upon_o pain_n of_o 5_o l._n for_o default_n thereof_o xliv_o the_o say_v surveyor_n shall_v within_o 20_o day_n after_o election_n view_v all_o the_o highway_n and_o bridge_n within_o their_o parish_n and_o consider_v of_o needful_a reparation_n and_o thereupon_o with_o 2_o or_o more_o substantial_a householder_n make_v a_o assessment_n for_o repair_v thereof_o not_o exceed_v 6_o d._n in_o the_o pound_n for_o one_o year_n 20_o l._n stock_n to_o be_v rate_v as_o 20_o l._n per_fw-la annum_fw-la which_o be_v allow_v by_o some_o justice_n of_o the_o peace_n shall_v be_v pay_v within_o 20_o day_n after_o demand_n by_o the_o surveyor_n upon_o pain_n of_o forfeiture_n of_o double_a so_o much_o unless_o upon_o complaint_n to_o the_o say_a justice_n he_o shall_v think_v fit_a to_o alter_v the_o same_o xlv_o the_o surveyor_n shall_v cause_v all_o nuisance_n in_o highway_n or_o ditch_n and_o watercourse_n not_o scour_v to_o be_v amend_v and_o the_o offender_n punish_v by_o law_n and_o deduct_v their_o charge_n for_o prosecution_n thereof_o and_o may_v yearly_o between_o the_o 1_o of_o may_n and_o the_o last_o of_o august_n hire_v labourer_n cart_n and_o carriage_n for_o that_o purpose_n xlvi_o they_o may_v appoint_v person_n to_o work_v in_o the_o highway_n according_a to_o former_a law_n and_o cart_n and_o carriage_n for_o more_o day_n then_o by_o former_a law_n direct_v pay_v according_a to_o the_o rate_n of_o the_o country_n and_o one_o justice_n of_o peace_n may_v upon_o question_n of_o value_n determine_v the_o same_o and_o upon_o neglect_n or_o refusal_n of_o any_o person_n charge_v he_o shall_v forfeit_v 10_o s._n for_o a_o team_n a_o day_n and_o 18_o d._n for_o a_o labourer_n provide_v none_o be_v charge_v for_o land_n and_o stock_n which_o he_o use_v upon_o the_o same_o xlvii_o the_o surveyor_n within_o their_o parish_n by_o order_n from_o the_o quarter_n session_n and_o upon_o view_n and_o by_o consent_n of_o 2_o justice_n authorise_v by_o the_o say_a session_n under_o their_o hand_n and_o seal_n in_o writing_n may_v enlarge_v any_o highway_n not_o of_o to_o the_o breadth_n 8_o yard_n out_o of_o the_o sale_n of_o the_o owner_n in_o such_o manner_n as_o by_o the_o act_n appoint_v xlviii_o in_o case_n of_o want_n of_o gravel_n sand_n etc._n etc._n in_o one_o parish_n it_o may_v be_v dig_v in_o the_o waste_n of_o another_o fill_v up_o the_o pit_n again_o if_o require_v xlix_o in_o case_n of_o want_n of_o gravel_n sand_n or_o other_o material_n in_o any_o common_a or_o waste_v of_o any_o parish_n the_o same_o may_v be_v dig_v in_o the_o soil_n of_o any_o owner_n the_o same_o not_o be_v a_o house_n orchard_n garden_n court-yard_n park_n with_o deer_n or_o meadow_n render_v damage_n to_o the_o owner_n for_o dig_v and_o fill_v again_o the_o pit_n l._n no_o travel_a wagon_n wain_n or_o carriage_n for_o hire_n other_o than_o carriage_n for_o husbandry_n &_o manage_v land_n carry_v hay_n straw_n corn_n unthresh_v coal_n chalk_n timber_n for_o ship_n material_n for_o building_n stone_n ammunition_n and_o artillery_n for_o the_o king_n service_n shall_v go_v in_o any_o highway_n with_o above_o 7_o horse_n whereof_o 