the_o authority_n of_o this_o present_a parliament_n that_o the_o say_a estatute_n of_o repeal_n force_n a_o repeal_n of_o the_o statute_n of_o 1_o m._n 2._o and_o the_o book_n of_o common_a prayer_n or_o appoint_v in_o or_o by_o the_o say_a book_n shall_v be_v void_a and_o of_o none_o effect_n from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v and_o that_o the_o say_a book_n with_o the_o order_n of_o service_n and_o of_o the_o administration_n of_o sacrament_n rite_n and_o ceremony_n with_o the_o alteration_n and_o addition_n therein_o add_v and_o appoint_v by_o this_o estatute_n shall_v stand_v and_o be_v from_o and_o after_o the_o say_a feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n in_o full_a force_n and_o effect_n realm_n of_o england_n wales_n and_o the_o march_n of_o the_o same_o or_o other_o the_o queen_n dominion_n shall_v from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v be_v bind_v to_o say_v and_o use_v the_o matin_n evensong_n celebration_n of_o the_o lord_n supper_n and_o administration_n of_o each_o of_o the_o sacrament_n and_o all_o the_o common_a and_o open_a prayer_n 6._o the_o alteration_n of_o the_o book_n set_v forth_o 5_o &_o 6_o ed._n 6._o in_o such_o order_n and_o form_n as_o be_v mention_v in_o the_o say_a book_n so_o authorize_v by_o parliament_n in_o the_o say_v five_o and_o six_o year_n of_o the_o reign_n of_o king_n edward_n the_o six_o with_o one_o alteration_n or_o addition_n of_o certain_a lesson_n to_o be_v use_v on_o every_o sunday_n in_o the_o year_n and_o the_o form_n of_o the_o litany_n alter_v and_o correct_v and_o two_o sentence_n only_o add_v in_o the_o delivery_n of_o the_o sacrament_n to_o the_o communicant_n and_o none_o other_o or_o otherwise_o prayer_n the_o forfeiture_n of_o those_o which_o use_v any_o other_o service_n than_o the_o book_n of_o common_a prayer_n and_o that_o if_o any_o manner_n of_o parson_n vicar_n or_o other_o whatsoever_o minister_n that_o ought_v or_o shall_v sing_v or_o say_v common_a prayer_n mention_v in_o the_o say_a book_n or_o minister_v the_o sacrament_n from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v refuse_v to_o use_v the_o say_v common_a prayer_n or_o to_o administer_v the_o sacrament_n in_o such_o cathedral_n or_o parish_n church_n or_o other_o place_n as_o he_o shall_v use_v to_o minister_v the_o same_o in_o such_o order_n and_o form_n as_o they_o be_v mention_v and_o set_v forth_o in_o the_o say_a book_n or_o shall_v wilful_o or_o obstinate_o stand_v in_o the_o same_o use_v any_o other_o rite_n ceremony_n order_n form_n or_o manner_n of_o celebrate_v the_o lord_n supper_n open_o or_o privy_o or_o matin_n evensong_n administration_n of_o the_o sacrament_n or_o other_o open_a prayer_n then_o be_v mention_v and_o set_v forth_o in_o the_o say_a book_n open_a prayer_n in_o and_o throughout_o this_o act_n be_v mean_v that_o prayer_n which_o be_v for_o other_o to_o come_v unto_o or_o hear_v either_o in_o common_a church_n prayer_n the_o penalty_n for_o deprave_v the_o book_n of_o common_a prayer_n or_o private_a chapel_n or_o oratory_n common_o call_v the_o service_n of_o the_o church_n or_o shall_v preach_v declare_v or_o speak_v any_o thing_n in_o the_o derogation_n or_o deprave_v of_o the_o say_a book_n or_o any_o thing_n therein_o contain_v or_o of_o any_o part_n thereof_o and_o shall_v be_v thereof_o lawful_o convict_v according_a to_o the_o law_n of_o this_o realm_n by_o verdict_n of_o twelve_o man_n or_o by_o his_o own_o confession_n or_o by_o the_o notorious_a evidence_n of_o the_o fact_n shall_v loose_v and_o forfeit_a to_o the_o queen_n highness_n land_n etc._n etc._n liable_a to_o such_o seizure_n or_o to_o the_o