the_o say_a debt_n out_o of_o the_o say_a money_n good_n chattel_n or_o debt_n so_o attach_v as_o aforesaid_a provide_v always_o that_o if_o any_o will_v appear_v as_o attorney_n to_o the_o say_a debtor_n and_o put_v in_o bail_n to_o answer_v the_o action_n and_o pay_v the_o condemnation_n that_o then_o and_o in_o all_o such_o case_n the_o attachment_n on_o the_o say_a money_n good_n chattel_n or_o debt_n shall_v be_v dissolve_v and_o proceed_n have_v according_a to_o the_o custom_n of_o the_o common_a law_n but_o if_o the_o possessor_n or_o owner_n of_o such_o money_n good_n chattel_n or_o debt_n be_v they_o attorney_n wife_n servant_n or_o other_o person_n as_o aforesaid_a shall_v after_o attachment_n so_o lay_v on_o they_o in_o the_o respective_a hand_n dispose_v of_o the_o say_a money_n good_n chattel_n or_o debt_n towards_o the_o payment_n of_o any_o other_o debt_n before_o the_o say_a debt_n for_o which_o the_o attachment_n be_v lay_v be_v satisfy_v or_o the_o say_a attachment_n be_v dissolve_v that_o then_o and_o in_o all_o such_o case_n the_o say_a party_n for_o such_o their_o default_n shall_v be_v liable_a to_o make_v satisfaction_n to_o the_o plaintiff_n out_o of_o their_o own_o proper_a estate_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o in_o all_o debt_n not_o exceed_v forty_o shilling_n upon_o complaint_n make_v to_o any_o justice_n of_o the_o peace_n that_o the_o debtor_n against_o who_o he_o complain_v be_v go_v off_o this_o island_n or_o otherwise_o absent_v himself_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a justice_n of_o the_o peace_n to_o issue_v out_o a_o warrant_n of_o attachment_n to_o be_v levy_v by_o the_o constable_n in_o manner_n and_o form_n as_o be_v before_o prescribe_v to_o the_o provost-marshal_n for_o the_o execution_n of_o the_o writ_n and_o to_o be_v immediate_o determine_v by_o the_o say_a justice_n any_o clause_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o summons_n and_o other_o process_n hereafter_o mention_v shall_v be_v serve_v and_o execute_v in_o manner_n and_o form_n as_o be_v herein_o direct_v and_o in_o no_o other_o manner_n or_o way_n whatsoever_o that_o be_v to_o say_v that_o all_o summons_n as_o well_o from_o the_o supreme_a court_n as_o all_o other_o the_o inferior_a court_n within_o this_o island_n port-royal_a only_o except_v shall_v be_v deliver_v to_o the_o party_n or_o leave_v at_o their_o respective_a dwelling_n fourteen_o day_n before_o the_o several_a court_n by_o a_o swear_a marshal_n and_o that_o at_o port-royal_a all_o summons_n shall_v be_v deliver_v ten_o day_n before_o the_o court_n otherwise_o it_o shall_v be_v deem_v and_o take_v as_o no_o service_n and_o the_o defendant_n not_o bind_v by_o it_o to_o appear_v and_o that_o all_o replevin_n foreign_a attachment_n at_o the_o supreme_a court_n and_o warrant_n of_o arrest_n be_v serve_v at_o any_o time_n as_o heretofore_o and_o that_o no_o execution_n shall_v be_v take_v out_o serve_v or_o execute_v until_o twenty_o eight_o day_n be_v full_o expire_v after_o judgement_n except_o at_o port-royal_a where_o execution_n shall_v issue_v ten_o day_n after_o judgement_n obtain_v and_o that_o no_o negro_n horse_n or_o any_o manner_n of_o utensil_n belong_v to_o a_o plantation_n brick_n or_o pot-work_n nor_o any_o other_o negro_n whatsoever_o from_o and_o after_o the_o make_n hereof_o shall_v be_v take_v in_o execution_n where_o the_o party_n against_o who_o the_o execution_n be_v obtain_v shall_v offer_v good_n for_o satisfaction_n of_o the_o debt_n and_o cost_v of_o suit_n and_o it_o be_v further_o enact_v that_o the_o say_a defendant_n who_o have_v his_o good_n take_v upon_o execution_n shall_v have_v free_a liberty_n to_o convey_v and_o carry_v off_o the_o good_n so_o take_v at_o his_o own_o proper_a cost_v and_o charge_n to_o the_o next_o