from_o the_o proprietor_n he_o or_o they_o so_o offend_v shall_v forfeit_v for_o every_o such_o trespass_n four_o hundred_o pound_n of_o tobacco_n one_o half_a to_o the_o owner_n of_o the_o land_n and_o the_o other_o half_a to_o public_a uses_n notwithstanding_o it_o shall_v be_v lawful_a for_o any_o person_n or_o person_n to_o hunt_v or_o shoot_v upon_o any_o dividend_n of_o land_n not_o plant_v or_o seat_v though_o take_v up_o without_o restraint_n or_o penalty_n provide_v also_o that_o it_o shall_v be_v lawful_a for_o any_o person_n that_o have_v shoot_v any_o game_n without_o the_o the_o treasurer_n to_o make_v composition_n lxxv_o surveyor_n of_o land_n be_v it_o enact_v that_o surveyor_n of_o land_n shall_v demand_v no_o more_o than_o twenty_o pound_n of_o yobacco_n for_o evident_o appear_v to_o the_o court_n that_o it_o be_v just_o due_a to_o he_o xlviii_o apprisement_n of_o good_n be_v it_o enact_v for_o the_o equal_a aprisement_n of_o good_n seize_v by_o execution_n that_o the_o plaintiff_n and_o defendant_n shall_v choose_v each_o of_o they_o two_o indifferent_a man_n for_o that_o purpose_n and_o in_o case_n of_o disagreement_n the_o say_v four_o or_o three_o of_o they_o shall_v choose_v a_o umpire_n which_o umpire_n so_o choose_v shall_v be_v swear_v by_o the_o next_o commissioner_n to_o apprise_v such_o good_n indifferent_o and_o his_o umpirage_n to_o be_v final_a appraized_a good_n seize_v by_o who_o they_o shall_v be_v appraized_a and_o be_v it_o further_o enact_v that_o if_o plaintiff_n or_o defendant_n shall_v neglect_v to_o appoint_v apprize_v within_o three_o day_n after_o execution_n be_v serve_v notice_n be_v give_v they_o by_o the_o sheriff_n to_o who_o the_o execution_n be_v direct_v that_o then_o the_o sheriff_n in_o such_o case_n every_o debtor_n under_o execution_n for_o debt_n shall_v be_v detain_v in_o prison_n until_o he_o have_v pay_v the_o debt_n in_o kind_n but_o that_o real_a poor_a man_n lay_v under_o execution_n for_o a_o debt_n under_o one_o thousand_o pound_n of_o tobacco_n shall_v still_o have_v liberty_n by_o part_n of_o their_o estate_n by_o some_o justice_n of_o the_o county_n indifferent_o assign_v and_o by_o apprizer_n summon_v by_o the_o sheriff_n and_o swear_v equal_o to_o apprise_v the_o say_a estate_n shall_v make_v payment_n thereof_o to_o their_o creditor_n and_o redeem_v their_o person_n xlix_o no_o commissioner_n clerk_n or_o sheriff_n to_o be_v attorney_n in_o the_o court_n where_o they_o officiate_v officiate_n no_o commissioner_n clerk_n or_o sheriff_n shall_v be_v attorney_n in_o that_o court_n wherein_o he_o officiate_n be_v it_o enact_v that_o neither_o sheriff_n commissioner_n under-sheriff_n or_o clerk_n of_o any_o court_n within_o this_o colony_n shall_v be_v permit_v to_o plead_v as_o a_o attorney_n in_o any_o person_n behalf_n in_o the_o court_n wherein_o he_o officiate_n and_o the_o say_a commissioner_n sheriff_n under-sheriff_n or_o clerk_n offend_v herein_o commissioner_n etc._n etc._n so_o plead_v the_o poor_a man_n cause_n not_o to_o give_v judgement_n therein_o provide_v also_o that_o any_o commissioner_n sheriff_n vnder-sheriff_n or_o clerk_n act_v thereof_o with_o the_o day_n appoint_v for_o the_o election_n endorse_v to_o be_v send_v to_o the_o minister_n or_o reader_n of_o every_o parish_n in_o their_o county_n who_o be_v to_o read_v the_o