priest_n or_o deacon_n in_o the_o church_n chappel_n or_o place_n of_o public_a worship_n where_o the_o say_a sermon_n or_o lecture_n be_v to_o be_v preach_v before_o such_o sermon_n or_o lecture_n be_v preach_v and_o that_o the_o lecturer_n then_o to_o preach_v shall_v be_v present_a at_o the_o read_n thereof_o provide_v nevertheless_o that_o this_o act_n shall_v not_o extend_v to_o the_o university_n church_n university_n proviso_n for_o sermon_n and_o lecture_n in_o the_o university_n in_o the_o university_n of_o this_o realm_n or_o either_o of_o they_o when_o or_o at_o such_o time_n as_o any_o sermon_n or_o lecture_n be_v preach_v or_o read_v in_o the_o say_a church_n or_o any_o of_o they_o for_z or_o as_o the_o public_a university_n sermon_n or_o lecture_n but_o that_o the_o same_o sermon_n and_o lecture_n may_v be_v preach_v or_o read_v in_o such_o sort_n and_o manner_n as_o the_o same_o have_v be_v heretofore_o preach_v or_o read_v this_o act_n or_o any_o thing_n herein_o contain_v to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a good_a law_n law_n the_o law_n and_o statute_n former_o make_v for_o uniformity_n of_o common_a prayer_n confirm_v and_o to_o be_v execute_v for_o punish_v offender_n against_o this_o law_n and_o statute_n of_o this_o realm_n which_o have_v be_v former_o make_v and_o be_v now_o in_o force_n for_o the_o uniformity_n of_o prayer_n and_o administration_n of_o the_o sacrament_n within_o this_o realm_n of_o england_n and_o place_n aforesaid_a shall_v stand_v in_o full_a force_n and_o strength_n to_o all_o intent_n and_o purpose_n whatsoever_o for_o the_o establish_n and_o confirm_v of_o the_o say_a book_n entitle_v the_o book_n of_o common_a prayer_n and_o administration_n of_o the_o sacrament_n and_o other_o rite_n and_o ceremony_n of_o the_o church_n according_a to_o the_o use_n of_o the_o church_n of_o england_n together_o with_o the_o psalter_n or_o psalm_n of_o david_n point_v as_o they_o be_v to_o be_v sing_v or_o say_v in_o church_n and_o the_o form_n or_o manner_n of_o make_v ordain_v and_o consecrate_v of_o bishop_n priest_n and_o deacon_n herein_o before_o mention_v to_o be_v join_v and_o annex_v to_o this_o act_n and_o shall_v be_v apply_v practise_v and_o put_v in_o ure_n for_o the_o punish_n of_o all_o offence_n contrary_a to_o the_o say_a law_n with_o relation_n to_o the_o book_n aforesaid_a and_o no_o other_o provide_v always_o and_o be_v it_o further_o enact_v by_o the_o or_o say_v in_o church_n and_o the_o form_n and_o manner_n of_o make_v ordain_v and_o consecrate_v of_o bishop_n priest_n and_o deacon_n shall_v at_o the_o cost_n and_o charge_n of_o the_o common_o speak_v or_o use_v before_o the_o first_o day_n of_o may_n one_o thousand_o six_o hundred_o sixty_o five_o and_o that_o from_o and_o after_o the_o imprint_n and_o publish_v of_o the_o say_a book_n so_o translate_v the_o whole_a divine_a service_n shall_v be_v use_v and_o say_v by_o the_o minister_n and_o curate_n throughout_o all_o wales_n within_o the_o say_a diocese_n where_o the_o perpetual_o preserve_v and_o for_o the_o avoid_n of_o all_o dispute_v for_o the_o time_n to_o come_v keep_v true_a and_o perfect_a copy_n of_o this_o act_n and_o the_o book_n of_o common_a prayer_n by_o who_o and_o how_o to_o be_v have_v and_o keep_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a dean_n and_o chapter_n of_o every_o cathedral_n or_o

summary_n course_n without_o formality_n of_o plead_n or_o proceed_n with_o power_n to_o warn_v party_n to_o come_v before_o they_o and_o to_o examine_v upon_o oath_n any_o witness_n that_o shall_v or_o twelve_o pound_n and_o sometime_o thirtéen_v or_o fourtéen_v pound_n weight_n and_o the_o pot_n be_v make_v general_o to_o weigh_v seven_o pound_n and_o some_o of_o they_o eight_o pound_n or_o yield_v not_o that_o price_n nor_o be_v vent_v there_o in_o such_o quantity_n as_o otherwise_o it_o will_v for_o remedy_v whereof_o be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a cask_n a_o kilderkin_n of_o butter_n shall_v contain_v 112_o l._n beside_o the_o cask_n and_o commons_o in_o this_o present_a parliament_n assemble_v that_o from_o and_o after_o the_o first_o day_n of_o june_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o neat_a or_o above_o beside_o the_o weight_n of_o the_o cask_n of_o good_a and_o merchantable_a butter_n and_o every_o pot_n of_o butter_n do_v and_o shall_v contain_v fourtéen_v pound_n neat_a or_o above_o beside_o the_o weight_n of_o the_o pot_n l._n the_o pot_n 14._o l._n of_o good_a and_o merchantable_a butter_n and_o that_o no_o butter_n which_o be_v old_a or_o corrupt_a shall_v be_v mix_v or_o pack_v up_o into_o any_o kilderkin_n firkin_n or_o other_o cask_n vessel_n or_o pot_n whatsoever_o with_o any_o butter_n