her_o trial_n or_o discharge_v in_o due_a course_n of_o law_n 5._o or_o in_o case_n of_o sudden_a fire_n or_o infection_n â—r_o other_o necessity_n 6._o and_o if_o any_o person_n or_o person_n act_n because_o relate_v to_o the_o same_o subject_a viz._n the_o free_n of_o the_o subject_a from_o causeless_a tedious_a and_o arbitrary_a imprisonment_n anno_fw-la tricesimo_fw-la primo_fw-la caroli_n secundi_fw-la regis_fw-la chap._n ii_o a_o act_n for_o the_o better_a secure_v the_o liberty_n of_o the_o subject_a and_o for_o prevention_n of_o imprisonment_n beyond_o sea_n common_o call_v the_o habeas_fw-la corpus_fw-la act._n i._o whereas_o great_a delay_n have_v be_v use_v by_o sheriff_n gaoler_n and_o other_o officer_n to_o who_o custody_n any_o of_o the_o king_n subject_n have_v be_v commit_v for_o criminal_a or_o suppose_a criminal_a matter_n in_o make_v return_v of_o writ_n of_o habeas_fw-la corpus_fw-la to_o they_o direct_v by_o stand_v out_o a_o alias_o and_o plury_n habeas_fw-la corpus_fw-la and_o sometime_o more_o and_o by_o other_o shift_n to_o avoid_v their_o yield_a obedience_n to_o such_o writ_n contrary_a to_o their_o duty_n and_o the_o know_a law_n of_o criminal_a matter_n 2_o be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n thereof_o that_o whensoever_o any_o person_n or_o person_n shall_v bring_v any_o habeas_fw-la corpus_fw-la direct_v unto_o any_o sheriff_n or_o sheriff_n goaler_n minister_n or_o other_o person_n whatsoever_o for_o any_o person_n in_o he_o or_o their_o custody_n and_o the_o say_a writ_n shall_v be_v serve_v upon_o the_o say_a officer_n or_o leave_v at_o the_o goal_n or_o prison_n with_o any_o of_o the_o under_o officer_n under_o keeper_n or_o deputy_n of_o the_o say_a officer_n or_o keeper_n that_o the_o say_a such_o person_n so_o wilful_o neglect_v shall_v not_o have_v any_o habeas_fw-la corpus_fw-la to_o be_v grant_v in_o vacation_n time_n in_o pursuance_n of_o this_o act._n v._o be_v it_o further_o write_v within_o the_o respective_a time_n aforesaid_a or_o upon_o demand_n make_v by_o the_o prisoner_n or_o person_n in_o his_o behalf_n shall_v resuse_v to_o deliver_v or_o within_o the_o space_n debt_n bill_n plaint_n or_o information_n wherein_o no_o essoign_n protection_n wager_n of_o law_n aid-prayer_n privilege_n injunction_n or_o order_n of_o restraint_n shall_v be_v in_o any_o wise_a or_o motion_n make_v by_o his_o council_n or_o other_o employ_v by_o he_o for_o that_o purpose_n unto_o the_o judge_n of_o the_o court_n of_o king's-bench_n or_o common-plea_n in_o open_a court_n to_o all_o court_n of_o like_a jurisdiction_n to_o be_v hereafter_o erect_v ordain_v constitute_v or_o appoint_v as_o aforesaid_a and_o to_o the_o warrant_n and_o direction_n of_o the_o council-board_n and_o to_o the_o commitment_n restraint_n and_o imprisonment_n of_o any_o person_n or_o person_n make_v command_v or_o award_v by_o the_o king_n majesty_n his_o heir_n or_o successor_n in_o their_o own_o person_n or_o by_o the_o lord_n and_o other_o of_o the_o privy-council_n and_o every_o one_o of_o they_o and_o last_o provide_v and_o be_v it_o enact_v that_o no_o person_n or_o person_n shall_v be_v sue_v implead_v molest_v or_o trouble_v for_o any_o offence_n against_o this_o present_a act_n unless_o the_o party_n suppose_v to_o have_v so_o offend_v shall_v be_v sue_v or_o implead_v for_o the_o same_o within_o two_o year_n at_o the_o most_o after_o such_o time_n wherein_o the_o say_a offence_n shall_v be_v commit_v the_o comment_n the_o court_n of_o star-chamber_n so_o call_v because_o hold_v in_o a_o chamber_n at_o westminster_n the_o roof_n of_o which_o
