credit_n it_o be_v only_o to_o show_v he_o have_v his_o clergy_n once_o and_o shall_v have_v it_o no_o more_o the_o allowance_n of_o clergy_n by_o the_o statute_n of_o eliz._n operate_v as_o a_o so_o full_o to_o this_o matter_n that_o i_o think_v it_o ought_v to_o put_v a_o end_n to_o the_o question_n he_o say_v the_o stat._n of_o eliz._n appoint_v the_o burn_a in_o the_o hand_n without_o purgation_n do_v operate_v as_o a_o statute_n pardon_v to_o all_o intent_n and_o purpose_n and_o the_o party_n have_v now_o the_o benefit_n of_o his_o clergy_n allow_v be_v in_o all_o respect_n in_o the_o same_o condition_n as_o if_o he_o have_v be_v acquit_v that_o be_v the_o opinion_n that_o he_o hold_v throughout_o that_o case_n i_o need_v not_o trouble_v your_o lordship_n with_o read_v all_o the_o particular_a word_n that_o he_o use_v but_o only_o those_o which_o relate_v to_o the_o thing_n now_o in_o question_n immediate_o before_o your_o lordship_n he_o deliver_v his_o opinion_n that_o whosoever_o speak_v word_n of_o accusation_n reflect_v upon_o a_o man_n for_o any_o offence_n for_o which_o he_o be_v indict_v and_o convict_v and_o have_v have_v his_o clergy_n allow_v a_o action_n lie_v as_o if_o he_o have_v be_v total_o acquit_v from_o it_o it_o be_v not_o the_o burn_a
in_o the_o hand_n but_o the_o allowance_n of_o clergy_n that_o set_v he_o right_a in_o his_o credit_n in_o the_o eye_n of_o the_o law_n and_o he_o be_v thereby_o in_o the_o same_o condition_n in_o make_v nothing_o for_o though_o it_o be_v a_o case_n where_o the_o hand_n ought_v to_o be_v burn_v yet_o it_o be_v not_o so_o essential_a but_o a_o man_n may_v have_v the_o benefit_n of_o the_o stat._n though_o he_o be_v not_o burn_v the_o king_n may_v pardon_v the_o burn_a for_o the_o burn_v even_o in_o a_o appeal_n be_v no_o part_n of_o the_o judgement_n nor_o so_o much_o as_o in_o the_o nature_n of_o punishment_n but_o rather_o a_o mark_n to_o notify_v that_o he_o may_v have_v his_o clergy_n but_o once_o these_o be_v his_o very_a word_n in_o this_o case_n so_o that_o the_o statute_n of_o queen_n eliz._n do_v abolish_v purgation_n but_o give_v the_o party_n all_o the_o benefit_n thereof_o as_o if_o he_o have_v go_v through_o it_o and_o instead_o of_o deliver_v the_o party_n to_o in_o the_o hand_n it_o add_v be_v burn_v in_o the_o hand_n according_a to_o the_o statute_n in_o that_o behalf_n provide_v by_o the_o statute_n of_o hen._n seven_o he_o be_v first_o to_o be_v burn_v in_o the_o hand_n and_o then_o deliver_v to_o the_o ordinary_a to_o make_v his_o purgation_n but_o by_o the_o statute_n of_o eliz._n he_o be_v first_o pardon_v his_o crime_n by_o be_v allow_v the_o benefit_n of_o his_o clergy_n without_o make_v his_o purgation_n and_o afterward_o to_o be_v burn_v in_o the_o hand_n before_o he_o be_v deliver_v out_o of_o prison_n so_o that_o the_o burn_v in_o he_o intend_v upon_o that_o subject_a under_o the_o title_n of_o clergy_n when_o he_o come_v to_o treat_v of_o the_o consequence_n of_o the_o allowance_n of_o clergy_n and_o what_o the_o several_a effect_n of_o clergy_n allow_v shall_v be_v he_o say_v it_o give_v he_o a_o capacity_n to_o purchase_v good_n and_o retain_v the_o profit_n of_o his_o land_n and_o restore_v he_o to_o his_o credit_n according_a to_o the_o case_n i_o have_v mention_v before_o in_o hobbart_n of_o searle_n and_o williams_n for_o that_o case_n be_v particular_o in_o that_o book_n mention_v and_o refer_v to_o therefore_o i_o hope_v your_o lordship_n will_v make_v no_o difficulty_n of_o hear_v this_o witness_n for_o we_o think_v the_o have_v his_o clergy_n allow_v he_o be_v that_o which_o restore_v he_o to_o his_o credit_n if_o they_o have_v any_o other_o objection_n against_o he_o i_o hope_v we_o shall_v hear_v it_o from_o