hereby_o for_o repair_v of_o the_o say_a highway_n and_o in_o case_n of_o difference_n in_o rate_v the_o same_o to_o be_v order_v and_o settle_v by_o the_o justice_n of_o the_o peace_n of_o the_o say_a county_n city_n or_o town_n corporate_a where_o such_o parish_n lie_v or_o any_o two_o of_o they_o and_o in_o such_o case_n where_o no_o such_o election_n of_o surveyor_n shall_v be_v make_v as_o aforesaid_a the_o then_o overseer_n for_o the_o poor_a of_o that_o parish_n be_v hereby_o appoint_v to_o be_v surveyor_n of_o the_o say_a surveyor_n of_o the_o say_a highway_n within_o such_o parish_n for_o the_o year_n ensue_v iii_o that_o every_o person_n be_v elect_v or_o hereby_o appoint_v to_o be_v surveyor_n of_o highway_n as_o aforesaid_a shall_v undertake_v the_o office_n and_o shall_v within_o ten_o day_n after_o such_o his_o election_n or_o be_v appoint_v as_o aforesaid_a procure_v himself_o to_o be_v swear_v before_o some_o justice_n of_o peace_n of_o the_o county_n ride_v city_n or_o town_n corporate_a or_o limit_v within_o which_o his_o parish_n do_v lie_v diligent_o and_o faithful_o to_o execute_v the_o office_n of_o surveyor_n of_o highway_n within_o his_o parish_n for_o the_o year_n then_o ensue_v and_o faithful_o to_o account_v for_o all_o money_n which_o shall_v come_v to_o his_o hand_n by_o virtue_n of_o his_o say_a office_n which_o oath_n every_o justice_n of_o peace_n be_v hereby_o empower_v and_o authorize_v to_o administer_v within_o the_o limit_n of_o his_o commission_n according_o and_o if_o any_o such_o person_n so_o elect_v or_o hereby_o appoint_v shall_v refuse_v to_o accept_v of_o his_o say_a office_n and_o to_o procure_v himself_o to_o be_v swear_v as_o aforesaid_a that_o then_o every_o person_n so_o fail_v shall_v forfeit_v for_o the_o same_o the_o sum_n of_o ten_o pound_n iv_o that_o every_o surveyor_n of_o high_a way_n have_v accept_v the_o office_n and_o be_v swear_v as_o aforesaid_a shall_v diligent_o apply_v himself_o to_o the_o duty_n and_o execution_n of_o his_o office_n and_o shall_v within_o ten_o day_n after_o his_o oath_n take_v view_v all_o the_o common_a and_o public_a highway_n and_o road_n where_o cart_n and_o carriage_n usual_o pass_v and_o all_o common_a bridge_n belong_v to_o the_o say_a parish_n to_o repair_v and_o all_o watercourse_n as_o also_o all_o street_n and_o pavement_n and_o common_a nuisance_n in_o the_o say_a way_n and_o street_n within_o their_o respective_a parish_n and_o shall_v consider_v what_o reparation_n will_v be_v needful_a to_o be_v make_v and_o what_o sum_n of_o money_n will_v be_v requisite_a and_o necessary_a to_o be_v raise_v within_o the_o parish_n for_o amend_v and_o repair_v the_o same_o upon_o pain_n of_o forfeit_v twenty_o shilling_n a_o piece_n for_o neglect_v of_o such_o view_n v._o that_o the_o say_a surveyor_n do_v within_o six_o day_n after_o such_o view_n give_v public_a notice_n in_o the_o church_n or_o chapel_n to_o the_o parishioner_n to_o meet_v to_o make_v a_o assessment_n for_o repair_v the_o say_a highway_n &_o street_n for_o make_v &_o repair_v of_o pavement_n and_o for_o cleanse_v the_o say_a street_n and_o pavement_n from_o time_n to_o time_n and_o for_o what_o else_o shall_v be_v requisite_a for_o the_o purpose_n aforesaid_a and_o thereupon_o a_o rate_n or_o tax_n in_o writing_n within_o three_o day_n