after_o such_o tax_n make_v and_o not_o afterward_o and_o that_o there_o it_o appear_v to_o the_o say_a justice_n that_o he_o she_o or_o they_o be_v overrated_n tax_v or_o assess_v the_o say_a justice_n be_v hereby_o authorize_v and_o impower_v if_o they_o find_v he_o her_z or_o they_o so_o overrated_n or_o assess_v to_o ease_v he_o her_z or_o they_o as_o to_o their_o discretion_n shall_v seem_v meet_a but_o that_o no_o appeal_n shall_v lie_v further_o or_o to_o any_o other_o court_n or_o place_n in_o this_o island_n for_o any_o tax_n or_o rate_v make_v or_o assess_v by_o the_o justice_n and_o vestry-man_n of_o each_o respective_a parish_n in_o this_o island_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o churchwarden_n of_o each_o respective_a parish_n within_o this_o island_n do_v buy_v or_o cause_n to_o be_v buy_v one_o record_n of_o all_o such_o birth_n christen_n marriage_n and_o burial_n and_o in_o all_o and_o every_o the_o court_n of_o record_n in_o this_o island_n but_o if_o any_o person_n hereby_o authorize_v to_o make_v such_o entry_n or_o any_o other_o whatsoever_o shall_v make_v or_o cause_n to_o be_v make_v any_o false_a entry_n or_o shall_v raze_v our_o or_o imbezel_n any_o entry_n or_o book_n of_o and_o that_o the_o parish_n of_o st._n thomas_n st._n andrews_n and_o st._n john_n do_v allow_v and_o pay_v unto_o their_o respective_a minister_n one_o hundred_o pound_n of_o like_a money_n per_fw-la annum_fw-la and_o that_o all_o the_o other_o parish_n within_o this_o his_o majesty_n island_n that_o either_o have_v or_o shall_v have_v a_o minister_n do_v allow_v and_o pay_v eighty_o pound_n currant_n money_n and_o not_o less_o as_o a_o constant_a yearly_o salary_n for_o the_o support_n and_o maintenance_n of_o every_o of_o their_o minister_n to_o be_v pay_v at_o their_o respective_a dwell_v house_n every_o six_o month_n without_o any_o charge_n or_o defalcation_n by_o equal_a portion_n and_o none_o to_o be_v capable_a of_o be_v present_v to_o the_o say_a benefice_n or_o receive_v the_o profit_n of_o the_o same_o unless_o they_o produce_v due_a testimonial_n that_o they_o be_v qualify_v according_a to_o the_o canon_n of_o the_o church_n of_o england_n by_o have_v take_v deacon_n and_o priest_n order_n and_o the_o say_a testimonial_n to_o be_v record_v in_o the_o secretary_n office_n and_o be_v it_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o no_o minister_n not_o due_o qualify_v as_o aforesaid_a presume_v to_o marry_v any_o person_n or_o person_n whatsoever_o under_o the_o penalty_n of_o one_o hundred_o pound_n currant_n money_n of_o this_o island_n one_o third_n thereof_o to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o
quarter-session_n of_o the_o parish_n where_o the_o same_o way_n be_v as_o well_o under_o his_o own_o as_o the_o hand_n of_o the_o juror_n by_o who_o oath_n the_o same_o as_o lay_v out_o to_o the_o end_n the_o same_o may_v be_v there_o file_v or_o record_v and_o after_o know_v for_o a_o public_a highway_n and_o if_o the_o say_a surveyor_n shall_v neglect_v his_o duty_n therein_o he_o shall_v forfeit_v twenty_o pound_n and_o be_v it_o further_o enact_v that_o every_o vestry_n with_o consent_n of_o the_o justice_n may_v agree_v for_o two_o year_n with_o particular_a person_n for_o their_o part_n and_o proportion_n of_o the_o way_n by_o they_o to_o be_v clear_v as_o also_o with_o the_o surveyor_n what_o part_n of_o the_o parish_n they_o shall_v look_v after_o and_o such_o agreement_n shall_v discharge_v the_o party_n from_o other_o duty_n than_o what_o be_v agree_v for_o as_o also_o the_o surveyor_n from_o look_v after_o any_o other_o part_n than_o what_o be_v allot_v he_o and_o such_o justice_n and_o vestry-man_n be_v to_o record_v all_o their_o do_n touch_v the_o way_n in_o the_o vestry-book_n which_o record_v in_o all_o place_n shall_v be_v deem_v good_a evidence_n and_o under_o the_o hand_n of_o two_o of_o the_o justice_n of_o the_o peace_n live_v in_o the_o same_o precinct_n where_o the_o say_a person_n keep_v or_o intend_v to_o set_v up_o his_o house_n of_o entertainment_n and_o have_v also_o give_v good_a security_n in_o the_o