her_o majesty_n or_o by_o order_n of_o six_o or_o more_o of_o the_o privy-councell_n or_o by_o such_o sickness_n and_o infirmity_n of_o body_n that_o they_o shall_v not_o be_v able_a to_o travel_v themselves_o and_o deliver_v their_o true_a name_n in_o write_v to_o the_o minister_n or_o curate_n of_o the_o parish_n and_o to_o the_o constable_n head-borough_n or_o tythingman_n of_o the_o town_n within_o such_o time_n and_o in_o such_o manner_n as_o aforesaid_a or_o shall_v after_o remove_v five_o mile_n from_o thence_o and_o shall_v not_o within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v conform_v himself_o to_o resort_v usual_o to_o divine_a service_n and_o in_o make_v such_o public_a confession_n and_o submission_n as_o hereafter_o be_v express_v refuse_v to_o answer_v direct_o whether_o he_o be_v a_o jesuit_n or_o not_o shall_v be_v commit_v to_o prison_n without_o bail_n or_o mainprize_n until_o he_o answer_v direct_o every_o person_n confine_v as_o aforesaid_a to_o the_o compass_n of_o five_o mile_n that_o have_v necessary_a occasion_n of_o business_n upon_o licence_n from_o two_o justice_n of_o the_o peace_n in_o the_o same_o county_n under_o their_o hand_n with_o the_o assent_n of_o the_o bishop_n of_o the_o diocese_n in_o writing_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n may_v travel_v about_o his_o necessary_a business_n for_o such_o time_n only_o as_o be_v contain_v in_o the_o licence_n no_o person_n so_o restrain_v as_o aforesaid_a which_o shall_v be_v forty_o pound_n and_o for_o every_o year_n after_o the_o sum_n of_o sixty_o pound_n until_o he_o or_o she_o shall_v receive_v the_o sacrament_n as_o aforesaid_a and_o if_o he_o or_o she_o who_o have_v receive_v the_o sacrament_n as_o aforesaid_a shall_v after_o offend_v in_o not_o receive_v the_o sacrament_n as_o aforesaid_a by_o the_o space_n of_o one_o whole_a year_n that_o then_o he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o sixty_o pound_n the_o one_o moiety_n to_o the_o king_n the_o other_o to_o he_o who_o will_v sue_v for_o the_o same_o in_o any_o of_o the_o court_n of_o record_n in_o westminster_n or_o before_o any_o justice_n of_o assize_n or_o before_o justice_n of_o peace_n at_o their_o general_a quarter-session_n by_o action_n of_o debt_n bill_n plaint_n or_o information_n wherein_o no_o essoyne_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v the_o churchwarden_n and_o constable_n of_o every_o town_n parish_n or_o chapel_n for_o the_o time_n be_v or_o some_o one_o of_o they_o or_o if_o there_o be_v none_o than_o the_o chief_a constable_n of_o the_o hundred_o where_o such_o town_n parish_n or_o chapel_n be_v or_o one_o of_o they_o as_o well_o in_o place_n exempt_a as_o not_o exempt_a shall_v once_o every_o year_n present_v the_o monthly_a absence_n from_o church_n of_o all_o popish_a recusant_n within_o such_o town_n and_o parish_n and_o shall_v present_v the_o name_n of_o every_o of_o the_o child_n of_o the_o say_a recusant_n be_v above_o the_o age_n of_o nine_o year_n and_o as_o near_o as_o they_o can_v the_o age_n of_o the_o say_a child_n as_o also_o the_o name_n of_o the_o servant_n of_o the_o say_a recusant_n at_o the_o next_o general_n or_o quarter-session_n of_o that_o shire_n limit_n division_n or_o liberty_n all_o such_o presentment_n shall_v be_v record_v in_o the_o say_a session_n by_o the_o clerk_n of_o the_o peace_n or_o town-clerk_n for_o the_o time_n be_v without_o any_o fee_n and_o for_o default_n of_o every_o such_o presentment_n the_o say_a churchwarden_n constable_n or_o high-constable_n shall_v forfeit_v twenty_o shilling_n and_o for_o default_n of_o record_v such_o presentment_n without_o a_o fee_n the_o clerk_n of_o the_o peace_n or_o town-clerke_a shall_v forfeit_v 40._o s._n every_o presenement_n make_v