that_o land_n of_o the_o value_n of_o four_o hundred_o pound_n per_fw-la annum_fw-la to_o be_v take_v out_o of_o the_o forfeit_a estate_n of_o luke_n nettervill_n shall_v be_v settle_v part_n of_o which_o estate_n together_o with_o certain_a house_n in_o dublin_n be_v set_v out_o according_o and_o the_o relict_n and_o heir_n of_o sir_n simon_n harcourt_n thereof_o possess_v at_o the_o time_n of_o his_o majesty_n late_o gracious_a declaration_n and_o so_o still_o be_v which_o land_n and_o house_n together_o be_v as_o be_v allege_v still_o short_a of_o the_o value_n of_o four_o hundred_o pound_n per_fw-la annum_fw-la intend_v to_o be_v settle_v as_o aforesaid_a it_o be_v therefore_o explain_v and_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o sir_n philip_n harcourt_n knight_n son_n and_o heir_n of_o sir_n simon_n harcourt_n knight_n to_o hold_v and_o enjoy_v to_o he_o and_o his_o heir_n the_o house_n in_o the_o four_o court_n in_o dublin_n between_o two_o and_o five_o of_o the_o clock_n in_o the_o afternoon_n shall_v think_v fit_a and_o assess_v which_o say_v sum_n or_o sum_n so_o to_o be_v assess_v and_o raise_v shall_v not_o exceed_v two_o penny_n for_o every_o profitable_a acre_n which_o shall_v be_v by_o virtue_n of_o this_o act_n confirm_v unto_o they_o their_o heir_n and_o assign_n now_o in_o their_o possession_n or_o at_o any_o time_n hereafter_o shall_v be_v confirm_v upon_o they_o respective_o and_o shall_v be_v pay_v unto_o the_o receiver_n herein_o after_o mention_v and_o shall_v be_v dispose_v by_o they_o or_o any_o three_o or_o more_o of_o they_o for_o and_o towards_o the_o end_n aforesaid_a and_o not_o otherwise_o provide_v always_o that_o of_o the_o three_o there_o be_v always_o one_o of_o the_o peer_n and_o two_o of_o the_o commoner_n before_o specify_v and_o for_o default_n of_o payment_n of_o any_o sum_n or_o sum_n so_o assess_v it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o person_n aforesaid_a or_o any_o three_o or_o more_o of_o they_o or_o such_o other_o person_n or_o person_n as_o they_o shall_v direct_v and_o appoint_v to_o levy_v by_o distress_n and_o sale_n of_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n so_o make_v default_n double_v the_o sum_n that_o shall_v be_v upon_o he_o or_o they_o assess_v and_o in_o arrear_n render_v the_o overplus_n to_o the_o party_n distrain_v and_o whereas_o among_o several_a bill_n certify_v and_o transmit_v under_o the_o great_a seal_n of_o ireland_n unto_o his_o majesty_n in_o his_o high_a court_n of_o chancery_n in_o england_n by_o a_o certificate_n bear_v date_n at_o dublin_n the_o thirteen_o day_n of_o may_n in_o the_o sixteenth_o year_n of_o his_o majesty_n reign_n a_o bill_n be_v transmit_v entitle_v a_o act_n for_o settle_v of_o certain_a land_n of_o erasmus_n smith_n esq_n for_o charitable_a use_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o the_o land_n tenement_n and_o hereditament_n in_o the_o say_a bill_n mention_v and_o thereby_o intend_v to_o be_v dispose_v for_o charitable_a use_n and_o not_o already_o decree_v away_o by_o the_o commissioner_n for_o execution_n of_o the_o say_v former_a act_n shall_v be_v continue_v &_o apply_v unto_o and_o preserve_v entire_o for_o such_o pious_a and_o charitable_a use_n and_o that_o the_o commissioner_n for_o execution_n of_o this_o act_n shall_v not_o allot_v or_o distribute_v the_o say_a land_n or_o any_o part_n thereof_o or_o suffer_v the_o same_o to_o be_v allot_v or_o distribute_v to_o any_o adventurer_n or_o soldier_n in_o pursuance_n of_o this_o act_n and_o where_o any_o of_o the_o land_n set_v out_o by_o the_o say_v erasmus_n smith_n to_o pious_a or_o charitable_a use_n have_v be_v evict_v recover_v or_o charge_v by_o any_o decree_n which_o be_v confirm_v by_o this_o act_n the_o commissioner_n for_o execution_n of_o this_o act_n shall_v cause_v a_o patent_n unto_o sir_n john_n