secretary_n office_n of_o one_o hundred_o pound_n that_o he_o shall_v suffer_v no_o disorder_n to_o be_v commit_v in_o his_o say_a house_n or_o any_o thing_n there_o do_v contrary_a to_o the_o law_n of_o england_n or_o of_o this_o island_n and_o that_o no_o person_n whatsoever_o presume_v to_o sell_v rum_o or_o rum-punch_a or_o any_o other_o mixture_n of_o rum_o without_o licence_n first_o obtain_v from_o the_o justice_n in_o session_n and_o security_n give_v to_o the_o clerk_n of_o the_o peace_n of_o the_o say_v levy_v by_o distress_n by_o warrant_n from_o any_o justice_n of_o the_o peace_n within_o this_o island_n and_o whosoever_o shall_v by_o public_a and_o open_a profaneness_n or_o blasphemy_n dishonour_v almighty_a god_n and_o be_v thereof_o due_o convict_v in_o the_o supreme_a court_n of_o judicature_n shall_v be_v fine_v twenty_o pound_n currant_n money_n of_o this_o island_n or_o more_o at_o the_o discretion_n of_o the_o court_n for_o every_o such_o offence_n and_o that_o such_o as_o be_v either_o servant_n or_o not_o worth_a so_o much_o shall_v be_v liable_a to_o such_o corporeal_a whosoever_o shall_v by_o false_a dice_n or_o other_o fraud_n or_o deceit_n win_v any_o money_n or_o other_o thing_n shall_v forfeit_v treble_a the_o value_n thereof_o be_v convict_v by_o verdict_n confession_n or_o otherwise_o and_o that_o no_o sum_n exceed_v forty_o shilling_n win_v at_o any_o game_n or_o bet_v on_o the_o side_n of_o any_o shall_v be_v recoverable_a and_o all_o bond_n contract_n and_o security_n whatsoever_o for_o above_o the_o sum_n aforesaid_a win_v as_o aforesaid_a shall_v be_v void_a provide_v nevertheless_o that_o nothing_o herein_o contain_v shall_v be_v hand_n or_o in_o case_n of_o a_o book_n debt_n upon_o a_o concessit_fw-la solvere_fw-la and_o disclose_v the_o special_a matter_n to_o the_o chief_a judge_n of_o the_o supreme_a court_n of_o judicature_n that_o the_o say_a debtor_n against_o who_o the_o plaint_n be_v enter_v be_v either_o go_v off_o this_o island_n or_o that_o upon_o process_n already_o take_v out_o against_o he_o a_o non_fw-la est_fw-la inventus_fw-la have_v be_v return_v a_o attachment_n shall_v then_o issue_n thereby_o command_v the_o provost_n marshal_n or_o his_o lawful_a deputy_n to_o attach_v such_o moneys_n good_n chattel_n or_o debt_n in_o the_o hand_n of_o the_o possessor_n of_o the_o same_o be_v they_o attorney_n wife_n servant_n or_o any_o other_o person_n and_o also_o require_v they_o to_o appear_v at_o the_o next_o court_n to_o show_v cause_n why_o the_o say_a money_n good_n chattel_n or_o debt_n or_o so_o much_o thereof_o as_o will_v satisfy_v the_o say_a debt_n then_o demand_v shall_v not_o be_v deliver_v to_o the_o plaintiff_n at_o which_o day_n if_o the_o say_a possessor_n or_o debtor_n be_v they_o attorney_n wife_n servant_n or_o other_o person_n as_o aforesaid_a be_v convict_v by_o confession_n verdict_n or_o otherwise_o that_o the_o say_v money_n good_n chattel_n or_o debt_n do_v proper_o belong_v to_o the_o person_n so_o go_v off_o this_o island_n or_o otherwise_o absent_v himself_o as_o aforesaid_a and_o if_o the_o plaintiff_n before_o or_o after_o due_a proof_n make_v do_v solemn_o swear_v in_o open_a court_n that_o his_o debt_n be_v true_a and_o that_o direct_o or_o indirect_o no_o part_n or_o parcel_n of_o what_o he_o demand_v be_v satisfy_v and_o also_o give_v in_o security_n in_o double_a the_o sum_n he_o demand_v to_o restore_v the_o same_o with_o treble_a damage_n or_o so_o much_o thereof_o as_o shall_v at_o any_o time_n afterward_o be_v disprove_v that_o then_o and_o in_o all_o such_o case_n the_o plaintiff_n shall_v have_v judgement_n to_o recover_v the_o say_a debt_n out_o of_o the_o say_a money_n good_n chattel_n or_o debt_n so_o attach_v as_o aforesaid_a provide_v always_o that_o if_o any_o will_v appear_v as_o attorney_n to_o the_o say_a debtor_n and_o put_v in_o bail_n to_o answer_v the_o action_n and_o pay_v the_o condemnation_n that_o then_o and_o in_o all_o such_o case_n the_o attachment_n on_o the_o say_a money_n good_n chattel_n or_o debt_n shall_v be_v dissolve_v and_o proceed_n have_v according_a to_o the_o