which_o be_v new_a and_o sound_a new_a no_o old_a butter_n shall_v be_v mix_v with_o new_a nor_o any_o whay-butter_n shall_v be_v pack_v or_o mix_v with_o any_o butter_n that_o be_v make_v of_o cream_n but_o that_o the_o say_v respective_a sort_n of_o butter_n shall_v be_v pack_v up_o several_o and_o apart_o by_o themselves_o and_o shall_v not_o be_v mix_v one_o with_o another_o and_o that_o every_o cask_n or_o pot_n of_o butter_n shall_v be_v of_o one_o sort_n and_o goodness_n throughout_o such_o cask_n and_o pot_n whay-butter_n nor_o whay-butter_n and_o that_o no_o butter_n shall_v be_v salt_v with_o any_o great_a salt_n but_o that_o all_o butter_n shall_v be_v salt_v and_o save_v with_o small_a salt_n nor_o more_o salt_n shall_v be_v intermix_v with_o it_o then_o shall_v be_v needful_a for_o its_o preservation_n penalty_n the_o penalty_n upon_o pain_n and_o penalty_n that_o every_o owner_n farmer_n or_o packer_n of_o butter_n not_o put_v up_o in_o each_o kilderkin_n firkin_n and_o pot_n of_o butter_n to_o be_v sell_v or_o to_o be_v expose_v to_o sale_n respective_o such_o quantity_n as_o aforesaid_a or_o offend_v in_o false_a pack_v as_o aforesaid_a for_o every_o such_o offence_n shall_v forfeit_v the_o value_n of_o all_o the_o butter_n so_o false_a pack_v and_o for_o every_o offence_n where_o any_o kilderkin_n firkin_n or_o pot_n shall_v be_v find_v to_o contain_v a_o lesser_a quantity_n of_o butter_n then_o by_o this_o act_n be_v appoint_v six_o time_n the_o value_n of_o every_o pound_n of_o butter_n that_o shall_v be_v want_v in_o any_o such_o cask_n or_o pot._n and_o to_o the_o intent_n that_o the_o benefit_n intend_v by_o this_o act_n may_v be_v extend_v with_o full_a effect_n to_o all_o person_n who_o do_v either_o cut_v out_o butter_n by_o retail_n or_o expend_v it_o be_v it_o further_o enact_v
such_o rate_n be_v make_v whereby_o they_o shall_v have_v power_n for_o their_o several_a county_n to_o raise_v upon_o the_o parish_n that_o lie_v in_o or_o near_o the_o say_a road_n and_o so_o will_v have_v a_o benefit_n therefrom_o such_o sum_n or_o sum_n of_o money_n as_o they_o shall_v see_v fit_a and_o convenient_a for_o the_o speedy_a effect_n of_o the_o say_v repair_v before_o mention_v which_o say_v sum_n and_o sum_n so_o to_o be_v rate_v as_o aforesaid_a shall_v be_v pay_v to_o the_o surveyor_n for_o the_o respective_a county_n where_o such_o rate_n be_v make_v or_o to_o their_o receiver_n or_o collector_n to_o be_v employ_v for_o the_o repair_n of_o the_o say_a way_n and_o place_n aforementioned_a and_o not_o otherwise_o and_o in_o case_n any_o person_n shall_v refuse_v to_o pay_v such_o rate_n so_o to_o be_v make_v that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a surveyor_n or_o their_o say_a receiver_n and_o collector_n to_o distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o the_o distress_n to_o sell_v render_v the_o overplus_n to_o the_o owner_n provide_v always_o and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o advance_v by_o the_o say_v several_a town_n in_o the_o say_v respective_a county_n shall_v again_o be_v repay_v with_o interest_n by_o the_o several_a surveyor_n for_o the_o several_a county_n as_o it_o do_v arise_v out_o of_o the_o say_a toll_n every_o county_n pay_v for_o what_o be_v so_o borrow_a within_o its_o own_o county_n and_o no_o further_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n not_o have_v any_o lawful_a cause_n to_o be_v allow_v as_o aforesaid_a surveyor_n the_o penalty_n for_o refuse_v to_o take_v the_o office_n of_o surveyor_n shall_v neglect_v or_o refuse_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n be_v thereunto_o nominate_v and_o choose_v according_a as_o by_o this_o act_n be_v appoint_v or_o to_o do_v or_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_a justice_n of_o the_o peace_n for_o the_o several_a and_o respective_a county_n where_o such_o surveyor_n or_o surveyor_n dwell_v at_o their_o quarter-session_n shall_v and_o may_v hereby_o have_v power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v such_o fine_a or_o fine_n not_o exceed_a ten_n pound_n upon_o each_o person_n so_o refuse_v or_o neglect_v as_o to_o they_o fine_n or_o forfeiture_n to_o be_v impose_v or_o incur_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o surveyor_n for_o the_o time_n be_v or_o any_o three_o of_o they_o or_o the_o treasurer_n of_o the_o say_a surveyor_n for_o the_o say_v respective_a county_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a and_o in_o case_n of_o refusal_n or_o if_o any_o person_n or_o person_n so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n shall_v happen_v to_o die_v or_o shall_v for_o any_o lawful_a impediment_n be_v discharge_v from_o the_o say_a office_n that_o then_o