jan._n 19_o 83_o 4._o come_v and_o exhibit_v three_o several_a information_n one_o against_o young_a the_o other_o two_o against_o each_o of_o his_o surety_n matthew_n haviland_n and_o john_n fowler_n these_o information_n be_v in_o his_o majesty_n name_n and_o on_o his_o behalf_n prosecute_v but_o the_o bond_n be_v enter_v into_o to_o sir_n richard_n dutton_n and_o never_o by_o he_o assign_v to_o the_o king_n the_o information_n set_v forth_o that_o on_o september_n 18._o 1682._o young_a haviland_n and_o fowler_n become_v joint_o and_o several_o bind_v to_o the_o say_a sir_n richard_n dutton_n governor_n of_o barbadoes_n in_o a_o bond_n of_o 2000_o l._n penalty_n condition_v among_o other_o thing_n that_o young_a shall_v not_o carry_v off_o any_o person_n whatsoever_o white_a or_o black_a without_o a_o ticket_n from_o the_o say_a sir_n richard_n or_o his_o successor_n deputy_n or_o deputy_n that_o contrary_a to_o this_o bond_n letter_n note_v whatever_o cresset_n write_v be_v in_o kindness_n to_o sir_n richard_n and_o prove_v to_o be_v truth_n for_o the_o king_n and_o council_n have_v declare_v that_o judgement_n erroneous_a which_o hanson_n complain_v of_o and_o cresset_n write_v some_o of_o the_o lord_n be_v of_o opinion_n will_v be_v reverse_v when_o the_o cause_n come_v to_o hear_v therefore_o advise_v he_o to_o end_v the_o matter_n there_o which_o be_v all_o the_o letter_n young_a carrid_a off_o samuel_n hanson_n a_o planter_n and_o resident_n on_o the_o island_n without_o a_o ticket_n which_o hanson_n be_v then_o a_o prisoner_n for_o crime_n and_o misdemeanour_n commit_v against_o his_o majesty_n contain_v in_o a_o order_n of_o the_o governor_n and_o council_n make_v october_n 31._o 1682._o which_o order_n recite_v that_o hanson_n be_v commit_v some_o day_n before_o by_o warrant_n from_o sir_n richard_n for_o divulge_v the_o content_n of_o a_o letter_n send_v to_o he_o by_o john_n cresset_n of_o london_n solicitor_n in_o which_o sir_n richard_n be_v traduce_v and_o some_o lord_n of_o the_o king_n most_o honourable_a privy_a council_n unfit_o mention_v and_o expose_v to_o the_o malicious_a censure_n of_o the_o disaffect_v in_o before_o three_o of_o his_o majesty_n council_n to_o answer_v the_o same_o and_o other_o misdemeanour_n commit_v it_o also_o recite_v that_o hanson_n appear_v that_o day_n before_o the_o council_n and_o upon_o examination_n deny_v that_o he_o have_v see_v the_o letter_n so_o direct_v as_o aforesaid_a but_o confess_v he_o receive_v a_o copy_n thereof_o from_o one_o south_n his_o correspondent_a which_o copy_n he_o produce_v and_o upon_o examination_n be_v find_v a_o true_a copy_n the_o which_o he_o confess_v he_o have_v show_v or_o read_v to_o three_o person_n or_o suffer_v they_o to_o read_v it_o for_o which_o and_o other_o misdemeanour_n he_o have_v do_v to_o sir_n richard_n he_o be_v remand_v till_o he_o shall_v find_v surties_n as_o aforesaid_a and_o for_o the_o good_a hanson_n be_v become_v due_a to_o his_o majesty_n and_o pray_v a_o judgement_n for_o the_o same_o young_a haviland_n and_o fowler_n by_o council_n appear_v pray_v time_n to_o plead_v 4._o feb._n 2._o 83_o 4._o and_o have_v till_o the_o thursday_n follow_v give_v for_o that_o purpose_n they_o all_o three_o plead_v several_o 4._o feb._n 6._o 83_o 4._o they_o protest_v against_o the_o information_n add_v that_o the_o matter_n therein_o contain_v be_v not_o sufficient_o set_v forth_o and_o deny_v that_o they_o be_v guilty_a of_o any_o contempt_n against_o the_o king_n or_o breach_n of_o his_o law_n in_o manner_n and_o form_n as_o in_o