep_v in_o custody_n according_a to_o law_n for_o such_o other_o suit_n 9_o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n subject_n of_o this_o realm_n shall_v be_v commit_v to_o any_o prison_n or_o in_o custody_n of_o any_o officer_n or_o officer_n whatsoever_o for_o any_o criminal_a or_o suppose_a criminal_a matter_n that_o the_o say_a person_n shall_v not_o be_v remove_v from_o the_o say_a prison_n and_o custody_n into_o the_o custody_n of_o any_o other_o officer_n or_o officer_n 2._o unless_o it_o be_v by_o habeas_fw-la corpus_fw-la or_o some_o other_o legal_a writ_n or_o where_o the_o prisoner_n be_v deliver_v to_o the_o constable_n or_o other_o inferior_a officer_n to_o carry_v such_o prisoner_n to_o some_o common_a gaol_n 3_o or_o where_o any_o person_n be_v send_v by_o â—rder_n of_o any_o judge_n of_o assize_n or_o justice_n of_o the_o peace_n â—o_o any_o common_a workhouse_n or_o house_n of_o correction_n 4._o or_o where_o the_o prisoner_n be_v remove_v from_o one_o prion_n or_o place_n to_o another_o within_o the_o same_o county_n in_o order_n to_o he_o or_o her_o trial_n or_o discharge_v in_o due_a course_n of_o law_n 5._o or_o in_o case_n of_o sudden_a fire_n or_o infection_n â—r_o other_o necessity_n 6._o and_o if_o any_o person_n or_o person_n â—hall_v after_o such_o commitment_n aforesaid_a make_v out_o and_o sign_n or_o countersign_v any_o warrant_n or_o warrant_n for_o â—uch_v removal_n aforesaid_a contrary_a to_o this_o act_n as_o well_o â—e_v that_o make_v or_o sign_n or_o countersign_v such_o warrant_n or_o warrant_n as_o the_o officer_n or_o officer_n that_o obey_v or_o execute_v the_o same_o shall_v suffer_v and_o incur_v the_o pain_n and_o forfeiture_n in_o this_o act_n beforementioned_a both_o for_o the_o first_o and_o second_o offence_n respective_o to_o be_v recover_v in_o manner_n aforesaid_a by_o the_o party_n grieve_v 10._o provide_v also_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o prisoner_n and_o prisoner_n as_o aforesaid_a to_o move_v and_o obtain_v he_o or_o their_o habeas_fw-la corpus_fw-la as_o well_o out_o of_o the_o high_a court_n of_o chancery_n or_o court_n of_o exchequer_n as_o out_o of_o the_o court_n of_o king_n bench_n or_o common_a plea_n or_o either_o of_o they_o 2._o and_o if_o the_o say_a lord_n chancellor_n or_o lord_n keeper_n or_o any_o judge_n or_o judge_n baron_n or_o baron_n for_o the_o time_n be_v of_o the_o degree_n of_o the_o coif_n of_o any_o of_o the_o court_n aforesaid_a in_o the_o vacation_n time_n upon_o view_n of_o the_o copy_n or_o copy_n of_o the_o warrant_n or_o warant_n of_o commitment_n or_o detainer_n or_o upon_o oath_n make_v that_o such_o copy_n or_o copy_n be_v deny_v as_o aforesaid_a shall_v deny_v any_o writ_n of_o habeas_fw-la corpus_fw-la by_o this_o act_n require_v to_o be_v grant_v be_v move_v for_o as_o aforesaid_a they_o shall_v several_o forfeit_v to_o the_o prisoner_n or_o party_n grieve_v the_o sum_n of_o five_o hundred_o pound_n to_o be_v recover_v in_o manner_n aforesaid_a 11._o and_o be_v it_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o a_o habeas_fw-la corpus_fw-la according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n may_v be_v direct_v and_o run_v into_o any_o county_n palatine_n the_o cinquâ—…_n port_n or_o other_o privilege_a place_n within_o the_o kingdom_n of_o engl._n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n and_o the_o isle_n of_o jersey_n or_o guernsey_n any_o law_n or_o usage_n to_o the_o contrary_a notwithstanding_o 12._o and_o for_o prevent_v illegal_a imprisonment_n in_o