some_o other_o fit_a person_n or_o person_n within_o that_o county_n shall_v be_v appoint_v by_o two_o or_o more_o justice_n in_o the_o say_a county_n live_v near_o the_o say_a highway_n and_o place_n aforesaid_a in_o the_o place_n of_o he_o or_o they_o that_o shall_v so_o refuse_v die_v or_o be_v discharge_v and_o the_o person_n or_o person_n so_o choose_v shall_v and_o be_v hereby_o require_v upon_o notice_n thereof_o to_o he_o or_o they_o give_v under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n by_o who_o he_o or_o like_a penalty_n as_o if_o he_o or_o they_o have_v be_v choose_v by_o the_o justice_n at_o their_o session_n of_o the_o peace_n in_o manner_n as_o aforesaid_a issue_n suit_n upon_o this_o act_n shall_v be_v lay_v in_o the_o proper_a county_n and_o the_o defendant_n may_v plead_v the_o general_a issue_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o suit_n shall_v be_v commence_v against_o any_o person_n for_o any_o thing_n do_v in_o pursuance_n of_o this_o present_a act_n that_o in_o every_o such_o case_n the_o action_n shall_v be_v lay_v in_o the_o say_v respective_a county_n where_o the_o cause_n do_v arise_v and_o not_o elsewhere_o and_o the_o defendant_n in_o such_o action_n so_o to_o be_v bring_v may_v plead_v the_o general_a issue_n for_o the_o defendant_n and_o upon_o such_o verdict_n or_o if_o the_o plaintiff_n shall_v be_v nonsuit_v or_o discontinue_v his_o action_n after_o the_o defendant_n shall_v have_v appear_v or_o if_o upon_o demurrer_n judgement_n shall_v be_v give_v against_o the_o plaintiff_n the_o say_a defendant_n shall_v have_v and_o recover_v his_o double_a cost_v cost_v double_o cost_v and_o have_v the_o like_a remedy_n for_o the_o same_o as_o any_o defendant_n have_v in_o any_o other_o case_n by_o law_n day_n toll_n not_o to_o be_v pay_v twice_o in_o the_o same_o day_n provide_v always_o that_o no_o person_n or_o person_n have_v occasion_n to_o pass_v any_o place_n where_o the_o toll_n be_v take_v and_o return_v the_o same_o day_n with_o the_o same_o horse_n coach_n wagon_n or_o other_o carriage_n or_o with_o cattle_n shall_v be_v compel_v in_o the_o same_o day_n to_o pay_v the_o say_a toll_n a_o second_o time_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o provide_v also_o that_o all_o and_o every_o person_n and_o person_n who_o by_o law_n be_v chargeable_a towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a shall_v still_o remain_v so_o chargeable_a any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o toll_n the_o continuance_n of_o this_o act_n for_o 11._o year_n only_o proviso_n for_o exempt_n certain_a person_n and_o thing_n from_o pay_v any_o toll_n provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o any_o the_o heir_n male_n of_o his_o body_n beget_v or_o to_o be_v beget_v his_o and_o their_o receivers-general_n to_o receive_v all_o and_o every_o the_o say_a rent_n issue_n and_o profit_n accrue_v for_o out_o of_o the_o say_v general_a letter-office_n or_o post-office_n or_o office_n of_o post-master-general_n shall_v for_o and_o during_o the_o say_a estate_n tail_n be_v pay_v into_o the_o reason_n of_o any_o allot_v either_o of_o great_a quantity_n or_o as_o belong_v to_o other_o county_n parish_n or_o manor_n or_o in_o more_o inconvenient_a place_n than_o they_o be_v former_o allot_v and_o set_v out_o by_o a_o law_n of_o sewer_n make_v at_o saint_n ives_n the_o twelve_o day_n of_o october_n in_o the_o thirteen_o year_n of_o king_n charles_n the_o first_o notwithstanding_o any_o say_a law_n of_o st._n ives_n in_o lieu_n of_o like_a proportion_n alter_v and_o restore_v to_o the_o country_n shall_v be_v hold_v and_o enjoy_v by_o the_o say_a corporation_n subject_n shall_v be_v set_v forth_o to_o the_o say_a corporation_n in_o trust_n for_o the_o participant_n or_o adventurer_n who_o proportion_n shall_v be_v so_o alter_v or_o exchange_v in_o lieu_n of_o such_o part_n as_o shall_v be_v so_o alter_v exchange_v or_o restore_v such_o other_o proportion_n in_o such_o other_o place_n within_o the_o say_v level_n as_o to_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o that_o any_o of_o the_o proportion_n of_o the_o say_v ninety_o five_o thousand_o acre_n heretofore_o set_v forth_o to_o francis_n earl_n of_o bedford_n his_o then_z participant_n and_o assign_v do_v fall_v short_a in_o the_o quantity_n of_o acre_n for_o which_o the_o same_o be_v set_v forth_o and_o allot_v according_a to_o the_o say_a law_n of_o lynne_n and_o year_n of_o his_o late_a majesty_n reign_n of_o ever_o bless_a memory_n have_v do_v or_o hereafter_o shall_v do_v any_o act_n or_o act_n to_o the_o prejudice_n of_o navigation_n and_o whereby_o navigation_n in_o the_o say_a river_n of_o owse_n and_o grant_v and_o all_o other_o river_n now_o