A65675 An ansvver to the order of the Middlesex justices, dated the 20th of December last, touching the suppressing of conventicles which order is here compared with the act of the 22d of this king, on which the same is grounded : wherein it will appear that the said order is lame and insufficient for any constable, or other officers to act by : being an answer to a letter received from a friend in Middlesex : wherein is also laid down some directions to the officers touching the execution of that act, according to the true intent and meaning of that law / by D. R. Whitaker, Edward. 1682 (1682) Wing W1699; ESTC R8053 8,931 12

command_v none_o of_o the_o constable_n or_o other_o officer_n to_o swear_v against_o any_o and_o this_o may_v be_v say_v of_o the_o order_n in_o general_a that_o be_v it_o not_o a_o order_n of_o session_n it_o may_v be_v take_v to_o be_v a_o force_n upon_o man_n to_o swear_v and_o look_v something_o like_o a_o invitation_n to_o barratry_n or_o at_o least_o set_v up_o a_o new_a trade_n of_o swear_v and_o as_o to_o that_o part_n which_o command_v the_o constable_n to_o return_v the_o name_n to_o they_o at_o the_o session_n there_o be_v no_o pretence_n in_o the_o act_n to_o warrant_v such_o a_o command_n therefore_o as_o to_o the_o whole_a order_n of_o the_o session_n and_o their_o warrant_n thereupon_o to_o the_o constable_n send_v by_o the_o high_a constable_n wherein_o they_o be_v command_v to_o act_v according_a to_o that_o order_n i_o do_v here_o affirm_v there_o be_v not_o the_o least_o ground_n in_o the_o act_n for_o such_o order_n nor_o can_v the_o constable_n or_o headburrough_n answer_v the_o same_o in_o case_n they_o shall_v turn_v informer_n if_o question_v hereafter_o no_o more_o than_o some_o of_o the_o justice_n of_o the_o peace_n of_o middlesex_n can_v answer_v the_o stop_a indictment_n from_o be_v find_v by_o the_o grand_a jury_n at_o hick_n hall_n about_o three_o or_o four_o session_n ago_o which_o be_v so_o bold_a a_o attempt_n and_o stab_v to_o the_o common_a law_n that_o i_o dare_v affirm_v there_o never_o be_v so_o great_a a_o offence_n commit_v by_o any_o justice_n since_o the_o saxon_a race_n begin_v in_o england_n thus_o have_v give_v you_o my_o opinion_n of_o the_o order_n and_o compare_v the_o same_o a_o little_a with_o the_o act_n i_o shall_v go_v on_o a_o little_a further_o to_o show_v what_o the_o constable_n and_o officer_n duty_n be_v upon_o the_o act._n and_o first_o i_o do_v say_v where_o the_o constable_n receive_v a_o warrant_n to_o seize_v any_o person_n convict_v he_o ought_v to_o obey_v it_o and_o go_v with_o the_o informer_n to_o seize_v the_o person_n but_o nevertheless_o if_o the_o person_n be_v in_o any_o house_n that_o be_v shut_v and_o the_o door_n refuse_v to_o be_v open_v the_o constable_n have_v no_o power_n to_o break_v it_o open_v nor_o to_o stand_v by_o while_o it_o be_v do_v unless_o it_o be_v where_o there_o be_v a_o meeting_n and_o then_o no_o more_o but_o to_o get_v into_o the_o meeting_n if_o they_o be_v refuse_v entrance_n and_o no_o other_o way_n will_v the_o act_n bear_v they_o out_o in_o nor_o be_v it_o the_o constable_n work_n to_o be_v a_o informer_n but_o to_o keep_v the_o peace_n and_o if_o any_o constable_n have_v a_o warrant_n from_o a_o justice_n to_o go_v to_o such_o a_o place_n where_o there_o be_v a_o meeting_n to_o take_v the_o name_n of_o the_o people_n who_o will_v not_o give_v their_o name_n the_o constable_n nor_o justice_n can_v force_v they_o nor_o be_v they_o bind_v to_o be_v over_o forward_o in_o ask_v for_o the_o act_n appoint_v no_o such_o thing_n nor_o be_v the_o constable_n or_o any_o under_o officer_n oblige_v to_o enter_v into_o any_o meetinghouse_n to_o disturb_v they_o unless_o that_o first_o they_o have_v a_o certificate_n under_o the_o hand_n and_o seal_n of_o some_o justice_n of_o the_o peace_n of_o such_o meeting_n which_o appear_v plain_o in_o the_o 9th_o paragraph_n of_o that_o act._n but_o admit_v such_o a_o certificate_n shall_v be_v make_v of_o a_o meeting_n have_v or_o intend_v to_o be_v have_v 〈◊〉_d sect._n 〈◊〉_d consider_v how_o dangerous_a a_o thing_n this_o will_v be_v to_o the_o constable_n or_o any_o under_o officer_n to_o seize_v person_n in_o the_o same_o meeting_n for_o how_o can_v he_o that_o come_v to_o seize_v the_o person_n tell_v but_o that_o those_o very_a people_n there_o meet_v be_v according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n and_o if_o it_o be_v so_o that_o the_o same_o duty_n of_o religion_n be_v perform_v there_o in_o a_o peaceable_a manner_n as_o be_v in_o the_o church_n of_o england_n than_o it_o be_v most_o plain_a that_o the_o same_o be_v no_o conventicle_n and_o so_o not_o within_o the_o compass_n of_o the_o law_n now_o it_o will_v not_o be_v amiss_o to_o consider_v what_o be_v use_v for_o service_n in_o the_o church_n of_o england_n in_o the_o first_o place_n prayer_n be_v use_v in_o the_o church_n both_o by_o the_o common-prayer-book_n and_o without_o in_o the_o pulpit_n then_o sing_v of_o psalm_n than_o a_o sermon_n now_o if_o the_o meeting_n do_v perform_v nothing_o but_o these_o exercise_n it_o can_v by_o this_o act_n be_v make_v a_o conventicle_n and_o if_o there_o be_v any_o meeting_n in_o england_n that_o do_v not_o all_o or_o the_o most_o of_o those_o duty_n then_o let_v the_o middlesex_n justice_n and_o constable_n do_v what_o they_o please_v with_o they_o and_o if_o they_o do_v all_o these_o exercise_n though_o one_o of_o they_o may_v be_v omit_v yet_o i_o think_v it_o can_v be_v make_v a_o conventicle_n for_o the_o word_n be_v viz._n in_o other_o manner_n then_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n and_o how_o any_o officer_n can_v swear_v or_o prove_v that_o prayer_n preach_v and_o sing_v of_o psalm_n be_v not_o the_o practice_n and_o usage_n of_o the_o church_n of_o england_n i_o know_v not_o but_o must_v leave_v they_o to_o consider_v the_o consequence_n london_n print_v for_o ab._n green_n 1682._o
