time_n of_o the_o make_v thereof_o and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tything-man_n by_o warrant_n from_o the_o say_a justice_n justice_n or_o chief_a magistrare_fw-la respective_o shall_v and_o may_v with_o what_o aid_n force_n and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v to_o dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custsdy_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v be_v then_o resident_a shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n head-borough_n tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v dispose_v in_o manner_n aforesaid_a and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o one_o hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o his_o majesty_n the_o other_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidente_n and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n or_o if_o the_o plaintiff_n discontinue_v his_o action_n or_o if_o upon_o demurrer_n of_o any_o other_o act_n or_o law_n whatsoever_o provide_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liverty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberry_n thereof_o for_o the_o examine_v convict_a and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberry_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a and_o that_o within_o a_o week_n after_o the_o penalty_n pay_v or_o levy_v i_o answer_v that_o will_v be_v know_v by_o the_o warrant_n of_o the_o foreign_a justice_n upon_o which_o the_o levy_n be_v order_n to_o a_o conviction_n be_v a_o prosecution_n within_o the_o meaning_n of_o this_o clause_n it_o be_v not_o say_v convict_v but_o prosecute_v and_o such_o information_n be_v a_o commencement_n of_o the_o suit_n this_o be_v the_o primum_fw-la movens_fw-la towards_o a_o conviction_n after_o the_o offence_n commit_v as_o in_o civil_a action_n which_o be_v limit_v to_o be_v bring_v within_o such_o a_o time_n the_o beginning_n of_o a_o suit_n be_v the_o sue_v a_o original_a or_o other_o first_o writ_n as_o latitat_fw-la etc._n etc._n if_o within_o the_o time_n limit_v be_v well_o enough_o though_o the_o suit_n be_v not_o effectual_o prosecute_v though_o there_o be_v no_o judgement_n in_o a_o long_a while_n after_o so_o in_o capital_a criminal_a cause_n which_o must_v be_v prosecute_v shall_v not_o be_v double_o punish_v for_o one_o and_o the_o same_o offence_n but_o yet_o again_o if_o any_o preacher_n teacher_n or_o other_o person_n shall_v at_o such_o meeting_n speak_v seditious_a or_o treasonable_a word_n resist_v the_o magistrate_n come_v to_o disperse_v they_o or_o give_v opprobrious_a language_n to_o the_o justice_n or_o other_o officer_n in_o the_o execution_n of_o this_o act_n he_o may_v be_v indict_v and_o punish_v for_o any_o such_o offence_n and_o by_o this_o act_n too_o sect_n 15._o provide_v also_o that_o every_o alderman_n of_o london_n etc._n etc._n have_v this_o clause_n not_o be_v add_v it_o will_v be_v no_o great_a question_n but_o that_o they_o be_v include_v in_o the_o meaning_n of_o this_o act_n for_o they_o be_v the_o chief_a magistrate_n and_o convict_a be_v a_o feme-covert_a co-habiting_a etc._n etc._n in_o this_o case_n co-habitation_n as_o a_o wife_n be_v a_o sufficient_a evidence_n her_o be_v so_o and_o the_o justice_n need_v look_v no_o far_o for_o the_o husband_n be_v good_n and_o chattel_n be_v liable_a co-habiting_a i._n e._n for_o the_o most_o part_n or_o general_o for_o though_o she_o be_v in_o country_n house_n about_o this_o town_n and_o her_o husband_n in_o london_n yet_o his_o good_n will_v be_v liable_a if_o it_o have_v be_v otherwise_o it_o will_v have_v say_v then_o co-habiting_a or_o then_o personal_o reside_v so_o if_o the_o husband_n be_v upon_o any_o occasion_n from_o home_n for_o co-habitation_n here_o be_v use_v only_o in_o opposition_n to_o a_o separate_a live_n by_o sentence_n of_o spiritual_a court_n or_o by_o agreement_n of_o themselves_o not_o be_v apart_o now_o and_o then_o or_o at_o certain_a season_n of_o the_o year_n or_o on_o a_o occasional_a journey_n for_o in_o all_o such_o case_n the_o husband_n be_v still_o suppose_a to_o have_v the_o command_n over_o his_o wife_n so_o far_o as_o to_o restrain_v she_o from_o break_v this_o law_n and_o in_o case_n she_o offend_v it_o be_v to_o be_v suppose_v by_o his_o consent_n or_o connivance_n and_o therefore_o this_o law_n lay_v the_o punishment_n upon_o his_o shoulder_n sect_n 16._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o force_n of_o this_o act_n etc._n etc._n peer_n here_o seem_v to_o include_v all_o such_o as_o by_o law_n be_v privilege_v from_o