navigable_a pass_v through_o the_o say_v level_n and_o the_o river_n of_o westwater_n be_v a_o amend_v at_o the_o proper_a cost_v and_o charge_n of_o the_o say_a corporation_n within_o a_o convenient_a time_n as_o to_o their_o judgement_n shall_v seem_v meet_a and_o in_o case_n it_o shall_v happen_v and_o so_o fall_v out_o that_o the_o say_a corporation_n shall_v neglect_v or_o refuse_v to_o repair_v and_o make_v good_a the_o same_o according_a to_o the_o order_n and_o decree_n of_o the_o say_a commissioner_n and_o within_o the_o time_n limit_v by_o they_o that_o then_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o by_o warrant_n under_o their_o hand_n and_o seal_n attest_v to_o tax_v the_o say_v ninety_o five_o thousand_o acre_n in_o such_o sum_n and_o sum_n of_o money_n as_o in_o their_o judgement_n shall_v seem_v meet_a for_o the_o make_n preserve_v and_o keep_v the_o navigation_n in_o any_o of_o the_o aforesaid_a river_n as_o the_o same_o be_v in_o the_o say_v six_o year_n of_o refuse_v or_o neglect_v to_o pay_v the_o say_a sum_n or_o sum_n as_o aforesaid_a that_o then_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o shall_v have_v full_a power_n and_o authority_n to_o empower_v the_o say_a person_n or_o person_n to_o levy_v the_o say_a sum_n or_o sum_n of_o money_n by_o distress_n or_o distress_n to_o be_v take_v upon_o the_o say_v ninety_o five_o thousand_o acre_n or_o any_o part_n thereof_o and_o make_v sale_n of_o the_o say_a distress_n or_o distress_n so_o take_v and_o sell_v the_o same_o and_o render_v the_o overplus_n unto_o the_o say_a governor_n or_o treasurer_n deduct_v the_o reasonable_a charge_n for_o their_o labour_n and_o pain_n therein_o all_o which_o say_v sum_n or_o sum_n of_o money_n so_o to_o be_v tax_v and_o levy_v by_o the_o authority_n aforesaid_a shall_v be_v expend_v and_o lay_v out_o in_o preserve_v and_o keep_v the_o say_a navigation_n as_o aforesaid_a and_o maintain_v the_o same_o according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o statute_n and_o not_o otherwise_o and_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o be_v also_o hereby_o impower_v and_o authorize_v within_o the_o space_n of_o four_o year_n from_o the_o four_o and_o twenty_o day_n of_o june_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o &_o three_o to_o ascertain_v and_o divide_v the_o precinct_n and_o boundary_n of_o such_o part_n of_o the_o say_v respective_a county_n lordship_n manor_n and_o parish_n within_o the_o say_v level_n as_o have_v be_v by_o and_o since_o the_o undertake_n deface_v and_o make_v obscure_a or_o by_o some_o other_o mean_n remain_v uncertain_a and_o hard_a to_o be_v find_v out_o and_o shall_v set_v down_o such_o bound_n and_o division_n in_o writing_n by_o such_o mark_n boundary_n and_o description_n as_o to_o they_o shall_v seem_v meet_a and_o shall_v certify_v the_o same_o under_o their_o hand_n and_o seal_n in_o the_o high_a court_n of_o chancery_n according_a to_o which_o division_n of_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o the_o extent_n of_o the_o say_v respective_a county_n lordship_n manor_n and_o parish_n in_o such_o place_n so_o bound_v and_o divide_v shall_v for_o ever_o after_o the_o say_a certificate_n be_v deem_v to_o be_v and_o none_o other_o and_o in_o case_n the_o quantity_n of_o eight_o thousand_o acre_n lie_v together_o or_o near_o together_o or_o any_o great_a quantity_n of_o ground_n lie_v together_o or_o near_o together_o within_o the_o say_v level_n shall_v become_v drown_v and_o so_o continue_v for_o the_o space_n of_o twelve_o month_n together_o that_o then_o it_o shall_v
be_v lawful_a for_o the_o say_a commissioner_n for_o the_o time_n be_v or_o any_o seven_o or_o more_o of_o they_o from_o time_n to_o time_n and_o at_o all_o time_n to_o assess_v tax_n or_o sum_n of_o money_n upon_o the_o say_v ninety_o five_o thousand_o acre_n for_o the_o raise_n money_n for_o draining_n the_o same_o again_o in_o such_o proportion_n as_o they_o or_o any_o seven_o or_o more_o of_o they_o shall_v think_v fit_a together_o with_o a_o penalty_n for_o not_o pay_v the_o say_a tax_n the_o say_a penalty_n not_o exceed_a a_o three_o part_n of_o such_o tax_n penalty_n how_o land_n may_v be_v sell_v for_o nonpayment_n of_o tax_n or_o penalty_n and_o for_o default_n of_o payment_n of_o the_o say_a tax_n or_o sum_n of_o money_n and_o penalty_n be_v it_o enact_v that_o the_o lot_n and_o share_v of_o such_o participant_a or_o adventurer_n of_o and_o within_o the_o say_v ninety_o five_o thousand_o acre_n as_o shall_v be_v in_o arrear_n for_o the_o say_a tax_n sum_n of_o money_n or_o penalty_n and_o unpaid_a by_o the_o space_n of_o two_o month_n next_o after_o the_o day_n appoint_v for_o payment_n by_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o