and_o justice_n of_o peace_n of_o the_o city_n of_o westminster_n and_o the_o liberty_n thereof_o or_o any_o two_o or_o more_o of_o they_o or_o any_o two_o justice_n of_o peace_n of_o the_o respective_a county_n of_o middlesex_n and_o surrey_n by_o their_o warrant_n under_o their_o hand_n and_o seal_n to_o authorise_v the_o churchwarden_n or_o overséer_v for_o the_o poor_a within_o the_o place_n and_o parish_n aforesaid_a to_o demand_v gather_v and_o receive_v of_o every_o person_n and_o person_n such_o sum_n and_o sum_n of_o money_n as_o shall_v be_v assess_v upon_o they_o by_o necessary_a expense_n which_o have_v be_v lay_v out_o by_o the_o say_v former_a corporation_n for_o the_o relief_n of_o the_o say_v poor_a and_o the_o carry_v on_o of_o the_o say_a service_n since_o the_o time_n before_o express_v by-law_n power_n to_o make_v order_n and_o by-law_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a precedent_n and_o governor_n or_o any_o seven_o of_o they_o shall_v have_v power_n from_o time_n to_o time_n to_o make_v and_o constitute_v order_n and_o by-law_n for_o the_o better_a relieve_n regulate_v and_o set_v the_o poor_a to_o work_v and_o the_o apprehend_n and_o punish_v of_o rogue_n vagabond_n and_o beggar_n within_o the_o city_n liberty_n and_o place_n aforesaid_a that_o have_v not_o wherewith_o to_o maintain_v themselves_o and_o for_o other_o the_o matter_n aforesaid_a provide_v the_o say_a order_n and_o by-law_n shall_v from_o time_n to_o time_n be_v present_v to_o the_o justice_n of_o peace_n in_o their_o quarter-session_n assemble_v to_o be_v allow_v by_o the_o major_a part_n of_o they_o and_o confirm_v by_o order_n of_o the_o say_v court_n and_o it_o be_v further_o enact_v by_o the_o shall_v be_v needful_a to_o be_v employ_v in_o and_o about_o the_o premise_n and_o they_o or_o any_o of_o they_o from_o time_n to_o time_n to_o remove_v as_o they_o shall_v see_v cause_n and_o upon_o the_o death_n or_o removal_n of_o they_o or_o any_o of_o they_o to_o choose_v other_o in_o their_o place_n for_o the_o carry_v on_o of_o the_o work_n and_o to_o make_v and_o give_v such_o reasonable_a further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o sheriff_n bailiff_n constable_n officer_n all_o sheriff_n etc._n etc._n to_o be_v assist_v the_o say_a corporation_n &_o their_o officer_n and_o all_o other_o officer_n and_o minister_n of_o justice_n shall_v be_v aid_v and_o assist_v to_o the_o say_a corporation_n or_o corporation_n and_o to_o all_o such_o officer_n as_o shall_v be_v employ_v by_o they_o or_o any_o of_o they_o in_o the_o execution_n or_o performance_n of_o the_o say_a service_n and_o whereas_o the_o law_n and_o statute_n for_o the_o apprehend_n of_o rogue_n and_o vagabond_n have_v not_o be_v due_o execute_v sometime_o for_o want_v of_o officer_n by_o reason_n lord_n of_o manor_n do_v not_o keep_v court_n léet_v every_o year_n for_o the_o make_n of_o they_o court-leet_n constables_z how_o make_v in_o default_n of_o hold_v court-leet_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n any_o constable_n headborough_z or_o tithingman_n shall_v die_v or_o go_v out_o of_o the_o parish_n any_o two_o justice_n of_o the_o peace_n may_v make_v and_o swear_v a_o new_a constable_n headborough_z or_o tithingman_n until_o the_o say_a lord_n shall_v hold_v a_o court_n or_o until_o next_o quarter-session_n who_o shall_v approve_v of_o the_o say_a officer_n so_o make_v and_o swear_v as_o aforesaid_a or_o appoint_v other_o as_o they_o shall_v think_v fit_a and_o if_o any_o officer_n shall_v continue_v above_o a_o year_n in_o he_o or_o their_o office_n that_o then_o in_o such_o case_n the_o justice_n of_o peace_n in_o their_o quarter-session_n may_v discharge_v such_o officer_n