give_v relief_n to_o a_o soldier_n or_o mariner_n as_o aforesaid_a the_o justice_n of_o the_o peace_n may_v fine_v he_o for_o the_o same_o according_a to_o their_o discretion_n and_o if_o any_o such_o officer_n his_o executor_n or_o administrator_n shall_v not_o give_v up_o his_o account_n within_o the_o time_n aforesaid_a or_o shall_v be_v otherwise_o negligent_a in_o the_o execution_n of_o his_o office_n the_o justice_n of_o the_o peace_n at_o the_o session_n may_v assess_v such_o fine_a upon_o he_o his_o executor_n or_o administrator_n as_o they_o think_v fit_a so_o it_o be_v not_o under_o allow_v they_o again_o upon_o their_o account_n fifteenth_o where_o a_o offender_n that_o be_v gaol_n to_o carry_v a_o prisoner_n to_o gaol_n commit_v to_o prison_n have_v not_o good_n sufficient_a all_o offence_n that_o be_v do_v within_o their_o parish_n against_o the_o statute_n make_v for_o the_o suppress_n of_o drunkenness_n and_o other_o disorder_n of_o alehouse_n 3._o they_o be_v to_o join_v with_o the_o constable_n in_o present_v of_o popish_a recusant_n chap._n xii_o of_o the_o overseer_n of_o the_o poor_a and_o their_o office_n the_o overseer_n of_o the_o poor_a numb_a 1_o be_v the_o parish_n it_o must_v be_v consider_v what_o will_v he_o may_v sell_v and_o what_o benefit_n he_o may_v make_v thereof_o yearly_a to_o the_o world_n end_n and_o according_a to_o the_o same_o the_o rate_n must_v be_v make_v and_o for_o coal-mine_n it_o must_v be_v consider_v what_o benefit_n a_o man_n do_v make_v by_o they_o and_o according_a to_o the_o same_o he_o must_v be_v rate_v 10._o parson_n vicar_n and_o such_o like_a person_n as_o inhabitant_n within_o the_o intent_n of_o this_o statute_n be_v to_o be_v rate_v towards_o the_o relief_n of_o the_o poor_a as_o well_o as_o other_o man_n and_o so_o have_v it_o be_v resolve_v of_o late_a by_o the_o judge_n 11._o any_o man_n that_o dwell_v within_o the_o parish_n albeit_o he_o have_v no_o land_n within_o the_o parish_n may_v be_v rate_v towards_o the_o relief_n of_o the_o poor_a of_o the_o parish_n and_o so_o have_v it_o be_v also_o resolve_v by_o the_o judge_n 12._o in_o some_o case_n a_o man_n may_v be_v tax_v for_o his_o good_n as_o well_o as_o for_o his_o land_n and_o in_o case_n of_o a_o rate_n for_o the_o poor_a man_n may_v be_v tax_v for_o their_o visible_a estate_n of_o good_n viz._n their_o ox_n kine_n sheep_n etc._n etc._n as_o well_o as_o for_o their_o land_n and_o not_o only_o for_o those_o good_n that_o be_v within_o the_o same_o parish_n where_o a_o man_n do_v dwell_v but_o also_o for_o those_o good_n which_o he_o have_v in_o any_o other_o place_n for_o a_o man_n shall_v not_o be_v rate_v for_o his_o good_n in_o any_o place_n but_o in_o the_o place_n where_o he_o do_v dwell_v nay_o it_o be_v hold_v in_o this_o case_n of_o rate_v for_o the_o poor_a some_o respect_n may_v be_v have_v to_o man_n invisible_a estate_n of_o money_n for_o the_o case_n may_v be_v so_o that_o the_o rater_n may_v know_v a_o man_n within_o the_o parish_n that_o have_v no_o other_o estate_n and_o yet_o perhaps_o have_v a_o annuity_n of_o one_o hundred_o pound_n by_o the_o year_n or_o have_v hundred_o of_o thousand_o of_o pound_n of_o money_n owe_v to_o he_o and_o in_o such_o a_o clear_a and_o certain_a case_n they_o may_v no_o doubt_n rate_v he_o according_a to_o that_o value_n 13._o in_o some_o special_a case_n a_o man_n may_v be_v rate_v beyond_o his_o ability_n for_o if_o a_o parishioner_n for_o his_o own_o gain_n or_o otherwise_o shall_v bring_v into_o the_o parish_n