or_o so_o much_o thereof_o as_o they_o shall_v think_v fit_a shall_v be_v sequester_v by_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o for_o or_o towards_o the_o payment_n of_o such_o tax_n sum_n of_o money_n or_o penalty_n so_o in_o arrear_n restore_v the_o overplus_n of_o the_o money_n for_o which_o such_o lot_n or_o share_v or_o any_o part_n thereof_o shall_v be_v sequester_v if_o any_o be_v which_o sequestration_n shall_v be_v make_v in_o write_v under_o the_o hand_n and_o seal_n of_o the_o say_a commissioner_n for_o the_o time_n be_v or_o any_o seven_o or_o more_o of_o they_o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n the_o say_a governor_n bailiff_n and_o corporation_n constitute_v by_o this_o act_n shall_v neglect_v or_o refuse_v to_o pay_v such_o tax_n or_o tax_n and_o penalty_n sum_n or_o sum_n of_o money_n as_o shall_v from_o time_n to_o time_n hereafter_o be_v tax_v and_o impose_v by_o the_o say_a commissioner_n before_o name_v or_o to_o be_v name_v by_o virtue_n of_o this_o act_n or_o any_o seven_o or_o more_o of_o they_o pursuant_n to_o the_o power_n give_v they_o by_o this_o act_n whereupon_o the_o good_n and_o chattel_n of_o any_o person_n or_o person_n his_o or_o their_o tenant_n or_o tenant_n of_o and_o in_o the_o say_v ninety_o five_o thousand_o acre_n or_o any_o part_n thereof_o shall_v be_v distrain_v or_o sell_v or_o he_o or_o their_o land_n sequester_v for_o the_o payment_n thereof_o or_o that_o such_o person_n or_o person_n his_o or_o their_o tenant_n or_o tenant_n shall_v thereupon_o pay_v the_o say_a tax_n and_o tax_n and_o penalty_n so_o assess_v and_o impose_v as_o aforesaid_a that_o then_o the_o say_a governor_n bailiff_n and_o corporation_n immediate_o from_o and_o after_o notice_n to_o he_o or_o they_o give_v thereof_o shall_v assess_v and_o tax_v the_o whole_a ninety_o five_o thousand_o acre_n for_o the_o satisfaction_n and_o payment_n and_o their_o heir_n and_o assign_v shall_v and_o may_v bring_v he_o and_o their_o action_n or_o action_n of_o debt_n in_o any_o of_o the_o king_n majesty_n court_n at_o westminster_n against_o the_o say_a governor_n bailiff_n and_o corporation_n for_o the_o recovery_n thereof_o and_o by_o virtue_n of_o this_o act_n shall_v recover_v the_o same_o and_o be_v allow_v cost_v of_o suit_n expend_v therein_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n so_o constitute_v or_o to_o be_v hereafter_o constitute_v as_o aforesaid_a or_o any_o seven_o or_o more_o of_o they_o for_o the_o better_a execution_n of_o the_o power_n hereby_o give_v shall_v &_o may_v inform_v themselves_o by_o examine_v witness_n upon_o oath_n which_o hereby_o they_o or_o any_o seven_o or_o more_o of_o they_o shall_v have_v power_n to_o administer_v due_a execution_n of_o all_o every_o or_o any_o the_o power_n or_o authority_n hereby_o give_v they_o &_o for_o the_o do_v justice_n therein_o according_o oath_n the_o commissioner_n to_o take_v a_o oath_n provide_v always_o that_o the_o say_a commissioner_n and_o every_o of_o they_o before_o he_o or_o they_o take_v upon_o he_o or_o they_o the_o execution_n of_o any_o the_o power_n or_o authority_n hereby_o give_v they_o other_o than_o the_o administer_a the_o oath_n follow_v to_o one_o another_o which_o they_o shall_v have_v authority_n by_o this_o present_a act_n to_o administer_v to_o one_o another_o shall_v take_v the_o oath_n follow_v viz._n i_o a._n b._n shall_v and_o will_v without_o favour_n or_o affection_n hatred_n or_o malice_n true_o and_o impartial_o according_a to_o the_o best_a of_o my_o skill_n and_o knowledge_n execute_v and_o perform_v all_o and_o every_o the_o power_n and_o authority_n establish_v by_o this_o act_n of_o parliament_n which_o oath_n any_o one_o of_o the_o say_a commissioner_n be_v hereby_o authorize_v to_o administer_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o judgement_n order_n decree_n determination_n alteration_n change_n restauration_n and_o other_o act_n do_v by_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a or_o of_o any_o seven_o or_o more_o of_o they_o respective_o pursuant_n to_o the_o power_n and_o authority_n by_o this_o act_n give_v shall_v be_v final_a and_o that_o the_o first_o time_n and_o place_n of_o their_o meeting_n shall_v be_v at_o or_o before_o the_o two_o and_o twenty_o day_n of_o september_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o three_o at_o ely_n and_o that_o afterward_o the_o usual_a place_n where_o the_o say_v commissioner_n shall_v sit_v to_o hear_v order_n sit_v the_o place_n where_o the_o commissioner_n shall_v sit_v and_o determine_v the_o matter_n to_o they_o refer_v by_o this_o act_n shall_v from_o the_o 29_o of_o september_n to_o the_o 26_o day_n of_o march_n in_o