natural_a allegiance_n yea_o it_o be_v not_o question_v by_o those_o that_o most_o scruple_n about_o the_o present_a settlement_n but_o now_o there_o be_v positive_a law_n require_v those_o oath_n yet_o before_o they_o be_v take_v the_o respective_a duty_n both_o of_o king_n and_o people_n be_v to_o be_v observe_v by_o force_n of_o the_o radical_a nature_n of_o our_o monarchy_n and_o the_o fundamental_a constitution_n of_o government_n in_o our_o common_a law._n 2._o for_o a_o further_a answer_n we_o must_v remind_v what_o have_v be_v say_v of_o our_o hereditary_a monarchy_n which_o if_o understand_v in_o no_o other_o sense_n than_o these_o very_a person_n be_v eager_a to_o maintain_v methinks_v supercede_v this_o objection_n for_o if_o the_o government_n in_o their_o own_o sense_n be_v hereditary_a then_o in_o consequence_n of_o it_o when_o the_o throne_n be_v vacant_a of_o the_o predecessor_n it_o be_v in_o the_o same_o instant_n fill_v by_o the_o next_o heir_n as_o to_o right_o and_o title_n in_o analogy_n with_o all_o other_o case_n of_o inheritance_n and_o even_o from_o the_o nature_n of_o inheritance_n we_o need_v not_o here_o speak_v over_o again_o what_o we_o have_v about_o the_o late_a king_n abdication_n and_o leave_v the_o throne_n void_a we_o may_v be_v allow_v here_o to_o suppose_v it_o and_o then_o it_o be_v evident_a that_o upon_o this_o ground_n upon_o that_o avoidance_n without_o any_o intervention_n or_o act_n of_o the_o people_n either_o in_o a_o convention_n or_o parliament_n the_o crown_n immediate_o descend_v to_o the_o next_o heir_n of_o the_o royal_a family_n by_o right_a of_o blood_n or_o birthright_n 3._o so_o far_o for_o their_o right_n as_o to_o their_o entry_n and_o possession_n of_o the_o government_n though_o in_o all_o such_o extraordinary_a revolution_n it_o have_v be_v safe_a to_o be_v admit_v with_o the_o consent_n of_o the_o people_n yet_o it_o be_v evident_a from_o the_o same_o concession_n that_o it_o be_v their_o inheritance_n that_o the_o next_o heir_n may_v claim_v and_o take_v possession_n of_o himself_o without_o the_o consent_n or_o act_n of_o the_o people_n that_o be_v he_o have_v right_a to_o do_v so_o and_o if_o he_o be_v hinder_v and_o keep_v by_o force_n from_o his_o lawful_a entry_n without_o just_a cause_n or_o his_o own_o consent_n he_o be_v apparent_o injure_v and_o this_o seem_v to_o follow_v irresistible_o from_o the_o nature_n of_o a_o inheritance_n 4._o according_o the_o duke_n of_o lancaster_n come_v into_o the_o parliament_n and_o claim_v and_o challenge_v the_o crown_n as_o descend_v unto_o he_o by_o the_o right_a line_n of_o the_o blood_n of_o hen._n 3._o and_o his_o claim_n and_o challenge_n without_o any_o dispute_n be_v immediate_o admit_v upon_o the_o resignation_n of_o edw._n 2._o his_o son_n edw._n 3._o as_o the_o hist_o first-born_a and_o heir_n of_o the_o kingdom_n declare_v that_o upon_o his_o father_n concession_n by_o the_o counsel_n and_o advisement_n no_o other_o act_n of_o the_o great_a man_n he_o assume_v and_o take_v upon_o he_o the_o government_n 5._o but_o i_o need_v instance_n in_o no_o more_o when_o we_o have_v consider_v what_o pass_v in_o parliament_n 1_o edw._n 4._o they_o