6_o by_o paier_n and_o not_o above_o 8_o ox_n or_o six_o and_o two_o horse_n by_o pair_n nor_o carry_v above_o 2000_o weight_n between_o 1_o october_n and_o 1_o may_n nor_o above_o 3000_o between_o 1_o may_n and_o 1_o october_n nor_o above_o 8_o quarter_n of_o barley_n malt_n or_o oat_n nor_o with_o any_o wheel_n less_o than_o 4_o inch_n broad_a in_o the_o tire_n upon_o pain_n of_o 40_o s._n one_o three_o part_n whereof_o shall_v be_v to_o the_o surveyor_n one_o other_o three_o part_n to_o the_o poor_a of_o the_o parish_n and_o the_o other_o three_o part_n to_o the_o discoverer_n to_o be_v levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n if_o payment_n be_v not_o make_v within_o 3_o day_n and_o the_o offence_n aforesaid_a declare_v common_a nuisance_n li._n suit_n against_o any_o officer_n for_o any_o thing_n do_v upon_o this_o act_n shall_v be_v try_v in_o their_o proper_a county_n the_o defendant_n may_v plead_v the_o general_a issue_n and_o if_o wrongful_o sue_v recover_v double_a cost_n lii_o all_o money_n assess_v and_o charitable_a gift_n for_o mend_v the_o highway_n pavement_n etc._n etc._n and_o all_o fine_n and_o forfeiture_n not_o otherwise_o dispose_v by_o this_o act_n and_o all_o amerciament_n upon_o parish_n for_o repair_a highway_n shall_v be_v employ_v by_o the_o respective_a surveyor_n within_o their_o respective_a parish_n by_o warrant_n under_o their_o hand_n and_o seal_n and_o levy_v by_o distress_n and_o sale_n of_o the_o offender_n good_n as_o aforesaid_a liii_o all_o surveyor_n shall_v within_o one_o month_n after_o their_o year_n expire_v give_v in_o a_o account_n under_o their_o hand_n in_o write_v to_o the_o parish_n of_o all_o their_o receipt_n and_o disbursement_n and_o of_o all_o arrear_n fine_n forfeiture_n penalty_n and_o charitable_a gift_n and_o pay_v what_o remain_v in_o their_o hand_n to_o the_o succeed_a surveyor_n and_o upon_o default_n and_o complaint_n to_o any_o 2_o justice_n of_o the_o peace_n near_o the_o say_a parish_n the_o say_a justice_n shall_v commit_v the_o party_n offend_v to_o prison_n till_o a_o true_a account_n be_v make_v liv._o justice_n of_o oyer_n and_o terminer_n and_o of_o the_o make_v order_n therein_o provide_v person_n grieve_v by_o such_o order_n may_v appeal_v to_o the_o chancery_n as_o upon_o decree_n upon_o the_o statute_n of_o charitable_a use_n lv._o no_o certiorari_fw-la shall_v be_v allow_v to_o remove_v any_o information_n indictment_n or_o other_o proceed_n in_o the_o quarter_n session_n touch_v any_o matter_n in_o this_o act_n unless_o the_o party_n prosecute_v give_v security_n to_o the_o prosecutor_n to_o pay_v they_o their_o cost_n and_o damage_n lvi_o proviso_n touch_v the_o lessee_n of_o the_o iron_n work_v in_o surroy_n sussex_n car._n 2._o cap._n 1._o stat._n 3._o a_o act_n appoint_v special_a commissioner_n with_o power_n to_o oversee_v and_o repair_v the_o highway_n within_o the_o county_n of_o hertford_n cambridge_n the_o say_a statute_n of_o 37_o h._n 8.4_o other_o than_o such_o as_o by_o the_o king_n commission_n shall_v be_v alter_v and_o all_o manor_n land_n pension_n hereditament_n and_o thing_n belong_v