penalty_n aforesaid_a but_o it_o be_v grant_v on_o all_o hand_n that_o by_o these_o general_a word_n here_o the_o king_n have_v not_o any_o estate_n give_v he_o in_o the_o recusants_n copyhold_n land_n but_o only_o a_o right_n or_o title_n to_o two_o three_o of_o the_o profit_n by_o the_o king_n receive_v of_o which_o the_o lord_n can_v be_v impeach_v of_o his_o custom_n and_o service_n as_o he_o will_v be_v if_o the_o king_n shall_v seize_v the_o land_n itself_o and_o a_o difference_n be_v there_o take_v between_o a_o every_o such_o person_n so_o refuse_v to_o answer_n shall_v for_o his_o disobedience_n and_o contempt_n in_o that_o behalf_n be_v commit_v to_o prison_n by_o such_o as_o shall_v examine_v he_o as_o be_v aforesaid_a and_o thereupon_o shall_v remain_v and_o continue_v in_o prison_n without_o bail_n or_o mainprize_n until_o he_o shall_v make_v direct_a and_o true_a answer_n to_o the_o say_a question_n whereupon_o he_o shall_v be_v so_o examine_v suspicion_n cause_o of_o suspicion_n suspect_v although_o the_o party_n be_v no_o jesuit_n seminary_n or_o massing_n priest_n yet_o if_o there_o be_v cause_n to_o suspect_v he_o and_o he_o refuse_v to_o answer_v whether_o he_o be_v so_o or_o no_o such_o suspicion_n and_o refusal_n be_v ground_n enough_o for_o his_o commitment_n have_v lawful_a authority_n in_o that_o behalf_n this_o clause_n seem_v to_o refer_v to_o the_o statute_n of_o 27_o eliz._n cap._n 2._o 2._o stat._n 27_o eliz._n 2._o which_o appoint_v that_o the_o discovery_n of_o a_o popish_a priest_n or_o jesuit_n shall_v be_v make_v to_o some_o justice_n of_o peace_n or_o high_a officer_n who_o be_v to_o give_v information_n thereof_o to_o some_o of_o the_o privy_a council_n etc._n etc._n under_o the_o penalty_n of_o two_o hundred_o mark_n etc._n who_o shall_v examine_v a_o jesuit_n etc._n etc._n which_o statute_n of_o 27._o though_o it_o do_v not_o in_o express_a term_n say_v that_o the_o justice_n of_o peace_n or_o other_o high_a officer_n shall_v examine_v the_o priest_n or_o jesuit_n so_o discover_v yet_o inasmuch_o as_o it_o give_v he_o power_n to_o take_v cognizance_n of_o the_o matter_n it_o seem_v implicit_o to_o empower_v he_o to_o inform_v himself_o of_o the_o truth_n whether_o the_o party_n be_v a_o priest_n or_o jesuit_n or_o not_o as_o well_o by_o examination_n of_o the_o party_n as_o otherwise_o that_o he_o may_v be_v the_o better_o enable_v to_o give_v information_n thereof_o to_o some_o of_o the_o privy_a council_n etc._n etc._n and_o one_o justice_n of_o peace_n have_v by_o 27._o lawful_a authority_n to_o examine_v he_o he_o have_v authority_n likewise_o by_o this_o statute_n of_o 35._o to_o commit_v he_o he_o and_o commit_v he_o if_o he_o be_v suspect_v to_o be_v a_o priest_n or_o jesuit_n and_o refuse_v to_o answer_v whether_o he_o be_v such_o or_o no._n as_o for_o mr._n shepherd_n opinion_n in_o his_o sure_a guide_n cap._n 14._o sect._n 5._o that_o there_o must_v be_v two_o justice_n of_o peace_n to_o commit_v a_o man_n by_o force_n of_o this_o statute_n who_o be_v suspect_v to_o be_v a_o jesuit_n or_o priest_n till_o he_o answer_v direct_o i_o see_v no_o ground_n at_o all_o for_o it_o answer_v to_o the_o say_a question_n that_o be_v examine_v to_o what_o point_n he_o may_v be_v examine_v whether_o he_o be_v a_o jesuit_n seminary_n or_o massing_n priest_n for_o he_o be_v not_o bind_v to_o answer_v to_o any_o other_o question_n nor_o can_v be_v commit_v by_o force_n of_o this_o act_n for_o his_o refusal_n provide_v nevertheless_o 5._o stat._n sect._n 9_o licence_n to_o travel_v above_o five_o mile_n alt._n 3_o jac._n 5._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o person_n which_o be_v hereby_o limit_v