without_o the_o consent_n thereof_o a_o stranger_n who_o be_v or_o be_v apparent_o like_a to_o be_v burdensome_a to_o the_o parish_n in_o this_o case_n the_o parishioner_n because_o they_o have_v no_o other_o remedy_n against_o he_o may_v rate_v he_o not_o only_o according_a to_o his_o ability_n of_o land_n and_o good_n but_o according_a to_o the_o damage_n he_o bring_v or_o be_v like_a to_o bring_v to_o the_o parish_n by_o his_o folly_n for_o if_o any_o person_n shall_v find_v himself_o grieve_v with_o any_o such_o rate_n to_o the_o poor_a or_o other_o such_o like_a act_n do_v by_o the_o overseer_n of_o the_o poor_a or_o the_o justice_n of_o the_o peace_n he_o have_v no_o other_o remedy_n but_o to_o complain_v to_o the_o justice_n of_o the_o peace_n at_o the_o quarter_n session_n where_o the_o case_n appear_v to_o be_v as_o aforesaid_a he_o shall_v have_v a_o little_a relief_n 14._o if_o any_o man_n refuse_v to_o pay_v his_o rate_n for_o the_o poor_a the_o present_a or_o subsequent_a overseer_n of_o the_o poor_a shall_v have_v a_o warrant_n from_o the_o justice_n of_o the_o peace_n to_o levy_v the_o same_o of_o the_o party_n good_n and_o thereupon_o they_o may_v and_o must_v sell_v the_o party_n good_n and_o pay_v themselves_o their_o rate_n and_o give_v the_o party_n the_o overplus_n of_o the_o money_n if_o there_o be_v any_o and_o if_o he_o have_v no_o good_n then_o to_o carry_v he_o to_o gaol_n there_o to_o abide_v until_o he_o do_v pay_v it_o it_o seem_v to_o i_o that_o for_o relief_n of_o the_o poor_a that_o they_o have_v not_o place_n for_o in_o case_n of_o necessity_n that_o they_o may_v rate_v the_o parish_n to_o build_v a_o house_n and_o to_o buy_v a_o piece_n of_o ground_n in_o some_o of_o the_o parishioner_n name_n to_o set_v it_o upon_o for_o it_o be_v in_o their_o discretion_n which_o way_n to_o provide_v and_o if_o they_o overrate_v any_o man_n to_o these_o end_n they_o can_v be_v sue_v by_o the_o party_n grieve_v but_o if_o there_o be_v any_o conspiracy_n in_o the_o case_n to_o oppress_v a_o man_n or_o he_o be_v rate_v to_o pay_v debt_n or_o for_o alimonie_n or_o for_o any_o other_o purpose_n by_o these_o officer_n a_o action_n will_v lie_v against_o they_o these_o officer_n with_o the_o churchwarden_n the_o parson_n or_o vicar_n and_o the_o constable_n of_o the_o place_n or_o the_o most_o part_n of_o they_o where_o any_o money_n be_v or_o shall_v be_v give_v to_o be_v continual_o employ_v for_o the_o bind_v out_o as_o apprentice_n the_o poor_a sort_n of_o child_n shall_v within_o the_o same_o place_n have_v the_o nomination_n and_o place_n of_o such_o apprentice_n and_o the_o guide_n and_o employment_n of_o such_o money_n as_o have_v be_v heretofore_o so_o give_v or_o which_o hereafter_o shall_v be_v so_o give_v to_o and_o for_o the_o continual_a bind_v forth_o of_o such_o and_o so_o many_o apprentice_n and_o in_o such_o sort_n as_o be_v already_o or_o shall_v hereafter_o be_v so_o give_v and_o appoint_v either_o by_o the_o last_o will_n or_o any_o write_n under_o the_o hand_n and_o seal_n of_o the_o giver_n of_o such_o money_n and_o if_o any_o of_o they_o wilful_o forbear_v or_o refuse_v according_a to_o their_o duty_n to_o employ_v such_o money_n by_o mean_n whereof_o the_o say_a money_n shall_v not_o be_v employ_v according_o than_o every_o of_o they_o so_o offend_v shall_v forfeit_v three_o pound_n for_o every_o such_o offence_n and_o the_o master_n mistress_z or_o dame_n of_o such_o apprentice_n shall_v be_v bind_v with_o one_o or_o two_o sufficient_a surety_n