dunstan_n church_n 1659._o a_o act_n for_o impre_v of_o seamen_n whereas_o in_o this_o time_n of_o action_n the_o affair_n of_o the_o commonwealth_n require_v that_o there_o shall_v be_v sufficient_a and_o full_a number_n of_o seaman_n for_o the_o timely_a furnish_n and_o set_v forth_o of_o the_o fleet_n to_o sea_n for_o public_a service_n be_v it_o therefore_o enact_v by_o this_o present_a parliament_n and_o by_o the_o authority_n of_o the_o same_o that_o the_o council_n of_o state_n or_o commissioner_n for_o order_v and_o manage_n of_o the_o affair_n of_o the_o admiralty_n and_o navy_n or_o the_o general_n of_o the_o fleet_n or_o the_o commissioner_n of_o the_o navy_n shall_v hereby_o have_v power_n within_o the_o commonwealth_n of_o england_n and_o dominion_n thereof_o at_o any_o time_n or_o time_n from_o the_o five_o and_o twenty_o day_n of_o june_n one_o thousand_o six_o hundred_o fifty_o nine_o by_o their_o commissioner_n or_o commissioner_n officer_n or_o officer_n authorize_v thereunto_o by_o warrant_n under_o their_o or_o any_o of_o their_o hand_n and_o seal_n raise_v levy_n and_o impress_v such_o and_o so_o many_o mariner_n sailor_n waterman_n surgeon_n shall_v so_o impress_v he_o for_o conduct_n money_n for_o every_o mile_n from_o the_o place_n where_o he_o shall_v be_v so_o impress_v to_o the_o ship_n or_o place_n where_o he_o shall_v be_v appoint_v to_o make_v his_o repair_n the_o sum_n of_o one_o penny_n half_a penny_n per_fw-la mile_n and_o the_o like_a sum_n of_o one_o penny_n half_a penny_n for_o every_o mile_n from_o the_o place_n of_o his_o discharge_n unto_o the_o place_n of_o his_o abide_v and_o shall_v be_v allow_v for_o his_o service_n the_o same_o wage_n and_o entertainment_n in_o all_o respect_n which_o be_v allow_v by_o the_o parliament_n to_o any_o such_o person_n or_o person_n employ_v in_o the_o say_a service_n according_a to_o their_o respective_a place_n and_o if_o any_o mariner_n sailer_n waterman_n chirurgeon_n gunner_n ship-carpenter_n cawker_fw-ge hoy-man_n or_o carman_n shall_v refuse_v to_o be_v impre_v in_o and_o for_o the_o say_a service_n or_o shall_v hide_v or_o absent_v himself_o at_o the_o time_n of_o the_o press_n to_o avoid_v the_o say_a service_n he_o or_o they_o shall_v be_v commit_v to_o prison_n and_o there_o remain_v for_o the_o space_n of_o six_o month_n unless_o the_o council_n of_o state_n or_o commissioner_n for_o order_v and_o manage_n the_o affair_n of_o the_o admiralty_n and_o navy_n or_o the_o general_n or_o commissioner_n for_o the_o navy_n shall_v see_v cause_n to_o release_v they_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o mariner_n and_o seaman_n that_o shall_v be_v impress_v and_o receive_v impress_v or_o conduct-money_n or_o shall_v be_v retain_v or_o receive_v into_o the_o hire_n or_o service_n of_o this_o commonwealth_n to_o serve_v in_o any_o part_n of_o the_o fleet_n or_o navy_n or_o ship_n or_o ship_n of_o this_o commonwealth_n shall_v be_v bind_v and_o be_v hereby_o require_v to_o appear_v personal_o at_o such_o place_n and_o time_n as_o by_o ticket_n deliver_v to_o every_o such_o mariner_n or_o seaman_n under_o the_o hand_n of_o the_o person_n thereto_o authorize_v shall_v be_v set_v down_o nominate_v and_o appoint_v and_o shall_v make_v he_o or_o their_o personal_a and_o speedy_a repair_n to_o such_o ship_n and_o ship_n respective_o as_o he_o and_o they_o shall_v be_v direct_v and_o order_v unto_o and_o go_v on_o board_n such_o ship_n according_o and_o continue_v on_o board_n the_o say_a ship_n and_o do_v and_o perform_v his_o service_n therein_o without_o either_o withdraw_a or_o absent_v he_o or_o themselves_o from_o such_o ship_n and_o ship_n or_o remove_v from_o one_o sh●p_n to_o another_o without_o licence_n in_o write_v thereto_o obtain_v upon_o pain_n of_o death_n and_o all_o and_o every_o such_o offence_n and_o offence_n shall_v be_v by_o virtue_n of_o this_o act_n try_v before_o the_o judge_n of_o the_o admiralty_n for_o the_o time_n be_v and_o their_o associate_n commissioner_n of_o oyer_n and_o terminer_n for_o trial_n of_o maritine_n offender_n upon_o direction_n in_o write_v send_v unto_o they_o from_o the_o council_n of_o state_n for_o the_o trial_n of_o all_o and_o every_o such_o person_n and_o person_n as_o shall_v be_v proceed_v against_o for_o his_o or_o their_o life_n by_o virtue_n of_o this_o act._n and_o thereupon_o the_o say_a judge_n of_o the_o admiralty_n and_o their_o associate_n commissioner_n aforesaid_a by_o virtue_n of_o