and_o may_v put_v another_o fit_a person_n in_o he_o or_o their_o place_n until_o the_o lord_n of_o the_o say_a apprehend_v any_o rogue_n vagabond_n or_o sturdy_n beggar_n by_o grant_v unto_o such_o person_n or_o person_n a_o order_n or_o warrant_n under_o his_o hand_n and_o seal_n to_o the_o constable_n headborough_z or_o tithingman_n of_o such_o parish_n where_o such_o rogue_n vagabond_n or_o sturdy_a beggar_n pass_v through_o unapprehend_v require_v he_o to_o pay_v such_o person_n or_o person_n shall_v be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n or_o offender_n good_n and_o chattel_n by_o warrant_n from_o the_o say_a justice_n master_n warden_n and_o assistant_n or_o any_o the_o sum_n of_o twenty_o pound_n of_o often_o as_o such_o person_n or_o person_n shall_v upon_o due_a proof_n be_v find_v guilty_a of_o the_o same_o which_o say_v forfeiture_n be_v to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n penalty_n the_o penalty_n render_v the_o overplus_n to_o the_o owner_n thereof_o upon_o demand_n and_o for_o want_v of_o such_o distress_n shall_v before_o any_o public_a vend_v of_o the_o say_a book_n bring_v they_o to_o the_o master_n of_o the_o company_n of_o stationer_n and_o deliver_v they_o to_o he_o one_o whereof_z shall_v be_v deliver_v to_o the_o keeper_n of_o his_o majesty_n library_n and_o the_o other_o two_o to_o be_v send_v to_o the_o vicechancellor_n of_o the_o two_o university_n respective_o for_o the_o use_n of_o the_o public_a library_n of_o the_o say_a university_n university_n proviso_n for_o the_o privilege_n of_o the_o two_o university_n provide_v always_o that_o nothing_o in_o this_o act_n contain_v receive_v and_o pay_v into_o the_o exchequer_n may_v from_o time_n to_o time_n be_v pay_v into_o his_o exchequer_n with_o as_o little_a charge_n as_o may_v be_v be_v it_o enact_v by_o the_o his_o majesty_n his_o heir_n and_o successor_n so_o that_o no_o person_n who_o shall_v have_v such_o acquittance_n shall_v be_v molest_v sue_v or_o vex_v or_o put_v to_o any_o charge_n in_o his_o aforesaid_a duty_n receive_v a_o acquittance_n without_o pay_v any_o thing_n for_o the_o same_o collect_v the_o allowance_n for_o collect_v and_o deduct_v two_o penny_n in_o the_o pound_n for_o their_o pain_n in_o collect_v the_o same_o and_o shall_v also_o then_o in_o write_v under_o his_o hand_n deliver_v unto_o the_o say_v high_a constable_n the_o name_n of_o the_o person_n of_o who_o they_o receive_v the_o same_o and_o also_o the_o name_n of_o such_o person_n who_o ought_v to_o have_v pay_v the_o respective_a duty_n yearly_o charge_v upon_o they_o and_o have_v not_o pay_v the_o same_o where_o no_o distress_n can_v be_v have_v sheriff_n within_o what_o time_n the_o money_n ought_v to_o be_v pay_v to_o the_o high_a sheriff_n and_o be_v it_o further_o enact_v that_o the_o high_a constable_n of_o the_o several_a hundred_o and_o respective_a limit_n shall_v within_o ten_o day_n next_o after_o their_o several_a receipt_n from_o the_o say_a constable_n headborough_n tithingman_n and_o other_o officer_n pay_v unto_o the_o high_a sheriff_n of_o every_o county_n all_o such_o money_n as_o they_o shall_v so_o receive_v deduct_v a_o penny_n in_o the_o pound_n for_o their_o pain_n and_o shall_v also_o then_o deliver_v or_o cause_n to_o be_v deliver_v unto_o the_o say_v high_a sheriff_n the_o several_a return_n which_o they_o receive_v from_o the_o constable_n and_o other_o officer_n aforesaid_a exchequer_n and_o when_o the_o high_a sheriff_n ought_v to_o pay_v the_o same_o into_o the_o exchequer_n and_o the_o respective_a sheriff_n shall_v within_o thirty_o day_n after_o he_o or_o they_o shall_v receive_v the_o say_a money_n from_o the_o respective_a collector_n return_v the_o