stephens_n and_o his_o heir_n as_o land_n conceal_v which_o grant_v nevertheless_o may_v at_o any_o time_n by_o the_o rule_n of_o the_o say_v former_a act_n have_v be_v revoke_v by_o his_o majesty_n if_o his_o majesty_n have_v not_o be_v please_v since_o the_o pass_n of_o the_o say_a act_n to_o release_v his_o power_n of_o revocation_n by_o reason_n whereof_o great_a suit_n and_o controversy_n be_v likely_a to_o arise_v between_o the_o say_v erasmus_n smith_n and_o the_o say_a sir_n john_n stephens_n and_o such_o as_o do_v or_o may_v hereafter_o claim_v under_o john_n stephens_n in_o and_o to_o the_o say_a land_n and_o tenement_n and_o if_o they_o shall_v find_v that_o the_o say_v erasmus_n smith_n or_o those_o under_o who_o he_o claim_v be_v on_o the_o seven_o of_o may_n one_o thousand_o six_o hundred_o fifty_o and_o nine_o seize_v or_o possess_v of_o all_o or_o any_o the_o say_a land_n as_o a_o adventurer_n or_o adventurer_n or_o as_o the_o heir_n or_o assignee_n of_o any_o adventurer_n than_o they_o shall_v forthwith_o restore_v the_o possession_n to_o the_o say_v erasmus_n smith_n to_o be_v hold_v by_o he_o and_o his_o heir_n and_o assign_n in_o like_a manner_n and_o proportion_n as_o other_o adventurer_n ought_v to_o enjoy_v their_o several_a and_o respective_a proportion_n according_a to_o this_o act_n in_o which_o case_n the_o say_v erasmus_n smith_n be_v hereby_o enable_v to_o sue_v for_o and_o recover_v the_o measne_n profit_n thereof_o receive_v but_o if_o they_o shall_v find_v the_o say_a land_n to_o have_v be_v hold_v by_o the_o say_v erasmus_n smith_n without_o any_o such_o title_n as_o aforesaid_a and_o that_o the_o same_o be_v conceal_v from_o his_o majesty_n at_o the_o time_n of_o the_o pass_n of_o the_o say_a letter_n patent_n than_o they_o shall_v adjudge_v the_o say_v land_n or_o so_o much_o thereof_o as_o they_o shall_v find_v to_o be_v so_o conceal_v to_o sir_n john_n stephens_n and_o his_o heir_n to_o be_v hold_v by_o he_o and_o his_o heir_n according_a to_o the_o tenor_n of_o his_o say_a letter_n patent_n and_o such_o judgement_n and_o decree_n as_o the_o say_a commissioner_n shall_v make_v touch_v the_o premise_n shall_v be_v and_o be_v hereby_o make_v conclude_v to_o the_o say_v erasmus_n smith_n and_o the_o say_a sir_n john_n stephens_n their_o heir_n and_o assign_n any_o thing_n in_o the_o say_a letter_n patent_n or_o in_o the_o say_v former_a act_n contain_v to_o the_o contrary_a notwithstanding_o and_o whereas_o william_n mountgomery_n of_o rosemound_n in_o the_o county_n of_o down_n esq_n do_v purchase_v of_o several_a person_n certain_a debenture_n which_o be_v due_a for_o service_n do_v in_o ireland_n since_o the_o five_o of_o june_n one_o thousand_o six_o hundred_o forty_o and_o nine_o and_o place_v the_o same_o in_o and_o upon_o the_o purchase_n of_o a_o part_n of_o his_o own_o estate_n call_v or_o know_v by_o the_o name_n of_o the_o manor_n of_o florida_n in_o the_o county_n aforesaid_a then_o set_v out_o or_o set_v a_o part_n by_o reason_n of_o or_o upon_o account_n of_o the_o say_v late_a rebellion_n or_o war_n since_o which_o time_n the_o say_a william_n mountgomery_n have_v by_o the_o commissioner_n for_o the_o execution_n of_o the_o say_v former_a act_n be_v declare_v &_o adjudge_v a_o innocent_a protestant_n and_o thereupon_o the_o say_a manor_n of_o florida_n together_o with_o the_o rest_n of_o the_o estate_n of_o the_o say_v william_n mountgomery_n have_v be_v decree_v unto_o he_o by_o reason_n whereof_o the_o debenture_n so_o purchase_v and_o place_v thereupon_o as_o aforesaid_a do_v remain_v whole_o unsatisfied_a be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n for_o execution_n of_o this_o act_n shall_v set_v out_o or_o cause_n to_o be_v set_v out_o unto_o the_o say_v william_n mountgomery_n so_o much_o forfeit_v land_n as_o may_v be_v sufficient_a to_o satisfy_v the_o say_a