in_o double_a the_o sum_n they_o have_v receive_v with_o such_o apprentice_n to_o such_o person_n as_o aforesaid_a appoint_v to_o dispose_v the_o same_o money_n to_o repay_v the_o money_n so_o receive_v at_o seven_o year_n end_n or_o within_o three_o month_n next_o after_o the_o same_o seven_o year_n end_v and_o if_o the_o apprentice_n master_n etc._n etc._n happen_v to_o die_v within_o the_o say_v seven_o year_n then_o within_o one_o year_n next_o after_o such_o death_n and_o these_o officer_n and_o the_o rest_n ought_v to_o put_v forth_o and_o employ_v such_o money_n within_o three_o month_n at_o the_o further_a after_o the_o same_o shall_v come_v to_o their_o hand_n and_o if_o there_o shall_v not_o be_v find_v fit_a person_n to_o be_v bind_v out_o apprentice_n in_o the_o town_n and_o parish_n where_o such_o money_n be_v or_o shall_v be_v give_v to_o be_v employ_v as_o aforesaid_a the_o poor_a child_n of_o any_o of_o the_o parish_n next_o adjoin_v may_v by_o the_o discretion_n of_o the_o say_a parson_n vicar_n etc._n etc._n be_v bind_v apprentice_n take_v such_o bond_n as_o be_v before_o mention_v and_o choice_n must_v be_v always_o make_v of_o the_o poor_a sort_n of_o child_n and_o that_o no_o apprentice_n be_v above_o fifteen_o year_n old_a when_o he_o shall_v be_v first_o bind_v and_o the_o say_a parson_n vicar_n etc._n etc._n be_v once_o every_o year_n in_o easter_n week_n or_o within_o a_o month_n after_o easter_n day_n to_o be_v accountable_a before_o four_o three_o or_o two_o justice_n of_o the_o peace_n dwell_v in_o or_o next_o the_o say_v town_n or_o parish_n for_o all_o such_o money_n as_o they_o have_v employ_v in_o bind_v of_o apprentice_n and_o of_o all_o bond_n and_o obligation_n take_v for_o payment_n thereof_o and_o of_o the_o money_n remain_v in_o their_o hand_n and_o be_v at_o such_o account_n or_o within_o ten_o day_n after_o to_o deliver_v to_o their_o successor_n or_o to_o such_o as_o have_v be_v in_o their_o time_n or_o place_n all_o the_o say_a bond_n and_o obligation_n and_o such_o money_n as_o remain_v in_o their_o hand_n not_o then_o employ_v they_o must_v be_v require_v by_o the_o justice_n 8._o numb_a 8._o of_o peace_n attend_v they_o and_o with_o the_o churchwarden_n presentment_n in_o make_v presentment_n give_v they_o a_o account_n of_o these_o thing_n what_o stock_n of_o money_n be_v in_o their_o parish_n by_o rate_n or_o otherwise_o what_o apprentice_n they_o have_v place_v and_o what_o they_o have_v do_v in_o all_o the_o rest_n of_o their_o office_n these_o officer_n and_o the_o
churchwarden_n be_v to_o meet_v monthly_o in_o the_o church_n on_o sunday_n after_o evening_n prayer_n except_o they_o be_v let_v by_o sickness_n or_o other_o cause_n to_o be_v allow_v a_o good_a excuse_n by_o two_o justice_n of_o the_o peace_n to_o consider_v of_o all_o these_o thing_n they_o be_v always_o within_o four_o day_n after_o the_o end_n of_o their_o year_n and_o after_o other_o overseer_n name_v and_o allow_v by_o the_o justice_n to_o give_v up_o to_o any_o two_o such_o justice_n of_o the_o peace_n as_o aforesaid_a a_o true_a and_o perfect_a account_n 1._o of_o all_o sum_n of_o money_n by_o they_o receive_v or_o rate_v and_o not_o receive_v 2._o of_o all_o such_o stock_n of_o ware_n or_o stuff_v as_o they_o or_o any_o of_o their_o poor_a have_v in_o their_o hand_n 3._o what_o apprentice_n they_o have_v put_v out_o 4._o what_o poor_a they_o have_v set_v on_o work_n or_o relieve_v 5._o whether_o they_o have_v suffer_v any_o of_o their_o poor_a to_o wander_v