every_o year_n be_v at_o the_o town_n of_o huntingdon_n and_o from_o the_o 25_o day_n of_o march_n till_o the_o 30_o day_n of_o september_n in_o every_o year_n be_v at_o ely_n unless_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a or_o any_o seven_o or_o more_o of_o they_o shall_v appoint_v some_o other_o place_n or_o place_n be_v a_o market_n town_n or_o town_n and_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o shall_v by_o warrant_n under_o their_o hand_n and_o seal_n declare_v the_o place_n and_o time_n of_o their_o after-méeting_n which_o warrant_n shall_v be_v publish_v in_o the_o open_a market_n of_o such_o respective_a place_n where_o they_o last_o sit_v between_o the_o hour_n of_o twelve_o &_o two_o upon_o some_o market_n day_n one_o month_n at_o the_o least_o before_o the_o say_a time_n or_o time_n of_o meeting_n to_o the_o end_n all_o person_n concern_v may_v have_v sufficient_a time_n and_o notice_n to_o make_v their_o appearance_n before_o they_o upon_o any_o cause_n of_o complaint_n or_o other_o occasion_n and_o shall_v have_v power_n and_o authority_n by_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o seven_o or_o more_o of_o they_o to_o summon_v party_n and_o witness_n to_o appear_v before_o they_o provide_v that_o none_o of_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a shall_v vote_n or_o give_v his_o judgement_n or_o determination_n in_o any_o matter_n or_o thing_n which_o concern_v the_o division_n and_o bound_n of_o the_o county_n of_o or_o for_o which_o he_o be_v appoint_v commissioner_n provide_v also_o that_o no_o person_n who_o
their_o duty_n in_o execution_n of_o this_o act._n and_o be_v it_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n shall_v wilful_o neglect_v or_o refuse_v to_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_v respective_a commissioner_n or_o any_o three_o or_o more_o of_o they_o have_v hereby_o power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v their_o duty_n such_o fine_a or_o fine_n as_o to_o they_o shall_v be_v think_v fit_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o and_o their_o good_n provide_v that_o no_o fine_a to_o be_v impose_v by_o any_o of_o the_o say_a commissioner_n shall_v for_o any_o one_o offence_n exceed_v the_o sum_n of_o twenty_o pound_n and_o that_o all_o fine_n that_o shall_v be_v impose_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o respective_a receivers-general_n and_o by_o they_o to_o the_o receipt_n of_o his_o majesty_n exchequer_n same_o collector_n and_o subcollector_n receive_v money_n and_o not_o pay_v the_o same_o and_o it_o be_v further_o enact_v and_o declare_v that_o if_o any_o collector_n or_o sub-collector_n that_o shall_v by_o virtue_n of_o this_o act_n be_v appoint_v for_o the_o receipt_n of_o any_o sum_n or_o sum_n of_o money_n thereby_o to_o be_v assess_v shall_v neglect_v or_o refuse_v to_o pay_v any_o sum_n or_o sum_n of_o money_n which_o shall_v by_o he_o be_v receive_v as_o their_o respective_a division_n be_v hereby_o authorize_v and_o empower_v to_o imprison_v the_o person_n and_o seize_v and_o secure_v the_o estate_n both_o real_a and_o personal_a of_o such_o collector_n or_o sub-collector_n to_o they_o respective_o belong_v or_o which_o shall_v descend_v or_o come_v into_o the_o hand_n or_o possession_n of_o their_o heir_n executor_n or_o administrator_n cause_n aforesaid_a seize_v and_o secure_v or_o any_o part_n of_o they_o and_o satisfy_v and_o pay_v such_o county_n and_o place_n the_o sum_n that_o shall_v be_v so_o detain_v in_o the_o hand_n of_o such_o collector_n or_o sub-collector_n and_o return_v the_o overplus_n deduct_v necessary_a charge_n to_o such_o collector_n or_o sub-collector_n their_o heir_n executor_n and_o administrator_n enact_v and_o declare_v that_o at_o the_o expiration_n of_o the_o respective_a time_n in_o this_o act_n prescribe_v for_o the_o full_a payment_n of_o the_o say_v quarterly_a assessment_n the_o several_a and_o respective_a commissioner_n or_o any_o two_o of_o they_o within_o their_o division_n and_o hundred_o shall_v and_o be_v hereby_o require_v to_o call_v before_o they_o the_o chief_a collector_n and_o subcollector_n within_o each_o respective_a division_n and_o hundred_o to_o examine_v and_o assure_v themselves_o of_o the_o full_a and_o whole_a payment_n of_o the_o particular_a sum_n and_o sum_n of_o money_n charge_v upon_o the_o say_a division_n hundred_o and_o every_o parish_n and_o place_n therein_o and_o of_o the_o due_a return_n of_o the_o same_o into_o the_o hand_n of_o the_o receivers-general_n of_o the_o say_a county_n city_n town_n and_o place_n respective_o and_o by_o such_o receiver-general_n to_o the_o receipt_n of_o his_o majesty_n exchequer_n to_o the_o end_n there_o may_v be_v