to_o mr._n attorney_n general_n be_v make_v viz._n at_o the_o court_n at_o white-hall_n the_o 21th_o of_o september_n 1693._o present_v the_o qveen_n most_o excellent_a majesty_n in_o council_n upon_o read_v the_o annex_v petition_n of_o several_a inhabitant_n of_o the_o county_n of_o cornwall_n in_o behalf_n of_o themselves_o and_o other_o the_o inhabitant_n of_o the_o say_a county_n humble_o pray_v that_o the_o right_n and_o privilege_n grant_v by_o letter_n patent_n of_o king_n charles_n the_o first_o to_o the_o say_a inhabitant_n to_o have_v a_o free_a trade_n and_o commerce_n unto_o and_o from_o all_o port_n and_o place_n whatsoever_o in_o amity_n with_o the_o crown_n of_o this_o realm_n may_v be_v preserve_v to_o they_o in_o the_o intend_a charter_n grant_v the_o sole_a trade_n opinion_n thereupon_o richard_n colinge_v next_o council_n day_n mr._n attorney_n general_n give_v the_o follow_a report_n on_o the_o reference_n make_v to_o he_o on_o the_o cornish_a petition_n viz._n to_o the_o queen_n most_o excellent_a majesty_n may_v it_o please_v your_o majesty_n in_o humble_a obedience_n to_o your_o majesty_n order_n in_o council_n upon_o the_o petition_n of_o several_a inhabitant_n of_o the_o county_n of_o cornwall_n in_o behalf_n of_o themselves_o and_o other_o inhabitant_n of_o the_o say_a county_n hereunto_o annex_v i_o have_v in_o the_o presence_n of_o some_o of_o the_o petitioner_n and_o their_o counsel_n and_o some_o of_o the_o east_n india_n company_n and_o their_o counsel_n examine_v the_o petitioner_n allegation_n and_o do_v find_v that_o his_o late_a majesty_n king_n charles_n the_o first_o by_o his_o letter_n patent_n under_o the_o great_a seal_n of_o england_n bear_v date_n at_o oxford_n the_o 26_o day_n of_o january_n in_o the_o nineteenth_o year_n of_o his_o reign_n out_o of_o his_o princely_a contemplation_n of_o the_o many_o and_o extraordinary_a faithful_a service_n to_o his_o say_a majesty_n then_o of_o late_o perform_v by_o his_o county_n of_o cornwall_n and_o for_o their_o better_a encouragement_n to_o proceed_v in_o their_o duty_n and_o allegiance_n to_o his_o person_n and_o crown_n and_o for_o other_o consideration_n do_v for_o himself_o his_o heir_n and_o successor_n give_v and_o grant_v unto_o all_o and_o every_o the_o man_n and_o inhabitant_n liege_n subject_n of_o the_o kingdom_n of_o england_n within_o the_o say_a county_n of_o cornwall_n then_o be_v and_o then_o after_o to_o be_v that_o they_o and_o every_o of_o they_o by_o themselves_o or_o any_o of_o they_o their_o or_o any_o of_o their_o factor_n agent_n or_o servant_n liberty_n and_o freedom_n from_o time_n to_o time_n and_o at_o all_o time_n for_o ever_o afterward_o to_o trade_n traffic_n and_o commerce_n with_o their_o ship_n and_o vessel_n good_n and_o merchandize_n unto_o and_o from_o the_o hanse-town_n and_o all_o
port_n and_o place_n within_o the_o dominion_n of_o the_o king_n of_o denmark_n and_o great_a duke_n of_o muscovia_n and_o all_o port_n and_o place_n in_o the_o levant_n sea_n whilst_o they_o or_o any_o of_o they_o shall_v be_v in_o amity_n with_o his_o say_a majesty_n his_o heir_n and_o successor_n and_o unto_o all_o other_o port_n and_o place_n for_o the_o time_n be_v in_o amity_n with_o his_o say_a majesty_n his_o heir_n and_o successor_n whether_o the_o merchant_n of_o the_o east-land_n russia_n and_o turkia_n company_n of_o london_n and_o company_n of_o merchant-adventure_n of_o london_n or_o any_o of_o they_o do_v or_o may_v trade_n and_o unto_o and_o from_o all_o other_o port_n and_o place_n whatsoever_o beyond_o the_o