custom_n of_o the_o common_a law_n but_o if_o the_o possessor_n or_o owner_n of_o such_o money_n good_n chattel_n or_o debt_n be_v they_o attorney_n wife_n servant_n or_o other_o person_n as_o aforesaid_a shall_v after_o attachment_n so_o lay_v on_o they_o in_o the_o respective_a hand_n dispose_v of_o the_o say_a money_n good_n chattel_n or_o debt_n towards_o the_o payment_n of_o any_o other_o debt_n before_o the_o say_a debt_n for_o which_o the_o attachment_n be_v lay_v be_v satisfy_v or_o the_o say_a complaint_n make_v to_o any_o justice_n of_o the_o peace_n that_o the_o debtor_n against_o who_o he_o complain_v be_v go_v off_o this_o island_n or_o otherwise_o absent_v himself_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a justice_n of_o the_o peace_n to_o issue_v out_o a_o warrant_n of_o attachment_n to_o be_v levy_v by_o the_o constable_n in_o manner_n and_o form_n as_o be_v before_o prescribe_v to_o the_o provost-marshal_n for_o the_o execution_n of_o the_o writ_n and_o to_o be_v immediate_o determine_v by_o the_o say_a justice_n any_o clause_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o summons_n and_o other_o process_n hereafter_o mention_v shall_v be_v serve_v and_o execute_v in_o manner_n and_o form_n as_o be_v herein_o direct_v and_o in_o no_o other_o manner_n or_o way_n whatsoever_o that_o be_v to_o say_v that_o all_o summons_n as_o well_o from_o the_o supreme_a court_n as_o all_o other_o the_o inferior_a court_n within_o this_o island_n port-royal_a only_o except_v shall_v be_v deliver_v to_o the_o party_n or_o leave_v at_o their_o respective_a dwelling_n fourteen_o day_n before_o the_o several_a court_n by_o a_o swear_a marshal_n and_o that_o at_o port-royal_a all_o summons_n shall_v be_v deliver_v ten_o day_n before_o the_o court_n otherwise_o it_o shall_v be_v deem_v and_o take_v as_o no_o service_n and_o the_o defendant_n not_o bind_v by_o it_o to_o appear_v and_o that_o all_o replevin_n foreign_a attachment_n at_o the_o supreme_a court_n and_o warrant_n of_o arrest_n be_v serve_v at_o any_o time_n as_o heretofore_o and_o that_o no_o execution_n shall_v be_v take_v out_o serve_v or_o precept_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o defendant_n after_o his_o good_n shall_v be_v so_o take_v in_o execution_n as_o aforesaid_a shall_v delay_v or_o neglect_v sell_v or_o dispose_n of_o the_o good_n until_o ten_o day_n before_o the_o next_o ensue_a court_n that_o then_o and_o in_o all_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o the_o marshal_n to_o take_v the_o say_v good_n and_o chattel_n of_o the_o defendant_n and_o the_o same_o to_o sell_v by_o public_a outcry_n and_o it_o be_v further_o enact_v by_o tho_o authority_n aforesaid_a that_o where_o no_o such_o good_n as_o aforesaid_a shall_v be_v show_v and_o offer_v to_o the_o provost-marshal_n so_o that_o the_o negro_n working-cattel_n or_o necessary_a utensil_n must_v be_v take_v in_o execution_n that_o then_o and_o in_o all_o such_o case_n the_o say_v negro_n horse_n or_o utensil_n shall_v not_o be_v remove_v but_o remain_v still_o in_o the_o defendant_n possession_n and_o that_o
upon_o the_o marshal_n return_n at_o the_o same_o court_n as_o aforesaid_a that_o he_o have_v levy_v such_o effect_n and_o leave_v they_o in_o the_o defendant_n hand_n there_o issue_n out_o a_o venditioni_fw-la exponas_fw-la without_o any_o charge_n of_o mile-money_n in_o these_o word_n follow_v the_o king_n to_o the_o provost-marshal_n greeting_n whereas_o we_o late_o command_v thou_o by_o our_o writ_n that_o of_o the_o good_n and_o chattel_n real_a and_o personal_a of_o a._n b._n thou_o shall_v levy_v or_o cause_n to_o be_v levy_v as_o also_o cost_v of_o suit_n which_o c._n d._n have_v recover_v against_o he_o by_o virtue_n of_o which_o writ_n thou_o do_v return_v unto_o we_o that_o thou_o have_v take_v in_o execution_n of_o the_o good_n of_o the_o say_v a._n b._n to_o the_o value_n of_o the_o say_a debt_n and_o cost_v of_o suit_n which_o say_v good_n remain_v in_o the_o custody_n of_o the_o say_v a._n b._n by_o thou_o in_o form_n as_o aforesaid_a take_v thou_o expose_v to_o sale_n and_o the_o money_n