by_o any_o churchwarden_n constable_n or_o high-constable_n as_o aforesaid_a whereby_o any_o recusant_n shall_v happen_v to_o be_v convict_v shall_v be_v reward_v by_o have_v 40._o s._n to_o be_v levy_v out_o of_o such_o recusants_n good_n and_o estate_n in_o such_o manner_n as_o by_o the_o more_o part_n of_o the_o justice_n shall_v be_v order_v by_o warrant_n under_o their_o hand_n and_o seal_n the_o justice_n of_o assiize_n and_o justice_n of_o quarter-session_n have_v power_n to_o hear_v and_o determine_v of_o all_o recusant_n as_o well_o for_o not_o receive_v the_o sacrament_n as_o for_o not_o come_v to_o church_n and_o have_v also_o power_n to_o make_v proclamation_n that_o the_o body_n of_o every_o such_o offendor_n shall_v be_v render_v to_o the_o sheriff_n of_o the_o county_n or_o the_o baylif_n or_o keeper_n of_o the_o goal_n of_o the_o liberty_n before_o the_o next_o assize_n general_n or_o quarter-session_n and_o if_o then_o the_o offendor_n shall_v not_o make_v his_o appearance_n upon_o record_n that_o every_o such_o default_n shall_v be_v deem_v as_o a_o sufficient_a conviction_n by_o verdict_n of_o 12_o man_n this_o statute_n recite_v the_o penalty_n impose_v by_o the_o 29_o eliz._n 6._o upon_o a_o recusant_n convict_v and_o that_o every_o conviction_n shall_v be_v certify_v into_o the_o exchequer_n as_o be_v in_o the_o statute_n of_o 23_o el._n 1._o concern_v recusant_n monthly_a forfeiture_n yet_o by_o this_o statute_n the_o king_n may_v refuse_v the_o 20_o l._n a_o month_n and_o take_v the_o 2_o part_n of_o the_o recusants_n land_n yet_o the_o king_n shall_v not_o take_v into_o his_o two_o part_n the_o mansion_n house_n nor_o shall_v demise_n nor_o lease_n over_o the_o 2_o three_o part_n or_o any_o part_n thereof_o to_o any_o recusant_n nor_o to_o the_o use_n of_o any_o recusant_n and_o whosoever_o shall_v take_v any_o lease_n of_o the_o king_n of_o such_o land_n shall_v give_v such_o security_n as_o the_o court_n of_o exchequer_n shall_v allow_v not_o to_o suffer_v any_o waste_n to_o be_v commit_v upon_o the_o premise_n for_o the_o better_a trial_n how_o the_o king_n subject_n stand_v affect_v in_o point_n of_o loyalty_n and_o due_a obedience_n it_o be_v enact_v that_o after_o the_o end_n of_o the_o session_n of_o parliament_n any_o bishop_n of_o the_o diocese_n or_o any_o two_o justice_n of_o peace_n whereof_o one_o of_o the_o quorum_fw-la within_o the_o jurisdiction_n of_o their_o session_n may_v require_v any_o person_n of_o the_o age_n of_o 18_o year_n or_o above_o be_v or_o which_o shall_v be_v convict_v or_o indict_v for_o any_o recusancy_n except_o nobleman_n and_o noble_a woman_n for_o not_o repair_v to_o divine_a service_n according_a to_o law_n or_o have_v not_o receive_v the_o sacrament_n twice_o within_o the_o year_n next_o pass_v or_o any_o person_n pass_v through_o the_o county_n or_o liberty_n and_o unknown_a except_o as_o be_v before_o except_v that_o be_v examine_v by_o they_o upon_o oath_n shall_v confess_v or_o not_o deny_v himself_o to_o be_v a_o recusant_n or_o shall_v confess_v or_o not_o deny_v that_o he_o have_v not_o take_v the_o sacrament_n twice_o within_o the_o year_n to_o take_v this_o oath_n hereafter_o upon_o the_o holy_a evangelist_n which_o say_v bishop_n or_o two_o justice_n shall_v certify_v in_o write_v subscribe_v with_o his_o or_o their_o hand_n at_o the_o next_o general_n or_o quarter-session_n the_o christian_a name_n surname_n and_o place_n of_o abode_n of_o every_o person_n which_o shall_v take_v the_o say_a oath_n which_o certificate_n shall_v be_v there_o record_v and_o keep_v among_o record_n of_o the_o say_a session_n if_o any_o person_n other_o than_o nobleman_n and_o noble_a woman_n shall_v refuse_v to_o answer_v upon_o oath_n to_o such_o bishop_n or_o the_o nativity_n