and_o appoint_v to_o continue_v and_o abide_v within_o five_o mile_n of_o their_o usual_a dwell_a place_n or_o of_o such_o place_n where_o they_o be_v bear_v or_o where_o their_o father_n and_o mother_n shall_v be_v dwell_v as_o be_v aforesaid_a shall_v have_v necessary_a occasion_n or_o business_n to_o go_v and_o travel_v out_o of_o the_o compass_n of_o the_o say_v five_o mile_n that_o then_o and_o in_o every_o such_o case_n upon_o licence_n in_o that_o behalf_n to_o be_v get_v under_o the_o hand_n of_o two_o of_o the_o justice_n of_o peace_n of_o the_o same_o county_n with_o the_o privity_n and_o assent_n in_o write_v of_o the_o bishop_n of_o the_o diocese_n or_o of_o the_o lieutenant_n or_o of_o any_o deputy_n lieutenant_n of_o the_o same_o county_n under_o their_o hand_n it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o person_n to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n attend_v and_o return_v as_o shall_v be_v comprise_v in_o the_o same_o licence_n any_o thing_n before_o in_o this_o act_n to_o the_o contrary_a notwithstanding_o this_o clause_n be_v repeal_v 5._o repeal_n stat._n 3_o jac._n 5._o and_o a_o new_a form_n of_o licence_n appoint_v by_o the_o statute_n of_o 3_o jac._n cap._n 5._o which_o see_v there_o sect._n 8._o provide_v also_o appear_v stat._n sect._n 10._o person_n urge_v by_o process_n or_o command_v to_o appear_v that_o if_o any_o such_o person_n so_o restrain_v as_o be_v aforesaid_a shall_v be_v urge_v by_o process_n without_o fraud_n or_o covin_z or_o be_v bind_v without_o fraud_n or_o covin_z to_o make_v appearance_n in_o any_o her_o majesty_n court_n or_o shall_v be_v send_v for_o command_v or_o require_v by_o any_o three_o or_o more_o of_o her_o majesty_n privy_a council_n or_o by_o any_o four_o or_o more_o of_o any_o commissioner_n to_o be_v in_o that_o behalf_n nominate_v and_o assign_v by_o her_o majesty_n to_o make_v appearance_n before_o her_o majesty_n say_a counsel_n or_o commissioner_n that_o in_o every_o such_o case_n every_o such_o person_n so_o bind_v urge_v command_v or_o require_v to_o make_v such_o appearance_n shall_v not_o incur_v any_o pain_n forfeiture_n or_o loss_n for_o travel_v to_o make_v appearance_n according_o nor_o for_o his_o abode_n concern_v the_o same_o nor_o for_o convenient_a time_n for_o his_o return_n back_o again_o upon_o the_o same_o urge_v by_o process_n if_o a_o popish_a recusant_n restrain_v by_o this_o act_n be_v summon_v by_o warrant_n of_o a_o justice_n of_o peace_n to_o appear_v before_o he_o the_o recusant_n ought_v not_o to_o travel_v to_o such_o justice_n out_o of_o his_o compass_n of_o 5_o mile_n for_o although_o a_o justice_n of_o peace_n his_o warrant_n be_v the_o king_n process_n mean_v whaâ—_n process_n be_v here_o mean_v yet_o it_o be_v not_o intend_v here_o for_o these_o word_n urge_v by_o process_n be_v restrain_v by_o the_o subsequent_a word_n to_o such_o process_n as_o require_v the_o recusants_n appearance_n in_o some_o one_o of_o the_o king_n court_n and_o extend_v not_o to_o all_o case_n of_o summons_n and_o process_n as_o wingate_n tit_n crown_n numb_a 83._o mistake_n but_o if_o in_o the_o case_n aforesaid_a the_o warrant_n be_v to_o arrest_v the_o recusant_n and_o by_o force_n thereof_o he_o be_v carry_v by_o the_o constable_n etc._n etc._n out_o of_o the_o compass_n of_o five_o mile_n there_o he_o be_v excuse_v and_o shall_v forfeit_v nothing_o for_o that_o it_o be_v do_v by_o compulsion_n and_o yet_o if_o there_o be_v any_o covin_z between_o the_o recusant_n and_o the_o justice_n of_o peace_n or_o officer_n it_o may_v be_v otherwise_o court_n the_o king_n court_n in_o any_o her_o majesty_n court_n all_o court_n wherein_o the_o