and_o most_o convenient_a place_n and_o market_n for_o disposal_n of_o the_o say_a good_n and_o there_o shall_v have_v free_a power_n and_o liberty_n to_o make_v contract_n bargain_n for_o and_o sell_v the_o good_n so_o take_v in_o execution_n the_o defendant_n first_o acquaint_v the_o marshal_n who_o levy_v the_o execution_n upon_o the_o good_n with_o such_o bargain_n or_o contract_n to_o the_o end_n the_o marshal_n may_v deliver_v the_o same_o and_o receive_v the_o produce_v thereof_o according_a to_o his_o precept_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o defendant_n after_o his_o good_n shall_v be_v so_o take_v in_o execution_n as_o aforesaid_a shall_v delay_v or_o neglect_v sell_v or_o dispose_n of_o the_o good_n until_o ten_o day_n before_o the_o next_o ensue_a court_n that_o then_o and_o in_o all_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o the_o marshal_n to_o take_v the_o say_v good_n and_o chattel_n of_o the_o defendant_n and_o the_o same_o to_o sell_v by_o public_a outcry_n and_o it_o be_v further_o enact_v by_o tho_o authority_n aforesaid_a that_o where_o no_o such_o good_n as_o aforesaid_a shall_v be_v show_v and_o offer_v to_o the_o provost-marshal_n so_o that_o the_o negro_n working-cattel_n or_o necessary_a utensil_n must_v be_v take_v in_o execution_n that_o then_o and_o in_o all_o such_o case_n the_o say_v negro_n horse_n or_o utensil_n shall_v not_o be_v remove_v but_o remain_v still_o in_o the_o defendant_n possession_n and_o that_o
say_a woman_n as_o in_o other_o case_n of_o bastardy_n give_v good_a security_n to_o save_v the_o parish_n harmless_a and_o as_o a_o further_a punishment_n for_o his_o offence_n and_o for_o and_o towards_o satisfaction_n of_o the_o master_n or_o mistress_n of_o such_o servant_n shall_v forfeit_v and_o pay_v unto_o the_o say_a master_n and_o mistress_n the_o full_a sum_n of_o twenty_o pound_n currant_n money_n of_o this_o island_n and_o shall_v likewise_o provide_v for_o the_o maintenance_n of_o the_o say_a servant_n and_o child_n and_o in_o case_n of_o failure_n herein_o shall_v serve_v the_o master_n or_o mistress_n of_o such_o servant_n double_a the_o time_n that_o she_o have_v to_o serve_v at_o the_o time_n of_o the_o offence_n commit_v or_o shall_v procure_v one_o in_o he_o or_o their_o stead_n that_o shall_v be_v oblige_v so_o to_o do_v and_o in_o case_n one_o servant_n shall_v beget_v another_o with_o child_n than_o the_o manservant_n shall_v after_o the_o expiration_n of_o his_o term_n serve_v the_o master_n or_o mistress_n of_o the_o woman-servant_n double_v the_o time_n she_o have_v to_o serve_v at_o the_o time_n of_o the_o offence_n commit_v that_o any_o manservant_n marry_v without_o the_o master_n or_o mistress_n consent_v shall_v serve_v two_o year_n for_o such_o offence_n but_o if_o any_o freeman_n shall_v marry_v a_o servant_n he_o shall_v be_v liable_a to_o pay_v the_o master_n or_o mistress_n twenty_o pound_n and_o she_o shall_v be_v free_a that_o all_o suit_n between_o servant_n and_o their_o master_n or_o mistress_n relate_v to_o their_o freedom_n shall_v be_v hear_v and_o determine_v by_o any_o two_o justice_n of_o the_o peace_n without_o any_o appeal_n and_o if_o any_o servant_n absent_v themselves_o from_o their_o master_n or_o mistress_n service_n without_o leave_n or_o a_o ticket_n from_o their_o master_n mistress_z or_o overseer_n shall_v for_o every_o such_o day_n absence_n serve_v one_o week_n and_o so_o in_o proportion_n for_o a'long_a or_o short_a time_n the_o whole_a punishment_n not_o to_o exceed_v three_o year_n that_o if_o any_o person_n shall_v turn_v away_o any_o sick_a or_o infirm_a servant_n under_o pretence_n of_o debt_n in_o any_o court_n of_o record_n unless_o the_o party_n offend_v shall_v pay_v the_o same_o and_o also_o receive_v the_o say_a servant_n if_o live_v