of_o st._n 2._o stat._n 27_o eliz._n cap._n 2._o john_n the_o baptist_n in_o the_o first_o year_n of_o the_o queen_n shall_v within_o 40._o day_n next_o after_o the_o session_n of_o parliament_n if_o they_o be_v not_o wind-bound_a depart_v out_o of_o england_n and_o other_o the_o queen_n dominion_n if_o any_o jesuit_n seminary_n priest_n or_o other_o such_o priest_n deacon_n or_o religious_a or_o ecclesiastical_a person_n whatsoever_o bear_v within_o the_o dominion_n of_o the_o queen_n and_o make_v since_o the_o feast_n of_o the_o nativity_n of_o st._n john_n in_o the_o traitor_n all_o they_o which_o shall_v receive_v any_o such_o jesuit_n or_o priest_n after_o such_o time_n shall_v be_v adjudge_v a_o fellow_n without_o benefit_n of_o clergy_n if_o any_o subject_a of_o england_n then_o be_v or_o after_o shall_v be_v of_o or_o bring_v up_o in_o any_o college_n of_o jesuit_n or_o seminary_n already_o erect_v or_o to_o be_v erect_v out_o of_o the_o realm_n shall_v not_o within_o six_o month_n next_o after_o proclamation_n in_o that_o behalf_n make_v in_o london_n under_o the_o broad_a seal_n return_v into_o this_o realm_n and_o within_o two_o day_n after_o before_o the_o bishop_n of_o the_o diocese_n or_o two_o justice_n of_o the_o peace_n of_o the_o county_n where_o he_o shall_v arrive_v submit_v himself_o to_o her_o majesty_n and_o her_o law_n and_o take_v the_o oath_n set_v forth_o in_o the_o first_o year_n of_o her_o reign_n that_o then_o every_o such_o person_n which_o shall_v otherwise_o return_v shall_v be_v take_v and_o deem_v as_o a_o serve_v in_o their_o trade_n as_o merchant_n or_o mariner_n beyond_o the_o sea_n without_o the_o queen_n special_a licence_n or_o under_o four_o of_o the_o counsel_n hand_n upon_o the_o penalty_n of_o one_o hundred_o pound_n every_o offence_n commit_v against_o this_o act_n may_v be_v hear_v and_o determine_v as_o well_o in_o the_o king_n bench_n as_o also_o in_o any_o county_n within_o this_o or_o bishop_n of_o this_o realm_n or_o to_o some_o justice_n of_o peace_n within_o the_o county_n where_o he_o shall_v arrive_v and_o do_v thereupon_o true_o and_o sincere_o before_o the_o archbishop_n bishop_n or_o justice_n of_o peace_n take_v the_o say_a oath_n set_v forth_o the_o first_o of_o eliz._n and_o under_o his_o hand_n confess_v afterward_o to_o continue_v in_o due_a obedience_n to_o the_o queen_n law_n make_v or_o to_o be_v make_v in_o cause_n of_o religion_n peer_n shall_v be_v try_v by_o their_o peer_n for_o any_o offence_n make_v treason_n felony_n or_o praemunire_n by_o this_o act._n any_o person_n be_v a_o subject_a of_o this_o realm_n which_o shall_v after_o the_o say_v 40._o day_n know_v any_o such_o jesuit_n or_o priest_n etc._n etc._n and_o shall_v not_o discover_v the_o same_o to_o some_o justice_n of_o peace_n or_o high_a officer_n within_o 12._o day_n every_o such_o person_n shall_v be_v fine_v and_o imprison_v according_a to_o the_o queen_n pleasure_n and_o every_o such_o justice_n of_o peace_n or_o high_a officer_n which_o shall_v not_o discover_v the_o same_o within_o 28._o day_n to_o some_o of_o the_o queen_n council_n or_o to_o the_o precedent_n or_o vicepresident_n of_o the_o queen_n council_n establish_v in_o the_o north_n or_o march_n of_o wales_n than_o he_o or_o they_o so_o offend_v shall_v forfeit_v 200_o mark_n forty_o pound_n for_o every_o month_n that_o he_o or_o they_o shall_v relieve_v etc._n etc._n any_o person_n so_o offend_v this_o act_n shall_v in_o no_o wise_n extend_v to_o punish_v or_o impeach_v any_o person_n for_o relieve_v or_o keep_v his_o father_n wife_n mother_n child_n ward_n brother_n or_o sister_n or_o his_o wife_n father_n or_o mother_n not_o have_v any_o certain_a place_n of_o habitation_n of_o their_o own_o or_o the_o husband_n or_o wife_n of_o