declare_v the_o king_n be_v in_o right_o from_o the_o death_n of_o the_o king_n his_o father_n very_o just_a king_n and_o that_o they_o take_v and_o repute_v the_o say_v edw._n 4._o according_a to_o his_o say_a right_a and_o title_n declare_v his_o title_n be_v just_a and_o lawful_a as_o ground_v upon_o the_o law_n of_o god_n and_o nature_n and_o also_o upon_o the_o ancient_a law_n and_o laudable_a custom_n of_o the_o say_a realm_n agreeable_a hereunto_o be_v the_o recognition_n of_o king_n james_n beforementioned_a 6._o now_o if_o we_o apply_v this_o to_o our_o own_o case_n may_v i_o demand_v what_o be_v there_o leave_v for_o the_o convention_n to_o do_v king_n james_n have_v relinquish_v the_o government_n and_o leave_v the_o throne_n vacant_a thereby_o there_o be_v a_o immediate_a descent_n of_o the_o crown_n by_o inherent_a birthright_n to_o his_o daughter_n if_o willing_a to_o accept_v it_o i_o say_v what_o have_v we_o to_o do_v more_o than_o to_o recognize_v and_o declare_v she_o to_o be_v queen_n of_o england_n indeed_o they_o do_v join_v in_o their_o say_a declaration_n the_o prince_n her_o husband_n with_o she_o but_o they_o seem_v not_o to_o pretend_v to_o make_v either_o he_o or_o she_o king_n or_o queen_n their_o word_n be_v these_o the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_n assemble_v at_o westminster_n do_v resolve_v that_o william_n and_o mary_n prince_n and_o princess_n of_o orange_n be_v and_o be_v declare_v king_n and_o queen_n of_o england_n etc._n etc._n object_n but_o why_o do_v they_o not_o then_o declare_v the_o princess_n as_o immediate_a heir_n to_o be_v queen_n only_o or_o at_o least_o before_o the_o prince_n sol._n this_o i_o hope_n have_v be_v fair_o account_v for_o before_o consensus_fw-la tollit-errorem_a especial_o consent_v ground_v upon_o invincible_a reason_n of_o state_n in_o that_o juncture_n or_o rather_o confusion_n of_o affair_n and_o if_o we_o look_v back_o upon_o former_a time_n we_o be_v not_o without_o instance_n in_o this_o particular_a not_o much_o unlike_o it_o 2._o edward_n the_o second_o deny_v himself_o of_o his_o right_n and_o actual_o relinquish_v the_o government_n it_o be_v not_o material_a here_o upon_o what_o motive_n and_o his_o son_n with_o the_o father_n like_n and_o the_o advice_n of_o the_o great_a man_n be_v king_n of_o england_n during_o his_o father_n life_n though_o before_o he_o have_v swear_v invito_fw-la patre_fw-la he_o will_v never_o accept_v of_o the_o crown_n yet_o when_o he_o do_v accept_v it_o he_o declare_v he_o take_v it_o not_o as_o the_o gift_n of_o the_o people_n nor_o any_o other_o way_n but_o as_o primogenitus_fw-la regis_fw-la &_o haeres_fw-la 3._o somewhat_o like_o it_o we_o read_v concern_v richard_n duke_n of_o york_n he_o be_v permit_v by_o the_o true_a heir_n to_o the_o crown_n though_o his_o own_o title_n to_o it_o be_v upon_o examination_n sound_v defective_a to_o possess_v the_o throne_n for_o the_o honour_n of_o the_o king_n and_o to_o maintain_v peace_n during_o his_o life_n and_o the_o true_a heir_n do_v cedere_fw-la de_fw-la jure_fw-la svo_fw-la with_o establish_v for_o the_o estate_n of_o the_o king_n and_o of_o the_o realm_n and_o people_n may_v