this_o act_n be_v authorize_v and_o require_v to_o hear_v and_o determine_v the_o say_v offence_n and_o to_o arraign_v and_o try_v all_o such_o criminous_a delinquent_n for_o the_o matter_n in_o this_o act_n contain_v and_o be_v find_v guilty_a to_o give_v judgement_n of_o death_n upon_o they_o respective_o for_o the_o same_o and_o to_o cause_n execution_n thereof_o to_o be_v do_v according_a to_o the_o usual_a course_n and_o form_n of_o criminal_a trial_n before_o the_o say_a judge_n and_o commissioner_n in_o case_n of_o maritine_n delinquency_n and_o for_o all_o and_o every_o such_o person_n or_o person_n offend_v in_o the_o premise_n as_o shall_v not_o by_o such_o direction_n in_o write_v from_o the_o council_n of_o state_n be_v direct_v to_o be_v try_v before_o the_o say_a judge_n of_o the_o admiralty_n and_o their_o associate_n as_o aforesaid_a they_o and_o every_o of_o they_o shall_v stand_v commit_v to_o prison_n as_o aforesaid_a there_o to_o remain_v by_o the_o space_n of_o six_o month_n without_o bail_n or_o mainprise_n and_o be_v it_o likewise_o enact_v that_o all_o and_o every_o person_n and_o person_n that_o shall_v oppose_v or_o resist_v any_o of_o the_o officer_n entrust_v for_o impre_v as_o aforesaid_a in_o their_o execution_n of_o that_o service_n or_o abet_v or_o set_v on_o any_o other_o so_o to_o do_v shall_v for_o the_o same_o offence_n incur_v the_o penalty_n of_o death_n and_o be_v try_v and_o adjudge_v and_o execute_v in_o manner_n and_o form_n aforesaid_a by_o and_o before_o the_o judge_n of_o the_o admiralty_n and_o their_o associate_n upon_o like_a direction_n in_o writing_n to_o be_v send_v unto_o they_o from_o the_o council_n of_o state_n and_o if_o no_o such_o direction_n shall_v be_v send_v for_o their_o trial_n by_o the_o council_n of_o state_n that_o then_o nevertheless_o they_o the_o say_v offender_n respective_o stand_v commit_v to_o prison_n without_o bail_n or_o mainprise_n for_o the_o space_n of_o six_o month_n and_o all_o justice_n of_o the_o peace_n mayor_n bailiff_n constable_n and_o all_o other_o officer_n be_v hereby_o require_v and_o enjoin_v to_o be_v aid_v and_o assist_v from_o time_n to_o time_n to_o the_o person_n authorize_v by_o virtue_n of_o this_o act_n for_o the_o better_a put_v in_o execution_n the_o same_o according_a to_o the_o true_a intent_n and_o meaning_n thereof_o and_o in_o case_n any_o person_n or_o person_n employ_v or_o to_o be_v employ_v in_o the_o impre_n of_o any_o mariner_n saylor_n waterman_n chirurgeon_n gunner_n ship-carpenter_n cawker_fw-ge hoyman_n or_o carman_n shall_v direct_o or_o indirect_o take_v or_o receive_v any_o money_n gratuity_n or_o reward_n for_o pre_v change_a spare_a or_o discharge_v of_o any_o person_n or_o person_n so_o impress_v or_o to_o be_v impre_v as_o aforesaid_a all_o and_o every_o such_o person_n so_o offend_v against_o this_o act_n shall_v forfeit_v and_o pay_v the_o sum_n of_o ten_o pound_n for_o every_o such_o offence_n the_o one_o moiety_n thereof_o to_o the_o use_n of_o the_o commonwealth_n and_o the_o other_o moiety_n to_o the_o use_n of_o such_o person_n or_o person_n who_o shall_v sue_v for_o the_o same_o in_o any_o court_n of_o record_n provide_v always_o that_o this_o act_n shall_v not_o extend_v to_o the_o pre_v any_o master_n masters-mate_n gunner_n carpenter_z or_o boatswain_n of_o any_o ship_n or_o vessel_n that_o be_v or_o shall_v be_v in_o employment_n and_o last_o for_o the_o further_a and_o better_a encouragement_n of_o seaman_n and_o waterman_n to_o apply_v themselves_o the_o more_o willing_o to_o the_o service_n it_o be_v further_a enact_v and_o ordain_v by_o this_o present_a parliament_n and_o the_o authority_n thereof_o that_o all_o mariner_n sailor_n and_o likewise_o all_o waterman_n who_o have_v serve_v a_o apprenticeship_n by_o the_o space_n of_o seven_o year_n in_o their_o say_a profession_n or_o that_o be_v servant_n &_o apprentice_n by_o indenture_n to_o any_o such_o waterman_n shall_v be_v and_o be_v hereby_o free_v and_o exempt_v from_o be_v pre_v to_o serve_v as_o soldier_n in_o any_o land-service_n provide_v that_o no_o seaman_n or_o waterman_n above_o the_o age_n of_o fifty_o or_o under_o the_o age_n of_o fifteen_o year_n shall_v be_v impre_v by_o virtue_n of_o this_o act._n provide_v that_o this_o act_n shall_v continue_v and_o be_v in_o force_n until_o the_o first_o day_n of_o december_n one_o thousand_o six_o hundred_o fifty_o nine_o and_o no_o long_o june_n 28_o 1659._o order_v by_o the_o parliament_n