same_o to_o the_o people_n two_o sunday_n successive_o both_o in_o the_o church_n and_o chapel_n of_o ease_n to_o it_o belong_v to_o the_o end_n that_o no_o person_n may_v pretend_v ignorance_n and_o return_v the_o same_o to_o the_o sheriff_n with_o his_o attestation_n subscribe_v that_o he_o have_v publish_v the_o same_o according_a to_o the_o tenor_n of_o this_o act_n which_o attestation_n shall_v be_v sufficient_a to_o discharge_v the_o sheriff_n from_o blame_n but_o if_o the_o sheriff_n neglect_v to_o send_v copy_n as_o aforesaid_a then_o to_o be_v fine_v two_o thousand_o pound_n of_o tobacco_n to_o the_o use_n of_o the_o county_n tobacco_n freeman_n neglect_v to_o giuc_v their_o vote_n at_o election_n of_o burgess_n shall_v be_v fine_v 200_o l._n of_o tobacco_n and_o every_o freeman_n after_o such_o publication_n make_v neglect_v to_o come_v and_o give_v his_o vote_n at_o the_o day_n appoint_v for_o election_n shall_v be_v amerce_v two_o hundred_o pound_n of_o tobacco_n to_o the_o use_n of_o the_o county_n and_o be_v it_o further_o enact_v that_o if_o the_o sheriff_n shall_v not_o before_o the_o day_n of_o the_o return_n make_v his_o due_a return_n of_o the_o writ_n with_o the_o name_n of_o the_o burgess_n endorse_v into_o the_o secretary_n office_n at_o james_n city_n the_o say_a sheriff_n so_o neglect_v shall_v be_v fine_v two_o thousand_o pound_n of_o tobacco_n to_o the_o public_a li._n public_a levy_n to_o be_v first_o pay_v be_v it_o also_o enact_v that_o no_o sheriff_n shall_v where_o he_o receive_v tobacco_n of_o any_o person_n indebt_v for_o his_o levy_n and_o also_o for_o fee_n and_o other_o debt_n due_a to_o himself_o or_o any_o other_o officer_n and_o not_o pay_v the_o whole_a in_o kind_n by_o which_o mean_v for_o part_n thereof_o distress_n must_v be_v make_v shall_v presume_v to_o convert_v the_o tobacco_n in_o kind_n to_o his_o own_o or_o any_o other_o use_n and_o force_v the_o country_n creditor_n to_o accept_v of_o the_o distress_n or_o stay_v for_o his_o debt_n pay_v debt_n due_a to_o the_o public_a shall_v be_v first_o pay_v but_o that_o all_o debt_n due_a to_o the_o public_a be_v first_o pay_v and_o the_o tobacco_n in_o kind_n pay_v to_o the_o creditor_n of_o the_o public_a who_o reputation_n be_v by_o these_o evasion_n often_o vilify_v and_o that_o the_o sheriff_n make_v default_n herein_o shall_v be_v fine_v his_o deputy_n the_o number_n of_o hogshead_n of_o tobacco_n make_v by_o he_o and_o his_o family_n and_o to_o who_o they_o be_v sell_v and_o shall_v not_o suffer_v any_o of_o the_o say_a hogshead_n of_o tobacco_n to_o be_v carry_v out_o of_o his_o house_n until_o he_o receive_v certificate_n from_o the_o say_a collector_n that_o the_o imposition_n of_o the_o say_a tobacco_n be_v pay_v and_o if_o any_o planter_n shall_v contrary_v to_o this_o act_n suffer_v any_o of_o his_o tobacco_n to_o be_v carry_v on_o board_n any_o ship_n boat_n or_o sloop_n without_o such_o certificate_n than_o the_o say_v planter_n to_o be_v fine_v 20_o s._n for_o every_o hogshead_n so_o carry_v away_o without_o certificate_n as_o aforesaid_a whereas_o the_o like_a inconvenience_n be_v incident_a to_o northampton_n county_n and_o low_a norfolk_n in_o recover_v the_o imposition_n of_o two_o and_o ten_o shilling_n per_fw-la hogshead_n as_o to_o the_o river_n of_o potomack_n by_o reason_n of_o the_o