thereof_o come_v thou_o immediate_o render_v to_o the_o say_v c._n d._n for_o his_o debt_n or_o damage_n and_o cost_n as_o aforesaid_a but_o if_o the_o good_n aforesaid_a shall_v be_v embezzle_v or_o make_v away_o or_o that_o the_o say_v a._n b._n do_v not_o deliver_v the_o same_o that_o then_o thou_o levy_v the_o say_a debt_n or_o damage_n and_o cost_v upon_o any_o other_o the_o good_n and_o chattel_n of_o the_o say_v a._n b._n and_o immediate_o expose_v they_o to_o sale_n and_o if_o thou_o can_v not_o find_v sufficient_a good_n or_o chattel_n by_o which_o the_o whole_a debt_n or_o damage_n and_o cost_v may_v be_v satisfy_v that_o then_o you_o take_v the_o body_n of_o the_o say_v a._n b._n and_o he_o safe_o keep_v so_o that_o thou_o have_v his_o body_n before_o we_o at_o our_o next_o court_n to_o satisfy_v the_o say_v c._n d._n of_o the_o say_a debt_n or_o damage_n and_o cost_n or_o so_o much_o thereof_o as_o by_o thou_o can_v be_v levy_v and_o have_v thou_o then_o and_o there_o this_o writ_n witness_v etc._n etc._n by_o virtue_n whereof_o the_o say_v good_n shall_v be_v sell_v by_o public_a outery_n at_o the_o next_o court_n of_o the_o or_o utensil_n upon_o or_o belong_v to_o any_o plantation_n brick_n or_o pot-work_n or_o any_o other_o negro_n whatsoever_o if_o the_o defendant_n show_v or_o deliver_v to_o he_o any_o other_o stock_n or_o cattle_n be_v in_o a_o pen_n the_o say_a cattle_n or_o stock_n to_o be_v sell_v by_o public_a outcry_n upon_o venditioni_fw-la exponas_fw-la to_o be_v issue_v as_o aforesaid_a and_o it_o be_v disclose_v the_o same_o upon_o oath_n unto_o two_o justice_n of_o the_o peace_n of_o the_o parish_n where_o he_o she_o or_o they_o shall_v be_v prisoner_n and_o make_v it_o appear_v to_o the_o judge_n of_o the_o supreme_a court_n that_o he_o she_o or_o they_o have_v give_v notice_n to_o all_o their_o creditor_n ten_o day_n before_o the_o say_a court_n that_o they_o or_o either_o of_o they_o intend_v to_o take_v the_o benefit_n of_o this_o act_n bring_v likewise_o to_o the_o say_a court_n a_o certificate_n of_o such_o their_o oath_n under_o the_o hand_n and_o seal_n of_o the_o say_a be_v equal_o divide_v among_o the_o creditor_n as_o aforesaid_a but_o in_o case_n any_o creditor_n shall_v refuse_v to_o consent_v to_o let_v the_o say_a prisoner_n or_o prisoner_n to_o hire_v that_o then_o such_o creditor_n shall_v pay_v or_o cause_v to_o be_v pay_v to_o the_o say_a prisoner_n or_o prisoner_n three_o shilling_n and_o six_o penny_n weekly_a provide_v always_o and_o it_o be_v hereby_o enact_v that_o if_o any_o prisoner_n or_o prisoner_n so_o let_v to_o hire_n shall_v at_o any_o time_n afterward_o come_v to_o have_v or_o enjoy_v a_o estate_n have_v not_o first_o satisfy_v their_o debt_n that_o then_o at_o all_o time_n hereafter_o the_o judgement_n obtain_v against_o he_o her_z or_o they_o shall_v remain_v good_a and_o in_o force_n and_o another_o execution_n shall_v be_v take_v out_o and_o levy_v against_o the_o good_n and_o chattel_n of_o the_o say_a prisoner_n or_o prisoner_n wheresover_n they_o shall_v be_v find_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o provost-marshal_n by_o himself_o or_o any_o of_o his_o deputy_n shall_v levy_v any_o execution_n in_o any_o other_o manner_n than_o what_o be_v herein_o before_o declare_v or_o shall_v ask_v demand_n or_o receive_v any_o mile-money_n for_o the_o execute_v any_o writ_n of_o execution_n or_o venditioni_fw-la exponas_fw-la shall_v forfeit_v one_o hundred_o pound_n currant_n money_n of_o this_o island_n for_o every_o such_o offence_n to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v be_v allow_v the_o one_o moiety_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o authority_n aforesaid_a that_o the_o several_a fine_n forfeiture_n and_o penalty_n beforementioned_a in_o this_o act_n and_o not_o declare_v how_o they_o shall_v be_v dispose_v of_o shall_v be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v be_v allow_v the_o one_o moiety_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o moiety_n to_o the_o informer_n or_o he_o that_o shall_v sue_v for_o the_o same_o a_o act_n appoint_v where_o the_o law_n of_o this_o