sea_n for_o the_o time_n be_v in_o amity_n with_o his_o say_a late_a majesty_n his_o heir_n and_o successor_n whether_o any_o of_o the_o subject_n for_o the_o time_n be_v of_o his_o say_a majesty_n his_o heir_n or_o successor_n do_v or_o may_v trade_n in_o as_o full_a and_o ample_a manner_n as_o his_o late_a majesty_n can_v grant_v the_o same_o save_v his_o right_n to_o his_o custom_n and_o duty_n yield_v and_o pay_v therefore_o to_o his_o majesty_n his_o heir_n and_o successor_n the_o sum_n of_o four_o shilling_n to_o be_v pay_v to_o the_o sheriff_n of_o cornwall_n at_o all_o saint_n and_o his_o say_a majesty_n do_v thereby_o for_o himself_o his_o heir_n and_o successor_n promise_v and_o grant_v to_o the_o say_a man_n and_o inhabitant_n as_o well_o present_a as_o to_o come_v that_o if_o any_o doubt_n or_o question_n shall_v happen_v to_o arise_v touch_v the_o validity_n of_o that_o grant_v that_o then_o upon_o the_o petition_n of_o the_o say_a man_n and_o inhabitant_n or_o upon_o notice_n or_o certificate_n of_o their_o learned_a counsel_n touch_v any_o defect_n to_o be_v amend_v therein_o amend_v amend_v here_o the_o crown_n covenant_n to_o make_v this_o a_o grant_v valid_a in_o law_n in_o case_n of_o any_o defect_n therein_o his_o say_a late_a majesty_n his_o heir_n or_o successor_n will_v grant_v other_o letter_n patent_n unto_o the_o say_a man_n and_o inhabitant_n with_o such_o amendment_n explanation_n amplification_n and_o addition_n for_o supply_v the_o say_a defect_n as_o by_o their_o counsel_n shall_v be_v advise_v and_o think_v fit_a and_o which_o may_v tend_v to_o the_o confirmation_n of_o that_o present_a grant_n or_o to_o the_o perfection_n of_o his_o majesty_n intention_n any_o way_n appear_v with_o several_a non_fw-la obstante_fw-la be_v among_o which_o one_o be_v though_o the_o say_v man_n and_o inhabitant_n in_o construction_n of_o law_n be_v not_o repute_v a_o corporation_n or_o body-politick_a nor_o capable_a in_o law_n to_o have_v and_o hold_v the_o privilege_n thereby_o grant_v the_o petitioner_n produce_v a_o print_a paper_n date_v at_o sudeley-castle_n the_o 10_o of_o september_n 1643._o which_o be_v previous_a to_o the_o grant_v purport_v his_o say_a late_a majesty_n letter_n or_o order_n from_o king_n charles_n the_o second_o and_o to_o be_v countersign_v by_o mr._n secretary_n coventry_n and_o superscribe_v to_o the_o right_n honourable_a john_n earl_n of_o bath_n the_o lord_n mohun_n lord_n arundel_n of_o trerice_n and_o divers_a other_o eminent_a and_o considerable_a gentleman_n of_o that_o county_n date_v the_o 17_o of_o march_n 1673._o recite_v the_o former_a grant_n of_o king_n charles_n the_o first_o and_o command_v all_o governor_n of_o island_n castle_n fort_n etc._n etc._n captain_n officer_n agent_n factor_n merchant_n and_o all_o other_o his_o subject_n not_o to_o hinder_v or_o molest_v the_o inhabitant_n of_o cornwall_n their_o agent_n factor_n or_o servant_n in_o their_o trade_n or_o traffic_n nor_o to_o detain_v seize_v or_o prejudice_v their_o ship_n good_n or_o merchandise_n but_o in_o all_o respect_n to_o treat_v they_o as_o his_o majesty_n love_a subject_n ought_v to_o be_v they_o always_o produce_v the_o copy_n of_o the_o say_v former_a grant_n and_o of_o the_o letter_n attest_v under_o any_o five_o of_o the_o person_n hand_n to_o who_o that_o letter_n be_v subscribe_v command_v that_o no_o other_o person_n be_v permit_v to_o trade_n under_o pretence_n of_o that_o former_a grant_n but_o such_o only_a as_o be_v thereby_o design_v provide_v that_o if_o any_o of_o the_o company_n or_o