be_v treat_v move_v and_o establish_v by_o the_o king_n and_o by_o the_o assent_n of_o the_o prelate_n earl_n baerons_n and_o commonalty_n of_o the_o kingdom_n and_o there_o be_v no_o doubt_n but_o this_o be_v the_o proper_a course_n in_o ordinary_a case_n 5._o but_o that_o there_o be_v a_o necessity_n for_o a_o convention_n that_o be_v no_o parliament_n in_o some_o extraordinary_a case_n to_o meddle_v in_o these_o high_a matter_n none_o i_o think_v can_v question_v namely_o if_o we_o can_v suppose_v the_o royal_a family_n extinct_a at_o least_o so_o far_o as_o there_o be_v no_o heir_n appear_v to_o claim_v and_o take_v the_o government_n upon_o the_o demise_n of_o the_o king._n be_v there_o not_o a_o plain_a necessity_n now_o to_o preserve_v all_o from_o confusion_n for_o the_o great_a man_n etc._n etc._n to_o meet_v and_o to_o consider_v where_o to_o place_v the_o government_n according_a to_o right_n or_o merit_v 6._o again_o we_o may_v suppose_v two_o or_o more_o rival_n for_o the_o crown_n case_n upon_o the_o king_n death_n when_o there_o can_v be_v no_o parliament_n that_o if_o in_o be_v before_o die_v with_o the_o king_n shall_v not_o the_o great_a man_n meet_v and_o prevent_v the_o ruin_n of_o the_o kingdom_n by_o civil_a war_n by_o acknowledge_v and_o assist_v the_o right_a heir_n as_o they_o be_v bind_v by_o their_o natural_a allegiance_n yea_o i_o may_v add_v if_o a_o pretender_n exclude_v by_o the_o limitation_n of_o the_o law_n shall_v by_o violence_n invade_v the_o government_n what_o remedy_n if_o the_o people_n may_v not_o meet_v especial_o be_v invite_v thereunto_o by_o the_o next_o heir_n qualify_v by_o the_o law_n to_o keep_v out_o the_o pretender_n and_o admit_v the_o lawful_a heir_n to_o take_v the_o government_n 7._o that_o there_o may_v be_v limitation_n put_v to_o the_o descent_n of_o the_o crown_n methinks_v lie_v not_o only_o in_o the_o nature_n of_o government_n but_o have_v be_v the_o declare_a sense_n of_o the_o kingdom_n i._n e._n of_o king_n &_o parliament_n upon_o all_o occasion_n and_o never_o deny_v and_o if_o those_o limitation_n be_v necessary_a for_o the_o preservation_n of_o the_o whole_a and_o our_o very_a constitution_n as_o they_o may_v be_v or_o be_v clear_o express_v in_o a_o
allegiance_n be_v both_o the_o natural_a and_o legal_a result_v of_o the_o relation_n betwixt_o king_n and_o subject_a which_o very_a title_n do_v after_o a_o sort_n import_v so_o much_o 7._o nor_o be_v the_o take_v this_o oath_n necessary_a only_o by_o the_o law_n of_o nature_n and_o by_o the_o common_a law_n of_o the_o land_n and_o act_n of_o parliament_n but_o by_o the_o law_n of_o god._n if_o we_o shall_v grant_v it_o to_o be_v perfect_o indifferent_a without_o it_o yet_o we_o must_v grant_v that_o if_o it_o be_v determine_v by_o the_o word_n of_o god_n it_o thereby_o become_v necessary_a now_o i_o shall_v think_v that_o to_o obey_v the_o power_n in_o be_v be_v as_o clear_o command_v by_o the_o law_n of_o god_n in_o the_o holy_a scripture_n as_o by_o any_o other_o law_n whatsoever_o and_o that_o we_o can_v or_o do_v not_o obey_v the_o power_n in_o be_v if_o we_o refuse_v to_o take_v the_o oath_n which_o we_o say_v be_v in_o itself_o