and_o he_o to_o maintain_v during_o the_o whole_a time_n the_o say_a servant_n have_v to_o serve_v but_o if_o any_o servant_n through_o wilful_a misbehaviour_n shall_v happen_v to_o have_v the_o french_a pox_n yaws_n or_o any_o other_o disease_n break_a bone_n bruise_n sickness_n impediment_n or_o imprisonment_n he_o or_o she_o shall_v serve_v their_o master_n or_o mistress_n double_v the_o time_n thereby_o neglect_v and_o also_o for_o all_o charge_n occasion_v by_o reason_n thereof_o at_o ten_o shilling_n per_fw-la month_n after_o their_o time_n by_o indenture_n or_o otherwise_o be_v expire_v and_o also_o master_n or_o mistress_n of_o servant_n who_o shall_v receive_v unjust_a molestation_n by_o complaint_n or_o suit_n of_o law_n shall_v have_v the_o same_o remedy_n for_o their_o expense_n and_o loss_n of_o time_n that_o no_o servant_n be_v whip_v naked_a without_o order_n of_o a_o justice_n of_o peace_n upon_o penalty_n of_o five_o pound_n to_o be_v recover_v by_o the_o party_n injure_v by_o action_n of_o debt_n in_o any_o court_n of_o record_n and_o whosoever_o shall_v not_o give_v to_o each_o white_a servant_n weekly_n four_o pound_n of_o good_a flesh_n or_o four_o pound_n of_o good_a fish_n together_o with_o such_o convenient_a plantation_n provision_n as_o may_v be_v sufficient_a shall_v forfeit_v to_o the_o party_n injure_v ten_o shilling_n for_o each_o offence_n and_o whosoever_o shall_v not_o yearly_o give_v to_o each_o servant_n three_o shirt_n three_o pair_n of_o drawer_n three_o pair_n of_o shoe_n three_o pair_n of_o stocking_n and_o one_o hat_n or_o cap_n and_o to_o the_o woman_n proportionable_o shall_v forfeit_v to_o the_o party_n injure_v forty_o shilling_n that_o no_o master_n mistress_z or_o overseer_n shall_v cause_v or_o suffer_v any_o christian_a servant_n to_o be_v bury_v or_o inter_v until_o the_o body_n of_o such_o servant_n shall_v be_v view_v by_o a_o justice_n of_o the_o peace_n constable_n or_o tythingman_n or_o by_o two_o such_o neighbour_n as_o the_o say_a justice_n constable_n or_o tythingman_n shall_v choose_v and_o appoint_v on_o penalty_n of_o twenty_o pound_n currant_n money_n of_o this_o island_n unless_o such_o person_n die_v ten_o mile_n from_o the_o dwelling_n of_o a_o justice_n constable_n or_o tythingman_n and_o have_v be_v view_v by_o two_o of_o the_o next_o neighbour_n and_o in_o default_n of_o neighbour_n by_o two_o of_o the_o same_o family_n or_o that_o the_o say_a justice_n constable_n tythingman_n or_o neighbour_n have_v not_o within_o six_o hour_n after_o notice_n give_v come_v to_o view_v the_o dead_a body_n and_o whosoever_o upon_o notice_n give_v and_o request_v make_v to_o view_v such_o dead_a shall_v not_o within_o four_o hour_n after_o such_o notice_n repair_v to_o the_o view_n or_o on_o the_o view_n find_v any_o suspicious_a token_n of_o the_o body_n unlawful_a death_n shall_v not_o forthwith_o give_v notice_n to_o the_o coroner_n or_o in_o default_n of_o a_o coroner_n of_o that_o parish_n to_o the_o next_o justice_n of_o the_o peace_n shall_v forfeit_v ten_o pound_n which_o justice_n in_o such_o case_n be_v hereby_o empower_v to_o act_v as_o a_o coroner_n that_o whosoever_o shall_v entertain_v a_o servant_n know_v the_o same_o to_o be_v so_o shall_v forfeit_v for_o every_o day_n and_o night_n after_o the_o first_o five_o pound_n and_o not_o know_v he_o to_o be_v a_o servant_n twenty_o shilling_n for_o every_o day_n and_o night_n after_o the_o first_o so_o that_o the_o whole_a exceed_v not_o treble_v the_o value_n of_o the_o servant_n time_n remain_v to_o be_v serve_v with_o the_o master_n or_o mistress_n provide_v that_o this_o clause_n extend_v not_o to_o servant_n by_o contract_n make_v in_o this_o island_n but_o such_o as_o be_v attest_v by_o a_o justice_n of_o the_o peace_n nor_o to_o such_o as_o entertain_v any_o as_o