the_o information_n be_v set_v forth_o but_o for_o further_a plea_n 1._o they_o say_v that_o upon_o the_o construction_n of_o the_o law_n it_o be_v evident_a that_o the_o intent_n of_o enter_v into_o such_o bond_n as_o aforesaid_a be_v only_o to_o secure_v the_o inhabitant_n of_o the_o island_n who_o shall_v have_v their_o debtor_n or_o slave_n carry_v richard_n do_v assign_v the_o say_a bond_n to_o the_o king_n 10._o they_o insist_v that_o the_o attorney_n general_n in_o his_o information_n have_v not_o cite_v the_o proper_a act_n whereby_o any_o officer_n be_v impower_v to_o take_v any_o such_o bond_n with_o such_o condition_n endorse_v as_o he_o pretend_v be_v forfeit_v to_o the_o king_n 11._o they_o aver_v that_o if_o the_o information_n shall_v be_v rule_v right_o to_o lie_v than_o judgmeet_n will_v be_v enter_v for_o 2000_o l._n and_o no_o relief_n against_o the_o entire_a penalty_n to_o be_v have_v though_o the_o damage_n design_v in_o suit_n by_o his_o majesty_n attorney_n general_n for_o bring_v hanson_n over_o without_o a_o ticket_n 4._o sir_n richard_z to_o answer_v the_o general_a article_n by_o the_o 30_o of_o that_o month._n sir_n richard_z have_v time_n give_v to_o answer_v till_o the_o 5_o december_n follow_v 5._o nou._n 30._o 83._o decemb._n 5._o he_o put_v in_o his_o answer_n full_a of_o scandalous_a reflection_n upon_o the_o say_v hanson_n on_o read_v whereof_o it_o be_v order_v that_o he_o shall_v be_v at_o liberty_n to_o proceed_v on_o his_o voyage_n to_o barbadoes_n notwithstanding_o the_o general_a article_n exhibit_v against_o he_o which_o article_n and_o answer_v thereto_o be_v refer_v to_o the_o lord_n committee_n aforesaid_a hanson_n by_o petition_n 83._o dec._n 19_o 83._o humble_o offer_v several_a reason_n against_o the_o severity_n of_o the_o order_n of_o the_o 23d_o november_n upon_o read_v whereof_o he_o have_v then_o again_o liberty_n give_v he_o till_o next_o council_n day_n to_o choose_v whither_o to_o proceed_v at_o law_n or_o abide_v the_o hear_n of_o that_o board_n but_o still_o upon_o the_o same_o term_n and_o under_o the_o same_o inconvenience_n as_o before_o viz._n to_o release_n sir_n richard_n and_o he_o to_o examine_v with_o such_o of_o the_o council_n as_o he_o shall_v think_v fit_a the_o witness_n on_o both_o side_n which_o order_n neither_o hanson_n or_o his_o council_n believe_v will_v have_v be_v make_v if_o his_o petition_n which_o be_v force_v to_o be_v long_o have_v be_v full_o read_v hanson_n put_v in_o his_o answer_n to_o the_o former_a order_n 83_o jan._n 9_o 83_o together_o with_o a_o reply_n to_o sir_n richard_n answer_n to_o the_o general_a article_n exhibit_v against_o he_o by_o which_o he_o well_o hope_v he_o have_v clear_o evince_v the_o say_a answer_n to_o be_v in_o all_o part_n of_o it_o which_o relate_v to_o himself_o not_o only_o scandalous_a but_o untrue_a in_o every_o particular_a thereof_o and_o as_o to_o all_o other_o matter_n very_o cunning_a and_o fallacious_a which_o do_v first_o he_o therein_o declare_v that_o as_o he_o ever_o be_v so_o he_o be_v still_o and_o ever_o shall_v be_v ready_a to_o subject_v may_v come_v before_o he_o without_o be_v prejudice_v by_o sir_n richard_n and_o his_o council_n their_o have_v the_o examination_n of_o his_o witness_n and_o declare_v he_o have_v no_o design_n to_o proceed_v at_o law_n when_o he_o first_o send_v to_o sir_n richard_n for_o a_o appearance_n till_o after_o the_o hear_n before_o his_o majesty_n his_o only_a intent_n therein_o be_v to_o have_v a_o appearance_n before_o his_o go_v over_o that_o so_o he_o may_v