same_o together_o with_o the_o name_n of_o such_o person_n who_o be_v defaulter_n and_o have_v no_o distress_n to_o be_v find_v into_o his_o majesty_n court_n of_o exchequer_n deduct_v four_o penny_n out_o of_o every_o twenty_o shilling_n and_o so_o after_o that_o rate_n whereof_o three_o penny_n to_o be_v for_o the_o sheriff_n own_o use_n as_o a_o reward_n of_o his_o pain_n in_o receive_v and_o return_v the_o same_o and_o one_o penny_n to_o be_v pay_v by_o the_o sheriff_n to_o the_o clerk_n of_o the_o peace_n for_o his_o pain_n to_o be_v recover_v by_o the_o say_a clerk_n of_o the_o peace_n by_o action_n of_o debt_n middlesex_n london_n middlesex_n provide_v always_o and_o be_v it_o enact_v that_o the_o high_a sheriff_n of_o london_n and_o middlesex_n for_o the_o time_n be_v for_o london_n and_o so_o much_o of_o the_o county_n of_o middelsex_n as_o lie_v within_o the_o bill_n of_o mortality_n other_o than_o the_o inn_n of_o court_n and_o chancery_n and_o the_o high_a sheriff_n of_o surrey_n for_o the_o time_n be_v for_o the_o burrow_n of_o southwark_n southwark_n surrey_n southwark_n and_o all_o other_o sheriff_n of_o any_o other_o city_n or_o town_n be_v a_o county_n of_o itself_o for_o such_o city_n and_o town_n respective_o shall_v be_v and_o be_v hereby_o make_v collector_n of_o and_o for_o the_o several_a duty_n arise_v within_o their_o several_a and_o respective_a limit_n for_o which_o end_n and_o purpose_n and_o in_o those_o place_n only_o the_o constable_n tithingman_n headborough_n and_o other_o officer_n shall_v deliver_v unto_o the_o sheriff_n of_o the_o city_n and_o place_n aforesaid_a duplicate_v of_o the_o same_o account_n of_o hearth_n and_o stove_n which_o the_o say_v constable_n headborough_n tithingman_n and_o other_o officer_n be_v appoint_v by_o this_o act_n to_o take_v from_o time_n to_o time_n and_o to_o deliver_v to_o the_o justice_n of_o peace_n to_o be_v enrol_v as_o aforesaid_a and_o the_o say_a sheriff_n of_o the_o city_n and_o place_n last_v before_o mention_v be_v hereby_o enable_v to_o levy_v the_o say_a duty_n and_o require_v to_o give_v acquittance_n without_o any_o fee_n as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n as_o in_o this_o act_n be_v appoint_v to_o be_v do_v by_o any_o other_o collector_n and_o the_o say_a sheriff_n shall_v from_o time_n to_o time_n within_o forty_o day_n after_o the_o say_a duty_n shall_v be_v payable_a by_o virtue_n of_o this_o act_n make_v payment_n of_o all_o the_o money_n levy_v into_o his_o majesty_n exchequer_n with_o a_o perfect_a list_n of_o the_o name_n of_o such_o person_n as_o shall_v make_v default_n of_o payment_n where_o no_o distress_n can_v be_v find_v to_o be_v take_v any_o thing_n in_o this_o

act_n to_o the_o contrary_a notwithstanding_o and_o the_o say_a sheriff_n shall_v deduct_v out_o of_o their_o payment_n four_o penny_n in_o the_o pound_n whereof_o three_o penny_n to_o be_v for_o themselves_o and_o one_o penny_n for_o the_o clerk_n of_o the_o peace_n to_o be_v recover_v as_o aforesaid_a fee_n officer_n of_o the_o exchequer_n shall_v discharge_v person_n who_o pay_v the_o duty_n without_o any_o fee_n and_o that_o his_o majesty_n officer_n in_o his_o say_a court_n of_o exchequer_n shall_v discharge_v all_o such_o person_n who_o pay_v their_o respective_a duty_n without_o take_v any_o fee_n for_o the_o same_o and_o shall_v also_o issue_v out_o process_n to_o levy_v the_o say_a duty_n upon_o such_o person_n who_o shall_v fail_v in_o payment_n thereof_o where_o no_o distress_n can_v be_v find_v to_o be_v take_v according_a to_o this_o act._n pension_n the_o say_a revenue_n shall_v be_v pay_v into_o the_o exchequer_n and_o not_o charge_v with_o any_o grant_n or_o pension_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o