the_o several_a liquor_n and_o good_n aforesaid_a import_v into_o this_o island_n by_o way_n of_o merchandise_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o merchant_n or_o other_o person_n import_v any_o wine_n or_o other_o liquor_n into_o this_o island_n shall_v be_v thereunto_o require_v by_o the_o collector_n within_o twenty_o day_n after_o landing_n make_v up_o account_n and_o give_v bond_n in_o the_o penalty_n of_o double_a the_o value_n the_o same_o shall_v amount_v unto_o and_o upon_o such_o account_n so_o to_o be_v make_v up_o and_o bond_n give_v as_o aforesaid_a shall_v be_v allow_v after_o the_o rate_n of_o ten_o per_n cent_z for_o leakage_n and_o shall_v have_v time_n for_o payment_n thereof_o as_o be_v hereafter_o mention_v that_o be_v to_o say_v from_o the_o end_n and_o expiration_n of_o the_o first_o two_o month_n from_o the_o make_n up_o such_o account_n to_o pay_v one_o three_o part_n thereof_o and_o another_o three_o part_n at_o the_o end_n of_o the_o four_o month_n and_o the_o remainder_n at_o the_o end_n of_o the_o six_o month_n and_o that_o every_o hogshead_n of_o wine_n or_o other_o liquor_n that_o shall_v not_o have_v full_a seven_o inch_n or_o above_o leave_v therein_o and_o every_o butt_n or_o pipe_v not_o above_o nine_o inch_n shall_v be_v account_v for_o out_v and_o the_o merchant_n or_o importer_n to_o pay_v no_o custom_n for_o the_o same_o and_o in_o case_n of_o difference_n that_o may_v arise_v between_o the_o importer_n or_o master_n of_o the_o vessel_n touch_v leakage_n on_o board_n and_o for_o wine_n or_o liquor_n that_o shall_v happen_v to_o sour_a within_o the_o aforesaid_a twenty_o day_n the_o person_n or_o person_n so_o aggrieve_v shall_v have_v a_o warrant_n of_o survey_n from_o the_o naval_a officer_n who_o be_v hereby_o impower_v and_o require_v to_o grant_v the_o same_o and_o that_o return_v of_o such_o warrant_n to_o be_v grant_v as_o aforesaid_a shall_v be_v make_v upon_o oath_n to_o the_o say_v naval_a officer_n and_o by_o he_o remit_v to_o the_o collector_n office_n in_o order_n to_o the_o make_v up_o their_o account_n with_o the_o collector_n and_o better_o prove_v their_o damage_n by_o ill_a stowage_n or_o otherwise_o and_o in_o case_n any_o such_o merchant_n or_o importer_n shall_v be_v thereunto_o require_v as_o aforesaid_a refuse_v to_o make_v up_o his_o accompto_n and_o give_v bond_n as_o aforesaid_a he_o shall_v lose_v the_o benefit_n of_o the_o ten_o per_n cent_z for_o leakage_n and_o the_o time_n give_v for_o the_o payment_n of_o the_o money_n and_o if_o the_o receiver_n shall_v be_v force_v to_o sue_v for_o the_o same_o and_o do_v recover_v the_o defendant_n shall_v pay_v treble_a damage_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o at_o the_o entry_n of_o any_o ship_n or_o vessel_n in_o the_o naval_a office_n it_o shall_v appear_v by_o the_o master_n report_n or_o otherwise_o that_o he_o have_v import_v any_o madera_n wine_n he_o the_o say_a master_n or_o the_o boatswain_n shall_v take_v the_o follow_a oath_n which_o the_o say_v naval_a officer_n be_v hereby_o impower_v to_o administer_v i_o a._n b._n do_v swear_v that_o the_o wine_n by_o i_o import_v be_v take_v on_o board_n at_o the_o island_n of_o madera_n and_o that_o i_o do_v not_o direct_o or_o indirect_o know_v but_o that_o the_o say_v wine_n be_v of_o the_o say_a island_n without_o any_o mixture_n of_o the_o wine_n of_o the_o growth_n of_o any_o of_o the_o western_a island_n so_o help_v i_o god_n and_o if_o the_o say_a master_n or_o boatswain_n shall_v resuse_v to_o take_v the_o abovesaid_a oath_n that_o then_o the_o say_a wine_n so_o import_v shall_v be_v deem_v and_o take_v to_o be_v wine_n of_o the_o growth_n of_o the_o western_a island_n and_o shall_v pay_v custom_n according_o and_o it_o be_v further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o all_o or_o any_o of_o the_o aforesaid_a liquor_n or_o good_n liable_a to_o the_o duty_n aforesaid_a be_v land_a and_o afterward_o export_v within_o twelve_o month_n after_o the_o importation_n thereof_o that_o the_o collector_n or_o receiver_n shall_v discompt_v or_o