A93839 To the supreme authority the Parliament of the Common-wealth of England, his excellency the Lord General Cromwell, and his Councell of Officers the humble remonstrance of Sir John Stawell, setting forth the reason of his first engaging on the late Kings part, and his deportment therein. His desisting from further action upon the Articles of Exeter. The benefit which he claimes by vertue of the said articles. The meanes by which that benefit hath been retarded. His several tryals, both by indictment at Common Law and in the High Court of Justice, for high treason, murder, and other felonies in relation to actions committed in the late unhappy warre; and his almost seven yeares imprisonment. The sequestration of his estate, and sale of the greatest part thereof. The proceedings and judgement of the Honourable Court of Articles thereupon: and his present state and condition. old_a man_n think_v well_o of_o as_o his_o case_n stand_v and_o give_v i_o his_o thanks_o and_o i_o forthwith_o write_v my_o letter_n unto_o the_o prince_n that_o mr._n chaplain_n have_v no_o money_n and_o limitation_n i_o humble_o conceive_v to_o be_v for_o that_o the_o parliament_n have_v confirm_v and_o ratify_v divers_a article_n and_o condition_n grant_v in_o time_n of_o war_n to_o the_o make_v good_a of_o which_o their_o honour_n and_o justice_n as_o well_o as_o the_o faith_n of_o the_o army_n and_o nation_n be_v eminent_o concern_v and_o for_o that_o at_o the_o time_n when_o this_o act_n do_v pass_v they_o neither_o do_v nor_o can_v possible_o take_v notice_n of_o such_o as_o have_v right_a or_o claim_v to_o the_o same_o they_o reserve_v unto_o themselves_o this_o power_n and_o do_v provide_v that_o the_o trustee_n shall_v order_v and_o dispose_v of_o the_o same_o according_o and_o by_o their_o act_n of_o the_o 29_o of_o september_n 1652._o for_o revive_v of_o the_o act_n of_o the_o 18_o of_o june_n 1649._o which_o upon_o just_a and_o honourable_a ground_n give_v relief_n to_o all_o such_o person_n who_o be_v or_o shall_v be_v arrest_v sue_v implead_v imprison_v or_o sequester_v contrary_a to_o any_o article_n give_v or_o grant_v etc._n etc._n a_o court_n for_o that_o purpose_n be_v constitute_v to_o do_v right_a in_o all_o the_o particular_n of_o both_o the_o say_a act_n according_a to_o the_o tenor_n and_o meaning_n of_o article_n any_o law_n order_n or_o ordinance_n to_o the_o contrary_a notwithstanding_o by_o which_o act_n and_o declaration_n the_o parliament_n do_v make_v use_n of_o their_o former_a power_n express_o reserve_v unto_o they_o and_o if_o any_o man_n estate_n or_o part_n thereof_o be_v sell_v contrary_a to_o the_o right_n of_o article_n it_o be_v no_o wrong_n unto_o the_o purchaser_n if_o it_o be_v by_o judgement_n restore_v to_o the_o right_a owner_n for_o the_o decree_n or_o judgement_n that_o shall_v so_o restore_v it_o be_v give_v by_o authority_n of_o parliament_n and_o be_v in_o order_n to_o the_o power_n in_o the_o act_n of_o sale_n reserve_v unto_o the_o parliament_n so_o to_o do_v and_o the_o purchaser_n have_v no_o cause_n to_o complain_v so_o as_o recompense_v be_v assign_v unto_o they_o for_o that_o their_o bargain_n and_o contract_n make_v with_o they_o can_v not_o be_v absolute_a and_o direct_a in_o regard_n the_o say_a clause_n of_o limitation_n have_v debar_v the_o trustee_n themselves_o from_o who_o they_o claim_v in_o the_o case_n of_o article_n from_o any_o such_o absolute_a estate_n and_o therefore_o it_o seem_v that_o some_o of_o they_o take_v notice_n of_o this_o reserve_a power_n upon_o pass_v the_o act_n of_o revivour_n prefer_v the_o two_o prouiso_n aforementioned_a to_o the_o parliament_n that_o that_o act_n which_o be_v then_o to_o pass_v shall_v not_o extend_v or_o be_v construe_v to_o extend_v to_o prejudice_n alter_v or_o make_v void_a any_o resolution_n vote_n or_o judgement_n give_v in_o parliament_n touch_v any_o the_o article_n aforesaid_a or_o any_o person_n claim_v thereby_o as_o also_o that_o no_o real_a or_o personal_a estate_n which_o have_v be_v settle_v convey_v or_o assure_v to_o any_o person_n or_o person_n by_o virtue_n of_o any_o act_n order_n or_o ordinance_n of_o the_o then_o parliament_n shall_v be_v make_v null_n vacate_v or_o otherwise_o determine_v or_o dispose_v of_o by_o the_o commissioner_n name_v in_o that_o act_n or_o by_o their_o authority_n etc._n etc._n but_o the_o parliament_n reflect_v upon_o their_o honour_n in_o the_o case_n of_o article_n upon_o the_o question_n reject_v both_o the_o prouiso_n and_o whereas_o if_o they_o have_v be_v approve_v i_o have_v be_v ruin_v and_o undo_v so_o by_o the_o same_o reason_n be_v reject_v i_o may_v with_o the_o help_n of_o your_o favour_n and_o justice_n be_v preserve_v and_o restore_v to_o what_o be_v proper_o and_o of_o right_n belong_v unto_o i_o thus_o in_o all_o humbleness_n i_o have_v remonstrate_v and_o faithful_o declare_v unto_o you_o to_o the_o best_a of_o my_o remembrance_n by_o what_o mean_v i_o come_v to_o take_v up_o arm_n in_o the_o behalf_n of_o the_o late_a king_n in_o those_o most_o unhappy_a distraction_n my_o judgement_n at_o that_o time_n be_v satisfy_v of_o the_o king_n real_a intention_n and_o unfeigned_a constancy_n thereunto_o for_o the_o sure_a establishment_n of_o religion_n and_o the_o law_n the_o safety_n and_o welfare_n of_o the_o people_n as_o also_o to_o declare_v how_o and_o in_o what_o manner_n i_o proceed_v during_o all_o the_o time_n of_o my_o service_n and_o employment_n and_o upon_o what_o term_n article_n and_o concession_n i_o cease_v from_o further_a action_n on_o the_o king_n part_n
