they_o have_v promise_v either_o to_o other_o by_o join_v themselves_o in_o matrimony_n and_o that_o without_o sin_n which_o be_v a_o argument_n that_o the_o sinful_a obliquity_n be_v only_o in_o the_o act_n of_o promise_a which_o therefore_o they_o ought_v to_o repent_v of_o but_o do_v not_o cleave_v to_o the_o matter_n of_o the_o promise_n which_o therefore_o they_o ought_v not_o to_o do_v occasional_o arise_v betwixt_o husband_n and_o wife_n from_o this_o difference_n in_o religion_n as_o concern_v the_o entertainment_n of_o friend_n the_o choice_n of_o servant_n the_o education_n of_o child_n very_o considerable_a thing_n all_o beside_o sundry_a other_o perhaps_o of_o less_o moment_n yet_o such_o as_o be_v apt_a to_o breed_v discontent_n and_o jealousy_n and_o sometime_o break_v out_o into_o great_a distemper_n in_o the_o family_n such_o marriage_n therefore_o i_o shall_v utter_o dissuade_v especial_o in_o the_o nobility_n gentry_n and_o commonalty_n where_o there_o the_o performance_n of_o the_o say_a vow_n or_o promise_n be_v due_a as_o to_o give_v instance_n in_o a_o case_n not_o much_o unlike_a to_o this_o in_o question_n a_o wife_n estate_v upon_o her_o marriage_n in_o a_o jointure_n or_o annuity_n for_o her_o life_n of_o a_o 100_o l._n per_fw-la annum_fw-la make_v a_o promise_n in_o her_o husband_n life-time_n to_o one_o of_o her_o young_a brother_n that_o have_v but_o short_a mean_n to_o allow_v he_o thence_o forward_o out_o of_o the_o say_a estate_n 10_o l._n yearly_a towards_o his_o better_a maintenance_n this_o promise_n be_v void_a unless_o the_o husband_n consent_n because_o the_o performance_n thereof_o will_v prejudice_v he_o in_o that_o right_n which_o he_o have_v during_o his_o own_o life_n in_o the_o revenue_n of_o all_o the_o land_n and_o annuity_n estate_v upon_o the_o wife_n in_o reversion_n but_o if_o such_o a_o wife_n shall_v promise_v to_o her_o say_a brother_n to_o allow_v he_o the_o say_v yearly_a sum_n of_o 10_o l._n after_o the_o decease_n of_o her_o husband_n in_o case_n she_o survive_v he_o this_o promise_n be_v good_a though_o make_v by_o the_o wife_n in_o her_o husband_n life-time_n and_o without_o his_o consent_n because_o the_o husband_n right_a be_v to_o cease_v before_o the_o promise_n be_v to_o be_v perform_v can_v be_v prejudice_v by_o the_o performance_n thereof_o and_o this_o i_o find_v agreeable_a to_o the_o best_a casuist_n who_o peremptory_a opinion_n it_o be_v that_o alios_fw-la husband_n and_o master_n can_v disannul_v such_o vow_n as_o their_o wife_n and_o servant_n make_v concern_v thing_n to_o be_v perform_v at_o such_o time_n as_o they_o shall_v be_v from_o under_o their_o power_n which_o position_n if_o it_o be_v true_a and_o i_o yet_o see_v no_o reason_n why_o it_o shall_v not_o then_o doubtless_o this_o gentlewoman_n vow_n make_v to_o her_o friend_n though_o in_o the_o life-time_n and_o without_o the_o consent_n of_o her_o husband_n be_v not_o original_o void_a from_o the_o inability_n to_o make_v it_o upon_o this_o respect_n that_o she_o be_v not_o svi_fw-la juris_fw-la so_o to_o do_v point_n iii_o sect._n 8._o but_o though_o i_o dare_v not_o say_v this_o issue_n that_o they_o mutual_o vow_v either_o to_o other_o that_o if_o happy_o either_o of_o they_o shall_v at_o any_o time_n be_v free_v from_o the_o bond_n of_o matrimony_n either_o he_o by_o as_o we_o know_v be_v often_o do_v in_o solemn_a promise_n between_o man_n and_o man_n yet_o neither_o be_v that_o sufficient_a to_o make_v it_o proper_o a_o vow_n for_o to_o judge_n right_o when_o question_n be_v make_v concern_v any_o particular_a promise_n whether_o it_o be_v a_o vow_n yea_o or_o no_o we_o be_v not_o to_o be_v guide_v so_o much_o by_o the_o form_n of_o speech_n which_o be_v subject_a to_o change_v impropriety_n and_o many_o defect_n as_o by_o the_o true_a intention_n and_o purpose_n of_o the_o party_n especial_o the_o promiser_n now_o what_o be_v the_o whole_a intent_n and_o purpose_n of_o these_o party_n when_o they_o mutual_o bind_v themselves_o in_o such_o sort_n as_o in_o the_o case_n propound_v be_v lay_v down_o no_o reasonable_a man_n can_v be_v ignorant_a