repay_v unto_o the_o owner_n or_o their_o assign_v half_o the_o custom_n of_o the_o say_a liquor_n and_o good_n according_a to_o the_o rate_n before_o mention_v which_o the_o collector_n or_o receiver_n be_v to_o repay_v or_o count_n on_o the_o penalty_n of_o double_a the_o sum_n for_o every_o such_o refusal_n to_o the_o party_n aggrieve_v lieu_n thereof_o to_o receive_v money_n or_o any_o other_o consideration_n whatsoever_o upon_o penalty_n of_o twenty_o pound_n currant_n money_n for_o every_o such_o offence_n and_o it_o be_v likewise_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o master_n or_o commander_n of_o any_o ship_n or_o ship_n merchant_n factor_n purser_n mariner_n or_o any_o other_o person_n whatsoever_o without_o the_o presence_n of_o the_o collector_n or_o some_o person_n appoint_v by_o he_o or_o notice_n give_v he_o or_o before_o his_o or_o their_o regular_a entry_n make_v with_o the_o say_a collector_n or_o payment_n of_o the_o duty_n or_o security_n give_v by_o bond_n as_o aforesaid_a shall_v after_o sunset_n and_o before_o sunrising_n put_v on_o shoar_n or_o put_v into_o any_o boat_n or_o vessel_n in_o order_n to_o land_v any_o of_o the_o liquor_n or_o any_o good_n contain_v or_o mention_v in_o this_o act_n with_o a_o intent_n to_o defraud_v his_o majesty_n of_o his_o custom_n for_o the_o same_o the_o say_a liquor_n and_o good_n shall_v be_v forfeit_v two_o three_o part_n to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o three_o part_n to_o the_o informer_n or_o seizer_n be_v it_o the_o receiver_n his_o agent_n or_o any_o other_o person_n whatsoever_o the_o same_o to_o be_v recover_v by_o bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n within_o this_o island_n any_o thing_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a notwithstanding_o and_o all_o manner_n of_o person_n be_v hereby_o require_v to_o be_v aid_v and_o assist_v to_o the_o receiver_n his_o agent_n the_o informer_n discoverer_n and_o seizer_n of_o such_o liquor_n or_o good_n so_o land_a or_o unlade_v contrary_a to_o the_o true_a intent_n and_o meaning_n of_o this_o discoverer_n by_o virtue_n of_o a_o warrant_n from_o the_o commander_n in_o chief_a or_o any_o of_o his_o majesty_n justice_n of_o the_o peace_n to_o that_o purpose_n first_o obtain_v with_o one_o constable_n or_o more_o to_o search_v according_a to_o law_n all_o manner_n of_o house_n cellar_n warehouse_n and_o shop_n for_o such_o liquor_n and_o good_n as_o they_o or_o any_o of_o they_o shall_v be_v inform_v be_v carry_v there_o to_o be_v conceal_v in_o prejudice_n to_o the_o true_a meaning_n of_o this_o act_n and_o such_o liquor_n and_o good_n so_o find_v shall_v be_v forfeit_v and_o condemn_v in_o manner_n and_o form_n before_o mention_v provide_v that_o the_o search_v be_v make_v within_o three_o day_n after_o information_n and_o it_o be_v likewise_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o during_o the_o continuation_n of_o this_o act_n the_o collector_n or_o his_o deputy_n give_v his_o or_o their_o attendance_n at_o his_o office_n from_o nine_o to_o
justice_n of_o the_o peace_n without_o give_v notice_n to_o the_o captain_n of_o the_o say_a fort_n or_o whosoever_o shall_v command_v in_o chief_a therein_o in_o his_o absence_n which_o say_v notice_n shall_v be_v sufficient_a leave_n to_o pass_v the_o say_a fort_n without_o any_o further_a charge_n or_o trouble_v whatsoever_o unless_o the_o say_a captain_n or_o other_o his_o subordinate_a officer_n have_v reasonable_a cause_n to_o suspect_v the_o person_n so_o desire_v leave_n to_o have_v some_o evil_a design_n in_o go_v off_o with_o or_o carry_v off_o any_o person_n contrary_a to_o law_n in_o which_o case_n it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a captain_n or_o his_o aforesaid_a officer_n to_o hinder_v their_o departure_n out_o of_o the_o harbour_n until_o the_o say_a captain_n or_o officer_n be_v satisfy_v of_o the_o lawfulness_n of_o their_o occasion_n any_o act_n custom_n or_o usage_n to_o the_o contrary_a notwithstanding_o be_v it_o also_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n whatsoever_o presume_v to_o fire_v