corporation_n of_o merchant_n shall_v find_v themselves_o aggreive_v with_o or_o by_o reason_n of_o the_o say_v former_a grant_n they_o may_v try_v the_o validity_n thereof_o in_o any_o of_o his_o majesty_n court_n of_o england_n proper_a for_o the_o same_o the_o petitioner_n council_n insist_v that_o this_o be_v a_o good_a licence_n to_o all_o the_o inhabitant_n of_o cornwall_n then_o and_o in_o future_a time_n to_o trade_n to_o the_o place_n therein_o mention_v and_o that_o though_o the_o east-indies_n be_v not_o therein_o name_v yet_o that_o the_o inhabitant_n may_v trade_n thither_o as_o to_o a_o place_n in_o amity_n with_o the_o crown_n and_o desire_v that_o a_o proviso_n may_v be_v add_v to_o the_o charter_n prepare_v for_o the_o east-india_n company_n for_o save_v the_o inhabitant_n right_o to_o that_o trade_n by_o virtue_n of_o the_o say_a grant_n of_o king_n charles_n the_o first_o and_o that_o the_o say_a charter_n may_v not_o prejudice_v the_o same_o the_o council_n for_o the_o east-india_n company_n object_v against_o the_o validity_n of_o that_o grant_v of_o king_n charles_n the_o first_o as_o not_o make_v any_o corporation_n nor_o confer_v any_o right_n to_o trade_n in_o the_o east-indies_n that_o place_n not_o be_v name_v nor_o any_o league_n truce_n or_o amity_n be_v make_v out_o to_o be_v between_o the_o crown_n of_o england_n and_o the_o prince_n or_o governor_n of_o the_o place_n within_o the_o east-indies_n and_o assert_v that_o this_o grant_v of_o king_n charles_n the_o first_o be_v never_o put_v in_o execution_n and_o that_o if_o it_o be_v and_o continue_v a_o good_a grant_n in_o point_n of_o law_n it_o can_v nor_o will_v be_v prejudice_v by_o pass_v the_o charter_n now_o under_o consideration_n to_o the_o east-india_n company_n in_o my_o humble_a opinion_n the_o grant_n of_o king_n charles_n the_o first_o be_v of_o a_o unusual_a nature_n and_o by_o the_o non_fw-la obstante_fw-la in_o it_o it_o seem_v as_o if_o it_o do_v not_o nor_o be_v not_o intend_v to_o make_v a_o corporation_n and_o as_o this_o case_n be_v i_o humble_o conceive_v it_o do_v not_o make_v the_o inhabitant_n of_o cornwall_n a_o corporation_n though_o there_o be_v a_o yearly_a sum_n of_o four_o shilling_n reserve_v to_o the_o crown_n and_o to_o have_v it_o operate_v as_o a_o personal_a grant_n to_o each_o inhabitant_n present_a and_o to_o come_v be_v not_o pretend_v to_o be_v good_a and_o by_o the_o general_a word_n of_o it_o it_o seem_v to_o be_v a_o invasion_n upon_o the_o right_n of_o the_o former_a company_n therein_o mention_v which_o they_o hold_v by_o royal_a charter_n precede_v to_o it_o and_o in_o word_n confer_v a_o liberty_n to_o trade_n into_o russia_n against_o a_o act_n of_o parliament_n that_o establish_v that_o trade_n to_o the_o company_n exclusive_a to_o all_o other_o this_o grant_n be_v make_v when_o a_o former_a charter_n be_v in_o be_v to_o a_o east-india_n company_n which_o charter_n be_v afterward_o in_o the_o reign_n of_o king_n charles_n the_o second_o renew_v to_o that_o company_n and_o for_o aught_o i_o can_v perceive_v there_o be_v no_o pretence_n of_o exercise_n of_o the_o liberty_n confer_v by_o that_o grant_v since_o the_o make_n of_o it_o upon_o the_o whole_a matter_n i_o humble_o conceive_v that_o grant_v of_o king_n charles_n the_o first_o to_o the_o inhabitant_n of_o cornwall_n former_a cornwall_n cornwall_n admit_v it_o be_v noâ—_n good_a yet_o 〈◊〉_d crown_n hatâ—_n covenant_v to_o make_v it_o 〈◊〉_d good_a granâ—_n by_o any_o subsequent_a charâ—â—â—_n to_o supply_v 〈◊〉_d defect_n of_o tâ—â—_n former_a