no_o failer_z in_o the_o payment_n of_o any_o part_n of_o the_o assessment_n by_o virtue_n of_o this_o act_n to_o be_v assess_v and_o pay_v nor_o any_o arrears_n remain_v chargeable_a upon_o any_o the_o say_a county_n city_n town_n or_o place_n respective_o and_o in_o case_n of_o any_o faileriâ—n_n the_o premise_n the_o say_a commissioner_n or_o any_o two_o of_o they_o be_v hereby_o to_o cause_v the_o same_o to_o be_v forthwith_o levy_v and_o pay_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n vote_n commissioner_n concern_v in_o any_o controversy_n to_o withdraw_v and_o not_o vote_n and_o it_o be_v hereby_o enact_v and_o declare_v that_o in_o case_n any_o controversy_n arise_v concern_v the_o say_a assessment_n or_o the_o divide_n apportion_v or_o payment_n thereof_o which_o concern_v any_o of_o the_o commissioner_n by_o this_o act_n appoint_v that_o the_o commissioner_n so_o concern_v in_o the_o say_a controversy_n shall_v have_v no_o voice_n but_o shall_v withdraw_v at_o the_o time_n of_o the_o debate_n of_o any_o such_o controversy_n until_o it_o be_v determine_v by_o the_o rest_n of_o the_o commissioner_n rent_n no_o exemption_n of_o any_o privilege_a place_n or_o person_n fee-farm_n rent_n and_o be_v it_o hereby_o enact_v and_o declare_v that_o no_o privilege_a place_n or_o person_n body_n politic_a or_o corporate_a within_o the_o county_n city_n and_o town_n aforesaid_a shall_v be_v exempt_v from_o the_o say_a assessment_n and_o tax_n and_o that_o they_o and_o every_o of_o they_o and_o also_o all_o fée-farm_n rent_n and_o all_o other_o manner_n of_o rent_n payment_n sum_n of_o money_n and_o annuity_n issue_v out_o of_o any_o land_n within_o city_n or_o county_n shall_v be_v liable_a towards_o the_o payment_n of_o every_o sum_n by_o this_o act_n to_o be_v tax_v and_o levy_v and_o all_o the_o tenant_n of_o every_o fée-farm_n rent_n other_o rent_n sum_n of_o money_n or_o annuity_n aforesaid_a be_v hereby_o direct_v and_o authorise_v to_o pay_v they_o proportionable_o according_a to_o the_o rate_n and_o assessment_n by_o this_o act_n appoint_v and_o direct_v and_o all_o such_o tenant_n shall_v be_v hereby_o save_v and_o keep_v harmless_a by_o authority_n of_o this_o act_n from_o any_o further_a payment_n of_o such_o portion_n of_o any_o such_o rent_n rent_n sum_n or_o annuity_n either_o to_o the_o exchequer_n or_o to_o any_o other_o person_n or_o person_n to_o who_o any_o such_o rent_n rent_n sum_n of_o money_n or_o annuity_n as_o aforesaid_a shall_v or_o ought_v to_o be_v or_o westminster_n or_o any_o hospital_n for_o or_o in_o respect_n of_o the_o scites_n of_o the_o say_a college_n or_o hall_n or_o hospital_n nor_o any_o master_n fellow_n or_o scholar_n of_o any_o such_o college_n or_o hall_n or_o in_o any_o other_o free-schoole_n or_o any_o reader_n officer_n or_o minister_n of_o the_o say_a university_n college_n or_o school_n or_o of_o any_o hospital_n or_o almshouse_n for_o or_o in_o respect_n of_o any_o stipend_n wage_n or_o profit_n whatsoever_o arise_v or_o grow_v due_a to_o they_o in_o respect_n of_o the_o say_v several_a place_n and_o employment_n in_o the_o say_a university_n college_n school_n hospital_n or_o almshouse_n nor_o to_o charge_v any_o of_o the_o house_n or_o land_n belong_v to_o christ_n hospital_n saint_n bartholomewes_n bridewell_n saint_n thomas_n and_o bethlehem_n hospital_n
the_o coal_n which_o shall_v be_v otherwise_o sell_v or_o expose_v to_o sale_n by_o any_o woodmonger_n or_o retailer_n of_o coal_n and_o the_o double_a value_n thereof_o to_o be_v recover_v by_o any_o person_n or_o person_n that_o will_v prosecute_v for_o the_o same_o in_o any_o court_n of_o record_n or_o by_o way_n of_o complaint_n make_v unto_o the_o lord_n mayor_n of_o london_n for_o the_o â—ell_v at_o the_o say_a rate_n that_o then_o the_o say_a lord_n mayor_n and_o alderman_n and_o justice_n of_o peace_n respective_o be_v hereby_o authorise_v to_o appoint_v and_o empower_v such_o officer_n or_o officer_n or_o other_o person_n as_o they_o shall_v think_v fit_a to_o enter_v into_o any_o wharf_n or_o other_o place_n where_o such_o coal_n be_v store_v up_o and_o in_o case_n of_o refusal_n take_v a_o constable_n to_o force_v entrance_n and_o the_o say_a coal_n to_o sell_v or_o cause_n to_o be_v sell_v at_o such_o rate_n as_o the_o say_a lord_n mayor_n and_o alderman_n and_o justice_n respective_o shall_v judge_v reasonable_a render_v to_o such_o engrosser_n or_o retailer_n the_o money_n for_o which_o the_o say_v coal_n shall_v be_v so_o sell_v necessary_a charge_n be_v deduct_v act._n the_o continuance_n of_o this_o act._n provide_v that_o this_o act_n shall_v continue_v for_o three_o year_n next_o ensue_v and_o thenceforth_o to_o the_o end_n of_o the_o next_o session_n of_o parliament_n