transportation_n of_o much_o of_o the_o tobacco_n make_v in_o those_o place_n in_o sloop_n to_o mary-land_n be_v it_o enact_v that_o the_o provitional_a act_n make_v the_o last_o assembly_n for_o payment_n of_o those_o duty_n in_o potomack_n river_n extend_v and_o be_v in_o force_n in_o the_o say_a county_n of_o lower_n norfolk_n and_o northampton_n and_o that_o the_o collector_n appoint_v certain_a person_n to_o take_v account_n of_o the_o planter_n according_a to_o the_o tenor_n of_o this_o act._n cxxx_o payment_n of_o fort-duty_n in_o accomack_n etc._n etc._n whereas_o there_o be_v a_o act_n of_o the_o last_o assembly_n provide_v for_o the_o secure_n of_o the_o payment_n of_o the_o 2_o s._n per_fw-la hdd._n due_a to_o the_o country_n but_o no_o provision_n make_v therein_o for_o the_o secure_v the_o payment_n of_o fort_n duty_n of_o potomack_n accomack_n and_o lin_z haven_n etc._n three_o penny_n per_fw-la hogshead_n payable_a for_o fort_n duty_n in_o accomack_n etc._n etc._n from_o whence_o they_o fetch_v their_o tobacco_n in_o sloop_n be_v it_o enact_v that_o the_o say_a act_n shall_v extend_v as_o well_o to_o cause_v the_o planter_n load_v it_o to_o reserve_v and_o make_v payment_n of_o three_o penny_n per_fw-la hogshead_n for_o fort_n duty_n of_o the_o say_a tobacco_n as_o for_o the_o payment_n of_o the_o 2_o s._n per_fw-la hogshead_n cxxxi_o ten_o shilling_n per_fw-la hogshead_n whereas_o the_o prudence_n of_o all_o nation_n have_v provide_v for_o the_o defray_v the_o public_a necessary_a charge_n of_o the_o country_n rather_o by_o lay_v a_o imposition_n upon_o the_o adventurer_n for_o the_o staple_n commodity_n of_o the_o country_n by_o the_o exportation_n of_o which_o the_o great_a advantage_n accrue_v then_o by_o tax_v the_o person_n of_o the_o of_o ship_n and_o mariner_n trade_v to_o virginia_n and_o not_o bind_v by_o charter-party_n to_o return_v and_o discharge_v in_o any_o of_o the_o english_a dominion_n in_o europe_n shall_v pay_v for_o every_o hogshead_n of_o tobacco_n they_o shall_v load_v aboard_o any_o ship_n bark_n or_o other_o vessel_n arrive_v here_o after_o the_o first_o of_o august_n next_o and_o not_o bind_v as_o aforesaid_a ten_o shilling_n sterling_a either_o in_o money_n or_o good_a bill_n of_o exchange_n hogshead_n inhabitant_n of_o this_o country_n trade_v on_o bottom_n belong_v to_o virginia-owner_n negotiate_v in_o england_n all_o other_o public_a affair_n of_o this_o country_n and_o because_o it_o be_v manifest_a that_o a_o work_n of_o this_o nature_n be_v not_o to_o be_v undertake_v nor_o effectual_o prosecute_v without_o money_n and_o that_o we_o be_v not_o imprudent_o want_v to_o ourselves_o in_o a_o matter_n of_o so_o great_a importance_n this_o grand_a assembly_n have_v think_v fit_a that_o a_o sum_n of_o money_n be_v raise_v of_o and_o from_o the_o inhabitant_n of_o this_o country_n to_o be_v use_v and_o employ_v towards_o the_o accomplishment_n of_o the_o end_n and_o purpose_v aforesaid_a be_v it_o therefore_o enact_v by_o the_o governor_n council_n and_o burgess_n of_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o fifty_o pound_n of_o tobacco_n beside_o cask_n and_o salary_n be_v levy_v from_o every_o tythable_a person_n within_o this_o colony_n this_o present_a year_n same_o levy_n to_o be_v make_v for_o carry_v on_o the_o same_o and_o fifty_o pound_n of_o tobacco_n