proceed_n be_v direct_v by_o the_o king_n law_n be_v the_o king_n court_n and_o therefore_o a_o court_n leet_n leet_n court_n leet_n though_o of_o a_o inferior_a nature_n and_o keep_v in_o the_o lord_n name_n yet_o be_v the_o king_n court_n co._n 5._o 39_o cawdry_n case_n hetley_n 18._o court_n ecclesiastical_a court_n if_o a_o popish_a recusant_n restrain_v by_o this_o act_n be_v cite_v into_o the_o ecclesiastical_a court_n he_o may_v by_o force_n of_o this_o proviso_n travel_v out_o of_o the_o compass_n of_o five_o mile_n to_o appear_v there_o for_o all_o ecclesiastical_a court_n be_v the_o king_n court_n and_o the_o law_n by_o which_o they_o proceed_v there_o be_v the_o king_n law_n vide_fw-la cawdry_n case_n render_v their_o body_n to_o the_o sheriff_n of_o the_o county_n where_o they_o shall_v happen_v to_o be_v upon_o proclamation_n in_o that_o behalf_n without_o fraud_n or_o covin_z to_o be_v make_v tenement_n annuity_n profit_n commodity_n hereditament_n good_n chattel_n debt_n duty_n legacy_n or_o sum_n of_o money_n within_o this_o realm_n of_o england_n or_o any_o other_o his_o majesty_n dominion_n and_o that_o all_o and_o singular_a estate_n term_n and_o other_o interest_n whatsoever_o hereafter_o to_o be_v make_v suffer_v or_o do_v to_o or_o for_o the_o use_n or_o behoof_n of_o any_o such_o person_n or_o person_n or_o upon_o any_o trust_n or_o confidence_n mediate_o or_o immediate_o to_o or_o for_o the_o benefit_n or_o relief_n of_o any_o such_o person_n or_o person_n shall_v be_v utter_o void_a and_o of_o none_o effect_v to_o all_o intent_n construction_n and_o purpose_n intend_v public_a college_n etc._n etc._n only_o here_o intend_v to_o any_o college_n etc._n etc._n this_o act_n extend_v only_o to_o public_a house_n or_o college_n but_o not_o to_o such_o as_o be_v breed_v beyond_o the_o sea_n in_o any_o private_a popish_a family_n and_o therefore_o the_o statute_n of_o 3_o car._n 1._o cap._n 2._o 2._o stat._n 3_o car._n 1._o 2._o be_v make_v to_o supply_v that_o defect_n return_v stat._n sect._n 6._o they_o who_o be_v in_o seminary_n etc._n etc._n shall_v return_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n bear_v within_o this_o realm_n or_o any_o the_o king_n majesty_n dominion_n be_v at_o this_o present_a in_o any_o college_n seminary_n house_n or_o place_n in_o any_o part_n beyond_o the_o sea_n to_o the_o end_n to_o be_v instruct_v or_o strengthen_v in_o the_o popish_a religion_n which_o shall_v not_o make_v return_n into_o this_o realm_n or_o some_o of_o his_o majesty_n dominion_n within_o one_o year_n next_o come_v after_o the_o end_n of_o this_o session_n of_o parliament_n and_o submit_v himself_o as_o be_v aforesaid_a shall_v be_v in_o respect_n of_o himself_o only_o and_o not_o to_o or_o in_o respect_n of_o any_o of_o his_o heir_n or_o posterity_n utter_o disable_v and_o uncapable_a to_o inherit_v have_v or_o enjoy_v any_o manor_n land_n tenement_n hereditament_n good_n chattel_n debt_n or_o other_o thing_n aforesaid_a within_o this_o realm_n or_o any_o other_o his_o majesty_n dominion_n conformable_a stat._n sect._n 7._o remedy_n for_o such_o as_o return_v into_o the_o realm_n and_o become_v conformable_a provide_v always_o that_o if_o any_o such_o person_n or_o child_n so_o pass_v send_v send_v or_o now_o be_v beyond_o the_o sea_n as_o aforesaid_a to_o such_o intent_n as_o be_v before_o mention_v shall_v after_o become_v conformable_a and_o obedient_a unto_o the_o law_n and_o ordinance_n of_o the_o church_n of_o england_n and_o shall_v repair_v to_o the_o church_n and_o there_o remain_v and_o be_v as_o be_v aforesaid_a and_o continue_v in_o such_o conformity_n according_a to_o the_o true_a intent_n and_o