body_n of_o such_o person_n or_o person_n as_o shall_v be_v name_v in_o the_o say_v write_v or_o process_n into_o the_o say_a court_n of_o the_o king_n be_v beneh_n at_o the_o day_n of_o the_o officer_n to_o who_o the_o say_v second_o write_v of_o capias_fw-la shall_v be_v so_o direct_v shall_v serve_v and_o execute_v the_o say_a writ_n in_o such_o like_a manner_n and_o form_n as_o before_o and_o officer_n to_o who_o the_o execution_n of_o process_n there_o do_v appertain_v returnable_a before_o the_o justice_n there_o at_o their_o next_o session_n or_o court_n two_o month_n at_o the_o least_o after_o the_o testae_fw-la of_o every_o such_o process_n 3._o so_o always_o as_o in_o every_o degree_n they_o shall_v proceed_v in_o their_o session_n and_o court_n against_o the_o offender_n as_o the_o justice_n of_o the_o say_a court_n of_o king's-bench_n be_v limit_v by_o the_o tenor_n of_o this_o act_n in_o term-time_n to_o do_v and_o execute_v 12._o provide_v also_o and_o be_v it_o the_o ecclesiastical_a court_n or_o idolatry_n 3._o that_o then_o all_o and_o every_o pain_n and_o forfeiture_n limit_v against_o such_o person_n excommunicate_a by_o this_o statute_n by_o reason_n the_o due_a execution_n of_o the_o statute_n against_o jesuit_n seminary_n priest_n recusant_n the_o 2_o former_a word_n include_v the_o romish_a clergy_n the_o latter_a the_o laiety_n etc._n etc._n and_o begin_v thus_o for_o the_o better_a and_o more_o due_a execution_n of_o the_o statute_n heretofore_o make_v against_o who_o as_o well_v against_o jesuit_n seminary_n priest_n and_o other_o next_o after_o the_o end_n of_o this_o session_n of_o parliament_n by_o print_v write_v or_o express_a word_n or_o speech_n advise_o or_o purposely_o practice_v or_o go_v about_o to_o make_v or_o persuade_v any_o of_o her_o majesty_n subject_n or_o any_o other_o within_o her_o highness_n realm_n or_o dominion_n to_o deny_v withstand_v and_o impugn_v her_o majesty_n power_n and_o authority_n in_o case_n ecclesiastical_a unite_a and_o annex_v to_o the_o imperial_a crown_n of_o this_o realm_n or_o to_o that_o end_n or_o purpose_n shall_v advise_o or_o malicious_o move_v or_o persuade_v any_o other_o person_n whatsoever_o to_o forbear_v or_o abstain_v from_o come_v to_o church_n to_o hear_v divine_a service_n or_o to_o receive_v the_o communion_n according_a to_o her_o majesty_n law_n and_o statute_n aforesaid_a or_o to_o come_v to_o or_o be_v present_a at_o any_o unlawful_a assembly_n conventicle_n or_o meeting_n under_o colour_n or_o pretence_n of_o any_o exercise_n of_o religion_n contrary_a to_o her_o majesty_n law_n and_o statute_n or_o if_o any_o person_n or_o person_n which_o shall_v obstinate_o refuse_v to_o repair_v to_o some_o church_n by_o the_o space_n of_o one_o month_n to_o hear_v divine_a service_n as_o be_v aforesaid_a shall_v after_o the_o say_v forty_o day_n either_o of_o he_o or_o themselves_o or_o by_o the_o motion_n persuasion_n enticement_n or_o allurement_n of_o any_o other_o willing_o join_v in_o or_o be_v present_a at_o any_o such_o assembly_n conventicle_n or_o meet_v under_o colour_n or_o pretence_n of_o any_o such_o exercise_n of_o religion_n contrary_a to_o the_o law_n and_o statute_n of_o this_o realm_n as_o be_v aforesaid_a that_o then_o every_o such_o person_n so_o offend_v as_o aforesaid_a and_o be_v thereof_o lawful_o convict_v shall_v be_v commit_v to_o prison_n and_o there_o to_o remain_v without_o bail_n or_o mainprize_n until_o they_o shall_v conform_v and_o yield_v themselves_o to_o come_v to_o some_o church_n chapel_n or_o usual_a place_n of_o common-prayer_n and_o hear_v divine_a service_n etc._n etc._n then_o the_o act_n go_v on_o and_o provide_v that_o if_o the_o person_n do_v not_o conform_v within_o three_o month_n after_o conviction_n he_o shall_v abjure_v that_o be_v be_v banish_v and_o swear_v never_o to_o come_v back_o without_o leave_n and_o if_o he_o will_v not_o swear_v so_o than_o the_o same_o to_o be_v felony_n without_o benefit_n of_o clergy_n from_o which_o act_n these_o 3_o thing_n be_v observable_a 1._o that_o the_o same_o be_v whole_o intend_v against_o the_o puritan_n or_o sectary_n for_o the_o papist_n be_v express_o exempt_v by_o a_o particular_a clause_n sect._n 12._o in_o these_o word_n '_o provide_v that_o no_o popish_a recusant_n or_o feme_fw-fr covert_n shall_v be_v compel_v or_o bind_v to_o abjure_v by_o virtue_n of_o this_o act._n 2._o that_o q._n