any_o of_o they_o or_o for_o relieve_v maintain_v or_o keep_v any_o such_o person_n as_o shall_v be_v commit_v by_o authority_n to_o the_o custody_n of_o any_o by_o who_o they_o shall_v be_v so_o relieve_v or_o maintain_v these_o two_o last_o clause_n be_v repeal_v by_o the_o 3_o jac._n 4._o all_o duty_n forfeiture_n and_o payment_n due_a to_o the_o queen_n by_o virtue_n of_o this_o act_n or_o the_o act_n of_o the_o 23_o of_o eliz._n concern_v recusant_n may_v be_v recover_v and_o levy_v to_o her_o majesty_n use_n by_o charitable_a use_n in_o such_o manner_n and_o form_n as_o be_v limit_v and_o appoint_v in_o the_o statute_n make_v in_o the_o 29_o eliz._n c._n 6._o concern_v recusant_n no_o popish_a recusant_n or_o feme_fw-fr covert_n shall_v be_v compel_v to_o abjure_v by_o this_o act._n every_o person_n that_o shall_v abjure_v by_o virtue_n of_o this_o act_n and_o refuse_v be_v thereunto_o require_v as_o aforesaid_a shall_v forfeit_v to_o the_o queen_n all_o his_o good_n and_o chattel_n for_o ever_o and_o his_o land_n and_o tenement_n during_o life_n the_o wife_n of_o any_o such_o offendor_n shall_v then_o according_a to_o the_o church_n of_o england_n by_o a_o minister_n lawful_o authorize_v shall_v be_v disable_v to_o have_v any_o estate_n of_o freehold_n by_o courtesy_n of_o england_n and_o every_o woman_n be_v a_o popish_a recusant_n convict_v which_o shall_v be_v marry_v in_o other_o form_n then_o as_o aforesaid_a shall_v be_v disable_v not_o only_o to_o claim_v any_o dower_n or_o jointure_n but_o also_o the_o widow_n estate_n and_o frankbanck_n in_o any_o customary_a land_n whereof_o her_o husband_n die_v seize_v and_o likewise_o from_o have_v part_n of_o her_o husband_n good_n by_o virtue_n of_o any_o custom_n of_o any_o county_n city_n or_o place_n and_o if_o a_o man_n be_v marry_v contrary_a to_o the_o true_a intent_n of_o this_o statute_n to_o a_o woman_n who_o have_v no_o land_n or_o tenement_n whereby_o he_o may_v become_v tenant_n by_o courtesy_n he_o shall_v forfeit_v 100_o l._n to_o be_v pay_v as_o aforesaid_a every_o popish_a recusant_n which_o shall_v the_o king_n court_n wherein_o no_o essoine_n etc._n etc._n shall_v be_v allow_v if_o any_o popish_a recusant_n not_o be_v excommunicate_v shall_v be_v bury_v in_o any_o place_n other_o than_o the_o church_n or_o church-yard_n or_o not_o according_a to_o the_o ecclesiastical_a law_n of_o the_o realm_n that_o the_o executor_n or_o administrator_n of_o every_o such_o person_n so_o bury_v know_v the_o same_o or_o the_o party_n that_o so_o buri_v he_o shall_v forfeit_v twenty_o pound_n to_o be_v pay_v as_o aforesaid_a if_o the_o child_n of_o any_o of_o the_o subject_n within_o this_o realm_n the_o say_a child_n not_o be_v soldier_n mariner_n merchant_n or_o their_o apprentice_n or_o factor_n shall_v be_v send_v or_o go_v beyond_o sea_n without_o licence_n of_o the_o king_n or_o six_o of_o the_o privy_a council_n whereof_o the_o principal_a secretary_n to_o be_v one_o under_o their_o hand_n and_o seal_n that_o very_o such_o child_n shall_v take_v no_o benefit_n by_o any_o gift_n make_v for_o the_o keep_n of_o holy_a day_n and_o fast_v day_n and_o of_o the_o 5_o ed._n 6._o 12._o touch_v the_o marriage_n of_o priest_n and_o legitimation_n of_o their_o child_n all_o such_o divine_a service_n and_o administration_n of_o sacrament_n as_o be_v most_o common_o use_v in_o england_n in_o the_o last_o year_n of_o h._n 8._o shall_v be_v use_v through_o the_o realm_n after_o the_o 20_o day_n of_o december_n anno_fw-la dom._n 1553._o and_o no_o other_o kind_n of_o service_n nor_o administration_n of_o sacrament_n it_o be_v enact_v that_o if_o any_o person_n or_o person_n of_o their_o own_o power_n and_o authority_n after_o the_o 20._o of_o december_n shall_v willing_o and_o of_o purpose_n