meaning_n of_o the_o say_a statute_n and_o ordinance_n that_o in_o every_o such_o case_n every_o such_o person_n and_o child_n for_o and_o during_o such_o time_n as_o he_o or_o she_o shall_v continue_v in_o such_o conformity_n and_o obedience_n shall_v be_v free_v and_o discharge_v of_o all_o and_o every_o such_o disability_n and_o incapacity_n as_o be_v before_o mention_v and_o be_v it_o further_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n that_o no_o woman_n etc._n stat._n sect._n 8._o no_o woman_n or_o child_n shall_v pass_v over_o the_o sea_n without_o licence_n except_o etc._n etc._n nor_o any_o child_n under_o the_o age_n of_o one_o and_o twenty_o year_n except_o sailor_n or_o ship-boy_n or_o the_o apprentice_n or_o factor_n of_o some_o merchant_n in_o trade_n of_o merchandise_n shall_v be_v permit_v to_o pass_v over_o the_o sea_n except_o the_o same_o shall_v be_v by_o licence_n of_o the_o king_n his_o heir_n or_o successor_n or_o of_o some_o six_o or_o more_o of_o the_o king_n privy_a council_n thereunto_o first_o have_v under_o their_o hand_n upon_o pain_n that_o the_o officer_n of_o the_o port_n that_o shall_v willing_o or_o negligent_o suffer_v any_o such_o to_o pass_v ship_n the_o forfeiture_n of_o the_o officer_n of_o the_o port._n owner_n of_o the_o ship_n or_o shall_v not_o enter_v the_o name_n of_o such_o passenger_n license_v shall_v forfeit_v his_o office_n and_o all_o his_o good_n and_o chattel_n and_o upon_o pain_n that_o the_o owner_n of_o any_o ship_n or_o vessel_n that_o shall_v witting_o or_o willing_o carry_v any_o such_o over_o the_o sea_n without_o licence_n as_o be_v aforesaid_a shall_v forfeit_v his_o ship_n or_o vessel_n and_o all_o the_o tackle_n and_o every_o master_n or_o mariner_n mariner_n master_n and_o mariner_n of_o or_o in_o any_o such_o ship_n or_o vessel_n offend_v as_o aforesaid_a shall_v forfeit_v all_o their_o good_n some_o such_o nobleman_n or_o noblewoman_n or_o gentleman_n or_o gentlewoman_n house_n as_o be_v not_o recusant_n or_o where_o the_o same_o schoolmaster_n shall_v be_v special_o license_v thereunto_o by_o the_o archbishop_n bishop_n or_o guardian_n of_o the_o spiritualty_n of_o that_o diocese_n upon_o pain_n that_o as_o well_o the_o schoolmaster_n as_o also_o the_o party_n that_o shall_v retain_v or_o maintain_v any_o such_o schoolmaster_n contrary_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act_n shall_v forfeit_v each_o of_o they_o for_o every_o day_n so_o witting_o offend_v forty_o shilling_n note_v all_o grammar_n school_n be_v not_o here_o except_v house_n grammar_n school_n gentleman_n house_n but_o only_o public_a or_o free_a grammar_n school_n nor_o yet_o all_o gentleman_n house_n but_o only_o of_o such_o as_o be_v not_o recusant_n in_o both_o which_o respect_v this_o statute_n be_v defective_o recite_v in_o the_o late_a addition_n to_o dalton_n cap._n 87._o tit_n schoolmaster_n sect._n 1_o recover_v stat._n sect._n 10._o the_o forfeiture_n how_o to_o be_v recover_v the_o one_o half_a of_o all_o the_o penalty_n and_o sum_n of_o money_n beforementioned_a to_o be_v forfeit_v to_o be_v to_o the_o king_n his_o heir_n and_o successor_n the_o other_o to_o he_o or_o they_o that_o shall_v or_o will_v sue_v for_o the_o same_o in_o any_o the_o court_n of_o the_o point_n of_o their_o loyalty_n and_o due_a allegiance_n unto_o the_o king_n majesty_n and_o the_o crown_n of_o england_n as_o they_o be_v ready_a to_o entertain_v and_o execute_v any_o treasonable_a conspiracy_n and_o practice_n as_o evident_o appear_v by_o that_o more_o than_o barbarous_a and_o horrible_a attempt_n to_o have_v blow_v up_o with_o gunpowder_n the_o king_n queén_n prince_n lord_n and_o commons_o in_o the_o house_n of_o