eliz._n and_o her_o wise_a parliament_n do_v not_o intend_v or_o take_v such_o protestant_a recusant_n to_o be_v within_o the_o meaning_n of_o or_o punishable_a by_o the_o other_o before_o mention_v statute_n against_o popish_a recusant_n for_o if_o they_o have_v so_o understand_v they_o may_v have_v punish_v they_o sufficient_o on_o those_o old_a law_n without_o give_v themselves_o the_o trouble_n of_o make_v this_o new_a law_n against_o they_o frustra_fw-la fit_a per_fw-la plura_fw-la quod_fw-la fieri_fw-la potest_fw-la per_fw-la pauciora_fw-la god_n and_o the_o law_n do_v nothing_o in_o vain_a 3._o if_o it_o be_v object_v that_o all_o those_o law_n as_o well_o as_o this_o aught_o to_o be_v construe_v to_o one_o
justice_n justices_z or_o chief_a magistrate_n respective_o be_v hereby_o impower_v and_o require_v to_o levy_v the_o same_o by_o warrant_n as_o aforesaid_a upon_o the_o good_n &_o chattel_n of_o any_o such_o person_n who_o shall_v be_v present_a at_o the_o same_o conventicle_n any_o thing_n in_o this_o or_o any_o other_o act._n law_n or_o statute_n to_o the_o contrary_a notwithstanding_o and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a 3._o and_o if_o such_o offender_n so_o convict_v as_o aforesaid_a shall_v at_o any_o time_n again_o commit_v the_o like_a offence_n or_o offence_n contrary_a to_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a than_o such_o offender_n so_o convict_v of_o such_o like_a offence_n or_o offence_n shall_v for_o every_o such_o offence_n incur_v the_o penalty_n of_o forty_o pound_n to_o be_v levy_v and_o dispose_v as_o aforesaid_a 4._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n that_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n meeting_n or_o unlawful_a assembly_n aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n yard_n or_o backside_n and_o be_v convict_v thereof_o in_o manner_n aforesaid_a shall_v forfeit_v the_o sum_n of_o 20_o l._n to_o be_v levy_v in_o manner_n aforesaid_a upon_o his_o or_o her_o good_n and_o chattel_n or_o in_o case_n of_o he_o or_o her_o poverty_n or_o inability_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o such_o person_n who_o shall_v be_v convict_v in_o manner_n abovesaid_a of_o be_v present_a at_o the_o same_o conventicle_n and_o the_o money_n so_o levy_v to_o be_v dispose_v of_o in_o manner_n aforesaid_a 5._o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n shall_v by_o any_o clause_n of_o this_o act_n be_v liable_a to_o pay_v above_o ten_o pound_n for_o any_o one_o meeting_n in_o regard_n of_o the_o poverty_n of_o any_o other_o person_n or_o person_n provide_v also_o and_o be_v it_o further_o enact_v that_o in_o all_o case_n of_o this_o act_n where_o the_o penalty_n or_o sum_n charge_v upon_o any_o offender_n exceed_v the_o sum_n of_o ten_o shilling_n and_o such_o offendor_n shall_v find_v himself_o aggrieve_v it_o shall_v and_o may_v be_v lawful_a for_o he_o within_o one_o week_n after_o the_o say_a penalty_n or_o money_n charge_v shall_v be_v pay_v or_o levy_v to_o appeal_v in_o write_v from_o the_o person_n or_o person_n convict_v to_o the_o judgement_n of_o the_o justice_n of_o the_o peace_n in_o the_o next_o quarter-session_n 2._o to_o who_o the_o justice_n or_o justice_n of_o peace_n chief_a magistrate_n or_o alderman_n that_o first_o convict_v such_o offendor_n shall_v return_v the_o money_n levy_v upon_o the_o appellant_n and_o shall_v certify_v under_o his_o and_o their_o hand_n and_o seal_n the_o evidence_n upon_o which_o the_o conviction_n past_a with_o the_o whole_a record_n thereof_o and_o the_o say_a appeal_n 3._o whereupon_o such_o offender_n may_v plead_v and_o make_v defence_n and_o have_v his_o trial_n by_o a_o jury_n thereupon_o 4._o and_o in_o case_n such_o appellant_n shall_v not_o prosecute_v with_o effect_n or_o if_o that_o upon_o such_o trial_n he_o shall_v not_o be_v acquit_v or_o judgement_n pass_v not_o for_o he_o upon_o his_o say_a appeal_n the_o say_a justice_n at_o the_o session_n shall_v give_v treble_a cost_n against_o such_o