bring_v a_o certificate_n of_o their_o freedom_n attest_v under_o the_o name_n of_o a_o justice_n of_o peace_n though_o the_o same_o be_v false_a and_o forge_a or_o for_o any_o other_o person_n who_o name_n the_o bringer_n personate_v but_o such_o forger_n falsifier_n personater_n or_o bringer_n and_o every_o one_o of_o they_o shall_v be_v set_v in_o the_o pillory_n and_o lose_v his_o ear_n on_o conviction_n thereof_o in_o the_o supreme_a court_n of_o judicature_n but_o whosoever_o shall_v entertain_v a_o servant_n any_o time_n if_o the_o say_a servant_n shall_v be_v drink_v trade_n or_o gain_n during_o the_o say_a time_n shall_v forfeit_v the_o sum_n of_o twenty_o shilling_n the_o one_o half_a to_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v and_o the_o other_o half_a to_o the_o informer_n to_o be_v levy_v by_o a_o warrant_n from_o any_o justice_n of_o the_o peace_n and_o also_o if_o a_o servant_n quarter-session_n of_o the_o parish_n where_o the_o same_o way_n be_v as_o well_o under_o his_o own_o as_o the_o hand_n of_o the_o juror_n by_o who_o oath_n the_o same_o as_o lay_v out_o to_o the_o end_n the_o same_o may_v be_v there_o file_v or_o record_v and_o after_o know_v for_o a_o public_a highway_n and_o if_o the_o say_a surveyor_n shall_v neglect_v his_o duty_n therein_o he_o shall_v forfeit_v twenty_o pound_n and_o be_v it_o further_o enact_v that_o every_o vestry_n with_o consent_n of_o the_o justice_n may_v agree_v for_o two_o year_n with_o particular_a person_n for_o their_o part_n and_o proportion_n of_o the_o way_n by_o they_o to_o be_v clear_v as_o also_o with_o the_o surveyor_n what_o part_n of_o the_o parish_n they_o shall_v look_v after_o and_o such_o agreement_n shall_v discharge_v the_o party_n from_o other_o duty_n than_o what_o be_v agree_v for_o as_o also_o the_o surveyor_n from_o look_v after_o any_o other_o part_n than_o what_o be_v allot_v he_o and_o such_o justice_n and_o vestry-man_n be_v to_o record_v all_o their_o do_n touch_v the_o way_n in_o the_o vestry-book_n which_o record_v in_o all_o place_n shall_v be_v deem_v good_a evidence_n and_o the_o say_a surveyor_n may_v respective_o issue_v their_o warrant_n to_o the_o constable_n or_o tything-man_n to_o warn_v in_o worker_n or_o to_o levy_v money_n according_a to_o the_o tax_n or_o the_o use_v of_o the_o highway_n and_o if_o not_o exceed_v forty_o shilling_n to_o be_v recover_v by_o action_n of_o debt_n before_o any_o justice_n of_o the_o peace_n if_o above_o forty_o shilling_n in_o any_o court_n of_o record_n where_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v a_o act_n appoint_v the_o price_n of_o meat_n be_v it_o enact_v and_o ordain_v by_o beef_n or_o goat_n four_o penny_n per_fw-la pound_n and_o mutton_n six_o penny_n to_o be_v weigh_v without_o the_o head_n entrail_n or_o foot_n and_o that_o the_o suet_n be_v sell_v at_o no_o high_a rate_n than_o the_o meat_n aforesaid_a under_o penalty_n of_o forfeit_v twenty_o pound_n currant_n money_n of_o this_o island_n for_o every_o time_n they_o shall_v take_v ask_v or_o receive_v any_o high_a price_n and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o sell_v any_o beef_n mutton_n or_o goat_n by_o weight_n he_o or_o they_o for_o every_o such_o offence_n shall_v forfeit_v twenty_o pound_n currant_n money_n of_o this_o island_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o any_o person_n whatsoever_o that_o shall_v destroy_v any_o turtle_n nest_n or_o take_v away_o any_o of_o the_o egg_n thereof_o upon_o any_o bay_n or_o place_n within_o this_o island_n where_o the_o turtle_n shall_v lay_v shall_v forfeit_v forty_o shilling_n currant_n money_n of_o this_o island_n or_o receive_v so_o many_o lash_n on_o the_o bare_a back_o as_o any_o justice_n shall_v order_n not_o exceed_v nine_o and_o thirty_o for_o every_o such_o offence_n