the_o king_n council_n but_o if_o this_o be_v stand_v upon_o in_o point_n your_o lordship_n will_v not_o let_v this_o noble_a lord_n at_o the_o bar_n suffer_v any_o prejudice_n by_o the_o not_o perfect_v of_o the_o pardon_n by_o actual_a pass_v of_o the_o great_a seal_n l._n h._n st._n mr._n attorney_n general_n what_o say_v you_o to_o the_o matter_n which_o have_v be_v urge_v mr._n at._n gen._n my_o lord_n we_o have_v state_v our_o objection_n we_o think_v there_o be_v afterward_o indict_v and_o three_o be_v try_v and_o find_v guilty_a of_o manslaughter_n and_o upon_o their_o prayer_n have_v their_o clergy_n allow_v and_o the_o burn_a in_o the_o hand_n be_v respite_v but_o not_o pardon_v whether_o any_o of_o the_o three_o can_v be_v a_o witness_n upon_o the_o trial_n of_o either_o the_o other_o two_n sir_n t._n powis_n my_o lord_n with_o submission_n though_o he_o be_v convict_v of_o the_o felony_n yet_o upon_o prayer_n of_o his_o clergy_n that_o be_v allow_v he_o that_o restore_v he_o to_o all_o the_o capacity_n we_o say_v that_o he_o have_v before_o the_o conviction_n and_o particular_o to_o his_o credit_n and_o for_o that_o we_o submit_v our_o solve_n to_o your_o lordship_n judgement_n marq._n of_o hallifax_n i_o suppose_v your_o lordship_n will_v have_v the_o opinion_n of_o the_o judge_n upon_o this_o point_n and_o that_o must_v be_v in_o the_o presence_n of_o the_o prisoner_n l._n h._n st._n it_o must_v certain_o be_v in_o the_o presence_n of_o the_o prisoner_n if_o you_o ask_v the_o judge_n opinion_n marq._n of_o hallifax_n but_o in_o these_o case_n my_o lord_n it_o be_v usual_a to_o hear_v the_o king_n council_n to_o make_v a_o reply_n i_o desire_v to_o hear_v what_o they_o will_v say_v to_o what_o have_v be_v offer_v by_o the_o council_n for_o the_o noble_a lord_n the_o prisoner_n at_o the_o bar._n mr._n serj._n wright_n my_o lord_n i_o do_v apprehend_v that_o the_o very_o state_v of_o the_o objection_n will_v have_v set_v this_o matter_n in_o its_o true_a light_n for_o the_o first_o place_n it_o be_v agree_v either_o be_v pardon_v or_o clergy_n allow_v he_o be_v put_v in_o the_o same_o condition_n as_o if_o he_o have_v be_v acquit_v my_o lord_n i_o must_v admit_v a_o pardon_n restore_v to_o credit_v and_o i_o must_v likewise_o admit_v that_o allowance_n of_o the_o benefit_n of_o clergy_n and_o burn_v in_o the_o hand_n upon_o it_o amount_n in_o law_n to_o a_o pardon_n or_o be_v equivalent_a to_o a_o pardon_n in_o this_o matter_n but_o the_o fact_n here_o be_v not_o so_o for_o here_o be_v neither_o actual_a pardon_n norany_a burn_v in_o the_o hand_n the_o benefit_n of_o clergy_n be_v pray_v and_o allow_v but_o that_o alone_o be_v not_o sufficient_a there_o must_v be_v a_o actual_a burn_v in_o the_o hand_n or_o a_o pardon_n of_o that_o burn_a in_o the_o hand_n otherwise_o it_o can_v be_v a_o satisfaction_n in_o law_n such_o as_o shall_v put_v he_o in_o the_o same_o condition_n as_o if_o he_o be_v acquit_v your_o lordship_n have_v hear_v what_o be_v say_v by_o his_o grace_n my_o lord_n high_a steward_n that_o as_o to_o the_o burn_v in_o the_o hand_n the_o king_n have_v be_v please_v to_o proceed_v so_o
which_o shall_v be_v admit_v and_o allow_v to_o have_v the_o benefit_n or_o privilege_n of_o his_o clergy_n shall_v not_o thereupon_o be_v deliver_v to_o the_o ordinary_a as_o have_v be_v accustom_v but_o after_o such_o clergy_n allow_v and_o burn_v in_o the_o hand_n according_a to_o the_o statute_n in_o that_o behalf_n provide_v mean_v that_o of_o 4_o h._n 7._o shall_v forthwith_o be_v enlarge_v and_o deliver_v out_o of_o prison_n by_o the_o justice_n before_o who_o such_o clergy_n shall_v be_v grant_v that_o cause_v notwithstanding_o then_o there_o follow_v a_o proviso_n to_o this_o effect_n