beside_o cask_n and_o salary_n the_o next_o year_n and_o that_o this_o be_v dispose_v to_o several_a undertaker_n at_o the_o rate_n of_o eight_o shilling_n per_fw-la cent._n for_o produce_v money_n as_o aforesaid_a and_o accomplish_v the_o end_n and_o purpose_v aforesaid_a in_o manner_n and_o form_n follow_v viz._n the_o fifty_o pound_n of_o tobacco_n to_o be_v levy_v this_o present_a year_n in_o the_o county_n of_o york_n new-kent_n gloucester_n and_o middlesex_n be_v pay_v to_o the_o several_a undertaker_n of_o those_o county_n at_o eight_o shilling_n per_fw-la cent_z raise_v how_o to_o be_v raise_v by_o the_o sheriff_n or_o collector_n of_o those_o respective_a county_n they_o pay_v double_a the_o money_n this_o present_a year_n that_o fifty_o pound_n of_o tobacco_n per_fw-la poll_n do_v amount_v to_o at_o eight_o shilling_n per_fw-la cent._n and_o to_o accept_v of_o their_o full_a compensation_n of_o their_o present_a disbursment_n fifty_o pound_n of_o tobacco_n per_fw-la poll._n of_o the_o same_o county_n aforesaid_a the_o next_o year_n and_o that_o the_o undertaker_n for_o the_o rest_n of_o the_o county_n in_o virginia_n pay_v no_o more_o money_n than_o fifty_o pound_n of_o tobacco_n do_v amount_v to_o at_o eight_o shilling_n per_fw-la cent._n this_o present_a year_n to_o be_v pay_v they_o by_o the_o sheriff_n or_o collector_n of_o those_o county_n aforesaid_a and_o the_o like_a sum_n of_o money_n next_o year_n upon_o payment_n make_v to_o they_o of_o fifty_o pound_n of_o tobacco_n per_fw-la poll._n and_o order_v they_o to_o be_v levy_v and_o that_o all_o sheriff_n and_o collector_n who_o have_v the_o charge_n of_o those_o payment_n to_o the_o undertaker_n be_v and_o be_v hereby_o strict_o require_v to_o cause_n payment_n to_o be_v make_v of_o the_o best_a tobacco_n and_o as_o convenient_a as_o may_v be_v provide_v always_o that_o if_o no_o undertaker_n do_v present_v themselves_o for_o any_o of_o those_o remain_a county_n that_o then_o the_o respective_a county-courts_a be_v hereby_o require_v and_o command_v to_o ship_n the_o tobacco_n within_o the_o county_n for_o england_n and_o consign_v it_o to_o sufficient_a merchant_n and_o to_o cause_v the_o neat_a produce_v of_o it_o to_o be_v pay_v unto_o mr._n secretary_n ludwel_n and_o colonel_n daniel_n park_n for_o the_o account_n of_o the_o grand_a assembly_n of_o virginia_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o money_n which_o shall_v be_v find_v due_a on_o the_o balance_n of_o the_o account_n of_o the_o two_o shilling_n per_fw-la hogshead_n be_v also_o remit_v into_o england_n to_o the_o order_n of_o the_o grand_a assembly_n as_o aforesaid_a and_o whereas_o this_o grand_a assembly_n be_v also_o sensible_a by_o the_o lowness_n of_o the_o public_a revenue_n that_o money_n may_v yet_o be_v want_v for_o the_o advance_v and_o carry_v on_o this_o most_o necessary_a work_n be_v it_o also_o further_o enact_v by_o this_o grand_a assembly_n and_o the_o authority_n thereof_o that_o seventy_o pound_n of_o tobacco_n per_fw-la cause_n in_o the_o general_a court_n and_o fifty_o pound_n of_o tobacco_n per_fw-la cause_n in_o the_o county-courts_a shall_v be_v amerce_v in_o the_o name_n of_o the_o penalty_n upon_o every_o person_n that_o shall_v be_v cast_v in_o any_o suit_n if_o in_o the_o county-court_n thirty_o pound_n of_o tobacco_n and_o in_o case_n of_o appeal_n double_a provide_v nevertheless_o that_o all_o cause_n of_o orphan_n be_v out_o of_o this_o clause_n of_o amercement_n utter_o excuse_v and_o foreprize_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o the_o county_n court_v give_v account_n of_o the_o say_a amercement_n also_o of_o all_o line_n arise_v on_o penal_a law_n at_o the_o raise_n of_o the_o levy_n when_o the_o court_n