offender_n for_o his_o unjust_a appeal_n 5._o and_o no_o other_o court_n whatsoever_o shall_v intermeddle_v with_o any_o cause_n or_o cause_n of_o appeal_n upon_o this_o act_n but_o they_o shall_v be_v final_o determine_v in_o the_o quarter-session_n only_o 7._o provide_v always_o and_o be_v it_o further_o enact_v that_o upon_o the_o delivery_n of_o such_o appeal_n as_o aforesaid_a the_o person_n or_o person_n appellant_n shall_v enter_v before_o the_o person_n or_o person_n convict_v into_o a_o recognizance_n to_o prosecute_v the_o say_a appeal_n with_o effect_n 2._o which_o say_v recognizance_n the_o person_n or_o person_n convict_v be_v hereby_o impower_v to_o take_v and_o require_v to_o certify_v the_o same_o to_o the_o next_o quarter_n session_n 3._o and_o in_o case_n no_o such_o recognizance_n be_v enter_v into_o the_o say_a appeal_n to_o be_v null_n and_o void_a 8._o provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o 9_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justices_z of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tythingman_n by_o warrant_n from_o the_o say_a justice_n justices_z or_o chief_a magistrate_n respective_o shall_v and_o may_v with_o what_o aid_n force_v and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v of_o any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberty_n as_o without_o 2._o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act_n 3._o and_o that_o the_o lieutenant_n or_o deputy_n lieutenant_n or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o of_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n 10._o provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v then_o be_v resident_n shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy_n lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v 11._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n headborough_z tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precinct_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n headborough_z tything-man_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o aid_n of_o the_o constable_n headborough_z or_o tything-man_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o be_v thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o be_v levy_v upon_o his_o good_n and_o chattel_n and_o dispose_v in_o manner_n aforesaid_a 2._o and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o one_o
hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v lie_v 12._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidence_n 2._o and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o full_a treble_n cost_v 13._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o this_o act_n and_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o 2._o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n 3._o and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_n to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o 4._o which_o say_v justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o full_o as_o the_o say_v other_o justice_n of_o peace_n may_v have_v do_v in_o case_n he_o or_o they_o have_v be_v inhabitant_n in_o the_o place_n where_o the_o offence_n be_v commit_v 14._o provide_v also_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v 2._o and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o 15._o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liberty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberty_n thereof_o for_o the_o examine_v convict_v and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberty_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n 16._o provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o person_n offend_a and_o convict_a as_o aforesaid_a be_v a_o feme-covert_n cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o aforesaid_a incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o chattel_n of_o the_o husband_n of_o each_o feme-covert_n 17._o provide_v also_o that_o no_o peer_n of_o this_o realm_n shall_v be_v attach_v or_o