have_v proceed_v against_o he_o in_o his_o absence_n if_o upon_o such_o hear_n his_o majesty_n shall_v think_v fit_a to_o leave_v he_o to_o common_a law_n as_o he_o have_v do_v in_o the_o very_a same_o case_n with_o captain_n mingham_n who_o ship_n sir_n henry_n morgan_n have_v condemn_v and_o sell_v and_o imprison_v his_o person_n for_o appeal_n to_o this_o most_o honourable_a board_n from_o that_o sentence_n of_o condemnnation_n 2d_o that_o he_o have_v never_o choose_v to_o go_v to_o law_n when_o leave_v to_o his_o election_n if_o by_o the_o same_o order_n he_o have_v not_o be_v oblige_v to_o release_n sir_n richard_n immediate_o if_o he_o shall_v elect_v to_o abide_v the_o hear_n of_o that_o board_n and_o therefore_o offer_v as_o follow_v that_o so_o as_o his_o appeal_n may_v remain_v as_o they_o do_v upon_o the_o hear_n 9th_o october_n 83_o till_o the_o hear_n of_o the_o cause_n appoint_v in_o february_n then_o next_o follow_v and_o be_v then_o hear_v and_o all_o proceed_n relate_v to_o any_o of_o the_o matter_n therein_o contain_v in_o the_o mean_a time_n stay_v and_o no_o new_a evidence_n admit_v of_o in_o that_o first_o apeal_v which_o have_v be_v full_o hear_v that_o then_o and_o in_o such_o case_n he_o be_v still_o willing_a to_o wait_v the_o hear_v appoint_v and_o abide_v the_o determination_n thereof_o so_o as_o sir_n richard_z before_o his_o go_v to_o barbadoes_n will_v appoint_v a_o attorney_n to_o appear_v for_o he_o if_o his_o majesty_n in_o council_n shall_v think_v fit_a upon_o the_o hear_n to_o refer_v he_o to_o common_a law_n for_o recover_v his_o damage_n which_o offer_v hansons_n council_n advise_v he_o be_v as_o they_o conceive_v all_o that_o the_o order_n of_o council_n require_v or_o at_o least_o design_v nevertheless_o a_o order_n of_o council_n be_v past_a 83._o jan._n 9_o 83._o whereby_o the_o say_a offer_n be_v declare_v not_o satisfactory_a to_o that_o most_o honourable_a board_n and_o that_o they_o do_v not_o find_v any_o reason_n to_o alter_v what_o have_v be_v order_v relate_v to_o the_o say_a sir_n richard_n and_o hansons_n case_n therefore_o direct_v all_o former_a order_n to_o stand_v hanson_n perceive_v that_o nothing_o by_o he_o offer_v do_v prove_v satisfactory_a resolve_v if_o possible_a to_o treat_v with_o sir_n richard_n for_o a_o a_o jew_n nor_o any_o prejudice_n come_v to_o one_o bird_n who_o come_v into_o england_n and_o be_v examine_v as_o a_o witness_n against_o he_o in_o council_n to_o which_o proposition_n sir_n richard_n ready_o consent_v faithful_o promise_v in_o the_o presence_n of_o his_o say_a friend_n and_o relation_n to_o perform_v they_o all_o with_o this_o further_a assurance_n that_o he_o will_v john_n witham_n have_v make_v colonel_n edwin_n steed_n chief_a baron_n of_o his_o majesty_n court_n
in_o council_n to_o which_o he_o receive_v no_o other_o answer_n than_o that_o he_o have_v his_o appeal_n to_o his_o majesty_n if_o he_o find_v himself_o aggrieve_v and_o be_v there_o proper_o relieveable_a this_o do_v and_o hanson_n see_v no_o hope_n of_o relief_n he_o according_a to_o his_o promise_n set_v out_o eleven_o negro_n and_o send_v for_o the_o provost_z marshal_z to_o come_v and_o levy_v the_o fine_a who_o according_o come_v and_o attach_v appraise_v and_o sell_v they_o for_o 171_o l._n of_o which_o the_o fine_a and_o charge_n as_o he_o allege_v come_v to_o 162_o l._n 8_o s._n 8_o d._n the_o remainder_n he_o pay_v back_o in_o london_n in_o 1683._o and_o not_o before_o but_o detain_v 12_o l._n 8_o s._n 8._o for_o charge_n beside_o the_o 150_o l._n fine_a which_o be_v