parliament_n assemble_v tend_v to_o the_o utter_a subversion_n of_o the_o whole_a state_n late_o undertake_v by_o the_o instigation_n of_o jesuit_n and_o seminary_n and_o in_o advancement_n of_o their_o religion_n by_o their_o scholar_n teach_v and_o instruct_v by_o they_o to_o that_o purpose_n which_o attempt_n by_o the_o only_a goodness_n of_o almighty_a god_n be_v discover_v and_o defeat_v and_o where_o divers_a person_n popish_o affect_v do_v nevertheless_o the_o better_a to_o cover_v and_o hide_v their_o false_a heart_n and_o with_o the_o more_o safety_n to_o attend_v the_o opportunity_n to_o execute_v their_o mischievous_a design_n repair_v sometime_o to_o church_n to_o escape_v the_o penalty_n of_o the_o law_n in_o that_o behalf_n provide_v for_o the_o better_a discovery_n therefore_o of_o such_o person_n and_o their_o evil_a affection_n to_o the_o king_n majesty_n and_o the_o state_n of_o this_o his_o realm_n 2._o stat._n sect._n 2._o to_o the_o end_n that_o be_v know_v their_o evil_a purpose_n may_v be_v the_o better_o prevent_v be_v it_o enact_v by_o the_o king_n most_o excellent_a majesty_n the_o lord_n spiritual_a and_o temporal_a and_o the_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o every_o popish_a recusant_n convict_v or_o hereafter_o to_o be_v convict_v which_o heretofore_o have_v conform_v he_o or_o herself_o or_o which_o shall_v hereafter_o conform_v he_o or_o herself_o and_o repair_v to_o the_o church_n and_o continue_v there_o during_o the_o time_n of_o divine_a service_n according_a to_o the_o law_n and_o statute_n in_o that_o behalf_n make_v and_o provide_v shall_v within_o the_o first_o year_n next_o after_o the_o end_n of_o this_o session_n of_o year_n follow_v at_o the_o least_o receive_v the_o bless_a sacrament_n of_o the_o lord_n supper_n in_o the_o church_n of_o that_o parish_n where_o he_o or_o she_o shall_v most_o usual_o abide_v or_o be_v within_o the_o say_a year_n wherein_o by_o the_o true_a meaning_n of_o this_o statute_n he_o or_o she_o ought_v so_o to_o receive_v yearly_o the_o forfeiture_n of_o a_o conform_a recusant_n which_o do_v not_o receive_v the_o sacrament_n of_o the_o lord_n supper_n yearly_o and_o if_o there_o be_v no_o such_o parish_n church_n then_o in_o the_o church_n next_o adjoin_v to_o the_o place_n of_o he_o or_o her_o such_o most_o usual_a abode_n and_o if_o any_o recusant_n so_o conform_v shall_v not_o receive_v the_o say_a sacrament_n of_o the_o lord_n supper_n according_o he_o or_o she_o information_n that_o the_o defendant_n be_v convict_v in_o due_a form_n of_o law_n and_o the_o defendant_n do_v not_o demur_v thereto_o but_o plead_v not_o guilty_a and_o it_o be_v find_v against_o he_o there_o judgement_n shall_v not_o be_v stay_v for_o this_o defect_n for_o he_o have_v lose_v his_o advantage_n and_o by_o his_o plea_n have_v admit_v the_o point_n of_o conviction_n and_o at_o receive_v threescore_o pound_n note_v the_o statute_n say_v not_o that_o the_o offender_n shall_v forfeit_v for_o the_o first_o second_o and_o three_o offence_n but_o for_o the_o first_o and_o second_o year_n and_o for_o every_o year_n after_o for_o if_o it_o have_v be_v say_v he_o shall_v have_v forfeit_v twenty_o pound_n for_o the_o first_o offence_n forty_o pound_n for_o the_o second_o presentment_n as_o a_o profit_n of_o the_o advowson_n which_o be_v parcel_n of_o the_o manor_n moor_n ibid._n matter_n the_o recusant_n may_v plead_v collateral_a matter_n or_o other_o defect_n whatsoever_o this_o be_v mean_v of_o defect_n within_o the_o indictment_n or_o other_o proceed_n and_o not_o of_o any_o collateral_a matter_n which_o the_o recusant_n have_v to_o discharge_v himself_o