indifferent_a when_o express_o require_v by_o the_o law_n of_o the_o land_n 8._o i_o think_v it_o be_v the_o sense_n not_o only_o of_o the_o church_n of_o england_n but_o of_o all_o good_a christian_n that_o the_o word_n of_o god_n make_v it_o our_o duty_n to_o obey_v the_o government_n in_o all_o indifferent_a thing_n make_v necessary_a by_o our_o own_o law_n and_o that_o we_o be_v bind_v to_o such_o obedience_n not_o only_o for_o wrath_n but_o conscience_n sake_n conscience_n towards_o god_n his_o ordinance_n and_o command_v let_v we_o not_o misjudg_v it_o for_o our_o honour_n or_o reputation_n to_o change_v our_o law_n require_v we_o to_o take_v this_o oath_n do_v not_o the_o necessity_n of_o it_o as_o it_o be_v a_o mean_n make_v it_o medii_fw-la our_o duty_n what_o if_o reputation_n weigh_v something_o with_o we_o do_v not_o the_o danger_n of_o the_o public_a continue_v by_o our_o stiffness_n weigh_v more_o do_v we_o talk_v of_o honour_n when_o the_o commonwealth_n lie_v at_o stake_n be_v it_o comely_a for_o a_o soldier_n to_o be_v play_v with_o a_o feather_n in_o his_o cap_n when_o hannibal_n be_v at_o the_o gate_n 1._o pardon_v i_o if_o zeal_n have_v eat_v i_o up_o and_o i_o can_v contain_v o_o do_v thou_o good_a 2._o who_o consider_v how_o much_o be_v owe_v to_o niceness_n and_o strangeness_n to_o the_o government_n for_o the_o hazard_n and_o blood_n of_o ireland_n and_o scotland_n already_o who_o weigh_v the_o further_a consequence_n of_o it_o both_o at_o home_n and_o abroad_o where_o be_v our_o compassion_n to_o our_o protestant_a brethren_n our_o concern_v for_o the_o these_o be_v substantial_a and_o weighty_a thing_n and_o what_o be_v the_o colour_n of_o a_o pretend_a reputation_n in_o comparison_n of_o these_o 3._o what_o do_v we_o mean_v upon_o a_o point_n of_o honour_n to_o throw_v a_o glove_n to_o the_o government_n be_v it_o reasonable_a or_o fit_a for_o we_o to_o provoke_v the_o king_n to_o a_o quarrel_n who_o have_v so_o many_o enemy_n already_o and_o must_v stake_v three_o kingdom_n to_o our_o little_a reputation_n yea_o the_o interest_n of_o the_o protestant_a world_n too_o of_o which_o he_o be_v make_v the_o protector_n 4._o be_v it_o not_o beside_o how_o unaccountable_a be_v principle_n that_o engage_v a_o man_n against_o his_o own_o as_o well_o as_o the_o public_a interest_n as_o if_o a_o man_n be_v bind_v to_o oppose_v and_o fight_v with_o himself_o and_o all_o about_o he_o certain_o this_o be_v a_o miserable_a strait_n and_o such_o as_o one_o can_v imagine_v the_o wise_a and_o good_a providence_n of_o god_n shall_v bring_v we_o christian_a religion_n i_o be_o sure_a our_o saviour_n and_o more_o large_o st._n paul_n require_v our_o obedience_n to_o the_o power_n that_o be_v without_o any_o consideration_n of_o their_o title_n mere_o because_o of_o their_o authority_n and_o administration_n in_o which_o the_o apostle_n express_o find_v the_o duty_n of_o subjection_n for_o conscience_n sake_n the_o argument_n to_o this_o purpose_n late_o urge_v from_o roman_n 13._o by_o several_a worthy_a author_n i_o despair_v of_o ever_o see_v tolerable_o answer_v to_o who_o i_o refer_v my_o reader_n only_o let_v we_o meditate_v those_o notable_a