all_o the_o ceremony_n at_o once_o but_o by_o degree_n see_v the_o wise_a course_n of_o those_o time_n now_o to_o prove_v that_o this_o act_n be_v only_o intend_v against_o papist_n be_v most_o plain_a because_o the_o whole_a act_n run_v for_o the_o beat_n down_o of_o popish_a foppery_n and_o superstition_n of_o the_o church_n of_o rome_n and_o then_o again_o it_o be_v impossible_a it_o can_v be_v intend_v against_o any_o sort_n of_o protestant_n for_o at_o that_o time_n a_o day_n there_o be_v but_o two_o sort_n of_o people_n in_o england_n viz._n protestant_n and_o papist_n now_o for_o the_o penalty_n of_o this_o act_n it_o be_v very_o various_a but_o as_o to_o the_o come_n to_o church_n it_o be_v 12_o d._n a_o week_n and_o this_o to_o be_v levy_v by_o the_o churchwarden_n and_o overseer_n of_o the_o poor_a but_o i_o confess_v churchwarden_n etc._n etc._n must_v have_v a_o warrant_n before_o they_o can_v distrein_o and_o that_o the_o session_n have_v power_n to_o do_v upon_o conviction_n see_v sect_n 14_o and_o 15._o but_o other_o offence_n commit_v against_o the_o act_n must_v be_v try_v by_o peer_n see_v sect_n 21._o so_o that_o upon_o the_o whole_a matter_n if_o the_o justice_n shall_v execute_v this_o act_n upon_o the_o protestant_a dissenter_n from_o the_o now_o establish_v church_n of_o england_n yet_o the_o labour_n be_v more_o than_o the_o profit_n and_o therefore_o can_v do_v no_o great_a hurt_n the_o next_o law_n in_o force_n against_o popish_a recusant_n be_v the_o 23_o eliz._n cap._n 1._o entitle_v a_o act_n to_o retain_v the_o queen_n majesty_n to_o turn_v informer_n and_o to_o give_v in_o their_o information_n at_o the_o next_o session_n i_o doubt_v not_o but_o these_o person_n so_o fine_v or_o imprison_v will_v traverse_n those_o fine_n but_o how_o can_v this_o stand_v with_o reason_n that_o the_o justice_n pretend_v viz._n thai_n seditious_a conventicler_n be_v disturber_n of_o the_o pear_n as_o by_o the_o order_n and_o the_o act_n seem_v to_o confirm_v and_o yet_o at_o the_o same_o time_n the_o order_n call_v such_o sober_a man_n certain_o it_o be_v the_o first_o time_n that_o ever_o any_o court_n call_v disturber_n of_o the_o peace_n sober_a man_n but_o if_o it_o shall_v be_v admit_v by_o the_o justice_n that_o all_o conventicler_n be_v sober_a man_n now_o will_v that_o agree_v with_o the_o same_o order_n in_o the_o next_o part_n that_o call_v breaker_n of_o the_o peace_n and_o a_o danger_n even_o to_o the_o monarchy_n itself_o and_o keep_v up_o the_o division_n that_o be_v among_o we_o certain_o not_o sober_a man_n can_v do_v such_o thing_n yet_o all_o such_o man_n as_o do_v meet_v in_o a_o seditious_a riotous_a manner_n under_o colour_n of_o religion_n with_o force_n and_o arm_n do_v break_v the_o peace_n and_o therefore_o can_v be_v call_v sober_a men._n but_o i_o suppose_v the_o justice_n have_v this_o reach_n with_o they_o that_o since_o they_o have_v make_v the_o first_o learned_a order_n and_o no_o notice_n take_v of_o it_o they_o be_v resolve_v by_o this_o order_n to_o show_v themselves_o moderate_a man_n such_o as_o will_v do_v something_o to_o continue_v their_o place_n though_o it_o be_v but_o to_o make_v a_o noise_n in_o the_o county_n therefore_o i_o shall_v say_v no_o more_o to_o they_o as_o to_o this_o part_n of_o the_o order_n only_o but_o that_o if_o sober_a man_n do_v meet_v to_o worship_n and_o serve_v god_n by_o sing_v of_o psalm_n pray_v and_o preach_v not_o under_o a_o pretence_n of_o serve_v of_o god_n but_o in_o reality_n then_o both_o as_o a_o court_n or_o as_o single_a justice_n nor_o yet_o their_o officer_n who_o they_o so_o hot_o pursue_v can_v meddle_v or_o touch_v such_o by_o this_o act_n or_o any_o other_o law_n and_o if_o they_o have_v any_o information_n of_o any_o other_o meeting_n they_o will_v do_v well_o to_o extend_v their_o power_n for_o the_o suppress_v they_o so_o far_o as_o the_o act_n of_o the_o 22_o of_o this_o king_n or_o another_o passage_n can_v be_v omit_v to_o be_v take_v notice_n of_o in_o that_o order_n which_o be_v viz._n which_o in_o all_o probability_n will_v destroy_v both_o church_n and_o state_n this_o be_v the_o opinion_n of_o this_o court_n and_o of_o the_o justice_n with_o who_o his_o majesty_n have_v be_v please_v to_o intrust_v the_o peace_n of_o this_o county_n which_o make_v they_o not_o sit_v be_v a_o clause_n on_o purpose_n that_o the_o justice_n of_o oyer_n and_o terminer_n and_o gaol-delivery_n and_o session_n of_o the_o peace_n shall_v have_v power_n in_o their_o session_n to_o hear_v