revenue_n and_o sum_n of_o money_n arise_v by_o virtue_n of_o this_o act_n except_o what_o shall_v be_v allow_v to_o the_o aforesaid_a officer_n and_o minister_n for_o collect_v the_o same_o shall_v be_v due_o and_o constant_o pay_v and_o answer_v into_o his_o majesty_n court_n of_o exchequer_n and_o shall_v not_o be_v particular_o charge_v or_o chargeable_a either_o before_o it_o be_v pay_v into_o the_o exchequer_n or_o after_o with_o any_o gift_n grant_n or_o pension_n whatsoever_o and_o that_o all_o and_o every_o grant_n of_o any_o such_o pension_n and_o all_o and_o every_o clause_n of_o non_fw-la obstante_fw-la therein_o contain_v shall_v be_v and_o be_v hereby_o declare_v to_o be_v utter_o void_a and_o all_o and_o every_o the_o person_n to_o who_o such_o grant_n be_v pass_v shall_v be_v and_o be_v hereby_o make_v accomptant_n unto_o his_o majesty_n accomptane_n grantee_n of_o the_o same_o shall_v be_v accomptane_n his_o heir_n and_o successor_n and_o shall_v pay_v back_o all_o sum_n of_o money_n receive_v by_o pretence_n of_o such_o grant_n and_o the_o court_n of_o exchequer_n shall_v be_v and_o be_v hereby_o enjoin_v to_o issue_n out_o process_n according_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n suit_n issue_n person_n act_v upon_o this_o statute_n be_v sue_v therefore_o may_v plead_v the_o general_a issue_n or_o information_n shall_v be_v commence_v or_o prosecute_v against_o any_o person_n or_o person_n for_o what_o he_o or_o they_o shall_v do_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o upon_o issue_n join_v may_v give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v become_v nonsuit_n or_o suffer_v discontinuance_n or_o if_o a_o verdict_n pass_v against_o he_o or_o if_o upon_o a_o demurrer_n judgement_n pass_v against_o he_o defendant_n treble_a cost_v to_o the_o defendant_n the_o defendant_n shall_v recover_v treble_a cost_v for_o which_o there_o shall_v be_v like_o remedy_n as_o in_o any_o case_n where_o cost_v by_o law_n be_v give_v to_o the_o defendant_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a happen_v increase_v of_o hearth_n or_o stove_n which_o may_v happen_v that_o where_o any_o increase_n or_o decrease_v of_o such_o hearth_n or_o stove_n shall_v hereafter_o happen_v that_o a_o account_n in_o write_v of_o the_o same_o shall_v be_v have_v and_o make_v in_o like_a manner_n as_o the_o same_o be_v direct_v to_o be_v first_o take_v return_v and_o enrol_v by_o this_o act_n and_o a_o duplicate_v thereof_o send_v into_o the_o exchequer_n in_o such_o sort_n as_o be_v before_o direct_v discharge_v decrease_v how_o discharge_v and_o from_o thenceforth_o the_o owner_n or_o occupier_n of_o such_o house_n where_o such_o decrease_v be_v shall_v be_v discharge_v proportionable_o without_o any_o further_a plead_n in_o the_o exchequer_n provide_v always_o that_o no_o person_n or_o person_n shall_v be_v charge_v prosecute_v due_a arrearage_n not_o to_o be_v charge_v or_o sue_v for_o but_o within_o 2_o year_n next_o after_o they_o become_v due_a or_o bring_v to_o account_v for_o the_o arrearage_n of_o any_o duty_n or_o arrearage_n of_o revenue_n raise_v by_o this_o act_n unless_o the_o say_a suit_n shall_v commence_v within_o two_o year_n and_o be_v bring_v to_o a_o judgement_n within_o four_o year_n and_o the_o duty_n levy_v within_o five_o year_n next_o after_o the_o same_o shall_v grow_v due_a provide_v always_o that_o no_o person_n who_o by_o reason_n of_o his_o poverty_n exempt_v poor_a people_n exempt_v or_o the_o smallness_n of_o his_o estate_n be_v exempt_v from_o the_o usual_a tare_n payment_n and_o contribution_n towards_o the_o church_n and_o poor_a shall_v be_v charge_v or_o chargeable_a with_o any_o the_o