counsel_n of_o god_n by_o the_o prophet_n seek_v the_o peace_n of_o the_o city_n babylon_n where_o the_o people_n be_v captive_n to_o their_o tyrannical_a enemy_n and_o pray_v unto_o our_o allegiance_n to_o a_o king_n regnant_a without_o our_o be_v satisfy_v touch_v his_o title_n have_v we_o not_o the_o authority_n of_o former_a age_n be_v not_o our_o statute-book_n a_o clear_a testimony_n of_o it_o in_o what_o time_n be_v it_o ever_o deny_v who_o be_v ever_o censure_v or_o punish_v for_o grant_v it_o be_v not_o all_o such_o king_n who_o reign_v without_o right_o record_v as_o king_n of_o england_n and_o their_o law_n as_o authentic_a and_o obligatory_a be_v it_o not_o evident_a then_o that_o allegiance_n due_a to_o a_o king_n regnant_a with_o right_a or_o with_o none_o be_v agreeable_a to_o the_o state_n and_o principle_n of_o this_o monarchy_n and_o found_v in_o the_o usage_n and_o common_a law_n of_o england_n but_o that_o which_o methinks_v shall_v put_v the_o matter_n beyond_o question_n be_v the_o know_v and_o often_o mention_v stat._n of_o 11_o hen._n 7._o 1._o ground_v as_o it_o speak_v the_o sense_n of_o the_o nation_n upon_o reason_n law_n and_o good_a conscience_n and_o though_o the_o worthy_a author_n of_o consideration_n and_o other_o have_v with_o a_o great_a deal_n of_o strength_n argue_v hence_o to_o satisfy_v the_o scruple_n of_o our_o brethren_n and_o it_o can_v be_v expect_v that_o i_o shall_v add_v any_o thing_n very_o considerable_a yet_o i_o shall_v very_o brief_o observe_v a_o few_o thing_n for_o our_o purpose_n from_o it_o 1._o it_o be_v thereby_o acknowledge_v that_o a_o king_n de_fw-fr facto_fw-la have_v the_o name_n and_o style_n of_o a_o king_n of_o england_n 2._o we_o be_v to_o recognize_v such_o a_o one_o as_o our_o sovereign_a lord_n 3._o that_o allegiance_n be_v due_a to_o such_o a_o king_n from_o all_o his_o subject_n 4._o that_o by_o reason_n of_o the_o same_o allegiance_n they_o be_v bind_v to_o serve_v he_o even_o in_o his_o war_n 5._o that_o they_o be_v never_o hereafter_o to_o be_v question_v though_o the_o lawful_a king_n shall_v recover_v his_o right_n for_o so_o do_v their_o true_a duty_n and_o service_n of_o allegiance_n as_o the_o word_n be_v 6._o that_o war_n make_v against_o such_o a_o king_n by_o his_o subject_n be_v rebellion_n all_o these_o thing_n be_v plain_a in_o the_o letter_n of_o that_o law_n which_o have_v continue_v unrepealed_a or_o unquestioned_a for_o above_o two_o hundred_o year_n and_o consequent_o so_o long_o have_v be_v the_o approve_a sense_n of_o the_o whole_a nation_n that_o allegiance_n and_o true_a and_o faithful_a service_n be_v due_a to_o our_o sovereign_a lord_n for_o the_o time_n be_v whatever_o his_o title_n be_v hence_o it_o follow_v that_o in_o the_o sense_n of_o the_o law_n a_o king_n de_fw-fr jure_fw-la only_o be_v not_o king._n the_o statute_n say_v the_o king_n for_o the_o time_n be_v and_o see_v we_o can_v have_v but_o one_o king_n he_o that_o have_v only_o right_a to_o be_v king_n be_v no_o king_n in_o be_v or_o for_o the_o time_n be_v hereupon_o i_o suppose_v the_o great_a lawyer_n inform_v we_o that_o the_o king_n de_fw-fr jure_fw-la only_o be_v not_o within_o the_o purview_n