and_o no_o long_o provide_v also_o that_o no_o person_n or_o person_n that_o shall_v be_v sue_v by_o virtue_n of_o this_o act_n for_o not_o observe_v thereof_o shall_v be_v sue_v upon_o any_o other_o act_n or_o law_n now_o in_o force_n for_o the_o same_o offence_n and_o if_o any_o action_n shall_v be_v commence_v against_o any_o justice_n of_o peace_n issue_n person_n sue_v upon_o this_o act_n may_v plead_v the_o general_a issue_n constable_n or_o other_o officer_n or_o person_n for_o any_o thing_n do_v by_o colour_n of_o this_o act_n the_o defendant_n in_o every_o other_o in_o his_o own_o or_o any_o other_o name_n in_o the_o sale_n of_o any_o coal_n or_o the_o engross_a the_o same_o in_o order_n to_o sell_v the_o same_o and_o not_o for_o his_o own_o private_a use_n only_o shall_v act_v or_o otherwise_o intermeddle_v in_o the_o set_n the_o price_n of_o coal_n any_o thing_n in_o this_o act_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o cap._n iii_o for_o the_o return_v of_o able_a and_o sufficient_a juror_n for_o the_o return_v of_o more_o able_a and_o sufficient_a juror_n for_o trial_n hereafter_o to_o be_v have_v between_o party_n and_o a_o time_n for_o the_o general_a meeting_n of_o the_o commissioner_n of_o such_o county_n city_n or_o town_n and_o there_o to_o cause_v public_a notice_n to_o be_v give_v at_o the_o place_n where_o such_o meeting_n shall_v be_v appoint_v ten_o day_n at_o least_o before_o such_o general_a meeting_n and_o the_o commissioner_n present_v at_o such_o general_a meeting_n or_o the_o major_a part_n of_o they_o in_o case_n the_o money_n detain_v by_o such_o head-collector_n be_v not_o pay_v or_o satisfy_v as_o aught_o to_o be_v according_a to_o the_o direction_n of_o this_o act_n shall_v and_o be_v hereby_o empower_v and_o require_v to_o sell_v and_o dispose_v of_o all_o such_o estate_n or_o any_o part_n of_o they_o which_o shall_v be_v for_o the_o cause_n aforesaid_a seize_v and_o thereby_o to_o secure_v and_o pay_v all_o the_o money_n in_o arrear_n in_o such_o head-collector_n hand_n for_o his_o majesty_n use_n and_o return_v the_o overplus_n deduct_v necessary_a charge_n to_o such_o head-collector_n his_o executor_n and_o administrator_n respective_o â—enalty_n â—enalty_n and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o pay_v the_o several_a sum_n and_o sum_n and_o proportion_n appoint_v by_o this_o act_n for_o such_o person_n to_o pay_v upon_o demand_n make_v by_o the_o officer_n or_o collector_n of_o the_o place_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v by_o the_o say_a commissioner_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o officer_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v for_o nonpayment_n thereof_o to_o distrain_v the_o person_n or_o person_n so_o refuse_v by_o his_o or_o their_o good_n or_o chattel_n and_o the_o distress_n so_o take_v to_o keep_v by_o the_o space_n of_o four_o day_n at_o the_o cost_n and_o charge_n of_o the_o owner_n thereof_o and_o if_o the_o say_a owner_n do_v not_o pay_v the_o sum_n of_o money_n due_a by_o this_o act_n within_o the_o say_v four_o day_n than_o the_o say_a distress_n to_o be_v apprize_v by_o three_o or_o two_o of_o the_o inhabitant_n where_o the_o say_a distress_n be_v take_v and_o there_o to_o be_v sell_v by_o the_o say_a officer_n for_o payment_n of_o the_o say_a money_n and_o the_o overplus_n come_v by_o the_o say_a sale_n if_o any_o be_v over_o and_o above_o the_o charge_n of_o take_v and_o keep_v the_o say_a distress_n to_o be_v immediate_o restore_v to_o the_o owner_n thereof_o and_o if_o any_o person_n or_o person_n assess_v by_o this_o act_n shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o twenty_o day_n after_o demand_n as_o aforesaid_a where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o same_o may_v be_v levy_v in_o every_o such_o case_n three_o or_o more_o of_o the_o commissioner_n by_o this_o act_n appoint_v for_o any_o such_o city_n county_n or_o place_n be_v hereby_o authorize_v by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o person_n or_o person_n to_o the_o common_a goal_n there_o to_o be_v keep_v without_o bail_n or_o mainprize_n until_o payment_n shall_v be_v make_v and_o if_o any_o person_n certify_v assess_v or_o rate_v find_v he_o or_o herself_o aggrieve_v with_o such_o assess_n or_o rate_v and_o do_v within_o ten_o day_n after_o demand_v thereof_o make_v complain_v to_o the_o commissioner_n the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o whereof_o one_o of_o the_o commissioner_n who_o sign_v or_o allow_v he_o or_o her_o rate_n to_o be_v one_o shall_v and_o may_v within_o fourtéen_v day_n next_o after_o such_o complaint_n particular_o examine_v the_o person_n so_o complain_v upon_o his_o or_o her_o oath_n of_o