duty_n by_o this_o act_n impose_v any_o thing_n herein_o before_o to_o the_o contrary_a notwithstanding_o provide_v always_o and_o be_v it_o hereby_o enact_v that_o if_o the_o churchwarden_n and_o overséer_v of_o the_o poor_a of_o the_o parish_n together_o with_o the_o minister_n of_o the_o same_o or_o any_o two_o of_o they_o whereof_o the_o minister_n to_o be_v one_o shall_v in_o write_v under_o their_o hand_n yearly_o certify_v their_o belief_n that_o the_o house_n wherein_o any_o person_n do_v inhabit_v be_v not_o of_o great_a value_n than_o of_o twenty_o shilling_n per_fw-la annum_fw-la upon_o the_o full_a improve_a rent_n and_o that_o neither_o the_o person_n so_o inhabit_v nor_o any_o other_o use_v the_o same_o message_n have_v use_v or_o occupi_v any_o land_n or_o tenement_n of_o their_o own_o or_o other_o of_o the_o yearly_a value_n of_o twenty_o shilling_n per_fw-la annum_fw-la nor_o have_v any_o land_n tenement_n good_n or_o chattel_n of_o the_o value_n of_o ten_o pound_n in_o their_o own_o possession_n or_o in_o the_o possession_n of_o any_o other_o in_o trust_n for_o they_o that_o then_o in_o such_o case_n upon_o such_o certificate_n make_v to_o the_o two_o next_o justice_n of_o peace_n and_o allow_v for_o which_o certificate_n and_o allowance_n no_o fee_n shall_v be_v pay_v the_o person_n on_o who_o behalf_n such_o certificate_n be_v make_v shall_v not_o be_v return_v by_o the_o constable_n or_o other_o officer_n and_o the_o say_a house_n be_v hereby_o for_o that_o year_n discharge_v of_o and_o from_o all_o the_o duty_n by_o this_o act_n impose_v any_o thing_n herein_o to_o the_o contrary_a notwithstanding_o provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n etc._n further_a penalty_n upon_o any_o person_n that_o shall_v accept_v or_o procure_v any_o pension_n gift_n or_o grant_v for_o year_n etc._n etc._n body_n politic_a or_o corporate_a shall_v at_o any_o time_n hereafter_o procure_v or_o accept_v of_o from_o the_o king_n majesty_n his_o heir_n or_o successor_n any_o pension_n gift_n or_o grant_v for_o year_n life_n or_o any_o other_o estate_n or_o any_o sum_n or_o sum_n of_o money_n out_o of_o the_o revenue_n arise_v by_o virtue_n of_o this_o act_n that_o then_o such_o person_n or_o body_n politic_a or_o corporate_a procure_v or_o accept_v the_o same_o shall_v forfeit_v double_a the_o value_n of_o such_o pension_n gift_n or_o grant_v the_o one_o moiety_n of_o which_o forfeiture_n shall_v be_v to_o the_o use_n of_o the_o poor_a of_o the_o parish_n or_o parish_n where_o the_o say_v offender_n be_v or_o inhabit_v to_o be_v recover_v by_o the_o churchwarden_n the_o other_o moiety_n to_o he_o that_o will_v sue_v for_o the_o same_o by_o action_n of_o debt_n bill_n plaint_n or_o information_n provide_v that_o this_o act_n hospital_n blow_v house_n stamp_n furnace_n kiln_n oven_n hospital_n or_o any_o thing_n herein_o contain_v shall_v not_o extend_v to_o charge_v any_o blowing-house_n and_o stamp_v furnace_n or_o kiln_n or_o any_o private_a oven_n within_o any_o of_o the_o house_n hereby_o charge_v nor_o any_o hearth_n or_o stove_n within_o the_o scite_fw-la of_o any_o hospital_n or_o alms-house_n for_o the_o relief_n of_o poor_a people_n who_o endowment_n and_o revenue_n do_v not_o excee_v in_o true_a value_n the_o sum_n of_o one_o hundred_o pound_n by_o the_o year_n provide_v occupier_n the_o payment_n and_o duty_n charge_v only_o upon_o the_o occupier_n that_o the_o payment_n and_o duty_n hereby_o charge_v shall_v be_v charge_v only_o on_o the_o occupier_n for_o the_o time_n be_v of_o such_o hearth_n or_o stove_n dwell_v in_o such_o house_n whereto_o such_o hearth_n or_o stove_n shall_v be_v belong_v his_o executor_n or_o administrator_n and_o not_o on_o the_o