of_o the_o statute_n of_o treason_n be_v not_o as_o they_o say_v signior_n le_fw-fr roy._n consequent_o if_o treason_n can_v be_v commit_v against_o a_o king_n de_fw-fr jure_fw-la while_o he_o be_v out_o of_o possession_n allegiance_n can_v be_v due_a to_o he_o which_o be_v a_o duty_n we_o owe_v to_o the_o king_n as_o our_o soveragin_n lord_n and_o none_o in_o the_o eye_n of_o the_o law_n be_v so_o but_o the_o king_n in_o possession_n thus_o the_o formal_a reason_n of_o the_o oath_n of_o allegiance_n to_o the_o late_a king_n cease_v if_o he_o be_v no_o king_n in_o law_n because_o out_o of_o possession_n the_o obligation_n of_o that_o oath_n with_o respect_n to_o he_o cease_v also_o beside_o much_o of_o the_o matter_n of_o our_o former_a oath_n be_v go_v too_o for_o we_o be_v swear_v to_o bear_v true_a allegiance_n to_o he_o in_o reveal_v and_o prevent_v treason_n against_o he_o and_o now_o he_o be_v not_o a_o object_n capable_a of_o treason_n but_o they_o also_o tell_v we_o treason_n may_v be_v commit_v against_o a_o king_n regnant_a without_o right_n and_o if_o so_o it_o be_v thence_o evident_a that_o allegiance_n be_v due_a to_o he_o against_o which_o treason_n be_v direct_o contrary_a treason_n be_v a_o offence_n against_o our_o natural_a allegiance_n which_o appear_v from_o the_o form_n of_o endictment_n the_o word_n be_v contra_fw-la debitum_fw-la fidei_fw-la &_o ligeantiae_fw-la suae_fw-la against_o the_o duty_n of_o faith_n and_o true_a allegiance_n so_o near_o be_v they_o to_o the_o very_a word_n in_o the_o oath_n of_o allegiance_n in_o a_o word_n to_o apply_v it_o be_v not_o william_n and_o mary_n now_o regnant_a and_o in_o full_a possession_n of_o the_o government_n to_o deny_v this_o be_v to_o impose_v upon_o our_o sense_n be_v they_o not_o our_o sovereign_n also_o to_o who_o we_o owe_v allegiance_n this_o to_o question_n be_v against_o all_o kind_n of_o law_n may_v we_o be_v guilty_a of_o treason_n against_o they_o then_o suppose_a allegiance_n to_o their_o enemy_n seem_v to_o be_v a_o degree_n towards_o that_o treason_n and_o to_o be_v a_o treasonable_a principle_n if_o bring_v into_o act_n it_o tend_v apparent_o to_o the_o death_n of_o the_o king_n and_o queen_n and_o how_o far_o the_o very_a opinion_n be_v from_o imagination_n and_o consequent_o from_o the_o formality_n of_o treason_n shall_v be_v sober_o consider_v at_o least_o to_o abate_v our_o censure_v of_o the_o government_n that_o with_o some_o severity_n require_v our_o allegiance_n and_o if_o it_o may_v be_v to_o persuade_v we_o to_o timely_a conformity_n therein_o the_o sum_n be_v i_o think_v we_o can_v justify_v our_o refuse_v to_o take_v the_o new_a oath_n of_o allegiance_n to_o king_n william_n and_o queen_n mary_n without_o destroy_v act_n of_o parliament_n change_v the_o law_n of_o england_n and_o raze_v the_o principle_n and_o law_n of_o nature_n the_o word_n of_o two_o hen._n 7._o cap._n 1._o bear_v to_o our_o purpose_n be_v these_o the_o king_n our_o sovereign_a lord_n call_v to_o his_o remembrance_n the_o duty_n of_o allegiance_n of_o the_o subject_n of_o this_o his_o realm_n and_o that_o they_o by_o reason_n of_o the_o same_o be_v bind_v to_o serve_v their_o prince_n