any_o small_a arm_n after_o eight_o of_o the_o clock_n at_o night_n unless_o in_o case_n of_o a_o alarm_n insurrection_n or_o other_o lawful_a occasion_n and_o in_o either_o of_o the_o say_a case_n four_o musket_n or_o small_a arm_n distinct_o fire_v shall_v be_v take_v for_o a_o alarm_n from_o quarter_n to_o quarter_n and_o every_o person_n that_o shall_v be_v due_o convict_v before_o a_o regimental_n court_n martial_a of_o neglect_v his_o duty_n in_o take_v and_o give_v forward_o any_o alarm_n by_o fire_v four_o musket_n or_o small_a arm_n as_o aforesaid_a or_o shall_v be_v guilty_a of_o fire_v any_o small_a arm_n after_o eight_o of_o the_o clock_n at_o night_n unless_o as_o to_o be_v levy_v by_o warrant_n from_o the_o chief_a officer_n not_o under_o the_o degree_n of_o a_o captain_n who_o be_v hereby_o impower_v to_o administer_v a_o oath_n and_o give_v judgement_n thereupon_o by_o distress_n or_o sale_n of_o the_o offender_n good_n and_o for_o want_v of_o distress_n the_o say_v chief_a officer_n be_v hereby_o impower_v to_o commit_v such_o offender_n to_o extend_v to_o any_o captain_n or_o officer_n of_o any_o of_o his_o majesty_n ship_n of_o war_n for_o their_o fire_v of_o one_o gun_n for_o the_o set_n of_o the_o watch._n provide_v always_o and_o it_o be_v hereby_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o nothing_o in_o this_o act_n contain_v be_v expound_v construe_v or_o understand_v to_o diminish_v alter_v or_o abridge_v the_o power_n of_o the_o governor_n or_o commander_n in_o chief_a for_o the_o time_n be_v but_o that_o in_o all_o thing_n and_o upon_o all_o occasion_n he_o may_v act_v as_o full_o and_o free_o as_o captain_n general_n and_o chief_a governor_n to_o all_o intent_n and_o purpose_n as_o if_o this_o act_n have_v never_o be_v make_v any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o provide_v also_o and_o it_o be_v hereby_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o nothing_o within_o this_o act_n or_o any_o clause_n therein_o contain_v receiver_n be_v hereby_o require_v to_o pay_v or_o cause_n to_o be_v pay_v the_o sum_n or_o sum_n of_o money_n the_o say_v escheat_v estate_n be_v value_v at_o out_o of_o the_o treasury_n unto_o or_o the_o justice_n of_o the_o peace_n shall_v hold_v and_o keep_v the_o quarter_n session_n once_o every_o three_o month_n and_o that_o none_o of_o the_o say_a court_n be_v keep_v often_o nor_o in_o any_o other_o place_n or_o manner_n than_o be_v hereby_o declare_v provide_v always_o and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o in_o respect_n port-royal_a be_v the_o chief_a seat_n of_o trade_n within_o this_o island_n and_o it_o be_v find_v by_o experience_n that_o a_o quick_a and_o more_o speedy_a dispatch_n of_o all_o maritine_n and_o merchandize_v affair_n give_v the_o great_a satisfaction_n to_o all_o party_n concern_v it_o shall_v and_o may_v be_v lawful_a for_o the_o judge_n or_o judge_n of_o the_o court_n there_o establish_v to_o hold_v and_o keep_v the_o same_o once_o every_o two_o month_n and_o not_o often_o and_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o chancellor_n here_o for_o the_o time_n be_v upon_o application_n make_v to_o grant_v a_o justice_n to_o any_o of_o the_o inferior_a court_n within_o this_o island_n any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v not_o be_v lawful_a for_o any_o person_n or_o person_n whatsoever_o appoint_v elect_v or_o choose_v to_o be_v a_o judge_n or_o judge_n of_o the_o aforesaid_a court_n to_o execute_v or_o officiate_v his_o or_o their_o say_a place_n or_o office_n until_o such_o time_n as_o he_o or_o they_o shall_v respective_o take_v the_o oath_n of_o allegiance_n and_o supremacy_n in_o open_a court_n and_o that_o none_o of_o the_o say_a judge_n direct_o nor_o indirect_o shall_v ask_v demand_n or_o receive_v any_o other_o profit_n benefit_n or_o advantage_n from_o any_o of_o the_o clark_n of_o the_o say_a court_n or_o other_o person_n whatsoever_o under_o colour_n or_o pretence_n of_o such_o their_o place_n office_n or_o authority_n but_o what_o be_v allow_v they_o by_o the_o act_n of_o this_o island_n under_o the_o penalty_n