after_o such_o notice_n shall_v be_v lay_v by_o the_o say_a inhabitant_n present_a at_o such_o meeting_n or_o the_o great_a number_n of_o they_o by_o a_o pound_n rate_n upon_o all_o the_o several_a occupier_n of_o house_n land_n tithe_n cole_n mine_n fellable_n wood_n tenement_n or_o hereditament_n within_o the_o parish_n according_a to_o the_o true_a yearly_a value_n of_o the_o same_o and_o also_o upon_o the_o dead_a good_n commodity_n or_o stock_n in_o trade_n of_o every_o particular_a parishioner_n charge_v to_o pay_v to_o the_o poor_a rate_v every_o twenty_o pound_n value_v of_o such_o good_n equal_a to_o every_o twenty_o shilling_n land_n by_o year_n and_o such_o further_a rate_n to_o be_v afterward_o and_o often_o make_v as_o occasion_n shall_v require_v so_o as_o all_o the_o rate_n together_o do_v not_o exceed_v twelve_o penny_n in_o the_o pound_n for_o any_o one_o parish_n in_o any_o one_o year_n vi_o that_o if_o such_o parishioner_n or_o the_o great_a number_n of_o they_o shall_v not_o agree_v among_o themselves_o to_o make_v such_o rate_n within_o two_o day_n after_o such_o meeting_n that_o then_o the_o say_a surveyor_n of_o highway_n themselves_o shall_v make_v a_o rate_n in_o writing_n according_a to_o the_o direction_n aforesaid_a and_o such_o rate_n as_o the_o say_a parishioner_n or_o surveyor_n respective_o shall_v so_o make_v be_v confirm_v by_o one_o justice_n of_o peace_n shall_v stand_v until_o upon_o complaint_n and_o proof_n of_o some_o irregularity_n or_o inequality_n therein_o to_o the_o justice_n of_o peace_n at_o the_o session_n the_o bench_n of_o justice_n or_o any_o two_o of_o they_o then_o present_a shall_v see_v cause_n to_o alter_v the_o same_o and_o if_o the_o say_a justice_n shall_v find_v cause_n to_o alter_v it_o than_o the_o say_a rate_n with_o such_o alteration_n as_o they_o shall_v make_v shall_v stand_v without_o any_o further_a appeal_n vii_o that_o in_o case_n where_o common_a nuisance_n be_v in_o highway_n or_o where_o such_o common_a highway_n in_o any_o parish_n be_v straighten_v by_o reason_n of_o enclosure_n make_v within_o twenty_o year_n either_o by_o hedge_n ditch_n wall_n or_o the_o like_a or_o where_o ditch_n or_o water_n course_n adjoin_v upon_o such_o highway_n or_o which_o do_v lead_v the_o water_n from_o such_o highway_n be_v not_o scour_v and_o dress_v or_o where_o any_o pavement_n be_v defective_a or_o any_o nuisance_n by_o filth_n or_o otherwise_o be_v in_o any_o pave_a street_n the_o say_a surveyor_n shall_v see_v that_o the_o same_o be_v reform_v and_o the_o offender_n in_o any_o of_o the_o premise_n punish_v according_a to_o law_n by_o information_n or_o indictment_n deduct_v for_o the_o charge_n of_o prosecution_n out_o of_o the_o money_n collect_v and_o the_o say_a parishioner_n or_o surveyor_n of_o highway_n respective_o be_v hereby_o empower_v in_o such_o case_n also_o to_o impose_v and_o levy_v over_o and_o above_o the_o twelve_o penny_n in_o the_o pound_n beforementioned_a such_o great_a tax_n and_o rate_n upon_o the_o occupier_n of_o those_o land_n where_o such_o enclosure_n or_o undress_v ditch_n or_o fence_n be_v as_o they_o shall_v respective_o think_v fit_a have_v the_o same_o rate_n allow_v by_o the_o session_n of_o the_o peace_n or_o the_o two_o next_o justice_n of_o peace_n as_o aforesaid_a which_o shall_v be_v