provide_v nevertheless_o and_o be_v it_o enact_v that_o the_o justice_n before_o who_o any_o such_o allowance_n of_o clergy_n shall_v be_v have_v may_v for_o the_o further_a correction_n of_o such_o person_n detain_v and_o keep_v they_o in_o prison_n for_o such_o convenient_a time_n as_o the_o same_o justice_n in_o their_o discretion_n shall_v think_v convenient_a so_o as_o the_o same_o do_v not_o exceed_v one_o year_n imprisonment_n this_o statute_n refer_v to_o that_o of_o h._n 7._o and_o follow_v the_o order_n of_o it_o as_o that_o appoint_v that_o the_o convict_v shall_v be_v burn_v before_o he_o shall_v be_v deliver_v to_o the_o ordinary_a to_o have_v the_o benefit_n of_o purgation_n so_o this_o of_o 18._o el._n appomt_n that_o he_o shall_v be_v burn_v before_o he_o shall_v be_v discharge_v by_o the_o justice_n and_o have_v the_o benefit_n thereby_o intend_v instead_o of_o purgation_n the_o council_n for_o the_o noble_a lord_n at_o the_o bar_n say_v that_o the_o allowance_n of_o clergy_n by_o virtue_n of_o this_o act_n free_v this_o man_n and_o make_v he_o rectus_n in_o curia_n as_o if_o he_o have_v make_v his_o purgation_n and_o that_o by_o this_o statute_n he_o be_v any_o ground_n for_o this_o notion_n in_o this_o statute_n it_o do_v not_o require_v clergy_n to_o be_v allow_v nor_o give_v any_o new_a virtue_n or_o operation_n to_o it_o when_o allowed_n it_o suppose_v such_o a_o thing_n to_o be_v by_o virtue_n of_o the_o common_a law_n but_o there_o it_o leave_v it_o if_o there_o be_v nothing_o more_o do_v it_o be_v one_o clause_n consist_v of_o two_o part_n 1._o negative_a he_o that_o be_v allow_v his_o clergy_n shall_v not_o be_v deliver_v to_o the_o ordinary_a 2._o affirmative_a but_o after_o that_o and_o burn_v in_o the_o hand_n shall_v be_v deliver_v by_o the_o justice_n now_o if_o it_o have_v stop_v at_o the_o first_o part_n it_o have_v be_v so_o far_o from_o pardon_v or_o restore_a any_o clerk_n convict_v that_o it_o have_v put_v all_o into_o the_o same_o condition_n that_o those_o be_v who_o be_v without_o purgation_n viz._n to_o be_v perpetual_o imprison_v and_o infamous_a indeed_o it_o have_v not_o be_v reasonable_a to_o take_v this_o convict_v have_v make_v that_o satisfaction_n to_o the_o law_n he_o may_v have_v be_v a_o witness_n for_o in_o that_o case_n he_o will_v have_v be_v free_v from_o his_o discredit_v by_o virtue_n of_o the_o last_o word_n of_o the_o say_a cause_n it_o be_v true_a the_o word_n be_v only_o shall_v forthwith_o be_v enlarge_v and_o deliver_v out_o of_o prison_n by_o the_o justice_n which_o literal_o import_n nothing_o but_o restore_a his_o liberty_n but_o under_o this_o prime_a instance_n be_v imply_v and_o intend_v all_o other_o particular_n which_o a_o convict_v may_v be_v discharge_v of_o by_o mean_n of_o purgation_n it_o be_v never_o the_o intent_n of_o the_o statute_n mere_o to_o set_v he_o at_o large_a and_o leave_v he_o a_o felon_n convict_v but_o when_o it_o be_v say_v deliver_v it_o be_v mean_v deliver_v free_a free_v from_o all_o incident_a further_a penalty_n as_o he_o may_v have_v be_v if_o deliver_v upon_o purgation_n this_o be_v a_o reasonable_a construction_n but_o i_o take_v it_o to_o be_v otherwise_o a_o convict_v be_v discharge_v from_o imprisonment_n and_o all_o other_o penalty_n incident_a to_o the_o conviction_n forthwith_o upon_o his_o burn_v in_o the_o hand_n but_o if_o there_o be_v a_o commitment_n make_v by_o virtue_n of_o the_o proviso_n it_o be_v a_o collateral_a and_o a_o new_a thing_n and_o the_o party_n be_v not_o then_o in_o prison_n by_o virtue_n of_o his_o conviction_n but_o by_o afresh_o express_v order_n of_o the_o judge_n make_v upon_o the_o heinousness_n of_o the_o circumstance_n appear_v on_o the_o evidence_n they_o may_v