of_o five_o hundred_o pound_n of_o currant_n money_n of_o this_o island_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o of_o the_o judge_n of_o the_o several_a court_n before_o mention_v be_v and_o be_v hereby_o sufficient_o empower_v to_o make_v order_n and_o establish_v all_o such_o rule_n and_o order_n for_o the_o more_o orderly_o practise_v and_o proceed_v in_o their_o say_a court_n as_o full_o and_o ample_o to_o all_o intent_n and_o purpose_n whatsoever_o as_o all_o or_o any_o of_o the_o judge_n of_o the_o several_a court_n of_o the_o king_n bench_n common_a plea_n and_o exchequer_n in_o england_n legal_o do_v and_o that_o no_o councillour_n or_o attorney_n be_v suffer_v to_o practice_v in_o any_o of_o the_o say_a court_n until_o they_o be_v first_o admit_v by_o the_o same_o and_o have_v take_v as_o well_o the_o oath_n of_o damage_n or_o damage_n whether_o in_o servant_n negro_n horse_n cattle_n or_o in_o the_o labour_n of_o any_o of_o they_o or_o in_o the_o expense_n of_o provision_n or_o by_o fire_n or_o by_o any_o other_o loss_n whatsoever_o that_o may_v accrue_v by_o the_o mean_v aforesaid_a that_o then_o upon_o due_a application_n and_o proof_n thereof_o make_v unto_o the_o governor_n and_o council_n the_o say_a damage_n shall_v be_v reasonable_o value_v and_o forthwith_o pay_v out_o of_o the_o public_a revenue_n and_o that_o if_o there_o be_v no_o money_n there_o the_o governor_n and_o commander_n in_o chief_n do_v forthwith_o call_v a_o assembly_n and_o recommend_v to_o they_o all_o case_n of_o the_o like_a nature_n so_o that_o money_n may_v be_v legal_o raise_v for_o the_o public_a disbursement_n and_o every_o one_o receive_v just_a and_o equal_a satisfaction_n for_o their_o loss_n provide_v always_o and_o it_o be_v hereby_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o the_o several_a fine_n and_o forfeiture_n mention_v in_o this_o act_n and_o not_o declare_v in_o what_o manner_n they_o shall_v be_v recover_v and_o how_o dispose_v of_o that_o all_o such_o as_o do_v relate_v to_o any_o person_n under_o the_o degree_n of_o a_o captain_n shall_v be_v to_o the_o respective_a captain_n to_o defray_v the_o charge_n of_o their_o company_n or_o troop_n and_o to_o be_v levy_v before_o the_o next_o exercise_v day_n by_o distress_n and_o sale_n of_o the_o oftender_n good_n by_o the_o captain_n warrant_v to_o the_o sergeant_n or_o corporal_n and_o if_o no_o distress_n be_v find_v the_o punishment_n to_o be_v by_o ride_v the_o wooden_a horse_n or_o be_v tie_v neck_n and_o heel_n not_o exceed_v a_o hour_n at_o the_o discretion_n of_o their_o officer_n but_o if_o the_o offender_n be_v a_o servanâ—_n the_o owner_n good_n shall_v be_v liable_a to_o the_o distress_n and_o sales_n as_o aforesaid_a so_o that_o satisfaction_n may_v be_v make_v and_o for_o all_o other_o penalty_n mention_v in_o this_o act_n the_o same_o shall_v be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n and_o chattel_n by_o the_o provost_n marshal_n by_o warrant_n from_o the_o commander_n in_o chief_a one_o half_a thereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his._n heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o informer_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o commission_n officer_n belong_v to_o the_o regiment_n on_o port-royal_a under_o the_o degree_n of_o a_o captain_n in_o the_o absence_n of_o the_o say_a captain_n from_o of_o the_o point_n to_o grant_v warrant_n of_o distress_n against_o any_o person_n whatsoever_o that_o shall_v absent_n themselves_o from_o their_o duty_n on_o the_o night_n guard_n without_o send_v a_o sufficient_a person_n to_o serve_v and_o watch_n in_o their_o stead_n which_o say_v warrant_n so_o grant_v shall_v be_v as_o effectual_a to_o all_o intent_n and_o purpose_n whatsoever_o as_o if_o they_o or_o any_o of_o they_o have_v be_v grant_v by_o the_o captain_n themselves_o and_o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o no_o wherry_n ship_n boat_n or_o canoa_n shall_v at_o any_o time_n pass_v the_o fort_n at_o port-royal_a under_o the_o penalty_n of_o twenty_o shilling_n to_o be_v recover_v by_o warrant_n from_o any_o