the_o one_o three_o part_n of_o all_o the_o aforesaid_a penal_a sum_n of_o money_n shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o one_o three_o to_o the_o churchwarden_n for_o the_o use_v of_o the_o parish_n the_o other_o three_o to_o the_o informer_n to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n by_o bill_n plaint_n or_o information_n in_o which_o no_o essoign_n wager_n of_o law_n or_o protection_n shall_v be_v allow_v an_z act_z angainst_a blasphemy_n and_o for_o prevent_v disorder_n in_o alehouse_n tavern_n and_o victualling-house_n be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o no_o person_n or_o person_n whatsoever_o in_o this_o island_n be_v enable_v to_o have_v and_o receive_v any_o licence_n or_o licenses_fw-la from_o the_o governor_n for_o the_o time_n be_v to_o retail_n any_o strong_a liquor_n unless_o they_o bring_v yearly_o certificate_n under_o the_o hand_n of_o two_o of_o the_o justice_n of_o the_o peace_n live_v in_o the_o same_o precinct_n where_o the_o say_a person_n keep_v or_o intend_v to_o set_v up_o his_o house_n of_o entertainment_n and_o have_v also_o give_v good_a security_n in_o the_o secretary_n office_n of_o one_o hundred_o pound_n that_o he_o shall_v suffer_v no_o disorder_n to_o be_v commit_v in_o his_o say_a house_n or_o any_o thing_n there_o do_v contrary_a to_o the_o law_n of_o england_n or_o of_o this_o island_n and_o that_o no_o person_n whatsoever_o presume_v to_o sell_v rum_o or_o rum-punch_a or_o any_o other_o mixture_n of_o rum_o without_o licence_n first_o obtain_v from_o the_o justice_n in_o session_n and_o security_n give_v to_o the_o clerk_n of_o the_o peace_n of_o the_o say_v precinct_n under_o the_o penalty_n of_o forty_o shilling_n for_o every_o such_o offence_n provide_v always_o and_o it_o be_v hereby_o further_o enact_v and_o ordain_v that_o whatsoever_o person_n so_o license_v as_o aforesaid_a shall_v entertain_v or_o receive_v any_o one_o in_o their_o house_n to_o tipple_n or_o drink_v in_o the_o time_n of_o divine_a worship_n or_o service_n shall_v forfeit_v levy_v by_o distress_n by_o warrant_n from_o any_o justice_n of_o the_o peace_n within_o this_o island_n and_o whosoever_o shall_v by_o public_a and_o open_a profaneness_n or_o blasphemy_n dishonour_v receive_v licenses_fw-la as_o aforesaid_a shall_v keep_v or_o suffer_v any_o common_a game_n in_o their_o house_n they_o shall_v forfeit_v ten_o pound_n currant_n money_n of_o this_o island_n and_o whosoever_o shall_v by_o false_a dice_n or_o other_o fraud_n or_o deceit_n win_v any_o money_n or_o other_o thing_n shall_v forfeit_v treble_a the_o value_n thereof_o be_v convict_v by_o verdict_n confession_n or_o otherwise_o and_o that_o no_o sum_n exceed_v forty_o shilling_n win_v at_o any_o game_n or_o bet_v on_o the_o side_n of_o any_o shall_v be_v recoverable_a and_o all_o bond_n land_n be_v not_o concern_v shall_v and_o may_v be_v hear_v adjudge_v and_o determine_v by_o any_o of_o his_o majesty_n justice_n of_o the_o peace_n of_o this_o island_n within_o their_o respective_a precinct_n without_o appeal_n which_o say_v justice_n be_v hereby_o require_v upon_o complaint_n make_v to_o grant_v a_o warrant_n or_o summons_n against_o the_o person_n complain_v of_o thereby_o require_v he_o to_o appear_v and_o answer_v the_o say_a complaint_n and_o in_o case_n of_o non-appearance_n to_o issue_v out_o a_o warrant_n of_o contempt_n direct_v to_o the_o constable_n to_o bring_v the_o contemner_n before_o he_o as_o well_o to_o answer_v the_o say_a contempt_n as_o the_o plaintiff_n action_n and_o may_v if_o he_o see_v cause_n fine_a the_o contemner_n provide_v the_o his_o majesty_n public_a revenue_n a_o yearly_o salary_n of_o ten_o pound_n during_o his_o residence_n in_o this_o island_n which_o say_v sum_n of_o money_n be_v hereby_o appoint_v to_o be_v pay_v