prison_n beyond_o sea_n 2._o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o subject_n of_o this_o realm_n that_o now_o be_v or_o hereafter_o shall_v be_v a_o inhabitant_n or_o resiant_a of_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n shall_v or_o may_v be_v send_v prisoner_n into_o scotland_n ireland_n jersey_n guernsey_n tangier_n or_o into_o any_o part_n garrison_n island_n or_o place_n beyond_o the_o sea_n which_o be_v or_o at_o any_o time_n hereafter_o shall_v be_v within_o or_o without_o the_o dominion_n of_o his_o majesty_n his_o heir_n or_o successor_n 3._o and_o that_o every_o such_o imprisonment_n be_v hereby_o enact_v and_o adjudge_v to_o be_v illegal_a 4._o and_o that_o if_o any_o of_o the_o say_a subject_n now_o be_v or_o hereafter_o shall_v be_v so_o imprison_v every_o such_o person_n and_o person_n so_o imprison_v shall_v and_o may_v for_o every_o such_o imprisonment_n maintain_v by_o virtue_n of_o this_o act_n a_o action_n or_o action_n of_o false_a imprisonment_n in_o any_o of_o his_o majesty_n court_n of_o record_n against_o the_o person_n or_o person_n by_o who_o he_o or_o she_o shall_v be_v so_o commit_v detain_v imprison_v send_v prisoner_n or_o transport_v contrary_a to_o the_o true_a meaning_n of_o this_o act_n and_o against_o all_o or_o any_o
person_n or_o person_n that_o shall_v frame_v contrive_v write_v seal_v or_o countersign_v any_o warrant_n or_o write_v for_o such_o commitment_n detainer_n imprisonment_n or_o transportation_n or_o shall_v be_v advise_v aid_v or_o assist_v in_o the_o same_o or_o any_o of_o they_o 5._o and_o the_o plaintiff_n in_o every_o such_o action_n shall_v have_v judgement_n to_o recover_v his_o treble_n cost_v beside_o damage_n which_o damage_n so_o to_o be_v give_v shall_v not_o be_v less_o than_o five_o hundred_o pound_n 6._o in_o which_o action_n no_o delay_n stay_v or_o stop_v of_o proceed_v by_o of_o berwick_n upon_o tweed_n or_o any_o of_o the_o island_n territory_n or_o dominion_n thereunto_o belong_v 8._o and_o shall_v incur_v and_o sustain_v the_o pain_n penalty_n and_o forfeiture_n limit_v ordain_v and_o provide_v in_o and_o by_o the_o statute_n of_o provision_n and_o praemunire_n make_v in_o the_o sixteen_o year_n of_o king_n richard_n the_o second_o 9_o and_o be_v incapaple_n of_o any_o pardon_n from_o the_o king_n his_o heir_n or_o successor_n of_o the_o say_a forfeiture_n loss_n or_o disability_n or_o any_o of_o they_o 13._o provide_v always_o that_o nothing_o in_o this_o act_n extend_v to_o give_v benefit_n to_o any_o person_n who_o shall_v by_o contract_n in_o write_v agree_v with_o any_o merchant_n or_o owner_n of_o any_o plantation_n or_o other_o person_n whatsoever_o to_o be_v transport_v to_o any_o part_n beyond_o the_o sea_n and_o receive_v earnest_a upon_o such_o agreement_n although_o that_o afterward_o such_o person_n shall_v renounce_v such_o contract_n 14._o provide_v always_o and_o be_v it_o enact_v that_o if_o any_o person_n or_o person_n lawful_o convict_v of_o any_o felony_n shall_v in_o open_a court_n pray_v to_o be_v transport_v beyond_o the_o sea_n and_o the_o court_n shall_v think_v fit_a to_o leave_v he_o or_o they_o in_o prison_n for_o that_o purpose_n such_o person_n or_o person_n may_v be_v transport_v into_o any_o part_n beyond_o the_o sea_n this_o act_n or_o any_o thing_n therein_o contain_v to_o the_o contrary_a notwithstanding_o 15._o provide_v also_o and_o be_v it_o enact_v that_o nothing_o herein_o contain_v shall_v be_v deem_v construe_v or_o take_v to_o extend_v to_o the_o imprisonment_n of_o any_o person_n before_o