without_o the_o cape_n of_o virginia_n into_o this_o colony_n either_o in_o boat_n sloop_n or_o other_o vessel_n whatsoever_o to_o be_v land_a on_o shore_n sell_v or_o ship_v off_o in_o any_o ship_n or_o other_o vessel_n ride_v in_o this_o colony_n except_o only_o by_o such_o person_n as_o shall_v make_v it_o appear_v that_o they_o be_v inhabitant_n of_o lower-norfolk-county_n and_o that_o the_o to_o be_v equal_o divide_v between_o the_o informer_n and_o the_o country_n provide_v always_o that_o it_o shall_v be_v lawful_a for_o any_o merchant_n or_o other_o person_n inhabit_v in_o this_o country_n to_o fetch_v from_o carolina_n common_o call_v the_o south_n and_o bring_v hither_o all_o such_o tobacco_n as_o be_v already_o due_a to_o he_o before_o the_o make_v this_o law_n provide_v also_o that_o such_o merchant_n or_o other_o inhabitant_n of_o this_o country_n as_o shall_v pretend_v to_o have_v tobaccoes_n due_a there_o and_o expect_v liberty_n of_o import_v the_o same_o into_o this_o country_n do_v within_o three_o month_n next_o after_o the_o publication_n of_o this_o act_n repair_v to_o the_o court_n in_o the_o county_n where_o he_o live_v and_o there_o make_v oath_n upon_o the_o holy_a evangelist_n what_o sum_n of_o tobacco_n be_v due_a to_o he_o there_o and_o that_o the_o same_o be_v due_a to_o he_o before_o the_o publication_n of_o this_o act_n and_o cause_v the_o same_o to_o be_v enter_v upon_o record_n and_o further_o that_o such_o merchant_n or_o other_o person_n reside_v in_o this_o country_n and_o have_v tobacco_n due_a to_o he_o in_o carolina_n and_o claim_v the_o benefit_n of_o this_o law_n to_o import_v the_o same_o into_o this_o colony_n shall_v and_o do_v immediate_o and_o before_o he_o shall_v unload_v the_o same_o either_o out_o of_o boat_n sloop_n or_o other_o vessel_n bring_v the_o same_o into_o this_o country_n repair_v to_o the_o next_o or_o near_a collector_n of_o the_o impost_n of_o two_o shilling_n per_fw-la hogshead_n shall_v for_o his_o encouragement_n be_v exempt_v from_o pay_v any_o levy_n either_o for_o himself_o or_o servant_n for_o the_o term_n of_o three_o year_n except_o it_o be_v for_o the_o minister_n due_n and_o church_n duty_n provide_v always_o that_o if_o any_o person_n claim_v the_o benefit_n of_o this_o act_n shall_v direct_o or_o indirect_o at_o home_o or_o abroad_o plant_n or_o tend_v or_o cause_n to_o be_v plant_v or_o tend_v any_o tobacco_n contrary_a to_o the_o intent_n of_o this_o act_n or_o hire_v out_o his_o servant_n or_o servant_n to_o other_o to_o plant_v or_o tend_v tobacco_n he_o shall_v be_v censuer_v to_o pay_v double_a levy_n for_o himself_o and_o all_o his_o tythable_n to_o the_o use_n of_o the_o county_n lvii_o councillor_n to_o raise_v a_o levy_n whereas_o the_o on_o the_o sabbath-day_n whereas_o it_o have_v be_v the_o frequent_a practice_n of_o sheriff_n and_o their_o officer_n for_o their_o own_o ease_n and_o benefit_n to_o repair_v to_o the_o church_n