by_o open_a or_o 3._o st._n an._n 1_o mariae_fw-la sess_n 2._o cap._n 3._o overt_a word_n fact_n etc._n etc._n malicious_o or_o contemptuous_o neglect_v vex_v or_o disturb_v etc._n etc._n any_o preacher_n or_o preacher_n license_v allow_v or_o authorize_v to_o preach_v by_o cambridge_n or_o otherwise_o lawful_o authorize_v by_o reason_n of_o his_o cure_n or_o benefice_n etc._n etc._n in_o any_o open_a sermon_n preach_v or_o collation_n in_o any_o church_n chappel_n or_o churchyard_n etc._n etc._n or_o if_o any_o person_n shall_v wilful_o disturb_v etc._n etc._n any_o parson_n vicar_n parish-priest_n curate_n or_o other_o lawful_a priest_n say_v or_o celebrate_v the_o mass_n or_o other_o divine_a service_n sacrament_n or_o sacramental_n as_o be_v common_o frequent_v and_o use_v in_o the_o last_o year_n of_o h._n 8._o or_o afterward_o shall_v be_v allow_v and_o set_v forth_o or_o authorize_v by_o the_o queen_n or_o if_o any_o person_n shall_v contemptuous_o unlawful_o or_o malicious_o deface_v spoil_n abuse_n or_o unreverent_o handle_v or_o order_v the_o most_o bless_a comfortable_a and_o holy_a sacrament_n of_o the_o body_n and_o blood_n of_o our_o lord_n and_o saviour_n jesus_n christ_n common_o call_v the_o sacrament_n of_o the_o altar_n be_v in_o any_o church_n chappel_n or_o other_o decent_a place_n or_o the_o piece_n or_o canapy_n wherein_o the_o same_o sacrament_n be_v or_o shall_v be_v or_o pull_v down_o deface_v spoil_n or_o otherwise_o break_v any_o altar_n or_o altar_n or_o any_o crucifix_n or_o cross_n in_o any_o church_n chappel_n or_o churchyard_n that_o then_o every_o such_o offender_n his_o aider_n and_o abettor_n shall_v be_v apprehend_v etc._n etc._n by_o the_o constable_n or_o churchwarden_n of_o the_o place_n wherein_o the_o say_v offence_n shall_v be_v commit_v which_o person_n so_o apprehend_v &c_n &c_n with_o extinguish_v the_o authority_n of_o the_o bishop_n of_o rome_n stat._n 28._o h._n 8._o 16._o for_o release_v of_o such_o as_o then_o have_v obtain_v pretence_a licence_n and_o dispensation_n from_o the_o see_v of_o rome_n stat._n
shall_v retain_v in_o service_n see_v or_o livery_n any_o person_n which_o shall_v forbear_v to_o go_v to_o some_o usual_a place_n of_o divine_a service_n by_o the_o space_n of_o a_o month_n shall_v forfeit_v for_o every_o such_o month_n he_o know_v the_o same_o the_o sum_n of_o ten_o pound_n this_o act_n shall_v not_o extend_v to_o punish_v any_o person_n for_o maintain_v relieve_v or_o harbour_v his_o father_n or_o mother_n want_v without_o fraud_n any_o other_o habitation_n or_o sufficient_a maintenance_n or_o the_o ward_n of_o any_o person_n commit_v by_o authority_n to_o the_o the_o common_a law_n as_o a_o councillor_n clerk_n attorney_n or_o solicitor_n nor_o shall_v practise_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practise_v physic_n nor_o be_v a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o any_o court_n nor_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town-clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v office_n as_o captain_n lieutenant_z corporal_n sergeant_n ancient-bearer_n or_o other_o office_n in_o camp_n troop_n band_n or_o company_n of_o soldier_n nor_o bear_v any_o office_n in_o any_o ship_n castle_n or_o fortress_n of_o the_o king_n upon_o penalty_n of_o one_o hundred_o pound_n to_o be_v forfeit_v as_o aforesaid_a no_o popish_a recusant_n convict_v or_o have_v a_o wife_n convict_v shall_v bear_v any_o public_a office_n in_o the_o commonwealth_n every_o marry_a woman_n be_v a_o recusant_n convict_v her_o husband_n not_o be_v convict_v shall_v forfeit_v 2._o three_o part_n of_o her_o jointure_n and_o dower_n during_o her_o life_n and_o be_v make_v uncapable_a of_o be_v executrix_n or_o administratrix_n to_o her_o husband_n