imprison_v by_o virtue_n or_o force_n of_o this_o act_n any_o thing_n matter_n or_o clause_n therein_o to_o the_o contrary_a notwithstanding_o 18._o provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o invalidate_v or_o avoid_v his_o majesty_n supremacy_n in_o ecclesiastical_a affair_n 2._o but_o that_o his_o majesty_n and_o his_o heir_n and_o successor_n from_o time_n to_o time_n and_o at_o all_o time_n hereafter_o exercise_n and_o enjoy_v all_o power_n and_o authority_n in_o ecclesiastical_a affair_n as_o full_o and_o as_o ample_o as_o himself_o or_o any_o of_o his_o predecessor_n have_v or_o may_v have_v do_v the_o same_o any_o thing_n in_o this_o act_n notwithstanding_o note_n upon_o the_o forego_n act._n 1._o by_o the_o title_n preamble_n and_o scope_n of_o the_o act_n it_o appear_v that_o the_o same_o be_v intend_v for_o suppress_v seditious_a conventicle_n under_o pretence_n of_o religious_a worship_n that_o be_v where_o the_o conventicler_n meet_v together_o under_o a_o pretence_n of_o worship_n not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n but_o indeed_o to_o carry_v on_o ill_a design_n against_o the_o state_n 2._o if_o any_o such_o conventicle_n be_v the_o justices_z know_v it_o by_o the_o oath_n of_o two_o witness_n may_v make_v a_o record_n thereof_o and_o then_o the_o person_n so_o offend_v shall_v forfeit_v so_o as_o in_o the_o act_n you_o have_v hear_v 3._o it_o must_v appear_v upon_o oath_n before_o the_o justice_n or_o confession_n of_o the_o party_n 1._o that_o it_o be_v a_o seditious_a conventicle_n meet_v together_o to_o disturb_v the_o peace_n under_o pretence_n of_o religion_n 2._o that_o the_o worship_n there_o practise_v be_v not_o according_a to_o the_o liturgy_n and_o practice_n of_o the_o church_n of_o england_n so_o that_o the_o informer_n must_v be_v present_a the_o whole_a time_n of_o the_o meeting_n for_o if_o they_o only_o hear_v a_o man_n pray_v or_o preach_v that_o be_v not_o contrary_a to_o the_o practice_n of_o the_o church_n of_o england_n and_o how_o do_v it_o appear_v that_o they_o do_v not_o read_v the_o liturgy_n 3._o it_o must_v be_v prove_v that_o there_o be_v assemble_v five_o person_n or_o more_o beside_o the_o inhabitant_n in_o the_o house_n 4._o if_o a_o party_n be_v fine_v above_o ten_o shilling_n if_o he_o pay_v down_o the_o money_n or_o it_o be_v levy_v within_o one_o week_n after_o such_o payment_n or_o levy_n he_o may_v appeal_v from_o the_o justice_n convict_v to_o the_o next_o quarter-session_n where_o he_o shall_v have_v a_o trial_n by_o jury_n thereupon_o and_o undoubted_o if_o it_o do_v not_o appear_v to_o the_o say_a jury_n that_o it_o be_v a_o seditious_a meeting_n they_o ought_v to_o find_v for_o the_o appealer_n 5._o a_o general_n warrant_v from_o any_o justice_n or_o justice_n to_o constable_n to_o inquire_v after_o seize_v etc._n etc._n all_o conventicle_n in_o their_o precinct_n be_v not_o good_a it_o ought_v to_o particularize_v the_o house_n and_o place_n house_n and_o place_n where_o the_o conventicle_n be_v or_o conventicle_n be_v hold_v and_o then_o the_o constable_n ought_v forthwith_o to_o go_v and_o if_o he_o find_v it_o so_o to_o suppress_v it_o but_o otherwise_o the_o constable_n may_v be_v put_v to_o endless_a vexation_n in_o hunt_v after_o meeting_n to_o no_o purpose_n whereas_o the_o act_n enjoin_v he_o no_o such_o trouble_n and_o if_o you_o go_v once_o and_o find_v no_o conventicle_n you_o be_v not_o oblige_v to_o go_v a_o second_o time_n on_o the_o same_o warrant_n but_o aught_o to_o have_v a_o new_a one_o nor_o be_v the_o constable_n oblige_v to_o turn_v informer_n 6._o as_o to_o break_v open_a door_n you_o see_v the_o act_n direct_v that_o it_o may_v be_v do_v first_o only_a in_o a_o house_n where_o it_o be_v inform_v there_o be_v actual_o a_o conventicle_n as_o aforesaid_a that_o be_v upon_o the_o oath_n of_o two_o person_n 2._o the_o constable_n &c._n &c._n can_v do_v this_o without_o first_o there_o be_v a_o demand_n and_o denial_n to_o enter_v 3._o nor_o then_o neither_o