to_o first_o day_n of_o june_n one_o thousand_o six_o hundred_o seventy_o and_o nine_o or_o to_o any_o thing_n advise_v procure_v or_o otherwise_o do_v relate_v to_o such_o imprisonment_n any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o 16._o provide_v also_o that_o if_o any_o person_n or_o person_n at_o any_o time_n resiant_a in_o this_o realm_n shall_v have_v commit_v any_o capital_a offence_n in_o scotl._n or_o ireland_n or_o any_o of_o the_o island_n or_o foreign_a plantation_n of_o the_o king_n his_o heir_n or_o successor_n where_o he_o or_o she_o aught_o to_o be_v try_v for_o such_o offence_n such_o person_n or_o person_n may_v be_v send_v to_o such_o place_n there_o to_o receive_v such_o trial_n in_o such_o manner_n as_o the_o same_o may_v have_v be_v use_v before_o the_o make_n of_o this_o act_n any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o 17._o provide_v always_o and_o be_v it_o enact_v that_o no_o person_n or_o person_n shall_v be_v sue_v implead_v molest_v or_o trouble_v for_o any_o offence_n against_o this_o act_n unless_o the_o party_n offend_v be_v sue_v or_o implead_v for_o the_o same_o within_o two_o year_n at_o the_o most_o after_o such_o time_n wherein_o the_o offence_n shall_v be_v commit_v in_o case_n the_o party_n grieve_v shall_v not_o be_v then_o in_o prison_n and_o if_o he_o shall_v be_v in_o prison_n then_o within_o the_o space_n of_o two_o year_n after_o the_o decease_n of_o the_o person_n imprison_v or_o he_o or_o her_o delivery_n out_o of_o prison_n which_o shall_v first_o happen_v 18._o and_o to_o the_o intent_n no_o person_n may_v avoid_v his_o trial_n at_o the_o assize_n or_o general_a gaol_n delivery_n by_o procure_v his_o removal_n before_o the_o assize_n at_o such_o time_n as_o he_o can_v be_v bring_v back_o to_o receive_v his_o trial_n there_o 2._o be_v it_o enact_v that_o after_o the_o assize_n proclaim_v for_o thatcounty_n where_o the_o prisoner_n be_v detain_v no_o person_n shall_v be_v remove_v from_o the_o common_a gaol_n upon_o any_o habeas_fw-la corpus_fw-la grant_v in_o pursuance_n of_o this_o act_n but_o upon_o any_o such_o habeas_fw-la corpus_fw-la shall_v be_v bring_v before_o the_o judge_n os_fw-la assize_n in_o open_a court_n who_o be_v thereupon_o to_o do_v what_o to_o justice_n shall_v appertain_v 19_o provide_v nevertheless_o that_o after_o the_o assize_n be_v end_v any_o person_n or_o person_n detain_v may_v have_v his_o or_o her_o habeas_fw-la corpus_fw-la according_a to_o the_o direction_n and_o intention_n of_o this_o act._n 20._o and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o information_n suit_n or_o action_n shall_v be_v bring_v or_o exhibit_v against_o any_o person_n or_o person_n for_o anyoffence_n commit_v or_o to_o be_v commit_v against_o the_o form_n of_o this_o law_n it_o shall_v be_v lawful_a for_o such_o defendant_n to_o plead_v the_o general_n issue_n that_o they_o be_v not_o guilty_a or_o that_o they_o own_v nothing_o and_o to_o give_v such_o special_a matter_n in_o evidence_n to_o the_o jury_n that_o shall_v try_v the_o same_o which_o matter_n be_v plead_v have_v be_v good_a &_o sufficient_a in_o law_n to_o have_v discharge_v the_o say_a defendant_n or_o defendant_n against_o the_o say_a information_n suit_n or_o action_n &_o the_o say_a matter_n shall_v be_v then_o as_o available_a to_o he_o or_o they_o to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o they_o have_v sufficient_o plead_v set_v forth_o or_o allege_v the_o same_o matter_n in_o bar_n or_o discharge_v of_o such_o information_n suit_n or_o action_n
