part_n thereof_o that_o then_o he_o or_o they_o so_o make_v default_n shall_v forfeit_v and_o pay_v the_o double_n and_o wane_v of_o their_o say_a scot_n according_a to_o the_o custom_n of_o romney_n water_n together_o with_o the_o drown_a land_n through_o the_o indraught_n in_o wittersham_n level_n and_o then_o i_o presume_v will_v not_o upon_o mature_a deliberation_n have_v find_v any_o reason_n why_o the_o late_a sommer-land_n shall_v be_v scot_v for_o their_o preservation_n but_o at_o one_o three_o part_n with_o the_o late_o drown_v land_n unto_o the_o say_a work_n and_o indraught_n whereby_o they_o equal_o enjoy_v preservation_n the_o sommer-land_n be_v of_o equal_a yearly_a value_n with_o the_o best_a of_o the_o drown_a land_n and_o of_o much_o more_o than_o a_o considerable_a part_n of_o they_o and_o they_o may_v likewise_o then_o have_v see_v that_o the_o highland_n in_o shirley_n moor_n redhill_n and_o appledore_n issue_n their_o water_n between_o redding_n gutt_n and_o keet_n gutt_n one_o of_o they_o lie_v on_o the_o east_n the_o other_o on_o the_o west_n of_o they_o viz._n above_o and_o belove_v they_o upon_o the_o same_o channel_n and_o must_v have_v benefit_n land_n drown_a land_n and_o sommer-land_n contain_v about_o 5000_o acre_n and_o the_o 1000_o acre_n of_o highland_n shall_v be_v equal_o scot_v to_o the_o charge_n thereof_o when_o as_o it_o appear_v unto_o they_o upon_o their_o view_n and_o be_v apparent_a to_o every_o eye_n upon_o the_o place_n that_o no_o part_n of_o the_o drown_a land_n nor_o the_o twenty_o part_n of_o the_o sommer-land_n sew_v any_o of_o their_o water_n by_o that_o sluice_n or_o channel_n and_o therefore_o by_o the_o law_n and_o rule_n of_o sewer_n be_v not_o to_o be_v scot_v thereunto_o or_o have_v they_o well_o understand_v what_o operation_n and_o effect_n groyn_n and_o obstruction_n make_v in_o a_o salt_n channel_n they_o will_v not_o have_v present_v that_o the_o decay_n of_o that_o sluice_n be_v the_o cause_n that_o the_o slubb_v swerve_v the_o channel_n but_o will_v have_v present_v that_o the_o groyn_n bridge_n and_o obstruction_n make_v in_o the_o channel_n have_v cause_v the_o same_o and_o that_o it_o be_v fit_a to_o have_v they_o remove_v that_o those_o groyne_n and_o obstruction_n have_v cause_v the_o channel_n to_o swerve_v have_v appear_v upon_o several_a view_n of_o the_o commissioner_n and_o it_o be_v further_o manifest_v by_o several_a decree_n which_o be_v hereunto_o annex_v make_v by_o commissioner_n most_o of_o they_o be_v interest_v in_o the_o sommer-land_n and_o have_v be_v remove_v if_o the_o limit_n of_o walland_n marsh_n have_v not_o be_v undue_o enlarge_v to_o oxney_n ferry_n which_o prevent_v the_o same_o as_o your_o lordship_n may_v well_o remember_v my_o lord_n i_o believe_v those_o juror_n to_o be_v man_n of_o integrity_n and_o such_o as_o will_v not_o act_v contrary_a to_o their_o conscience_n but_o they_o be_v man_n and_o may_v err_v in_o