and_o beg_v out_o of_o their_o town_n or_o in_o the_o highway_n or_o in_o their_o town_n without_o their_o direction_n 6._o whether_o they_o have_v not_o monthly_o meet_v to_o consider_v of_o these_o thing_n 7._o whether_o they_o have_v assess_v the_o inhabitant_n and_o occupier_n of_o land_n etc._n etc._n in_o their_o parish_n viz._n all_o such_o as_o be_v of_o ability_n and_o with_o indifferency_n 8._o whether_o they_o have_v endeavour_v to_o levy_v and_o gather_v such_o assessment_n 9_o whether_o they_o have_v be_v any_o way_n negligent_a in_o their_o office_n in_o execute_v the_o justice_n warrant_n about_o any_o thing_n touch_v their_o office_n and_o if_o any_o churchwarden_n or_o overseer_n shall_v refuse_v to_o give_v up_o his_o account_n as_o aforesaid_a and_o to_o pay_v over_o the_o arrearage_n due_a if_o any_o be_v upon_o the_o same_o account_n unto_o his_o successor_n he_o may_v be_v commit_v to_o the_o gaol_n by_o two_o justice_n of_o the_o peace_n until_o he_o do_v account_n and_o pay_v over_o the_o same_o money_n and_o if_o any_o of_o these_o officer_n shall_v offend_v in_o any_o other_o of_o the_o particular_n aforesaid_a he_o shall_v forfeit_v for_o every_o default_n twenty_o shilling_n all_o these_o forfeiture_n be_v to_o go_v to_o the_o use_n of_o the_o poor_a of_o the_o parish_n and_o may_v be_v levy_v as_o follow_v viz._n the_o money_n forfeit_v by_o the_o father_n grandfather_n etc._n etc._n of_o any_o poor_a person_n tax_v by_o the_o justice_n towards_o the_o maintenance_n of_o such_o poor_a person_n that_o will_v not_o pay_v that_o rate_n may_v be_v levy_v of_o the_o offender_n good_n upon_o a_o warrant_n from_o two_o or_o more_o justice_n of_o peace_n as_o aforesaid_a by_o sale_n of_o the_o same_o good_n render_v to_o the_o party_n the_o overplus_n of_o the_o money_n and_o if_o there_o be_v no_o distress_n to_o be_v have_v the_o justice_n of_o peace_n may_v commit_v the_o offender_n to_o prison_n there_o to_o remain_v without_o bail_n until_o the_o forfeiture_n be_v pay_v the_o money_n forfeit_v by_o the_o churchwarden_n or_o overseer_n for_o not_o receive_v or_o take_v care_n to_o convey_v a_o rogue_n etc._n etc._n may_v be_v levy_v upon_o the_o offender_n good_n upon_o a_o warrant_n from_o two_o or_o more_o justice_n of_o the_o peace_n the_o money_n forfeit_v by_o the_o churchwarden_n and_o overseer_n for_o offend_v in_o any_o of_o the_o particular_n aforesaid_a may_v be_v levy_v by_o the_o subsequent_a churchwarden_n and_o overseer_n upon_o the_o offender_n good_n also_o in_o the_o same_o manner_n by_o a_o warrant_n from_o any_o two_o justice_n of_o the_o peace_n and_o if_o there_o be_v no_o such_o distress_n to_o be_v find_v the_o same_o justice_n may_v commit_v the_o same_o offender_n to_o gaâ—le_n until_o they_o do_v pay_v it_o and_o if_o any_o man_n shall_v in_o any_o wise_a disturb_v the_o execution_n of_o the_o statute_n of_o 30_o eliz._n 4._o he_o shall_v forfeit_v five_o pound_n and_o be_v bind_v to_o the_o good-behaviour_n by_o any_o two_o justice_n of_o the_o peace_n we_o have_v do_v with_o the_o office_n of_o these_o officer_n so_o far_o as_o it_o concern_v the_o poor_a now_o we_o come_v to_o that_o wherein_o their_o office_n lie_v about_o other_o matter_n the_o which_o be_v give_v they_o also_o by_o certain_a act_n of_o parliament_n and_o lie_v in_o these_o particular_n follow_v for_o the_o better_a understanding_n of_o the_o law_n numb_a 9_o herein_o these_o thing_n aâ—e_v to_o be_v know_v day_n against_o such_o a_o profane_a the_o lord_n day_n
